Public Safety Minutes 2013 07-03-13 APPROVED 8/1/13 UNITED CITY OF YORKVILLE PUBLIC SAFETY COMMITTEE Wednesday, July 3, 2013, 6:30pm City Hall, Conference Room 800 Game Farm Road IN ATTENDANCE Committee Members: Chairman Carlo Colosimo Alderman Chris Funkhouser Alderman Larry Kot Absent: Alderman Rose Spears Other City Officials : City Administrator Bart Olson Chief of Police Rich Hart Deputy Chief Larry Hilt Deputy Chief Terry Klingel Administrative Intern Jeff Weckbach Other Guests: none Chairman Carlo Colosimo called the meeting to order at 6:30pm, quorum established. Citizen Comments: none Minutes for Correction/Approval: May 2, 2013 The minutes were approved as read on a unanimous voice vote. New Business: 1. PS 2013-17 Police Reports for April-June 2013 There was no discussion. 2. PS 2013-18 Request to Amend Liquor Code Regarding Beer Garden/Patio Licenses Mr. Olson reported there are 6 patio licenses, 3 on hold, one new application with another anticipated for a total of 11. He said there has been no issues with patio licenses regarding noise or enclosures. He said the City is looking at eliminating the enclosure requirements. Alderman Kot asked for clarification on patio licenses. If a business has a full liquor license, they can request a patio license as well—these are tied to their full license. No additional background checks are needed. Alderman Colosimo said he favors patio dining and thinks it helps increase business and attracts patrons. Mr. Funkhouser said he would like the enclosure restrictions removed unless the business is located on a high speed road and Alderman Kot concurred. Some type of barrier keeps patrons from spreading into parking lots and helps maintain safety. This item will move to the Council consent agenda. Page 1 of 3 3. PS 2013-19 Request to Purchase Three Vehicles Chief Hart said $90,000 was budgeted for vehicles and the purchase was $2,500 over that amount. He said there is $10,000 in the repair fund to cover the overage. Two SUV's and 1 car were purchased and a 4-wheel drive will be requested next year. He said only 3 squads are currently under 80,000 miles and a vehicle fell into disrepair today. No cars were purchased last year and at the current time, there are 21 vehicles and 1 motorcycle. Three vehicles will be purchased per year for the next 4-5 years. Chief Hart said 3 criteria are used to determine the purchase of a new vehicle: miles, repair cost and age. The white part of the new vehicles are wraps and can be replaced if damaged. It is part of the new color scheme. Action Graphics, a Yorkville company, provided the wraps. The committee recommended approval and this item moves to the Council consent agenda. Old Business: 1. PS 2013-08 Ordinance Adopting License Regulations for Pawnbrokers and Resale Dealers Alderman Kot suggested a change for the inspection clause to insure the items are properly entered in the Leads on Line and should be worded in such a way that it is the main purpose of the inspection. He said this is a compliance issue just like liquor compliance checks. Chairman Colosimo said he did not favor the inspection clause and would like a test done similar to liquor checks. Second, Alderman Kot would like the coins and bullion removed from the ordinance. Bart Olson said the current draft states these items are only exempted from the waiting period. The 7-day waiting period was deemed too long by Alderman Colosimo while the other two Aldermen approved the 7 days. The committee also discussed the video recording portion of the ordinance. Alderman Colosimo said he does not favor “warrantless” procedures and that the court system cannot be usurped. The general consensus was that video surveillance tapes should be held 30 days and Chief Hart said shop owners are generally cooperative about turning over tapes when necessary. It was suggested that the last sentence should be deleted in section 3-13-22. Mr. Olson recapped the changes to be made: 1.Inspection clause: make clear that purpose of inspections is to enforce compliance with Leads on Line 2.Coins, currency and bullion will be exempted from the ordinance 3.Section 3-13-22: Videotapes will be held for 30 days, but no unfettered police access Chairman Colosimo asked for a revised draft to be brought back for committee review before moving it to the Council meeting. The committee concurred. 2. PS 2013-13 On-Street Parking Regulations in Bristol Bay Notices were sent out and there were no negative comments. Jeff Weckbach called all residents for whom he had phone numbers and there were no objections. The committee approved and this item will be moved to the consent agenda. 3. PS 2013-14 On-Street Parking Regulations on Marketplace Drive Chief Hart said the parking problems are especially apparent in the mornings even with school not in session. The proposed restrictions will apply to both sides of the street due to the curve. The committee recommended approval of this proposal and it will move to the Council consent agenda. Page 2 of 3 Additional Business: Carlo Colosimo said there is still a parking problem on McHugh by Menards and the ballfield. There are now designated parking spaces and people are continuing to park where the road narrows. Chris inquired if the turn lane can be removed. Sight distance is also an issue for Hayden and it was also suggested to remove parking north of Hayden. Since baseball season is finished, it is not currently a problem and there was no further discussion at this time. Alderman Kot asked if there were any problems with the weather warning systems, given the recent bad weather. The systems are all working well according to the progress reports received and the City now has full coverage. Mr. Olson said complaints have been received from Bristol Bay residents about the lightning detector noise. This can be turned off when the parks are not in use. Mr. Kot said he had received a complaint that the lightning detector near the old police department/Riverfront Park has been malfunctioning. Public Works personnel are working on it according to Chief Hart. The Parks Department now oversees the lightning detectors. Weather warnings can be received on phones and they come through the National Weather Service or KenCom. The City has been promoting weather warning apps on the water bills. Alderman Funkhouser asked if the City does overlays with surrounding communities for bad weather notification—there is an area in Grande Reserve that overlaps with Oswego. Chief Hart said he receives complaints that the sirens are not audible within homes, however, the sirens are not meant for inside. Also, he receives complaints that there is no “all clear” notification. The National Weather Service now can trigger the sirens as well. Mr. Funkhouser also noted that the City answering system “hold” indicates to check the city newsletter. He noted there is no longer a newsletter. Mr. Kot also asked if foot patrols will be present on July 4th near the Big Band area. All police personnel will be on duty throughout the day. Chief Hart has received information there is a potential rioting concern following the Trayvon Martin murder trial in Florida. He said social media is instructing people to leave the cities and come to smaller towns. Alderman Kot cautioned about the handling of any news information that might be disseminated.
