The meeting was called to order by Chairman Plocher at 6:00pm.

Items Recommended for Consent Agenda
New Business
1. PW 2010-40 Commercial Solid Waste Franchise Agreement
Frank Guilbo, City Administrative Intern, reported on this item. He said a proposal was
prepared by the Green Committee for a solid waste program highlighting increased
recycling for businesses. Marta Keane of the Green Committee said this item was
brought forth as a recommendation. It was suggested to have only one waste hauler
which she said would save money for the businesses.
Bart Olson said the City would issue RFP's and one vendor would be chosen. He said
any contract approved cannot go into effect for 15 months according to State law and that

fees would apply. In addition, surveys of the businesses would need to be taken to
determine needs.
Peggy Macenas said the businesses should have the right to determine their own
providers. She said businesses produce different quantities of recyclable waste and it is
very different from household waste. She also addressed the issue of wear and tear to the
streets.
Alderman Gilson asked about the $6,000 "administration costs" for the agreement. This
would be for the yearly management.
Contracts with the recyclers were also discussed and it was noted that the contracts were
between the recyclers and the businesses.
Alderman Teeling questioned the cost structure to the businesses. Mr. Olson said the
costs would be based on a matrix and also on the size of container needed. A guest also
added that the matrix could be based on the type and weight of the waste produced.
It was decided that this matter will be sent to the Green Committee for further discussion.
2. PW 2010-41 Ordinance Regarding Trails and Sidewalks
According to Joe Wywrot, this is a proposed ordinance to create partial funding of a city-
wide trail system. The funding would come from property owners obligated to construct
sidewalks. The funds could be used for the trails or sidewalks or another option is to
bank the money until a later date.
Alderman Gilson asked about the parameters for this ordinance and it was noted that the
property owner will have some input. Requirements in an annexation agreement will not
be waived according to Bart Olson. Gilson raised several other questions in this
discussion including possible increased costs if the project is not done right away.
This matter will move forward to the June 22nd City Council meeting.
3. PW 2010-42 Sunflower Estates Phase 3—Final Acceptance and Bond Reduction #3
Wywrot said a driveway had been completed on Walsh Circle and he recommended to
appr4ove Phase 3 along with a bond reduction and a 1-year warranty period.
4. PW 2010-43 Downtown Parking Lot—Design Engineering Agreement
This is a proposed agreement with Engineering Enterprises for design work for this
proposed parking lot. It is 100% funded by IDOT. For the record, Gilson stated he was
opposed to this project.
5. PW 2010-44 Route 47 Project—Resolution Regarding Overnight Construction
IDOT is asking for adoption of this resolution allowing them to perform night-time work
to expedite the project. The hours would be 8pm to 6am. This item will be placed on the
consent agenda.

6. PW 2010-45 Tree Bank Proposal
Bart Olson explained this is a result of developers not replacing trees, residents offering
to pay for trees and the City planting them. He said the City does not want to absolve the
developers from paying for the trees. The developer could also opt to donate cash to a
"tree bank". This will move to the consent agenda and then back to committee to draft
the proposal.
7. PW 2010-46 Inter governmental Agreement with Kendall County for Bulk Rock
Salt Storage
Kendall County has asked the City if they wished to join in a consortium to store rock
salt according to Eric Dhuse. Olson said this should be considered if extra funds are
found in the MFT or Public Works Capital budget. After discussion, it was decided to
reconsider this next year.
8. PW 2010-47 Proposed Revisions to the Nuisance Ordinance (Weeds and Grass)
Eric Dhuse said he is seeking a long-term solution for nuisance weeds. Gilson and
Plocher said they thought weeds are a nuisance at 8"rather than the 12" suggested in the
ordinance. Gilson also suggested that 3 times a year is not enough frequency for
mowing. Alderman Teeling also cited a safety issue in some instances.
After much discussion, it was decided to bring this mattre back to the next meeting.
9. PW 2010-48 Proposed Water Ordinance Revision
Bart Olson suggested that this be brought back next month pending input from the Mayor
and Attorney Orr.
Old Business
1. PS 2010-38 Punch List Processes
Joe Wywrot said this item was brought back from last month. In a memo to City
Administrator Olson, Wywrot recommended that punch lists be updated once a year and
that they not be created until 50% of a development has built out. Gilson agreed, but
added that developers need to be reminded yearly of the City expectations and it may
speed completion of the build out. Olson cautioned that generating a punch list before
50%build out, the list is likely to be incomplete. Also noted was that a more frequent
punch list requires more City staff time and more tracking. Wywrot said that on average,
yearly inspections are being done at this time. Gilson asked that this be discussed further
at Council so it will move forward to the June 22nd meeting.
Additional Business
Alderman Munns discussed a letter from an energy group whereby an audit is done of gas
and electric usage. Olson said the City had done this twice in the last 5 years and it
would not save the City money at this time.
There was no further business and the meeting was adjourned at 7:38pm.

Subject: Route 47 Widening—Resolution for Right-of Way Conveyance
Attached find a letter from IDOT requesting that the city convey a strip of property at the
northwest corner of Rt.47 and Countryside Parkway to them for right-of-way purposes. Also
attached find the corresponding resolution for this conveyance. Please note that the resolution
requires a 2/3 majority vote of the City Council. Related documents also attached are an
indenture, receipt, affidavit of title, and PTAX 203 form.
The parcel is approximately 330 feet long and varies in width from a point at the north end to
approximately 9 feet wide at the north end. The total area is about 2436 square feet. The parcel is
part of an open space buffer strip along Route 47 that the city acquired from the Countryside
developer several years ago. Please refer to the attached premise plat for more details.
The right-of-way is needed to provide room for a proposed southbound right-turn lane at
Countryside Parkway and for a drainage swale. The existing right-of-way line is only about 3
feet from the proposed curbline.
I recommend that this resolution be approved. Please place this item on the Public Works
Committee agenda of December 16, 2010 for consideration.

Subject: 2010 Misc. Bituminous Patching—Change Order#1
Attached find one copy of proposed Change Order#1 for the referenced project. This final
balancing change order, in the amount of a $6704.10 decrease, is a result of certain repairs not
being necessary.
No repairs of the subgrade were required during the removal and replacement of the pavement.
This resulted in zero quantities and zero cost for aggregate base repair and fabric. The aggregate
shoulder and pavement markings are to be completed as required by the Public Works
Department. The elimination of all these line items resulted in a total savings of$8608.50.
This decrease was counterbalanced by an increase of$1904.40 for an additional 27.60 SY of
pavement that was marked out on Kennedy Road for patching. The area of the original patches
in the contract was adjusted slightly based on the condition of the stretch of pavement along
Kennedy Road prior to commencement.
I recommend approval of this change order. Please place this item on the December 21, 2010
Public Works Committee agenda for consideration.

The one-year warranty periods for Bristol Bay Units 1, 2 & 6 expire on December 22, 2010.
We inspected the site this past fall and generated warranty punchlists, which generally consisted
of re-grading along the edge of sidewalks, replacing deteriorated sidewalks, and replacing dead
landscaping. The developer has completed the warranty punchlists, and has requested that the
warranty bonds be released.
International Fidelity Insurance Company Bond No. 0504710 (in the amount of$423,429.53),
Bond No. 0504709 (in the amount of$218,993.32), and Bond No. 0504708 (in the amount of
$164,722.70) are serving as the warranty bonds for Units 1, 2 and 6, respectively. Since the
warranty punchlists have been completed, I recommend that these bonds be released.
Please place this item on the December 21, 2010 Public Works Committee agenda for
consideration.

POLICY
PRIVATE IMPROVEMENTS IN CITY RIGHT OF WAY,TREE REMOVAL
WHEREAS, the United City of Yorkville ("City") owns right of ways throughout
the City commonly called"parkways"which generally lie between a side walk and a City
Street, and less often lie adjacent to a City Street in• areas that have no sidewalk
(hereinafter referred to as"City Right of Way"), and
WHEREAS, the City has received, and expects to continue to receive inquires and
requests from land owners adjacent to the right of way to make improvements in the City
Right of Way, and/or to remove trees in the City Right of Way, and
WHEREAS, the City deems it prudent to adopt this Policy to provide a consistent
and ascertainable response to the issues concerning City Right of Way improvements and
Tree Removal, be it resolved that the City's Policy for Private Improvements in City
Right of Way and Tree Removal is as follows:
1. The City will consider "Requests to Improve City Right of Way" by adjacent
land owners,only. Certain improvements shall require a permit,others shall not.
2. Examples of improvements that shall require a permit are: Planting a tree,
removing a tree, constructing a new sidewalk, Adding curb or gravel shoulders,
widening a driveway apron,major grade changes, placing boulders or other obstructions,
cutting a street curb. This list is meant as an example, only, to describe the type and
extent of improvements that shall require a permit under this Policy, however the list is
not intended to be exhaustive and other specific items that are similar in size, scope and
content may also require a permit.
3. Examples of improvements that shall not require a permit are: planting
flowers, making minor landscape changes, replacing existing sidewalk, adding gravel to
shoulders, installing a break away mailbox, repaving a driveway apron, minor grade
changes. This list is meant as an example only, to describe the type and extent of
improvements that are considered exempt from this policy and shall not require a permit
under this Policy, however the list is not intended to be exhaustive and other specific
items that are similar in size, scope and content may also be considered exempt from this
policy.
4. Said Requests shall be made to the City Engineer, and shall be in writing.
' Requests shall include at a minimum: A plat of survey, a site plan or sketch, a narrative
of what is intended to be accomplished including a list of who will do the work. The City
( Engineer may ask for additional information as may be reasonably required to review the
request. The applicant must also request a building permit for the improvement. The fee
for this permit shall be$ 50.00.
5. In determining whether or not to approve the Request the City Engineer shall
consider reasonable engineering and aesthetic factors for the parcel, and for the area of
the City. These factors shall include, at a minimum: drainage, safety, the existing
sidewalk and roadway, and consistency with the neighborhood.
6. If, after receiving the information required herein, and considering the factors
identified herein, the City Engineer determines that the request is in keeping with the
factors set forth herein,then the City Engineer may issue a letter approving the request.
7. Said letter shall indicate that the approval is for the requested improvement, only,
and that the Engineer shall inspect the work and the City shall require the work to be
performed according to the plans approved by the City. If the project has anticipated
costs in excess of$1,000, the City shall require a bond or letter of credit to secure the
completion of the work. If the work is initiated, but not completed, within 90 days of
issue of the permit,the City may call the bond or letter of credit and complete the work as
designed or return the parkway to its pre-existing condition,at the City's sole discretion.
8. All improvements performed in City Right of Way shall become property of the
City regardless of whether said work is approved via this policy and permit process. The
improvement shall be subject to removal or modification at the sole discretion of the
City. If such work has been completed by permit in compliance with this policy,then the
cost of removal or modification at a later date shall be borne by the City. If an
improvement is made without a permit, then any future removal or modification shall be
paid for by the owner of the property who constructed the unpermitted improvement.
9. Regarding any citizen request for voluntary removal of trees it shall be the policy
of the City, trees within the City Right of Way shall not be removed. The only
exceptions to this policy shall be:
---Trees that suffer from disease may be removed upon demonstration of the
likelihood that the tree will not survive
---Trees that must be removed for the purposes of installation of driveways
Requests for removal of trees shall be submitted to the City Engineer consistent with the
procedure set forth herein.

Bart,
As you know,the Public Works committee discussed the possibility of an alternative planting for
vacant lots. The committee members did not want this type of planting to be allowed on a single
lot, and asked for recommendations as to what would be the minimum square footage or acreage
that we would allow. After listening to ideas from the committee and talking with Laura Schraw,
I would recommend the following:
Minimum Area
• R2 typical single family residential lot—a minimum of 4 contiguous lots that are
sequentially addressed and owned by one entity
• R2-D typical residential duplex lot—a minimum of 3 contiguous lots that are sequentially
addressed and owned by one entity
• All other zoning classifications— 1 acre (43,560 SF)
Mowing Schedule
Areas planted with the approved seed mixture shall be mowed at the following times:
• First Mowing—on or before.i une 1
• Second Mowing—on or before September 1
• Third Mowing—on or before November 15
Any deviation from this schedule will result in a violation of this ordinance
If this amendment is approved, I will work with the building and community development
departments to come up with an application form and tracking procedures.

This item was last discussed at the June Public Works Committee meeting. The materials
from that meeting are attached. The end result of the discussion was that the aldermen were
going to observe the aesthetics of some of the prairie grasses in the subdivisions. As you may
recall, the policy issue at the time was whether or not we wanted to allow a specific prairie grass
plant mix to grow beyond 8".
Additionally, Alderman Spears has requested that we revisit the discussion on increased
fines for repeat offenders. Currently,there is no mandatory fine in the code and no option to pre-
pay the fine prior to the adjudication hearing. This means the hearing officer sets the fine at the
adjudication hearing. At the hearing, staff will inform the hearing officer of the history of
violations on the property, and the hearing officer will set the fine accordingly. In the past, this
has resulted in steeper fines for repeat offenders.

While working with Paul Zabel this spring,we would like to propose some changes to the
current nuisance ordinance regarding certain weeds and grasses. These proposed changes are
being brought forward in an effort to work with lot/home/business owners to gain compliance
and a long term solution to this chronic problem.
Section 4-1-5 Nuisances and offensive conditions,generally
7. Certain weeds, grasses,plants or vegetables: Any weeds,grass,plant or vegetable
matter,other than trees,bushes, flowers,vegetable gardens or other ornamental plants to
grow to a height exceeding eight inches (8")where a structure is present on the lot or
tract of land.
8. Certain weeds, grasses, plants or vegetables: Any weeds, grass, plant or vegetable
matter,other than trees, bushed,flowers, vegetable gardens or other ornamental plants to
grow to a height exceeding twelve inches (12")where the lot or tract of land has no
structure(s).
C. Allowable exceptions
1. Farming shall be allowed to continue on lot(s) or tracts of land where there has been an
established history of cultivation of the land for a period of one(1) year.
2 StabiliZ3ti^.^.and re_vebetation ofio.t(s) or traet(s) of land. in an effort to promote erosion
control,water conservation, and minimize the occurrence of unwanted weeds and other
plant species all of the following rules/criteria shall apply:

B. The lot(s)or tract(s) shall be planted with the following seed mix:

Any deviation from this schedule will result in a violation of this ordinance.
The benefits of the proposed stabilization and re-vegetation are:
1. A solid long term plan in place which will benefit both owners and the City.
2. Greatly assists in erosion control of vacant land
3. Promotes a quality green philosophy
4. Greatly reduces work load on both owners and the City.
5. Possible income for larger tracts of land
6. Owners will have to clean up lots to prepare the soil for planting
Drawbacks of the proposed stabilization and re-vegetation are:
1. not all owners will choose this option
2. Is not an instant fix. This is a long term plan and the plants take time to establish
3. Not mowed as often
4. Specified species are taller than the 8"height that is currently mandated. Average
heights of proposed plants are 12"-36"tall.
5. Some adjacent property owners may object to taller plants

Bart,
As you know,this year we had some residents asking to participate in the parkway tree
replacement program that lived in unaccepted subdivisions. At that time it was decided that
since the developer was responsible for replacing parkway trees up until the one year warranty
expires after the subdivision is accepted that the residents that live in those subdivisions would
not be able to participate in the program this year. Instead of telling residents no,we would like
to find a way to let all residents participate in this program.
One idea was to let all residents participate but if the resident lived in an unaccepted
subdivision, the developer of that subdivision would have to purchase and install a tree
elsewhere in the subdivision such as a park or other city owned space before the subdivision
would be accepted. So in essence, the developer would still have to replace the tree, but it would
be planted in a different location.
The benefits of this idea are:
• Allows all residents to participate
• Maintains developer responsibility to replace trees
Disadvantages of this idea are:
• Tracking individual trees over multiple years
• Possibility of more applicants for the program than we have allotted trees
Another idea is to just let all residents participate without tracking the status of acceptance of the
subdivision. If we inform residents that live in an unaccepted subdivision that the developer is
ultimately responsible for the replacement of the parkway tree and they are still willing to
participate, we should allow them to.
Currently we have many residents that have lived in an unaccepted subdivision for multiple
years. During that time, they have seen the development dry up almost completely and some
have even seen the development go through the foreclosure process and now have a receiver and
property manager instead of a developer. Trying to get a parkway tree replaced in this situation
could be very difficult to say the least. If we inform these residents when they call that they do
have the choice of waiting for the developer to replace the tree or participating in the program
and they choose to participate at their own expense, we should not turn them away because of
where they live.
The benefits of this idea are:
• Allows all residents to participate equally
• Do not have to track individual trees over multiple years in multiple developments
Disadvantages of this idea are:
• Does not hold the developer responsible for the tree
• Possibility of more applicants for the program than we have allotted trees
I would ask that this be placed on the October 19th Public Works Committee agenda for
discussion. If you have any questions or need further information,please let me know.
Section 1. Upon review of a proposed parkway tree, the City Administrator or his designee shall
determine if a tree replacement is warranted at that location. Properties that are privately owned will not
be eligible to participate in this program.
Section 2. Upon making said determination, the City Administrator or his designee shall notify
the resident of approval or denial of the application.
Section 3. When the application is accepted, the Owner/developer shall be held liable for the
cost of the tree and labor to install said tree. Costs will vary from year to year based on species of tree
selected and labor rates.
Section 4. One (1) original invoice will be distributed to the Finance department for billing and
one (1) copy of the invoice will be distributed to the Engineering department to be attached to the current

Subject: Yorkville 50150 Parkway Tree Program
Please see the attached proposal information to establish a Parkway Tree Program for the
residents of Yorkville. The 50/50 program includes purchase and planting of the tree by the
City,with the homeowner reimbursing the City for the cost of the tree.The City's share is in
kind including pickup of trees, delivery to homes,JULIE locate,planting, first water,and all
Staff time coordinating the project. Many communities have established successful 50/50 tree
planting programs to cost share the replacement of parkway trees.
Attachment A is the program explanation sheet and registration form that will be filled in and
returned to City Hall with a check from the resident who desires to have a tree planted in the
parkway near their home. To help ensure the survival of the tree, all trees except oaks will be
planted in the fall.The City will allow the resident to locate the tree at their desired location,
but if the location must be adjusted due to utilities, the homeowner will still approve the
location prior to planting. The City will be responsible for calling JULIE and one-time
watering.No guarantee for the tree will be provided.The program will be limited to 36 trees
this first year of establishment.
The tree list,Attachment B, shows the price of the tree that the City would charge the
homeowner.Tree prices have been based on the average price for the species obtained in
estimates provided in January of 2009.The basis for using an average tree prices is that the
City cannot pre-determine the nursery from which we will be getting the tree,and therefore
cannot guarantee prices or availability of the species for the price listed since we are not
purchasing the trees until after the order is placed.Three local nurseries submitted price lists
for the species offered. This does not mean we will purchase all trees from a single nursery,
but selection availability, delivery or pickup charges,and the tree price will be considered
prior to final purchase.
Attachment C is a sample of the tree information that will be provided if the homeowner
requests additional information on the tree species.

Yorkville 50/50 Parkwav Tree Program
Through the 50/50 Street Tree Program,the United City of Yorkville shares the cost of
planting trees with homeowners. Residents simply choose the trees they want and send in
a check for their portion of the cost.The City does the rest!
The purpose of the Street Tree Program is intended to provide quality shade trees to
residents within the City to be planted within the right-of-way areas along the streets and
corridors throughout the City.The trees are intended to provide shade,screening,
wildlife,pollution control, reduction of water runoff,soil erosion control, increased
property values,reduced stress, aesthetics, and a sense of well being within the
community. Please note that if your development still requires street trees to be planted,
by the developer,you cannot participate in this program.
All trees purchased through the program are required to be planted within the area of the
right-of-way in front of or on the sides of the purchaser's property.The right-of-way area
available for planting the trees varies depending on the platting of the property and the
width of the right-of-way. Generally it is eight to ten feet(8'to 10') from edge of curb to
edge of right-of-way. Trees must be located a minimum distance of 50 feet from any
other tree in the parkway;not conflict with existing utilities,be at least 20 feet from an
overhead light, and must be 30 feet from any intersection.
The City will work with the homeowner to locate the tree. All trees will be purchased for
a fall planting except for oak trees,which will be planted the following spring.The tree
will be planted,mulched, and watered(once) by the City. After the watering,care is left
to the purchaser.No guarantee will be provided.
Each tree will be a minimum of 2.5"in diameter.The homeowner's cost for each tree is
based on the tree species and planting option selected from the list below.Orders with
check payable to the United City of Yorkville, must be received by Monday,August
24,2009. Please mail checks and complete application to: 800 Game Farm Road,'
Yorkville,IL, 60560. For more information,please contact the Laura Haake at
Community Deveiopment Department at(630)553-8574. Limited quantities per species
are available and will be served on a first-come,first-serve basis. The City's limit for
trees sold this year as part of the program is thirty-six(36). This program will continue on
an annual basis and planting will occur at the fall of every year.

mimics the classic elm. Dutch Elm Disease resistant,

Several residents have called to participate in the Parkway Tree Replacement Program
over the past few weeks from subdivisions in which the City has not accepted infrastructure. We
have denied the residents from participating in these areas because parkway trees are considered
public improvements and therefore part of the developer's responsibility in building the
subdivision. In these cases, we inform the resident of that information and tell them that their
particular tree will be added to the developer's punchlist for infrastructure completion. in most
cases, the resident is happy with this response,but in some cases they have argued they should
be able to replace the dead tree anyway.
A solution to this situation is to change our subdivision improvement code to allow the
City staff to allow the residents to participate in the Parkway Tree Program and further to allow
us to require the developer to donate money or a tree to a tree bank to be used in other public
areas in the City. This concept would be similar to the trail bank that is being proposed on
tonight's agenda.
One potential hurdle to the enactment of a tree bank is subdivision ordinance locks. Most
of the subdivisions of the City have an ordinance lock that only allows those ordinances and
regulations in place at time of annexation agreement approval to be applied to the property for a
number of years. The tree bank proposal would not be effective on those subdivisions unless
consented to by the developer. While I have not spoken with any developers on whether they
would consent to it, I am optimistic they will agree to it since likely result in a cost savings to
them (because they would not have to have their contractors rip out the old tree and purchase a
new one).
