Sincerely 7r- Chief Michael Hitzemann INTERGOVERNMENTAL AGREEMENT FOR FIRE PREVENTION CODE ENFORCEMENT THIS AGREEMENT made and entered into as of , 2010, by and between the United City of Yorkville, an Illinois municipal corporation (the "City") and the Bristol-Kendall Fire Protection District, a body corporate and politic (the "District"). WITNESSETH: WHEREAS, Article VII, Section 10 of the Illinois Constitution of 1970 authorizes units of local government to obtain or share services and to exercise, combine or transfer any power or function, in any manner not prohibited by law or ordinances; and, WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 22013, provides that any power or powers, privileges, functions, or authority exercised or which may be exercised by a public agency may be exercised, combined, transferred and enjoyed jointly with any other public agency of the State except where specifically and expressly prohibited by law; and, WHEREAS, the District has heretofore adopted a Fire Prevention Code in and for the District, a copy of which is attached hereto as Exhibit A and incorporated herein by reference; and, WHEREAS, the City has adopted the District's Fire Prevention Code in order to permit the District to apply its standards within the boundaries of the City as hereinafter set forth; and, WHEREAS, the District employs personnel who are able to perform the inspection services necessary to enforce the District's Fire Prevention Code and review services to ensure compliance with said Fire Protection Code; and, 1 WHEREAS, the City desires to have the District perform such inspection services as are necessary for the proper enforcement of the Fire Prevention Code as hereinafter provided and to provide review services; and, WHEREAS,the City has previously instituted an administrative adjudication process for the enforcement of local ordinances and codes; and, WHEREAS, the District and City desire to work together to ensure compliance with fire codes and building codes that are parallel to national standards. NOW, THEREFORE, in consideration of the foregoing recitals and of the covenants and conditions hereinafter contained, the adequacy and sufficiency of which the parties hereto hereby acknowledged,the parties hereto mutually agree as follows: 1. The District shall conduct such inspections as the District deems necessary to enforce the provisions of the District's Fire Prevention Code, and any and all amendments or revisions thereto, within the common boundaries of the District and the City. The District shall report the results of these inspections to the City in writing. 2. The District shall, upon the request of the City, perform plan review services in addition to such inspection services and provide all equipment that may be necessary for provisions of review services and the performance of such inspections and the proper enforcement of the District's Fire Prevention Code, within the common boundaries of the District and the City. 3. It is expressly agreed by the Parties hereto that the inspection and review services provided for in this Agreement shall be made at no cost to the City; however, any fees collected by the District in connection with its inspection and/or review services from 2 property owners shall benefit the District. A copy of the inspection and review services fee schedule as attached hereto as Exhibit B to this Agreement. 4. The City shall make available to the District all available plans, specifications, and such other data and information in the possession of the City as may be necessary for the performance of the District's inspection services or review services under this Agreement. 5. The City shall be responsible for the prosecution of any and all citations of the Fire Prevention Code and Building Code (as applicable). The District agrees to provide assistance and testimony when necessary in any court cases prosecuted by the City. The Parties agree to split the revenues of any fines collected through the City's administrative adjudication process; 75% City portion and 25% District portion. 6. The City shall make reasonable arrangements with the District to assist the District in the performance of the plan review and inspection services provided herein. The number of inspections required at any time, the inspection assignments and the shifts to be worked shall be determined by the District. 7. Either party may terminate this Agreement at any time effective at the end of any calendar month, provided, however, that the party desiring to terminate this Agreement shall give sixty (60) days prior written notice to the other party specifying the end of the month on which the termination is to be effective. 8. This Agreement shall be effective upon the last date of execution of the Agreement by the final party hereto. 9. The District agrees to hold harmless, indemnify and defend the City from any and all claims, demands, liabilities and suits in law or in equity that may arise from or out of 3 the District's performance under this Agreement. The City agrees to hold harmless, indemnify and defend the District from any and all claims, demands, liabilities and suits in law or in equity that may arise from or out of the City's performance under this Agreement. 10. This Agreement shall be binding upon and inure to the benefit of any successor governmental legal entity that may assume and perform the duties of either party hereto. Notwithstanding the foregoing, this Agreement shall not be assigned by either party hereto without the prior written consent of the other party to this Agreement. 11. The invalidity of any provisions of this Agreement shall not impair the validity of any other provisions. If any provision of this Agreement is determined by a court of competent jurisdiction to be unenforceable, that provision shall be deemed severed from this Agreement or as otherwise modified by the court. 12. This Agreement sets forth the entire understanding of the parties, and may only be amended, modified or terminated by a written instrument signed by the parties. 13. This Agreement shall be interpreted and construed in accordance with the laws of the State of Illinois. 14. A fee of$100.00 shall be paid for the review of a sprinkler system in occupancies where the sprinkler system requires changes due to alterations or a change of occupant. Standpipe System Review Fee: Any applicant for a building or structure having (or required to have) a standpipe system shall pay to the District the following fees, in addition to the other fees set forth herein, for performing standpipe system plan review and inspections: a. At this point in time, it is possible for the Yorkville Police Department to provide the policing services to the Village of Newark as explained in the following. POLICE PATROL. The Yorkville Police Department would provide an average of approximately five (5) hours per day of guaranteed policing patrol in Newark. The assigned officer would use a squad car provided by Newark, which includes gasoline and maintenance. For the periods where there cannot be an officer assigned specifically in Newark, we would treat it as we would a subdivision in town. This entails an officer driving through the area in a Yorkville squad car performing patrol duties. We would also be providing all community services to Newark that are provided to Yorkville residents. Included services would be Senior Services, special events/details (high school events), extra patrols/watches, and community events. Other services that will be extended to Newark would be the availability of the Major Crimes Task Force, Special Response Team, and CPAT services. Note that Newark residents would have access to policing services 24 hours a day, seven days a week, including 9-1-1 emergency services. REPORTING AND INVESTIGATIONS. Included in our proposal would be taking police reports, investigative follow-up services (Detectives being assigned to cases) on said reports, UCR reporting and all other state-mandated reporting and requests (i.e. FOIA requests and accident reporting). City attorneys for both entities will have to meet and come to terms on an intergovernmental agreement. This would also include adopting the Administrative Adjudication process, and holding said processes for Newark under our current system in Yorkville. This would include adopting similar ordinances for the adjudication process. One of the issues that would have to be worked out with the entire process would be if Newark needed their own citations/forms (i.e. state citations, ordinance citations, reporting forms, etc.); or if Yorkville officers could use current forms. A request from the Village of Newark is that we enter into a ten-year intergovernmental agreement. This is not saying the cost per year will be set at $60,000 each year; however, this is another term that will have to be factored into the proposal and negotiated through attorneys/administration. A final point would be factoring in how much of a percentage Yorkville would receive on Newark citations (both state and local ordinances), as well as costs for paper forms and citations. FINAL RECOMMENDATION. At this point in time, it is our recommendation that the United City of Yorkville enter into formal negotiations for an intergovernmental agreement providing police services to the Village of Newark. Current Policing in Newark Currently Newark is patrolled by the Kendall County Sheriff's Office. The deputies work in Newark as an over time detail separate from regular patrol duties. Newark budgeted $63,825.00 for the fiscal year 2009/2010 to pay for police salaries, there is a separate line item for vehicle maintenance and gas. The deputies who work the detail are paid directly by the Village of Newark; they make $30.00 an hour. The detail is considered outside employment, but the deputy's liability and insurance are covered by the Sheriff's Office while working the detail. Scheduling for the detail is completed by a patrol sergeant. The shifts are varied in length by day and there are more hours worked in some months than in others (adjusting for busy times). The deputies drive the Newark squad car (owned by Newark) from the Sheriff's Office to Newark to work the detail. The Sheriff's Office sets up the servicing of the squad car, but Newark pays for it. The Sheriff's Office treats Newark as any other unincorporated area when calls for service come in when there is no deputy working the detail. The Sheriff's Office provides Newark with full police service as needed. A deputy also attends their monthly Village Board council meetings. Yorkville P.D. Patrol Possibilities I would recommend the following if Yorkville were to come to an agreement to take over police services in Newark. The day shifts in Yorkville have 4 officers and a sergeant assigned to them, while the night shifts have 3 officers and a sergeant. The traffic unit has 2 officers and they work varied hours. The shift minimum is currently 3 officers. We could provide about the same amount of patrol time in the Newark squad car that the Sheriff's Office provides by placing an officer in the Newark car for 3 to 4 hours a day for at least 4 or 5 days out of the week. We would only have an officer in the Newark car when we have full shifts on days or when a traffic car is available during the night shift. When shifts are short we would treat Newark as we would treat a subdivision. We would have the area car drive thru Newark at least 2 or 3 times during a shift. We would treat any extra watches or problem areas the same as we would in Yorkville. In comparison Newark is very similar to the Fox Hill subdivision. Fox Hill has 436 residences to Newark's 354 residences and businesses. The call volume and reports are much higher in Fox Hill when compared to Newark. On average our emergency and non-emergency response time to Newark would be similar or faster than the current response time by the Sheriff's Office. The Sheriff's Office patrol area that covers Newark extends all the way to south/east corner (Minooka) and the north/west corner (Little Rock) of the county. If the Yorkville area car that covered Newark kept beat integrity they would be closer than most County cars are to Newark when they are not in the village limits. We would also be able to provide the same investigative, evidence, DARE, and community policing services to Newark as we do in Yorkville. We could have officers present at special events such as festivals, parades, school events, and so on. One of the Lieutenants could also attend the monthly village board meetings and public safety meetings. Newark could also adopt similar ordinances to ours and then we could come to an agreement for Newark to use our adjudication process. Special Note While speaking with the village board president, board members, and residents about this study I was greeted with enthusiasm and eagerness to have Yorkville take over the police responsibilities. One of the biggest concerns expressed by all that I spoke to was what would happen if Yorkville took over police services and then later stopped providing police services? They feel that the once an agreement was made with Yorkville that the Sheriff's Office would never agree to provide police services again and that Newark would have to create their own police department, which would be very expensive. The Village planning area also extends into Mission Township on the eastern edge of LaSalle County. Newark is approximately 55 miles west of Chicago's Loop, and ten miles west of Yorkville, on Route 71. The Fox River is approximately 1.5 miles north of Newark. The intersection of Rte. 71 and Newark Road is most descriptive of Newark's location. The town is accessible by Newark Road, Fox River Drive and Town- house Road, all being County roads. In addition, Chicago Road and Fennel Road are in Fox Township, with Crimmins Road and Sandhill Road being Big Grove Township roads. The nearest towns are Millington, 1 mile to the north; Millbrook, 6 miles to the northeast; Sheridan, 6 miles to the northwest; Sand- wich, 8 miles to the north; Plano, 8 miles to the northeast; Lisbon, 8 miles southeast; Yorkville, 10 miles northeast; and Morris, 17 miles to the southeast. Some towns, such as Yorkville to the northeast, Sandwich to the north and Plano to the northeast of the Village, have plans to grow towards Newark. Boundary agreements with the above men- ,,g tioned towns and the Village of Sheridan to the northwest will be especially important to acquire in the near future. Having such boundary agreements will be especially helpful in slowing down the potential competition for land between communities. Currently, a boundary agreement exists between the Villages of Newark and Millington. See the Ex- isting Conditions Plan at the back of this report for further detail. .T�1i`%TIC %0#9 The Village corporate area totals approximately 714 acres. A 1.5-mile plan- ning jurisdiction area surrounding Newark is defined on the Existing Condi- tions Plan at the back of this report. Newark has the authority to plan future growth within this planning jurisdiction area. This area encompasses ap- proximately 4,805 acres of predominantly rural farmland interspersed with residential and commercial development at the core of the village. The Newark jurisdictional planning area contains portions of several govern- mental units. The area lies within both Fox and Big Grove Township in Kend- all County and Mission Township in LaSalle County. Local roads, totaling 9.35 miles are also owned and maintained (snowplowing included) by the Village. The Village operates a water treatment system. Two deep wells supply all of Newarks water. One of the wells is located near the water tower and can pump 100 gpm. The tower can hold 50,000 gallons of water. The other well is in Puckerville south end of Newark and has a capacity to pump 200 - � w ( ) P Y gpm.A tank on-site can hold 6,000 gallons in reserve. The Village draws about 2-3 million gallons of water per year, or 70,000 gallons per day. The Newark Sanitary District has a wastewater treatment facility directly north of town. This facility is functioning at "near capacity" levels. The current facility planning area (FPA) boundary for the district is just one half mile outside the Village of Newark's corporate boundary. Encourage the expansion of forest preserve land nearby. • PLANNED GROWTH - Recognize that growth is inevitable and that the Village must be in control to ensure maximum quality. Create a quality of life in Newark that makes it a desirable community to live work and play, by retaining the rural character and preserving natural features in the area. • SMALL TOWN CHARACTER - Preserve the existing small town character in town. New architecture and landscape must be compatible with the existing rural character. • MUNICIPAL FACILITIES - Encourage new elementary schools to be locat- ed in the neighborhoods. Commit to keeping municipal buildings in the town center, such as the library, post office, village hall, etc. • WALKABILITY - Require new walkable residential neighborhoods that connect to each other as well as to as many village amenities as possible, such as the library, churches, schools, parks, and shopping. • DIVERSE HOUSING TYPES - Provide a variety of housing types, sizes and selling costs. Ensure that a diverse mix of economic levels is able to purchase/rent in town. Provide both affordable housing and senior hous- ing as very important components in the housing mix. • NEW COMMERCIAL - Provide adequate retail and service space to meet the commercial needs of the future population and the potential tourists. Allow mixed use buildings within the historic core of town. • NEW INDUSTRY - Attract other industrial businesses to town in strategic locations near Route 71 and Fennel Road and Rte 71 and Newark Road. Plan on providing future industrial sites as close to the Prairie Parkway/ Route 71 intersection as possible, if and when it is constructed. • AGRI-BUSINESS - Save agricultural land by retaining the existing agri- business in the Newark area and plan for agri-tourism. Use conservation easements to protect agricultural land from development whenever pos- sible. • TRANSPORTATION - Provide an efficient and well-maintained system of roads that is as pedestrian friendly as possible.
