Municipal Public Safety Pension Reform Act
A copy of this act was given to MVT for their review. This act states that an RFP must be issued to
hire an Investment Manager for the fund every 5 years. MVT has been the Investment Manager
since Jan of 2006.

TW Actuary Summary Dated Dec. 22, 2008
A copy of TSW Actuarial summary was distributed and discussed. It was noted that the percent funded
has decreased from 37.7%to 35.6% and that the annual funding allocated from the City through the tax
levy was less than the actuarial guidelines. It was suggested that the City be informed of this short fall. It
was also suggested that Tim Sharp of TWS Actuary make a presentation to the City at next year's
Municipal Public Safety Pension Reform Act report to the City. This report is made prior to the City's
Budget approval. The Police Pension Actuarial Report is on the agenda for Feb 12th Administration
meeting. The Pension is to be 100% funded by he year 2033.
Copies of Fiscal 2007—2008 Audit:
Copies of pages of the 2007-2008 City audit report that relate to the Police Pension were distributed.
Additional Business:
Pages from the Feb 2009 IML Legislative Update that pertain to the Police Pension were distributed. An
error in copying these pages excluded page 8 that has been attached for completeness.
Copies of Grayslake's Investment policy were distributed. The board will review this for the next
meeting to determine if there is anything that it wishes to incorporate into Yorkville's policy.

Dear Mr.Martin:
We are enclosing our retainer invoice for the 2d quarter of 2009. You will note that there has been a
small increase in the amount of the retainer. As you know,we have not raised our fees in the last few
years despite the increase in costs. We hope that you understand our position in raising these fees at this
time.
As a reminder,the retainer covers our attending your quarterly meetings.We are also available to help
you prepare a trustee booklet which would include the current Investment Policy(drafting or updating of
your Investment Policy if you do not have one)and Rules and Regulations. We do set up annual
examinations for any individuals who are on disability pensions and under the age of 50 if you wish.
The pension board is now required to deal with Q1LDRO's of your pension fund members which was not
required when the original retainer was set and this can and does become quite time-consuming in many
instances. We are available to assist you with requests for transfer of time by portability or buyback of
prior creditable service. We offer advice to the pension board of any changes in legislation. The
retainer fee covers any telephone or e-mail questions you may have regarding your pension fund.
For those services of an adversarial nature which are not covered by the retainer, such as applications for
disability and/or litigation, our hourly rate for retainer clients will increase from$160.00 per hour to
$175.00 per hour. Non-retainer clients will be charged$200.00 per hour for such matters.
If there is a problem with our increase in service fees,please let me know so that we can discuss the
matter. We value your pension fund as a client and want to retain the relationship.

particular services to be provided and their frequency. Our services will cover the year ending
April 30, 2009.

competent employee to oversee any bookkeeping services or other services we provide. You

None of the services can be relied on to detect errors, fraud, or illegal acts that may exist.
However, we will inform the appropriate level of management of any material errors that come
to our attention and any fraud or illegal acts that come to our attention, unless they are clearly

deficiencies or material weakness in your internal control as part of this engagement.
Based on discussions with you, the Police Pension Fund is looking for assistance in completing
the annual filing for the Department of Professional and Financial Regulation for the year ending
April 30, 2009. It is our expectation that the Police Pension Fund will provide us with a trial
balance for period ending April 30, 2009, all necessary investmenttbank account statements
showing the detailed transactions from your investment advisor, all supporting documentation
for the participant data (including cumulative payroll withholdings, new employee information,
changes in status for the year, etc), a detail listing of board members as of April 30, 2009 and as
of the filing of the report and a completed interrogatory for the entire fiscal year.
The fee for these non-audit services is based on a fixed fee basis of$1,350. Our invoices for
these fees will be rendered each month as work progresses and are payable on presentation.

BARRINGTON POLICE The IPPFA (Illinois Public Pension Fund Association)was founded in 1985 as a not-
for-profit umbrella association representing police and fire defined benefit retirement
funds in the State of Illinois. Founded by a small group of elected fund trustees who
were bewildered by their new responsibilities, but who were intrigued by the
possibilities they saw around them, the original goals of the Association were
VICE PRESIDENT educating pension fund trustees, providing legal advice and representation for
DAVID W.NAGEL pension funds and proposing and supporting legislation beneficial to Illinois Pension

There is one bill and one new law that address training. The bill is SB 1974. 1 have provided a

As introduced,the bill required municipalities to pay for the training fees. Senator Harmon was
willing to accept an amendment requiring that the training fees come from the pension fund. The
bill requires an initial 32 hours of training, however, current pension trustees are exempt from this
requirement. All trustees will be required to receive 16 hours of training a year. The bill was
approved by the Senate and is presently assigned to the House Personnel and Pensions
Committee.
As for the law, P.A. 96-0006 was signed into law on April 3, 2009 and contains the following
language on pension fund trustee training for all articles under the Illinois Pension Code:

Sec. 1-113.18. Ethics training.All board members of a retirement system,
pension fund, or investment board created under this Code must attend ethics
training of at least 8 hours per year. The training required under this Section shall
include training on ethics, fiduciary duty, and investment issues and any other
curriculum that the board of the retirement system, pension fund, or investment
board establishes as being important for the administration of the retirement
system, pension fund, or investment board. The Supreme Court of Illinois shall
be responsible for ethics training and curriculum forjudges designated by the
Court to serve as members of a retirement system, pension fund, or investment
board. Each board shall annually certify its members' compliance with this
Section and submit an annual certification to the Division of Insurance of the
Department of Financial and Professional Regulation. Judges shall annually
certify compliance with the ethics training requirement and shall submit an annual
certification to the Chief Justice of the Supreme Court of Illinois.

service occupation tax or any other sales tax or successor tax which may be enacted by the State
of Illinois as replacement thereto that are generated by the operation of any retail stores operating
on the Commercial Parcels and are distributed to the CITY by the Illinois Department of
Revenue. Such payments shall be made until the first to occur of the following: (i) OWNER has
been fully reimbursed for the Reimbursement Amount(including interest); or(ii)the termination
date of the Economic Incentive Agreement. Thereafter the CITY shall have no further obligation
to make any payments under this Agreement to OWNER or their assigns.
(f) The CITY agrees to consider providing up to '/ of 1%of the local sales tax to the
OWNER or developer of buildings in the PROPERTY that include"Green"provisions.
(g) The CITY agrees to allow up to fifty (50%) of the real estate tax generated from
the PROPERTY to be used to repay the bonds issued for the development.of the PROPERTY as a
secondary source for repayment of the bonds. This incentive shall expire upon,the first to occur:
five (5) years after the date of this Agreement; or when four hundred thousand (400,000) square
feet of the shopping center has been leased; or when sales of one hundred twenty five million
(125,000,000) have been achieved from stores in the shopping center. This incentive shall not be
available if it is determined that the incentive will adversely impact the sale of the bonds.
33. ESTABLISHMENT OF SPECIAL SERVICE AREA AS FUNDING MECHANISM
FOR INSTALLATION OF PUBLIC IMPROVEMENTS. At the OWNER's request, the CITY shall
establish a special service area("SSA")to be utilized as a funding mechanism, in the commercial portion
of the PUD only, for acquisition, construction and installation of public improvements including but not
limited to, engineering, surveying, soil testing and appurtenant work, mass grading and demolition, storm
water management facilities, storm drainage systems and storm sewers, site clearing and tree removal,
public water facilities, sanitary sewer facilities, erosion control measures, roads, streets, curbs, gutters,
street lighting,traffic controls, sidewalks,paths and related street improvements, equipment and materials
necessary for the maintenance thereof, landscaping, wetland mitigation, public park improvements and
tree installation, costs for land and easement acquisitions or dedications relating to any of the foregoing
improvements, required tap-on and related fees for water or sanitary sewer services, required impact fees
and dedications and other eligible costs to serve the Special Service Area(the "Special Services"). It is
contemplated that the Business District Tax shall be the first source of payment for the Special Services.
In the event that the Business District Tax is not adequate to pay for the Special Services, then the
OWNER shall request the CITY to establish the SSA. The OWNER and CITY presently estimate the
total cost of these Special Services, together with costs of borrowing money for that purpose, funding
administrative expenses and providing for necessary debt service reserves and capitalized interest
(collectively the "Costs of the Special Services") to be approximately Twenty Seven Million Seven
Hundred Thousand Dollars ($27,700,000.00). The CITY acknowledges that it is in the best interests of
the CITY to issue Special Service Area Ad Valorem Tax Bonds in a principal amount not to exceed
Twenty Seven Million, Seven Hundred Thousand Dollars ($27,700,000.00) to pay or provide funds to
pay the costs of the Special Services. The CITY and OWNER shall'cooperate in good faith to identify and
agree on an appropriate structure for the financing, which the CITY and OWNER currently believe will
consist of an SSA pursuant to 35 ILCS 200127-5 et sea., but which may be authorized and implemented
under other legal frameworks acceptable to the CITY and OWNER.
The CITY agrees to prepare and publish and mail the public notices required by the Special
Service Area Act, and to hold the required public hearing to consider establishment of the Special Service
Area,the issuance of the Bonds for the purpose of paying the costs of the Special Services and the manner
in which the Bonds are proposed to be retired and the proposed tax levy.

This new law was motivated by the scandals that surrounded the state pension systems,
particulary the Teachers' Retirement System. We have yet to conduct a full analysis of P.A. 96-
006, but we do know that several of the ethics reforms and disclosure requirements are similar to
those the IML successfully championed for introduction within the police and fire pension systems

Synopsis As Introduced
Amends the Illinois Pension Code. Requires all elected and appointed trustees of
downstate police and fire pension funds to participate in a mandatory trustee certification
training seminar that must consist of at Ieast 32 hours of initial trustee certification at a
training facility that is accredited and affiliated with a State of Illinois certified college or
university. Provides guidelines for the training. Provides that, in addition to the initial
trustee certification training, those elected and appointed trustees shall also participate in
a minimum of 16 hours of continuing trustee education each year thereafter. Requires the
employer to pay for the training. Amends the State Mandates Act to require
implementation without reimbursement. Effective immediately.
Senate Floor Amendment `o. f
Replaces everything after the enacting clause with the introduced bill with the following
changes. Requires that the training must be completed within the first year that a trustee
is elected or appointed. Provides that trustees who are police officers or firefighters or are
employed by the municipality shall be permitted time away from their duties to attend
that training. Exempts active or appointed trustees serving on the effective date of the
amendatory Act from the initial 32-hour trustee certification training. Provides that the
training shall be paid for by the pension fund rather than by the trustee's employer.
Provides that any board member who does not timely complete the required training is
not eligible to serve on the board of trustees of a downstate police or downstate
firefighters pension fund, unless the board member completes the missed training within
6 months after the date the member failed to complete the required training. Provides
that, in the event of a board member's failure to complete the required training, a
successor shall be appointed or elected, as applicable, for the unexpired term. Makes
other changes. Effective immediately.

Upon creation of the Special Service Area, the CITY agrees to issue bonds in the amount not to
exceed Twenty Seven Million, Seven Hundred Thousand Dollars($27,700,000.00).
To the extent that the OWNER desires to utilize a special service area to construct public
improvements in the residential areas, OWNER shall abide by CITY policies then in effect.
34. BUSINESS DISTRICT.
A. Oualification of District. Prior to OWNER's execution of this Agreement the
CITY agrees to take the necessary steps to formally qualify the PROPERTY as a Business
District as described by the Business District Development and Redevelopment Act, 65 ILCS
5/11-74.3 et seq. If the PROPERTY qualifies as a Business District under the Business District
Development and Redevelopment Act, the CITY agrees to create a Business District. OWNER
shall select a consultant from the CITY's list of preferred consultants and OWNER shall be
responsible to pay CITY's consultant fees, but in no event more than twenty thousand
($20,000.00) dollars.
B. Amount of Business District Tax. The CITY agrees to allow for the
generation of additional sales tax revenue on the Commercial Parcel, at a rate of not more than an
additional one-half percent(1/2 %)tax. The OWNER agrees to not object to the creation of said
Business District.
C. Priority of Payments. One hundred percent(100%) of all revenues received as
a result of the aforesaid additional tax shall be rebated back to the OWNER by CITY as
reimbursement for OWNER'S share of engineering expenses and improvement costs for Route
34, Beecher Road, and all other eligible expenses, pursuant to the following priority of
reimbursements:
(i) CITY and OWNER's share of Route 34 Improvements through
Sycamore pursuant to an "Agreement for Sycamore Road Intersection
Improvements"dated , entered into between the Parties.
(ii) Public Improvements for Commercial Development Phase 1 as eligible
under state statute.
(iii) Phase 2 of Route 34 Improvements from Sycamore to east side of creek.
(iv) Public Improvements for Commercial Development Phase 2 as eligible
under state statute.
(v) Beecher Road Improvements to north PROPERTY line.
(vi) Off-Site Sanitary Sewer extension(through Cobblestone South).
(vii) North Beecher Road(north of PROPERTY Iine to Faxon Road) and
Faxon Road improvements.
In the event that there are not sufficient Business District taxes and/or local sales taxes generated
to fund the improvements set forth in Section 34-C(vii)above,then such improvements shall not
