ALSO PRESENT:

of The Record and the following residents from the City of Yorkville or Kendall
County: Charles Walker, Kim Brengman, Ed Brengman, and Darren Decatoire.
Chairperson Werderich called the meeting to order at 6:06 p.m. However, without a quorum,
only discussion can take place. He informed the members of the public that they were free to
speak at tonight' s discussion, however, no action would be taking place and further
discussion will need to take place at the next scheduled meeting. Mayor Burd noted that item
1 under Old Business (Off Street Parking Regulations) is on the Plan Commission agenda for
a Public Hearing on September 24, 2009.

NEW BUSINESS:
1. PS 2009-25 Police Reports for July, 2009
Due to lack of a quorum, this item was skipped and will be moved to the next
agenda.
2. PS 2009-26 Discussion on New Video Gaming Act
Lt. Hart stated that he has looked into this matter and found that the Gaming
Board does not yet have rules in place and that it may be 2 years before that
happens. He recommends that the City take no action at this time. He stated that
Chief Martin and Sgt. Groesch are in agreement with him.

Sgt. Groesch stated that the Illinois Municipal League has a lot of information
"regarding this matter regarding funds received, compliance checks, etc. and that
they also feel it is premature for any decisions to be made now.
Lt. Hart stated that the laws may be so restrictive that many establishments may
not want to be a part of it. Chairperson Werderich asked if licenses are issued
through the City, to which Lt. Hart replied that it is believed that all licenses
would be issued through the State of Illinois. Chairperson Werderich asked if the
City had the right to regulate the amount of gaming machines. Sgt. Groesch
stated that 5 machines would be allowed per liquor license and that there is a fee
of $25 .00 per unit, per year for the permit. Further discussion took place
regarding the amount of funds that would be given back to the City. It is a small
amount, 1 /6 of 1 %.
Discussion was open to the public:
Mr. Darren Decatoire stated that he works in the gaming industry and feels that
the City should not take a stand at this time. He feels that once the rules and
regulations have been established, the City could better decide if this would
benefit the City or not and then decide whether or not to opt out. Furthermore, he
stated that studies have been done that prove that allowing video gaming does not
ruin communities or increase their crime rates. Studies prove that there is no
evidence to support what the opponents are saying. Alderman Gilson asked Mr.
Decatoire what part of the industry he is involved with, to which he replied the
coin operators industry. Alderman Gilson asked if the City holds off at this point,
then what happens. Mr. Decatoire stated that nothing can happen until the rules
and regulations are in place. Because of the new law, this will be highly
publicized. The City can choose to act at that time.
Mr. Decatoire asked how many establishments are within the City limits. Sgt.
Groesch stated 31 . He stated that any funds that comeback to the City annually,
the City could do with those funds whatever they choose.
No action was taken at this time.
3. PS 2009-27 Draft Ordinance Amending City Code Regarding Number of
Package Liquor Licenses
4. PS 2009 -28 Ordinance Approving Fine Schedule for Pre-Payment of Certain
Fines Pending Under Administrative Adjudication
These items were moved to the next agenda due to lack of a quorum.
5 . PW 2009-85 Traffic Study — Church and W. Main Street — Informational
The traffic study shows that the yield signs should be flipped and placed on W.
Main Street rather than on Church. This item is informational only.
6. PW 2009-86 Traffic Study — Kylyn's Ridge — Informational
The traffic study shows that no action needs to be taken. This item is
informational only.
7. PW 2009-87 Traffic Study — Van Emmon and Heustis — Informational

The traffic study shows that the stop signs need to be switched at this location.
Warning signs will be placed at the intersection informing motorists of the
change.
OLD BUSINESS:
1. CC 2009-75 Off Street Parking Regulations — Draft Zoning Ordinance Text
Amendment
Chairperson Werderich stated that no action can be taken; however, the discussion
will be opened to the public:
• Mr. Ed Brengman stated that he doesn't understand why the City had allowed
this to become a pathway. Alderman Gilson stated that Tommy Hughes Drive
is a private roadway on private property.
• Mrs. Kim Brengman asked what rules and regulations apply to private
property. Mayor Burd stated that trucks are not allowed to park in a
residential area. The subject area is zoned commercial.
• Mr. Brengman stated that the subject road is an easement. Mayor
Hurd contends it is a private roadway. Mr. Brengman asked if it's
private, why do vehicles drive and park on it. Mayor Burd stated that
the property owner lets them. It is a private roadway on his property.
• Mrs. Brengman stated that they see trucks parked their every day. She
stated that at the present time, there is a truck blocking the entire road
as it is on the driveway and roadway. Chairperson Werderich stated
that he has seen trucks parked all over the place their and that the City
is going to try to do something about it.
• Mrs. Brengman stated that when she has been over there, she sees the
truckers drinking alcohol in their trucks. She has lived across the
street for 5 years and it is getting worse. She feels that the truckers
should have respect for the community.
• Mr. Brengman stated that there is trash their all the time. It is not a
parking lot and something should be done.
• Mrs. Brengman stated that it is being used as a truck stop, which it is
not. There is garbage all over the place, the truckers drink and sit there
all night.
• Mr. Brengman stated that a neighbor who is an over-the-road trucker
parks his truck there for days at a time.
• Mrs. Brengman added that construction equipment is also parked
there.
• Mr. Brengman stated that the idling all night is a public nuisance.
Mayor Bard stated that gas station is a truck stop. Mr. Brengman
stated that Mr. Dettmer informed him that the gas station is zoned as a
gas station, not a truck stop.
• Mrs. Brengman stated that it used to be used for overnight parking
during inclement weather, but as the town has grown, trucks are now
parked there all the rime.
• Mayor Hurd stated that she has resided here for over 23 years and the
City has always been a blue-collar community. Most residents worked

at Caterpillar or were farmers. Those residents did not want growth
and back then, there were always a lot of trucks. She does not want
this to become an anti-truck situation as everything we use is brought
to us by trucks. If the City takes away where they park, then we have
to find a new place for them. We need to consider everyone' s needs.
• Mrs. Brengman stated that most of these truckers are not paying taxes
to our community.
• Mr. Charles Walker stated he following:
• He is not against truck drivers. In fact, prior to his retirement, he
was a district manager that dealt with over 125 trucks per day. His
employer had a trucker lounge and he found that most truckers
were good. However, even after he put out 50 gallon trash
containers and bags, he still found trash dumped in the parkway
(food wrappers, booze bottles, etc.). He had to have 3 employees
pick up the trash every morning. Additionally, some truckers
would urinate or defecate in the parking lot.
• The subject location is a probable breeding pool for mosquitoes.
• The trucking situation at Rt. 47 and Rt. 71 is a safety issue.
Because of a truck parked on Tommy Hughes Drive, other trucks
can't get around it so they pull onto Rt. 71 .
• The signs that are up are unreadable.
• The minutes from the last meeting state that the area will be
cleaned up by the owner. The owner says that the clean up should
no be his responsibility because it' s from Shell customers.
• There are no receptacles for trash.
• At a prior City Council meeting, I was disturbed that officials say
that trucks take 250 gallons of gas and it's being purchased here.
Additionally, at that meeting, the Mayor stated that she received 5-
6 phone calls regarding this matter. That does not take into
account the number of calls to Aldermen.
• Most drivers are not keeping legal logs.
• Fox News did a report on `Big Rig Serial Killers' regarding an FBI
report regarding murders being done by truckers. There are over
500 murders or kidnaps done by truckers. In Missouri, a trucker
was convicted of murder and he admitted to 12 other slayings. The
FBI program started in 2004 and currently they have a list of over
200 truckers that are potential murder suspects. In Illinois, there
are 12 unsolved murders, 8 of those cases are within 60 miles of
Chicago. These are motiveless crimes and truckers are hard to
catch because of the mobile crime scene. Many victims are found
miles away from where they live.
• He feels that the elected officials are not looking out for the
welfare of the community. He asks that the elected officials do the
right thing and not sell out the residents for the truckers.
• Alderman Gilson stated the following:

• He presented photos to the committee of what has been going on in
the subject area. He would like them included in the next
discussion.
• The trucks have been a real nuisance to the residents.
• Shell states that not allowing the trucks to park there would `kill
their business' ; however, most of the garbage in the area is from
McDonalds or empty alcohol bottles.
• Parking is being done in a hazardous way.
• 1 spoke to people in Pontiac, Dwight and Kankakee (truck stop
locations) and their biggest problem is with waste haulers.
• He is also perturbed by comments made by the City Council such
as ` I would rather them stop at Shell then drive through Yorkville
and kill someone' or `the gas station has always been a truck stop'
or `impede business' . With regards to comment 1 , if the truckers
are that tired, they should have driven this far. With regards to
comment 2, it is a gas station as there are no showers, etc. With
regards to comment 3 , my response is no it will not.
• He stated he is trying to resolve resident concerns of trash,
standing water, trucks being parked on both sides of the entrance.
These are public safety hazards and a breeding ground for
problems.
• This is a real issue and if it does not go forward to City Council to
pass a citywide ordinance, it will continue to be a nuisance to the
residents and a safety issue to the community.
• Committeeman Plocher stated that he agrees that if Shell is
a problem, they should be dealt with, but that this should
not be handled through a citywide ordinance. Alderman
Gilson stated that the hours of 10-4 are reasonable and that
without facilities for overnight truckers, they have no
reason to be there. Committeeman Plocher stated that this
one problem should not result in a blanket city ordinance.
Mayor Burd stated that those in attendance should not pick
on Committeeman Plocher. Chairperson Werderich
advised Committeeman Plocher that if he felt
uncomfortable he should let him know.
• Discussion took place regarding the agreement already
signed with Shell Gas Station. Shell needs to purchase and
install the signs, but an agreement is already in place.
• Mr. Walker stated that comments made at the City Council meeting
are being reiterated here. He asked the group to read the Preamble,
which starts `We the People . . . ' . He feels as though the City Council is
not acting on behalf of the people.
o Mayor Burd stated that it goes back to what she stated
before, that it would be hard for trucks to park in Morris
and drive 40 miles back here. If we eliminate truck

parking, it will not address the litter and puddles. It will
not solve the problems.
o Alderman Gilson stated that the litter is a direct result of
the trucks. He stated that we need to eliminate the source
to eliminate the problem. There is a facility in Morris, the
trucks should be there. Mayor Burd stated that the
ordinance will not stop the trucks to which Alderman
Gilson stated it will at least cut down on the trucks.
Chairperson Werderich stated that no action can be taken; however, he agrees that
there is a problem. Personally, he stated that his first thought is that the truck stop
was there long before everything around it, however, there has been a significant
increase in trucks and the area is beginning to deteriorate. He informed the
attendees that the ordinance is being considered and the problem will be taken
care of

MINUTES :
The minutes of July 23, 2009 meeting were approved as amended.
NEW BUSINESS :
1. PS 2009-25 Police Reports for July, 2009
Chairperson Werderich noted that vehicle registration and seatbelt violations have
almost doubled. Chief Martin stated that there were 2 officers in the traffic unit
whereas previously there was only 1 ; therefore, there has been more activity.
Chairperson Werderich noted that the overtime detail states `detail' in the
comments section and he would like to more clarification. Chief Martin stated
that it means details in which the Police Department is reimbursed such as the
church detail or school detail.
Committeeman Spears noted that there appears to be many dog complaints. Chief
Martin stated that they have been busy with animal complaints such as running
loose, barking, etc. It tends to pick up in the summer and slow down again in late
fall through the winter.

2. PS 2009-29 Police Reports for August, 2009

Chairperson Werderich commented that the Police Department received and sent
a lot of nice letters. Chief Martin stated that he is happy with the response from
people and area agencies. Committeeman Spears asked if officers are rewarded
for their efforts. Chief Martin stated that copies of the letters are placed in their
files and are used during the evaluation process. Additionally, extraordinary
efforts are rewarded with certificates. Chairperson Werderich stated that there
was quite a heroic situation in August. Chief Martin stated it was handled well.
Chief Martin wished to note that grant funds are requested in order to provide
equipment for the department without having to request funds from the City.
There was a grant match in the amount of $2500.00. Grants help in keeping the
capital expenses down. Chairperson Werderich stated that the committee
appreciates when the department looks for alternative revenues sources.

3. PS 2009-27 Ordinance Amending City Code Regarding Number for Package
Liquor Licenses
Chairperson Werderich stated that there is a set amount of licenses approved for
the establishments within the City, plus 1 additional for the establishment at Rt.
34 and Cannonball Trail. Since that establishment will not be moving in, it is
requested that the number of licenses be reduced to 8 .
This item was removed to the Consent Agenda.
4. PS 2009-28 Ordinance Approving a Fine Schedule for Pre-Payment of
Certain Fines Pending Under Administrative Adjudication
Chief Martin stated that the Department would like for people to have the option
to pre-pay fines for ordinance violations instead of everyone having to come to a
hearing. It will help clean up paperwork too.
This item was moved to the Consent Agenda.
5 . PS 2009-30 Request to Dispose of 2002 Chevrolet Impala
Chief Martin stated that the vehicle has been used by the cadets; however, it is
now in need of a transmission as it only has l " 2"d and reverse. It will cost
approximately $2500.00 to fix it and the car is currently worth approximately
$50041000. The vehicle has 128,930 miles on it. If it goes to bid, the City could
request a minimum bid, however, a local junk yard is willing to give us $ 1000.00
for the vehicle. The last one that went to bid only got $500.00, so selling it to the
junk yard would be great.
This item was moved to the Consent Agenda.
6. PS 2009-31 Continued Participation in KenCom
Chief Martin stated that there was a meeting with the KenCom Executive Board
and other agencies to decide if we should stay with KenCom. The contract states
that Kendall County will cover the costs indefinitely. Due to growing issues, we
were looking at our ideas and theirs, and we will be having another meeting.
Chief Martin suggests staying with KenCom as it would be very costly to use

another agency. Committeeman Spears stated that the number I concern is office
safety and public safety. Furthermore, she will continue to keep the committee
apprised of information as she is the KenCom Liaison.
Chief Martin stated that this was information only and no action is requested at
this time.
7. PS 2009-32 Ordinance Amending City Code Regarding Towing of Vehicles
Chief Martin is asking the committee to consider an administrative towing fee,
which is the main change to this ordinance. Many agencies tow vehicles for No
Valid DL, DWLS, and other criminal acts. This would be a charge for
administrative fees that needs to be paid before the vehicle owner could get their
vehicle back. Most agencies charge $500.00, which is what is being requested.
He stated that this is a way for the department to offset the charges for officers
during arrests and their time involved with the case.
He discussed the difference between seizing vehicles which is done for felony
arrests. Also, he added this would not involve vehicles towed for snow ordinance
violations, only vehicles involved in crimes.
The committee is concerned that the funds would be put into the General Fund
and not returned to the Police Department. Committeeman Spears stated that she
has a similar concern regarding the adjudication process as the funds collected are
going into the General Fund. Chief Martin stated that he suggests that any funds
collected be returned to the Police Department fund, as well as funds collected for
the adjudication process.
As the budget is currently being reviewed, it was suggested that all expenses and
fees collected from the adjudication process be put into the Police Department
budget, as the committee feels the General Fund is being mismanaged at this time.
A recommendation could come from this committee, however, not from this
agenda item. Therefore, this issue will be placed on the next agenda item for
further discussion,
With regards to the towing issue, the committee recommendation will be that
funds collected will be placed in the Police Department budget.
Chairperson Werderich stated that he had issues with a few items in the draft
ordinance. The first item is section 6-5-3 states that vehicle owners will be
contacted by fax or email and he feels that is inappropriate. Chief Martin stated
that it should only read ` letter or telephone' and that letter would be the preferred
form of contact, however, if the vehicle owner is out of the state, then contact
would be made via telephone if possible. Chairperson Werderich asked if letters
are sent via registered mail. Chief Martin stated that they are not, but that good
records are kept regarding this matter.

Chairperson Werderich stated that he is also concerned about Section 6-5- 1
Abandoned #1 . Chief Martin stated that he only received this draft copy in the
last 2 days and that he too had concern about this section, but has been unable to
contact Attorney Orr. He stated that he would be willing to remove that language.
It was determined that item # 1 would end at `being driven. '
Another concern was Section 6-5- 1 Owner #1 and #2. He feels that the language
belongs somewhere else as it does not make sense here. Chief Martin will look
into this matter,
Discussion took place regarding the fee amount of $500.00. Some committeemen
felt the fee was too high. Chief Martin stated that it is the standard in the suburbs
and he was trying to stay along the lines of every other department. It was
determined that the amount would stay at $500.00 and the City Council would
then have the opportunity to voice their opinions.
Committeeman Plocher asked what abandoned vehicles have to do with vehicles
in disrepair or vehicles for sale. Minute Taker Hartigan stated that those vehicles
would not be along a roadway, therefore, it does not apply. Committeeman
Plocher stated that he had no other concerns then.
Alderman Gilson asked if the ordinance could stipulate that the funds needs to be
returned to the Police Department. Chief Martin stated that it would be
administrative and not in the ordinance. He said that it may be a policy set by the
budget process, but he would look into the matter.
Committeeman Plocher asked if this item could be returned to the next agenda
since there were some issues. Chief Martin stated that he would get the answers
that the committee is seeking.
The discussion returned to the Adjudication Hearing process and the funds
collected from same. Committeeman Spears stated that she had been informed
that revenues collected would be returned to the Police Department. Chief Martin
stated that there are specific line items for expected revenue and actual revenue.
Committeeman Spears suggests discussing this matter at the budget meetings.
Chairperson Werderich stated that he would speak with Alderman Sutcliff and
inform her that if it is possible to put in the ordinance where the revenues should
be listed, that is what this committee prefers.
8. PS 2009-33 Committee Liaison Review
Committeeman Munns requested discussion of this matter, as he is not in
attendance, this item will be moved to the next agenda. However, it was
determined that Committee Spears will take over the School District Board if he
is not interested in being liaison to that committee. Chairperson Werderich will
check with him and advise.

OLD BUSINESS :
1. CC 2009-75 Off Street Parking Regulations / Draft Zoning Ordinance Text
Amendment
This item has been previously discussed in the past. It is time to determine where
to go from here. Committeeman Plocher stated that he feels it is best to remove
item #2 from the draft ordinance as he doesn't think it' s is anyone's intention to
stop people from doing their jobs. The ordinance as written does not allow people
to own or have construction equipment. Additionally, he stated that even if the
ordinance is changed, he would not be in favor of it. Chief Martin stated that it is
not the intent to put people out of work.
Chairperson Werderich stated that without 3 votes, this item can not move out of
committee. With 1 member absent, and 1 not in favor, he doesn't think that it
requires discussion at this time. Committeeman Spears stated that she would like
this item to move out of committee and be discussed at the City Council level.
Chairperson Werderich opened the discussion to the public:
• Mr. Ed Brengman stated the following:
• This is not a truck stop and it's not about money. It is about the
health and welfare of the neighbors.
• Presently, signs are posted prohibiting 24 hour parking, yet nobody
does anything about it. There are currently 9 trucks parked there.
• This is private property, but it is zoned for business. No business
is on that property so why are the trucks being allowed to park
there?
• Curtains are drawn on the trucks and they are there to camp out.
• Alderman Gilson stated the following:
• He has distributed photos in the past and has more to distribute.
He would like everyone to review them again.
• This is not about being against truckers; it is about the residents in
the area.
• There is a photo of a dropped trailer on Tommy Hughes Drive.
That does not belong there.
• The trucks are parked 4x4 on the entrance drive. This is a main
access and thoroughfare. When 4 trucks are parked there, it is a
safety concern.
• There are holes in the ground and standing water.
• He knows the area well and there are trucks there all day long and
all night long.
• There is a photo of a tanker truck at the end of Rt. 71 and Tommy
Hughes Drive. Other drivers are not able to see around it. It is
dangerous.
• Another issue is idling. Kendall County is the only county exempt
from the state idling law. We are exempt from it, but Oswego
Township is not. The law allows for no more than 10 minutes of
idling per 60 minutes.

• Idling all night wastes fuel and is a noise nuisance. Many cities
have idling ordinances. We have a city ordinance regarding our
own vehicles, so why do we allow other to do it?
• Alderman Gilson read a statement (see attached).
• He asked that the committee please consider this item again.
Committeeman Plocher stated that he agrees there is a problem, but a citywide
ordinance is not the way to handle it. With regards to the trash, the violators
should be given ordinance violations and subject to the adjudication process.
Chief Martin stated that the trash is an issue that Community Development
handles and there is not a representative from that department here to discuss it.
Chairperson Werderich stated that in summary he feels that the concerns are trash,
parking and idling. Chief Martin stated that with regards to idling,
Building/Zoning would need to make sure that we are able to establish an
ordinance.
With regards to the parking issue, Chairperson Werderich asked if vehicles
needed to be parked in designated parking areas. Chief Martin stated that on
private property, the Police Department is only allowed to ticket vehicles illegally
parked in handicapped spots. Other than that, they can not enforce parking.
Alderman Gilson stated that since the Hughes Family also seems to be against the
parking, why can't the City approach them about dedicating the property to the
City so that we can control the roadway? Chief Martin stated that he does not
believe that the roadway and parking lot meet standards and there would be a cost
to maintain the property. Discussion took place regarding the City's authority
with regards to this property. The City had to approve the naming of the roadway
and installation of the street sign, but other than that it is private property and the
City has no control. Chief Martin stated that the Police Department can enforce
the stop signs at the entrance and any handicapped parking signs.
Committeeman Plocher asked what the cost of the proper signage is. Chief
Martin stated that he believed it to be approximately $200.00 per sign. He
suggested that the City purchase the signs and have them installed. Chief Martin
stated that it would only control the problem during specific hours.
Committeeman Plocher stated that issues pertaining to the trash should be
forwarded to the Public Works Committee. Chief Martin stated that Travis would
then be available to speak about the zoning aspect.
Alderman Gilson stated that Chief Martin previously stated that the roadway is
not up to specific standards. He is concerned that trucks are driving on the
roadway. Chief Martin stated that since it is private property, there is nothing the
City can do about it. Committeeman Plocher stated that the Public Works
Committee would also look into this matter. Chairperson Werderich stated that
the property is zoned B-3 and therefore parking is allowed there. Mr. Brengman

stated that since a business is not located there, it should not apply. The
committee feels that this is a good point and suggested that Mr. Travis Miller be
in attendance at the next meeting.
The committee determined that the language should be changed as follows:
#2. All vehicles weighing 15,000 pounds or more shall be restricted from parking
in any business district between the hours of 10 :00 pm and 4:00 am unless under
repair or actually engaged in loading or unloading any material or product
required by such business or establishment or used solely for the parking of
vehicles of owners, employees, agents, contractors of the business or
establishment.
This item will be moved to the City Council agenda for discussion with the above
change.

Alderman Gilson — with regards to the trash enforcement, what is the best way to
have it enforced? Committeeman Plocher stated that he could contact Paul.
Alderman Gilson asked if he could contact him directly, to which Chairperson
Werderich and Committeeman Plocher both agrees that he could.
Chairperson Werderich — there seems to be a problem with the meeting schedule.
After discussion it was determined that this committee would meet the 4"' Thursday
of the month. The next meeting will take place on October 9, 2009 at 6:00 pm.
Chairperson Werderich will make sure the permanent change is acceptable to
Committeeman Munns first.
Chief Martin — trick-or-treat hours are from 4:00 pm — 7:00 pm on October 31 , 2009,

I was also told by a resident who spoke to a manager at Shen, that a certain elected official took it upon
herself to speak to Shell after a :'event public safety, m eeting and told She'd that they do not have to sign
tfor agreement that they originally agreed to sign for enforcement because the council does riot have
the vote to pass the propitiate ordinance through. This is the same ordinance and agreement that a lot
of time and effort had been spent on for a resolution to Committee. I find this disappointing because
that same elected official has preached that everything should be done through the committees, yet
unilaterally, she took it upon herself to contact the Shell and undo what we. have been trying to
accomplish in the committee by preventing them from signing the same agreement that the Hughes
family has signed for the adjoining property, In order for Yorkville to help regulate the issues. That same
elected official has been telling others that i have been kicked off the Shell property several times and '..
have been taking down their postings to the truckers, This is nonsense and false. I visit the Shell quite '..
often as a customer. I have never been kicked off the property nor confronted anyone or been '..
confronted by anyone at Shell. The only dialogue I have had with employees of the Shell station Is being
thanked across the counter for my purchases. 1 hive never Liken any signs or postings and out not
bullying anyone. '..
The it stop in Morris has 250 designated spaces for semi trucks there that are set aside towards the
rear of the stop, and away from residents. These track stops also have services offered to the truckers
for their trucks and the drivers. They also have appropriate waste receptacles, staff, showers, and
overnight amenities and facilities for the trucks parking there. The Yorkville Shell is riot a truck stop and
does not have these same offerings. In fact; they do not have, any designated parking spaces or separate
area for truckers. They also do not have any overnight amenities such as showers, services, etc....
The nuisances brought to the residents whom I have heard from and chosen to represent, in my opinion,
to outweigh the fact that truckers need a place to park overnight, or they are trying to get as close as
they can to their destination and park their trucks wherever they can, or places for thern to park
overnight are being taken away from them all over the country, which are the arguments I have heard
Inv not having this ordinance. These are arguments that are out of cut control. I have legitimized the
residents complaints from whom I have heard from myself, and feel they are warranted to Investigate
and regulate better.
This issues brought forth by these residents has been brought up to aldermen in the past. Our city
council has looked at regulating this before. The issue keeps resurfacing, and now it is time to tine a
resolution.
I am open to suggestions, but as of now, whimut the cooperation of the property owners by signing an
agreement with the city and posting signs to chief cc regulation and ticket offenders, this Issue has not
and will not go away. The residents I have spoken, in, and through my own observations, this issue has
gotten exponentially worse and will continue to do so in the future.
The ordinance on the table is fair in terms of hours that limit the trucks from parking overnight. It Is my
belief and the belief of the residents 1 am representing that iPuckers rolling in between 1D30 PM and
4;70 AM and parking at the Shell, should hove planned their routes better and given themselves more
time to get to their destinations. We have overnight trucking facilities 15 miles from here in Morris, and
Ottawa as well. If the argument Is made that this is a waste of their time and fuel, I apologize, but I feel
the issues that are being expressed by the residents outweigh the incenvenlence to the truckers.
if you look at cost, the fuel spent idling using the figures I mentioned earlier, far exceeds the cost to
drive to or stop at the truck stops in Morris or Ottawa, whicih are nearby our community and set up for
overnight semi parking.
I also keep hearing in the paper that the Lucke,,s are essential to mu local economy and good for our
community. I agree. My brother-ir,-law is a trucker. I am not against truckers, as sorne are trying to make
me out as. What I am against, and what the majority of residents that I have spoken to and have chosen
to represent are against, is the Issues that are brought to our community as a result of these fer„i's
being parked overnight at a facility that is not designed to accommodate them with designated
overnight parking, essential truck maintenance services, trash recepticals, staff, and overnight showers
and services. I also wanted to address one other argument I have heard. For those that say they would
rather have the semirs park at the Shell overnight, than drive down the road and kill somebody, I would
have to challenge this with the argument, if that same exhausted trucker made it to Rte 47 and 71 in the
condition of possibly killing someone if they drive through our town or 15 miles to the nearby truckstop,
then they .shouldn't have driven as for as Rte 47 and 71 in our town. That itself is a safety concern. I
asked myself several questions when I chose to represent these residents, and I would like you all here
tonight to ask the same questions of yourselves before you vote. Would you be upset if you had a house
facing these issues which I have taken pictures of and documented as real? Would you be upset if you
had to deal with these safety issues everyday when accessing the only gas station on this side of town
along with an access road to one of the very few essentiaf commercial outlets in this ward. I think that if
you are true to yourselves, the answer is vest 111 n

Dear Chief Martin,
I am writing this letter to commend Sgt. Terry Klingel and Ofc. Sarah Klingel, who deployed to the Group
of 20 (G20) Summit in Pittsburgh, Pennsylvania, from September 22nd to September 2611, 2009.
The Illinois Law Enforcement Alarm System (ILEAS) sent over 150 officers to this event upon a request from
the Pittsburgh Police Department. A total of twenty-nine (29) officers came from the Region 3 Central
Mobile Field Force. These officers were assigned to work side-by-side with Mobile Field Force units from
throughout Pennsylvania and around the Country during crowd control and other protest-type situations
that occurred throughout the City. These officers, along with all the ILEAS officers deployed to Pittsburgh,
displayed exceptional professionalism and fortitude,especially during the high profile and highly stressful
protests.
Officials from Pittsburgh and many other jurisdictions present at this event, expressed their thanks and
commented on the level of professionalism, readiness, and knowledge that ILEAS brought to this event.
Thank you for allowing your officers to participate on this Team, and to deploy to Pittsburgh, and again I

Dear Nominating committee;
On behalf of Senior Services Associates, I would like to take this opportunity to
nominate Sergeant Barry Groesch as Elderly Service Officer of the Year. Sergeant
Groesch has made significant contributions as the current president of Kendall County' s
TRIAD , Sergeant Groesch exhibits great determination when dealing with community
issues. His commitment to seniors is admirable; he is truly an asset to the Yorkville
Police Department and the senior citizens of Kendall County.
When the members of TRIAD bring a concern to the group on behalf of the
seniors in the community, Officer Groesch enthusiastically takes on the challenge and
develops a program. The TRIAD group, under the leadership of Sergeant Groesch, has
implemented several programs. Among these include a daily well-being check, Cells for
Seniors, and Medication Disposal program. All of these programs are offered to the
senior citizens of Kendall County with no cost to the senior. In addition, this year
Sergeant Groesch was able to obtain a donation from a local company in the amount of
$ 15,000 to purchase Knox Boxes for senior residents of Kendall County. These boxes
allow the fire department to gain entrance to the senior's home in an emergency.
Approximately 80 devices have been installed at the homes of local seniors.
Recently, the members of the Kendall County TRIAD brought concerns regarding
senior citizens who have received code violations due to the lack of lawn maintenance
and the concern for those seniors who have difficulties with snow removal. Sergeant
Groesch has agreed that this is a need, and is working with TRIAD and the Kendall Co.
State's Attorney to implement a program to assist senior citizens with this issue as well.

AN ORDINANCE AMENDING THE CITY CODE
OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,ILLINIOS
WHEREAS.,it is imperative that those persons operating vehicles do so in a safe manner with
the express permission of its owner;and,
WHEREAS,it is imperative that vehicles are not left unattended on public ways or are used in
connection with any prohibited conduct;and,
WHEREAS, it has been determined that if vehicles are abandoned or disabled, or used in
connection with any prohibited conduct,it is in the best interests of the general public that such vehicles
be removed or placed under the control orthe City's Police Department all as hereinafter set forth.
NOW,THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City
of Yorkville,Kendall County,Illinois,that the City Code be amended as follows:
Section 1. Section 6-2-7 of Chapter 2 of Title 6 of the City Code be deleted in its entirety.
Section R. The following new Chapter 5 is hereby added to Title VI of the City Code:
6-5-1: Definitions.
The following definitions shall apply unless the context clearly indicates or requires a different
meaning. Any term not defined herein shal l have the meaning ascribed to it in ILLS,Ch.625,Act 5.
Abandoned Vehicle.
(1) A vehicle parked or otherwise located on a public wayz in such state of disrepair that it is -_.— Formatted:strikethrough
incapable of being driven has no license plates and appears to have been abandoned; or a
vehicle that has been unmoved for a period of at least 24 hours,has no license plates or valid

abandoned by its owner;or;
(2) Vehicles parked in a public parking lot or on private property without the consent of the lot

towed.
Hazardous Vehicle.
1. A vehicle that has been involved in an accident and is disabled or cannot be immediately
moved by the owner or operator of the vehicle;or,
2. A vehicle that presents an immediate danger to the health or welfare of the members of the
public;or,

3. A vehicle abandoned or disabled on a public street or public way, that is impeding the
orderly flow of traffic or poses a potential danger to pedestrians and other operators of
vehicles;or,
4. A vehicle that must be moved to allow for proper municipal snow removal from a public
street,way or alley.
Owner. A person who holds legal title to the vehicle.
Unlawfid Vehicle. - Formatted:Font:Italic
1. A vehicle that has been reported stolen or is the subject of a search and seizure by the
Police Department;or,
2. A vehicle parked in violation of state statutes or ordinances of the City which
prohibit parking at the location in question or for the period of time for which the
vehicle has been parked, and where either the statute or the ordinance authorize the
vehicle to be towed,and the signs posted at the general location note that fact.
Vehicle. Any device in, upon, or by which any person or property is or may be
transported or drawn upon a street, highway, or any public way, except devices moved by
human power,devices used exclusively upon stationary mils or tracks,and snowmobiles.
6-5-2: Aulhorizationfor Towing.
A. Generally: The lowing of vehicles by the municipality, or by its approved towing service
operators on behalf of the City, shall be authorized only by the Police Department and only
under the circumstances herein provided. Towed vehicles shall be impounded at facilities
designated by the Police Department until lawfully claimed or disposed of pursuant to ILCS
Ch.625,Act 5.
R Towing withow notice; immediate tows. Hazardous or unlawful vehicles may be towed
without prior notice; except that,when an unlawful vehicle is one that has been reported as
stolen and is not towable for some other specific reason, the owner should be, when
practicable,notified by telephone or other means and given the opportunity to claim or move
the vehicle, if he/she so wishes, to avoid incurring the expenses of a police-ordered tow.
However, the vehicle may be towed if the owner permitted the tow to be made when the
vehicle was reported stolen or at any time thereafter. Within 24 hours after towing a vehicle
pursuant to this Chapter,a notice shall be sent to or personally delivered to the owner of the
vehicle affording the opportunity for a hearing,as provided in 6-5-4.
C. Towing with prior notice;abandoned vehicles. Abandoned vehicles may be towed after the
mailing or delivery of prior notice and the affording of an opportunity for a hearing as
provided in 6-5-4(c)of this Chapter.

6-5-3. Po-e-Tou,NoticefarAbandorved Fehiclm.
A. Notice pursuant to this section shall be personally delivered to the owner by personal

vehicles as indicated in the most current registration list of the Secretary of State.
The notice shall be in the form provided in 6-5-5. In the event that an out-of-state
vehicle is proposed to be towed, inquiry by computer, telephone, or letter shall be
made of the Secretary of State of the particular jurisdiction for the furnishing of the
most current registered name and address of the owner of the vehicle,and notice shall
be made as provided herein to the address furnished,though in no case will the City
be required to delay towing more than seven(7)days after the date of the mailing or
personal delivery of the notice if no request for a hearing has been received within
that seven-day period.
B. A notice of intent to tow sticker with the earliest date upon which the tow may take -
place and the address and phone number of the Police Department shall be placed on
the vehicle.
6-5-4. Pre-lbw/fearing Procedures.
A. Opportunity for hearing. The owner or person entitled to possession of a vehicle to
be towed as an abandoned vehicle shall have seven days after the date of mailing or
personal delivery of the notice to request,in writing, a pre-tow hearing. Subsequent
to this seven-day period, the vehicle may be towed, if the owner has not filed a
written hearing request within the seven-day period,and any hearing rights under the
provisions of this subchapter will be deemed waived.
B. Request for a Hearing. Requests for a hearing are to be made in person to the Chief
of Police. Requests for hearing by persons who reside more than 50 miles..from the
municipality may be made by mail. Forms for such requests shall be made available
at the Police Department. At the time of making the request, the owner will be
provided a hearing date and time by mail or in person,as the circumstances require.
C. Preliminary Hearing. If the owner or person entitled to a hearing must request within
seven days after the mailing or personal delivery of the notice,preliminary hearings
shall be conducted by a hearing officer appointed by the Chief of Police within 24
hours after receipt of the request, excluding Saturdays, Sundays and legal holidays.
All interested persons shall be given a reasonable opportunity to be heard and the
formal rules of evidence will not apply and hearsay evidence shall be admissible only

D. The hearing officer shall make a written decision upon a preponderance of the
evidence as to whether towing of the vehicle is authorized by the laws of the state or
the ordinances of the City,with a specific statutory or ordinance section cited in the
decision. The owner shall be provided a copy of the pre-tow hearing decision.

E. Decision to tow and rates to be charged. If the preponderance of the evidence
supports towing and compliance with the provisions of this chapter, the hearing
officer shall direct that the vehicle be towed, with any towing and storage costs to
then be imposed upon the owner. The fees to be charged for towing and storage
services shall be no more than the maximum rates set by the Chief of Police pursuant
to the provisions of this Chapter. The owner of the vehicle having had such a hearing
may avoid the towing by immediately removing the vehicle from the improper
location to a proper, lawful location and correcting any unlawful condition of the
vehicle.
F. Establishment of maximum towing and storage rates. The owner shall pay fees to the
towing service operator for towing and storage on police-ordered tows at rates that do
not exceed maximum amounts to be administratively established by the Chief of
Police and which may be revised from time to dine. However, nothing in this chapter
is intended to prevent a competitive towing service operator from charging less than
the established maximum rates for police-ordered or any other tows. In arriving at
the maximum rates for various services, the Chief of Police shall consider such '..
matters as the prevalent market rates in the area for the different types of vehicles, the
types of storage and area requirements for categories such as large trucks and
commercial vehicles, and the relative difficulties and amount of work required to
perform various types of towing operations. For particularly difficult or unusual
towing jobs, such as large or serious accidents, the Chief of Police is authorized to
allow towing operators to charge rates above those established for normal situations.
All special charges must be based upon the cost of services provided, taking into
account such matters as the man-hours and equipment time required for the job. A
towing service operator must fully itemize in writing the details of such a billing at
special rates for a particularly difficult or unusual tow, and supply a copy of the
itemized bill to the owner and to the Police Department. Any special rates charged
must be customary in the towing industry in the area for the nature and extent of the
services provided. Every towing service operator and the Police Department shall
have available a copy of the complete current rate schedule and any special rate
policy established by the Chief of Police, for vehicle owners to view upon request.

PRE-TON' NOTICE
You are listed as the registered Owner or person entitled to possession of the following described
vehicle: (make) (model/year) (other identifying features) (license plate number and State) which
is located on (location) in an apparently abandoned or unusable condition, to wit: ffacts forming
basis of proposed tow) as defined in (ordinance or statutory section).
The United City of Yorkville will tow the vehicle or cause it to be towed after seven (7) days
from the above date of mailing or personal delivery unless you move the vehicle to a lawful
location or request a hearing as set forth below. Any such hearing will only concern the proposed
towing, and will not be determinative of or adjudicate any parking ticket or other citation
concerning the vehicle. If the vehicle is towed, you will be required to pay all towing and storage
charges before the vehicle is released.
The towing is authorized by Section 6-5-2 of the City Code of the United City of Yorkville.
If you wish to request a hearing on the legality of the present location and condition of your
vehicle, you must contact the office listed below and file in person a request for such hearing
within 7 days of the above date of mailing or personal delivery, unless you live more than 50
miles from the municipality, in which case you may mail a request for hearing that must be
received by the office listed below within 7 days from the mailing or persona delivery of this
Notice.
6-5-6. Seizure and Impoundment of Motot Vehicles.
A. Conduct Prohibited. A motor vehicle operated with the permission, express or implied, of
the owner of record, that is used in connection with any of the following violations shall be
subject to seizure and impoundment by the City. The owner of record of said vehicle shall be
liable to the City for an administrative penalty of $500.00 in addition to any towing and
storage fees, and other fees deemed applicable. As used in this section, the owner of record
of a motor vehicle means the record title holder:
(i) Any vehicle which is operated by a person driving while his/her driver's license, permit
or privilege to operate a motor vehicle is suspended or revoked in violation of 625 ILCS
5/6-303. For the purposes of this section, the terms "revoked" or "suspended," when used
in the context of driving privileges or driver licenses, shall have the same meaning as
contained in the Illinois Vehicle Code, 625 ILCS 5/6-100 et seq.
(it) Any vehicle which is operated by a person driving while under the influence of alcohol,
other drug or drugs, intoxicating compound or compounds of any combination thereof, in
violation of 625 ILCS 5/11-501(a).
(iii) Any vehicle which is operated by a person driving against whom a warrant has been
issued by a Circuit Court in Illinois for failing to answer charges that the driver violated
(i) or (ii).
(iv) Any vehicle that contains any controlled substance or cannabis, as defined in the Illinois
Controlled Substances Act, 720 ILCS 570/100 et seq., and the Illinois Cannabis Control

Act,720 ILCS 55011 et seq.,or that is used in the purchase,attempt to purchase,sale or
attempt to sell such controlled substances or cannabis.
(v) Any vehicle used in connection with the unlawful use of weapons in violation of 720
ILCS 5/24-1,et seq„("Deadly Weapons")of the Illinois Criminal Code,or that contains
a firearm or ammunition for which a Firearms Owner's identification Card is required
under the Illinois Owners Identification Card Act,430 ILCS 6510.01 et seq..
(vi) Any vehicle that is used in the commission of prostitution as defined in the Illinois.
Criminal Code, 720 ILCS 5/11 et seq., solicitation of a prostitute or a sexual act as
defined in said Code,or pimping or juvenile pimping as defined in said Code.
(vii) Any vehicle that is used by a person who does not hold a valid Illinois driver's license or
permit or a restricted driver's permit issued under sections 6-205,6-206 or 6-113 of the
Illinois Motor Vehicle Code,625 ILCS 5/6-205,6-206 or 6-113.
(viii) Any vehicle which is used by a person during the aiding or abetting or commission of a
misdemeanor,felony or forcible felony as those terms are defined in the Illinois Criminal
Code,720 ILCS 5/2-7,2-8 and 2-11.
A. Driving While Intoxicated;Standard of Evidence. A swom report of a police officer,prepared in
conformity with Section 11.501.1 of the Illinois Vehicle Code,625 ILCS 5/11.501.1,establishing
that person has refused testing or has submitted to a test that discloses a blood alcohol
concentration of 0.08 or more,or any amount of a drug,substance,or intoxicating compound in
the person's breath,blood or urine resulting from the unlawful use or consumption of cannabis
listed in the Cannabis Control Act,controlled substance listed in the Controlled Substances Act,
or an intoxicating compound listed in the Use of Intoxicating Compounds Act, shall constitute
prinm facie evidence under this chapter sufficient to establish a finding of the vehicle owner's
liability under this chapter. The presumption maybe rebutted by clear and convincing evidence.

This chapter shall not apply to:
(a) A vehicle used in the violation was stolen at the time of the violation and the theft was
reported to the appropriate police authorities within twenty-four (24) hours after the theft was
discovered or reasonably should have been discovered;
(b) If the vehicle is operating as a common carrier and the violation occurs without the
knowledge of the person in control of the vehicle;or
(c) With respect to subsections 6-5-6(iv)or 6-5-6(v)of this chapter, the owner proves that
the item found is not unlawful.
6-5-8. Seizure and Impoundment.
(a) Whenever a police officer has probable cause to believe that a vehicle is subject to
seizure and impoundment pursuant to 6-5-6, the police officer shall provide for the

towing of the vehicle to a facility authorized by the City. At the time the vehicle is
towed,the police officer shall notify any person identifying him/herself as the owner,or
any person who is found to be in control of the vehicle at the time of the alleged
violation, of the fact of the seizure and the vehicle owner's right to request a vehicle
impoundment hearing as hereinafter provided.
6-5-9. Vehicle Impoendmen(Hearings.

and filed with the Chief of Police or his/her designated agent. If the appeal is timely filed,a
preliminary hearing shall be conducted by a hearing officer appointed by the Chief of Police with
the consent of the Mayor, within twenty-four (24) hours after receipt of the written request,
excluding Saturdays, Sundays and legal holidays. All interested persons shall be given a
reasonable opportunity to be heard at the preliminary vehicle'impoundment hearing. The formal
rules of evidence will not apply at the hearing,and hearsay evidence shall be admissible only if it
is the type commonly relied upon by reasonably prudent persons in the conduct of their affairs.
If, after the hearing, the hearing officer determines there is probable cause to believe that the
vehicle is subject to seizure and impoundment pursuant to this chapter,the hearing officer shall
order the continued impoundment of the vehicle, unless the owner of the vehicle posts a cash
bond in the amount of$500.00 with the City and pays the towing company any applicable towing
and storage fees. If the hearing officer determines that there is no such probable cause, the

Within ten (10) business days after a vehicle has been seized and impounded pursuant to this
chapter the City shall notify by United States mail, the registered owner of record of the date,
time and location of the scheduled bearing which shall be held pursuant to Chapter 13 of this
Code. The name and address of the person to whom a vehicle is registered as shown on the
records of the State in which the vehicle is registered shall be conclusive evidence of the name
and address of the owner of record of the vehicle,unless the owner of record has given the City
actual written notice of a different name and/or address. The hearing shall be scheduled and
conducted in accordance with the requirement of Chapter 13 of this Code.
6-5-77. Vehicle Possession.
Except as otherwise specifically provided by law, no owner, lienholder or other person shall be
legally entitled to take possession of as vehicle impounded under this chapter until the civil
penalty and applicable fees under this chapter have been paid. However,whenever a person with
a lien of record against an impounded vehicle has commenced foreclosure proceedings,
possession of the vehicle shall be given to that person if he/she agrees in writing to refund the
City the amount of the net proceeds of any foreclosure sale, less any amounts required to pay
lienbolders of record,not to exceed$500.00 plus the applicable fees.
Section IH: Severability. If any provision,clause,sentence,paragraph,section,or part of this Ordinance
or application thereof to any person, firm, corporation, public agency or circumstance, shall, for any
reason, be adjudicated by a court of competent jurisdiction to be unconstitutional or invalid, said
judgment shall not affect,impair or invalidate the remainder of this Ordinance and the application of such

provision to other persons, firms, corporations, or circumstances, but shall be confined in its operation to
the provision, clause, sentence, paragraph, section or part thereof, directly involved in the controversy in '..
which such judgment shall have been rendered and to the person, firm, corporation, or circumstances '..
involved. It is hereby declared to be the legislative intent of the Mayor and City Council of the United
City of Yorkville that this Ordinance would have been adopted had such unconstitutional or invalid
provision, clause, sentence, paragraph, section, or part thereof not been included.
Section IV: This Ordinance shall be in full force and effect immediately from and after its
passage and approval according to law.
