Citizen Comments: None Previous Meeting Minutes May 21, 2013 Alderman Kot said under Additional Business, 2nd paragraph, the sentence should state that he asked for electronics drop-off on a quarterly basis. Alderman Koch asked that the name Dezo be changed to Delo in the Windett Ridge agenda item. New Business 1. PW 2013-25 Water Department Reports for March &April 2013 Mr. Dhuse said these are the standard reports and noted that the water use was down from last year and not as many hydrants had been flushed in April. 2. PW 2013-26 Prairie Gardens— Un it 4 —Letter of Credit Ms. Noble said this item is part of a continuing effort to follow up on the outstanding letters of credit. This letter is for the executive center, subdivided in 2005. Ms. Noble and Mr. Sanderson would like to call the letter of credit for$165,000 after repeated attempts to contact the developer. The letter is with the State Bank of Illinois,but it is unknown if the bank is still solvent. The City Attorney will be consulted if there is a problem. This item will go to the June 25th Council consent agenda. Page 1 of 4 3. PW 2013-27 Sunflower Estates HOA SSA 4. PW 2013-28 Fox Hill HOA SSA These 2 items were discussed together. Mr. Olson said he is asking the Council to reconfirm the budgeting planned for the next few years. The first step is to file the tax levy ordinance in December and when approved,the work would go out for bids. The work to be done is sealcoating for Fox Hill and the naturalization of the Sunflower detention basins,both to be done next year. Notices to the residents regarding the impending dues increase must be sent. Sunflower residents will also be asked if the ponds should be naturalized which is easier to maintain as opposed to dredging. Bart would recommend sending a letter to Fox Hill residents asking them to attend a Public Works meeting. The Sunflower issue is more complex and a meeting should be set up for August or September with the Sunflower residents. In a later suggestion, Mr. Olson said a townhall meeting should be held for Fox Hill residents prior to the Sunflower meeting on the same night. Alderman Teeling suggested the drainage issue should also be considered during this meeting. Alderman Kot asked if the increased dues from $64 to approximately$228 for Sunflower would remain at the higher amount or decrease when the project is done. The City Council would set the tax levy each year according to Bart Olson. When discussed during the original budgeting process, there was no resident feedback. Alderman Koch said the residents may also be unaware of the situation. Ms. Milschewski asked how the naturalization prevents mosquitoes. The water would flow in and drain out after a rain—resulting in no standing water. The bio-diversity of the plants would also increase insects that feed on mosquitoes, resulting in a natural eco-system. The basins would be dry with some maintenance required to keep trees out. These 2 items will move forward to the Council consent agenda. Old Business out of order) 1. PW 2013-22 Sunflower Estates Drainage This item was moved up on the agenda following the previous discussion about Sunflower. Alderman Colosimo stated he and Alderman Koch have talked and feel that the City should repair the drainage without assessing the residents just because an SSA is in place. He said other problems in the City have been fixed and the cost is absorbed by the City through taxes. Mr. Colosimo questioned why the drainage problem exists and if it could actually be a City issue. He said this is a Public Works project like any other project. Mr. Olson replied that the drainage was constructed in compliance with the standards in place at the time, which according to Mr. Sanderson, were 10 years with the current standard now being 100 years. Ms. Teeling asked if Sunflower would be responsible for repairs if they still had their HOA and it had not been taken over by the City. Mr. Olson said the only reason it is being suggested the SSA should fix the issue is because it is legal and if a higher standard were in place at that time, the residents would have paid for the upgrade over time. Alderman Koch added that much of the commercial was not in place at the time the pond was built and there is now more blacktop which affects the runoff. Ms. Milschewski added that a previous hydrologic report showed the water also comes from as far as Legion Road. Mr. Colosimo added that water comes from the Walgreens area as well. Page 2 of 4 Alderman Kot commented that he agrees with Alderman Colosimo that the burden should not be placed on the SSA. He said the City should find the funding to fix the drainage problem especially since the City will be asking the residents to pay for a problem that is affecting only part of the residents there. Alderman Teeling also agreed and said if there were a problem with the sewers in the older part of town, the City would pay for those repairs. Mr. Olson said deficit spending is one option and he also noted that other areas of town have similar problems that have not been remedied. Ms. Milschewski said residents on Van Emmon have also had flooding issues in the past from runoff. Ms. Teeling questioned how likely it would be to have other subdivisions come forward with similar problems. There are currently problems on Van Emmon, State St., Morgan and Orange. Ms. Milschewski said the problem needs to be fixed. Ms. Teeling and Ms. Milschewski both commented the City cannot continue to deficit spend and must be conscious how the money is spent such as building a skate park. Commenting on the deficit spending,Alderman Kot said he does not think it is wise and would prefer to do a 6-month budget review to see if there is extra money from sales tax that could be earmarked. Implementing stormwater utilities is another option according to Mr. Olson. In that option, property taxes are decreased in conjunction with what is being spent on these improvements. A utility fee is then also added to churches, hospitals and other businesses with large parking lots, asking them to contribute. Alderman Colosimo agreed with a 6-month budget review, but also said the money should be taken from the general fund reserve, repaying tax dollars as the taxes come in. This would require a budget amendment according to Mr. Olson. The budget impact of$130,000 for the repairs was also discussed and it was noted that there is already a deficit in the budget for 2014. City liability was addressed by Mr. Olson and he said the City is not liable unless there is neglect in maintenance. Mr. Sanderson also discussed the drainage under Rt. 71. Alderman Koch said that cornstalks blocked the storm sewer during the recent downpour and with the help of another resident, they managed to unblock the area. Public Works Director Dhuse made some suggestions for a partial remedy. If the fence was removed, the cornstalks would not catch and block the water. The landowner could also be asked to create a bio-swale for better drainage. Mr. Dhuse will speak with the farmer and inquire about leasing 1 acre for a grass buffer to slow down the water and catch the stalks. He said the cost could be as low as $500 for an acre. Mr. Olson said this action would require Council approval. City Administrator Olson said both remedies need to done and Alderman Kot noted that at least it sends a message that the City is trying to help. Mr. Olson asked if the cost could be split among the Sunflower residents. Alderman Colosimo objected to this saying the City should pay and that a small group cannot be required to pay for this. Both Aldermen Kot and Colosimo asked if any project was under budget where the excess could be used for this repair. Alderman Milschewski inquired if the project can be bid prior to actual approval. This can be done and would only cost for preliminary work. The committee was in favor of this idea. Mr. Olson added that by early October the staff should have a firmer handle on the budget figures and he added that projects can be eliminated. The next step if the project will be bid, is to proceed with an RFP which will need Council approval. Alderman Koch also asked that when the letters are sent to the residents, that a comparison of costs in other subdivisions be provided. Page 3 of 4 Ms. Milschewski asked when the theatre would be opening. It will open in November, however, Mr. Olson said for the first 4-5 years the taxes would go back to the developer. Colosimo said that the theatre will help generate other taxes when people frequent restaurants, shopping, etc. Alderman Kot posed a hypothetical question as to what would occur if most of the residents are opposed to the increase and no action is taken. Mr. Olson said eventually the silt will completely fill the pond and flooding could occur with the City then being liable. Back to New Business........ S. PW 2013-29 Riverfront Park OSLAD Project Agreement Mr. Olson said this is the formal grant agreement for Riverfront Park. Once this is initiated, the City has 2-3 years to begin the project. All the money in the project is staff hours or State money and the City will be reimbursed. Completion date is 2014 or 2015. This will move to the Council consent agenda. 6 PW 2013-30 TAP Grant In tergovernm en tal Agreem en t This is a county-administered process requiring an intergovernmental agreement. The amount each year is $5,000 and the City needs to reapply each year. 7. PW 2013-31 Route 47 Parking Lot Contract Award Three bids were received on June 10th with D Construction submitting the lowest.A couple change orders are anticipated and there are some questionable soils which could be naturally-occurring substances. This moves to consent agenda. Additional Business: 1. Alderman Kot asked if progress had been made on gathering numbers regarding State Street and the flooding that occurs there. Many of the older neighborhoods do not have storm sewers, he said. He would like this to remain under Old Business and believes the project needs to be done. Mr. Dhuse estimated the cost to fix would be about $50,000. 2. Alderman Milschewski asked about the usage of left turn lights at Fox and Van Emmon. Van Emmon does not have the turn lane when work is being done during the day according to Mr. Dhuse. She also said the flooding by the tracks was an issue. That has now been fixed. 3. Alderman Colosimo asked about the road patch on Rt. 47 by Parfection Park. It was repaired on this date. 4. Ms. Teeling said sidewalk grinding had been done to level them and it was very well done. An authorization, as defined by IDOT, is the written approval of a contract change and the written directive to the contractor to perform said work. By this definition, it alters the contract work from that awarded under the competitive bidding process. An Authorization of Contract Changes signed by the Regional Engineer signifies completed review of and support for the change proposed. Background: Kendall County served as the lead agency during the design of the project and the City is taking the lead during construction. The State of Illinois and "D" Construction, Inc. entered into an agreement for a contract value of $1,463,662.55 for the above referenced project. Construction began on November 20, 2012 and will be completed in July 2013. The construction costs are being funded by 80 percent Federal participation and 20 percent local funds. The maximum federal participation amount is $1,742,000.00, inclusive of all change orders (authorizations) associated with this contract. Questions Presented: Should the City approve Authorizations No. 1A, 613, 8, and 9 the amount of$33,018.86? Discussion: Authorization No. 1A is for additional effort to remove buried obstructions to drilling shafts for installation of new H-piles for construction of the new west abutment. Authorization No. lA adds to previously completed work on the original approved Authorization No. 1. Authorization I completes invoicing for work undergone in Authorization 1. Authorization I has a value of $3,065.74. Authorization No. 6B is for additional labor costs due to differing site conditions associated with the existing dam. A second flood event deteriorated the integrity of the existing west abutment which was being utilized as part of the coffer dam system for construction of the new west abutment. In order to stop flood waters, the contractor added sandbags and riprap near the junction of the dam and the existing west abutment. Additionally PCC seal coats and a PCC mud sill were added to keep the excavation for the new west abutment dry. Authorization No. 6B adds to previously completed work on the original approved Authorization No. 6 and 6A used on a previous flood event. Authorization No. 6B has a value of$19,588.77. Authorization No. 8 is for additional effort to relocate material stockpiles. Access to the neighboring IDNR contract was confined to the northwest corner of the River Road bridge approach. Coordination between the two contracts required relocation of material stockpiles in that location to facilitate IDNR project completion prior to the Army Corps permit deadline and to provide continuous construction progress on the bridge contract. Waste material could not be removed from the site because access to dump sites was not possible due to wet, winter weather conditions. Authorization No. 8 has a value of$7,493.89. Authorization No. 9 is for additional effort required to splice H-piles for the west abutment. Bedrock elevation differred from elevations shown on the soil boring, requiring longer H-pile length for some west abutment piles. Authorization No. 9 has a value of$2,870.46. The net change to date for the authorizations (inclusive of IA, 613, 8, and 9) is $83,852.92 which is a 5.73% increase to the original contract value, which reflects a new revised contract value to date of $1,547,515.47. As such, the City's responsibility for the contract additions is the 20% share, or $16,770.58. We have attached IDOT form BC-22 for Authorizations No. 1A, 613, 8, and 9 for your information. All authorizations have a pre-approval from the IDOT District 3 Local Agency Bureau of Construction Engineer. We are recommending approval of the Authorizations. Backl4round The City applied for a Kane/Kendall Council of Mayors LAFO project grant(federal funds) a few years ago, and was fortunate enough to receive $300,000 for the resurfacing of Cannonball Trail between Amanda Lane and Blackberry Lane. The total cost of the resurfacing project is $435,000, which means the City is on the hook for$135,000 in total project funds. We have this project budgeted in the MFT fund in line-item 15-155-60-00-6089 for FY 16 and FY 17 (summer 2015 and 2016, respectively). Since this project is budgeted in the MFT fund, it's expenses have no tie to the cash-flow of the City's general fund or related capital funds. The condition of Cannonball Trail was not included in the City's analysis for the Road to Better Roads program because the project already has grant funded associated with it. We ran the numbers based on the condition of the roadway and determined that if we would have included it that it would have been recommended for Summer 2014 or Summer 2015. Further, the surface of the roadway is rapidly deteriorating. With the above information in hand, and based on complaints of the roadway condition from residents and an inquiry by Alderman Frieders, we contacted the Kane/Kendall Council of Mayors to see if they would allow us to accelerate the project from its current 2015/16 schedule. They indicated that it would be acceptable. In order to accelerate the project, we would need to approve an engineering agreement with EEI to manage the project and a budget amendment to allow expenditures related to the MFT agreement to be coded out of FY 14. No action would be required at this time by the City Council related to the budget and the construction of the improvements, as the improvements would be completed in FY 15. Since we have not yet formally approved a FY 15 budget, we would only need to include the construction costs in the FY 15 budget proposal to be approved in April 2014. Recommendation Staff recommends approval of the engineering agreement and budget amendment pushing the expenses for the project into FY 14 and FY 15. Cannonball Trail Roadway Improvements Local Agency Functional Overlay (LAFO) United City of Yorkville,Kendall County,IL Professional Services Agreement-Design Engineering THIS AGREEMENT, by and between the United City of Yorkville, hereinafter referred to as the "City" or "OWNER" and Engineering Enterprises, Inc. hereinafter referred to as the "Contractor" or"ENGINEER" agrees as follows: A. Services: ENGINEER agrees to furnish to the City the following services: The ENGINEER shall provide any and all necessary engineering services to the City as indicated on the included Attachment A. Design engineering for Cannonball Trail, for the limits as shown on Attachment D will be provided. All Engineering will be in accordance with all City and Illinois Department of Transportation requirements. B. Term: Services will be provided beginning on the date of execution of this agreement and continuing, until terminated by either party upon 7 days written notice to the non- terminating party or upon completion of the Services. Upon termination the ENGINEER shall be compensated for all work performed for the City prior to termination. C. Compensation and maximum amounts due to ENGINEER: ENGINEER shall receive as compensation for all work and services to be performed herein, a Lump Sum in the amount of $35,000.00, based on the Estimate of Level of Effort and Associated Cost included in Attachment B. These projects would be completed in the Summer of 2014. Background Brad Sanderson has attached a memo giving a brief update on the FY 14 Road to Better Roads Program and an overview of upcoming schedules for the FY 15 program. As stated in Brad's memo, engineering agreements for FY 15 roads should be in front of the City Council by the end of this calendar year, so that construction can occur as soon as possible during the summer. We can approve and pay for the engineering contracts with relative ease, and that engineering work could be used for a few years beyond completion, but we must resolve the funding gap for FY 15 soon. The City has committed to a$1,000,000 per year Road to Better Roads Program(RTBR). That yearly expense is paid for through the road infrastructure fee (about $670,000) and through capital funds. The roadways chosen by the City for FY 15 have a total cost of just over$2,000,000 in MFT ($250,000), City-wide Capital ($600,000), Sewer($340,000) and Water($845,000). The MFT budget and the City-wide Capital budget pay for storm-sewer, curb, and roadway rehab, the sewer budget pays only for sewer rehab, and the water budget pays only for water rehab items. While the City could pare down it's RTBR program to meet available revenues, we have identified that the City's overall roadway system(pavement only, no sewer and water utilities)would need an initial investment of over$17 million in the next five years, and then $2 million per year thereafter to maintain the same City-wide roadway rating as we currently have. Any value less than that means the roadway system will continue to deteriorate, including the $1 million we've currently identified as the amount we can afford to spend. Further, the City Council identified that it would be unacceptable to pave a roadway without taking the opportunity to fix the water and sewer utilities below the roadway. Thus, the sewer and water funds have money related to the RTBR program that is above and beyond our$1 in expense target. With those figures in mind, the expenses in the MFT fund($250,000) and the City-wide Capital ($600,000) can be considered under our$lm RTBR umbrella. That leaves us with a remaining commitment of$150,000. For ease of discussion, let's put this remaining money towards our sewer expenses of$340,000. This means our $lm annual budget is eaten up by MFT, City-wide capital, and a portion of the sewer budget, leaving a portion of the sewer budget ($190,000) and the entire water budget($845,000)unfunded for a total unfunded liability of$1.035 million. For comparison purposes, the water infrastructure fee, when it was $8.25 per month, generated $670,000 per year. The total annual revenue generated by water rates in the City is $1.9 million. While FY 13 numbers have not been finalized, we do anticipate the year-end numbers to end up better than the approved budget. It would be my recommendation to take the surplus in the water fund in FY 13 and use it to fund a portion of the unfunded water fund RTBR expenses. The remainder of the unfunded items would have to be made up with the ability for limited cost-cuts and a long-term water rate increase. Our intentions are to begin analysis and design of those improvements in early fall 2013. We also intend to begin the design of the roadway improvements in the fall of 2013. This Irrevocable Letter of Credit shall remain in effect until October 19, 2002, without regard to any default in payment of money owed to the issuer by our customer and without regard to other claims which the Issuer may have against our customer, and in no event shall terminate without notice as specified above. LOFTUS AND ILDEFONSA LOFTUS, OWNERS OF RECORD NOW WINDHAM DEVELOPMENT CO, INC., OWNER OF RECORD AND S & K DEVELOPMENT, L.L.C., DEVELOPER FOR LOT 4 OF PRAIRIE GARDEN SUBDIVISION WHEREAS, WINDHAM DEVELOPMENT CO, INC., an Illinois Corporation is the OWNER of certain real property within the United City of Yorkville, Kendall County, Illinois commonly known as LOT 4 OF PRAIRIE GARDEN SUBDIVISION; and WHEREAS, S & K DEVELOPMENT, LLC, is the DEVELOPER of said real estate; and WHEREAS, said real estate is the subject matter of a certain ANNEXATION AND PLANNED UNIT DEVELOPMENT AGREEMENT BETWEEN THE UNITED CITY OF YORKVILLE AND BARRY J. NILES, DEVELOPER, AND ROBERT M. LOFTUS AND ILDEFONSA LOFTUS, OWNERS OF RECORD (PRAIRIE GARDEN SUBDIVISION), as amended; and WHEREAS, the OWNER and DEVELOPER have requested an amendment to the Annexation and Planned Unit Development Agreement executed on July 7, 2000 and amended on August 23 , 2001 to permit the subdivision of Lot 4 in accordance with a Plat of Resubdivision attached to the Second Amendment and incorporated herein by reference; and WHEREAS, a Public Hearing was held before the City Council of the United City of Yorkville, which unanimously approved the requested change in the Annexation and Planned Unit Development Agreement; and WHEREAS, the Second Amendment to Annexation and Planned Unit Development Agreement shall only affect Lot 4; and WHEREAS, it is in the best interest of the City that the Second Amendment to Annexation and Planned Unit Development Agreement be approved; and WHEREAS, said Second Amendment to Annexation and Planned Unit Development Agreement has been drafted and has been considered by the City Council; and WHEREAS, the legal owners of record of the territory which is the subject of said Agreement are ready, willing and able to enter into said Agreement and to perform the obligations as required hereunder; and WHEREAS, the statutory procedures provided in 65 ILCS 5/11 -15 . 1 - 1 , as amended, for the execution of said Second Amendment to Annexation and Planned Unit Development Agreement have been fully complied with. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, AS FOLLOWS : SECTION 1 : That the Mayor and City Clerk are herewith authorized and directed to execute, on behalf of the City, the Second Amendment to Annexation and Planned Unit Development Agreement, SECTION 2: Subject to final approval of engineering by the City Engineer, the FINAL PLAT OF SUBDIVISION PRAIRIE GARDEN RESUBDIVISION OF LOT 4 is approved and the Mayor and City Clerk and other required City officials are authorized and directed to execute said Plat, SECTION 3 : That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. NOW THEREFORE, upon motion duly made, seconded, and approved by a majority of those voting, the following Second Amendment is made to the Annexation and Planned Unit Development Agreement of Prairie Gardens Subdivision: 1 ) INCORPORATION OF RECITALS : The above contained recitals are an integral part of this Agreement and hereby adopt those recitals as part of this Agreement. 2) AUTHORIZATION OF AMENDMENT: WINDHAM DEVELOPMENT CO., INC ., and S & K DEVELOPMENT, LLC, warrant that they have full and express authority to enter into this Amendment to the original Annexation and Planned Unit Development Agreement. 3) That, upon approval of this Second Amendment to Annexation and Planned Unit Development Agreement, OWNER and DEVELOPER, their successors and assigns, shall be permitted to subdivide and develop Lot 4 in Prairie Gardens Subdivision in accordance with the Final Plat of Resubdivision, attached hereto and marked as Exhibit "A " 4) The parties acknowledges that it is the intention of the DEVELOPER and OWNER, and future developers, to divide each of the lots and the commercial buildings to be constructed thereon into separate units to accommodate individual ownership of each of the commercial units in the buildings. The parties acknowledge and agree that no further or additional subdivision plat shall be required in order to comply with the requirements of the Illinois Plat Act and ackmowledge and agree that the subdivision has or will be constructed and developed in accordance with the Illinois Plat Act, thus permitting the recording of separate deeds of ownership to each of the individual commercial units without further subdivision plat. 5) The various parts, sections, and clauses of this Agreement are hereby declared to be severable. If any part, sentence, paragraph, section, or clause is adjudged unconstitutional or invalid by a Court of competent ,jurisdiction, the remainder of the Agreement shall not be affected thereby. 6) Any prior Agreement between the parties or parts thereof in conflict with the provisions of this Agreement are null and void as to the extent of such conflict.
