The meeting was called to order at 6:00 pm. by Alderman Werderich.
Minutes for Approval/Correction: None.
New Business:
1. PS 2010-13 — Police reports for May 2010 — This is an informational item only.
No comments or questions from the committee.
2. PS 2010-14 — Police Department Fleet Update — Chief Hart updated the
committee on the squad car fleet. In the past few years due to cut backs, vehicles
have not been replaced as previously planned. The Chief expressed his concern
with the state of the vehicles. This item is for the City Council attention.
Alderman Werderich suggested that the City Council start planning for this
however he noted that Chief Hart did not bring forward any plan of action. He
asked the Chief how he would rectify the situation. Chief Hart stated that this is
information for the next budgeting process when the department will be asking for
funds to replace squads; two are already on back order. He explained that one
squad has died and been taken to the junk yard recently. Parts from it were used
to fix another car. There was discussion on the type of vehicles that may be
purchased, if the existing vehicles will last until the next budget year,
maintenance costs, moving police funds into the city's general fund, etc. No
action taken — for information only.
3 . PS 2010-15 — Parking at Whispering Meadows Park and Prairie Meadows
Park — Alderman Spears reported that there major safety issues with the parking
at both parks. Residents are parking at both sides of the streets so kids jump out
of cars and dart out. With parking on both sides, other cars cannot pass through.
She stated that is the past she and former Park and Recreation director Mogle
canvassed the area and asked residents if they supported parking on only one side
of Hayden Court. The residents they spoke to supported this during the baseball
season. Signs were supposed to be posted but they never were due to the lack of
funding for the signs. Smith Engineering has allowed people to park in there

parking lot in the past but has stopped doing this. This matter was discussed at
the Park Board meeting. Chief Hart added that Chief Martin always
recommended a parking lot at sites where baseball games are held. Parking on
the streets causes numerous problems such as blocked driveways, congestions,
fender benders, etc. Alderman Spears recommended that in the future when
designing parks, parking is included in the park design. Alderman Werderich
suggested leaving this matter at the committee level until Administrator Olson can
give a report of the Park Board's discussion however it was the consensus of the
committee to move this on to the City Council meeting.
This item moved on to the July 13, 2010 City Council—regular agenda.
Old Business•
1. PS 2010-11 —Parfection Park—Discussion
Alderman Werderich gave Alderman Gilson the floor on this item as he was not
present at the last Public Safety Committee meeting where the issue of golf balls
damaging homes was discussed. Alderman Gilson expressed his displeasure that
the item was placed on the agenda for discussion however proper staff is not
present to give their opinions. Residents already expressed their concerns at the
last Public Safety Committee meeting and carne to this meeting to hear the city's
position on this matter. If the appropriate staff could not be present,he felt it
would have been nice to have been informed so that resident's would not have has
to come out again. He did not know what could be accomplished tonight.
Alderman Gilson had asked clarification on a code that applied to this matter.
Alderman Werderich and Alderman Munns agreed with Alderman Gilson; they
thought staff would be present for discussion.
Alderman Werderich opened the floor open for committee input. Alderman
Spears asked about the clarification of code. Alderman Gilson stated that
Administrator Olson was unsure if a city code on the books pertained to this
matter. Administrator Olson advised the committee at the last meeting that he
would get an official opinion and bring it back to the committee for this
discussion. Alderman Spears explained to Mr. Schalhamer from Parfection Park
(who was not present at the previous meeting) that staff was suppose to be
investigating if the golf balls from his driving range fell under the city's nuisance
ordinance.
Alderman Werderich opened the floor to Mr. Schalhamer who expressed his
concern that if this is deemed a nuisance where would it stop? He felt next it
could his lights, noise, etc. He stated that he is concerned with safety. He stated
that he sent a letter last meeting to be proactive in protecting the neighbors. He
outlined in the letter what he was going to do to correct the situation and has
implemented the outline. He has also planted more trees along the tree line
between the park and the homes. He does not want to put up netting. He wanted
to know how many complaints were received versus the cost of the netting. He
stated that the problem started when Nancy Grunstad's window was broken. He
explained he got in the middle of it but the golfer did pay for her window. He
reminded everyone that his business was present before the homes were built. He

expressed his frustration when he learned of last month's meeting just hours
before it was to take place. He was unable to attend.
Alderman Werderich opened the floor to the public. One resident noted that due
to technology over the past ten years, the balls are traveling further. He stated that
he did not want the balls in his yard; he had two this week. He stated that at the
last meeting, affected residents brought in 100 to 200 golf balls they collected
from outside the park, on their property. Other residents added their experiences
of getting balls hit into their yard.
Alderman Gilson read from Mr. Schalhamer's letter stating a low number of
complaints have been received. He stated that just with the residents present
tonight, there have been more balls reported in the last month. He stated that the
problem seems not to be as rare as it is being portrayed. If a ball hits someone it
will be a different story.
Ms. Grunstad noted that there has been more property damage than reported.
Residents have experienced damage to their house dining but never complained.
When her window broke, she had enough of being "a good neighbor".
Alderman Spears noted that the discussion and decision on this matter is difficult.
People moved next to a golf range. She stated she would like to see the neighbors
and the business work together to solve the problem. The residents present were
not open to this as it is projectiles coming into their yards. There was a brief
discussion of possible solutions, liability, etc.
Alderman Werderich asked for direction from the committee. It was the
consensus to get more information from the staff (Legal and Building & Zoning)
and bring the matter back to the committee.
Additional Business
Tree Removal
Alderman Spears stated that there is a large tree in her area that is hanging after the storm
last night and she asked if anyone know of a reputable tree removal business. Alderman
Plocher gave her information.
Affects of Storm
Chief Hart reported on the numerous calls due to the storm last night as well as the
damage to property. There were no injuries. Kendall County is presently at 85 severe
weather warnings as compared to a total of 120. KenCom and BKFD suffered lightening
strikes and are having problems with their systems.
Administrative Hearing Process
Alderman Werderich expressed his concern with the Administrative Hearing process. He
stated that during the hearing for the nuisance tickets for the Hammon property, Mr.
Hammon showed up with an attorney and the city did not have legal representation. He
felt this was a hole in the process. Chief Hart stated that it was a Building & Zoning
Department ticket and the police department has given the Building Department training
since then. Alderman Spears stated that she attended the hearing and the city looked
foolish. Staff was not prepared and Administrator Olson got up and presented the city' s

side after the matter was closed. Alderman Plocher asked how much money does the city
want to "throw" for a $75.00 ticket. The committee briefly discussed the matter.
There was no further discussion.
Alderman Werderich entertained a motion to adjourn. So moved by Alderman Spears;
seconded by Alderman Munns.
Motion approve unanimously by a viva voce vote.
The meeting was adjourned at 6:55 p.m.

Subject: 2008 Traffic Stop
Consider this correspondence a formal request for an investigation into the release of Yorkville
Police Department property to the public. The property in question is a 2008 traffic stop video.
On May 14, 2008 at 0717hrs, I was the subject of a traffic stop conducted by Officer M. Carlyle
of the Yorkville Police Department by for a seat belt violation. I was driving my Kendall County
Sheriff's Office assigned vehicle a maroon Chevy Impala bearing Illinois registration 206 7457.
The stop occurred on Route 126 just east of Route 71 .
The traffic stop in question has been posted on Todd Milliron's website more commonly known
as the Yorkville Insider (www.yorkvilleinsider.org). Since this video had no evidentiary value,
this video per the City of Yorkville policy should have been placed back in rotation. At the time
of the incident, the traffic stop in question was FOIA'd by the Kendall County Record
Newspaper and a copy was also distributed Kendall County Sheriff Richard Randall for his
investigation into the matter.
On Thursday, August 12, 2010, 1 had a conversation with Kathy Farren owner and editor of the
Kendall County Record. Mrs. Farren remembered the FOIA and the incident and stated that she
did not distribute the video to any outside party. She further stated that she would check with her
reporter Tony Scott to verify that he had not distributed said video. Mrs. Farren went on to say
that, her newspaper did not print a news article about the traffic stop because she did not think it
was news worthy. On Friday, Mrs. Farren confirmed that Tony Scott did not distribute the video
to anyone else.
On Friday, August 13, 2010, Operation Commander Phil Smith of the Kendall County Sheriff's
Office had a conversation with your Deputy Chief Dave Delany. Deputy Chief Delany relayed
to Commander Smith that on the Yorkville Police Department dissemination form that relate to
the traffic stop only indicate that the video was properly released twice. Once on a FOIA request
to the Kendall County Record and the other to Richard Randall, Sheriff of Kendall County.
I am requesting a thorough investigation be conducted into any possible criminal and/or
administrative rules violation by any City of Yorkville employee and/or official. Not only as a

fellow law enforcement executive but also as a resident of the City of Yorkville I am deeply
disturbed that Yorkville Police Department property was distributed either illegally and/or
improperly to the public. I am personally troubled that this Yorkville Police Department
property has ended up on a politically motivated website owned and operated by County Board
candidate Todd Milliron whose cause is being supported by Mayor Valerie Burd. Attached you
find an informational letter from me that was drafted in 2008 after I was informed of the FOIA
from the Kendall County Record. At that time, I did not distribute the letter because of the
Kendall County Record not finding the event to be news worthy.
Chief Hart I think it goes without saying the magnitude of the civil jeopardy this places upon the
City of Yorkville Police Department. Nevertheless, I want to assure you that the Kendall County
Sheriff s Office will continue as always to have a great professional working relationship with
the Yorkville Police Department.

On May 14, 2008, at 0717 ho irs I was the victim of an erroneous traffic stop
conducted by the Yorkville Police Department on Route 126 for a "seatbelt
violation".
First and foremost, let me sta .e that I do not perceive myself to be "above the
law" by any stretch of the imz gination , Secondly, I admit that I was a bit strong
in confronting the Yorkville 01 Icer for the alleged violation, to which I apologized
for. As the radio personality I laul Harvey says: here's the "rest of the story".
The Kendall County Sheriff's Office is notified every time one of our department
issued license plates are run. jAt the time of the traffic stop, I had recently been
informed that the registration Ifor my assigned vehicle had been run three times
as follows:

March 23, 2008 at 0902 hours by Yorkville Police Department
April 4, 2008 at 1252 hours by Yorkville Police Department
May 6, 2008 at 1005 hours by' Yorkville Police Department
Out of the 52 vehicles assigned to the Kendall County Sheriff's Office, my
registration was the only plat that was run by Yorkville Police Department.
On May 14, 2008, at 0717 hoylrs, I was on my way to a law enforcement
meeting in the City of Joliet. � was traveling eastbound on Route 126 in between
Route 47 and Route 71 . The posted speed limit in this area is 50 MPH . I was
traveling in a line of cars, all v�I(ithin the posted speed limit and was, as always,
wearing my seatbelt. I obseNred on the north side of the roadway on a gravel
access drive, a Yorkville squad car parked perpendicular to the roadway
observing traffic. The Yorkville. squad was at minimum 30-35 feet from my lane
of traffic.
As I approached the stoplight intersection of Route 126 and Route 71, I
observed in my rearview mirror that the Yorkville squad was now behind me. As
the light changed green, the li;ne of cars continued eastbound on Route 126.
Several hundred feet past thelintersection, the Yorkville squad in question
activated it overhead lights. Ie, as well as the two cars in front of me, did not
know who the officer was trying to stop. I slowed down and pulled onto the
shoulder and the Yorkville squad pulled in behind me. I then activated my
emergency lights in my unmarked car so that the officer would be aware of my
identity as a law enforcement officer. I took off my seatbelt and exited the

vehicle. This is where the DWR clearly shows the seatbelt retracting into the
roof pillar.
I was a bit perplexed as to wiry I had been stopped, when I had clearly not
violated any Illinois Vehicle Cclde. When I exited the vehicle and confronted the
officer as to the reason for the traffic stop, he stated that I was not wearing my
seatbelt. As clearly shown oni the DVR, I was wearing my seatbelt and this
unjustifiable traffic stop, coup ed with the fact that Yorkville Police Department
has recently been running only the plates on my assigned car, did perturb me to
say the least.
I do admit that I spoke strongly to the Yorkville Officer, that I regret, but please
understand the mitigating circumstances surrounding this unwarranted traffic
stop. I have been a law enforcement officer for over 32 years. In my current
position as a law enforcement, executive, I certainly understand good, aggressive
police work. _ There is, however, truly a difference between being assertive and
conducting "fishing expeditions".
We, at the Kendall County Sheriff's Office, also do seatbelt enforcement. We feel
that the most appropriate location to observe seatbelt enforcement is at check
points such as a stop sign int4rsection, not on a 50 MPH stretch of roadway, 35
feet way from the motoring public.
I feel that if I had been "Joe Citizen" of Yorkville, I probably would have been
issued a citation . I am a resident of Yorkville and would like to be proud of the
Yorkville Police Department. hief Martin, Sheriff Randall and I have met and
talked about the situation andl consider this matter closed.
On a final note, Officer Carlylo had applied previously at the Kendall County
Sheriff's Office and been de*d employment.

neighborhood electric vehicles use of City streets. We are allowed under the Act to permit their
use on, and across, certain City streets.

Be it enacted by the People of the State of Illinois,
{ represented in the General Assembly:
Section 5 . The Illinois Vehicle Code is amended by changing
Sections 1 - 148 . 3m, 11 - 1426 . 1 , and 11 - 1426 . 2 as follows :
( 625 ILCS 5 / 1 - 148 . 3m )
Sec . 1 - 148 . 3m . Neighborhood vehicle . A self-propelled,
electric -powered , four-wheeled motor vehicle ( or a
self-propelled , gasoline -powered, four-wheeled motor vehicle
with an engine displacement under 1 , 200 cubic centimeters ) that
is capable of attaining in one mile a speed of more than 20
miles per hour , but not more than 25 miles per hour , and which
does not conform e _ q to federal regulations under Title 49
C . F . R . Part 571 . 500 .

Sec . 11 - 1426 . 1 . Operation of non-highway vehicles on
streets , roads , and highways .
( a ) As used in this Section , " non-highway vehicle " means a
motor vehicle not specifically designed to be used on a public
highway , including :
( 1 ) an all - terrain vehicle , as defined by Section

1 - 101 . 8 of this Code ;
( 2 ) a golf cart , as defined by Section 1 - 123 . 9 ;
( 3 ) a neighborhood vehicle , as defined by Section
1 - 148 . 3m ; a-Ffd
( 4 ) an off-highway motorcycle , as defined by Section
1 - 153 . 1 ; and —
( 5 ) a recreational off-highway vehicle , as defined by
Section 1 - 168 . 8 .
(b ) Except as otherwise provided in this Section , it is
unlawful for any person to drive or operate a non -highway
vehicle upon any street , highway , or roadway in this State . If
the operation of a non-highway vehicle is authorized under
subsection ( d ) , the non-highway vehicle may be operated only on
streets where the posted speed limit is 35 miles per hour or
less . This subsection (b ) does not prohibit a non-highway
vehicle from crossing a road or street at an intersection where
the road or street has a posted speed limit of more than 35
miles per hour .
(b- 5 ) A person may not operate a non-highway vehicle upon
any street , highway , or roadway in this State unless he or she
has a valid ! 114:ns=s driver ' s license issued in his or her name
by the Secretary of State or by a foreign jurisdiction .
( c ) Except as otherwise provided in subsection ( c-5 ) , no
person operating a non-highway vehicle shall make a direct
crossing upon or across any highway under the jurisdiction of
the State , tollroad, interstate highway , or controlled access

highway in this State .
( c - 5 ) A person may make a direct crossing at an
intersection controlled by a traffic light or 4 -way stop sign
upon or across a highway under the jurisdiction of the State if
the speed limit on the highway is 35 miles per hour or less at
the place of crossing .
( d ) A municipality , township , county , or other unit of
local government may authorize , by ordinance or resolution , the
operation of non-highway vehicles on roadways under its
jurisdiction if the unit of local government determines that
the public safety will not be jeopardized . The Department may
authorize the operation of non-highway vehicles on the roadways
under its jurisdiction if the Department determines that the
public safety will not be jeopardized . The unit of local
government or the Department may restrict the types of
non-highway vehicles that are authorized to be used on its
streets .
Before permitting the operation of non-highway vehicles on
its roadways , a municipality , township , county, other unit of
local government , or the Department must consider the volume ,
speed , and character of traffic on the roadway and determine
whether non-highway vehicles may safely travel on or cross the
roadway . Upon determining that non-highway vehicles may safely
operate on a roadway and the adoption of an ordinance or
resolution by a municipality , township , county , or other unit
of local government , or authorization by the Department ,

appropriate signs shall be posted .
{I If a roadway is under the jurisdiction of more than one
unit of government , non-highway vehicles may not be operated on
the roadway unless each unit of government agrees and takes
action as provided in this subsection .
( e ) No non-highway vehicle may be operated on a roadway
unless , at a minimum , it has the following : brakes , a steering
apparatus , tires , a rearview mirror , red reflectorized warning
devices in the front and rear , a slow moving emblem ( as
required of other vehicles in Section 12 - 709 of this Code ) on
the rear of the non-highway vehicle , a headlight that emits a
white light visible from a distance of 500 feet to the front , a
tail lamp that emits a red light visible from at least 100 feet
from the rear , brake lights , and turn signals . When operated on
a roadway , a non -highway vehicle shall have its headlight and
tail lamps lighted as required by Section 12 - 201 of this Code .
( f ) A person who drives or is in actual physical control of
a non-highway vehicle on a roadway while under the influence is
subject to Sections 11 - 500 through 11 - 502 of this Code .
( g ) Any person who operates a non -highway vehicle on a
street , highway , or roadway shall be subject to the mandatory
insurance requirements under Article VI of Chapter 7 of this
Code .
( h ) It shall not be unlawful for any person to drive or
operate a non-highway vehicle , as defined in paragraphs ( 1 ) and
( 5 ) of subsection ( a ) of this Section , on a county roadway or

township roadway for the purpose of conducting farming
operations to and from the home , farm , farm buildings and any
adjacent or nearby farm land .
Non-highway vehicles , as used in this subsection ( h ) shall
not be subject to subsections ( e ) and ( q ) of this Section .
However , if the non -highway vehicle , as used in this Section
is not covered under a motor vehicle insurance policy pursuant
to subsection ( g ) of this Section , the vehicle must be covered
under a farm, home , or non-highway vehicle insurance policy
issued with coverage amounts no less than the minimum amounts
set for bodily injury or death and for destruction of property
under Section 7 -203 of this Code . Non -highway vehicles operated
on a county or township roadway at any time between one -half
hour before sunset and one-half hour after sunrise must be
equipped with head lamps and tail lamps , and the head lamps and
tail lamps must be lighted .
Non-highway vehicles , as used in this subsection ( h ) shall
not make a direct crossing upon or across any tollroad
interstate highway , or controlled access highway in this State .
Non-highway vehicles , as used in this subsection ( h ) shall
be allowed to cross a State highway , municipal street county
highway , or road district highway if the operator of the
non -highway vehicle makes a direct crossing provided :
( 1 ) the crossing is made at an angle of approximately
90 degrees to the direction of the street , road or highway
and at a place where no obstruction prevents a quick and

safe crossing ;
( 2 ) the non-highway vehicle is brought to a complete
stop before attempting a crossing ;
( 3 ) the operator of the non-highway vehicle yields the
right of way to all pedestrian and vehicular traffic which
constitutes a hazard ; and
( 4 ) that when crossing a divided highway , the crossing
is made only at an intersection of the highway with another
public street , road , or highway .
( i ) No action taken by a unit of local government under
this Section designates the operation of a non-highway vehicle
as an intended or permitted use of property with respect to
Section 3 - 102 of the Local Governmental and Governmental
Employees Tort Immunity Act .

prohibit , by regulation , ordinance , or resolution , the
operation of low- speed vehicles on streets under its
jurisdiction where the posted speed limit is 30 miles per hour
or less if the Department of Transportation or unit of local
government determines that the public safety would be
jeopardized .

( e ) If a street is under the jurisdiction of more than one
unit of local government , or under the jurisdiction of the
Department of Transportation and one or more units of local
government , low- speed vehicles may be operated on the street
unless each unit of local government and the Department of
Transportation agree and take action to prohibit such operation
as provided in this Section .
( f ) No low- speed vehicle may be operated on any street
unless , at a minimum , it has the following : brakes , a steering
apparatus , tires , a rearview mirror , red reflectorized warning
devices in the front and rear , a headlight that emits a white
light visible from a distance of 500 feet to the front , a tail
lamp that emits a red light visible from at least 100 feet from
the rear , brake lights , and turn signals . When operated on a
street , a low- speed vehicle shall have its headlight and tail
lamps lighted as required by Section 12 -201 of this Code . The
low- speed vehicle shall also have signs or decals permanently
and conspicuously affixed to the rear of the vehicle and the
dashboard of the vehicle stating " This Vehicle May Not Be
Operated on Streets With Speed Limits in Excess of 30 m . p . h . "
The lettering of the sign or decal on the rear of the vehicle
shall be not less than 2 inches in height . The lettering on the
sign or decal on the dashboard shall be not less than one -half
inch in height .
( g ) A person may not operate a low- speed vehicle upon any

street in this State unless he or she has a valid driver ' s
license issued in his or her name by the Secretary of State or
a foreign jurisdiction .
( h ) The operation of a low- speed vehicle upon any street is
subject to the provisions of Chapter 11 of this Code concerning
the Rules of the Road, and applicable local ordinances .
( i ) Every owner of a low- speed vehicle is subject to the
mandatory insurance requirements specified in Article VI of
Chapter 7 of this Code .
( j ) Any person engaged in the retail sale of low- speed
vehicles are required to comply with the motor vehicle dealer
licensing , registration , and bonding laws of this State , as
specified in Sections 5 - 101 and 5 - 102 of this Code .
( k ) No action taken by a unit of local government under
this Section designates the operation of a low- speed vehicle as
an intended or permitted use of property with respect to
Section 3 - 102 of the Local Governmental and Governmental
Employees Tort Immunity Act .

As you may be aware, there is a fihn studio in Chicago that is looking to film a couple
scenes on public and private property within the City limits of Yorkville. The City currently has
no permit governing such a request, which is an issue, as major filming operations can require a
significant police presence. Also, a permit allows the staff a point of contact within the filming
group.

I have attached to permits and supplemental information from Chicago, Lockport and
Lemont. Each City charges only $25 for a permit fee, but charges hourly and daily rates for
street closures, use of public property and police security detail.
I recommend that the Public Safety Committee approve a $25 permit fee, in an
application similar to Lockport' s with the procedures and standards policy from Lockport
included as an addendum to the permit. I ask that the Public Safety Committee review the
procedures and standards policy and recommend changes.

CITY OF LOCKPORT
PROCEDURES AND STANDARDS
FOR COMMERCIAL FILMING AND TAPING
The following guidelines establish the required procedures and standards for use of City streets,
rights-of-way, and public buildings, and for use of City equipment and personnel, for the filming
or taping of movies, television programs, commercials, or training films, and for related
activities.
The City Administrator may authorize the use of any street, right-of-way, or public building, or
the use of any City equipment or personnel, for the filming or taping of movies, television
programs, commercials, or training films, or for related activities. The City Administrator may
require compliance with any or all of the standards, and payment of the fees, specified herein as
conditions on such authorization.
The following standards shall apply to filming and taping, as required by the City Administrator:
I. NOTICE TO AFFECTED PROPERTY OWNERS
Prior to any authorization hereunder for any filming or taping, the applicant shall notify all
property owners in the affected neighborhood, as defined by the City Administrator but
including at least all properties within 250 feet of each filming or taping location, about the
filming or taping. The notice shall include a short description of the proposed project and the
filming or taping schedule. The applicant shall file with the City a report noting any reaction
received from any property owner and the addresses and telephone numbers of all property
owners notified. Such report shall be delivered to the office of the City Administrator prior to
any authorization hereunder for any filming or taping. No filming or taping shall be allowed in
any location where more than one-third of the property owners within the affected neighborhood
file written objections to such filming or taping with the City Administrator within five days
after receipt of the notice provided hereunder.
II. CITY CONTROL
The City shall have, and every applicant hereunder shall acknowledge that the City has full
control over the use of City streets and public buildings in the City.
III. RIGHT TO PROHIBIT OR HALT
The City Administrator shall have, and the City reserves, the right to prohibit all filming or to
halt any filming in progress if such filming is determined by the City Administrator in his or her
sole discretion to pose a threat to the public health, safety, or welfare.
IV. INSPECTIONS

The City Administrator may require, and every applicant hereunder shall agree to allow,
appropriate City officials to inspect any structure or device or equipment used in connection with
any filming or taping.
V. HOURS; LOCATION
The City Administrator may prescribe such rules, as he or she deems appropriate and necessary
regulating the hours of filming and taping and the general locations of the filming and taping.
No filming or taping shall be undertaken between 8:00 p.m. and 8:30 a.m. except with the prior
approval of the City Administrator. Only one filming or taping production shall be authorized in
the City on any day.
VI. SPECIFIC PERIODS
Every authorization granted pursuant to these guidelines shall be for specific dates and time
periods established by the City Administrator. No filming or taping shall exceed 6 productions
or 10 production days, whichever is less, in any one location in any calendar year, except with
the prior approval of the City Administrator.
VIL REPORT ON VEHICLES AND EQUIPMENT
The applicant shall provide a report listing the number of vehicles and types of equipment to be
used during the filming or taping, including the proposed hours of use and proposed parking
locations. All such parking locations shall be reviewed and approved by the City Administrator
prior to their use.
VIII. APPLICATION FEE
Every applicant hereunder shall sign the application form provided by the City and submit it to
the City, together with a $25 nonrefundable application fee, at least one week in advance of the
desired date for commencement of any filming or taping. The City Administrator may waive
this fee for non-profit organizations.
The City will require the filming company to pay a per week administrative/public land use fee
of $ 100.00. The fee will be paid in advance in an amount equal to 200% of the company' s
projected timetable for working in Lockport. Upon completion of the filming, the balance of the
unused fee will be returned. Payment must be made by check that will be cashed and cleared
before filming begins.
IX. USE OF CITY EQUIPMENT AND PERSONNEL

The applicant will agree to pay for the costs of any Police, Public Works, or other City personnel
assigned to the project (whether specifically requested by the producer or not). Remuneration
rates for the use of City equipment, including Police squad cars, will be established on a case-by-
case basis. The applicant will agree to pay in full, promptly upon receipt of an invoice, the
charges incurred.
The City Administrator has the authority to require additional police coverage if it is determined
to be in the best interest for public safety. Off-duty police officers are to be paid one and one-
half their hourly rate based on their rank.
X. USE OF CITY PROPERTY
The City Administrator may authorize the use of any street, right-of-way, or public building,
equipment or personnel for commercial uses in the filming or taping of movies, television
programs, commercials, or training films and related activities. In conjunction with these uses,
the City Administrator may require that any or all of the conditions and/or renumeration as
specified on the application be met as a prerequisite to that use.
Depending upon the extent of the use of City property, the producer agrees to reimburse the City
for inconveniences when using public property. Following is the rate schedule:
A. Total or disruptive use (regular operating hours) $500 per day
of a public building:
B. Partial non-disruptive use of a public building: $250 per day
C. Total closure of public street or right-of-way: $50 per hour
D. Partial closure or obstruction of public street $25 per hour
or right-of-way:
E. On-site City Police or Community Service $50 per hour

The applicant agrees that the City of Lockport shall have full control over the use of the public
streets and buildings of the City while being used, as well as control over the hours of production
and the general location of the production. The City reserves the full and absolute right to
prohibit all filming or to order cessation of filming if determined to be hazardous to the public
health, safety and welfare.
XI. CERTIFICATE OF INSURANCE

The producer shall attach a certificate of insurance, naming the City of Lockport as an additional
insured. Minimum General Aggregate shall be no less than $2,000,000, business automobile
liability (if applicable) in an amount not less than $ 1 ,000,000 combined single limit per accident
for bodily injury and property damage. The producer shall also attach proof that the appropriate
worker's compensation and employer's liability insurance have been provided for the employees
of the filming company.
XII. HOLD HARMLESS AGREEMENT
The producer shall sign the following hold harmless agreement with the City of Lockport
holding the City harmless from any claims that may arise from their use of designated public
property, right-of-way, or equipment in conjunction with the permitted use.
I certify that I represent the firm that will be performing the filming/taping at the
locations specified on the attached permit application. I further certify that I and my
firm will perform in accordance with the directions and specifications of the City of
Lockport, and that I and my firm will indemnify and hold harmless the City of Lockport
for and from any loss, damage, expense, claims and costs of every nature and kind
arising out of or in connection with the filming/taping pursuant to this permit.
The applicant shall comply with all of the procedures and standards established in the City's
Guidelines for Filming, as interpreted and applied by the City Administrator.
Without limiting the foregoing, the applicant shall pay all fees assessed by the City
Administrator pursuant to the Guidelines and shall reimburse the City for all costs and expenses
incurred by the City related to any filming or taping activity undertaken by the applicant.
The producer or representative shall sign this application and shall submit it to the City
Administrator or his designee, for consideration prior to any production activity taking place.
The City Administrator or his designee shall sign this application only on favorable
consideration of the terms herein. If approval is given, a signed copy will be given to the
producer or representative.

Hotel Class Liquor Category
We have received an inquiry from a hotel who would like to apply for a city liquor license.
Currently, the city code does not have a hotel liquor license class. Since the hotel does not have
a restaurant located within, they are unable to apply for a restaurant class license.
Staff is requesting approval of a new liquor license category for hotels/motels as follows:
H — Hotel/Motel.
a. Authorizes the licensee to sell beer, wine and liquor for consumption on the premises
where sold. This shall include all banquets, conventions, meetings, group dining
services, catering, lobby and meeting room service.
b. Authorizes the licensee to charge by the drink or cover the drink charges under the
hotel fees.
c. Authorizes the licensee to serve beer and wine only, for consumption by patrons of a
hotel on the premises of a hotel (manager's reception) with a limit of a no more than
two drinks per hotel patron per day.
d. Authorizes the licensee to place small, locked refrigerated units containing alcoholic
beverages (commonly referred to as "mini-bars") in the guest rooms. Keys for said
units may only be provided to hotel guests who are at least twenty-one (21) years of
age.

As part of creating a hotel class license, staff recommends that the following paragraph of the
liquor code be amended to remove the word hotel from this paragraph.
Unless the context otherwise requires, the words "beer", "alcoholic liquor", "original
package", "retailer", "club", "hotel". "to sell", "sale" and "sell at retail" shall have the
same meanings and definitions as said words have and are defined in an act relating to
alcoholic liquors, approved January 31 , 1934, as amended.
Staff recommends adding the following definition of hotel:
Hotel/Motel means every building or other structure, kept, used, maintained, advertised
and held out to the public to be a place where food is served and consumed and sleeping
accommodations are offered for pay to travelers and guests, whether transient, permanent
or residential, in which twenty-five (25) or more rooms are used for sleeping
accommodations and where dining rooms are maintained in the same building or
buildings.
Ordinance No. 2010-
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS, PROVIDING FOR LIQUOR CONTROL
WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality in
accordance with the Constitution of the State of Illinois of 1970 and has the powers granted to it by law;
WHEREAS, the Liquor Control Act of 1934, 235 ILCS 511 - 1 , et seq., (the "Liquor Control
Act") sets forth a comprehensive system for the regulation of liquor control within the state of Illinois,
and authorizes broad powers to municipalities with regard to local retail licenses; and
WHEREAS, the City Council of the United City of Yorkville has determined that it will
promote the public health, safety and welfare, and that it is in the best interests of the City to amend the
regulations pertaining to the sale of liquor as set forth in the City Code of the United City of Yorkville as
set forth herein.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City
of Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 3 , Chapter 3, Section 1 of the United City of Yorkville Code of Ordinances is
hereby amended by deleting paragraph A in its entirety and replacing it with the following:
A. Unless the context otherwise requires, the words "beer", "alcoholic liquor", 'original
package", "retailer", 'club", "to sell", "sale" and "sell at retail' shall have the same
meanings and definitions as said words have and are defined in an act relating to
alcoholic liquors, approved January 31 , 1934, as amended'. (Ord. 1979- 16A, 9-27- 1979;
amd. Ord. 1996-1 , 1 -11 - 1996)
Section 2. Title 3, Chapter 3, Section 1 of the United City of Yorkville Code of Ordinances is
hereby amended by adding the following definition in alphabetical order and renumbering all definitions
thereafter:
"Hotel/Motel" means every building or other structure, kept, used, maintained, advertised
and held out to the public to be a place where food is served and consumed and sleeping
accommodations are offered for pay to travelers and guests, whether transient, permanent
or residential, in which twenty-five (25) or more rooms are used for sleeping
accommodations and where dining rooms are maintained in the same building or
buildings.
Section 3. Title 3 , Chapter 3, Section 4, Subsection (A)(4) of the City Code is hereby amended
by adding the following:
H — Hotel/Motel.

Section 4. Title 3 , Chapter 3, Section 5, Subsection (B)(4) of the City Code is hereby amended
by adding the following:
H — Hotel/Motel — Beer, Wine and Liquor $2000.00
Section 5. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.
