Chairperson Werderich called the meeting to order at 6:03 pm.
MINUTES FOR CORRECTION/APPROVAL
The minutes of the February 25, 2010 meeting were approved as submitted.
NEW BUSINESS:
1. PS 2010-06 Police Reports for February and March,2010
Committeeman Spears what will happens with the vehicles that were supposed to
be replaced in 2008 and 2009. Chief Hart explained that the Police Department
has 3 vehicles for sale and is looking to replace 2 more this year. Additionally,
since some of the vehicles are older and should have been replaced, the Police
Department will need to add additional funds under maintenance for the next 2
years. He noted that the older the vehicle gets, the more costly the repairs are.
The request for 2 vehicles will be on the next agenda, if approved, they will be
purchased with capital funds.
2. PS 2010-07 Open Burning Ordinance-Discussion
Chairperson Werderich stated that Alderman Sutciiff asked him to put this item
on the agenda as a result of a resident letter. In summary, the letter states that the
resident's neighbor has an open pit for fires and the problem is that they leave the
fire burning unsupervised at the end of the night. The resident is suggesting that
the City amend the ordinance such that a person much supervise any fire that is
burning. Committeeman Plocher stated that in this particular situation, there is
more going on than just a complaint about open burning in that there is a neighbor
feud going on and the police have been called in the past. Chief Hart stated that
officers have responded there regarding the burning and have felt that there was
no issue. He stated that the police responded twice in one evening recently and
the first time the fire was already extinguished. The second time embers were

burning that the Sergeant extinguished. There was really nothing else that the
Police Department could do because embers could pick up again due to wind.
Committeemen Munns and Plocher expressed a desire to enforce the ordinance
already in place. Chief Hart stated that item 42 of the Open Burning Ordinance
could create confusion. He stated this is not normally an issue; but if the
committee wants more clarification he suggests clarifying the last sentence of that
item that states that "fire are conducted in such a manner so as not to constitute a
hazard or nuisance to persons or property".
Committeeman Spears stated that when this ordinance was worked on, fire rings
and fire pits were part of the language. She feels that the ordinance should be
changed because in this circumstance, the fire is held at the back of the property
line near the resident's carriage house and is left burning unattended. She feels
that language should be added that states that all fires should be extinguished
before persons depart. Committeeman Plocher feels that the more wording is
added, the more confusing the ordinance becomes. Chief Hart stated that he
understands both sides of this and feels that until this recent complaint, this matter
has not been an issue. The Police Department has only dealt with illegal fires in
the past such as burning leaves. Sgt. Delaney feels that leaving the ordinance as
vague as possible in order to allow the Police Department to use their judgment is
best, however, he does feel that some level of responsibility should be given to the
person having the fire. Chief Hart suggested adding language that the person
conducting the fire should use all means necessary to extinguish the fire before
leaving it unattended.
The ordinance will be re-written and brought back to the next agenda for review.
Chief Hart will also be sure that roll call training is conducted regarding public
nuisances.
3. PS 2010-08 KenCom Funding Agreement- Discussion
Committeeman Munns stated that KenCom had put $1.6395 million into their
budget, anything over that would have to be split by the other communities.
Additionally, there is a $.75 surcharge on phone bills for 911 services. KenCom
is seeking our agreement to a percentage of an unknown dollar amount. Chief
Hart stated that if the growth in the community stops, there would be no
additional funds needed, but if the growth picks up expenses will be incurred
based upon the number of CAD dispatches. Additionally, if another community
drops out of KenCom, then the remaining communities would have a bigger
portion of the expenses.
Chief Hart stated that Larry Nelson informed the group that any agency that does
not sign the agreement will not be part of KenCom. He explained that he cost
breakdown is 15% for fire agencies and 85% for police agencies. There are 4
police agencies that would split it based on the CAD incidents over a 3 year
period.

Chief Hart stated that the Communication Center project for 2011 is projected to
cost $10,000.00 - $15,000.00 which is inexpensive for a Dispatch Center as they
typically cost hundreds of thousands of dollars. His concern is that all tax dollars
go to the county and that Yorkville creates $1.25 million dollars of tax revenue
from businesses and public safety sales tax. Furthermore, he is concerned that
that County Board states that the deal is with KenCom, yet KenCom states that
the deal is with the County Board. At this point, our options are signing the
agreement under protest before the deadline or partnering with Oswego to create
our own Communication Center at a cost of $1.6 million dollars to start and
$700,000.00 a year split cost.
Chief Hart stated that the Public Safety Sales Tax was passed by the county and
was explained as funds to be used for the 911 center.
Chairperson Werderich stated that this item needs to go to the City Council as
soon as possible under the Public Safety Agenda because of the deadline.
Furthermore, he asked Chief Hart and Committeeman Munns to be ready to make
a presentation to the City Council regarding what our options are. Committeeman
Munns stated that he does not think the City should publicize the fact that we
have other options. Committeeman Plocher suggests discussing the matter in
Executive Session under Contract Negotiations. Committeeman Spears stated the
problem is that the County is aware of the City's budget situation and can use that
against us.
Chief Hart explained that there seems to be no dialogue between the County
Board and the KenCom Board. Some of the board members were scheduled to
speak at Oswego Village Board meetings but backed out twice.
Chief Hart also explained that the Village of Oswego has been making changes to
the way they dispatch for some time now. Certain items are not reported to
KenCom so that CAD incidents are not created, they report those items to their 24
hour Records Department. Therefore, if growth in the area continues, he feels
that Yorkville will be responsible for the largest portion of the cost to KenCom
because all our incidents and actions are reported through KenCom.
Chairperson Werderich asked if the $.75 surcharge could be funneled here. Chief
Hart stated that it goes into a county general fund and can be used for the jail,
courthouse, etc.
Chairperson Werderich asked Chief Hart to do more investigation into what
Oswego does.
This item will be presented to City Council at their next meeting.

1. PS 2010-04 Committee Liaisons

Committeeman Spears -
Would like to discuss problems at Parfection Park. Chairperson Werderich stated that
he was planning to discuss this item this evening.
A resident's husband is a Police Officer in Aurora and in COP Unit. The unit targets
landlords, rentals, etc. She was happy to find out that the City of Yorkville has does
this for over 15+ years and that our Lieutenant trained this particular Aurora officer.
The Aurora officer does have some projects that they do that he is willing to share
with us,perhaps our Police Department could spend some time with him.
Chairperson Werderich -
A resident on Greenbriar has property that backs up to Parfection Park's driving
range. The resident was unable to attend today's meeting so this item will be put on
the next agenda. Paul Zabel has been out there to investigate and has prepared a
response. Chief Hart asked if an extra watch was in order. Chairperson Werderich
stated that it's not really a police issue as the problem is golf balls in people's yard
therefore, it's more an issue for Building and Zoning. Committeeman Spears stated
that similar issues have come up in the past, but the golf course was there before the
houses were developed. Committeeman Plocher agrees. Chief Hart stated that
Parfection Park has been good about working with the residents in the past.

Nancy Grunstad, Jeff Luptak, Mary Hyatt, Vernon Fatima. Also present was Tony

Chairperson Werderich called the meeting to order at 6:04 pm. It was noted that there was
no quorum.

3. PS 2010-11 Parfection Park-Discussion
A letter was sent by a resident, but not received by all the members of the
committee. Alderman Gilson feels that Mr. Zabel should have forwarded the
letter to everyone. Mr. Olson stated that the letter was not provided to be
included in the packet.
Alderman Gilson stated that he met with the area residents to discuss some of
their issues. He noted that golf balls come through the back side of the park and
have damaged property, homes and even homes on the other side of the street.
There were several balls in residents' yard during his visit. Alderman Gilson read
the letter in its entirety. He noted the importance of paragraph 3 and 4.
Discussion was open to the member of the public in attendance.
Nancy Grunstad stated the following:
• She prepared a letter and handout for members of the committee.
• This is the 11th year of the driving range.
• Her family likes to enjoy the weather, but it's too dangerous to be outside so
they now dread the nicer weather.

• Mr. Schalhamer has asked us to return balls that we find in our yards, which
many of us have done for some time now.
• Mr. Schalhamer installed 2' tall trees, 10' apart and feels that they will act as
a barrier to stop the balls.
• The fence installed by the neighbors house has helped some.
• When the lights were installed, the residents were not notified this would
occur.
• Over the past 8 years, the incidents of damage have gotten worse. There are
better drivers which create greater loft to the balls.
• Residents can hear the ping of the wooden drivers and then shortly thereafter
hear the sound of the ball hitting trees or houses nearby.
• The powerful, tall lights has resulted in later hours of operation.
• The ball that came through her window happened on September 24 at
8:25pm. Since it's harder to see at night, you couldn't see the ball coming
towards the house.
• We have been pummeled by balls during parties we host and have to call the
driving range to tell them to have golfers stop using drivers.
• When we complain, we are told that the golf course was there first.
• 2 years ago, I called to complain and the manager told me that they were
there first and that if we don't return the balls, its stealing and he would call
the police on me.
• Mr. Schalhamer has stated that installing a net is too expensive. He has also
stated that he may sell the property and make millions.
• We are asking you to work with us and think about our safety.
• The golf course feels that damaged property should be replaced by the
golfer, not Parfection Park. The problem is that balls keep coming and
hitting their siding, sheds,roofs and windows.
• When the golf ball came through her tempered glass window, she had
enough. She contacted Parfection Park and Kristen gave her the golfers
name. But, then Brent called and stated that it was my responsibility to
contact the golfer. My response was that they needed to handle it and I told
them to call the Police Department. Since that time, I have had to write
letters asking for replacement cost and half of attorney fees.
• She contacted her Alderman who told her to bring this matter to the Public
Safety Committee. In the meantime, Mr. Zabel came out and did an
inspection, but the residents are insulted by his official determination. He
never contacted any residents and only did an interview with Mr.
Schalhamer. He stated that there is an occasional complaint of golf balls
which he hardly considers a nuisance. But, he never spoke to us to get our
side.
• Mr. Schalhamer started putting up a fence, but its only 3' high and plastic.
That will not stop the 6-30' air balls that come into our property.
• She brought with her a large bucket of balls that were found on her property.
Each resident in attendance had buckets of balls that they found on their own
property.
DISCUSSION:

Chairperson Werderich asked what her attorney said regarding responsibility to
which she replied that the attorney informed her that the golf course is
responsible for the property damage and that golf balls coming into the yard is
considered trespassing. Furthermore she stated that when the golf course starts
being mean, they stop returning the balls. They don't care about the ground balls
that roll into their yards, it's the balls coming through the air that are dangerous.
Jeff Luptak stated the following:
• Brought a bucket that was 3/4 full of golf balls. He noted that he has thrown
back as many golf balls as those he brought to this meeting.
• He is concerned for the safety of his children.
Mary Hyatt:
• Has bigger trees in her yard than most neighbors so they don't get as many
balls,but she still gets them.
• Sometimes their lawnmower has gone over balls they didn't know were in
the yard and then the lawnmower shoots it out, which is another danger.
• Brought with her a piece of siding that had a hole in it.
Mr. Olson advised the residents to contact Building and Zoning each time a balls
comes into their yards or does damage to their property. He cited ordinance
number 4.1.b regarding nuisance which is the only one that he can find that
applies at this time. Lt. Delaney stated that Criminal Damage to Property does
not apply because the damage is not intentional.
Vernon Fatima stated the following:
• He is thankful that Parfection Park is not a shooting range.
• As a resident, his concern is that Parfection Park states that they had
discussions with the City of Yorkville regarding their concerns about the
housing development. Since he implies that the City is responsible, he is
concerned because the City issued permits to build the homes which made
him believe that he would be safe.
• He is thankful that he has never been hit, but he has suffered 1 hole in his
siding.
• The residents should have been complaining from the beginning but were
trying to be nice neighbors.
• He feels that projectiles are knowingly coming into their yards.
• The sign inside the facility states that patrons are to use drivers and tees.
But, they are using woods and he feels the sign is sending mixed signals.
• His interest is in not seeing neighbor children get hit. He is also concerned
because he has suffered a hole in his siding and found golf balls in his trees,
siding,pool and front yard.
• Golf ball and club technology has improved, but Parfection Park has not
kept up with that.
DISCUSSION: Mr. Olson stated that the City issued building permits because
the home was structurally safe. It is not the City's responsibility via the permit

process to insure that the neighboring area was safe. Furthermore he stated he
would need to review case law regarding golf courses as he feels that the golf
course is not encouraging its patrons-to hit the houses. Nancy Grunstad stated
that Parfection Park is a driving range, not a golf course and that all other area
golf courses and driving ranges have tall nets to protect the neighbors. Mr.
Olson stated that he needs to determine if the issue is between the homeowners
and the business or the homeowners and the golfers. He has no ordinance to
refer to at this time. The City can look into creating an ordinance, however,
since the City is not home rule they can only do as much as the state allows
them to. Alderman Gilson stated that on Tuesday, he was told by Dan Kramer
that if it's a safety issue the City can amend the code.
Alderman Gilson noted that paragraph 4 of Mr. Schalhamer's letter states that he
voiced his concerns about golf balls going into the residential properties. He is
concerned that if the City ignored those warnings could they hold responsibility at
this time. Committeeman Spears stated that Mr. Schalhamer's claims are hearsay
and that it would not hold up in court. Alderman Gilson stated that meeting
minutes could prove that Mr. Schalhamer is correct, to which Chairperson Munns
noted that Mr. Schalhamer refers to Tony Graff as being City Administrator,
however, he was the Police Chief at the time. Committeeman Spears feels that
the land use planner would be more responsible. Mr. Olson stated that in
hindsight, the residential development may not have been a good idea, but there is
no responsibility on the part of the City.
Nancy Grunstad asked if the City could require nets to be installed, to which Mr.
Olson stated that there is nothing in the City Code that could require it.
Chairperson Werderich feels that more information is needed and research needs
to be done.
The residents were again advised by Mr. Olson to call Mr. Zabel to report balls
coming into their yards and / or doing damage. He informed them that they could
contact him if need be. Alderman Gilson feels that Mr. Zabel should have talked
with the residents to get their side while he was investigating. Mr. Olson
disagreed as there is no law to tie their complaints to. Mr. Gilson reiterated that
he felt that Mr. Zabel did not thoroughly do his job of investigating what was
happening.
Mr. Luptak stated that 2 neighbors have had busted siding, air conditioners have
been hit and other damage has been done. He has been there 10-11 years. The
damage was occasional but it has gotten worse as golf technology has gotten
better. He feels that the business has outgrown the property by 60-100 yards. It is
now a public safety issue.
Mr. Fatima stated that he wanted to distribute flyers to patrons advising them that
if they do damage to his property that they would be responsible. However, that

would hurt the business. The neighbors don't want him to lose his business, they
just want him to be a good neighbor and help them.
It was determined that the City would have the City Attorney look into the
ordinance and determine if there is more to be done, if the ordinance could be
changed, etc. This item will return to next month's agenda for an update.

The attached ad was placed in the Kendall County Record and ran for two
weeks in the public notice section. The ad ran on June 3 and again on June 10, 2010,
seeking bids on the squad (minimum bid $2,000.00). We received two bids.
On Tuesday, June 15 at 1000hrs. Accountant Rachel Wright opened the
two bids in my presence. First bid was from Mr. James Klingel for $2,250.00 and the
second, winning bid was from Mr. Larry Simmons in the amount of $2,500.00. I
notified Mr. Simmons and he came and picked up the vehicle. If you have any

The Yorkville Police Department is selling one 2001 Ford Crown Victoria(former
D.A.R.E. car). The vehicle has approximately 73,900 miles and can be seen at the
Yorkville Police Department, 804 Game Farm Road,Yorkville, Il. Interested parties
need to leave a sealed bid for the vehicle at the administration office of the Police
Department. The minimum bid is $2,000.00. The sealed bid must be have the amount
of bid,the bidder's name and the bidder's phone number. The vehicle will be sold "as is,
where is",no test drives and no warrantee. All bids must be received at the Police
Department by 5:00 pm on Monday, June 14, 2010. Bids will be opened on Tuesday,
June 15,2010 at 10:00 am. The Yorkville Police Department reserves the right to accept

Dear Yorkville Police Department,
We would like to thank you for your support of the Yorkville Parks and Recreation
Camp 911 and Safety Town event. By providing staff for the Camp 911 and Safety
Town program, you allowed us to provide a safety camp for students in the Yorkville
Community. Your goodwill helps us to grow and offer new programs, to the
Yorkville community.
As most of you know, nobody likes asking for volunteers, and we truly do not take
your volunteer support for granted. Your volunteer support is going to a good cause—
supporting the kids and the community. The students loved the opportunity to see
Officer Johnson and O'Neil show the commands they have learned! They received
very important information on Bike Safety and Stranger Danger as well. Parents
were all thrilled to see the hands on experience they received from your department.

Dear Chief Hart,
Yesterday we had the opportunity to visit your beautiful community to attend the funeral
service of a family friend. The wake and service were held at the Larson-Nelson Funeral Home,with the
burial at Immanuel Lutheran Church Cemetery in rural Yorkville.
We were quite disturbed by several events enroute to the cemetery. As the Funeral Procession
proceeded from the Funeral Home to the cemetery,we were in a procession of approximately twelve to
fifteen vehicles led by the hearse and the limousine. I was driving the last car in the procession. All
vehicles in the procession displayed the orange FUNERAL markers provided by the funeral home. I do
not know how many of the vehicles were using the flashing hazard lights.
As we drove south through Yorkville, a portion of the road is four lanes which soon narrows to
two lanes. The procession was travelling in the left lane at near speed limit. Several vehicles, including
at least two tractor-trailer rigs, passed the procession on the right, and, where the road narrowed,these
vehicles merged into the funeral procession.
Our vehicle was nearly hit by a pick-up truck entering Route 47 from River Street. We were
following the vehicle ahead of us at a safe distance with our hazard lights flashing. The driver ahead of
us became aware of this since I hit the horn and the brakes. Fortunately,we had room to swerve to the
left and avoid this vehicle. But I'm sure that commercial trucks mixed into the procession did not help
drivers waiting to enter from side streets to realize that we were still part of the funeral procession.
I have consulted "The Rules of the Road" to make sure I have an understanding of Illinois law
concerning funeral procession. Perhaps exterior mounted funeral flags and a police awareness and
presence along the route could help make the procession safer for the mourners.

fee for microbreweries/brew pubs.
Background:
On July 13, 2010, the City Council Committee approved a text amendment to allow for the
manufacturing of alcoholic beverages as a permitted use within the M-1 Limited Manufacturing
District and microbreweries/brew pubs as permitted Special Uses with the City's business
districts. As part of this approval, the City will also need to pass a code amendment to the Liquor
Control ordinance establishing a liquor license class and fee for microbreweries/brew pubs, as
long as they are connected with a restaurant. A liquor license will not be required for the
manufacturing of alcohol in the M-1 district, as this is done solely by the State.
Request:
Staff is requesting approval of a new license classification for a microbrewery/brew pub with a
license fee of$1,500.00, as follows:
M—Microbrewery/brew Pub - a restaurant-brewery that brews beer primarily for sale in
a restaurant and is dispensed directly from the brewery's storage tanks.
Authorizes the licensee to manufacture beer products on the licensed premises and to
make sales at retail of alcoholic liquor, including, but not limited, to the manufactured
beer products for both on-premise and off-premise consumption. All sales must be in a
hand-capped, sealed container with a total maximum production of 15,000 barrels per
calendar year (465,000 gallons) inclusive of on-premise and off-premise sales. One (1)
U.S. barrel is equivalent to thirty-one (31) gallons. Microbrewery/brew pub operations
will be ancillary to a restaurant or eating establishment, and the brewing component of
the facility shall not be more than twenty-five percent (25%) of the total floor area.
A holder of a class M license may furthermore be permitted to allow the sampling and/or tasting
of the products being sold subject to the following restrictions:
a. The administration of such sampling and/or tasting shall be done under the supervision
of a department manager or facility manager, and the actual serving shall be done only
by a person over the age of twenty one (21) years; and
b. The sampling and/or tasting, consumption, or possession of any alcoholic liquor by any
person under the age of twenty one (21) years is strictly prohibited, and the server of
such sample and/or taste will bear the responsibility of enforcing such prohibition; and

c. The sampling and/or tasting shall not exceed six(6)hours for each day of such
sampling and/or tasting; and
d. Sampling and/or tasting must occur in a single designated location; multiple locations
are strictly prohibited; and
e. The samples and/or tastes shall be limited to two (2) ounces or less of beer and/or
wine, and the samples and/or tastes shall be limited to one or two (2) ounces or less of
liquor.
f. The number of products to be sampled or tasted on any one day shall be limited to three
(3) or less.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVI LLE,]KENDALL COUNTY,ILLINOIS,PROVIDING FOR LIQUOR CONTROL
WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality in
accordance with the Constitution of the State of Illinois of 1970 and has the powers granted to it by law;
WHEREAS, the Liquor Control Act of 1934, 235 ILCS 511-1, et seq., (the "Liquor Control
Act") sets forth a comprehensive system for the regulation of liquor control within the state of Illinois,
and authorizes broad powers to municipalities with regard to local retail licenses; and
WHEREAS, the City Council of the United City of Yorkville has determined that it will
promote the public health, safety and welfare, and that it is in the best interests of the City to amend the
regulations pertaining to the sale of liquor as set forth in the City Code of the United City of Yorkville as
set forth herein.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City
of Yorkville, Kendall County, Illinois, as follows:
Section I. Title 3, Chapter 3, Section 4, Subsection (A)(4) of the City Code is hereby amended
by adding the following:
M—Microbrewery/Brew Pub - a restaurant-brewery that brews beer primarily for sale in a
restaurant and is dispensed directly from the brewery's storage tanks.
