PRESENT: Chairperson Werderich, Committeemen Munns and Spears ABSENT: Committeeman Plocher ALSO PRESENT: Chief Harold Martin, Lt. Hart, Lt. Schwartzkopf. Chairperson Werderich called the meeting to order at 6 :05 pm. PRESENTATION: None MINUTES: The minutes of August 27, 2009 and October 9, 2009 meetings were approved as amended. NEW BUSINESS : 1 . PS 2009-34 Police Reports for September, 2009 Chief Martin distributed a supplemental report of the State of Illinois Uniform Crime Reporting for Kendall County. He noted that crimes in Yorkville were down in 2008 by 32.9% over 2007. This item was moved to the Consent Agenda. 2. PS 2009-35 Public Safety Committee Meeting Dates for 2010 Chairperson Werderich stated that there have been scheduling issues and therefore, suggests changing the meeting to the 4"' Thursday of the month to try to accommodate everyone. Committeeman Munns found that to be acceptable. Committeeman Spears noted that it would no longer conflict with KenCom meetings. The Police Department representatives had no issues with the change. OLD BUSINESS : 1 . PS 2009-32 Ordinance Amending City Code Regarding Towing of Vehicles Chairperson Werderich stated that the draft ordinance is what he had in mind from the previous discussion. Committeeman Munns found it to be acceptable. Committeeman Spears asked if Attorney Orr feels that there will be no issues as 1 the City of Yorkville is not home-rule. Chief Martin replied that Attorney Orr has stated there would be no issues, however, he would ask for that statement in writing. 2. PS 2009-33 Committee Liaison Review Chairperson Werderich stated that the School Board Liaison position is currently open. He will open this position up to the remainder of the City Council members as there is no interest from the members of this committee. ADDITIONAL DISCUSSION: Committeeman Munns — He noted that the Village of Oswego did a crosswalk sting recently. Committeeman Spears — Noted that during the Trick or Treat event last week, there were buses parked all over the place at Southern Belle and that children were darted out between the buses. She found this to be very dangerous and feels that the buses should be parked somewhere else. Lt. Schwartzkopf noted that the Police Department was unaware that buses were involved. Chief Martin stated that the event was sponsored by the Chamber of Commerce and feels that complaints should be directed to them. Committeeman Munns — Noted that at the senior event on Wednesday, he was approached by many senior citizens who thanked him for the ` no' vote on the garbage issue. Staff at the school discovered several notes referring to a bomb going off at the school, and in one note a date of detonation was given. With the large number of students attending JT West, locating a possible suspect was extremely difficult. During a roll call session, one of our Detectives suggested contacting ATF for advice or assistance. The response we received was tremendous. The advice we received was to have several K-9s search the building for any possible devices. There were five K-9 Officers and their partners that responded. With this type of assistance, the building was thoroughly searched within a short period of time. Speaking with the Joliet Detective Jim Allison, he relayed to me how impressed he was with you and the entire team of Officers that responded. Detective Allison felt confident that the school was secure and safe for the children that would attend the next day. The building was locked down until the next morning when school resumed. I was at the school the following day, the date of detonation according to the note, and I too felt safe in knowing that you and your partner put yourselves in harms way to assist us. In closing, I would again like to thank you for sharing some of your expertise with us in searching for devices. I was speechless when I found out, that five handlers and their partners I rrived to assist. The City of Joliet is grateful that you shared your skills with us in order to protect our children. If we can ever be of assistance to you please do not hesitate to call. On a side note, the suspect was identified, interviewed, and confessed to writing the notes. This incident was dispatched to us at 4 : 00 PM and was to assist the Bristol- Kendall Ambulance at 402 Freemont St . for a 74 year old female who had collapsed and was not breathing . The officers that responded were Officers Bledsoe, Kolowski and Hayes . Upon my arrival , the above mentioned officers had already arrived (4 : 03 PM ) . Their response time was less than three minutes. Upon entering the home, I went to a bedroom and observed a female patient lying upon the floor. I saw that Officer Hayes (chest compressions) and Officer Bledsoe (providing breaths) had already begun Cardiopulmonary resuscitation (CPR) . I also observed Officer Kolowski had responded with his department AED (Automated External Defibrillator) and was applying the AED patches to begin the defibrillator process . He was not delayed in connecting the necessary pads and components of the AED and showed confidence in his ability to use the AED . During the course of the event, the above mentioned officers showed extreme professionalism and were very composed . I was pleased with the way these officers communicated with each other while administering CPR and utilizing the AED . Officer Bledsoe was relieved by a paramedic and almost immediately went and spoke with the patient's husband , offering him any needed assistance in contacting family members and answering questions from him . Officer Hayes refused to be relieved of doing chest compressions and by the time he was, he was sweating tremendously . The patient, Marilyn R. Benjamin , subsequently was transported away from the scene by the ambulance a short time later. These officers then promptly returned to their routine patrol duties without hearing anything further in day of Mrs . Benjamin 's condition . All three officers finished their shift wondering and hoping that Mrs . Benjamin would survive . It was later learned on December 4th, 2009, Mrs . Benjamin had passed away on December 1st, 2009, shortly after arriving at Rush -Copley Hospital . After witnessing these three officers during this event, I wish to express to you how proud I was to see these officers show their dedication and empathy for the patient and the patient's family and what a positive reflection they were for the Yorkville Police Department and the United City of Yorkville . On Tuesday, November 10, 2009 at approximately 1046 hours, Officer Johnson received a dispatch of a 3rd party report of a suicidal subject. There was limited information as to the whereabouts of the subject, but was quickly located by Officer Johnson . Once on scene, the subject who was seated in the vehicle, with "what appeared to be a zip-tie around their neck", was not complying with Officer Johnson 's commands . Officer Johnson remained calm and quickly acted in rendering aid , by using his ASP to break out the vehicle's window, unlocking the door, extracting the subject from the vehicle making sure he was safe until treated by medical personnel . I would like to commend Officer Johnson for his efforts and quick action in attempt to save a citizen from harming himself. I recommend Officer Johnson receive a Life Saving Award form his action . The restaurant is applying for a restaurant liquor license in addition to the beer garden/patio license. Currently, there is no limit on the number of restaurant licenses. However, per the city ordinances there is a limit on the number of Beer Garden/Patio licenses available. The city code currently allows for six Beer Garden/Patio licenses to be issued. We currently have five businesses with this license with the sixth business in the process of being constructed. The five businesses that have this license are: Capri Ristorante Italiano, Casa Santiago, Legends Sports Bar & Grill, Sports Fanatix Bar and Grill, and Taylor Street Pizza Warehouse. The sixth Beer Garden/Patio license that city council approved is for the restaurant that is being constructed at 171 Saravanos Drive. Buffalo Wild Wings is proposing to put in a four foot high fence constructed of iron. Any new requests for a Beer Garden/Patio license must go to city council for approval to amend the city code to allow for new locations to be licensed. Ica - UuE� 3-3-4-5: OUTDOOR LIQUOR LICENSE: A. Licenses Required": It shall be unlawful for any licensee or person, firm, corporation, partnership or club to sell or offer to sell any alcoholic liquor from an outdoor location of the premises without first: 1. Obtaining a class G (beer garden/patio service) license therefor as provided in this section; and 2. Being a license holder in good standing of a class A, R or C license. B. Maximum Number Of Outdoor Liquor Licenses: There shall be no more than seven i 1(76) outdoor liquor licenses at any one time, without prior approval of Yorkville city council. The issuance of said number of outdoor licenses shall be without taking into account the number of special event licenses issued by the city. C. Hours Of Sale: It shall be unlawful for any holder of an outdoor liquor license to sell or otherwise dispense alcoholic beverages from an outdoor location on premises except during the following hours upon the following days of the week: 1. Friday, Saturday, and all legal holidays recognized by the federal government: Eleven o'clock (11:00) A.M. to eleven o'clock (11:00) P.M. 2. Sunday through Thursday: Twelve o'clock (12:00) noon to ten o'clock (10:00) P.M. D. Months In Which Operation Is Prohibited: It shall be unlawful for any outdoor liquor license holder to sell or offer for sale any alcoholic liquor, including beer or wine between November 1 and April 30 of any year. E. Entertainment: It shall be unlawful for any holder of an outdoor liquor license to play or cause to play amplified music or cause to have performed such other forms of entertainment by means or use of electronic amplification except during the following times and following days (unless otherwise when extended by the mayor at his discretion), and then only when all other applicable city ordinances have been adhered to: 1. Friday and Saturday: Twelve o'clock (12:00) noon to ten o'clock (10:00) P.M. 2 . Sundays and legal holidays recognized by the federal government: Twelve o'clock ( 12 :00) noon to eight o'clock (8 :00) P. M . ; except that on the following Sundays when the hours shall be extended to ten o'clock ( 10:00) P. M. : a . The Sunday before July 4, when the Fourth falls on Monday. b. The Sunday before Memorial Day. c. The Sunday before Labor Day. 3. Amplified music or other entertainment shall not be presented in such a manner so that it can be heard more than seventy five feet (75') from the premises which holds the license. F. Restrictions: It shall be the affirmative duty of the license holder as a condition of the license to maintain and perform the following requirements: 1 . Presentation and continued maintenance of a certificate of insurance with the city for coverage of the outdoor service area, including all applicable dramshop insurance. 2. Outdoor service and consumption of alcohol shall be in an identified cordoned off area , as approved by the city liquor control commissioner. The area must be owned or leased by the license holder. This area must be covered by the insurance as stated above. G . Establishment Restrictions: 1 . Alcoholic beverages shall only be served to or consumed by those outdoor patrons during times at which food is being served on the site. 2 . Alcoholic beverages consumed in the outdoor area must be purchased on the premises where the outdoor area is permitted by the city liquor license. 3. Entrance and exit points for the outdoor area shall be restricted as approved by the city liquor control commissioner. There shall be one emergency exit for the area outside of the building. 4. No alcoholic beverages of any kind shall be served in the outdoor area in glass containers. H. Application : 1 . Application for permission to conduct such outdoor retail sale of alcohol shall be in writing in the standard license application form for any liquor license in the city, and shall additionally state the dates for the requested license and a diagram of the outdoor area upon which the sale and consumption will occur. 2 . The fee for a class G outdoor license shall be two hundred fifty dollars ($250 .00) annually as set forth in this chapter. For all classes of license holders except holders of a fraternal license, which shall be charged one hundred dollars ($ 100 .00) for said additional license permitting outdoor events. I . Revocation : 1 . In addition to those restrictions stated above, all class G outdoor licenses shall be subject to all the limitations and restrictions set out in this chapter and state statutes. The license holder's current standard license is subject to the terms and restrictions of the outdoor license. 2 . The local liquor commissioner may revoke the outdoor license for violation of the standards set forth herein , or any other applicable restriction set out by state statute. The commissioner may also consider revocation of the holder's standard license in addition to the revocation of the outdoor license based on any violation of the restrictions applicable to either the standard license or outdoor license. J . Renewal : Outdoor licenses are renewable on a yearly basis and shall last for only those months specified in the license. Renewal fees are the same as application fees. The north Walgreens is located at 100 W. Veterans Pkwy. The south Walgreens is located at 1991 S. Bridge Street. Class `B- 1 " liquor licenses allow for the carryout sale of beer and wine. Per city ordinances, there is a limit on the number of package liquor licenses that can be issued. Any new requests for package licenses require an amendment to the city code to allow for an increase in the number of licenses allowed. There are currently eight locations licensed for Class `B" Liquor Licenses and 5 locations licensed for Class `B- 1 " Licenses (attached). Greg Weber, the GIS Coordinator, has provided a map depicting the locations of all of the package liquor licenses for the city (attached). We as members attending the KenCom Funding Committee thought we as a committee came to an understanding at our prior committee meeting held in November 2009 . At that meeting we were of the understanding that we as City's within the County and Kendall County had agreed to maintain the current approved staffing level . If we were in the future to expand beyond our current staffing level we would at that time decide how to fund that need in increased personnel . We figured that at best we may be able to put off increasing the staffing level for another 2- 3 years; of course it would depend on growth . It was also decided to expand KenCom by building out the basement of the Public Safety Center instead of building a new facility. We would use the ETSB Funds as a funding mechanism . This way we would not be incurring any further funding from the participating agencies. We also agreed that by doing this it may put us out as far as 10 years or more in the future without having to look at another facility. We also approved the purchasinq� of the upgraded telephone and radio systems which had to be decided by February 25` 2010 . When we left the meeting we (Yorkville, Oswego, and Plano representatives) thought we had everything worked out. It was our belief at that time as a group that we would not need to address anything further until there was a need to increase staffing levels in KenCom . At our most recent meeting in December we were advised by Larry Nelson member at large (from my impression the spokesman for the County) that unless the City decides to ok a percentage that the City will pay sometime in the future, when and if there is any need to expand beyond the current allotted personnel he would not support the build out of the basement. He is in essence saying that unless we agree to an unknown dollar figure (but a known percentage) they (County) would not spend the money on the upgrades to the E911 system or the radios. This new idea was not presented to us in November's meeting, and was a complete change in direction without our knowledge.
