As you know, the COPS Office received an overwhelming response to last year's COPS Hiring Recovery Program (CHRP) grant solicitation, and as such carried over more than 6,000 unfunded CHRP applications j into FY 2010 in anticipation of additional hiring funding. A total of 4,423 agencies requesting approximately $2 .28 billion chose to complete updates to their 2009 CHRP applications to be considered for the $298 million available under CHP in 2010. Due to the high demand and limited funding available, only 379 CHP requests were ultimately funded, which is about 8% of the total number of eligible CHP applications submitted to COPS ., We regret to notify you that your proposal was not among those selected. ' I With an abundance of quality CHP grant requests, funding selections for this announcement were based upon a variety of factors, including (but not limited to) statutory mandates which govern how CHP and other COPS hiring funds are to be allocated, as well as each applicant's fiscal health, UCR-reported crime, and community policing information. For more information on the CHP program, and a more detailed description of how applications were evaluated, please visit the "Grants & Funding" page on the COPS Office website at btlp://www.cops.usdoj . pov/Default. ap?ltem=46. Please be advised that as of today' s date, we do not know what amount of hiring funds will be appropriated to the COPS Office iu FY 2011 . However, should additional funds be made available, we anticipate offering a new solicitation for funding, and expect to further emphasize community policing as an integral part of COPS hiring grant funding. Any oils , antifreeze , grease deposits , ect . shall also be covered by applicable materials so not to present any further danger to the motoring public . i 6 Towing Roster Application 02- 12-2010 Police Vehicle Towing and Storage : Towing agency will provide towing services to the Yorkville Police Department at .no charge to the city . These tows may consist of squad car tows , vehicles towed for evidentiary purposes or vehicles seized and impounded . In addition , the towing agency will not charge the Yorkville Police Department for vehicles stored as a result of any of the above mentioned types of towing situations . Towing agency shall not allow anyone to photograph , examine or remove any articles from an impounded vehicle without the express permission of the Chief of Police or his designee . Any vehicle which is on hold status due to an open investigation or evidentiary purposes , as indicated on the police department 's Tow Form , will not have storage fees applied until 24 hours after its release from police hold . In case of an error b the Yorkville Police Department in towing a vehicle or when Y p 9 extenuating circumstances exist, the towing agency will cancel all charges to the vehicle owner at the request of the Yorkville Police Department . LIGHT DUTY: Involving vehicles up to , and including , ten thousand ( 10 , 000 ) pounds GVWR. MEDIUM DUTY: Involving vehicles from ten thousand one ( 10 , 001 ) pounds up to, and including , twenty-six thousand (26 , 000) pounds GVW R. NORMAL BUSINESS HOURS : Licensee towing businesses shall have normal business hours of at least Monday through Friday eight o'clock (8 : 00) a . m . to six o'clock (6 : 00) p . m . , except for official City of Naperville holidays as set forth in Section 1 -5-4- 1 of this Code. POLICE TOW : A tow requested by the Naperville Police Department for: 1 . Vehicles that are disabled where the person in charge of the vehicle has no preference for any particular tow service or is unable to make such decision . 2 . City owned vehicles . 3 . Vehicles impounded by the Naperville Police Department for evidentiary, investigative or seizure purposes , or arrests . 4 . Abandoned vehicles that are towed pursuant to Naperville Police Department procedures . 5 . Illegally parked vehicles that pose a traffic hazard . Specifically excluded from this Article is the moving by tow truck, of vehicles within , or from one City lot to another for purposes related to auctioning or seizure . POLICE TOWING LICENSE : A license issued by the City of Naperville authorizing a person or firm to engage in the business of vehicle towing at the request of the Naperville Police Department . POLICE TOWING LICENSEE : A person or firm engaged in the business of, or offering the services of, vehicle towing whereby motor vehicles are or may be towed or otherwise relocated from one place to another, or serviced on scene, by use of a tow truck, and by request of the Naperville Police Department and approved by the Naperville Police Department. POLICE TOWING LICENSEE LIST : A list maintained by the Naperville Police Department containing the names of those licensees approved by the Chief of Police to respond to requests by the Naperville Police Department for the towing of vehicles . STANDBY: When a licensee is called out and the tow driver is asked by police or fire personnel to wait at the scene before the tow driver can start the requested service . TOW DRIVER: An agent that works for a licensee, driving or operating a tow truck, or working at the scene of a license call . TOW TRUCK: As defined in the Illinois Vehicle Code, 625 Illinois Compiled Statutes 5/1 -205 . 1 , as amended . UNCLAIMED VEHICLE : Vehicles that have been towed by a licensee to their storage lot and have not been picked up or disposed of by their owner. UPRIGHTING : Bringing a vehicle that is either overturned or on its side to the upright position to tow. WINCHING : Bringing a vehicle that is completely off of the road surface onto the road surface for the purpose of towing . (Ord . 05- 088, 6-7-2005) 11 -5A-2 : - APPLICATION FOR POLICE TOWING LICENSE : Any person/business desiring to perform police towing work at the request of the Naperville Police Department shall submit an "application for police towing license" to the Chief of Police. Application forms may be obtained from the Naperville Police Department. The tow license application period will be from September 15 to September 30 of each year, with the licenses issued for a period from January 1 to December 31 . Each licensee applying must have a completed and correct application returned to the Naperville Police Department by three o'clock (3 :00) p .m . September 30 , or the next business day where September 30 falls on a weekend or holiday. There will be a maximum of eleven ( 11 ) police tow licenses for the light duty tow list and five (5 ) police tow licenses for the medium and heavy tow lists issued pursuant to Section 11 -5A-4 of this Article. (Ord. 05-232, 11-15-2005) No person shall be approved as a licensee or a tow driver, nor shall any licensee knowingly permit such a person to be a tow driver pursuant to a license call who: 1 . Has any felony conviction within the last five (5) years in any State; or 2. Is a sex offender, as defined in Illinois law, 730 Illinois Compiled Statutes 150/2 , as amended ; or 3. Has been convicted under the laws of Illinois or any other state of an offense that under the laws of the State of Illinois would be a felony theft of a vehicle or vehicle parts. (Ord. 05.088, 6.7-2005) 11 -5A-3 : - INVESTIGATION AND APPROVAL : By November 15 of each year, after receiving a complete application for a police towing license, the Naperville Police Department will conduct an investigation to determine the truth and accuracy of the information contained in said application . The Naperville Police Department will also check to determine whether the location(s) meets applicable zoning and fire code requirements. The towing equipment and business will be inspected. Upon completion of the investigation , the applicant will be notified in writing that the application is either approved or disapproved and if disapproved the notification will state the reasons for such disapproval . 1 . Reasons for disapproval include , but are not limited to , the following : 1 . 1 . The applicant has furnished false or misleading information or has failed to provide relevant information on the application . 1 .2. The applicant has not obtained insurance as required by this Article . 1 .3. I The location(s) where the applicant will conduct business fails to meet applicable zoning and/or fire codes or the requirements of Section 11 -5A-11 , "Storage Facility", of this Article. 1 .4. The applicant or any of the owners/partners have been permanently removed from the police towing licensee list for cause pursuant to Section 11 -5A-9, "Removal From Police Towing Licensee List" , of this Article. 1 . 5. The applicant does not meet all of the requirements of this Article or the towing license agreement. (Ord. 05-088, 6-7-2005) i 2. Any applicant deemed ineligible by the Chief of Police will have the right to appeal the Chief of Police's decision to the City Manager, or designee. Appeals must be made by filing a written notice of appeal with the City Manager within ten ( 10) days of notice of the Chief of Police's decision . The City Manager will hear the appeal within fourteen ( 14) days after the appeal is filed , unless otherwise agreed . The City Manager will notify the applicant of the decision within seven (7) days after the decision is made. The City Manager may affirm or overrule the Chief of Police's decision . The City Manager's decision will be final . 3. After the investigation and approval process have been completed , a final eligibility list will be created for use in issuing police towing licenses. (Ord. 05-232, 11-15-2005) 11 -5A-4: - TOW LICENSE LIMIT: 1 . The City of Naperville will limit the number of police tow licenses that it issues to the following three (3 ) lists: 1 . 1 . Light duty: Eleven ( 11 ) licenses; 1 .2. Medium duty: Five (5) licenses; 1 .3. Heavy duty: Five (5 ) licenses. (Ord. 05-232, 11-15-2005) i 2. Preference in issuing the licenses will be given to those companies that were issued a license the prior year, as long as they still meet the criteria for the issuance of a license set forth in Section 11 -5A-3 of this Article. Even if issued a police tow license the prior year, all persons/businesses wishing to retain such license must submit a renewal application pursuant to Section 11 -5A-2 of this Article for the subsequent year. 3. After the deadline for submitting applications, an initial eligibility list will be created . The first names on the initial eligibility list will be those firms that held a license the previous year, as long as they have submitted a renewal application . The remainder of the initial eligibility list will be filled with the remaining applicants, through a drawing . (Ord. 05-088, 6-7-2005) i 4. The final eligibility list will be used at the beginning of and throughout the term of the tow license year, in numeric order, for the issuance of licenses base don the investigation and approval pursuant to Section 11 -5A-3 of this Article, and with the aforementioned limit of licenses. (Ord. 05-232, 11-15-2005) 5. The date , time , and location of the drawing will be announced at the time the application period begins. All interested parties will be allowed to attend the drawing . (Ord. 05-088, 6-7-2005) I 11 -5A-5 : - INSURANCE : I 1 . The licensee will obtain and maintain general liability, automobile liability, garage keeper's legal liability and workers' compensation insurance throughout the period of the agreement as determined by the City of Naperville and written in the towing license agreement. 2. The City will be named as an additional insured by the licensee on each insurance policy. 3. The licensee will provide certificates of insurance to the City which indicate coverage for the above mentioned insurance , which carries the provision that said insurance will not be canceled without giving the City at least thirty (30) days' notice of cancellation or material change . (Ord. 05-088, 6-7-2005) 11 -5A-6 : - DUTIES AND REQUIREMENTS OF LICENSEE AND TOW DRIVERS : 1 . All applicants issued a license , and their agents, will enter into a towing license agreement with the City, with separate signatures for each licensee and agent. The written agreement will be in a form approved by the City Attorney. 2. Each licensee will defend , indemnify and hold harmless the City, the City Council , and City officers and employees, from any suits, claims, or actions brought, or disease or illness or damages sustained or arising out of the operation of towing services and storage of vehicles and arising out of the performance of any requirement of this Section by the licensee or in consequence thereof. 3 . All tow trucks shall have working two-way communication equipment with their base station located at the point where calls are received . 4. All tow trucks (except flatbed car carriers) shall carry at least one set of wheel dollies at all times. 5. All licensees shall be able to safely transport motorcycles. 6. Each licensee shall provide 24-hour per day service each day of the year. There shall be an attendant or answering service on duty at all times for the purpose of receiving calls, and there shall be a person on call at all times for the purpose of releasing stored vehicles or for receiving vehicles. Prior to the release of a license towed vehicle, the licensee shall contact the Naperville Police Department's communications center of the release of said vehicle . 7. All tow trucks shall be equipped with warning lights and all other equipment required by federal , State or City laws . 8. Licensees must immediately, and in writing , inform the Naperville Police Department regarding any changes of the information on their original application for license. Failure to comply with this requirement may constitute grounds for removal from the police towing licensee list. (Ord. 05.088, 6-7-2005) 9. Licensees on the light duty tow list must maintain at least two (2) operational tow trucks at all times. However, all tow operators either currently on the City's police towing licensee list or with a pending application for the police towing licensee list having only one tow truck are exempt from this requirement for three (3) years until June 7 , 2008 . The exempt tow operators are B&L Auto Body, White Eagle Auto Body, and Kit's Classic Towing . Beginning on June 7 , 2008, B&L Auto Body, White Eagle Auto Body, and Kit's Classic Towing must maintain at least two (2 ) operational tow trucks at all times without exception and consistent with this Section and meet all other eligibility requirements for a license as set forth herein . (Ord. 05-138, 7-19.2005) 10. Every licensee or tow driver shall remove or cause to be removed all glass and debris deposited on any street or highway by the vehicle being serviced . The licensee or tow driver shall also spread oil-dry upon that portion of any street or highway where any fluids have been deposited by the vehicle being serviced , unless the Fire Department has taken charge of the cleanup , at which point the licensee will follow the instructions of Fire Department personnel regarding cleanup. 11 . While at the scene of any call for a license tow, every license tow driver will wear safety apparel compliant with the class 2 or 3 standard of the International Safety Equipment Association standard : ANSI/ISEA 107-2004 (as amended) standard for high visibility safety apparel , as appropriate to the task being performed and the conditions present. 12. While at the scene of any call for a license tow, every license tow driver will wear outer apparel that clearly identifies the company for which they work and the tow driver's first name . The name of the tow driver shall be on the front of their apparel . This identification must be able to be read by a person with normal vision at a distance of at least ten ( 10) feet. This identification can be incorporated into the requirement for high visibility safety apparel . 13. No licensee or tow driver shall respond to a license call for service while having any alcohol , controlled substances , or both in their system . They shall also not have prescribed or over the counter medication in their system that renders them incapable of safely driving or operating the tow truck. 14. All licensees shall comply with Section 11 -5A-11 , "Storage Facility", of this Article . 1 15. Tow drivers are not allowed to be on duty for more than one tow company at any one time. (Ord. 05.088, 6-7-2005) 11 -5A-7 : - OPERATION OF POLICE TOWING LICENSEE LISTS : I 1 . The City of Naperville Police Department will maintain three (3) police towing licensee lists, as follows: 1 . 1 . Light duty. 1 .2. ; Medium duty. _ 1 .3. Heavy duty. 2. The Naperville Police Department will ensure that licensees are called in rotation as far as is reasonable and practicable. Except upon request of the owner, operator or person legitimately in possession of the vehicle to be serviced , the Naperville Police Department will not call any tow truck not on the police towing licensee list unless all such licensees are unavailable . 3. The Naperville Police Department may deviate from the order of normal rotation if, in the Naperville Police Department's judgment, deviation is necessary to protect the public health , safety, and/or welfare or to ensure proper traffic, incident, or accident management. The Naperville Police Department may also deviate from the order of normal rotation if the licensee next on rotation is, in the Naperville Police Department's sole discretion and judgment, incapable or improperly equipped for handling a specific task. 4. If a licensee is unable to respond to a request for service within the time frames required in the towing license agreement, the licensee or their employee shall advise the Naperville Police Department that they are not available due to an extended response time . The licensee will then be placed at the bottom of the list. No substitute tow company or licensee will be allowed . The police telecommunicator will then call the next licensee on the list. 5. When a request for service is canceled after being dispatched off the police towing licensee list, the licensee will be put back at the top of the list. 6. The City reserves the right to terminate or modify its license procedure unilaterally at any time without any notice and without recourse. (Ord. 05.088, 6-7-2005) 11 -5A-8 : - LICENSE NONTRANSFERABLE : Any license granted pursuant to this Article shall be personal to the individual or entity to whom issued and may not be transferred to any other person or entity. Such license shall not be sold , leased , transferred , assigned , or otherwise disposed of, either in whole or in part, whether by forced sale, merger, consolidation , bankruptcy, reorganization under bankruptcy laws, or otherwise, without reapplication pursuant to Section 11 -5A-2 of this Article . (Ord. 05-088, 6-7-2005) 11 -5A-9 : - REMOVAL FROM POLICE TOWING LICENSEE LIST : 1 . Removal Of Licensee: The Chief of Police , or designee, may remove any licensee temporarily or permanently when it is determined that: 1 . 1 . The license was secured by fraud or concealment of a material fact, which if known would have caused disapproval of the application . 1 .2. The licensee has violated any of the provisions of this Article, or the Naperville Police Department towing license agreement. 1 .3. The service provided by the licensee has been substantially inadequate, which shall include, but not be limited to, failing to be available for or not accepting calls, slow response time , excessive damage claims, theft, repeated complaints from citizens, inadequate services or towing equipment. 1 .4. During the term of the license, any licensee or a tow driver: 1 .4. 1 . Is convicted of any felony in any State ; 1 .4. 2. Is determined to be a sex offender, as defined in Illinois law, 730 Illinois Compiled Statutes 150/2 , as amended ; or 1 .4. 3. Is convicted under the laws of Illinois or any other State of an offense that under the laws of the State of Illinois would be a felony theft of a vehicle or vehicle parts. 2. Temporary Removal : If the removal of the licensee from the police towing licensee list is temporary, such temporary removal shall not be for more than thirty (30 ) days at any one time. 3. Pending Suspension/Removal : If the Chief of Police, or designee , determines the alleged offense does not constitute an immediate threat to the health , safety or welfare of the public, the Chief of Police shall provide the licensee with written notice at least fifteen ( 15) days prior to the effective date of the temporary or permanent removal by delivering said notice to the licensee's place of business. Said written notice shall include: 3. 1 . The effective date of the removal . j 3.2. Whether the removal is temporary or permanent. 3 .3. The allegations which form the basis of the removal . 3.4. The actions, if any, the licensee may take to prevent the removal from occurring . 3. 5. The procedure that the licensee must follow to request a hearing to appeal the removal . 4. Immediate Suspension/Removal : 4. 1 . If the Chief of Police , or designee, determines that a licensee presents an immediate threat to the health , safety or welfare of the public, or if the licensee has not provided proof of valid insurance in the amounts required by ordinance, the Chief of Police shall provide the licensee with written notice that the licensee is being removed from the police towing licensee list immediately. Said written notice shall be delivered to the licensee's place of business on the first day the removal is effective, and shall state : 4. 1 . 1 . That the removal is effective immediately. 4. 1 .2 . Whether the removal is temporary or permanent. 4. 1 .3. The allegations which form the basis of the removal . 4. 1 .4. The actions, if any, the licensee may take to be reinstated . 4. 1 . 5. The procedure that the licensee must follow to request a hearing to appeal the removal . 4.2. If a hearing is requested , the City Manager, or the City Manager's designee shall act as the Hearing Officer. The hearing shall be informal and provide both sides with the opportunity to present all evidence relevant to the removal . The Hearing Officer shall issue a written decision based upon a preponderance of the presented evidence within seven (7 ) days of the hearing . The opinion shall be sent to the licensee's business address, with a copy retained in the licensee's application file at the Naperville Police Department. If the decision favors the licensee, the Hearing Officer shall notify the Naperville Police Department so that license towing privileges may be reinstated as soon as possible. I The City or the licensee may contest the decision of the Hearing Officer in any manner provided by law. 5. Method Of Requesting Hearing : A licensee must request a hearing by calling the City Manager's office within ten ( 10) days of receiving a notice of suspension or removal and scheduling a hearing . Leaving a message with the City Manager's office will not satisfy this requirement. The City Manager's office must provide a time for the hearing that is within seventy-two (72) hours of the request, provided there is one complete business day within the 72-hour time period . If there is no complete City business day in the 72-hour period , the hearing shall be held on the first City business day after the 72-hour time period . If j the licensee is unavailable at the time provided by the City, the City shall not be bound by the 72-hour time period and the removal will not be stayed . If the City is unable to provide a hearing time within the applicable time period , all action on the removal shall be stayed until the hearing . (Ord. 05-088, 6-7-2005) 11 -5A-10 : = ALLOWABLE FEES : The fee structure shall be adjusted annually based on the U .S . Department of Labor, Consumer Price Index (CPI ). This calculation will be done yearly at the time the application period starts. Each fee shall be calculated and adjusted separately. The calculation will be cumulative each year but adjustments to the fees contained herein will only be made in increments of five dollars ($5 .00) and rounded down to the nearest five dollars ($5 .00), except for mileage and accident cleanup fees which will be rounded down to the nearest one dollar ($ 1 .00). Yearly adjusted rates, subsequent to the year 2005 , will be contained within the Naperville Police Department towing license agreement. No licensee shall impose any fee not specifically provided for below for any tow performed pursuant to a police towing license . 1 . ! Charges for license tow services shall be on invoice forms provided by the City, which shall include the rate structure currently in effect. A copy of the completed invoice shall be provided to the Naperville Police Department and the owner of the vehicle serviced . (Ord. 05-088, 6-7-2005) 11 -5A-11 : - STORAGE FACILITY : 1 . Each licensee shall maintain a secure storage lot of adequate size to store all towed vehicles safely, but in no event shall the capacity be smaller than twenty (20) vehicles. For the purpose of this Section one vehicle shall equal one hundred twenty ( 120) square feet (eight (8) feet X fifteen ( 15) feet). Said lot shall be completely enclosed by a fence not less than six (6) feet in height and shall have a lockable and securable gate. All storage facilities must meet applicable zoning and fire code requirements. A clearance of at least twenty-four (24) inches must be maintained around all vehicles in licensee's storage lot. 2. The licensee shall maintain an office at said storage lot that is staffed and open to the public during normal business hours. 3. The storage lot for light duty tows shall be located within the planning boundary of Naperville or within one and one-half (1 ") miles of the City limits of Naperville. 4. The storage lot for medium duty tows and heavy duty tows shall be located within the planning boundary of Naperville or within fifteen ( 15) miles of the City limits of Naperville . 5. When instructed by the Naperville Police Department that a vehicle in storage must be secured from tampering , the operator shall store said vehicle so that it is not accessible to any person except upon specific approval of the Naperville Police Department. The licensee will not allow anyone but Naperville Police Department personnel to access the vehicle . This storage will be at the licensee's storage facility and can be within the fenced lot or within a building at the storage lot, at the discretion of the licensee. (Ord. 05-088, 6-7-2005) 11 -5A-12 : - INSPECTIONS : The Naperville Police Department shall conduct an inspection of all licensees at least annually. This inspection shall include the vehicles used by the licensee for license tows and service calls . It will also include the physical location of the business and any place where license vehicles are stored , all records associated with license calls, a check of employees for criminal and traffic records, and anything else related to the license as deemed appropriate. (Ord. 05-088, 6-7-2005) 11 -5A-13 : - VIOLATION AND PENALTY : Any person who shall violate any of the provisions of this Article shall , upon conviction thereof, be fined not less than one hundred dollars ($ 100 .00) and not more than one thousand dollars ($ 1 ,000 .00) for each offense . Up for consideration is whether we want to permit neighborhood electric vehicles use of City streets . Be it enacted by the People of the State of Illinois , represented in the General Assembly : Section 5 . The Illinois Vehicle Code is amended by changing Sections 1 - 148 . 3m , 11 - 1426 . 1 , and 11 - 1426 . 2 as follows : ( 625 ILCS 5 / 1 - 148 . 3m ) Sec . 1 - 148 . 3m . Neighborhood vehicle . A self -propelled , electric -powered , four - wheeled motor vehicle ( or a self - propelled , gasoline -powered , four - wheeled motor vehicle with an engine displacement under 1 , 200 cubic centimeters ) that is capable of attaining in one mile a speed of more than 20 miles per hour , but not more than 25 miles per hour , and which does not conform ees to federal regulations under Title 49 C . F . R . Part 571 . 500 . i ( Source : P . A . 96 - 279 , eff . 1 - 1 - 10 . ) I ( 625 ILCS 5 / 11 - 1426 . 1 ) Sec . 11 - 1426 . 1 . Operation of non - highway vehicles on streets , roads , and highways . ( a ) As used in this Section , " non - highway vehicle " means a motor vehicle not specifically designed to be used on a public highway , including : ( 1 ) an all - terrain vehicle , as defined by Section Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b 1 - 101 . 8 of this Code ; ( 2 ) a golf cart as defined b Section 1 - 123 . 9 • g y , ( 3 ) a neighborhood vehicle , as defined by Section 1 - 148 . 3m ; ( 4 ) an off - highway motorcycle , as defined by Section ' 1 -. 153 . 1 ; and - ( 5 ) a recreational off - highway vehicle , as defined by Section 1 - 168 . 84 ( b ) Except as otherwise provided in this Section , it is I unlawful for any person to drive or operate a non - highway vehicle upon any street , highway , or roadway in this State . If the operation of a non - highway vehicle is authorized under subsection ( d ) , the non - highway vehicle may be operated only on I streets where the posted speed limit is 35 miles per hour or less . This subsection ( b ) does not prohibit a non - highway vehicle from crossing a road or street at an intersection where the road or street has a posted speed limit of more than 35 miles per hour . ( b - 5 ) A person may not operate a non - highway vehicle upon any street , highway , or roadway in this State unless he or she has a valid Ta driver ' s license issued in his or her name by the Secretary of State or by a foreign -jurisdiction . ( c ) Except as otherwise provided in subsection ( c - 5 ) , no person operating a non - highway vehicle shall make a direct crossing upon or across any highway under the jurisdiction of the State , tollroad , interstate highway , or controlled access Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b highway in this State . ( c - 5 ) A person may make a direct crossing at an intersection controlled by a traffic light or 4 -way stop sign upon or across a highway under the jurisdiction of the State if the speed limit on the highway is 35 miles per hour or less at the place of crossing . ( d ) A municipality , township , county , or other unit of local government may authorize , by ordinance or resolution , the operation of non - highway vehicles on roadways under its i jurisdiction if the unit of local government determines that the public safety will not be jeopardized . The Department may authorize the operation of non - highway vehicles on the roadways under its jurisdiction if the Department determines that the public safety will not be jeopardized . The unit of local government or the Department may restrict the types of non - highway vehicles that are authorized to be used on its streets . Before permitting the operation of non - highway vehicles on its roadways , a municipality , township , county , other unit of local government , or the Department must consider the volume , speed , and character of traffic on the roadway and determine whether non - highway vehicles may safely travel on or cross the roadway . Upon determining that non - highway vehicles may safely operate on a roadway and the adoption of an ordinance or resolution by a municipality , township , county , or other unit of local government , or authorization by the Department , Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b appropriate signs shall be posted . If a roadway is under the jurisdiction of more than one unit of government , non - highway vehicles may not be operated on the roadway unless each unit of government agrees and takes action as provided in this subsection . ( e ) No non - highway vehicle may be operated on a roadway unless , at a minimum , it has the following : brakes , a steering apparatus , tires , a rearview mirror , red reflectorized warning devices in the front and rear , a slow moving emblem ( as required of other vehicles in Section 12 - 709 of this Code ) on the rear of the non - highway vehicle , a headlight that emits a white light visible from a distance of 500 feet to the front , a tail lamp that emits a red light visible from at least 100 feet from the rear , brake lights , and turn signals . When operated on a roadway , a non - highway vehicle shall have its headlight and tail lamps lighted as required by Section 12 - 201 of this Code . ( f ) A person who drives or is in actual physical control of a non - highway vehicle on a roadway while under the influence is subject to Sections 11 - 500 through 11 - 502 of this Code . ( g ) Any person who operates a non - highway vehicle on a street , highway , or roadway shall be subject to the mandatory insurance requirements under Article VI of Chapter 7 of this i Code . ( h ) It shall not be unlawful for any person to drive or operate a non - highway vehicle , as defined in paragraphs ( 1 ) and ( 5 ) of subsection ( a ) of this Section , on a county roadway or. Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b township roadway for the purpose of conducting farming operations to and from the home , farm , farm buildings , and any adjacent or nearby farm land . Non - highway vehicles , as used in this subsection ( h ) , shall not be subject to subsections ( e ) and ( q ) of this Section . However , if the non - highway vehicle , as used in this Section , is not covered under a motor vehicle insurance policy pursuant to subsection ( g ) of this Section , the vehicle must be covered under a farm , home , or non - highway vehicle insurance policy issued with coverage amounts no less than the minimum amounts set for bodily injury or death and for destruction of property under Section 7 - 203 of this Code . Non - highway vehicles operated on a county or township roadway at any time between one - half hour before sunset and one - half hour after sunrise must be equipped with head lamps and tail lamps , and the head lamps and tail lamps must be lighted . Non - highway vehicles , as used in this subsection ( h ) , shall not make a direct crossing upon or across any tollroad , interstate highway , or controlled access highway in this State . Non - highway vehicles , as used in this subsection ( h ) , shall be allowed to cross a State highway , municipal street , county highway , or road district highway if the operator of the non - highway vehicle makes a direct crossing provided : ( 1 ) the crossing is made at an angle of approximately 90 degrees to the direction of the street , road or highway and at a place where no obstruction prevents a quick and I Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b safe crossing ; i ( 2 ) the non - highway vehicle is brought to a complete stop before attempting a crossing ; ( 3 ) the operator of the non - highway vehicle yields the right of way to all pedestrian and vehicular traffic which constitutes a hazard ; and ( 4 ) that when crossing a divided highway , the crossing is made only at an intersection of the highway with another public street , road , or highway . ( i ) No action taken by a unit of local government under this Section designates the operation of a non - highway vehicle as an intended or permitted use of property with respect to Section 3 - 102 of the Local Governmental and Governmental Employees Tort Immunity Act . Operation of low - speed vehicles on streets . ( a ) Except as otherwise provided in this Section , it is lawful for any person to drive or operate a low - speed vehicle upon any street in this State where the posted speed limit is 30 miles per hour or less . Low - speed vehicles may not cross a street with a speed limit in excess of 45 miles per hour unless the crossing is at an intersection controlled by a traffic light or 4 - way stop sign . ( c ) The Department of Transportation or a municipality , �I township , county , or other unit of local government may prohibit , by regulation , ordinance , or resolution , the operation of low - speed vehicles on streets under its jurisdiction where the posted speed limit is 30 miles per hour or less if the Department of Transportation or unit of local government determines that the public safety would be jeopardized . The unit of local government or the Department of Transportation may prohibit the operation of low- speed vehicles on any and all streets under its jurisdiction . Appropriate applQ6191c ± signs shall be posted in conformance with the State Manual on Uniform Traffic Control I Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b Devices adopted pursuant to Section 11 - 301 of this Code . ( e ) If a street is under the jurisdiction of more than one unit of local government , or under the jurisdiction of the Department of Transportation and one or more units of local government , low - speed vehicles may be operated on the street unless each unit of local government and the Department of I� Transportation agree and take action to prohibit such operation as provided in this Section . ( f ) No low - speed vehicle may be operated on any street unless , at a minimum , it has the following : brakes , a steering apparatus , tires , a rearview mirror , red reflectorized warning devices in the front and rear , a headlight that emits a white light visible from a distance of 500 feet to the front , a tail lamp that emits a red light visible from at least 100 feet from the rear , brake lights , and turn signals . When operated on a street , a low - speed vehicle shall have its headlight and tail lamps lighted as required by Section 12 - 201 of this Code . The low - speed vehicle shall also have signs or decals permanently and conspicuously affixed to the rear of the vehicle and the dashboard of the vehicle stating " This Vehicle May Not Be Operated on Streets With Speed Limits in Excess of 30 m . p . h . " The lettering of the sign or decal on the rear of the vehicle shall be not less than 2 inches in height . The lettering on the sign or decal on the dashboard shall be not less than one - half inch in height . ( g ) A person may not operate a low - speed vehicle upon any i I Public Act 096 - 1434 HB6094 Enrolled LRB096 20767 AJT 36516 b street in this State unless he or she has a valid driver ' s license issued in his or her name by the Secretary of State or a foreign jurisdiction . ( h ) The operation of a low - speed vehicle upon any street is subject to the provisions of Chapter 11 of this Code concerning the Rules of the Road , and applicable local ordinances . ( i ) Every owner of a low - speed vehicle is subject to the mandatory insurance requirements specified in Article VI of Chapter 7 of this Code . ( j ) Any person engaged in the retail sale of low - speed vehicles are required to comply with the motor vehicle dealer licensing , registration , and bonding laws of this State , as specified in Sections 5 - 101 and 5 - 102 of this Code . ( k ) No action taken by a unit of local government under this Section designates the operation of a low - speed vehicle as an intended or permitted use of property with respect to Section 3 - 102 of the Local Governmental and Governmental Employees Tort Immunity Act .
