City Council Minutes 2013 05-28-13 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS 800 GAME FARM ROAD ON TUESDAY, MAY 28, 2013 Mayor Golinski called the meeting to order at 7 : 00 p .m. and led the Council in the Pledge of Allegiance. AMENDMENTS TO THE AGENDA Mayor Golinski requested that Item # 1 on the consent agenda Nicor Gas Property (PW2013 -21 ), be moved to the regular agenda under the Public Works Committee Report. Mayor Golinski tabled the Police Pension Fund Board Report to the next City Council meeting. Amendment approved unanimously by a viva voce vote . PRESENTATIONS None. PUBLIC HEARINGS None. CITIZEN COMMENTS ON AGENDA ITEMS None. CONSENT AGENDA None. MINUTES FOR APPROVAL None. BILLS FOR PAYMENT Mayor Golinski stated that the bills were $919,201 .66 . REPORTS MAYOR' S REPORT Selection of FY14 Mayor Pro-Tem (CC 2013 -39) Alderman Milschewski made a motion to appoint Alderman Funkhouser as Mayor Pro-Tem; seconded by Alderman Kot. Motion approved unanimously by a viva voce vote. Library Board 2012-2013 Annual Report (CC 2013 -40) Michelle Pfister gave the Library Board annual report. Alderman Funkhouser asked if money had been added into the budget for new purchases. She said purchases were coming out of development fees. He was told the library has a patron counter on the door. Ordinance 2013-32 Authorizing the First Amendment to the Annual Budget of the United City of Yorkville for the Fiscal Year Commencing on May 1 , 2013 and Ending on April 30, 2014 (ADM 2013 -27) Mayor Golinski entertained a motion to approve an ordinance authorizing the first amendment to the annual budget of the United City of Yorkville for the fiscal year commencing on May 1 , 2013 and ending on April 30, 2014 and authorize the Mayor and City Clerk to execute. So moved by Alderman Milschewski; seconded by Alderman Funkhouser. Motion approved by a roll call vote. Ayes-7 Nays-0 Teeling-aye, Koch-aye, Kot-aye, Frieders-aye, Colosimo-aye, Funkhouser-aye, Milschewski-aye Ordinance 2013-33 Amending the Infrastructure Maintenance Fee for Water Service and Establishing an Infrastructure Maintenance Fee for Sanitary Sewer Service (ADM 2013 -29 ) Mayor Golinski entertained a motion to approve an ordinance amending the infrastructure maintenance fee for water service and establishing an infrastructure maintenance fee for sanitary sewer service and authorize the Mayor and City Clerk to execute. So moved by Alderman Colosimo; seconded by Alderman Kot. Motion approved by a roll call vote. Ayes-7 Nays-0 Kot-aye, Frieders-aye, Colosimo-aye, Funkhouser-aye, Milschewski-aye, Teeling-aye, Koch-aye Ordinance 2013-34 Adopting a Motor Vehicle Tax for Roadway Improvement and Maintenance (ADM 2013 -30) Mayor Golinski entertained a motion to approve an ordinance adopting a motor vehicle tax for roadway improvement and maintenance and authorize the Mayor and City Clerk to execute. So moved by Alderman Colosimo; seconded by Alderman Funkhouser. Alderman Kot clarified that both of these had sunset clauses. Mayor Golinski said yes and it has to be reinstated every year. Alderman Funkhouser clarified that the intent of this ordinance is to fund the roadway program. Alderman Colosimo was concerned with paragraph D, for it didn't mention the sewers . He wanted to make sure the sewers were included. City Attorney Orr stated the sewers running under the street can be fixed. Alderman Colosimo said the only way streets will be fixed is if the City establishes a fund to keep those items reserved for the road repair program. Mayor Golinski stated the City is doing what it can to save money. Streets need to be taken care of. Alderman Frieders asked will there be active research into what roads should be looked at next. City Administrator Olson stated yes. Mayor Golinski stated hopefully it stays as a rolling five year plan. Motion approved by a roll call vote. Ayes-7 Nays-0 Koch-aye, Kot-aye, Frieders-aye, Colosimo-aye, Funkhouser-aye, Milschewski-aye, Teeling-aye NIMEC Street Light Renewal (ADM 2013 -31 ) Mayor Golinski entertained a motion to approve a motion to authorize the City Administrator and Finance Director to sign contracts to secure the provision of electricity for the City's street light accounts from the firm identified as the low cost provider by NIMEC, effective only for the current NIMEC renewal cycle, which ends on June 30, 2013 . So moved by Alderman Frieders; seconded by Alderman Colosimo. Motion approved by a roll call vote . PUBLIC WORKS COMMITTEE REPORT Kennedy Road Improvements Adjacent to Autumn Creek (PW 2013 -20) Agreement for Professional Engineering Services for Kennedy Road — Autumn Creek Alderman Teeling made a motion to approve an agreement for professional engineering services for Kennedy Road - Autumn Creek with Engineering Enterprises, Inc . and authorize the Mayor and City Clerk to execute; seconded by Alderman Milschewski. Alderman Funkhouser's conflict is that the City has not gone to bid on engineering fees . He wondered if the City is getting the best deal by not bidding this out. City Attorney Orr stated there is a law under the Illinois municipal code that states land surveying, architects and engineers may not bid out for cost. Motion approved by a roll call vote. Motion approved by a roll call vote . Ayes-7 Nays-0 Funkhouser-aye, Milschewski-aye, Teeling-aye, Koch-aye, Kot-aye, Frieders-aye, Colosimo-aye Nicor Gas Property — Final Acceptance (PW 2013 -21 ) Mayor Golinski entertained a motion to approve final acceptance - accept public improvements as described in the bill of sale for ownership and maintenance, subject to receipt of executed Bill of Sale for Nicor Gas property. So moved by Alderman Kot; seconded by Alderman Funkhouser. City Administrator Olson explained the mortgage statement in the bill of sale. Alderman Colosimo moved to amend the bill of sale as presented in the original packet with the subsequent bill of sale including the two paragraphs that are highlighted in the subsequent packet; seconded by Alderman Kot. PLAN COMMISSION Ordinance 2013-37 Authorizing the Third Amendment to the Planned Unit Development Plan for Heartland Center (608-728 East Veterans Parkway) (PC 2013 -03 ) Mayor Golinski entertained a motion to approve an ordinance authorizing the third amendment to the planned unit development plan for Heartland Center (608-728 E. Veterans Parkway) and authorize the Mayor and City Clerk to execute. So moved by Alderman Milschewski; seconded by Alderman Kot. The Minutes of the Regular Meeting of the City Council — May 28, 2013 — Page 4 of 4 Alderman Funkhouser believes the scale of the sign is too big for the space and will not support it. Alderman Frieders stated the sign is not obtrusive in any way. There are eleven businesses and without the sign there is no way of advertising the businesses . He believes the sign should be put in. Alderman Kot agrees, Alderman Koch and Alderman Teeling agree with Alderman Frieders. Mayor Golinski stated it is nice to have so many businesses in that area to advertise. Alderman Milschewski discussed going wider on the sign with Community Development Barksdale-Noble. Motion approved by a roll call vote . CITY CLERK' S REPORT No report. CITY TREASURER' S REPORT Required Reporting to Municipality by the Police Pension Fund Board (CC 2013 -42) Mayor Golinski stated this was tabled. COMMUNITY & LIAISON REPORT River Night Alderman Colosimo reminded everyone that River Night is coming up on Friday June 21 , 2013 . Summer Solstice Festival Alderman Frieders said to come out to the Summer Solstice Festival which is Saturday June 22, 2013 . Stars Of Hope Festival Mayor Golinski said the Stars of Hope Festival is June 1 , 2013 at 8 : 00 at the high school football field. STAFF REPORT No report. ADDITIONAL BUSINESS Construction Signs Alderman Kot had a concern about the construction signs being used for advertising purposes. Construction Traffic Alderman Colosimo and Alderman Milschewski brought up the issue of construction traffic. Paint Colors For City Hall Mayor Golinski asked the City Council their opinion on paint colors for City Hall . EXECUTIVE SESSION None . CITIZEN COMMENTS None .
