Presentations : None. New Business : 1 . PW 2009-48 Windett Ridge — Update — Bank of America is to be the new developer. There was discussion on the punch list. Some of the Aldermen want action on the complete punch list, not just the top 5 issues. Kathy Orr will be contacted about the City' s options. EEI is looking into the different drainage issues. This will come back next month. Old Business : 2. PW 2009-43 High Water Levels — Update & Discussion — There was discussion on the water in the Autumn Creek development. The retention pond was pumped out, and a new drain pipe was put in to drain the pond to Blackberry Creek. Also, the drainage from the Bristol Lake subdivision was separated from the Autumn Creek subdivision Items Recommended for Consent Agenda: 1 . PW 2009-44 Bristol Bay — Collector Road Surface Course Agreement — This will move on to City Council for discussion. 2. PW 2009-45 Menard Store Expansion — Acceptance of Public Improvements and Bond Reduction #2 — This will move on to City Council on Consent Agenda. 3. PW 2009-46 Galena Road Shared-Use path Easement Agreements - — This will move on to City Council on Consent Agenda. 4. No further action is needed. 5. PW 2009-52 Committee Liaison Appointments — Alderman Gilson will go to the YBSD meetings. Alderwoman Teeling will go to the Park Board meetings. Old Business: 1. PW 2009-42 Morgan Street Re-Paving (Fox St. to Washington St.) — This can not be part of the Fox Road LAPP project because it does not have logical termini and is not on the FAU route. There is no funding for this at this time. It will be put on the CIP in the fall. 2. PW 2009-43 High Water Levels — Update & Discussion — There was discussion on the high water levels on Van Emmon Road. A determination on where the water is coming from still needs to be made. This development has a very fight window for getting work completed this construction season. In order to prevent delays regarding work within the IDOT right-of-way, I recommend that we pre-approve the IDOT highway permit application. This permit will be for one right-in/right-out entrance fi-om Route 34 and utility crossings. While the entrance roadway will be private, IDOT requires that the city be the permittee. The attachments are examples of similar permit paperwork that we have approved in the past. By passing the resolution the city is guaranteeing that the work will be performed satisfactorily. We in turn will require the developer to provide a guarantee to us in the form of a bond that they will perform the work and satisfy IDOT's requirements. We will not submit the formal permit application to IDOT until we receive a satisfactory bond and insurance certificate. I recommend that City Council authorize the Mayor and City Clerk to sign the IDOT highway permit application for Cannonball Trails when we receive it, and also adopt the corresponding resolution. Main Street intersections. The Westem/High Ridge intersection is a four-way intersection currently with Western yielding to High Ridge. The Western/Northland 'intersection is a three-way intersection without any control signage. Both of these intersections have experienced increased traffic since High Ridge and Northland were extended south to Blackberry Shore Lane in the Kendall Marketplace development. There have been no traffic accidents at these intersections within the past year. The Church/Main intersection is a four-way intersection currently with Church yielding to Main. There have been two accidents at this location within the past year. The Manual on Uniform Traffic Control Devices (MUTCD) has been adopted by the Federal Highway Administration and establishes nationwide standards regarding signage, traffic signals, and pavement marking. The MUTCD criteria that must be met before multi-way stop sign control can be placed at these intersections are as follows: 1 . A crash problem, as indicated by 5 or more reported crashes in a 12-month period that are susceptible to correction by a multi-way stop installation. 2. Minimum traffic volumes: a. The vehicular volume entering the intersection from the major street approaches averages at least 300 vehicles per hour for any 8 hours of an average day, and b. The combined vehicular, pedestrian, and bicycle volume entering the intersection from the minor street approaches averages at least 200 vehicles per hour for the same 8 hours. We are currently conducting traffic counts at these intersections. There are other criteria not related to traffic volumes or crashes that we will also evaluate. We plan to complete the warrant analyses at all three intersections and place them on the July Public Works Committee agenda for discussion. Work Items Completed We talked to and visited the homes of several of the residents along East Van Emmon who have expressed concerns about drainage issues to the City. During our visits and conversations, we collected background information and observed conditions regarding the nature of their drainage problems. As such , we have obtained a good understanding of the current state of the problems. These problems are primarily basement seepage and ground water related issues. We also have undertaken other research into the factors that could be contributing to the drainage problems along East Van Emmon Street. We are using this information to prepare alternatives to address the problems and develop recommendations and cost estimates for the City. However, we are working on obtaining additional information in order to finish our investigation and recommendations. Proposed Schedule We are meeting with City staff on Monday July 20, 2009 to discuss our current findings, and then determine the most cost-effective approach to completing the investigation. We plan to develop a draft report by early August. We plan to review the draft report with the Mayor and City Staff in mid-August, and then present our draft findings to the Public Works Committee at the Committee's August meeting . Following the erection of the sign it was discovered that the sign slightly encroaches into the easement, under 1.5 feet. The practical impact is that the encroachment is negligible. The sanitary sewer in this location is twenty feet deep and by its nature is not likely to need to be excavated . In the unlikely circumstance that an excavation would be needed, even if the sign was in the exempted fifteen by ten foot area it would have to be removed in order to properly excavate the pipe. In the spirit of cooperation and to prevent the unnecessary business expense to relocate the sign by eighteen inches, staff recommends approval of the encroachment agreement. The City Attorney has reviewed and approved the encroachment agreement document. It is recommended for approval subject to one sentence being added to the agreement to recognize if the sign is ever removed, the reinstallation shall occur within the fifteen by ten foot exemption provided . The attorney for the sign company has agreed to this change. ENCROACHMENT AGREEMENT This agreement is entered into by and between, the City of Yorkville, (hereinafter referred to as "city"), Jason Poppen, Thomas Zanck, and Robert Wegener (hereinafter referred to as "owners"), and Prime Yorkville, LLC. Owners own a sign located within the Prairie Pointe Subdivision as depicted on the survey attached as Exhibit A. Said sign is encroaching on the lot owned by Prime Yorkville, LLC and the public utility and drainage easement dedicated to the City pursuant to that certain plat of subdivision recorded with the Kendall County Recorder on November 30, 2006 as document number 200600038768 . To assist in accomplishing this goal on a consistent basis, we have put in place the following plans, policies and procedures. Safety In any aspect of our job, safety is the number one priority. This is especially true with snow and ice removal due to the fact that we are trying to create safe environment while working in hazardous conditions. By following the policies and procedures outlined below, we can ensure that we are doing our part to be as safe as possible. 1 . Always check the vehicle or equipment to make sure it is in good working condition before beginning snow and ice removal operations. 2. Report any mechanical problems to your supervisor immediately. 3. Obey all traffic laws. 4. All vehicles must be operated at 20 mph or less depending on conditions. 5. No employee will work longer than 16 hours without having 8 hours off. 6. City vehicles or equipment may NOT be used to assist stranded motorists that are stuck. It is your responsibility to make sure that the motorist is not hurt, the roadway is safe and to notify the police and report the situation. Accidents Although you may be careful, there are times when you may become involved in an accident while performing snow and ice removal operations. If this happens, please follow the procedures outlined below: • Check for injuries to yourself and anyone else involved. • If injuries are sustained, call 911 immediately then call your supervisor • If injuries are sustained, the supervisor must fill out a first report of injury • If no injuries are present, call the police and your supervisor • When the police arrive, ask them to fill out an accident form that will be put on file and a copy given to the director. • When the supervisor arrives, you will be sent to the nearest drug testing center or emergency room depending on the time of day to take a mandatory drug and alcohol test. • Once the drug and alcohol test is complete, you will return to the shop and write your own account of the accident. Damage to Property Damage to property such as mailboxes or sod damage should be noted and turned into the supervisor at the end of the day. Damage to any other personal property should be reported to the supervisor immediately. The United City of Yorkville currently has a mailbox replacement policy that is attached to this plan for reference Plowin¢methods for intersections and cul-de-sacs The United City of Yorkville has determined the following methods to be the most effective methods to remove snow from intersections and cul-de-sacs. Intersections Pushing corners back onto the parkway will no longer be practiced. Snow should rather be pushed around the corner onto the cross street. The operator can then plow snow to the City right of ways as normally done. This allows pedestrians to cross at interconnecting streets and provides better visibility for the motoring public. Cul-de-sacs In order to provide service to all of the cul-de-sacs early on, they are to be plowed as follows: The driver will plow the right hand side of the centerline entering the cul-de-sac to the back of the bulb or island where they exist. The driver will then turn around and plows the other side of the centerline on the way out; this snow being carried out of the cul-de- sac to the adjoining though street where it is windrowed along the curb as the plow truck proceeds along the route. When it is decided to plow curb to curb, the following method will be used to finish the cul-de-sac. As the driver comes into the bulb itself he will lift the plow and deposit his load of snow where the throat meets the bulb. In the bulb the driver would push mounds of snow onto the parkway, in between obstacles such as mailboxes, driveways, street lights, and fire hydrants. The windrow is carried from the parking lane to the curb on the throat. After the driver has finished carefully aiming snow onto parkways in the bulb, he starts a spiral from the center of the cul-de-sac or from the edge of the island, it it is present, driving outward, picking up any remaining snow that has fallen off the plow. The spiral eventually reaches the outer curb line where the snow is uniformly distributed around the edge of the cul-de-sac, unfortunately some of it going in the driveway aprons. When the driver gets to the point where he unloaded snow at the juncture, this load of snow is pushed onto the parkway. We have found that this is about the best spot to deposit snow because there is seldom any driveway or any other obstacles located at this point. As the driver leaves, he carries any snow from the other side of the throat out of the cul-de-sac and distributes it in a windrow along the curb on the adjoining through street. The Street Department foreman will determine the salting application on a case by case basis. Storm Categories Category 1 This would be a storm of little significance to the safety of the motoring public. This would include accumulations of anywhere from a dusting up to 1 ". The snow removal operation in this instance would be to salt the collector roads, school routes, and any sharp curves, hills, and sidewalks in front of city buildings. In this operation, no other streets would be plowed or salted. This would not be a full crew operation. Instead, there would be up to 9 salt trucks on the street at any time salting and removing any necessary snow. Category 2 This would be considered our "typical"' storm. This would be a storm that would accumulate 1 "- 6" of snow over the course of a day or night. The entire crew would be deployed to clear the streets starting with the collector streets, then clearing the secondary roads, cul-de-sacs, and parking lots. Usually in this type of operation, the crew will open up the roads without salting anything except the hills and school routes. After the storm has passed, they will return to clean up any residual snow and salt the collector streets. Category 3 Category 3 storms are any storm that is forecast to accumulate more than 6" of snow or snowfalls of lesser amounts if it is forecast to have blowing and drifting snow for long periods of time. Once it has been determined to be a category 3 storm by the concurrence of the street foreman and the director of public works, the following procedures are to be followed: All employees will be expected to work for the duration of the snow event unless there has been a scheduled vacation approved. It will be determined at the beginning of the season a rotational shift of employees that will be sent home after 8 hours of plowing to rest and return in 8 hours for up to a sixteen hour shift. The employees that are not sent home will work a sixteen hour shift and be relieved for 8 hours to rest and then return to work. Collector streets will be given the highest priority followed by secondary streets then cul- de-sacs. By following these priorities, we will be able to move the most traffic safely. If the storm intensity is such that we find that we cannot keep the collector streets passable with our large trucks, we will then take employees in smaller trucks from the secondary and cul-de-sac routes to assist in clearing the collector streets until such time that the street foreman or person in charge is satisfied that the smaller trucks may return to their normal routes. During the snow event, there will be no salt spread except for the hills, dangerous curves and intersections. Once the snowfall has ended, the final clean up can begin. At this time, the large salt trucks will begin clearing the collector streets while the smaller trucks start on the secondary streets and cul-de-sacs. Once the collector streets are complete, the large trucks will begin salting the secondary streets, then cul-de-sacs. Parking lots and sidewalks will be plowed and salted after all city streets are cleared of snow and salted. Category 4 Category 4 storms are any type of freezing or frozen precipitation. With this type of storm, the public works department will have to make operational decisions with each storm due to the fact that the weather is very unstable at this time and may change throughout the course of the storm. In most cases, we will use caution and pre-salt all roadways to protect them from icing. He said that the dirt stockpile by the creek would be removed today, and that the landscaping work would begin within the next week. That landscaping work consists of replacing dead, dying, or missing trees and shrubs along Eldamain Road and the parkways within the development. Paul questioned how we can require him to replace landscaping on private property. I explained that the city's landscape requirements also include buffer areas, which are almost always located on private property. He also said that many missing parkway trees are supposed to be planted by George Javier, who is the builder in Unit 7. 1 told Paul that the city doesn't care who plants the trees,but they must comply with the landscape plan and that we look to the developer to guarantee that the work is done. He understood, but said that he would ask that the city not grant occupancy permits until the builder plants the parkway trees. I asked him to get me that request in writing and I would forward it to the city attorney to determine what our response would be. We also spoke about the stormwater basins. I told Paul that he needs to retain a wetland consultant to tend and monitor the basins. Paul insisted that the basins were landscaped per plan and that he has performed some maintenance. He also said that he supplied documentation regarding the initial landscaping, and that Laura Haake has misinterpreted the information that was supplied. Paul said that this type of basin,without a vegetated low-flow channel, will always look like these basins because the water spreads such that it's not practical to get maintenance crews in to perform work on the bottom. The bottom of the basin is covered with a combination of live and dead plants that tend to act like a sponge and retain water. The I " through 3rd growing maintenance guidelines are outlined on sheet L-2. Under the title "Native Mix Acceptance and Guarantee" states the following: "The Contractor shall be responsible for the satisfactory growth ofpermanent species of grasses, forbs, rushes, reeds and sedges on all areas seeded and/or planted under the Contract until final acceptance of the work. The Contractor shall provide an expert inspector (e.g. seed source vendor) to conduct an inspection of the native planting areas during the P and 2nd growing seasons and provide the Village and or Owner with a written assessment by January 31' of the following year of the establishment progress and any remedial action taken or proposed. A more detailed inspection shall be conducted at the end of the 3'd growing season for purposes of Final Acceptance. A written report of this inspection shall also be provided to Village and/or Owner by Jan. 31" of the following year. Acceptance of the work will be determined using a time meander search. The time meander search shall be conducted at the end of the third fidl growing season after seeding and/or plantings (not to exceed thirty-six [36] months). The search will sample 20% of each plant community that was seeded and/or planted are alive and apparent and the sample area has 80% ground cover of those permanent species, the work will be approved. If not accepted, the Contractor will replant, to fulfill Contract responsibility, at no cost to the owner. Present were Paul Dresden, Laura Haake, and Joe Wywrot. The following summarizes the discussions during the meeting. Paul asked about the Sycamore trees (which is a prohibited tree) that the city claims were planted in the public right-of-way. The tree nursery said that Sycamore trees were not planted. Joe said that it appears that some Sycamore trees were planted because the bark on some of the trees looks like Sycamore. We will know for sure in the spring when the trees leaf out. Paul will fax the information to us that he got from the nursery. The bulk of the meeting was about the stormwater basin landscaping. Paul said that his landscaper was under contract to landscape the basin, but not to monitor it. Laura said that Paul needs to hire a wetland consultant to monitor the progress of the basin and tend the basin to help the approved landscaping become established. Paul said that Travis Miller had referred Paul to the stormwater basins in Grande Reserve for examples of what the Fox Hill Unit 7 basin should look like. The Grande Reserve basins, however, have low-flow channels that keep the majority of the basin bottom dry. The Fox Hill Unit 7 basin does not have low-flow channels, and the bottom is very soggy. Laura said that there are other basins in Grande Reserve that don't have low-flow channels. Joe said that Travis' intent was probably just to show Paul what a dry-bottom naturalized basin looks like. Laura said that all basins are unique, and there may not be another basin in Yorkville that is exactly like the basin that is supposed to exist in Fox Hill Unit 7. Paul said that he has mowed the basin embankment slopes and also removed debris and invasive plants from the pond. If the wetland consultant evaluations indicate that the approved landscaping is not likely to become established, then a mutually agreeable revised landscape plan would need to be prepared. Paul will contact Encap and Ives Ryan to obtain proposals from them for basin monitoring and maintenance.
