PRESENT: Chairperson Spears, Committeemen Plocher (arrived at 6:25pm), Sutcliff, and Werderich ABSENT: None ALSO PRESENT: Chief Harold Martin and Lieutenant Don Schwartzkopf Chairperson Spears called the meeting to order at 6: 13 pm. PRESENTATION : None MINUTES : The minutes of March 26, 2009 were approved. NEW BUSINESS: 1 . PS 2009-12 Police Reports for March, 2009 Chief Martin stated that the Police Department has been rather busy. Please note that there are some letters regarding use of the K-9. Committeeman Werderich asked if there has been a spike in any type of offenses. Chief Martin replied that overall crime has been down by 4%, however, due to the spike in the number of people within the City and the hard economic times, there has been in increase in Domestic Violence cases. Discussion took place regarding an increase to DWLS and DWLR cases. Some vehicles from felony cases are being seized. In fact cars M-26 and M-27 are both confiscated vehicles that the department is currently using. This item was moved to the Consent Agenda. 2. PS 2009-13 Ordinance Amending the Code of Ordinances Providing for the Regulation of Animals Chief Martin explained that this item has returned to the Committee because the ordinance requires persons walking an animal to be 18 years of age or older. The 1 change allows for persons who are familiar with the animal and able to control the animal to walk it. Chairperson Spears noted that she received a call regarding this matter and the resident was upset. The resident was advised that a change was being considered for this ordinance. This item was moved to the Consent Agenda. OLD BUSINESS : 1. PS 2009-08 BASSET Training Requirement — Discussion This item was moved to the next meeting agenda as Mayor Burd was unable to attend. Committeeman Werderich advised that he has received calls from people interested in attending the meeting; he will advise them to attend the next meeting. This item is to return to the May Public Safety Committee Agenda. 3. PS 2008-55 Ordinance Amending the Code of Ordinances Providing for the Regulation of Truancy Chief Martin stated that the ordinance now mirrors the State Statute. Chairperson Spears stated that she asked an advisor to check the ordinance for her and was told to inquire about the following: 1 . What does the handbook say about calling parents? Chief Martin stated that Office Helland needs to respond to the question. Chairperson Spears will email him regarding this question. 2. How many violations must occur before the student and family appear in court? Recording Secretary Hartigan referred to the March 26, 2009 Public Safety Committee Minutes in which it stated that each case would be considered on a case-by-case basis. Chief Martin thinks it is good to get everyone involved. Committeeman Sutcliff that the School Truancy Officer, Mary Gozner, thinks the ordinance is great, but is worried that some of the work will be sent to her. Also, she noted that the school kids in the apartments near Jewel do not get bus service and therefore, have a high truancy rate. On a personal note, she stated that her daughter was very sick last semester and missed 15 days of school throughout the semester. She stated that she received 2 letters and a call from the school and these were for excused absences. She hopes that the ordinance will get parents attention and let them know that the school, the City and the Police Department are behind them and support this ordinance. It was noted that by the time the kids with truancy problems are sent to Mary Gozner, it is typically too late to try to help them. This ordinance allows something to be done sooner to help the kids stay on the right track. Chairperson Spears suggests moving this item to I " Reading at the City Council Meeting. Committeeman Sutcliff stated that I " Reading was supposed to happen at the last meeting and is concerned about getting the information into the school handbook. Recording Secretary Hartigan noted that the March 26, 2009 Public Safety Committee Meeting Minutes noted that the ordinance would go to I " 2 Reading at the April 14, 2009 City Council Meeting, however, since it was changed to mirror the State Statute, it must have returned to this committee for approval. Lt. Schwartzkopf contacted Rob to determine when the deadline was for the school handbook. Rob was unaware but stated that the next meeting is a few weeks away and then it will need to be sent for attorney approval, etc. Chairperson Spears suggested the item move to I " Reading at the City Council Meeting and also be posted on the City's website. Committeeman Sutcliff will advise the school district that the ordinance will be posted on the website, but that it has not yet been approved. This item was moved to First Reading at the City Council Meeting. STATE OF ILLINOIS ) DRAFT COPY FOR ) ss PUBLIC SAFETY COUNTY OF KENDALL ) RESOLUTION NO. 2009- A RESOLUTION TO ADOPT THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS) WHEREAS, in Homeland Security Directive HSPD-5, the President directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS), which would provide a consistent nationwide approach for Federal, State, local, and tribal governments to work together more effectively and efficiently to prevent, prepare for, respond to and recover from domestic incidents, regardless of cause, size or complexity; and WHEREAS, it is necessary and desirable that all Federal, State, local and tribal emergency agencies and personnel coordinate their efforts to effectively and efficiently provide the highest levels of incident management, and WHEREAS, to facilitate the most efficient and effective incident management it is critical that Federal, State, local, and tribal organizations utilize standard terminology, standard organizational structures, interoperable communications, consolidated action plans, unified command structures, uniform personnel qualification standards, uniform standards for planning, training, and exercising, comprehensive resource management, and designated incident facilities during emergencies or disasters, and WHEREAS, the NIMS standardized procedures for managing personnel, communications, facilities and resources will improve the ability to utilize federal funding to enhance local and state agency readiness, maintain first responder safety, and streamline incident management process, and WHEREAS, the Incident Command System components of NIMS are already an integral part of various incident management activities throughout the County, including current emergency management training programs, and WHEREAS, the National Commission of Terrorist Attacks (911 Commission) recommended adoption of a standardized Incident Command System NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, does hereby establish the National Incident Management System (NIMS) as the standard for incident management. SECTION 1 : this Resolution shall be in full force and effect immediately upon its passage. Our current city code allows for two Class A liquor licenses to be issued in the downtown area and an additional three Class A liquor licenses to be issued outside the downtown area for a total of five Class A liquor licenses. Previously, we had five Class A liquor licenses issued. We had one licensee change their Class A liquor license to a Class R liquor license. Now we currently have four businesses with a Class A liquor license. This amendment would reduce the number of Class A licenses down to four to match with the current number of issued licenses. Attached you will find a red-lined version of the current city code showing this proposed change. Also attached is a draft ordinance to make this change in our code book. 3-3-6: NUMBER OF LICENSES: A. No limitation shall be in effect within the city as to the maximum number of liquor license holders, except with reference to: 1. Number Of Licenses For Classes Al Through A4: Holders of classes Al through A4 which shall not exceed the number of two (2) licenses issued at any given time in an area commencing at the intersection of the center line of Route 47, also known as Bridge Street, and the center line of Van Emmon Street, and running thence west along the center line of Van Emmon Street to the alley; thence in a northerly direction parallel to the center line of said Route 47 to the south bank of the Fox River; thence easterly along the south bank of the Fox River to a point which intersects with the center line of Heustis Street extended; thence along said east line extended in a southerly direction and along the center line of said Heustis Street until said line intersects the center line of Van Emmon Street; thence west along the center line of Van Emmon Street to the intersection of the center line of Route 47; thence westerly along the center line of Van Emmon Street to a point 100 feet westerly of the easterly line of Route 47; thence southerly parallel with Route 47 (the same being Bridge Street) to the point of intersection of the center line of Washington Street; thence easterly along the center line of Washington Street to a point 100 feet easterly of the easterly line of Route 47, the same being Bridge Street thence northerly parallel with the easterly line of Route 47 to its intersection with the center line of Van Emmon Street; thence westerly along the center line of Van Emmon Street to the place of beginning. In any event, it shall be unlawful to sell or offer for sale at retail any alcoholic liquor within any residential portion of the city'. 2. Additional Retail Type Licenses Issued: The liquor control commissioner shall further have a right to issue up to a total of two three (23) additional retail type licenses inclusive of any of the four (4) existing retail class licenses, in areas outside the above designated downtown area and outside of any residential area subject to approval of the city council, in order to provide for the orderly growth of the city with respect to additional territories being developed and annexed within the city. No licenses in excess of two three (23) additional class Al through A4 licenses, inclusive, shall be issued outside of the downtown area without amendment of this section by the city council. (Ord. 2008-59, 7-8-2008) 3. Maximum Number Of Package (Class B And B1) Liquor Licenses: There shall be no more than nine (9) class B liquor licenses at any one time. Number Of Licenses Required In A Shopping Center: There shall be permitted not more than any one liquor license of any package (B or B1) class in any shopping center up to one hundred thousand (100,000) square feet of gross building floor area. There will be available one additional liquor license of said package class for those shopping centers in excess of one hundred thousand (100,000) square feet of gross building floor area upon approval of the liquor commissioner. (Ord. 2008-59, 7-8-2008) Ordinance No. AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS PROVIDING FOR LIQUOR CONTROL WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality pursuant to the Constitution of the State of Illinois of 1970 and with such powers as granted to it by law; WHEREAS, the Liquor Control Act of 1934, 235 ILCS 5/1 - 1 , et seq., (the "Liquor Control Act") sets forth a comprehensive system for the regulation of the sale and distribution of liquor within the state of Illinois, and grants broad powers to municipalities with regard to local retail licenses; and WHEREAS, the City Council of the United City of Yorkville has determined that it is in the best interests of the public health, safety and welfare of its residents to amend the regulations pertaining to the sale and distribution of liquor as set forth in the City Code of the United City of Yorkville as hereinafter, set forth. NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. Title 3 , Chapter 3, Section 6 (A)(2) of the United City of Yorkville Code of Ordinances is hereby amended by deleting subsection 2 in its entirety and replacing it with the following: 2.
