Citizen Comments: None Minutes for Correction/Approval: October 4, 2012 The minutes were approved as presented. New Business: 1. PS 2012-28 Purchase of Adjudication Software Ms. Schwartzkopf said the current software is outdated with no means for an update. They explored companies that specialize in software that would interface with current programs. As a bonus, building permit software is free. Ms. Schwartkopf said Code Official Peter Ratos had been exploring software so this would be helpful to him also. A cost of $1,000 would be incurred to get this set up. The total cost is $18,000 with a $400 monthly maintenance fee. She said the cost would be well worth the investment. Alderman Funkhouser asked how much money comes from adjudication fees each year. The net amount is between $30,000 and $70,000 according to Mr. Olson. Police tows also contribute to that amount. Alderman Colosimo said the adjudication software is being used in Oswego where he is the Adjudication Officer and he gave it a positive recommendation. DRAFT 2 The maintenance contract is a 5-year commitment. Ms. Schwartzkopf said she was comfortable with that and that it is too costly to be changing any sooner. It includes upgrades and 24/7 support. The $400 monthly maintenance fee is also locked in for this 5-year period and she said this type of fee is now standard for all companies. Company representatives will be present on the first adjudication night to insure the equipment is working properly. The committee members recommended the purchase of the software and this will move to the City Council consent agenda. 2. PS 2012-29 Public Safety Committee Meeting Schedule for 2013 All agreed to the current Thursday schedule with a start time of 6:30pm. Old Business: 1. PS 2012-20 Golf Carts in Subdivisions Public Safety committee members had previously discussed whether or not the City could restrict golf carts within a geographic area. From a legal perspective the restriction can be made, however, it is not clear how justification can be given to one subdivision and not another. He added that he would like to do this on a test basis if the program is approved. Alderman Colosimo said he and Alderman Koch would like to have a meeting with the Raintree residents and that the majority of the residents seem to favor the carts. Alderman Kot said he is OK with the concept, however, is concerned about the burden it will place on the Police Department. He asked who would be conducting inspections, doing licensing etc. and said he thought the fees should pay for a part-time person for this function in a self-supporting program. Chief Hart said that person would have to attend training and have mechanical ability. Due to the cost of the golf carts, Alderman Colosimo felt there would not be a large number of applicants to operate carts. Alderman Funkhouser said he is not in support of this program due to costs of a road study, signage, staffing and the fact Yorkville does not have gated communities. He added that if one neighborhood is allowed to operate carts, other neighborhoods will request it also. Alderman Spears concurred. It was decided to table this item to February 7th, 2013 under Old Business, to allow time for discussion with the residents in that subdivision. Additional Business: Chief Hart said Halloween night was orderly and sex offender compliance checks were conducted. Yorkville Patch also posted a map and list of sex offenders There was no further business and the meeting was adjourned at 6:56 on a motion by Alderman Kot and second by Alderman Funkhouser. Current Temporary Permit Class Per the city liquor code, there is currently a license class for temporary permits. Under this class of license, the liquor commissioner has the authority to issue temporary permits for special events to certain entities such as a political subdivision (the “city”), not for profit organizations or to a winery for the sale of its wine. Examples of special events that have had temporary permits issued in past years are Hometown Days, Ribs on the River, Music Under the Stars, and Brat Fest. Temporary permits are restricted to three temporary permits per organization per calendar year. Proposed Amendments to Temporary Permit Class The proposed amendment removes the restriction of the city being limited to only three temporary permits per calendar year. If the three limit restriction is removed for the city, it would allow for the city to be able to hold a temporary liquor permit for additional special events. The three limit restriction would remain in place for temporary permits issued to other entities. The amendment also proposes to add language that would allow the liquor commissioner to issue a temporary permit for a special event to a microbrewery, brew pub, or a craft brewer for the sale of their crafted beer. This language would be similar to the language currently in the code allowing temporary permits to be issued to wineries that participate in special events. In 2008 the city held a “Promenade of the Arts” event in Town Square Park. Along with the fine art and craft festival, seven wineries participated in the event by offering wine tastings and selling bottles of their wine. By adding the ability to issue a temporary permit to a microbrewery, brew pub, or a craft brewer, it would allow for more options for special events that are held in the city, such as expanding offerings at current special events or the potential to create new events. For example, in 2012, the Oswegoland Park District held a “Brew at the Bridge” craft beer festival at Hudson Crossing Park in downtown Oswego. The last proposed amendment to this class of license is the removal of language that says that a temporary permit may be issued for the sale and consumption of alcoholic liquor at a regularly scheduled game or tournament at a privately owned sports stadium. If a sports stadium is ever constructed here, most likely the owners would not want to be limited to only selling alcohol three times during a calendar year, so such a use would be licensed under a different class of license. Background: This item was brought up for discussionat the Committee of the Whole meeting on August 14, 2012 and tabled to the Public Safety committee.Golf carts have been requested to be used by residents in certain subdivisions of Yorkville. Currently Yorkville does not have a direct ordinance related to these vehicles. Therefore, any issue confronted with them must defer to the state policy. This law is found in the Illinois Compiled Statutes 625 ILCS 5 /11-1426.1and 1426.2.An IML handout is attached which clearly explains the different regulations of vehicles available to the City. For ease of use, we’ve extracted certain components of the IML FAQ below. The first category of vehicles is a “non-highway vehicle”. Non-highway vehicles include what is commonly referred to as ATVs, golf carts, dirt bikes and the lesser known “neighborhood vehicles” and “recreational off-highway vehicles”. The second category of vehicles is a “low-speed vehicle”. Low-speed vehicles are anything that conforms to federal regulations for vehicles in Title 49 CFR Part 571.500, and has a maximum speed greater than 20 mph and less than 25 mph. Most golf carts do not fit within this definition, but they can be speed modified. Both non-highway vehicles (NHVs) and low-speed vehicles (LSVs) must conform to federal vehicle standards in Title 49 C.F.R. Part 571.500 of federal law. These requirements are that they have head lamps, tail lamps, brake lamps, turn signals in the front and rear, red reflectors on the side and rear, mirrors, parking brakes, a windshield, seatbelts, vehicle identification number and registration plates from the Secretary of State. Any of these vehicles are also required to have a slow moving vehicle emblem attached to the rear of the vehicle (or in the case of a LSV one which specifies their top speed does not exceed 30 mph). A municipality is able to authorize any of these vehicles to be used on any streets which have a posted speed limit of 35 mph or less. The citymust pass an ordinance or resolution to do so and must postappropriate signage on streets where these vehicles are allowed. Currently there is not a law stating if one can restrict the usage of these vehicles to certain times of the day. These vehicles are also permitted to cross highways if there is a four way stop sign or traffic light or if the speedlimiton the highway is 35 mph or less (45 mph or less if the vehicle is a LSV). According to the statutes, the “Department must consider the volume, speed and character of traffic on the roadway.” This means thecity will need to conduct a study of the roads which would be conductedby EEI. The estimated cost of the study would be $5,000. Also, allowing for NHVs to be permitted on the roads would require signs to be posted. The estimated cost for city-wide signageis$10,000-$15,000.There would also be a signage cost associated with restricting the use of LSVs on roads as well. These vehicles also require proper insurance, licensing and inspections which would need to be conducted by the police force. Chief Hart was able to elaborate on the potential issues the police force may face in regards to an allowance of NHVs and LSVs on neighborhood roads. According to Chief Hart, a program where we allowed golf carts and other vehicles on the streets would require proper inspection and stickers for vehicles in order to be able to ensure the vehicle would meet the standards to be driven on these streets.By statute we are allowed to issue a fee for these vehicles to get a sticker to allow their use on streets, but at current staffing levels for the police force it is not likely there would be enough man power to adequately perform this essential task in order to ensure safety of the residents. Over the next few years as staff increases there is potential for this topic to be revisited but at this moment it does not appear likely that there are enough individuals to effectively and safely oversee the implementation of allowing NHVs and LSVs on neighborhood streets. Currently any vehicle which meets requirements of anLSV is closer to authorization than an NHV, asthe state statute requires the municipality to opt-out of LSV usage on City streets and NEV code requires the municipality opt-in to usage on City streets. However, for both classifications, the City is taking the position that operation is currently illegal as local permits have not been issued (which would certify that the vehicles have met our standards). Recommendation: Staff seeks direction on the potential drafting of a proposed ordinance or resolution in relation to restrictions on the usage of golf carts, NHVs or LSVs on city streets.
