The minutes from the last meeting (November 29, 2012) were approved as submitted. PC201304 and PC201305: Priority Health Requesting Annexation and Rezoning: Dan Kramer said they have submitted the annexation plat which has been reviewed by Brad Sanderson of EEI. There were minor changes on signature block language and those have been addressed. The property is contiguous on all four sides to the city and it seemed to him that B2 made the most sense (given the area around it). At this point, until they can establish the IDOT cut and utility issues, they thought it was wise to divorce the annexation and zoning from the actual site plan. There are contractual obligations with Castle Bank that still owns the property that they've got to get their due diligence and annexation completed before they close with them. When that is completed, they will return to the City with the site application. There is a `mock-up' of what the building would look like; in all likelihood, a single-user building—Priority Health—without additional user space. Ms.Noble commented that the City Attorney had reviewed the annexation agreement. It was a grill-plate agreement and he made some significant changes and language not in substance. She asked Attorney Kramer if he had any problems with that. He stated he did not receive the marked up version, and Ms.Noble said she would email it to his office. Ms.Noble confirmed with Attorney Kramer that they were not looking for any concessions as far as variances such as setbacks or sales tax since it is all service-based. The only other issue Attorney Kramer would like to look at—in a future meeting—was utilities along with the annexation and zoning. Ms.Noble agreed. The Plan Commission meeting will take place July 10 public meeting. I have also reviewed the draft First Amendment to the Annexation Agreement of the Yorkville Farms Development and the United City of Yorkville (Prestwick of Yorkville Subdivision) date stamped received July 5, 2013 and prepared by John F. Philipchuck, attorney, of Dommermuth, Cobine, West, Gensler, Philipchuck, Corrigan and Bernhard, Ltd. regarding the Prestwick of Yorkville development generally located in the southwest quadrant of Rte. 126 and Ashley Road. Based upon my review and of other city and local agency staff members of these plans and documents, I have compiled the following comments: General Comments: • The property is currently zoned R-2 One-Family Residence District which has the following permitted uses per Section 10-6C-1, 10-6B-1 and 10-6A-1 of the City of Yorkville Zoning Ordinance: • Single-family detached dwellings • Accessory Uses • Off-Street Parking Facilities • Schools - public, private or denominational, elementary and high schools including playgrounds, garages for school buses and athletic fields auxiliary thereto. • Signs It is staff's opinion that the proposed school and accessory uses are out-right permitted in the R-2 zoning district. Additional details regarding the placement of the accessory uses and size/dimensions will be required. • The required minimum lot area for the R-2 One-Family Residence District is as follows: • Detached residential —minimum 12,000 square feet lot area and minimum 100 ft width at building line. Complies • Non-residential — principal uses of buildings as permitted shall have a minimum two (2) acre area. Complies • Yard Area requirements for the R-2 One-Family Residence District are as follows: o Front Yard: Thirty feet(30')minimum setback. Complies • Side Yard: Ten feet (10') minimum setback or ten percent (10%), whichever is greater. • Corner Side Yard: Thirty feet(30') minimum setback. Complies • Rear Yard: Forty feet (40') minimum setback. • Maximum Lot Coverage for the R-2 One-Family Residence District is thirty percent (30%)which includes buildings or structures and accessory buildings. • Maximum Building Height requirements for the R-2 One-Family Residence District are as follows: • On-Family Detached Dwellings: Thirty feet (30') and not more than 2.5 stories, whichever is less. • Other Non-Residential permitted buildings and structures shall not exceed thirty five feet (35') and not more than three (3) stories in height. Parapet walls, chimneys' cooling towers, stacks and necessary mechanical appurtenances may be erected over and above the maximum height of thirty five feet (35') provided they are constructed in accordance with all other regulations. Final Plat of Subdivision Comments: • For clarification purposes, staff suggests providing a list or exhibit illustrating the number and/or location of the lots that will be lost as part of the proposed Final Plat. • Staff understands that this Final Plat review is strictly for the lot related to the proposed new school property. A separate Final Plat of Subdivision will be submitted for the Unit 2 of the Prestwick of Yorkville development. • Would the developer be amenable to sing Mustang Way for the entire length of the street rather than bifurcating the street into two (2) names, Mustang Way and Whitekirk Lane? It is understood that Whitekirk Lane was approved and platted in the existing Unit 1 Final Plat,but have suggested this change for ease of use. • Additional comments regarding the Final Plat of Subdivision will be provided by the City's engineering consultant, Engineering Enterprises, Inc. under a separate memorandum. Architectural Review & Shmage Comments: • Color elevations and/or renderings which identify material and styling proposed of school and accessory buildings. Staff suggests providing a material sample board. • Rooftop equipment plan which illustrates the location of all proposed mechanical equipment is required. • A digital monument signage is illustrated on sheet A1.0 dated 6/25/13 prepared by Norris Architects, Inc. If building mounted/wall signage is proposed, it should also be illustrated on the building elevations. A separate signage plan should be submitted with dimensions, illumination and materials for review. • Signage should also be indicated on a separate landscape plan. Amended Annexation Agreement Comments: • Please revised the 2nd Whereas on page 1 of the First Amendment to the Annexation Agreement of Yorkville Farms Development ("Amended Annexation Agreement") to read as follows: "Whereas, on April 26, 2005, the City annexed and zoned the Property in an R-2 Single Family Residence District in accordance with the terms...." • Revise to add the following phrase to the end of the 7th Whereas on page 1 of the Amended Annexation Agreement so that it reads as follows: "Whereas the OWNER/DEVELOPER desires to amend the AGREEMENT to provide for a re- subdivision of Lot 358 for a private high school; amend the donations and contributions; and seek other exceptions to the Zoning Ordinance." • Revise 5th Whereas on page of the Amended Annexation Agreement to read as follows: "Whereas, pursuant to due notice and publication in the manner provided by law, the Plan Commission of the CITY have had such public hearing and have taken all further action required by the provisions of 65 ILCS 5/11-15-1.3 (2002) and the ordinances of the CITY relating to the procedure for authorization, approval and execution of the subdivision of Lot 358 by the CITY." • Revise Paragraph 2C on page 3 to read as follows: "The City shall approve the revised final plat of subdivision of Lot 358 in Prestwick of Yorkville, Unit 1, prepared by HR Green dated July 2, 2013, attached hereto as Exhibit B, and approves the revised improvement plans attached hereto as Exhibit D." o Note this paragraph will have to be revised based on the final version (i.e., revision date) of the approved Final Plat. • Paragraph 3B on page 3 will need further discussion regarding timing of the Rte 126 and Ashley Road improvements. The City may want to include clauses in the agreement to further define. • Paragraph 3C on page 3 with regards to reduced land-cash fee value, this will have to be preliminarily reviewed by Park Board with a recommendation forwarded to the Plan Commission. According to the Land Cash Ordinance (Ord. 1996-3 as amended), the developer is entitled to petition for a reduced land-cash fee by submitting an appraisal showing the fair-market value of such improved land in the area of development. The final determination of the "fair market value"per acre of improved land shall be made by the City Council based on such information submitted by the developer and from other sources as may be submitted to the City Council by affected parties. • Revise paragraph C4 on page 3 should be revised to include the following ending phrase "...upon acceptance of the path." • Paragraph 4 on page 3 should include a reference to the security needed for the proposed high school improvements, including roadways. • Paragraph 5 on page 3 should replace the phrase "this AMENDMENT" with "the AGREEMENT'. • Paragraph 6 on page 3 should be revised to read as follows: "Notwithstanding the provisions of the AGREEMENT the fees due and owing to the CITYfor those fees and amounts shall be set forth in the revised Exhibit E attached hereto and made a part of this AMENDMENT." o A new paragraph shall be inserted which states "The OWNER acknowledges that the donations contained in this Agreement and City Code are made voluntarily by the OWNER, and the Owner hereby waives for itself and its successors and assigns the right to contest at any time in the future the validity or the amount of the donations. " • Paragraph 7 on the bottom on page 3 should be stricken in its entirety, as non-home rule communities can only enter into a total 20 year agreement. The original 20 year time frame of the initial Annexation Agreement shall apply, meaning the agreement is set to expire in April 2025. • Regarding paragraph 8 on top of page 4, the contact information for the City Attorney is as follows: Kathleen Field Orr & Associates, 53 West Jackson Boulevard, Suite 964, Chicago,Illinois 60604. • Paragraph 9 on page 4 of the Amended Agreement shall be revised to read as follows: "The term of this AGREEMENT shall be twenty (20)years. In the event that a permit for construction is issued within said twenty-year period all of the terms of this AGREEMENT for that permit shall remain enforceable despite said time limitation, unless modified by written agreement of the CITY and OWNERIDEVELOPER." • Paragraph 10 on page 4 and 5 of the Amended Agreement, replace the words "additional" with "accessory" and "ancillary" to "auxiliary" to remain consistent with Section 10-6C- 1 of the Zoning Ordinance regarding permitted uses. • Staff suggests adding an encapsulating introductory paragraph of the proposed permitted and accessory uses as follows: "The proposed accessory uses and improvements may include a retail school store; an equestrian arena and stable; cellular telephone tower; wind turbine; electronic scoreboard; public address system, lighting and concession/restrooms for athletic fields; outdoor storage of farm equipment, grain bins and greenhouses; street parking along Mustang Way and delayed construction of on-site parking; school bus parking and garage; an off-premise electronic school identification sign; and building height exceptions." • Additional detail needed with regards to location, elevation and placement of retail store. • Additional detail needed with regards to size and location of equestrian/riding arena; temporary stabling. • Additional details needed with regards to location and general elevation of the cell telephone tower and wind turbine/wind mill. • Regarding electronic scoreboard; permanent and temporary sponsor signage, etc... additional detail and/or exhibit needed regarding location, size, type, and decibel level (outdoor public address system). • Additional detail needed regarding location, size and duration of outdoor parking and storage of farming machinery; grain bins; greenhouses. • Additional detail needed regarding placement and size of the concession/restroom buildings serving outdoor athletic venues. • Additional detail of the proposed perpendicular parking and specification as to the intention of Mustang Way being a public or private street as it relates to the future maintenance. • Additional details regarding the location of the school bus parking and garage on the property. • The 1St paragraph under Paragraph 11 on page 5 of the Amended Agreement should remove the words "only as needed" and replace with"as determined by the City". o Additional information needed regarding the total number of students and employees at full capacity versus the projected population of the currently approved development agreement as a residential land use. • The 2nd paragraph under Paragraph 11 on page 5 of the Amended Agreement which references the perpendicular parking on Mustang Way should be removed as it is covered in paragraph 10 above. • Paragraph 12, page 5 of the Amended Agreement, it is noted that the development name will be changes to Ashley Pointe. All future references to the project will reflect this name change. o Is the name change for platting purposes for marketing? The City has had subdivisions marketed under different names from the plat, and it has worked well. If this is something the developer is amenable to, staff would prefer to continue to use the name "Prestwick of Yorkville" on plans and agreements for tracking purposes. • Paragraph 14 on page 5 of the Amended Agreement should be revised to include the following language at the end"at a location approved by the City." • More detail is required for the proposed off-site free-standing monument sign as proposed in Paragraph 15 at the bottom of page 5. • Exhibit E—Ashley Point Fees Per Unit • Water Meter Cost for detached units is proposed as $250. The current fee is actually$435.00 which is the City's at cost rate and cannot be reduced. • Development Fees — staff acknowledges the partial front funding of the Library and Bristol-Kendall Fire District development fees. • The remaining 104 lots in Unit 1 will pay$500 each at building permit for BKFD and$250.00 each at building permit for Library. • The future residential lots in Unit 2 will pay the full cost for BKFD ($1,000 per lot) and Library($500 per lot) at time of building permit. o Road Contribution Fees — Staff acknowledges the future road improvements the developer will make to the intersections of Penman Road/Rte. 126, Ashley Road/Rte. 126 and Ashley Road; however the Road Contribution Fee established via Ordinance 2006-11 is a policy set forth for the collection of transportation development fees for Kendall County Highways. ■ The fee guidelines in the ordinance states "As a rule, all residential developments would be subject to the collection of fees on behalf of the County, even if the development does not have frontage on a County Highway. This is because the average trip from nearly every development in Yorkville involves travel on at least one County Highway. And each new residential subdivision will have an incremental impact on the need for a capacity improvement." Public Works & YBSD Comments: • Water main — Will the proposed water main be a public or private utility? If the water main is to be public, staff asks that the main that is tapped off of Callander Trail be considered temporary and the permanent water main be located along the open space and tie into the existing system just south of Prestwick Lane at Whitekirk Lane. • Sanitary Sewer—What is the proposed enrollment of the school with staff included? The total P.E. needs to be established to make certain the current lift station is sufficient to meet all future needs. • It would be advisable, but not required that the landowner annex to the Yorkville Bristol Sanitary District (YBSD) so the District and the City can expand together. • YBSD Annexation and IPF fees would apply, if annexation is sought, $4,228/acre. • If the land owner's septic system fails in the future and a sanitary sewer is within 100 feet of their property line, they would be required to connect and annex at that time. Engineering Enterprises, Inc. i July 23, 2013 Ms. Krysti Barksdale-Noble Community Development Director United City of Yorkville 800 Game Farm Road Yorkville, IL 60560 Re: Yorkville Christian School Final Engineering Plan Review No. 1 United City of Yorkville, Kendall County, Illinois Dear Krysti: We are in receipt of the following documents prepared for Yorkville Christian School for the above referenced project: • Final Engineering Plans prepared by HR Green, stamped with a received date of July 5, 2013. • Final Plat of Subdivision Yorkville Christian School Subdivision prepared by HR Green, dated July 2, 2013 Our review of these plans is to generally determine their compliance with local ordinances and whether the improvements will conform to existing local systems and equipment. This review and our comments do not relieve the designer from his duties to conform to all required codes, regulations, and acceptable standards of engineering practice. Engineering Enterprises, Inc.'s review is not intended as an in-depth quality assurance review, we cannot and do not assume responsibility for design errors or omissions in the plans. As such, we offer the following comments: There are several items that will be required before we can recommend Final Engineering approval. Items that have yet to be submitted for review include: • Revised stormwater management report for the new land use; • Storm sewer sizing calculations; • Engineers Opinion of Probable Construction Cost for public improvements; • Revised traffic study; The following comments are based on a partial review of the plans. The cover sheet shall be dated and signed and sealed by a professional engineer. 2. The street name north of the school access drive is identified on the engineering plans as Mustang Way but identified on the plat as Whitekirk Lane. The street name shall be changed to Whitekirk Lane to match the plat. 3. The I.D.O.T. Standard Detail referenced in Note 12 of the specifications. Curb Ramps shall be changed to 424001-07 and the reference to a "Type "A"" ramp removed from the note since the detail no longer references a ramp type. 4. We recommend utility key note call outs be removed from the overall site plan and added to a utility sheet(s) and the plan and profile sheets. 5. If proposed utilities are shown on the site plan, existing utilities shall also be shown on the site plan. In addition, distinct line types for existing, proposed and future utilities should be included on the plans. 6. The key note tag labels in the legend as shown on the Overall Site Plan shall be reviewed and corrected for the proper utility. 7. Separate erosion control, utility, grading, landscape and lighting plans shall be prepared in addition to plan and profile sheets for the roadway and sanitary sewer installation. Typical Street Cross Sections/Specifications 8. There are a number of inconsistencies between the plans, specifications and the cross sections. They should be revised accordingly. 9. Placement of drainage and utility easements adjacent to the ROW for each roadway section shall be reviewed and revised accordingly and identified properly on the engineering plans and final plat. 10. Utilities are shown in the typical sections that do not appear on the plan views. The typical sections or plans are to be revised accordingly. 11. A typical section for Whitekirk Lane shall be added to the plans. Water Main 12. We recommend a reconfiguration of the proposed water system to serve the school. The water service shall be looped around the building and connected to the main at two locations. One connection to the east at Whitekirk Land and the other to the west at Pestwick/Mustang Way. We do not agree with the water service being installed between homes off of Callander Trail as proposed. Attached is a sketch of the suggested routing. Ms. Krysti Barksdale-Noble July 23, 2013 Page 3 of 4 13. A separate domestic water service is to be provided to the school and a fire department (Siamese) connection shown at the building. In addition a fire hydrant is to be within a certain distance from the siamese connection as specified by the fire department. 14. All public water mains are to be located within public ROW or in easements. Sanitary Sewer 15. IEPA Division of Water Pollution Control permit applications shall be submitted for review and approval since the proposed sanitary sewer discharge is anticipated to be in excess of 1,500 GPD 16. Engineering plans must be submitted to the Yorkville-Bristol Sanitary District for review. Comments are to be forwarded to us upon receipt. 17. We question the need to extend the sanitary sewer service past the last connection with the building service. Is this necessary for future improvements or can this last segment be deleted. Drainage & Grading 18. The extent of the proposed grading shall be clarified. Currently proposed contours are running off of the sheet. All proposed grading shall be included on a plan sheet. Existing, proposed and or future contours/grades shall be distinguished from each other on the plans. 19. All accessible routes and accessible parking areas shall be check for conformance to ADA standards. 20. We will require an updated stormwater management report including pipe sizing calculations. Considerations must also be given during interim conditions to maintain positive drainage for all areas designated future development. 21. It is also our understanding that not all of the outlet storm sewer for Unit 1 has been constructed. The outlet storm sewer should be included with the school improvements. FINAL PLAT 22. On Lot 358, a number shall be added to the "See Note xx". 23. Easements will be required through the lot for the public water main and all storm sewer serving off-site areas. Alignments will be finalized as part of the final engineering submittal. 24. Ten foot Public Utility and Drainage Easements are to be provided adjacent to both sides of the road ROW for Whitekirk Lane and Mustang Way. 25. A provision for Pedestrian and Bike Trail Easement in included however, there are no easements shown on the plat. Either the provision is to be removed or easements are to be shown. A more complete review will be performed upon the submittal of all required documents. Planned Unit Development (PUD) Agreements are unique and a complex form of zoning which differs from the conventional approval process allowing for flexibility in the design and land use of larger scale developments. Such approvals require agreements that are contractual in nature, therefore an amendment must be sought when a change, minor or substantial, in the original terms of the annexation or Planned Unit Development (PUD) Agreement occurs. This packet explains the process to successfully submit and complete an Application to Amend an Annexation or Planned Unit Development Agreement. It includes a detailed description of the process and the actual application itself (Pages 6 to 9). Please type the requied information in the application on your computer. The application will need to be printed and signed by the applicant. The only item that needs to be submitted to the City from this packet is the application. The rest of the packet is to help guide you through the process unto completion. Economic Development Committee meets at 7:00 p.m. on the 1st Tuesday of each month in the Yorkville City Hall Conference Room. This session is to discuss and consider recommendations prior to full City Council considerations and provide informal feedback. The Economic Development Committee will submit its recommendation to City Council. City Council Applicant will attend the City Council meeting where the recommendation of the proposed amendment will be considered. The City Council meets on the 2nd and 4th Tuesdays of the month at 7:OOpm. City Council will make the final approval of the amendment. Dormant Apptications The Community Development Director shall determine if an application meets or fails to meet the requirements stated above. If the Director determines that the application is incomplete it will become dormant under these circumstances: • The applicant has been notified of such deficiencies and has not responded or provided a time line for completing the application within ninety (90) days from the time of notification. • The applicant has not responded in writing to a request for information or documentation from the initial plan commission review within six (6) months from the date of that request. • The applicant has not responded to a request for legal or engineering deposit replenishment for city incurred costs and fees within ninety (90) days from the date of the request. If the Community Development Director has sent the required notice and the applicant has not withdrawn their application or brought it into compliance, then the director shall terminate the application. After termination, the application shall not be reconsidered except after the filing of a completely new application. Withdrawal or termination of an application shall not affect the applicant's responsibility for payment of any costs and fees, or any other outstanding debt owed to the city. WITNESSETH WHEREAS, OWNER owns fee simple title to the real property which is legally described in Exhibit "A" attached hereto, consisting of approximately 190 acres, more or Less (hereinafter "PROPERTY"); WHEREAS, on April 26, 2005, the CITY annexed the PROPERTY as an R-2 Single Family Residence District in accordance with the terms of the "Annexation Agreement of Yorkville Farms Development and The United City of Yorkville" ("AGREEMENT"); WHEREAS, the original owner and developer under the Agreement was unable to complete the development of the PROPERTY; WHEREAS, the Final Plat for Unit 1 of the Property was recorded and the improvements required under Unit I were substantially completed; WHEREAS, the Final Plat for Unit 2 was not recorded; WHEREAS, the OWNER/DEVELOPER subsequently acquired the PROPERTY, described in Exhibit "A" to the AMENDMENT; WHEREAS, the OWNER/DEVELOPER desires to amend the AGREEMENT to provide for a re-subdivision of Lot 358 for a private high school; WHEREAS, R-2 Zoning under the CITY' s ordinances allows for a school as a permitted use; 156551 /1 WHEREAS, all notices required by law relating to this AMENDMENT have been given to the persons or entities entitled thereto, pursuant to the applicable provisions of the Illinois Compiled Statues; WHEREAS, the Corporate Authorities of the CITY have duly fixed the time for a public hearing on this AMENDMENT and pursuant to legal notice have held such hearing thereon all as required by the provisions of the Illinois Compiled Statues; WHEREAS, the Corporate Authorities have duly held all public hearings relating to AMENDMENT all as required by the provisions of the CITY' s Ordinances and Illinois Compiled Statues; WHEREAS, in accordance with the powers granted to the CITY by the provisions of 65 ILCS 5/11 - 15. 1 -1 through 15. 1 -5 (2002), inclusive, relating to annexation agreements, the parties hereto wish to enter into this binding AMENDMENT of the AGREEMENT and to provide for various other matters related directly or indirectly to amending the annexation of the PROPERTY, as authorized by, the provisions of said statutes; WHEREAS, pursuant to due notice and publication in the manner provided by law, the appropriate zoning authorities of the CITY have had such public hearing and have taken all further action required by the provisions of 65 ILCS 5/11 - 15- 1 .3 (2002) and the ordinances of the CITY relating to the procedure for authorization, approval and execution of this AMENDMENT by the CITY. NOW, THEREFORE, in consideration of the mutual covenants, agreements and conditions herein contained, and by authority of and in accordance with the aforesaid statutes of the State of Illinois, the parties agree as follows: 1 . AMENDMENT TO AGREEMENT. Preliminary Plans and Final Plats allow the City Staff and local government to review how land will be developed and if it is ideal for that location within the city. This application is used to submit new preliminary plans and final plats but may also be used to ammend either of those documents. This packet explains the process to successfully submit and complete an Application for a Preliminary Plan and Final Plat. It includes a detailed description of the process and the actual application itself(Pages 6 to 8). Please type the required information in the application on your computer. The application will need to be printed and signed by the applicant. The only item that needs to be submitted from this packet is the application. (See attached Fee Sheet on page 6) ® 1 CD containing an electronic copy (pdf) of each of the signed application (complete with ex- hibits), proposed drawings, location snap, and site plan. • Subdivision Plats: 15 copies depicting the originally platted lots, the proposed new lots, the proposed modifications and adjustments. 5 of the copies must be full size while the remaining 10 must be 11 " by 17' . Within one (1 ) week of submittal, the Community Development Department will determine if the aplication is complete or if additional information is needed. These materials must be submitted a minimum of 45 days prior to the targeted Plan Commission meeting. An incomplete submittal could delay the scheduling of the project. Applicant is responsible for malting submittals to other review agencies such as Kendall County, Illinois Department of Transportation, Illinois Department of Natural Resources, U.S. Army Corps of Engineers, etc., to allow timely review by the City. Applicant will be responsible for payment of recording fees and public hearing costs, including written transcripts of the public hearing and outside consultant costs (i.e. legal review, land planner, zoning coordinator, environmental, etc.). The applicant will be required to establish a deposit account with the city to cover these fees. The Petitioner Deposit Account/Acknowledgement of Financial Responsibility form is attached to this document and must be submitted with the application. ' 0 Plan Council Applicant must present the proposed plan to the Plan Council. The Plan Council meets on the 2nd and 4th Thursday of the month. The members of the Council include the Community Development Director, City Engineer, the Building Department Official, the Public Works Director, the Director of Parks and Recreation, a Fire Department Representative, and a Police Department Representative. Upon recommendation by the Plan Council, applicant will move forward to the Plan Commission hearing. Plan Commission Applicant will attend a public hearing conducted by the Plan Commission. The Plan Commission meets on the 2nd Wednesday of the Month at 7:OOpm. Notice will be placed in the Kendall County Record by the United City of Yorkville. The Plan Commission will conduct a public hearing on the request, tape public comments, discuss the request, and make a recommendation to City Council. 3 Application • Step Economic Development Committee Applicant must present the proposed plan to the Economic Development Committee. Economic Development Committee meets at 7:00 p.m. on the 1st Tuesday of each month. This session is to discuss and consider recommendations prior to full City Council considerations and provide informal feedback The Economic Development Committee will submit its recommendation to Cit Council. City Council Applicant must present the proposed plan to the City Council. The City Council meets the 2nd and 4th Tuesdays of every month at 7:00 p.m. in the Yorkville City Hall Council Chambers. The proposal will be discussed at the City Council hearing where formal voting takes place. City Council will make the final approval of the plan. Final Plat Recording Once the final plat is approved by the City Council and all required documents, bonds, and letters of credit are submitted to the city, the final plat must be recorded with Kendall County. Submit the final plat mylar to the Deputy Clerk for signatures. When all city signatures are in place, the developer or his surveyor may take the mylar to the Kendall County Clerk for their signature. The next step is to have six (6) paper prints made and return to the Kendall County Recorder's office for recording. Kendall County requires the mylar and 4 paper copies. The City of Yorkville requires that you submit 2 recorded paper copies to the Deputy Cleric. Dormant • • • The Community Development Director shall determine if an application meets or fails to meet the requirements stated above. If the Director determines that the application is incomplete it will become dormant under these circumstances: The applicant has been notified of such deficiencies and has not responded or provided a time line for completing the application within ninety (90) days from the time of notification. The applicant has not responded in writing to a request for information or documentation from the initial plan commission review within six (6) months from the date of that request. The applicant has not responded to a request for legal or engineering deposit replenishment for city incurred costs and fees within ninety (90) days from the date of the request. If the Community Development Director has sent the required notice and the applicant has not withdrawn their application or brought it into compliance, then the director shall terminate the application. After termination, the application shall not be reconsidered except after the filing of a completely new application. Withdrawal or termination of an application shall not affect the applicant's responsibility for payment of any costs and fees, or any other outstanding debt owed to the city. The balance of any funds deposited with the city that is not needed to pay for costs and fees shall be returned to the applicant. Typical requests requiring the establishment of a Petitioner Deposit Account Fund include, but are not limited to, plan review of development approvals/engineering permits. In the event that a deposit account is not immediately replenished, review by the administrative staff, consultants, boards and commissions - may be suspended until the account is fully replenished. If additional funds remain in the deposit account at the completion of the project, the city will refund the balance to the Financially Responsible Party.
