A RESOLUTION SEEKING CERTIFICATION FOR THE IMPLEMENTATION
OF THE UNITED CITY OF YORKVILLE'S ADOPTION OF THE KENDALL
COUNTY STORMWATER MANAGEMENT ORDINANCE
Whereas, the United City of Yorkville (the "City") is a duly organized and validly
existing non home-rule municipality created in accordance with the Constitution of the
State of Illinois of 1970 and the laws of the State; and,
Whereas, the Mayor and City Council (the "Corporate Authorities") adopted
Ordinance No. 2012-5(o on November o?7, 2012, entitled, AN ORDINANCE
ADOPTING THE KENDALL COUNTY STORMWA TER MANAGEMENT ORDINANCE
TO REGULATE STORMWA TER MANAGEMENT IN THE UNITED CITY OF
YORKVILLE; and,
Whereas, the Corporate Authorities desire to petition Kendall County for
certification of its authority to enforce the Kendall County Stormwater Ordinance within
its corporate limits.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and City Council of
the United City of Yorkville, Kendall County, Illinois, as follows:
Section 1. That the Corporate Authorities have adopted the Kendall County
Stormwater Management Ordinance by Ordinance No. 2012-6(0 (the "City's Stormwater
Ordinance").
Section 2. That implementation of the City's Stormwater Ordinance will be by the
City's Community Development Director, currently Krysti Barksdale-Noble, and City
Engineer, currently Engineering Enterprises, Inc.
Section 3. That the City agrees that all annexation agreements entered into by the
City will contain a requirement that development of the territory annexed shall comply
with the City's Stormwater Ordinance.
Section 4. That the City agrees to be bound by the rules and procedures of the
Stormwater Management Committee of Kendall County.
Section S. That the City hereby attaches a list of development projects, attached
hereto and made a part hereof by reference as Exhibit A, to which some or all of the City's
Stormwater Ordinance does not apply.
Section 6. That therefore the City hereby requests certification from Kendall
County for the City's enforcement of the Kendall County Stormwater Management
Ordinance as adopted in the City's Stormwater Ordinance within the corporate limits of the
City.

Section 7. That this Resolution shall be in full force and effect upon its passage
and approval as provided by law.
