Members of the public in attendance included Mr. Andrew Shaw and Ms. Kim
Sullivan.
Chairperson Spears stated as there was not a quorum, that no official meeting could take
place, however, discussion could take place as there were members of the public present to
discuss an item under Old Business.
Chairperson Spears called the discussion to order at 6:03 pm.
OLD BUSINESS :
1. PS 2008-47 — Ordinance Amending City Code Regarding Parental
Responsibility
Chairperson Spears reminded the group that this is for discussion only.
Members of the community are present and have some concerns.
Additionally, she received an email and a phone call today from community
members that are against the ordinance.
Chief Martin stated that this item was brought forward, however, not for
monetary reasons or to create undue hardship. He stated it is a way for the
Police Department to work with parents and individuals instead of having to
go straight to criminal charges. At this time, he asks that the Committee
remove this item from the agenda. The Police Department will try to work
with juveniles that they can, others will be charged and processed through the
criminal court system. The main purpose of the proposed ordinance was to
stop juveniles from having charges on their record, easing up the court system
and saving money by reducing overtime for court appearances. The Police

Department is not in the business of making money. The ordinance would
have given officers more discretion.
Chief Martin asked to move forward with the items in Old Business # 1 .
Chairperson Spears stated that after receiving some phone calls regarding the
ordinance, she became concerned and agrees it should be removed from the
agenda. Additionally, she stated that Mr. Shaw spoke to the City Council at
the last meeting and made the council aware of other issues.
Chief Martin stated that removal of this item does not stop the parent from
being responsible for their children or fines they incur. He stated that Mr.
Shaw, as a teacher, has guidelines to follow and is given more opportunity to
work with children and their parents. The Police Department has to work with
what they have, that is the criminal court system.
Committeeman Suteliff stated that she feels it is difficult for a parent to be
responsible for a child when they are not home. She stated that most people
feel that this is extra policing. She also feels the item should be removed from
the agenda.
Ms. Sullivan stated that she does not mind that the item is being removed
from the agenda; however, she wanted to make it clear that the article she read
in the newspaper regarding this item is completely different from what she is
hearing at this meeting. Her understanding was that the child would be
charged and the parent would be fined. The newspaper did not discuss
anything about the Police Department working with the parents and child.
Her interpretation of the ordinance based upon the newspaper article was that
the incident would fall under double jeopardy. Chief Martin stated that the
newspaper article was blown out of proportion.
Mr. Shaw stated that he concurs with Ms. Sullivan' s interpretation of the
newspaper article. While he is in favor of accountability, to the degree of
fining the parents heavily he feels in not appropriate. Furthermore, he stated
that as a teacher he has noticed that the problem kids are typically seeking
parental attention and the demographic of the home life of problem kids is not
a solid one. Chief Martin disagreed with that statement and advised that the -
Police Department deals with many problem kids that come from solid homes.
Mr. Shaw asked for further clarification on the proposed ordinance.
Chief Martin stated that the ordinance would have allowed the Police
Department more discretion to try to work with kids on their parents when
possible. It would also require that the parent be more accountable. Mr.
Shaw asked to use a violation of vandalism as an example and explain what
would happen. Chief Martin stated that if a child vandalized a school, the
school would want accountability. Therefore, the Police Department would
try to work with the parent and child and try to get the damage cleaned or

restitution made to the school for the damage. If this was the I " offense, that
would be it and there would be no charges. If this was the 2"d offense, the
same would occur, but then the child would be issued a fine. If this was the
3`d offense, the child would be charged criminally and would still be held
responsible for making restitution to the school.
Officer Helland explained that the same offense occurred a few years ago and
the incident resulted in an automatic felony charge for the child. If the Police
Department had this route, the child would not have to be charged criminally.
Mr. Shaw clarified that this would help the child and gets the parent involved.
Chief Martin agreed and stated that perhaps the City could revisit this issue at
a later time. If that were the case, he would prepare a press release that
explains in more detail how it would work.
Chief Martin added that if there is ever a time when residents have questions
regarding ordinances, etc., they are welcome to contact him anytime. If they
are not happy with the Chiefs explanation or are still confused, they are also
welcome to contact the City Council.
Mr. Shaw asked if citizens could obtain copies of ordinances. Chief Martin
stated that all ordinances are available on the City' s website. Lt.
Schwartzkopf added that state statutes are also available through the internet.
Mr. Shaw thanked Chief Martin for the explanation and stated that as a
teacher he is in favor of accountability. He stated that the school liaison
officer at the school he teaches at explained the adjudication process to him
and he is now in favor of that.
Ms. Sullivan stated that the newspaper article stated that the Police
Department would fine and charge the children. Does the Police Department
still have that discretion? Ms. Batterson stated that at this time, the Police
Department can either charge a juvenile or not charge the juvenile. Chief
Martin stated that typically, the parents are contacted on a first offense and not
fined. If there is a second offense, the juvenile is charged criminally. The
proposed ordinance would have broadened their abilities. At a time when
juvenile offenses are up 20%, this tool would have helped and also reduced
officer's overtime for court appearances.
Chairperson Spears stated that no vote could take place at this meeting;
therefore, the item would have to be brought back to the next meeting. She
thanked the members of the community for attending the meeting. Mr. Shaw
thanked Chief Martin for his explanation and thanked the committee for being
accessible.
ADDITIONAL DISCUSSION :
Committeeman Sutcliff asked if the truancy ordinance when through the school
board. Officer Helland stated the ordinance was not good. The ordinance allowed for

too many truancies before something was done (30+ truancies). He stated that
something else needs to be put in place as right now there is nothing in place to
enforce truancy unless it is in conjunction with a crime such as burglary by a truant
student. Officer Helland stated that his proposed ordinance would be enforced by
himself and the other school liaison officer. They would use discretion regarding
when to charge a truant student as a history has usually developed. Mr. Shaw stated
that such a policy is needed in Plano where he teaches.
Chairperson Spears stated that she is concerned about paragraph number 2. Ms.
Batterson stated that this is just a sample ordinance, not a draft proposed ordinance.
She stated that the Police Department would prepare a draft once they know that the
committee would support it. Discussion took place regarding changing the age to 17
and also including all schools within the city boundaries. Mr. Shaw added that he is a
high school teacher who is very frustrated that he can't do anything about truancy.
This sample would help to keep kids in school
Committeeman Sutcliff urged the community attendees (who are both involved in the
schools) to check the agendas online. She feels it would be good for them to get
involved. Ms. Sullivan stated that the school board agenda is also available online,
along with a description of what is considered an excused absence.

The meeting was called to order at 6:00pm by Chairwoman Rose Spears.
Prior to beginning discussion of the agenda, Chairwoman Spears asked the committee to
address the issues brought forth by Guest Lou Denny. Mr. Denny said his landlord for
Mulhern Court has created a dangerous situation at the apartment complex because he
does not salt the parking lot though he does plow the lot and the sidewalk. The Chief
suggested that Mr. Denny review his lease agreement to see if snow removal is
addressed.
Mr. Denny also said he was made aware that residents of Yorkville are not required to
remove snow at their residences. Chief Martin said the Police Department is unable to
force the removal. Mr. Denny stated that Aurora requires removal of snow on all
walking surfaces. According to Chief Martin, Aurora is required to remove that snow
because they are a home-rule community, but he said many places don't salt due to
deterioration of surroundings and the cost of salt. In addition a special salt spreader is
required.
Alderwoman Spears said she contacted Alderman Joe Besco who suggested a letter be
sent to all the apartment residents asking if they would be willing to contribute to salt
purchase. Mr. Denny said he would be willing to purchase salt for the complex.
Ms. Spears will contact Mr. Denny after Joe Besco has a chance to address the issue.

Chairwoman Spears said a correction to the minutes had not been made as requested at
the last meeting. Page 1 , New Business, paragraph two, should state "Chairman Spears
asked Chief Martin to explain why Ron. . . "
The minutes were then approved with that correction.
New Business:
1. PS 2008-50 Police Reports for October 2008
It was noted that arrest activity went down slightly, however, Chief Martin said his
department is working on some cases and results should be seen next month. This report
moves to the consent agenda on December 22.
2. PS 2008-51 Request,for Purchase of Two Squad Cars
Chief Martin said 4 squads are budgeted, however, there are funds for only 2 at this time.
Alderman Werderich asked why Crown Victorias were ordered rather than Impalas.
These cars will be used to carry the canine cages, however, Impalas will be purchased in
the future. This moves to the December 22"d consent agenda.
3. PS 2008-52 Ordinance Amending City Code to Amend Hours of'Package Liquor
Sales
Alderman Plocher said patrons are traveling to other towns for liquor purchases after the
closing hours. Amending the hours until 2:00am on Friday and Saturday would be
consistent with other towns, he said. Alderman Werderich stated he was not in favor of
this. This item will move forward to the December 22"d regular agenda.
4. PS 2008-53 Ordinance Amending City Code regarding BASSET Training
This matter was brought forward by the Mayor and would provide training at no cost to
anyone who serves alcohol on their job. The training involves 6 hours of time and a meal
is donated by area businesses. It was noted that anyone 19 years old can serve liquor,
however, you must be 21 to sell alcohol.
A 2-month time limit for training will be included in the ordinance and Lt. Schwartzkopf
was asked to notify all Aldermen when the training is scheduled. This item moves
forward to the consent agenda.
5. PS 2008-54 Ordinance Amending City Code Regarding Dogs Running at Large
This item was placed on the agenda by Mayor Burd. At a recent adjudication session she
attended, a resident had received a ticket for dog at large. The offender felt tickets should
not be issued for dogs in their own yard. If the yard is fenced or has an electronic fence
the dog can be unleashed. Mayor Burd said the Hearing Officer also had concerns about

this ordinance. And it was noted that the Hearing Officer cannot use their discretion—
they must follow the ordinance.
Chief Martin pointed out that when children are outside, dogs may leave their yards to
follow them or dogs may run into the street. And, they have also followed elderly
people. He said they have responded to numerous dog bite cases. Mayor Bard suggested
that many residents might not know that allowing your dog to be unleashed in your yard
is illegal and Ms. Spears suggested it should be publicized.
Chairwoman Spears suggested the original ordinance should be included in the packet to
allow for a chance to review it. This item will be moved forward to the regular Council
agenda for discussion.
6. PS 2008-55 Truancy Ordinance Discussion
This was briefly discussed at a prior meeting with some recommendations being made.
Officer Jon Helland has further information, but was unable to be at this meeting, so it
will be brought back to the Public Safety meeting on January 22.
7. PS 2008-56 Amendments to Fine Schedule.for Pre-Payments of Citations Pending
Under Administrative Adjudication
The fine scheduled was briefly discussed and it was noted that the major difference on a
first offense was that the original fine was $50. This was thought to be too high. This
item will move forward to the Council consent agenda.
Old Business :
I. PS 2008-46 Code Amendment Ordinances
a) Advertising on signs and buildings, b) Fireworks, c) Possession of paint or marker
with intent to deface, d) Removal ofgraffiti, e) Cannabis, fi Retail theft
(shoplifting), g) Disorderly conduct, h) Trespassing on property
Chief Martin said this amendment would allow some offenses to be placed into the
adjudication process. The advantage of having the offenses go to the adjudication
process is fewer manhours, less officer court time and backlog, not on offender' s record,
allows the officers more discretion and ability to work with offenders.
Alderman Werderich said he would be in favor of only incorporating non-jailable
offenses in this ordinance. He was also concerned with the possibility of the offense
showing on the State Police LEADS system and becoming part of a criminal history. He
said he has seen ordinance violations on the computer. Chief Martin said if a community
is home-ruled, this may occur, but he will research this. He said Yorkville does not
report ordinance violations to the State.
It was decided to move this to City Council regular agenda for further discussion.

Additional Business:
Alderman Werderich expressed concern that not all City departments are using the
adjudication process. He asked if the Police Department could take the lead role in this.
City Administrator McLaughlin will also give direction to department heads.
Alderwoman Sutcliff asked about a recent school search for drugs. Chief Martin said the
canine units were utilized, but no drugs were found. Ms. Sutcliff said she had
information that drugs were more prevalent in the schools.
In earlier meetings, this committee decided these meetings would be informal.
Chairwoman Spears said it was brought to her attention by the Mayor that a formal
committee protocol including motions etc. should be used. Ms. Spears said that Robert's
Rules state that a formal meeting is not required. She asked the committee members for
their opinions and it was decided by consensus that they prefer informal meetings.
Chief Martin mentioned that following a recent heavy snowfall, 8 vehicles were towed as
a result of parking violations. Additionally, 26 citations were issued for parking on
certain roadways in violation of the 2-inch snowfall rule. He said the cadets also assisted
motorists.
There was no further business and the meeting was adjourned at 7:30pm.

I am writing to thank you for the prompt and efficient service we recently received from your
Department. As a retired police officer, I know that the quality and timeliness of leads regarding
crimes committed can make all the difference in an investigation.
Our company, Absolute Software, is the developer of Computracep Lcjack® for Laptops
patented computer theft recovery software. We have helped law enforcement recover over 5000
stolen computers. Quite often, the computers are recovered along with other proceeds of crime,
including other stolen property, counterfeit money, narcotics and weapons. In many of these
cases, subjects have been arrested on outstanding warrants and parole violations. This joint
success largely depends on the cooperation and quick response time of police departments such
as yours. I believe this clearly emphasizes the principles of Crime Prevention and Community
Policing and illustrates the success that can be achieved when joint effort is applied.
As you may be aware, a computer belonging to one of our customers was stolen in Yorkville, IL.
On October 08, 2008 it contacted our monitoring center over the Internet. Our Computrace
software identified an IP address and an Absolute Theft Recovery Officer supplied that, and other
supplemental information to Detective Stacey Mott. The subscriber information was subpoenaed,
supplemental information verified, identifying the user in Yorkville, IL. Detective Stacey Mott
successfully concluded the case when they recovered the computer on October 10, 2008.
Please pass on my compliments to Detective Stacey Mott, whose diligence and investigative skills
helped put a dent in property crime. The Theft Recovery Team looks forward to working with
your department again.

Dear Chief Martin,
I would like to request participation from your departments K-9 Unit(s) in a K-9 search I
am organizing for the Minooka School District#111, to be held on a date as yet to be
announced in late February or early March of this year. The event is a routine practice
done one to two times per school year at the discretion of the administration. As has been
past practice, we wish to keep the event date unannounced to school staff and students.
The school district includes the Minooka Community High School(MCHS) Central
Campus (Junior/Senior) in Minooka and the newly constructed MCHS South Campus
(Freshman/Sophomore) in Channahon, approximately 2 miles from the MCHS Central
Campus. The Minooka School District 111, the respective facility principals, and the
Channahon Police Department School Resource Officer have authorized me to coordinate
the K-9 search for both schools. Although the Channahon Police Departments School
Resource Officer has allowed me to coordinate the search, the Channahon Police
Department will be wholly responsible for the event at the MCHS South Campus location
within their jurisdiction.
I am hoping to get enough participation from various departments K-9 Units to be able to
search both schools simultaneously at the school district's request. If I cannot get enough
participation for a simultaneous school search, I would like to have enough participation
to cover the central campus and parking lot in the morning, followed by a search of the
south campus in the latter part of the day. Due to the south campus being a
freshman/sophomore facility, they provide no school attendee parking. The south campus
would be a secondary consideration if canine unit participation was low, or a possible
secondary date set for the south campus if necessary.
Due to the close working relationship the Minooka Police Department has with the
Grundy County Sheriffs Department and K-9 Handler and Deputy Paul Clampitt,
Deputy Clampitt has offered to help coordinate the K-9 Officers. Deputy Clampitt has
made himself available to K-9 Officers wishing to participate through his personal
cellular telephone number (815) 405-9964. Deputy Clampitt has participated in previous
searches conducted at the MCHS Campus and is also familiar with several of the regional
K-9 Officers.
Assistance from your department would be greatly appreciated and I welcome any
questions from your department and staff as they come up. Further information will also
be made available to participating departments as they respond.

On behalf of the Yorkville Park Board and the Park and Recreation Department of the
United City of Yorkville, I would like to thank you very much for the generous donation
of $8,821 .98 to be used for the purchase and installation of the Code Blue Unit/Camera.
We are anxiously awaiting the arrival and installation of this unique security equipment
that will be placed in Riverfront Park adjacent to the Yorkville Dam. There is excitement
on our part, that the equipment will provide the ability for immediate access to public
safety officials in times of trouble. When the new dam and paddling bypass are
completed in 2010, Riverfront Park will attract more park users than ever before The
"Code Blue" equipment will enhance their safety and well-being while in the park or near
the dam.
The addition of this equipment to the park is an outstanding way to honor Bruce and
Mark. It will provide an emergency phone that is linked to the Yorkville Police
Department and a pan/tilt/zoom video camera capable of viewing the entire park and
dam. The city has taken an additional step to provide a Digital Video Recorder so that
camera images can be recorded.
I have been in regular contact with Mayor Valerie Burd and Yorkville Police Chief
Harold Martin, updating them on the status of the project. Both have been supportive of
this endeavor and are appreciative of your donation.
It's our belief that the presence of this equipment will assure that tragedies involving the
dam or the escalation of other dangerous situations will be greatly diminished, if not
eliminated altogether, due to the extremely quick means by which help can be contacted.

We can't imagine the pain of loss that the Sperling family has experienced due to
suddenly losing such two remarkable young men from your family. Our hearts continue
to be moved by their act of selflessness as they rushed to the aid of a stranger in desperate
trouble.
Through the Foundation's generosity in providing funds for this equipment, that supreme
act of giving, demonstrated by Bruce and Mark, lives on to assist others in emergency
situations for many years to come.

Last May the City Council passed two ordinances revising the section of City Code pertaining
to mobile food vendors,including ice cream vendors. Those ordinances, which detail the
the requirements for persons seeking and possessing such a license, are attached.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS, PROVIDING FOR THE REGISTRATION OF
MOBILE FOOD VENDOR UNITS
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing
non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970
and the laws of the State; and,
WHEREAS, it is in the best interests of the City that all food establishments that are readily
moveable are regulated in order to protect the health, safety, and welfare of its citizens.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 3 , Chapter 5 of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Article B :
ARTICLE B. MOBILE FOOD VENDOR UNITS
3-513-1 : DEFINITIONS : For purposes of this Article, the following words and phrases
shall have the following meanings ascribed to them respectively:
COMMISSARY: A catering establishment, restaurant, or any other place in which food,
containers, or supplies are kept, handled, prepared, packaged, or stored.
MOBILE FOOD UNIT: A vehicle-mounted food service designed to be readily
movable.
PUSHCART: A self-propelled vehicle limited to serving nonpotentially hazardous foods
or commissary wrapped food maintained at proper temperatures.
SANITIZATION: The effective bactericidal treatment by a process that provides enough
accumulative heat or concentration of chemicals for enough time to reduce the bacterial
count, including pathogens, to a safe level on utensils and equipment.
3-5B-2: CERTIFICATE OF REGISTRATION REQUIRED: Every person desiring
to engage in mobile food service within the city is hereby required to make written
application for a certificate of registration as hereinafter provided. It shall be unlawful
for any person to engage in mobile food service without having first obtained said
certificate of registration. Said certificate shall be carried by the applicant while engaged
in mobile food service and shall be displayed for inspection upon request.
3-5B-3: APPLICATION FOR CERTIFICATE:
A. Application for a certificate of registration shall be made upon a form provided by the
Office of the City Clerk and filed with such. The applicant shall truthfully state in
full the information requested on the application:
1 . Place of Residence; Social Security Number: Name and address of present place
of residence of the applicant and length of residence at such address; also business
address if other than residence address; also social security number and date of birth;
2. Identification: Copy of current state photo identification or driver's license;
3 . Name of Employer or Representation: Name and address of the person, firm, or
corporation or association whom the applicant is employed by or represents; and the
length of time of such employment or representation;
4. Description of Mobile Food Service: Description sufficient for identification of
the mobile food service provided by the merchant which the applicant will engage in;
5 . Time Period: Period of time for which the certificate is applied for;
6. Date of Previous Application: The date, or approximate date, of the latest
previous application for certificate under this chapter, if any;
7. Revocation History: Whether a certificate of registration issued to the applicant
under this chapter has ever been revoked;
8. Conviction of a Violation; History: Whether the applicant has ever been convicted
of a violation of any of the provisions of this chapter or the ordinance of any other
Illinois municipality regulating the activities of mobile food vendors;
9. Conviction of a Felony; History: Whether the applicant has ever been convicted
of the commission of a felony under the laws of the state of Illinois or any other state
or federal law of the United States;
10. Tax Identification Number: Each applicant shall produce an Illinois Department
of Revenue identification number for the retailers' occupation tax. No license shall
be issued if the applicant does not have an identification number except that no
identification number shall be required if a mobile food vendor is sponsored by or
working for a religious, educational, or charitable organization where such
organization is entirely a nonprofit organization and who can furnish the city with a
"Tax Exempt Number" and written proof of its "Tax Exempt Status;"
11 . Health Certificate: Any mobile food vendor shall be required to obtain a health
inspection certificate from the Kendall County public health department. Said
certificate shall be required to do business under a certificate of registration under this
title and chapter in the city of Yorkville.

12. Photo of the applicant: Each applicant shall submit a photo that must be the same
size as required for passports — 2 inches by 2 inches.
B . All statements made by the applicant upon the application or in connection therewith
shall be under oath.
C. The Office of the City Clerk shall require every applicant to submit to fingerprinting
by the police department in connection with the application for certificate. The
applicant shall pay the fee as set by the Illinois State Police for fingerprint
submissions.
D. The Office of the City Clerk shall cause to be kept an accurate record of every
application received and acted upon together with all other information and data
pertaining thereto and all certificates of registration issued under the provisions of this
chapter and of the denial of applications.
E. No certificate of registration shall be issued to any person who has been convicted of
the commission of a felony under the laws of the state of Illinois or any other state or
federal law of the United States, within five (5) years of the date of the application;
nor to any person who has been convicted of a violation of any of the provisions of
this chapter, nor to any person whose certificate of registration issued hereunder has
previously been revoked as herein provided.
F. Each applicant shall pay a two hundred ($200.00) application fee per application. No
application fee shall be charged of a mobile food vendor sponsored by or working for
a religious, educational, or charitable organization where such organization is entirely
a nonprofit organization and who can furnish the city with a "Tax Exempt Number"
and written proof of its "Tax Exempt Status."
3-5B-4: ISSUANCE OF CERTIFICATE: The Office of the City Clerk, after
consideration of the application and all information obtained relative thereto, shall, within
ten (10) business days of application, approve or deny the application. If the person does
not possess the qualifications for such certificate, as herein required, and the issuance of a
certificate of registration to the applicant would not be in accord with the intent and
purpose of this chapter, then the Office of the City Clerk shall deny the application.
Endorsement shall be made by the Office of the City Clerk upon the application of the
denial of the application. If the applicant is found to be fully qualified, the certificate of
registration shall be issued within five (5) business days of the application approval so
long as the application fees have been fully paid. Any certificate of registration issued
pursuant to this chapter shall expire one ( 1 ) year after issuance.
3-513-5 : MOBILE FOOD SERVICE :
A. Mobile food units or pushcarts shall comply with the requirements of this Article,
except as otherwise provided in this section. The health department may impose
additional requirements to protect against health hazards related to the conduct of the
food service establishment as a mobile operation, may prohibit the sale of some or all
potentially hazardous food and, when no health hazard will result, may waive or
modify requirements of this Article relating to physical facilities except those

requirements of Subsections (D) and (E) of this Section, and Sections 3-513-613 and 3-
5B-7B set forth below.
B . Pushcarts are not permitted except those that contain only ice cream and related
products.
C. Mobile food units serving only food prepared, packaged in individual servings,
transported, and stored under conditions meeting the requirements of this Article or
beverages that are not potentially hazardous and are dispensed from covered urns or
other protected equipment, need not comply with requirements of this chapter
pertaining to the necessity of water and sewage systems nor to those requirements
pertaining to the cleaning and sanitization of equipment and utensils if the required
equipment for cleaning and sanitization exists at the commissary.
D . A mobile food unit requiring a water system shall have a potable water system under
pressure. The system shall be of sufficient capacity to furnish enough hot and cold
water for food preparation, utensil cleaning and sanitizing, and hand washing, in
accordance with the requirements of this chapter. The water inlet shall be located so
that it will not be contaminated by waste discharge, road dust, oil or grease, and it
shall be kept capped unless being filled. The water inlet shall be provided with a
transition connection of a size or type that will prevent its use for any other service.
All water distribution pipes or tubing shall be constructed and installed in accordance
with the requirements of this chapter.
E. If liquid waste results from operation of a mobile food unit, the waste shall be stored
in a permanently installed retention tank that is of at least fifteen percent ( 15%) larger
capacity than the water supply tank. Liquid waste shall not be discharged from the
retention tank when the mobile food unit is in motion. All connections on the vehicle
for servicing mobile food unit waste disposal facilities shall be of a different size or
type than those used for supplying potable water to the mobile food unit. The waste
connection shall be located lower than the water inlet connection to preclude
contamination of the potable water system.
3-513-6: COMMISSARY:
A. Mobile food units or pushcarts shall operate from a commissary or other fixed food
service establishment and shall report at least daily to such location for all supplies
and for all cleaning and servicing operations.
B . The commissary or other fixed food service establishment used as a base of operation
for mobile food units or pushcarts shall be constructed and operated in compliance
with the requirements of this chapter.
3-5B-7: SERVICING AREA AND OPERATIONS :
A. A mobile food unit servicing area shall be provided and shall include at least
overhead protection for any supplying, cleaning, or servicing operation. Within this
servicing area there shall be a location provided for the flushing and drainage of
liquid wastes separate from the location provided for water servicing and for the

loading and unloading of food and related supplies. This servicing area will not be
required where only packaged food is placed in the mobile food unit or pushcart or
where mobile food units do not contain waste retention tanks. The surface of the
servicing area shall be constructed of a smooth nonabsorbent material, such as
concrete or machine-laid asphalt and shall be maintained in good repair, kept clean,
and be graded to drain.
B . Potable water servicing equipment shall be installed according to law and shall be
stored and handled in a way that protects the water and equipment from
contamination. The mobile food unit liquid waste retention tank, where used, shall be
thoroughly flushed and drained during the servicing operation. All liquid waste shall
be discharged to a sanitary sewerage disposal system in accordance with Yorkville-
Bristol Sanitary District rules and regulations.
3-513-8 : TIME LIMIT ON MOBILE FOOD VENDOR UNITS:
A. Mobile food vendors may conduct business from nine o'clock (9:00) A.M. to eight
thirty o'clock (8 :30) P.M Sunday through Saturday, including holidays.
B . Mobile food vendors are not licensed to conduct business door-to-door.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.

WHEREAS, the City adopted Ordinance No. 2008-38 establishing registration of all moveable
food establishments in order to protect the health, safety, and welfare of its citizens.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Ordinance No. 2008-38 of the United City of Yorkville is hereby amended by
deleting 3-513-2 of Section 1 of said ordinance and inserting the following in its stead:

to engage in mobile food service within the city is hereby required to make written
application for a certificate of registration as hereinafter provided. It shall be unlawful

Section 2. Ordinance No. 2008-38 is further amended by deleting paragraph B of 3-513-5
and replacing it with the following:

B. All food items available for sale and the price of each item must be posted on the
exterior of the mobile food unit or pushcart.
Section 3. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.

The purpose of this code amendment is to change the term of city issued liquor licenses to a
yearly license instead of semi-annual licensing. This change would allow us to do liquor
licensing once a year instead of twice. Please note that the license fees are not being changed,
only the term of the license.
3-3-5 : LICENSE FEES AND TERMS :
The license fees for licenses to sell alcoholic liquors in the city shall , with the exception
of subsections C and D of this section , be for each ensuing six (6) month period or
fraction thereof, payable semiannually in advance, and all licenses shall be issued for a

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS
REGARDING ADVERTISING ON SIGNS AND BUILDINGS
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3 , Section 2, Subsection 5, of the United City of Yorkville Code of
Ordinances is hereby amended by deleting it in its entirety and replacing it with:
5-3-2-5 : ADVERTISING AND SIGNS ON BUILDINGS:
A. No person shall post, stick, stamp, tack, paint, or otherwise fix, or cause the same to
be done by another person, any notice, placard, bill, handbill, sign, poster, card
advertisement, or other device calculated to attract the attention of the public, upon
any building or part thereof, wall or part thereof, or window, without first obtaining
the authority of the city council and the written consent of the owner, agent, lessee, or
occupant of such premises or structure, and provided, further, that this section shall
not apply to advertising matter upon billboards owned or controlled by private
individuals.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS REGARDING FIREWORKS
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3 , of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 11 :
5-3-11 : FIREWORKS :
A. It shall be unlawful for any person to sell, keep, expose for sale, loan or give away
any substance of articles of any explosive nature designed or intended to be used as
fireworks such as any toy pistol, toy gun, toy cannon, blank cartridge, or any
fireworks, firecrackers, torpedoes, bombs, squibs, rockets, pinwheels, fire balloons,
Roman Candles, detonating canes or ammunition therefore, anywhere in the city.
B. It shall be unlawful for any person to be possessed of or to discharge anywhere in the
city any of the items enumerated in the above paragraph of this code; provided,
however, that they mayor and city council may issue a permit for the discharge of
fireworks and for pyrotechnical displays.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS
REGARDING TRESPASSING ON PROPERTY
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3 , of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 12:
5-3-12: TRESPASSING ON PROPERTY:
A. No person shall enter into or upon any lot, block, or tract of ground in the city which
is under cultivation, unless such person be an owner, lessee, or person entitled so to
enter, or the duly authorized agent thereof, and any person found by the police in and
upon any such premises shall be treated as a trespasser unless he can produce
satisfactory evidence of ownership or right to be in and upon such premises.
