PW 2008-157 Provena-Dreyer Medical Facility—Final Acceptance Alderman Allen had questions on three items: 1) He was concerned that Nicor's paperwork had, at one time,been misplaced at city hall. Mr. Wywrot explained that the paperwork had come up missing when the gap in city attorney duties occurred. Mr. Wywrot assured Mr. Allen that the clerk's office is very organized.; 2) Joe Wywrot informed Alderman Allen that the Hampton Inn site and building plans have been approved, and that photometrics would be approved soon; 3) Windrose sidewalk will be completed after the signal at Rt. 34 and Game Farm is completed. The property is solely for use of constructing and maintaining the sidewalk. New Business 1. PW 2008-158 Water Dept. Sept. 08 report 2. PW 2008-159 Water Dept. Oct. 08 report Mr. Dhuse said that water usage is slowing down as the weather becomes colder, and that the city has experienced two water main breaks. Losses were at 600,000 and 300,000 for the breaks. Mr. Dhuse said the downtown area pressure was higher than normal this summer but that blow off pressure valves were in place. 3. PW 2008-160 Leaf pickup summary. Mr. Dhuse said he would like more advertising next year in the Record and on WSPY for awareness and education. The leaf pick up message is too long for use of the police department portable sign. This information item will be added to the administrator's weekly report. 4. PW2008-161 Revision to UCOY Water ordinance This item is being tabled. Mr. Dhuse stated there are additional changes that need to be made, after Susan Mika's and Judy Dyon. It will be discussed at a future public works meeting. 1 Old Business: 1. PW 2008-147 Game Farm/Somonauk St.—Addn. Ph. 2 Engineering This was initially reported in November, and is ready for compensation of right of way, easements, and revised areas on the plat of highway in preparing legal documentation to enter negotiations for purchasing the easement properties. Smith Engineering originally identified some of the easement property, now not needed by the city. The$60,000 original request is now for about 536,400. Funding is through MFT, and 1/-2 would be federally funded, which will be available in 2010, so this process should begin now. This will be a joint agreement through the Kane Kendall Co. of Mayors. This will go to the city council for further discussion. 2. PW 2008-94 Quiet Zone Engineering Services Agreement— This was presented to the committee 6 months ago when a resident brought it to the committee's attention. Gr. Reserve has not built out additional units, nor is there money in the budget for engineering the contract, the application, design, or construction of the improvements. Mr. Olson is asking the committee if they should start the contract prior to the developer building the crossing at Mill l Kennedy Roads. The city could begin improvements, only to find that the developer needed further upgrades to be approved by federal quiet zone guidelines. The council members are not opposed to the quiet zone,but at this time do not feel it in the city's best interest to move forward with spending. The council members will be willing to visit with the resident regarding this matter, should the resident wish to attend the next public works meeting. If not, the item will come back to this committee in 6 months. 3. PW 2007-108 In Town Road Program—Update Alderman Besco asked this be brought to the attention of committee, because it is a program of utmost importance. He would like to see ongoing solutions,phasing mentioned on the administrator's weekly, as the budget proposals for next year begin. The original in-town program started in 2003, 1"phase was build in 2005, and second phase was build in 2007. Additional Business: Alderman Allen questioned if the revolving loan program would be available for any programs. City Administrator McLaughlin will find out additional information. The Beecher Road Bridge was mentioned by Alderman Allen. In particular,this new bridge would be another access through the area, and give greater accessibility to the new hospital and county buildings. The city needs a corridor study as the first step in the process of obtaining any funding for this project. Further discussion will continue on this next month. There are a minimal amount of chip sealed roads in Yorkville.Most are paved with asphalt. There will be areas proposed for this process on the next budget,because they are more cost effective. WITNESSETH: WHEREAS, the Owner/Developer is the owner of certain real estate situated within the existing corporate limits of the City, which real estate is the subject matter of a certain Annexation Agreement dated April 24, 2005, by and between the City and the Owner/Developer (the "Annexation Agreement"); and, WHEREAS, the terms of the Annexation Agreement recorded with the Kendall County Recorder of Deeds on December 19, 2005, as Document #200500039118 are hereby incorporated herein by this reference; and, WHEREAS, pursuant to the Annexation Agreement, the Owner/Developer is responsible to construct a temporary sanitary lift station to serve the needs of the residential subdivision to be developed on the real estate specifically described therein (the "Properly'); and, WHEREAS, the City has agreed to permit the Owner/Developer to construct a temporary sanitary sewer lift station to service the property so long as it meets all requirements of the City Code. NOW,THEREFORE,the parties hereto agree as follows: 1. The preambles hereinabove set forth are true and correct and hereby incorporated herein as if fully restated. 2. The Owner/Developer hereby agrees to construct a temporary lift station in accordance with all applicable ordinances of the City in order to adequately serve all development to be constructed on the Property. 3. The Owner/Developer hereby agrees to be responsible for all costs relating to the service, maintenance and operation of said temporary lift station for a period of no less than two years after acceptance by the City of title thereto pursuant to a Bill of Sale, in the form attached hereto and made hereof, delivered to the City upon completion of no less than 50% development of the approved subdivision plan for the Property and approval of the City Council after the approval of the City Engineer. 4. The City hereby agrees to service and maintain said temporary lift station and to pay all utility costs in connection with its operation for a period commencing with its initial usage and terminating on the second anniversary of its acceptance by the City as hereinabove stated, on the condition that simultaneously with the execution of this Agreement the Owner/Developer deposits with the City $7,500 ("Initial ReimbursemenP') for the purpose of reimbursing the City (in advance) for costs of service, maintenance and operation to be incurred by it for the succeeding twelve months and thereafter depositing an amount no less that the Initial Reimbursement plus five percent (5%) for each succeeding twelve month periods. The Initial Reimbursement amount is based on estimates as itemized in the attached Exhibit `B'. 5. The City agrees to hold the Initial Reimbursement and all subsequent reimbursement payments made by the Owner/Developer for said purposes and provide the Owner/Developer with an accounting each twelve month period following the date of the Initial Reimbursement. 6. In the event the Initial Reimbursement, plus 5%, is not anticipated to cover all of the costs for which the OwnerlDeveloper is responsible, the subsequent reimbursement by the Owner/Developer shall be increased to reflect the estimated increase in costs for the following twelve month period. 7. On the second anniversary of the date of acceptance of the temporary lift station by the City, the City shall return any unused amounts held by the City and not required for reimbursement of the aforesaid costs due and owing. 8. The Owner/Developer shall have the right to assign this Agreement to any qualified successor on the condition that such assignment is approved by the City and the assignee agrees, in writing, to be bound by the terms of this Agreement and perform all obligations of the Owner/Developer hereunder. 9. The Owner/Developer shall also be responsible for any costs incurred by the City in connection with the enforcement of any of the terms of this Agreement including, but not limited to, court costs and attorney's fees. Route 71, about one-quarter mile east of the intersection of Route 71 and E. Highpoint Road. This permit is required for construction of a new driveway entrance for an interim use of this property. Their request is based on work completed to date. I have reviewed the reduction requests and in general concur with the amount of work completed to date. Our Parks Department does not agree that the fertilizer/herbicide treatment claimed for Phase 1 was applied—this item is intended for application at a later date. The developer calculations also failed to retain 15%of the value of completed work in the remaining bond amounts. See the attached summary and calculation sheets for details. I recommend that Armor Assurance Company Bond 4ARM10694 for earthwork be reduced by the amount of$10,723.56. The remaining amount of the bond would be $61,913.97. Their request is based on work completed to date and Section 11A of their annexation agreement, which states that bonds or letters of credit shall not be required for work funded by Special Service Area bonds. Centex had previously established bonds for work funded by the SSA bonds, and is now requesting that those bonds be reduced accordingly. I have reviewed the various reduction requests and in general concur with the amount of work completed to date and the amount of work covered by the SSA bonds. While the developer calculations and my own are relatively close,there were some minor differences between the requested and recommended bond reduction amounts. See the attached summary and calculation sheets for details. I recommend that the construction guarantee bonds for sitework, earthwork, and landscaping for Bristol Bay Units 1, 2, 3, 5, 6, and 7 be reduced a total amount of$2,101,873.41 as detailed on the attached summary sheet. Please place this reduction request on the Public Works Committee agenda of January 20, 2009 for consideration. If the DEVELOPER chooses to use a Special Service Area as a primary funding mechanism for the installation of public improvements, per United City of Yorkville's Resolution No. 2002-04, the OWNERS and DEVELOPER shall not be required to post any irrevocable letters of credit or surety bonds to guarantee the installation of those public improvements. Any public improvements installed by the OWNER and DEVELOPER as part of a special service area shall require OWNER and DEVELOPER to post a one-year maintenance bond equal to ten percent (10%) of the CITY engineer's reasonable opinion of probable cost after acceptance by the CITY of said public improvements. Ordinance No. AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, DECLARING DUTCH ELM DISEASE AND THE EMERALD ASH BORER AS NUISANCES WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing non-home-rule municipality created in accordance with Article VII, Section 7 of the Constitution of the State of Illinois of 1970; and, WHEREAS, pursuant to Section 5/11-20-12 of the Illinois Municipal Code (65 ILCS 511-1-1, et seq.), the corporate authorities of the City have determined that it is in the best interest of the City and the health, safety, and welfare of its residents to provide for the removal of elm trees infected with Dutch elm disease or ash trees infected with the emerald ash borer (Agrilus planipennis Fairmaire) from property not owned by the City or dedicated for public use when the owner of such property refuses or neglects to remove any such tree, and to collect from the property owner the reasonable cost thereof. NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of Yorkville, Kendall County, Illinois, as follows: Section 1. Title 4, Chapter 2A of the United City of Yorkville Code of Ordinances is hereby deleted in its entirety and replaced with the following: CHAPTER 2 PLANTS AND WEEDS ARTICLE A. DUTCH ELM DISEASE AND EMERALD ASH BORER 4-2A-1: NUISANCES DECLARED: A. Dutch Elm Diseased and Emerald Ash Borer Trees: Any elm tree infected with Dutch elm disease and any ash tree infected with the emerald ash borer (Agrilus planipennis Fairmaire) is hereby declared to be a public nuisance and subject to abatement. It shall be unlawful for any property owner to possess or keep such a tree after notification of the infection is given pursuant to this Article. B. Dead Trees: Trees or parts thereof in a dead or dying condition that may serve as a breeding place for Dutch elm disease or the emerald ash borer (Agrilus planipennis Fairmaire) are hereby declared to be public nuisances. It shall be unlawful for any property owner to possess or keep such a tree after notification of the infection is given pursuant to this Article. 4-2A-2: NOTICE TO ABATE; DUTY OF OWNER TO REMOVE: A. The director of public works or his representative shall give a written notice of the existence of a nuisance described in Section 4-2A-1 of this Article to the owner of property whereon the public nuisance is found. Such notice shall describe the nuisance, state the city ordinance which has been violated, identify the property by common description and the tree or trees affected, and require the removal of the nuisance within thirty (30) days. After notice has been given, it shall become the duty of the property owner to abate the nuisance. The removal and disposal of the nuisance shall be under the direction and supervision of the director of public works or his representative. Said notice shall also notify the property owner that unless the nuisance is removed and disposed of in compliance with the terms of notice, the city will proceed with the removal and disposal of the nuisance and assess the property owner for one hundred percent (100%) of the cost of removal and disposal. B. Such notice shall be given by personal service or sent by registered mail to the person to whom the tax bill for the general taxes for the last precedent year on the property was sent. 4-2A-3: ABATEMENT BY CITY; COSTS: If the property owner shall neglect to abate the nuisance within thirty (30) days after notice is given and thereafter causes the removal of such nuisance by the city, then the city, by its agents, servants or independent contractors, shall have the authority to go upon such property to cut down, remove the nuisance, and spray (either before or after such removal) an area of one thousand (1,000) square feet surrounding the nuisance, and the property owner shall be assessed the sum of one hundred percent (100%) of the cost of such removal and disposal by the city, 4-2A-4: LIEN; NOTICE OF LIEN: A. Any cost incurred by the city to abate a nuisance described in this Article shall be a lien upon the real estate affected, superior to all other liens and encumbrances, except tax liens; provided that notice of the lien has been given as hereinafter described, and that within sixty (60) days after such cost is incurred the city, or person performing the service by authority of the city, in its or his/her own name, files notice of the lien in the Kendall County Recorder's Office, B. The notice of lien shall consist of a sworn statement setting out (1) a description of the real estate sufficient for identification thereof, (2) the 2 amount of money representing the cost incurred or payable for the service, and (3) the date or dates when such cost and expense was incurred by the city. C. The lien shall not be valid as to any purchaser whose rights in and to such real estate have arisen subsequent to the tree removal and prior to the filing of such notice, and the lien shall not be valid as to any mortgagee, judgment creditor or other lienor whose rights in and to such real estate arise prior to the filing of such notice. D. Upon payment of the cost by the owner of or persons interested in such property after notice of lien has been filed, the lien shall be released by the city or person in whose name the lien has been filed and the release may be filed of record as in the case of filing notice of the lien. E. The cost of such tree removal shall not be a lien upon the real estate affected unless notice is given pursuant to Section 4-2A-2 of this Article. 4-2A-5: DUTY TO REPORT EXISTENCE OF DISEASED TREES: It is hereby made the duty of any person in the city to report to the city clerk the existence of any diseased elm or ash tree of which such person has knowledge. 4-2A-6: BRINGING ELM OR ASH WOOD INTO CITY: It is unlawful for any person to bring into the city any dead or dying elm or ash limbs, branches, stumps or wood. Any cordwood, firewood, or timber brought into the city shall contain no elm or ash wood. The director of public works or his representative may stop any person from bringing such wood into the city and, if necessary, abate said nuisance by causing the removal and disposal of such wood. 4-2A-7: ENTRY POWERS: It is lawful for the city, by its agents, servants, employees or independent contractors, to go upon any private property in the city to examine any elm or ash trees for the purposes of detecting a diseased condition, removing a small portion of any branch as a sample for laboratory tests, spraying, and removing and disposing of any diseased tree. Elected officials and staff have received calls from residents along Claremont Court in the Windett Ridge subdivision in the past and more recently with concerns about rear yard drainage. During heavy stones, a significant amount of water flows through their rear yards (map attached). Much of this stormwater comes from undeveloped fannland on the west side of Route 47 and passes through the rear yards of 101-149 Claremont Court before reaching a stonnwater basin in Windett Ridge. The engineering plans for Windett Ridge identify this offsite flow and the plat of subdivision established a drainage easement to be located along the rear yards of these home sites to convey this stormwater. The offsite tributary area is about 10 acres in size, and is located at the NW corner of Route 47 and Windett Ridge Road. This area drains to a culvert beneath Route 47, and prior to development of Windett Ridge continued through a swale that ran down to a small creek near the Commonwealth Edison right-of- way. The swale was located along a line that later became Claremont Court. Illinois drainage law requires that general drainage patterns be maintained, therefore a replacement drainage swale was provided along the rear yards of the homes on the north side of Claremont Court. Resident contact The first such resident contact was made in Summer 2007, and intermittent contact has been made since then. Originally, a few residents had documented the stormwater drainage patterns in their backyards, and had asked the City if anything could be done about the amount and rate of stormwater flow and some erosion problems along fences. The issue with the drainage easement is that although the amount of stonnwater is high, the drainage easement is declared on plats of subdivision, and is functioning properly as a drainage easement. The residents have asked for relief from the stormwater flow (pictures attached) and erosion. Members of City staff have met with the residents on a few different occasions to discuss the issues. We had advised and requested some of the residents to make minor and major physical changes in their yard, and major changes. Residents have complied by moving playground equipment from the drainage easement, making minor topographical changes within the drainage easements (i.e. mini-benns), and attempting to reshape water flow near their fences. The builder had changed some of the topography in the area upstream of all of the residents, which prevented erosion and washout on land near Route 47. All of the residents on this section of Claremont Court were contacted to attend tonight's meeting (except one, who has not made contact with City Hall on this issue at any time), and all have confinned their attendance. A few have provided photos for your review prior to the meeting and would like to share their stories with the Committee. Reciuested solution from residents and alternative solutions At this point, the residents are asking for City intervention to I) reroute the stornnwater away from the drainage easement, or 2) install a stonnwater pipe. Staff does not believe it is possible to re-route the water without major engineering efforts and significant costs. This area is part of the historic drainage pattern. I spoke with Jeff Wilkins shortly after the meeting, and the following is the summary of that conversation. Details of program The funds in the Revolving Loan Fund came from Community Development Assistance Program (CDAP) money from the Federal Government. This money is routed to the state and then down to the county. The primary purpose of the fund is to assist projects in which there will be job creation and/or retention of private sector jobs. Preference is given to projects that create or retain jobs which are targeted to people who reside in low to moderate income households. Low interest loans are available to government entities or private businesses which need working capital (gap funding) or money for construction projects. Assistance for construction projects is much more difficult to obtain than working capital, since various bidding laws and processes are required to be followed and documented. Additionally, loans for construction projects (i.e, roads), are much more likely to be awarded for projects in commercial/industrial areas, rather than residential areas. Loans are given for amounts at $15,000 per job created or retained, up to $750,000 per project. The County can not loan anymore than 49% of a project's total cost. In order to give a loan, the County requires collateral, usually in the form of a mortgage on a building or property. Letters of credit from a bank also can be used in place of collateral. In the past, parts of the application required many environmental reports and critiques, but not anymore. The restrictions and documentation now required within the application is almost exclusively restricted to discussion of job creation and retention. Interest rates for the loans depend on the project and the amount requested. Typically, loans for private projects will be a few points lower than the banks can give out. Loans for government entities would be similar to the current bond market (-4%). Terms and conditions of the loans are usually more flexible than banks. The maximum term for the loan is 15 years. There are no costs or fees for the loans, but the approval process is completely public, as the loan must be approved by the Kendall County Board. Past projects It was asked at the last Public Works Committee meeting if the Sandwich Best Western (located in Kendall County) was awarded a loan. It was indeed loaned $750,000 as part of this program, for job creation. In 2002 the city hired Smith Engineering Consultants to conduct a citywide transportation study. The city also hired Smith Engineering in 2002 for a separate study of a Fox River crossing for Countryside Parkway. The citywide transportation study was completed in 2003, and recommended three new roadway crossings of the Fox River,those being at Eldamain Road, Beecher Road, and Countryside Parkway. The preliminary engineering study of the Countryside Parkway crossing was also completed in 2003, and evaluated four separate alignments ranging in cost from$31,000,000 to $70,000,000 dollars. To date there has been no follow-up action regarding this project. In 2004 Kendall County assumed jurisdiction over Eldamain Road, and has proceeded with preliminary engineering for a river crossing. This $30,000,000 project is currently projected for construction in 2012, pending receipt of federal funding. In 2004, Engineering Enterprises, Inc. presented a proposal to the city to conduct a corridor study for Beecher Road, from Rt. 34 to Rt. 71. This proposal generated much debate about whether another river crossing was actually needed. Consequently,the city hired Smith Engineering in 2005 to conduct a detailed analysis based on land-use and travel patterns to determine how many river crossings would be needed when the Yorkville area was completely built out. That study, completed in 2006, concluded that a crossing in the vicinity of Beecher Road would be beneficial. In 2006 we added a proposed project to our Capital Improvement Program to define a corridor for the Beecher Road river crossing. The estimated cost of the study is $100,000, and would determine a specific alignment based on anticipated traffic demand, environmental factors, impact on nearby properties, and construction cost. The study has been budgeted for fiscal year 2008-2009, but due to the downturn in the economy the revenue source we planned to fund this work did not materialize, and we have not proceeded with the study. Building permits issued for new residential dwellings for 2006, 2007, and 2008 were 821, 419, and 159, respectively. One Yorkville developer has declared bankruptcy, another is in foreclosure. Three residential developments have constructed infrastructure but have no residents. We have received complaints from some contractors of non-payment from developers. Liens have been filed in some instances, and we are aware of one lawsuit filed by a contractor attempting to obtain payment from the letter of credit established for the development. We have also received an increase in complaints from some residents in new developments about standing water, weeds, gaps in or missing sidewalks, etc. We have had limited success in addressing standing water issues. If there happens to be a construction crew working onsite at the time, sometimes we can get them to re-grade or fill in the low area. A weed complaint is a code enforcement matter initially responded to by the Building Department. If the property owner does not mow after being notified by the city,then the city arranges for the mowing and invoices the property owner. Last year most mowing was performed by the Public Works Department because we found ourselves paying a private company to mow and then not getting reimbursed. Gaps in sidewalk or missing sidewalks are an issue because sidewalk is almost always constructed across the frontage of a lot after a home is constructed on that lot. When the school district establishes bus pick-up locations,they assume that sidewalk exists at that location even though it may not. We have letters of credit in place to guarantee completion of sidewalk,but to proceed with that work prior to construction of the house would result in damaged sidewalk or the need to replace sidewalk when the house is eventually constructed because the lot grading has changed. Placing sidewalk across a vacant lot also creates an issue concerning snow removal. We have bonds or letters of credit in place for most developments that are available to complete the construction of public infrastructure. While the dollar amount of these instruments are very likely adequate to cover the cost of completing the public infrastructure,they are not a guarantee that the work will be completed regardless of cost. Calling a letter of credit is a serious undertaking, and I would not recommend that we do so until other measures are attempted to address a problem. Some developments have Special Service Area funding, and the annexation agreement typically states that a bond or letter of credit is not required for improvements funded by the SSA. While this has not been a problem to date, it does place us in a position of not having funds available towards the end of a project to make sure that punchlist work is completed. We should reconsider the use of SSA funds for future developments, or perhaps require that a certain percentage (10%-15%)of the cost of SSA-funded improvements also be covered by a bond or letter of credit for this purpose. When we reduce a bond or letter of credit, it is normally done in consideration of certain improvements having been constructed. Historically we have not required developers to provide waivers of lien from their contractors. We should consider making a policy change to this effect. Roadway maintenance and paving of surface course is another issue. Since the build-out of a development can result in pavement damage, our Standard Specifications for Improvements states that surface course shall not be paved until at least 70%of a development is built-out. If we wait too long,however,the roadway will deteriorate due to the constant pounding from construction traffic. Therefore we also have a requirement that paving of surface course should not be delayed for more than three years. We have allowed several developments to delay paving of surface course to fours years or more,with the understanding that the developer will make the necessary roadway repairs prior to paving the surface course. With a bleak housing market in our near future,we must choose between allowing the binder course to deteriorate, or having the surface course paved and then be damaged by construction activity. The contract attached to this memo is a formal agreement based upon the original proposal, but also includes some additional terms. These additional terms include a defined contract period (through April 30, 2011), clarification on disposal and recycling of all items, and agreement to conduct mobile collection days (minimum two per year) at the City's request. This contract and its services are at very limited operational cost to the City (interaction with the residents when they drop off the items, contact with Com2 for pickup), no cost for the actual pickup, and likely no cost for supplies[. A few issues remain from an operational perspective, and these are noted as comments on the contract. If the Committee is agreeable to the contract in general, I would request that the contract be put on a February City Council meeting so that I have enough time to get internal sign-offs on these issues. The first remaining operational issue is the actual payment of the fees. Fees are only required for CRT monitors ($5) and TV's ($1 per diagonal inch). The Public Works facility does not accept any payments for any City bills, so we would not want them to accept payment for a-waste collection. This can be simply remedied (and has been discussed with Public Works Director Dhuse) by having the residents pay for CRT monitors and television recycling at City Hall, and providing a receipt to the resident for presentation at the Public Works building. A second operational issue is that the Public Works crews are usually on the street, which means they will not be able to assist in unloading heavy objects from someone's car. Heavy items which will be recycled are likely to be the large CRT monitors and large TVs —both items that need to be paid. When a resident presents payment at City Hall for these items, the City Hall receptionist will ask the resident if they need assistance unloading the item. If they do, the receptionist will have to confirm that someone is available at the Public Works building, or give the resident a time later that day when someone is available to assist. The final issue is that of personal data. Section 2, paragraph C of the contract states that electronic items that contain personal data must be dropped off at one of Com2's permanent locations. I will be working with Attorney Orr to give us the option of providing a waiver of liability to the resident upon drop off these items. If the resident chooses to waive their liability for the personal data, we can accept the item and store it in a locked bin (this is where the lockable Gaylord box mentioned below fits in) until Com2 picks up all of the items. If we can not design an appropriate waiver, we will require that these items be taken to Com2 directly. To summarize, I seek your discussion and input on the contract. If it is acceptable in general, I ask that you move it forward to the February 10`h City Council meeting, to allow me enough time to work out the final details on our end. Staff has expressed interest in obtaining a lockable,plastic Gaylord box for storage of all items. Com2 does not have plastic lockable boxes,but the City staff has requested assistance in obtaining one. If we could not obtain one through Com2 or one of its vendors complimentary,the City would have to purchase a box at a cost of—$400. This would be the only cost for supplies. Com2 E-Waste Recycling Agreement This Agreement is entered into as of , 2009 by and between Com2 Computers and Technologies LLC an Illinois Company, (the "COMPANY") and the United City of Yorkville, (the "HOST"). No terms and conditions that may he contained in any order, acknowledgement, invoice or other form issued by either party shall he of any effect unless signed by the parties. The grant applications are due to Kane/Kendall Council of Mayors (our Subregional Planning Liaison) for a pre-review January 23, 2009 and due to CMAP February 6, 2009. Prior to the CMAP submittal, a resolution from City Council committing to the local match would be required. What is CMAQ? The source of this grant is a federal funding administered through CMAP (Chicago Metropolitan Agency for Planning) with recommendation by the Kane/Kendall Council of Mayors. CMAQ funds are used in northeastern Illinois for transportation projects that reduce congestion and related air pollution. Examples of projects that may be funded are transit service improvements, traffic signal interconnects, bicycle/pedestrian projects and diesel engine retrofits. The CMAQ program finances both bicycle and pedestrian facilities that reduce automobile travel. Recreational facilities often do not make good CMAQ project candidates. The goal is to reduce the amount of vehicle trips by providing a safe off-road bicycle or pedestrian route. Application Process and Project timing: Applications are due to the Kane/Kendall Council of Mayors (KKCM) by January 23, 2009. All projects must have been reviewed and approved by the KKCM to be considered by CMAP. Applications are due to The Chicago Metropolitan Agency for Planning(CMAP) February 6, 2009. The CMAP CMAQ Project Selection Committee selects CMAQ projects in northeastern Illinois, with subsequent approval by the Transportation Committee, Programming Coordinating Committee, CMAP Board and MPO Policy Committee. Successful projects must be initiated in calendar year 2010. Proposed Projects: With assistance offered by EEI at no charge, staff has reviewed potential eligible projects and have drafted applications for 3 projects: - Route 47 Trail Improvements—Enhancement to the IDOT widening project - US 34 Trail Improvements— Eldamain Road to Center Parkway - Kennedy Road--Route 47 to Bridge Park 1 Below is a summary of each application: Route 47 Trail Improvements: The Illinois Department of Transportation has completed Phase I Engineering and is at 90% pre- final stage for Phase II Engineering for the widening of 3 miles of Route 47 within the United City of Yorkville. The project terminus is Saravanos Drive to the south and Kennedy Road to the north. The off-road bicycle improvement will be engineered and constructed as part of the widening of Route 47. The engineering and construction will be performed by the Illinois Department of Transportation with project reimbursement from the United City of Yorkville. The construction of this facility will provide United City of Yorkville residents a safe, continuous alternative transportation method linking residents north of the Fox River to those south of the river. Residents will be able to utilize internal pedestrian facilities to connect to the Route 47 bicycle facility and thus providing residents with the connection to the commercial businesses lining Route 47. US 34 Trail Improvments: The Illinois Department of Transportation has completed Phase I Engineering and is beginning Phase II Engineering for the widening of US 34 between Center Parkway and Cannonball Trail. This does include a 10' wide asphalt trail and bridge over the Blackberry Creek. The oft-road bicycle improvement will be engineered and constructed as part of the widening of US 34. The portion of the trail that is part of the Illinois Department of Transportation Project engineering and construction will be performed by the Illinois Department of Transportation with project reimbursement from the United City of Yorkville. An off road bicycle facility is desired given the traffic volume and percentage of truck traffic. The construction of this facility will provide United City of Yorkville residents a safe, continuous alternative transportation method linking residents to one of the largest commercial areas, medical services, and the location of the government center for the county. Kennedy Road Trail Improvement: The Kennedy Road trail project connects commercial centers, the REC center, Post Office, spray park, two elementary schools, the golf course, several residential developments, regional ballfields, and to the Villages of Oswego and Montgomery in a safe off-road shared-use trail. This trail connects to the Grande Reserve Trail in three locations. Two links connect to the Oswego Park and Ride on the south side of the Burlington Northern Santa Fe railroad tracks, and on the north side of the tracks the project would connect to an existing trail that links to Oswego and then onto Montgomery and their shared-use trail system. The park and ride trail user, instead of winding through the Grand Reserve recreational trail, can easily commute to the facility through a more direct route. In addition, the trail will provide a non-vehicular connection to the only lighted ballfield complex in the City. Lastly, the trail will provide a safe route for children in neighboring developments to access the school. 2 Congestion Mitigation/Air Quality Improvement Program Transportation Control Measure Committal Agreement One copy of this page must be completed and signed by each sponsor of proposed FY 2010 CMAQ projects. The project offers non-vehicular transportation to residents for both work,commercial access and local community activities. From North to South: Yorkville's indoor fitness facility called the REC Center is located on Countryside Lane which is connected to the proposed facility via sidewalk.Further down Countryside Lane is the City's Post Office and Yorkville's Spray park and firefighter memorial at Riemenschneider Park.At the US 34/Route 47 intersection numerous stores and restaurants are connected to the project.Just south of this intersection,residents can access the music-themed Hiding Spot Park,Jaycee Pond,and Town Square Park(the home of many Yorkville events including the Halloween Egg Hunt,Music Under the Stars,summer Farmer's Market,and Holiday Under the Stars.) Parking is very limited for this intensely used park. Game Farm Road/Somonauk Street has an approved trail link planned for a 2010 completion.This trail, which will connect between the Route 47 trail and US 34,directly links to the Yorkville Public Works/Parks Department Facility,Yorkville Grade School, Yorkville High School Academy,Yorkville High School,all high school athletic fields and tennis courts,Parkview Christian Academy,Yorkville City Hall,Yorkville Public Library,Yorkville Police Station,Beecher Community Center,and Beecher Park (the location of Yorkville's Labor Day Festival called Hometown Days which hosts approximately 45,000 people over the three day festival.) Further south is the Fox River,the site of the new Canoe/Kayak Chute currently under construction by the Illinois Department of Natural Resources and the Bicentennial Riverfront Park, another popular park for festivals in Yorkville.The Yorkville Downtown Business District is also located in this area including shopping and restaurant destinations. Near the southern end of the Route 47 trail, Orange Street sidewalk connects to the Yorkville Intermediate School and Circle Center Grade School.Another fitness facility and commercial area is located at the intersection of Route 126 and Route 47,and south along Route 47 is another developing business district including a pharmacy and multiple restaurant destinations. Over 2,000 homes, approximately 5,300 residents,are located within a half-mile of this proposed facility. Yorkville staff projected the 2007 population at 15,240, a 36%increase in population in two years. This burgeoning population requires both increased transportation planning and non-vehicular transportation opportunities to accommodate the concomitant increase ADT. The United City of Yorkville works with IDOT(Illinois Tomorrow Corridor Planning Program Grant)and IDNR(Bike Path Program) as well as local agencies and surrounding municipalities to update and implement its Community Bicycle and Pedestrian Plan. The project addressed in this application is a priority for ADT reduction,public safety,and the presence of regional trip attractors. Illinois Route 47 spans approximately 160 miles from the Wisconsin State Line(Wisconsin Route 120)to Mahomet,Illinois(Illinois Route 10). Of these 160 miles, 8.39 miles are located in the United City of Yorkville. Within the City,Route 47 intersects with two US highways,US 30 and US 34,two state highways,Route 126 and Route 71,two railroad lines,the Burlington Northern Santa Fe and the Illinois Railway,and the Fox River. Given the numerous key intersections,commercial development is prevalent along the stretch of Route 47 with residential development offset from Route 47. Despite commercial development serving as a trip generator no continuous alternative transportation mode is currently provided to connect the 5,300 residents within a 1/z mile of Route 47 to the businesses located there. The project furthers community safety as currently high school students, during their lunch hour,walk along Game Farm and US 34,which currently has no bicycle or pedestrian facilities,to access a variety of restaurants. Continuing the trail from Game Farm Road over the Blackberry Creek links to another residential development,the Kendall County government center,and a major commercial district,Kendall Marketplace, located just past Cannonball Trail.The project would connect to existing trail in front of the new Rush Copley Medical Center,the current home of an urgent care center and future hospital site,and continue to connect to Provena/Dreyer medical offices,another commercial center,and the residential development of Fox Hill.Two city parks are located in this development; Fox Hill East Park and Yorkville's Disc Golf Course located at Fox Hill West Park.Just beyond Fox Hill the trail will cross Rob Roy Creek and continue to Eldamain Road,the project terminus.The Plano YMCA is located at this intersection of US 34 and Eldamain,and future Plano trail is planned to connect to Yorkville also on the south side of US 34. With a population increase of 77.5%from 2000 to 2007(according to the United States Census Bureau). Between the 2000 decennial Census and the 2005 Yorkville Special Census Yorkville's population increased 81%from 6,189 to 11,204. Yorkville staff projected the 2007 population at 15,240,a 36%increase in population in two years. This burgeoning population requires both increased transportation planning and non-vehicular transportation opportunities to accommodate the concomitant increase ADT. The United City of Yorkville works with IDOT(Illinois Tomorrow Corridor Planning Program Grant)and 1DNR(Bike Path Program) as well as local agencies and surrounding municipalities to update and implement its Community Bicycle and Pedestrian Plan. The project addressed in this application is a priority for ADT reduction,public safety,and the presence of regional trip attractors. US Highway 34 is the main east-west road between rural communities to the west of Yorkville and the southwest suburbs of Oswego, Aurora and Naperville.US 34,is a major commuter road,as well the home of a new business district for the City of Yorkville with the construction of several big box stores and future outlot development.City Staff has been working both with the Illinois Department of Transportation and their road improvement projects and any developers along US 34 to locate an off road trail along Route 34 to allow users to access the community centers, businesses,and schools. At the US 341 Route 47 intersection,over 23,500 cars pass through this area every day.Truck traffic will continually increase as the commercial development grows along the US 34 corridor. The Illinois Department of Transportation has completed Phase I Engineering and hopes to begin Phase II Engineering for the widening of US 34 between Center Parkway and Cannonball Trail. The engineering plans include a 10' wide asphalt trail and improvements to the bridge over the Blackberry Creek.The off-road bicycle improvement within the constraints of the US 34 widening project will be engineered and constructed as part of widening project by the Illinois Department of Transportation with project reimbursement from the United City of Yorkville.The United City of Yorkville will be the lead agency for the remainder of the project,Cannonball Trail to Eldamain Road,coordinating the efforts among various entities,such as IDOT and local developers,to provide a continuous trail connection to Yorkville residents. An off road bicycle facility is desired given the traffic volume and percentage of truck traffic,as listed above. The project connects to the Grande Reserve Trail in three locations. Of these locations,the two links south of the Burlington Northern Santa Fe railroad tracks connect to the Oswego Park and Ride, located along Mill Road just west of Orchard Road. This project would provide Yorkville residents commuting to the Oswego Park and Ride a direct route to the facility. The project will also offer residents not connected to the Grande Reserve Trail the option of utilizing alternative transportation to the Park and Ride.The one link north of the tracks connects the City of Yorkville to the Village of Oswego's and subsequently to the Village of Montgomery's shared-use trail systems. The project would also provide a safe pedestrian crossing of the Burlington Northern Santa Fe railroad tracks,as none currently exists. The lack of a pedestrian crossing of the railroad tracks is not only a safety concern,but also a deterrent to utilizing alternative transportation. In addition,the trail will provide a non-vehicular connection to the only lighted ballfield complex in the City which generates approximately 1,500 vehicle trips a week during baseball season.
