Public Hearings
1. PC 2012-11 Kendall Crossing, LLC, Petitioner, has filed an application
with the United City of Yorkville requesting Preliminary Plan and Final Plat
approval for the Kendall Crossing (formerly Countryside Center) property
for the purpose of constructing a new 38,500 square foot cinema complex.
The property consists of approximately 18.5 acres and is located immediately
north of US Route 34,west of Illinois Route 47, generally south of
Countryside Parkway and east of Center Parkway,in Yorkville, Illinois.

The Public Hearing was opened at 7:03pm on a motion by Sandra Adams and second by
James Weaver. Unanimous voice vote approval. All those who would speak were sworn
in by Chairman Lindblom.

The Hearing concluded at 7:07pm on a motion by Jones and second by Crouch.
Unanimous voice vote approval.
Discussion: A correction was noted to be the Yorkville Plan Commission in the letter
from RB &Associates regarding this project.
A half acre of the property being purchased by Mr. Ratos will be purchased by
McDonalds. They will be rebuilding their facility when Route 34 is widened. The
theater parking issue has been resolved and the explanation letter from Mr. Bauer will
become part of the official minutes. The parking stall width will not be reduced and the
number of handicapped spaces is adequate. Ms. Barksdale-Noble noted that staff is
recommending the Preliminary Plat only, at this time. Attorney Kramer asked that the
matter be continued to a future date to eliminate re-certification and re-mailing. The
Commission agreed to this request.

Commissioner Kraupner moved to continue the Final Plat approval process to the

1. City Council Action Updates
a. PC 2012-09 Kendall Crossing— Concept Plan PUD
Ms. Barksdale-Noble summarized the City Council's recent unanimous approval for the
Kendall Crossing project.
2. Illinois Rt. 47 Roadway Project Update Presentation
For the record, Chairman Lindblom stated that he appreciated the presentation packet of
updates. Mr. Sanderson said that there is a meeting with IDOT every 2 weeks. Some
additional work will be completed and the project will be shut down for the winter as of
December 21. It will resume in February or March. The concrete wall in the middle of
town will not be torn down for 2 more months and that will be followed by storm sewer
work and then water and sanitary sewer. Utility work has caused delays and IDOT and

AT&T are scheduled to have a meeting December 13. Ms. Barksdale-Noble noted that
updates are placed on the City website.
3. Year in Review
Ms. Barksdale-Noble recapped Plan Commission matters for 2012:
1. 8 applications were received this year
2. The Commission addressed most of the staff recommendations from last year
including motions and drawings
3. Approved the indoor shooting gallery
4. The R2 zoning district has not been addressed yet this year and it will be
discussed in Zoning Commission meetings and then at Plan
Commission. This will be done in 2013.
Commissioner Crouch added that the Zoning Commission will finish their updating
project and present it to Plan Commission and City Council.
4. 2013 Plan Commission Meeting Schedule
The Commission will continue to meet the 2nd Wednesday of the month at 7pm. All
proposed meeting dates were approved.

Mr. Crouch moved to adjourn and Mr. Jones seconded the motion. Meeting adjourned at
7:23pm.

Dear Krysti;
Thank you for forwarding me the packet of materials being distributed for the Plano
Commission Meeting scheduled for Wednesday, December 12, 2012. 1 wanted to
provide you with a few answers to your questions prior to the meeting for you to use in
your reporting of what has been going on.
The original number of parking spaces required was based on the information, at that
time, of 1,984 seating capacity.. Providing a parking space for 3 seats per ordinance
calculated out to be 662 parking spaces required. This is what we originally requested.
Original variance requested was actually allowing us to provide 63% of the required
parking spaces per ordinance.
As of today, the maximum seating capacity is expected to be 1,715 seats, down 269
seats, calculating out per ordinance to 572 parking spaces. ADA requires
2% of the total number of parking spaces to be for Handicap, which is 12 Handicap
spots. We are providing 411 parking spaces, including the Handicap spaces. ADA
requires 9 Handicap spaces for the number of parking spaces between 401 and 500
spaces. We are meeting the ADA requirement of 9 Handicap spots. We are now
providing 71% of the number of spaces required per the ordinance.
For your information, I have finished plotting a one page Preliminary Plat,
36" x 48" in size, at a 1"=60' Scale. You have the enlarged copies.
I have added to the Data Table on the Preliminary some additional numbers for your
use. The proposed building is being proposed currently at 35,212.6 sq. ft. or 0.8084
acres. The amount of Proposed Lot 1 containing paved roads, parking lots and
sidewalks has been computed to be 199,069 sq. ft. or 4.5700 acres and the amount of
grass and landscaping islands and etc. being proposed is 61,364.3 sq. ft. or 1.4087
acres. The percentage of Lot 1 being covered by impervious pavement and etc. is
76.2%.

Petitioner's Request&Background:
The Petitioners are requesting Final Plat approval for the resubdivision of an approximately 3-
acre property located at 512 E. Main Street, on the southwest corner of E. Main Street and Bruell Street.
The property was a former swim club which has since been abandoned, as illustrated on the aerial below
taken in 2009.

Since then, all the structures have been demolished and the swimming pool filled, leaving the
property essentially vacant. The Petitioners propose to resubdivide the existing property into three (3)
new lots for the purpose of constructing a new single-family residence on each lot in the future.
Zoning Analysis
The subject property is zoned R-1 One-Family Residence District which is generally consistent
with the immediately surrounding properties' zoning and land uses. The following chart provides details
of those properties:

Bulk Requirements
Since the proposed rezoning resubdivision contemplates the future construction of a new single
family residence on each of the proposed lots, a detailed review of the R-1 One Family District bulk
regulations was conducted to analyze compliance with the proposed re-platted parcels. The following R-1
bulk regulations will apply:
• Minimum lot size requirement of 18,000 square feet; each proposed new lot's area is
approximately one-acre(43,560 sq. ft.) Complies
• Minimum lot width requirement of 100 feet at the established building line; each proposed new
lot is in excess of 100 feet in width at the building setback line. Complies
• Maximum lot coverage of 30%;Shall comply
• Maximum building height of thirty feet (30') and no more than 2.5 stories, whichever is less;

Comprehensive Plan
The property is located within an area designated as "Traditional Neighborhood"within the 2008
Comprehensive Plan. The character for the Traditional Neighborhood designation is residential with
anticipated infill development.
Proposed Final Plat
Attached is the proposed Final Plat of Subdivision for the three (3) new R-1 One Family
Residential zoned lots. The plan has been reviewed by the City's engineering consultant for compliance
with the Subdivision Control Ordinance's Standards for Specification. In that regard, the following
comments have been provided to the Petitioners in a letter dated December 19,2012 (see attached)which
have been adequately addressed in the plans submitted by Todd Surveying date stamped received
01/03/2013.
Utilities
Public utilities will be made available to each of the parcels. An existing 12" sanitary forced
sewer main is located along the frontage of East Main Street and down the west side of Bruell Street. Lots
1 and 2 will connect directly to the sanitary system with a 6" PVC line off of E. Main Street, while Lot 3
will connect from the Bruell Street access. An existing water main runs along the north side of East Main
Street and will be utilized to provide water service to the proposed new residences. Finally, an existing
storm sewer manhole is located within the right-of-way of East Main Street,just northeast of the Lot 1.
Vehicular Access
Driveway access to the residences on the proposed new lots will occur via curb cuts off of East
Main Street as depicted on the Preliminary Engineering and Utility Plans. The driveway slopes of the lots
range between 1% and 4.5%,which is compliant with the maximum driveway grade of 8%. The driveway
aprons for each lot will be done as part of the individual house construction as approved through the
building permitting process.
Sidewalk/Trail Requirement
Per the requirement for the installation of a sidewalk or trail along the frontage of each property,
the Final Plat illustrates a fifteen foot (15') wide Pedestrian & Bike Trail Easement on the south side of

East Main Street beginning at the western edge of Lot 1,running eastward and down the western frontage
of Lot 3 on Bruell Street. This easement will be dedicated to the City upon approval of the Final Plat.
This is consistent with the Integrated Transportation Plan (ITP)which envisions a future bike path within
this area. While it will be the responsibility of the developer/home builder of these lots to install a
sidewalk or trail at time of building construction as part of the permit process, there is the option of
providing the City with funds to our Trail Bank in lieu of installation.
Stormwater Management
Recently, the City Council approved an ordinance adopting new storm water management
standards. As part of the new ordinance, development of residential property greater than 10,000 square
feet requires on-site storm water detention measures. However, certain developments which have been
substantially completed with a storm water management plan before the ordinance adoption date of
November 27, 2012 or have an agreement with the City regarding storm water management measures
prior to the ordinance's effective date are exempt to the new standards. Due to staff's on-going
discussions with the property owner over the past several years, this development was included on the list
of exempt properties.
To address the storm water run-off anticipated as a result of the resubdivision and development of
the parcels, staff and the City Engineer are recommending that best management practices (BMP's) be
incorporated into the design such as the use of permeable driveway pavers, installation of rain gardens
and the use of rain barrels. Each proposed use of these practices will be reviewed and approved by the
City Engineer on a lot-by-lot basis during the building permit process.
Right to Farm &Pump Station Notice
As indicated on the proposed Final Plat, notice has been given to future homebuyers regarding
Kendall County's Right to Farm Statement which specifies that certain properties zoned A-1 and AG
Special Use within the county can be used for farming purposes and may result occasional smells, dust,
sights,noise, and unique hours of operation that are not typical in other zoning areas.
In the same manner, staff as requested that the Petitioners also provide notice to the future
property owner of Lot 3 that an existing City-owned pump station is located immediately south of that
proposed lot at 101 E. Bruell Street. This notification is intended to make the future property owner of
the potential noise and/or odor as a result of the pumping station's operation.
Staff Recommendation:
Based upon the existing surrounding land use and zoning, as well as the compliance with the bulk
regulations of the current R-1 One Family Residence District and engineering review of the proposed
Final Plat,staff recommends approval of the requested Final Plat as submitted.
Proposed Motion:
In consideration of testimony presented during a Public Hearing on January 9, 2013 and discussions
conducted at that meeting, the Plan Commission recommends approval to the City Council of a request
for Final Plat approval for the Salek Subdivision of Lion's Pool, as prepared by Todd Surveying date
stamped received January 3, 2013, and further subject to {insert any additional conditions of the Plan
Commission)...

PRELIMINARY PLANXINAL PLAT
PETITIONER ROUTE
Step 1 : Petitioner must submit a completed application, fees* and all pertinent materials to the
Community Development Department a minimum of 45 days prior to the targeted Plan
Commission meeting. Petitioner is responsible for making submittals to other review
agencies such as Kendall County, Illinois Department of Transportation, Illinois
Department of Natural Resources, U.S. Army Corps of Engineers, etc., to allow timely
review by City.
*Fees: 1 . Preliminary Plan Fee - $500/Final Plat Fee - $500
a. Engineering Review Fees - 1 .25% of the approved engineer's estimate of cost
of all land improvements, to be determined by City Engineer.
It. Engineering Review Deposit - up to 1 acre = $ 1 ,000;
over 1 acre but not over 10 = $2,00
over 10 acres, but not over 40 = $5,000
over 40 acres, but not over 100 = $ 10,000
over 100 acres = $20,000

Note: Owner/Developer will be responsible for payment of recording fees and

pay these fees directly, they will be responsible for reimbursing the United
City of Yorkville for the aforementioned fees and costs.
Note: You must presentyour plan at each of the meetings below as indicated
Step 2: Plan Council: The Plan Council meets the 2nd and 4th Thursday of the month at 9:00
a.m. in the city conference room. Upon recommendation by the plan council, you will
move forward to the Plan Commission Meeting. Attendees to this meeting include:
Community Development Director, City Engineer, Building Department Official, Public
Works Director, Director of Parks and Recreation, Fire Department Representative, and
Police Department representative.
Step 3: For Preliminary Plans only; Park Board planning meeting: The Park Board makes
recommendations on any Park Sites included in the development. The Park Board
planning meeting is the 4th Thursday of each month at 7:00 p.m. at the Riverfront
Building, 201 W. Hydraulic Street.
Step 4: Plan Commission: The Plan Commission meets the 2nd Wednesday of each month at
7:00 p.m. in the Yorkville public library at 902 Game Farm Road. The Plan
Commission will make a recommendation for the City Council' s consideration. The Plan

Commission consists of 10 members appointed by the Mayor, the City Attorney and City
Land Planner.
Step 5: The project will be discussed in an informal atmosphere at the Economic Development
Committee meeting, held the first Tuesday of each month at 7 P.M. in the City Council
chambers. This session is to discuss and consider recommendations of prior committee
meetings.
Step 6: City Council: The City Council meets the second and fourth Tuesdays of the month at
7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting
takes place.
If this project has included an annexation and/or zoning petition, a Public Hearing will be
held at this time with notice given by publication. Any annexation agreement, PUD
agreement or development agreement must be signed by the Petitioner prior to being
voted on by the City Council. Prior to the recording of the final plat, the petitioner must
pay the Administration Fee. This is equal to 1 .25% of the approved engineer's estimate
of construction costs of land improvements, including but not limited to all public
improvements to be dedicated to the City, mass earth grading, and quasi-public
improvements to be maintained by the homeowner's associations such as private storm
sewer, parking areas, and trails.
Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council
and all required documents, bonds, and letters of credit are submitted to the city, the final
plat may be recorded with Kendall County. Submit the final plat mylar to the Deputy
Clerk for signatures. When all city signatures are in place, the developer or his surveyor
may take the mylar to the Kendall County Clerk for his signature. The next step is to
have six paper prints made and return to the Kendall County Recorder's office for
recording. Kendall County requires the mylar and four paper copies. The City of
Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any
copies you may require would be in addition to these.
Agreement:

Petitioner Deposit Account Fund:
It is the policy of the United City of Yorkville to require any petitioner seeking approval on a project or entitlement request to
establish a Petitioner Deposit Account Fund to cover all actual expenses occurred as a result of processing such applications and
requests. Typical requests requiring the establishment of a Petitioner Deposit Account Fund include, but are not limited to, plan
review of development approvals/engineering permits. Deposit account funds may also be used to cover costs for services related to
legal fees, engineering and other plan reviews, processing of other governmental applications, recording fees and other outside
coordination and consulting fees. Each fund account is established with an initial deposit based upon the estimated cost for services
provided in the INVOICE & WORKSHEET PETITION APPLICATION. This initial deposit is drawn against to pay for these
services related to the project or request. Periodically throughout the project review/approval process, the Financially Responsible
Party will receive an invoice reflecting the charges made against the account. At any time the balance of the fund account fall below
ten percent (10%) of the original deposit amount, the Financially Responsible Party will receive an invoice requesting additional
funds equal to one-hundred percent (100%) of the initial deposit if subsequent reviews/fees related to the project are required. In the
event that a deposit account is not immediately replenished, review by the administrative staff, consultants, boards and commissions
may be suspended until the account is fully replenished. If additional funds remain in the deposit account at the completion of the
project, the city will refund the balance to the Financially Responsible Party. A written request must be submitted by the Financially
Responsible Party to the city by the 15th of the month in order for the refund check to be processed and distributed by the 15th of the
following month. All refund checks will be made payable to the Financially Responsible Party and mailed to the address provided
when the account was established.

We are in receipt of the revised Final Plat of Subdivision prepared by Todd Surveying for the above
referenced project. Our review of these plans is to generally determine the plan's compliance with
United City of Yorkville ordinances and whether the improvements will conform to existing City systems
and equipment. This review and our comments do not relieve the designer from his duties to conform
to all required codes, regulations, and acceptable standards of engineering practice. Engineering
Enterprises, Inc.'s review is not intended as an in-depth quality assurance review. We cannot and do
not assume responsibility for design errors or omissions in the plans.
As such, we offer the following comments:
1. The legal description does not close. Accordingly the bearings and distances should be
confirmed.
2. All dimensions in the legal description need to be to the hundredth of a foot (.01). There
currently are some measured dimensions rounded to the tenth of a foot (.10).
3. The chord bearings and lengths need to be dimensioned.
4. The square footage of lots 1 and 3 appear to be incorrect.
5. The developer will need to submit the Final Plat to the City in digital form. The coordinate
system for the plat shall be NAD27 Illinois State Plane, East Zone, US Foot (IL-E) 6.03.02
6. The 30' Temporary Construction Easement can be removed from the plans.
7. Along Bruell, we will need a 10' Public Utility Easement (PUE) adjacent to the ROW and a 20'
City Utility Easement adjacent to the PUE. The City Utility Easement language is as follows:

DO NOT THEN OR LATER INTERFERE WITH THE AFORESAID USES OR RIGHTS HEREIN
GRANTED.
8. Final engineering plans should be developed and provided for review. The plans should include
the following:
• Grading plan w/proposed tops of foundations, including any necessary drainage
improvements
• Location of water and sanitary sewer services
• Location of proposed sidewalk, driveways and parkway trees
It is our understanding that there were previous communications in regards to stormwater
management. Detention will not be required, however best management practices (BMP's) will
need to be incorporated into the design. The proposed BMP's should be shown in the
engineering plans.
The developer should make the necessary revisions and resubmit two (2) plan sets for review. If you
have any questions or require additional information please call our office.
