PRESENT: Chairperson Spears, Committeemen Plocher, Sutcliff and Werderich ABSENT : None ALSO PRESENT: Chief Harold Martin, Lieutenant Rich Hart, Lisa Pickering, Alderman Bob Allen, Rowena Vergara of The Beacon News and Lisa Welz of The Record Members of the public in attendance included Mr. Art Prochasky, Mr. Glen Poole, Ms. Tammy Smock, Mr. Tom Gilmour, Ms. Judy Gilmour, Mr. George Gilson, Mr. Fred DuSell, Mr. Matt May, Ms. Jean McBride, Ms. Carol Foster, and Mr. Mark Johnson Chairperson Spears called the meeting to order at 6 :03 pm. She asked that item #3 be moved to the beginning of the agenda. NEW BUSINESS : 3. PS 2009-09 — Ice Cream Vendors Chairperson Spears stated that this topic was discussed by City Council in May, 2008 and by this committee in 2007. It was time to discuss the topic again to determine if vendors are a danger. Ms. Tammy Spock was asked to speak regarding incidents that have occurred in the area. Ms. Tammy Spock distributed newspaper clippings and Internet articles regarding incidents that have occurred in the area. Most articles occurred in 2008, with the exception of a few. Many of the articles state that the ice cream vendors are sexual predators, however, 1 of them was found to be selling marijuana from his truck. Ms. Speck resides in Rivers Edge and stated that the vendor comes through her neighborhood 4-5 times per day. She has seen the truck sit in one location for lengthy periods of time, away from the park, but close enough that it would appear as though the driver is watching the children, not trying to earn a living selling ice cream. Ms. Spock stated that there are loopholes in the system in that the owner of the company can have his/her background checked, then can allow someone else to 1 drive the truck. That person would not have had a background check. Chief Martin stated that Yorkville requires the drivers to have background checks and then they are issued a Yorkville vendor ID permit that they must have at all times. The Police Department checks the vendors periodically to ensure that they are permitted to be selling within the city limits. Ms. Spock stated that the world is different from when she grew up and for that reason she is an advocate of banning the vendors or requiring them to operate from carts without wheels. Many ice cream products get recalled and the trucks are in bad shape. Chief Martin stated that the Kendall County Health Department would conduct those types of inspections. Chief Martin stated that the City has to be careful regarding what they regulate. He feels that this matter needs to be discussed with the City Attorney because people have the right to earn a living. Mr. George Gilson suggested stricter enforcement or higher fees. Mr. Art Prochasky suggested an ordinance prohibiting them from stopping for longer than a specified amount of time. He stated that the City needs an avenue with which a resident could file a complaint. The City should look at the resident concerns and then tweak the ordinance to give people an opportunity to file complaints. Chief Martin stated that it might be difficult to determine those circumstances. Mr. Fred DuSell suggested that residents file a noise complaint. Chief Martin stated that the music from the ice cream truck may be annoying but it is not outside of the noise ordinance standards. In fact, he stated, resident lawnmowers and other lawn equipment is actually louder. Chairperson Spears stated that the City Attorney has advised that ice cream vendors cannot be banned. However, she suggests increasing fees to a maximum in order to be public safety minded. Discussion regarding the background checks and identification badges took place. It appeared as though many residents were unaware of the City' s current ordinance requiring both. Committeeman Werderich suggested that the City issue a statement in the newspaper informing residents of the ordinance and advising them to contact the Police Department if they see a vendor without an identification badge. Ms. Smock asked how other communities are able to ban ice cream vendors. She stated that someone needs to advocate for the children that are becoming victims. She feels that it would be easier to control a pushcart vendor in Town Square Park than a vendor driving throughout the City. Discussion returned the changing the current ordinance. Committeeman Plocher feels that the ordinance is a strict as it can be. Chairperson Spears feels that the 2 fines and licensing fees should be increased. Mr. Glen Poole suggested a revocation of the permit should a specific number of complaints be filed against a vendor. Committeeman Sutcliff asked Chief Martin if there were any complaints against the current vendor. Chief Martin stated that there have been a few in the past. Lt. Hart stated that there was an incident during an event at Town Square last year. Committeeman Sutcliff feels that the City Council spent a lot of time of this issue last year and that perhaps the ordinance should be changed to not allow drivers to sit still and it should also be added to the adjudication process. Mr. Gilson added that raising the permit fee would discourage illegitimate businesses from applying for a permit. Mr. Tom Gilmour feels that this is tough because you could be stomping on people's constitutional rights. Committeeman Werderich suggested educating the residents and changing the ordinance to no standing still if children are not present. Chief Martin stated that the Police Department would research what the City can legally do. Lisa Pickering reminded the group that the current ordinance requires each driver to have a written license from the City, have a picture ID in a lanyard and they must wear it at all times that they are soliciting business. Additionally, she stated that if the fees were raised, it would apply to all mobile food vendors, which affects the hot dog vendor. Chairperson Spears asked if the City could have separate ordinances, which is a question for the City Attorney to respond to. Mr. Mark Johnson asked how many companies / vendors applied for permits. Lisa Pickering stated that 2 people from the same company have applied for permits. After the ordinance was approved another company that previously did business in the City left town because they needed to have a Department of Revenue tax ID number. Mr. Prochasky stated that the City could regulate the hours of operation, whether or not the vehicle is in the vicinity of bus stops, etc. This would give the residents the opportunity to file complaints. Chairperson Spears stated that allowing the ice cream vendor in the City takes business away from Culvers, Jewel and other City businesses that pay taxes. She suggests the committee refer to the City Attorney regarding the maximum that can be done within constitutional parameters. Additionally, the City will put information in the water bills, newsletter and through the press regarding the ordinance to educate the residents. Committeeman Sutcliff suggested utilizing the schools for this matter as well. Mr. Matt May stated that the school could issue the information in the form of "Safety for Summer" at the end of the year. This item will be referred to the City Attorney for clarification and returned to the agenda next month. 3 2. PS 2009-02 — Leash Law — Discussion Chief Martin had a concern regarding this matter and outlined his concerns. The matter went before the City Council and there was a tie vote. As such, the Mayor broke the tie. At this time, it is requested that the matter be re-addressed. A residents' 17-year old son who was going to enter the Marines was walking to work and was attacked by a dog. The boy will now be confined to a wheelchair the rest of his life. Committeeman Werderich stated that his understanding is that an ordinance was passed to do away with the previous ordinance. If that's the case, how can this issue be brought back? Lisa Pickering stated that there was an amendment to the current code. Additionally, she stated that an ordinance could be passed to supercede the current ordinance. Committeeman Sutcliff stated that she is aware of what had transpired and wished to inform the members of the public that were present that a Public Hearing was scheduled for Tuesday, January 27, 2009 to discuss this matter. It would be nice if everyone could attend and address the entire City Council. Chairperson Spears stated that many of the people in attendance were informed of this meeting because the entire City Council had not been informed about the Public Hearing. The matter was opened up for public discussion. Members of the public stated the following: • Mr. George Gilson: • I feel that the City Attorney' s agenda is to do what the Mayor says. • Rescinding an ordinance would not be setting precedence. • The City Council did not look at the whole picture when making this decision. • Mr. Matt May: • It is the Council' s responsibility to write the ordinances and the Attorney should put it into legal terms. DISCUSSION: Committeeman Werderich stated that there has to be a vehicle with which to put forth another ordinance. Due to his legal background, Committeeman Werderich was asked to prepare an ordinance for review by the committee. Committeeman Sutcliff stated that the Mayor is providing the residents a forum for discussion. Committeeman Werderich stated that the memo states that the residents have a right to talk, however, no action can be taken. Chairperson Spears stated that the Alderman were elected to be the policymakers, let's do our jobs. She added that the original ordinance was put into place because a 6-year-old child was bitten by a dog while on his own front porch. • I have a 5 year old and my neighbor has 2 dogs. I spent $4,000.00 putting up a fence so that my child would be safe. • My problem is more about people taking the law into their own hands after an animal hurts someone. • I am an educator and I work with kids. 4 • I had a neighbor with an electric fence and it did not stop his dog. • Not all dog owners are responsible. • My wife won't walk past the neighbor' s house because of his animals. • I can't believe the Mayor had the audacity to pass this ordinance. • Mr. Art Prochasky: • What is the value of a Public Hearing after an ordinance has already been passed? • Approximately 13 years ago, when I was Alderman, I received a call from a mother whose child had been bitten by a neighbor' s dog while the child was playing on his own front porch. When the resident called the Police Department, she was advised that there was no ordinance regarding this matter, therefore, there was nothing they could do and she would have to pursue the matter civilly. Back then, there were no electric fences and other technology, therefore the best thing the City could do was pass an ordinance requiring dogs to be contained by a fence, leash, etc. Now that this matter has been opened back up and the ordinance was changed, what recourse do people have? • As a child, a dog jumped me and I was immediately given rabies shots, therefore, this is a passion of mine. • Isn't the reason for government to protect the people against what they cannot protect themselves against? Something needs to be in place to prevent harm from happening. • Mr. Fred DuSell: • I was attacked in Rivers Edge 1 year ago. Electric fences do not help. • Could this matter be considered under the bad law rule? DISCUSSION : Committeeman Werderich replied only non- constitutional laws would be. Chief Martin stated that his recommendation was not to change the ordinance that was in place. • Could the committee members ask the other Alderman to be more professional during meetings? During the discussion regarding this matter, another Alderman commented about `tethering children' which was not professional and sounded derelict. • Mr. Tom Gilmour: • If a gun was unsupervised and someone was shot, the person responsible for the gun would be charged; the same should apply to these circumstances. • By the time the Police Department is contacted regarding a dog problem, it could be too late. DISCUSSION: Chief Martin stated his problem is that you cannot always control animals. Additionally, one of the biggest problems over the years has been with animals. Chairperson Spears stated that Chief Martin provided the City Council with a memo 5 indicating the history behind this matter. In his memo he indicated that he recommended no change to the ordinance, yet the matter still moved forward and the ordinance was changed. o It is unlikely that renters would put up fences. This is a dangerous thing. • Ms. Carol Foster: • Being a pet owner is a choice. They should be more responsible. I am constantly aware of the people and dogs that are unleashed around me, as I have been attacked by dogs while I was walking mine. • Animals do not know where property lines are. • Ms. Jean McBride: • There was an article in today' s newspaper about a child mauled to death by a dog while in bed. • The City wants more trails and bike paths; unleashed animals can easily take off. It's too risky. • It's dangerous for meter readers, delivery people, politicians, etc. • The audience should have been allowed to speak before the ordinance was changed. • Mr. Mark Johnson: o Is a building permit required for installing an electric fence? I ask because some installers go past the sidewalk. Perhaps a building permit should be required. Committee discussion resumed. Committeeman Golinski feels this issues needs to be re-addressed. In the United States, since January I ", there have been 5 fatal dog attacks, 2 of which occurred in Illinois. 3 of those occurred to children under the age of 9. He has had more contact from constituents regarding this matter than any other. Committeeman Werderich questioned whether this matter should be brought back before the current session of City Council or to the new City Council in April. Alderman Allen stated that when he was obtaining signatures for his campaign, he saw a lot of dogs. He feels that dogs are good. They are a great deterrent to threats against a family. However, people need to control their dogs. He stated that good people came forward this evening to voice their opinions and now the City Council can review their input. Additionally, he stated that Mayor Burd responded to information that new technology is out there. However, he feels that this since many people have come forward, this is an opportunity for the issue to be brought forward again. Mr. Prochasky added that the issue is not how the ordinance got changed, but whether or not the City has done enough to protect the citizens. Additionally, no one wants to cause problems with dog owners as many people have well trained dogs, however, there are a lot of dogs that are not well trained. Chairperson Spears thanked the public attendees for coming and addressing the committee with their concerns. She reminded them of the Public Hearing on 6 January 27, 2009. Additionally, she stated that the leash law was amended to include only the owner' s yard, if animals are unleashed anywhere else, you are encouraged to contact the Police Department. Alderman Allen asked to clarify that the residents wish to revert back to the old ordinance. However, he feels the proper legal procedure would be to rescind the ordinance and re-issue it. He feels that the previous ordinance was ignored, as many residents did not want to start neighborhood problems by complaining about their neighbors. Chief Martin stated that once there was an issue where neighbors went back and forth about their animals. He stated that the normal procedure would be to issue a citation for an unleashed dog. Furthermore, his major concern is owners walking their dogs unleashed. Public Discussion was once again opened. The following comments were made: • Ms. Judy Gilmour: o I don't reside within the City limits, however, I am right next-door. I feel as though Alderman Sutcliff is the only person defending the change to the ordinance. DISCUSSION: Alderman Sutcliff stated that she did vote to change the ordinance because she feels that people own their property and have the right to do what they want on their property. Ms. Gilmour added that with regards to this issue, the City should have erred on the side of safety. • Mr. Fred DuSell: o I respect people' s rights. However, if a dog came off his property and attacked me, I have the right to defend myself. I feel that dogs should be fenced, in an electric fence or tethered. • Ms. Jean McBride: o I checked into what I could do to defend myself against a loose dog and was told to carry a stick for protection. DISCUSSION: Lt. Hart informed Ms. McBride that she has the right to carry pepper spray. • Mr. Matt May: o Do you have kids? What if your child was attacked? People will take the matter into their own hands. • Mr. Mark Johnson: • I reside in a neighborhood with 8-9 dogs. They are always leashed and the owners always pick up after them. However, I have been in areas where dogs run free. The majority of people are good owners and follow the law. • Whose job is it to handle loose dogs? DISCUSSION : Chief Martin stated that it is the responsibility of the Police Department, however, if they have problems getting control of a dog, they can ask Animal Control to assist them. Lt. Hart added that the Police Department tries to get a loose dog to get into their cars and then they take them to Animal Control. 7 However, that requires them to corral the dog. Before the ordinance was amended, citations would have been issued. The committee returned to their discussion. Committeeman Werderich stated that he feels this matter needs to return to City Council. He will draft an ordinance to supercede this one. Committeeman Plocher agrees and feels the issue needs to be addressed, as most residents believe that the ordinance has been rescinded. This item will be returned to next month' s agenda. MINUTES FOR CORRECTION/APPROVAL: The minutes of November 24, 2008 and December 18, 2008 were approved with corrections, which will be submitted to the City Clerk' s office. NEW BUSINESS : 1. PS 2009-01 — Police Reports for November/December, 2008 Committeeman Werderich noted that there were more complaints regarding ordinance violations. This item was moved to the Consent Agenda. 4. PS 2009-04 — Ordinance Amending the Code of Ordinances Regarding Term of Liquor License Lisa Pickering stated that the City currently issues liquor licenses twice per year. 16 other local towns issue them once per year. Much time and money would be saved by changing procedure to issue them once per year, without any additional cost of the City. The fees would remain the same. Currently there are 32-33 licenses issued and the process is very time consuming. Chief Martin stated that he supported this request. Discussion took place regarding the issuance of licenses. The license stays with the person it is issued to, not the establishment. There are no restrictions of the number of licenses for selling liquor. This item was moved to the Consent Agenda. 5. PS 2009-05 — Discussion of Amending Ordinances and/or Creating New Codes/Ordinances Chairperson Spears stated that this item was added to the agenda because Committeeman Werderich had a concern regarding the number of ordinances that have been amended. The Committee was told that the Attorney was informed to clean up the books; however, it is costing the City a lot of money. Committeeman Werderich stated that his concern is that the City Council is the policymakers. He feels it is wrong that ordinances are being brought to the City Council, as the City Council should be initiating changes. Chief Martin stated that the adjudication process has required many changes to ordinances. Committeeman Werderich stated that those changes are understandable and 8 acceptable. He stated that the City should initiate changes because there is a concern that needs to be addressed. There must be a core reason behind these changes. Committeeman Plocher asked why Building and Zoning ordinances are coming through this Committee. Chief Martin stated because they control the Adjudication Process. After discussion, it was determined that ordinances reviewed by the Public Safety Committee should be only reviewed if requested by the committee or Chief Martin. OLD BUSINESS: 1. PS 2008-46 Code Amendment Ordinances A. Ordinance Amending the Code of Ordinances Regarding Advertising on Signs and Buildings Chief Martin recommends moving this item to the Public Works Committee Agenda and allowing them to make a recommendation on this matter as they have knowledge of the purpose behind it. Lisa Pickering noted that Travis is the liaison to the EDC and he controls Building and Zoning so she recommends moving this item to EDC. Chief Martin and the Committee agreed. This item was moved to the Economic Development Committee. B. Ordinance Amending the Code of Ordinances Regarding Fireworks Chief Martin stated that he would like to retain this ordinance for the adjudication process. Discussion took place regarding cap guns and guns with blanks for use at the beginning of races. Lt. Hart suggested mimicking the state law regarding this matter, to which the Committee agreed. This item was moved to the City Council. C. Ordinance Amending the Code of Ordinances Regarding Trespassing on Property Chief Martin recommends withdrawing this item for consideration. The Committee unanimously agreed. No further action is required. ADDITIONAL DISCUSSION: Committeeman Plocher • Can jake breaking become a City ordinance? Chief Martin responded that it is a moving violation, therefore, it cannot be. Additionally, the City is not a Home Rule City, which also prohibits such action. • Can the ordinance regarding parking across a sidewalk be rescinded during a snowfall? Chief Martin replied that it is a state law; therefore, it cannot be rescinded. Additionally, the City ordinance is punishable by a $25.00 fine, whereas state law is punishable by a $75.00 fine. 9 Committeeman Werderich • With regards to the Bassett Training law, I received a call from Bob Dearborn who advised that it creates a hardship on his business, as he has to pay his employees to attend. Therefore, I would like to revisit this issue. Committeemen Plocher and Sutcliff agreed. Chairperson Spears suggested bringing this item forward at the next committee meeting and having Barry attend to speak regarding the matter. Chief Martin suggested inviting Mayor Burd to attend as well. • With regards to punishment in terms of the adjudication process, could the City consider issuing public service time rather than just a fine, as sometimes having to do public service would make a greater impact than a fine would? Chief Martin stated that many years ago that was the practice, however, it is difficult because the people have to be monitored and the City has to find things for them to do. He stated he is not against such a policy and therefore, it could be researched again. Chairperson Spears stated that from personal experience at her place of employment, the Police Department had to pick up the people and supervise and monitor their progress. Committeeman Werderich stated that in the case of a 14 year old who can not legally work to raise money for a fine he/she might be issued, that child would be required to get the money from his/her parents and therefore, is not really learning a lesson. Chairperson Spears stated that another consideration would be who would be legally responsible if that child was injured while conducting public service. Chief Martin stated that is why this matter was such a problem in the past and it was referred to the Probation Department. Chief Martin — none Lisa Pickering — none Chairperson Spears — none Alderman Allen • With regards to the Bassett Training, perhaps the City could find a medium ground such as an extension or scheduling another class. Your assistance in this investigation led to the arrest of one suspect who was charged with 10 counts of Child Pornography, Class 3 Felonies, On 11 - 14-08 I asked you to assist me in viewing over 40 DVD's and many other media components to check for possible child pornography. You cleared your work schedule and spent several days viewing these media components finding approximately 1015 questionable images. Region 2 encompasses the counties of Cook, Lake, McHenry, Kane, DuPage, Will, and Kendall. *An ad hoc "Community Advisory Committee" was appointed by the Kendall County a' Board to complete a state-mandated five year update of the Kendall County Solid Waste Plan (last updated in 2005). The Committee, comprised of local residents, and county and municipal government officials, met three times in 2008. A series of meetings are scheduled for 2009. The updated Plan is due to the Illinois Environmental Protection Agency by February of 2010. Before being submitted, the Plan must receive reviews by and the approval of the Kendall County Board of Health and the Kendall County Board. +A comprehensive review of the Special Use Permit (SUP) currently held by Green Organics compost operation (unincorporated Yorkville) as said company will soon be petitioning the County for an extension of their SUP (set to expire in 2009). The Green Organics compost operation was evaluated and found to be in compliance with the requirements of their Kendall County Special Use Permit. *Mr. Hartman joined the Plano Chamber of Commerce at one of their monthly breakfast meetings to discuss the merits of and opportunities for implementing commercial and multi-family recycling, a current and ongoing objective of the Office of Solid Waste Management. +Kendall County's partner in used electronics waste recycling, Vintage Tech Recyclers (of Plainfield), received the distinguished title of "Recycler of the Year" by the Illinois Recycling Association. We applaud their efforts and appreciate their service. *Mr. Hartman attended an Illinois Environmental Protection Agency workshop on Unwanted Medication A11,0Collection Programs in Illinois. This workshop identified Kendall County and the United City of Yorkville as having the first full-time medication collection program of its kind in the State of Illinois. The goal of this workshop was twofold: To identify and educate attendees on current expired medicine collection programs within the State, and to create a statewide taskforce as a forum to discuss and further address this potential environmental liability. Mr. Hartman, of course, was invited to become a member of this taskforce. 14 *Furthermore, entering its second and successful year, the Kendall County/United City of Yorkville's "Unwanted Medication Program" served as a highlight of an April seminar held in Springfield hosted by the Illinois Counties Solid Waste Management Association. Mr. Hartman and Yorkville Police Department's Sgt. Barry Groesch presented on the details of this valued recycling program and its success to date. Mr. Hartman and Sgt. Groesch also visited McHenry County io present on and aid in the creation of a McHenry County medication collection program. *Mr. Hartman initiated dialogue with a commercial latex paint recycling firm to discuss the possibility of establishing a routine paint collection/recycling program for Kendall County residents. The aforementioned company implements a "collection sticker recycling program" whereby residents can purchase special stickers at pre-arranged locations in the County (i.e., government centers, local retail businesses); the stickers then being applied to paint containers for drop-off at participating area hardware stores —where the paint is stored for pick-up and recycling by said company. +Mr. Hartman initiated dialogue with Unique Thrift Store representatives to discuss clothing reuse programs in Kendall County. *EDUCATION & OUTREACH *Mr. Hartman was a speaker at the United City of Yorkville's Third Annual Senior Police Academy (held at the Kendall County Historic Courthouse). We are very excited about the new format, and the valuable information contained within. County board members and residents are encouraged to visit this site to peruse the very helpful information it contains. The pages can be accessed by clicking on the "Environmental Health" tab at the top of the Health Department's homepage, www.kendaMealth.org. From there you will click on a button found in the left hand margin titled "Waste/Recycling". *Mr. Hartman devoted a great deal of time researching alternative waste disposal technologies and new approaches to the time-honored method of solid waste disposal, land-filling. Much of this information was presented to and discussed at both the County's Health and Environment Committee meetings and the Solid Waste Plan Update Community Advisory Committee meetings. Information was also shared with the public in a number of venues. •In a presentation given to the Health and Environment Committee, Mr. Hartman presented County Board members with information gained while attending the North American Waste-To-Energy Conference in Philadelphia, May 19-21 . Highlights of the conference included an update on the use and applications of incineration, as well as a number of advanced alternative waste disposal technologies (i.e., plasma arc gasification), as they apply to both the United States and the European Nation. 15 V ILLINOIS TOBACCO FREE COMMUNITIES GRANT k *The Kendall County Health Department's Tobacco Program is funded through the Tobacco Settlement Agreement that awarded Illinois $9. 1 billion over the next twenty-five years. The Illinois Department of Public Health disperses a part of this money to local Health Departments for tobacco education and prevention through a grant called "Illinois Tobacco- Free Communities" The goals of the Kendall County Health Department's Tobacco Program are to: Provide education to the community, through a variety of sources on the dangers of environmental tobacco smoke. R Promote quitting and prevention among youth and f adults. k ':•2008 TOBACCO PROGRAM HIGHLIGHTS *The tobacco program put a lot of resources into education and implementation of the Smoke Free Illinois Law. Staff held an educational forum for businesses, municipalities, and other interested individuals prior to the law going into effect. Tobacco program staff along with Environmental Health staff created an implementation toolkit and printed door decals that were made available to all businesses in the county. *With the Environmental Health Food Program Coordinator, developed an enforcement protocol for handling Smoke Free Illinois complaints. Created supporting materials such as complaint forms and educational letters. *The Health Department responded to fourteen complaints related to the Smoke Free Illinois law. Two businesses had multiple complaints requiring inspections. No fines have been issued. Businesses receiving complaints ranged from government offices, retail stores, clubs, and eating/ drinking establishments. +For Red Ribbon Week, the Joe Smokes Show video was sent to each Junior High in the county. The Joe Smokes video was created last year in collaboration with the Kane County Health Department. The video teaches young people about the 4,000 plus harmful chemicals in tobacco products. It was produced locally using local actors. t_ +Continued to utilize a workplace program being offered by G1axoSmithKline Pharmaceuticals to purchase Nicotine Replacement Products at a reduced price. The products were provided << to cessation program participants. *Two Freedom from Smoking clinics were held during FY2008. A total of twenty-four individuals registered for the clinics. Twenty individuals completed the eight sessions and nineteen of them were smoke free at the end of the eight sessions. Twenty individuals took advantage of the nicotine replacement products offered or utilized a prescription aid. AGREEMENT by and between THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS and THIS AGREEMENT is entered into this day of 20, by and between the United City of Yorkville, Illinois, a non-home rule municipality (the "City"), and (the "Owner or Tenant"); PREAMBLES WHEREAS, pursuant to the Section 1 - 1 -7 of the Illinois Municipal Code (65 ILCS 511 - 1 - 1 , et seq.), the corporate authorities of any municipality are authorized to contract with school boards, hospitals, commercial and industrial facilities, and owners of shopping centers or apartment complexes within and without the municipal limits in such manner as is provided by Section 11 -209 of "The Illinois Vehicle Code" (625 ILCS 511 - 100, et seq.) (the " Vehicle Code"); and, WHEREAS, Section 11 -209 of the Vehicle Code states that the corporate authorities of any municipality and a school board, hospital, church, condominium complex unit owners' association, or owner of any commercial and industrial facility, shopping center, or apartment complex which controls a parking area located within the limits of the municipality, or outside the limits of the municipality and within the boundaries of the county, may by contract, empower the municipality or county to regulate the parking of automobiles and the traffic at such parking area; and, WHEREAS, the Owner or Tenant has control of a parking area(s) located at (the "ParkingArea(s)"); and, WHEREAS, the City and Owner or Tenant desire to enter into an Agreement whereby the City shall have the authority to regulate the parking of automobiles and the traffic at the Parking Area(s). NOW, THEREFORE, the parties, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, agree as follows: Section 1. Incorporation of Recitals. The parties agree that all of the recitals contained in the Preambles to this Agreement are true and correct and are hereby incorporated into this Agreement as though they were fully set forth in this Section. 1 Section 2. Municipal Authority. The City shall have the authority to regulate and enforce the parking of automobiles and the traffic at the Parking Area(s) controlled by the Owner or Tenant, including the following: 1 . The erection of stop signs, flashing signals, person with disabilities parking area and the adoption of appropriate regulations thereto pertaining, or the designation of any intersection in the parking area as a stop intersection or as a yield intersection and the ordering of like signs or signals at one or more entrances too such intersection, subject to the provisions of Chapter 11 of the Vehicle Code. 2. The prohibition or regulation of the turning of vehicles or specified types of vehicles at intersections or other designated locations in the Parking Area(s). 3 . The regulation of a crossing of any roadway in the Parking Area(s) by pedestrians. 4. The designation of any separate roadway in the Parking Area(s) for one- way traffic. 5. The prohibition, regulation, restriction or limitation of the stopping, standing or parking of vehicles in specified areas of the Parking Area(s). 6. The designation of safety zones in the Parking Area(s) and fire lanes. 7. Providing for the removal and storage of vehicles parked or abandoned in the Parking Area(s) during snowstorms, floods, fires, or other public emergencies, or found unattended in the Parking Area(s), (a) where they constitute an obstruction to traffic, or (b) where stopping, standing or parking is prohibited, and for the payment of reasonable charges for such removal and storage by the owner or operator or any such vehicle. 8 . Issuance of notices of violation of any of the forgoing or any other City traffic regulation to the owner or the vehicle. Section 3. Liability of City. Nothing in this Agreement shall obligate the City to undertake any of the actions set forth in Section 2(a) of this Agreement. Nothing in this Agreement shall obligate the City Police Department to monitor or regulate traffic rules in the Parking Area(s), or impose fines for the violation of traffic rules. Section 4. Owner or Tenant Indemnification. The Owner or Tenant shall indemnify and hold harmless the City, its agents, officers and employees against all injuries, deaths, losses, damages, claims, suits, liabilities, judgments, costs, and expenses (including any liabilities, judgments, costs and expenses and reasonable attorney' s fees) which may arise directly or indirectly from the implementation of this Agreement. The 2 Owner or Tenant shall, at its own cost and expense, appear, defend, and pay all charges of attorneys, costs, and other expenses arising therefrom or incurred in connection therewith. If any judgment shall be rendered against the City, its agents, officers, officials, or employees in any such action, the Owner or Tenant shall have no obligation whatsoever, with respect to any acts of negligence or reckless or willful misconduct on the part of the City or any of its officers, agents, employees, or contractors. Section 5. Memorandum. This Agreement shall be recorded in the office of the recorder in the county in which the Parking Area(s) is/are located, and no regulation made pursuant to this Agreement shall be effective or enforceable until three (3) days after this Agreement is recorded. Consumer fireworks : Those fireworks that must comply with the construction, chemical composition, and labeling regulations of the U.S. Consumer Products Safety Commission, as set forth in 16 C.F.R Parts 1500 and 1507, and classified as fireworks UN0336 or UN0337 by the United States Department of Transportation under 49 C.F.R. 172. 101 . "Consumer fireworks" shall not include snake or glow worm pellets; smoke devices; trick noisemakers known as "party poppers", "booby traps", "snappers", "trick matches", "cigarette loads", and "auto burglar alarms'; sparklers' toy pistols, toy canes, toy guns, or other devices in which paper or plastic caps containing twenty- five hundredths grains or less of explosive compound are used, provided they are so constructed that the hand cannot come in contact with the cap when in place for the explosion; and toy pistol paper or plastic caps that contain less than twenty hundredths grains of explosive mixture. Display fireworks : L3G or special effects fireworks or as further defined in the Pyrotechnic Distributor and Operator Licensing Act (225 ILCS 227/1 , et seq. ). B . It shall be unlawful for any person to sell, keep, expose for sale, loan or give away any L3G fireworks, consumer fireworks, or display fireworks, anywhere in the city. C. It shall be unlawful for any person to possess or to discharge anywhere in the city any 1 .3G fireworks, consumer fireworks, or display fireworks; provided, however, that pursuant to a resolution the mayor and city council may issue a permit for the discharge of such fireworks and for pyrotechnical displays. D. It shall be unlawful for a parent, legal guardian or other adult person standing in loco parentis to allow a person under the age of 18 years who is enrolled in a public, private or parochial school to absent himself or herself from attendance at school during such period when public, private or parochial schools are in session. ATTENDANCE POLICY I. ABSENCE POLICY A. Excused Absences Yorkville High School will follow the attendance policies established by the State of Illinois in reference to excused/unexcused absences. A student's absence will be considered excused for the following reasons : 1 . Illness/injury 2 . Death in the Family 3 . Family emergency 4 . Religious holidays 5 . Pre-approved by administration 6 . Court appearance The office does not accept notes from parents. The parent must call the school office in the morning before 9 : 00 a . m . and explain the reason for the student's absence at 630/553-4380 . The office will handle requests for homework only after two consecutive absences . B. Pre-Excused Absences A pre-excused absence form should be issued from the Attendance Office days ahead of time, which includes two days plus the number of days of intended absence . Example : a three day absence requires a form filled out completely and returned to the office five days ahead of the intended absence . (In the case of a college day, the counselor will issue the pre-excused form . ) Pre-excused forms must be signed by all the student's teachers and a parent. The main office staff will cal the parent/guardian to verify the absence when the completed form is returned . 1 . Medical and dental appointments - Students who will miss a portion of the school day for a dental or medical appointment must fill out a pre-excused form and return it to the office at least one day before appointment. Students returning to the high school after a doctor or dentist appointment must have a doctor's note confirming the time frame that the student was seen by doctor. 2 . College visitation - two days may be used during the school year for juniors and seniors to visit colleges of their choice. The counselor should be contacted for approval prior to the student's absence . Credit will not be withheld for days missed ; however, days will be counted as absent days . Students that visit a college must bring back to the attendance office a visit confirmation note from either the college counseling office or the college registrar. 3 . Business trips with parents - Family business trips, when possible, and college visitations are not to be planned during the last week of each term and the last three weeks of school to be considered for excused absences . 4 . Parent or guardian of a child who is to be excused from attending school due to the observance of a religious holiday should give notice of the child 's absence to the appropriate school official, not to exceed five ( 5 ) days. 5 . Court Appearance C. Unexcused Absences If the Main Office has not received a phone call from the student's parent or guardian prior to 9 : 00 a . m . on the day of the absence, the student will be considered unexcused . Unexcused absences are defined as those absences which are not authorized and/or school related including suspensions. Unexcused absences will result in zero credit for any classes missed , with no opportunity to make up missed work. In order to comply with the School Code, the school reserves the right to determine if an absence is unexcused . The school considers the following reasons as examples of absences without valid cause, thereby resulting in an unexcused status : 1 . Oversleeping 2 . Car trouble 3 . Missing the bus 4 . Excessive Absences Yorkville C. U . S . D . 115 believes that in order for a student to obtain the most from the educational opportunities provided , it is important that the student be in attendance on a regular basis and every effort must be made to keep absences to a minimum . The following procedures are in place to insure that there is communication between the schools, parents and students regarding absences. 1 ) . At ten absences, a letter will be sent home regarding the concern with attendance. 2) . At 15 days absent, a letter will be sent home requiring medical documentation for any absence to be excused . 3) . At 18 days absent, any student under the age of 17 will be referred to the Kendall County Attendance Caseworker. (If a student is over 17 years of age, they may be dropped as a student from Yorkville High School . ) Please be aware that whether a student is excused or unexcused , excessive absences will have a negative impact on student learning and success . We strive to work together with parents and/or guardians to keep student absences to a minimum . We will consistently monitor our attendance and send informational letters to families to keep them abreast of their student's attendance pattern . E. Skip Day Disclaimer The school does not recognize or condone any "skip days" and discourages parents from excusing students for such absences . II. GUIDELINES FOR MAKE-UP WORK BECAUSE OF ABSENCE FROM SCHOOL A. It is the student's responsibility to meet with each teacher and obtain the assignments for each class that needs to be made up as a result of an absence . B. Work done to complete make-up assignments is to be outside of class time (make-up exams could be an exception) . C. The length of time to complete all make-up work will be equal to the number of days absent prior to the day the assignment was due . Example : Suppose a student is absent Wednesday through Friday of one week and comes back to school on Monday of the next week. Here is an example of when the assignments for the missed days will be due . (Of course this is in addition to the current work also being turned in . ) Monday : All assignments made prior to the first day of absence ( before Wednesday) which was due during the absence (any of the days Wednesday through Friday) will be due on this day . Tuesday : If an assignment was made on the first day of absence (Wednesday) and was to have been turned in on the next day (Thursday) it will be due today . Wednesday : If an assignment was made on the first or second day of the absence (Wednesday or Thursday) and was due on the third day of the absence ( Friday) it will be due today. Thursday : Any assignments made during the absence which was due on Monday of this week are due today . D . When advance notice of a test has been given , the test is to be made up on the day a student returns ( providing no new material was covered during the absence that is on the exam) . E . Assignments made before absences are due upon the student's return to class . F. If a student is absent because of a school or prearranged absence, it is the student's responsibility to secure the assignments and complete before the absence . The teacher must be given one full day for each day of absence for preparation of make-up work. Notification to the teacher of the planned absence must be two days in addition to the number of days absent because of the school/prearranged absence . Tuesday : This would be the last day that a student could notify a teacher of a planned school/prearranged absence on Friday. Wednesday : Teacher gives assignment to student, due on Thursday. Thursday : Student turns in assignments to teacher (takes quiz or test) . Friday : Student is absent. G . Make-up work will be graded and appropriate credit toward the class grade will be recorded when : 1 . the absence is excused . 2 . the make-up work is completed and turned in within the designated time limit. 3 . any work with major impact on grade; e . g . major test, paper, etc. , regardless is absence is excused or unexcused provided the student makes proper arrangements . H . Make- up work will be graded but zero credit will be given when : 1 . the absence is unexcused . 2 . the make- up work is turned in after the designated time limit, III. STUDENT SIGN IN /SIGN OUT POLICY A. Any absence which results from a student signing in late or signing out early will be considered excused or unexcused by the criteria used in the Absence Policy . A student may sign in/sign out for the following reasons : 1 . Illness/injury 2 . Death in family 3 . Family emergency 4 . Religious holiday 5 . Court Appearance B. Make- up work for those students signing in late or signing out early will be allowed according to the criteria listed above . C . Only the parents or legally appointed guardians may be permitted to sign a student in or out of school . D , A student can only be signed out of school for the above listed reasons. Students may not sign out for the sole purpose of lunch . If a student signs out of school , a written verification may be requested upon the student's return . IV. PENALTIES FOR ATTENDANCE VIOLATIONS Yorkville High School is on a closed campus attendance system . All students must be enrolled in four (4) blocks each semester. Seniors may have early release if they meet all graduation requirements . Every student must attend all classes assigned , and lunch is part of a student's assigned classes . Any student who is out of the building during the school day without permission is subject to disciplinary action . The disciplinary consequences for missing assigned classes are listed below . A. Tardiness - Per semester ( Unexcused late arrival to school or to class) . Yorkville C . U . S . D . # 115 provides a service in transporting students to and from school , provided the student lives more than 1 . 5 miles from school . Should a student choose not to take advantage of this service, the student assumes the responsibility of getting to school on time . The following applies to all students who arrive at school by means other than school bus transportation regardless if eligible for bus transportation or not. 1st and 2nd offenses - No Consequences 3rd offense - Verbal Warning 4th and any additional offenses - Results in a school consequence ranging from detention to one day suspension for each tardy to school . B. Arriving to School more than thirty (30) minutes late - Arriving to school or any class thirty (30) or more minutes after the tardy bell . 1st offense - 2 detentions 2nd offense - Saturday detention , parent contact 3rd offense - Saturday detention , loss of parking pass for one week, parent contact 4th offense and any other subsequent - one day suspension, loss of parking pass for one month, parent contact. C. Class Cutting Deliberate failure to attend classes or lunch . 1st offense - 2 detentions 2nd offense - Saturday detention , parent contact 3rd offense - Saturday detention, loss of parking pass for one week, parent contact 4th offense and any other subsequent - one day suspension, loss of parking pass for one month , parent contact. D . Unexcussed Absence from School The unexcused absence from class for at least half the school day and or leaving campus. 1st offense - Saturday detention , parent contact. 2nd offense - Saturday detention , loss of parking pass for one week, parent contact. 3rd offense and any other subsequent - one day suspension, loss of parking pass for one month , parent contact, and referral to Kendall County Truancy Program where appropriate . 4th offense - and any other subsequent offense is one day suspension and referral to the Grundy/Kendall Superintendent of Schools . The regional superintendent may then schedule a truancy hearing . E. Delegation of Authority Each teacher, and any other school personnel when students are under his or her charge, is authorized to impose any disciplinary measure, other than suspension , or expulsion , corporal punishment or in -school suspension , which is appropriate and in accordance with the policies and rules on student discipline . Teachers, other certificated employees, and other persons (whether or not certified ) providing a related service for or with respect to a student, may use reasonable force as needed to maintain safety for other students, school personnel or persons, or for the purpose of self-defense or defense of property. Teachers may remove students from a classroom for discipline behavior. The Superintendent, Building Principal, Assistant Building Principal or Dean of Students is authorized to impose the same disciplinary measures as teachers and may suspend students guilty of gross disobedience or misconduct from school ( including all school functions) and from riding the school bus for such misconduct on a school bus for up to ten ( 10) consecutive school days, provided the appropriate procedures are followed . Bernstein DATE: February 19, 2009 RE: Restricting Mobile Food Vendors The purpose of this memorandum is to provide guidance regarding the restriction of certain types of mobile food vendors in the City. It is my understanding that there have been several resident complaints about ice cream vendors. Section 11 -20-2 of the Illinois Municipal Code (65 ILCS 511 - 1 -1 , et seq.) gives a municipality the authority to regulate the sale of food and beverages. In accordance with this Section, the United City of Yorkville has provided for the regulation of mobile food vendors pursuant to City Code Section 3-513. Ice cream vendors are authorized as a mobile food vendor under this Section of the City Code. There is nothing in the City Code which authorizes the registration of one type of mobile food vendor but not another. If the mobile food vendor meets the qualifications and requirements of the City Code provisions, the vendor shall be registered with the City. In addition, federal law requires that businesses be treated equally. The law further mandates that there must be a compelling state interest to enact any law regulating businesses and the legislation must accomplish its goal using the least restrictive method. There has not been a compelling interest presented to the City for additional restrictions of ice cream vendors. It is certain that restricting ice cream vendors and not other types of mobile food vendors, i.e. hot dog vendors, would be a violation of federal law, unless specific reasons to differentiate between such businesses are demonstrated. For example, if the City Council decided to restrict a mobile food vendor from parking in one place for more than one hour, it would mean that the hot dog vendor who sells hot dogs from a cart at a baseball game would not be able to stay at the game for more than one hour. The basis for such a restriction would be that mobile food vendors should not have the same benefits and privileges as a stationary business which pays real estate taxes and has made a major investment in the community. Nonetheless, the rational basis would affect all mobile food vendors. Increasing the cost of the registration is an option to discourage all mobile food vendors from applying. However, the cost of registration must not be excessive and must be commensurate with the administrative costs incurred by the City to issue such certificate of registration since the 1970 Constitution of the State of Illinois prohibits occupation taxes unless specifically authorized by law. If for instance, the City imposed a $ 1000 registration cost and could not justify the basis for this amount, it would likely be considered an occupation tax. A municipality does not have the authority license mobile food vendors or to impose an occupation tax, it simply has the authority to regulate. Mobile food vendors may be cited for a violation of the City Code and could also be subject to the revocation of a certificate of registration. MOBILE FOOD VENDOR UNITS 3-513-1 : DEFINITIONS : For purposes of this article, the following words and phrases shall have the following meanings ascribed to them respectively: COMMISSARY: A catering establishment, restaurant, or any other place in which food , containers, or supplies are kept, handled, prepared, packaged , or stored . MOBILE FOOD UNIT: A vehicle mounted food service designed to be readily movable. PUSHCART: A self-propelled vehicle limited to serving nonpotentially hazardous foods or commissary wrapped food maintained at proper temperatures. SANITIZATION : The effective bactericidal treatment by a process that provides enough accumulative heat or concentration of chemicals for enough time to reduce the bacterial count, including pathogens, to a safe level on utensils and equipment. (Ord . 2008-38, 5-13-2008) 3-513-2 : CERTIFICATE OF REGISTRATION REQUIRED : Every person desiring to engage in mobile food service within the city is hereby required to make written application for a certificate of registration as hereinafter provided . It shall be unlawful for any person to engage in mobile food service without having first obtained said certificate of registration . Said certificate shall be carried by the applicant while engaged in mobile food service and shall be displayed at all times in a place readily visible to all customers. Application for a certificate of registration shall be made upon a form provided by the office of the city clerk and filed with such. The applicant shall truthfully state in full the information requested on the application: 1 . Place Of Residence; Social Security Number: Name and address of present place of residence of the applicant and length of residence at such address; also business address if other than residence address; also social security number and date of birth ; 2. Identification: Copy of current state photo identification or driver's license; 3. Conviction Of A Violation; History: Whether the applicant has ever been convicted of a violation of any of the provisions of this chapter or the ordinance of any other Illinois municipality regulating the activities of mobile food vendors; 9. Conviction Of A Felony; History: Whether the applicant has ever been convicted of the commission of a felony under the laws of the state of Illinois or any other state or federal law of the United States; 10 . Tax Identification Number: Each applicant shall produce an Illinois department of revenue identification number for the retailers' occupation tax. No license shall be issued if the applicant does not have an identification number except that no identification number shall be required if a mobile food vendor is sponsored by or working for a religious, educational , or charitable organization where such organization is entirely a nonprofit organization and who can furnish the city with a "tax exempt number" and written proof of its "tax exempt status'; 11 . Health Certificate: Any mobile food vendor shall be required to obtain a health inspection certificate from the Kendall County public health department. Said certificate shall be required to do business under a certificate of registration under this title in the city of Yorkville; 12. Photo Of The Applicant: Each applicant shall submit a photo that must be the same . size as required for passports _ two inches by two inches (2" x 2"). B. All statements made by the applicant upon the application or in connection therewith shall be under oath . C. The office of the city clerk shall require every applicant to submit to fingerprinting by the police department in connection with the application for certificate. The applicant shall pay the fee as set by the Illinois state police for fingerprint submissions. D. No application fee shall be charged of a mobile food vendor sponsored by or working for a religious, educational , or charitable organization where such organization is entirely a nonprofit organization and who can furnish the city with a "tax exempt number" and written proof of its "tax exempt status" . (Ord . 2008-38, 5-13-2008) 3-5134: ISSUANCE OF CERTIFICATE : The office of the city clerk, after consideration of the application and all information obtained relative thereto, shall , within ten (10) business days of application , approve or deny the application. If the person does not possess the qualifications for such certificate, as herein required, and the issuance of a certificate of registration to the applicant would not be in accord with the intent and purpose of this chapter, then the office of the city clerk shall deny the application . Endorsement shall be made by the office of the city clerk upon the application of the denial of the application. If the applicant is found to be fully qualified , the certificate of registration shall be issued within five (5) business days of the application approval so long as the application fees have been fully paid . Any certificate of registration issued pursuant to this chapter shall expire one year after issuance. (Ord . 2008-38, 5-13-2008) 3-5B-5 : MOBILE FOOD SERVICE: A. Mobile food units or pushcarts shall comply with the requirements of this article, except as otherwise provided in this section . The health department may impose additional requirements to protect against health hazards related to the conduct of the food service establishment as a mobile operation, may prohibit the sale of some or all potentially hazardous food and , when no health hazard will result, may waive or modify requirements of this article relating to physical facilities except those requirements of subsections D and E of this section , and subsections 3_513-613 and 3-513-713 of this article. (Ord . 2008-38, 5-13- 2008) B. All food items available for sale and the price of each item must be posted on the exterior of the mobile food unit or pushcart. Mobile food units serving only food prepared , packaged in individual servings, transported , and stored under conditions meeting the requirements of this article or beverages that are not potentially hazardous and are dispensed from covered urns or other protected equipment, need not comply with requirements of this chapter pertaining to the necessity of water and sewage systems nor to those requirements pertaining to the cleaning and sanitization of equipment and utensils if the required equipment for cleaning and sanitization exists at the commissary. D. A mobile food unit requiring a water system shall have a potable water system under pressure. The system shall be of sufficient capacity to furnish enough hot and cold water for food preparation, utensil cleaning and sanitizing, and hand washing , in accordance with the requirements of this chapter. The water inlet shall be located so that it will not be contaminated by waste discharge, road dust, oil or grease, and it shall be kept capped unless being filled . The water inlet shall be provided with a transition connection of a size or type that will prevent its use for any other service. All water distribution pipes or tubing shall be constructed and installed in accordance with the requirements of this chapter. E. If liquid waste results from operation of a mobile food unit, the waste shall be stored in a permanently installed retention tank that is of at least fifteen percent ( 15%) larger capacity than the water supply tank. Liquid waste shall not be discharged from the retention tank when the mobile food unit is in motion . All connections on the vehicle for servicing mobile food unit waste disposal facilities shall be of a different size or type than those used for supplying potable water to the mobile food unit. The waste connection shall be located lower than the water inlet connection to preclude contamination of the potable water system . (Ord . 2008-38 , 5- 13-2008) 3-5B-6: COMMISSARY: A. Mobile food units or pushcarts shall operate from a commissary or other fixed food service establishment and shall report at least daily to such location for all supplies and for all cleaning and servicing operations. B. The commissary or other fixed food service establishment used as a base of operation for mobile food units or pushcarts shall be constructed and operated in compliance with the requirements of this chapter. (Ord . 2008-38, 5-13-2008) 3-5B-7 : SERVICING AREA AND OPERATIONS : A. A mobile food unit servicing area shall be provided and shall include at least overhead protection for any supplying, cleaning , or servicing operation . The surface of the servicing area shall be constructed of a smooth nonabsorbent material , such as concrete or machine laid asphalt and shall be maintained in good repair, kept clean, and be graded to drain . B. Potable water servicing equipment shall be installed according to law and shall be stored and handled in a way that protects the water and equipment from contamination. The mobile food unit liquid waste retention tank, where used , shall be thoroughly flushed and drained during the servicing operation . All liquid waste shall be discharged to a sanitary sewerage disposal system in accordance with Yorkville-Bristol sanitary district rules and regulations.
