The first one for asphalt only(City would do excavation work and subbase), the second one for the entire trail connection including removal of old trail connection, excavation, subbase, surface course, and landscape restoration. 3) Railroad Right-of-Way The applications and insurance requirements are attached for discussion. Staff is proposing that we work on the application for the extension of Hydraulic Avenue so that we can provide an access road to the parking lot for our potential boat launch parking lot. The trail crossing request over the railroad tracks from the ComED easement to Riverfront Park is required to be a separate application and fee, and we can wait until a later date for this submittal. 4) Route 47 Widening Project Kendall County Planning, Building, and Zoning Department send us the attached letter regarding the Route 47 widening project. They have told the state of our proposed trails between Caton Farm and Route 71. 5) Trail Bank A sample ordinance is attached for discussion regarding establishing a trail bank. This ordinance would allow the City to collect the monetary value of the sidewalk and use it for trail. The ITP trail map and a property to which this would be applicable will be brought to the meeting. M. (d) Umbrella Liability Insurance written on an occurrence basis subject to a limit of$4,000,000 each occurrence for bodily injury, property damage, personal injury and advertising injury. Policy coverage is to be at least as broad as primary coverages and include, but not be limited to, Operations and Premises Liability, Completed Operations and Products Liability, Personal Injury Liability and Contractual Liability insurance. Completed Operations coverage is to be maintained for a period of not less than two years after the termination or cancellation of this agreement. All insurance required of(Name of Vendor/Contractor)with the exception of Workers Compensation and Employers Liability shall include OmniTRAX, (Name of OmniTRAX facility) and any subsidiary, parent or affiliate corporations of OmniTRAX and their agents, representatives and employees as additional insured and include wording which states that the insurance shall be primary and not excess over or contributory with any insurance carried by OmniTRAX and its affiliates. All insurance shall provide a minimum of 30 days advance written notice of insurer's intent to cancel or otherwise terminate policy coverage. (Name of Vendor/Contractor) shall file with OmniTRAX and its affiliates on or before the effective date of this agreement a valid Certificate of Insurance for all required insurance policies. Each certificate shall identify OmniTRAX, (Name of OmniTRAX facility) and its affiliates as additional insured as required and state that OmniTRAX, (Name of OmniTRAX facility) and its affiliates will receive a minimum of 30 days advance written notice of insurer's intent to cancel or otherwise terminate policy coverage. Fifteen (15) days prior to expiration of such insurance, (Name of Vendor/Contractor) shall supply updated Certificates of Insurance that clearly evidence the continuation of all coverage in the same manner, limits of protection, and scope of coverage, as was provided by the original Certificates. It is our understanding that [DOT is developing plans for the improvement of Illinois Route 47 from Caton Farm Road to Illinois Route 71 including adding multiple lanes. Per the request of IDOT, we have identified four (4) proposed trails within a mile of this proposed project that could be impacted by the proposed widening. One of these trails consists of a multi-use trail proposed on the east side of Illinois Route 47 that runs between Caton Farm Road and Legion Road. In addition to this trail,there are three proposed multi-use trails that cut across Illinois Route 47 located on the north side of Walker Road, the north side of the Middle Aux Sable Creek , and the north side of Legion Road. Please see the enclosed plan titled "Future Land Use & Transportation Plan" for more details. Furthermore, the United City of Yorkville has adopted an Integrated Transportation plan dated September 8, 2009. Dudgeon,AICP Director Enclosures Cc: United City of Yorkville PBZ Committee Beverly Moore,Illinois Trails Conservancy Resolution No. RESOLUTION REGARDING A POLICY AND PROCEDURE TO CREATE A FUNDING MECHANISM FOR SIDEWALK, TRAILS AND PATHS WHEREAS, the United City of Yorkville recently adopted the Integrated Transportation Plan by Resolution No. ; and, WHEREAS, said Integrated Transportation Plan calls for the construction of regional and local trails and bike paths throughout the city; and, WHEREAS, construction of said trails and bike paths requires significant funding; and, WHEREAS, new construction of homes and businesses include the construction of public sidewalk along their frontages of public roadways; and, WHEREAS,from time to time the location of some or all of said new construction is not in areas where sidewalk is either practical or beneficial to the general public, NOW THEREFORE, BE IT HEREBY RESOLVED by the Mayor and City Council of the United City of Yorkville,Kendall County,Illinois: Section 1. Upon recommendation of the Building Official, Community Development Director, or City Engineer, the City Administrator may make a determination that sidewalk is not practical or beneficial at the location of proposed new construction. Section 2. Upon making said determination, the Building Official shall notify the owner/developer of the finding and waive the requirement for sidewalk at that location subject to receipt of the monies that would have been used for construction of said sidewalk. Section 3. Owner/developer shall have the option of constructing sidewalk across their property's frontage or transferring those funds to the city for sidewalk, trail, or bike path projects elsewhere in the city. The city shall have the option of declining those funds if the city feels that the amount offered is insufficient, and instead require that the owner/developer construct the sidewalk across their property's frontage. Section 4. Said monies are to be deposited in a separate account and are to be used only for the purpose of acquiring easements, design, or construction of trails or bike paths at locations deemed beneficial to the public.
