Roll Call Roll call was taken and a quorum was established. Previous Meeting Minutes February 13, 2013 The minutes were unanimously approved on a voice vote following a motion by Baker and second by Crouch. Citizen's Comments None Public Hearings 1. PC 2013-05 Priority Health and Body Makeover, Inc.,petitioner has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting to annex and rezone land located in unincorporated Kendall County from the County's B-3 Highway Business District to the United City of Yorkville's B-2 General Business District. The real property consists of two (2) parcels totaling approximately 1.5 acres generally located immediately west of North Bridge Street (IL Route 47),just north of Walnut Street in Kendall County,Illinois. Page 1 of 3 A motion was made by Jones and seconded by Baker to open the Public Hearing. Voice vote approval and hearing began at 7:02pm. Chairman Lindblom swore in those who would speak. (See court reporter's transcript of hearing) The hearing ended at 7:07pm on a motion by Jones and second by Weaver. Voice vote approval. New Business: 1. PC 2013-05 (same as above Public Hearing) Discussion: Commissioner Jones asked what type of business is Priority Health. Mr. Weihler said his business performs chiropractic, massage therapy and rehab and has been in the area for 5 years. Ms. Barksdale-Noble said the petitioner has completed the standards already and these will officially be entered into the records (see attached). Ms. Dubajic commented that she has known Mr. Weihler for a long time and this is now their third location in Yorkville. She said it was good to see a success story in Yorkville. This property has been vacant for awhile and Mr. Crouch commented that having a professional building in this area was an appropriate use. Motion: Charles Kraupner made a motion as follows: In consideration of testimony presented during a Public Hearing on July 10, 2013 and discussions conducted at that meeting, the Plan Commission recommends approval to the City Council of a request rezoning of the subject property upon annexation to within the B-2 General Business District, as proposed by Priority Health and Body Makeover, Inc., as submitted in an application date stamped received May 10, 2013, subject to any conditions or comments. Commissioner Jones seconded the motion. Discussion: Mr. Baker commented that B-2 is a good fit, however, he suggested that B-3 would make the property more marketable in the future. Attorney Kramer said normally B-3 is the zoning for property on a state highway, however, the properties south of Jewel are B-2 also. Also, the highway conditions will not be conducive for in/out driveways. Mr. Crouch said the zoning will be appropriate with the surrounding businesses. Roll call vote: Crouch-yes, Kraupner-yes, Winninger-yes, Jones-yes, Baker-yes, Weaver-yes, Lindblom-yes. Passed 7-0 Old Business 1. City Council Action Updates a. PC 2012-11 Kendall Crossing—Final Plat Ms. Barksdale-Noble said the Final Plat was approved and no construction is underway. No further action is needed. My address is 1107A South Bridge 23 Street , Yorkville , Illinois , and I am an attorney 24 licensed to practice law in the state of Illinois Depo • Court Reporting Service ( 630 ) 983 - 0030 i I 5 1 and I represent the petitioner . 2 Stuart is moving , he and his wife i 3 are the owners of the business , so if you have any I 4 questions in particular for him , tonight he is i 5 here . 6 This property for those of you that 7 have lived in Yorkville a long time is immediately 8 south of the Sunset Hotel on the west side of the 9 street on 47 , and frankly I think all of us are 10 surprised that has never developed over the years , 11 so it looks like we ' re going to get a nice end 12 user . 13 Right now their business is in the 14 old Thomas R . Cabot Drugs on 34 , so this will be a 15 new building that they will be the primary tenant ; 16 could possibly have an another small tenant , but 17 will likely be the sole occupant initially . 18 We have a picture - - even though 19 we ' re not here on site plan approval tonight - - of 20 what they plan on doing with the building . It I 21 would be a masonry or a dryvit , stucco - type 22 structure . 23 The thing I told Stuart that I 24 really liked about their artist ' s rendition of it Depo • Court Reporting Service ( 630 ) 983 - 0030 6 1 is being out there on the curb , you ' re going to 2 see not just the front of it as you drive by , but 3 you are going to see the northern exposure when 4 you are going southbound , and as you ' ll see , 5 they ' re not just front jacketing the building ; in i I 6 other words , you ' re going to see nice architecture i 7 all the way around , so I thought that was a real 8 plus . 9 We bifurcated our approach here with 10 the City in two parts . First of all , the 11 property , as you will see in the petition , is out 12 in the county still , it ' s never been annexed . 13 Back when I was city attorney , one i 14 of my jobs was to get all of the parcels going up 15 47 and 34 , and when Bob Davidson was mayor , I 16 think we brought 60 - some parcels in . This one we 17 could never talk the Horton family into doing it 18 frankly . 19 One of the difficulties was the City 20 didn ' t have a way to serve it with sewer and 21 water , and I suspect that was one of the factors 22 of why it hasn ' t developed for so long . 23 About two years ago when IDOT was 24 getting serious about the Route 47 plans , the then Depo • Court Reporting Service ( 630 ) 983 - 0030 7 1 city engineer came to us and said the City was 2 going to work with IDOT to bring sanitary sewer 3 across from the intersection of Walnut and 47 4 where there was a manhole deep enough to serve 5 that side of the street , and whenever they would 6 do the state project and had it opened up , that 7 was the time to run it . 8 So Stuart would love to start this 9 year , but as you see , IDOT is moving not all that 10 quickly with the project and - - 11 CHAIRMAN LINDBLOM : To say the least . 12 MR . KRAMER : I was being charitable . He 13 and his wife are buying the property . Right now 14 it ' s owned by Castle Bank and it is a contract 15 contingent on getting annexation and zoning with 16 the City , so we ' re asking in the first sight from 17 you here tonight to recommend the annexation as 18 B - 2 Business District to the City , so it ' s almost 19 a down zoning from the County B - 3 , and the other 20 part we ' re asking is that you give the rezoning 21 recommendation to the City Council to B - 2 . 22 The thing is about B - 2 you get a 23 nice localized business like this , won ' t be a 24 24 - hour McDonald ' s drive - through or anything , not Depo • Court Reporting Service ( 630 ) 983 - 0030 8 1 that those aren ' t good things , but that just 2 wouldn ' t be an appropriate place with the 3 residences immediately behind it , so we think 4 given the City ' s Comprehensive Plan , B - 2 makes 5 sense , certainly makes sense since it is 6 surrounded by the city to be annexed in , and then 7 we will have to come back once the sewer and water 8 plans are finally in order with the state and city 9 to actually show the site plan for it . 10 Actually that will be more of just a 11 building department staff matter , but we want you 12 to know why we weren ' t giving you full blown 13 engineering and so on at this time . 14 It sounds like the most difficult I 15 part the city has is working with the state , no 16 quarrel or anything , but there is an awful lot of 17 utilities in a short narrow space right next to 18 the right - of - way , so they have to weave the sewer 19 and water and - - primarily it ' s sanitary , there is 20 water kind of on the corners of the property , so 21 we are good with that , so it will be fully served 22 by city water and sewer as well . i 23 So we will be happy to answer any I 24 questions , but we would ask for a positive Depo • Court Reporting Service ( 630 ) 983 - 0030 I 9 1 recommendation , and we did tender our certified 2 mailings to everybody , Krysti , and publications 3 some time ago . 4 CHAIRMAN LINDBLOM : Okay . Countryside Parkway has operated as a medical office, professional office and other various office/business uses which were permitted and consistent with the B-2 General Business District objectives. While business districts are typically zoned for uses that generate sales tax revenue, banking operations are considered service-based uses and rarely provide local sales tax dollars. Therefore, there location within a business district is subject to the special use process to ensure it is the right fit within the district which strives to maintain a balance between sales tax generating and service-based uses. While there is an existing bank adjacent to the subject property on the east at 26 W. Countryside Parkway (Old Second Bank) which also has drive-through facilities, the petitioner is confident in the positioning of their new facility in this location. Countryside Parkway has operated as a medical office, professional office and other various office/business uses which were permitted and consistent with the B-2 General Business District objectives. While business districts are typically zoned for uses that generate sales tax revenue, banking operations are considered service-based uses and rarely provide local sales tax dollars. Therefore, there location within a business district is subject to the special use process to ensure it is the right fit within the district which strives to maintain a balance between sales tax generating and service-based uses. While there is an existing bank adjacent to the subject property on the east at 26 W. Countryside Parkway (Old Second Bank) which also has drive-through facilities, the petitioner is confident in the positioning of their new facility in this location. The site plan has been reviewed by the City's engineering consultant and drainage, utilities and ingress and egress to access roads have been or will be adequately met. Consideration of the application for Special Use and the appropriateness of the use will be based upon the standards for special use. Bulk Requirements Since the proposed rezoning request contemplates the future construction of a multi-family residential development, a detailed review of the R-4 General Residence District bulk regulations was conducted to analyze compliance with the proposed annexed property. The following R-4 bulk regulations will apply: • Yard Area requirements for the R-4 General Residence District are as follows: • Front Yard: Thirty feet(30')minimum setback. • Side Yard: Twelve feet(12')minimum setback or sixty percent(60%) of the building height, whichever is greater. • Corner Side Yard: Twenty feet(20')minimum setback. • Rear Yard: Forty feet(40')minimum setback. • Maximum Lot Coverage for the R-4 General Residence District is thirty percent (30%)which includes buildings or structures and accessory buildings. • Maximum Building Height requirements for the R-4 General Residence District are as follows: o Multi-family dwelling units shall have not more than six(6) stories or eighty feet(80'), whichever is lower. While no formal plan is proposed for the future redevelopment of the site, the Petitioner envisions a multifamily residence development on the property consistent with housing permitted within the R-4 District (i.e. duplexes, townhomes, condos or apartments). Based upon the density standards of the R-4 District and the size of the property, the following maximum unit number and dwelling types would be permitted: Dwelling Type Density Permitted Maximum Unit Number Permitted 4,500 square feet minimum lot Duplex area per dwelling (assuming a Max. 8 Dwelling Units 3 bedroom unit) 5,000 square feet minimum lot Townhome area per dwelling (assuming a Max. 7 Dwelling Units 4 bedroom unit) 4,000 square feet minimum lot Condo/Apartment area per dwelling (assuming a Max. 8 Dwelling Units 2 bedroom unit) 2 Section 10-6F-3 of the Yorkville Zoning Ordinance provides that the allowable density based upon the gross area shall not exceed eight(8)dwelling units per gross acre. Comprehensive Plan The City's Comprehensive Plan Update 2008 had designated this parcel as "Suburban Neighborhood" which is intended primarily for single-family detached residences," preserving the existing housing stock and creating new lower density environments." The gross density envisioned for the Suburban Neighborhood classification is indicated as about 1.5 dwelling units per acre to 2.25 dwelling units per acre. Other Code Compliance: Appearance Code - The proposed new buildings will be subject to the City's Appearance Code standards. o Masonry products shall be incorporated on the front fagade of at least seventy five percent (75%) of the total buildings and shall incorporate a minimum of fifty percent(50%)premium siding material on the front fagade. Off-Street Parking - Off-Street Parking (Title 10 Chapter 11) regulations would apply to the future development of the property. • One and Two-Family dwellings- minimum of 2 enclosed parking spaces for each dwelling units. • Multi-family dwellings — minimum of 2 parking spaces with 1 enclosed parking space for each dwelling unit. Sanitary District — The Yorkville Bristol Sanitary District (YBSD) has stated while it is advisable that the landowner should annex to the Sanitary District so the District and the City can expand together, it is not required. Should the owner annex to the sanitary district, annexation and Infrastructure Participation Fees (IPF) would apply, which are $4228/acre. It was also noted that if the land owner's septic system fails in the future and a sanitary sewer is within 100 feet of their property line,they would be required to connect and annex at that time. Landscaping Ordinance — Although the Integrated Transportation Plan (ITP) indicates that a trail is to be located along McHugh, staff recommends installing sidewalk along McHugh, and verification from EEI that no additional easement language or width is required for when the City needs to remove the sidewalk and install a trail. Additionally, sidewalk will be required along Farmstead Drive. o The Landscape Ordinance 2009-42 will apply. This includes, but is not limited to, parkway trees, parking lot landscaping, and a 30' landscape buffer yard between single family and multi-family residential with 3 shade trees, 3 evergreen trees, and 2 ornamental trees per 100 lineal feet of buffer yard. Staff Comments: While the trend of development in the area surrounding the subject property (multifamily residential immediately to the east and a commercial land use to the west)may support a more denser transitional residential land use than the current single family detached, it is staff's position that without a definitive land plan which details proposed buffer areas, parking layout and above all housing type and density, full support for the rezoning request to R-4 is challenging. According to Section 10-4-5 of the City's Zoning Ordinance, all petitions for annexation upon approval will be automatically classified in the R-1 One-Family Residence District until otherwise requested for rezoning before the Plan Commission. In the interest of time, the Petitioner has filed concurrent applications for annexation and rezoning. The Plan Commission's recommendation will be forwarded to the City Council for consideration as part of the petitioner's public hearing request for annexation at their meeting scheduled for August 27, 2013. Findings of Fact: In considering rezoning requests, the Zoning Ordinance requires the Plan Commission to make findings based upon the evidence presented to it in each specific case with respect to the following matters: a. Existing uses of property within the general area of the property in question. b. The zoning classification of property within the general area of the property in question. c. The suitability of the property in question to the uses permitted under the existing zoning classification. d. The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning classification. e. The impact that such reclassification and/or annexation will have upon traffic and traffic conditions on said routes; the effect, if any, such reclassification and/or annexation would have upon existing accesses to said routes; and the impact of additional accesses as requested by the petitioner upon traffic and traffic conditions and flow on said routes. (Ord. 1976-43, 11-4-1976) Additional factors to be considered for an amendment to a zoning ordinance as determined by the `LaSalle' and `Sinclair' cases should also be considered. These factors are as follows: 1) The existing uses and zoning of nearby property; 2) The extent to which property values are diminished by the particular zoning restrictions; 3) The extent to which the destruction of property values of plaintiff promotes the health, safety, morals, and general welfare of the public; 4) The relative gain to the public as compared to the hardship imposed upon the individual property owner; 5) The suitability of the subject property for the zoned purposes; 6) The length of time the property has been vacant as zoned considered in the context of land development in the area in the vicinity of the subject property; 7) The community need for the proposed use; and, 8) The care with which the community has undertaken to plan its land use development. Requests for rezoning must not be merely arbitrary, but has to have validity as to the appropriate zoning classification for the existing or proposed land use in consideration of certain factors such as:the existing land use and zoning of the surrounding properties; suitability of the land use within the current zoning district; the trend of development in the general area; impact the proposed rezoning would have on traffic; the potential diminishment of property values due to the rezoning; and the promotion of public health, safety, morals or general welfare of the public as a result of the proposed rezoning. A Microsoft Word document with the legal description is required on the CD. Within one(1)week of submittal,the Community Development Department will determine if the application is complete or if additional information is needed. These materials must be submitted a minimum of 45 days prior to the targeted Plan Commission meeting. An incomplete submittal could delay the scheduling of the project. Applicant will be responsible for payment of recording fees and public hearing costs, including written transcripts of the public hearing and outside consultant costs(i.e.legal review,land planner,zoning coordinator, environmental, etc.). The applicant will be required to establish a deposit account with the city to cover these fees. The Petitioner Deposit Account/Acknowledgement of Financial Responsibility form is attached to this document and must be submitted with the application. Plan Council (If Applicable) Applicant may present the proposed request to the Plan Council. The Plan Council meets on the 2nd and 4th Thursday of the month. The members of the Council include the Community Development Director, City Engineer,the Building Department Official,the Public Works Director,the Director of Parks and Recreation,a Fire Department Representative,and a Police Department Representative. Upon recommendation by the Plan Council, applicant will move forward to the Plan Commission hearing. Plan Commission Applicant will attend a public hearing conducted by the Plan Commission. The Plan Commission meets on the 2nd Wednesday of the Month at 7:OOpm. Notice will be placed in the Kendall County Record by the United City of Yorkville. The applicant is responsible for sending certified public hearing notices to adjacent property owners within 500 feet of the subject property no less than 15 days and no more than 30 days prior to the public hearing date. Twenty Four (24) hours prior to the public hearing, a certified affidavit must be filed by the applicant with the Community Development Department containing the names, addresses and permanent parcel numbers of all parties that were notified. The Plan Commission will conduct a public hearing on the request, take public comments, discuss the request, and make a recommendation to City Council. 3 Application • Step 4 City Council Applicant will attend the City Council meeting where the recommendation of the rezoning request will be considered. The City Council meets on the 2nd and 4th Tuesdays of the month at 7:OOpm. City Council will make the final approval of the rezoning request. Dormant Applications The Community Development Director shall determine if an application meets or fails to meet the requirements stated above. If the Director determines that the application is incomplete it will become dormant under these circumstances: • The applicant has been notified of such deficiencies and has not responded or provided a time line for completing the application within ninety(90)days from the time of notification. • The applicant has not responded in writing to a request for information or documentation from the initial plan commission review within six(6)months from the date of that request. • The applicant has not responded to a request for legal or engineering deposit replenishment for city incurred costs and fees within ninety(90)days from the date of the request. If the Community Development Director has sent the required notice and the applicant has not withdrawn their application or brought it into compliance, then the director shall terminate the application. After termination, the application shall not be reconsidered except after the filing of a completely new application. Withdrawal or termination of an application shall not affect the applicant's responsibility for payment of any costs and fees,or any other outstanding debt owed to the city.The balance of any funds deposited with the city that is not needed to pay for costs and fees shall be returned to the applicant. Barksdale-Noble, Community Development Director co CC: Bart Olson, City Administrator a o 20 Date: August 8, 2013 Subject: PC 2013-13 Prestwick of Yorkville—Yorkville Christian School Final Plat Approval Petitioner Request/BackLround: In April 2005, the Prestwick of Yorkville subdivision (1ka Highlands at Ashley Pointe), located in the southwest quadrant of IL Route 126 and Ashley Road, was granted annexation agreement approval via Ord. 2005-30 to construct a total of 345 single-family residential dwelling units on approximately 190 acres of land in two (2) phases to be platted as Unit 1 and Unit 2 within the R-2 One-Family Residence District. While both Units 1 and 2 were given Final Plat approval (Res. 2005-78 and Res. 2006-82, respectively), only Unit 1 of the Prestwick of Yorkville subdivision was recorded. Currently, four (4) single family homes in Unit 1 of the Prestwick of Yorkville Subdivision have been constructed. Since that time, the subdivision's original developer lost the property in foreclosure and ownership reverted back to Homestar Bank in 2012. In March of 2013, the Petitioners, John and Michelle Stewart, repurchased the entire property, which originally belonged to their family, for the purpose of revamping the land plan to replace some of the single-family lots in a portion of the development with a new private Christian high school focusing on agriculture and farming technologies. Although the current R-2 One-Family Residence District zoning identifies schools as a permitted use, the existing annexation agreement will need approval by the City Council to be amended in order to change the land use. The Plan Commission prevue as part of this process is to review and forward a recommendation to the City Council regarding the Final Plat which will allow for the resubdivision of Lot 358 in Unit 1 and a portion of Unit 2 to construct the proposed new school. Proposed Final Plat: The proposed 43.62-acre area resubdivides Lot 358 in Unit 1 of the Prestwick of Yorkville Subdivision and removes 84 lots originally contained in a portion of Unit 2 (refer to attached reference plat). The new Final Plat of Subdivision for the Yorkville Christian School consists of 31.61 acres of land planned for a state-of-the-art 60,000 square foot, three-level private secondary education facility, athletic fields, on-site parking and other accessory structures. Approximately 5.54 acres will be utilized for retention area and open space to be conveyed to the future homeowners association (HOA). Finally, the remaining 6.48 acres will be dedicated for public right-of-way as Whitekirk Lane and Mustang Way. Upon recommendation by the Plan Council, applicant will move forward to the Plan Commission hearing. Plan Commission Applicant will attend a public hearing conducted by the Plan Commission. The Plan Commission meets on the 2nd Wednesday of the Month at 7:OOpm. Notice will be placed in the Kendall County Record by the United City of Yorkville. The Plan Commission will conduct a public hearing on the request, tape public comments, discuss the request, and make a recommendation to City Council. 3 Application • Step Economic Development Committee Applicant must present the proposed plan to the Economic Development Committee. Economic Development Committee meets at 7:00 p.m. on the 1st Tuesday of each month. This session is to discuss and consider recommendations prior to full City Council considerations and provide informal feedback The Economic Development Committee will submit its recommendation to Cit Council. City Council Applicant must present the proposed plan to the City Council. The City Council meets the 2nd and 4th Tuesdays of every month at 7:00 p.m. in the Yorkville City Hall Council Chambers. The proposal will be discussed at the City Council hearing where formal voting takes place. City Council will make the final approval of the plan. Final Plat Recording Once the final plat is approved by the City Council and all required documents, bonds, and letters of credit are submitted to the city, the final plat must be recorded with Kendall County. Submit the final plat mylar to the Deputy Clerk for signatures. When all city signatures are in place, the developer or his surveyor may take the mylar to the Kendall County Clerk for their signature. The next step is to have six (6) paper prints made and return to the Kendall County Recorder's office for recording. Kendall County requires the mylar and 4 paper copies. The City of Yorkville requires that you submit 2 recorded paper copies to the Deputy Cleric. Dormant • • • The Community Development Director shall determine if an application meets or fails to meet the requirements stated above. If the Director determines that the application is incomplete it will become dormant under these circumstances: The applicant has been notified of such deficiencies and has not responded or provided a time line for completing the application within ninety (90) days from the time of notification. The applicant has not responded in writing to a request for information or documentation from the initial plan commission review within six (6) months from the date of that request. The applicant has not responded to a request for legal or engineering deposit replenishment for city incurred costs and fees within ninety (90) days from the date of the request. If the Community Development Director has sent the required notice and the applicant has not withdrawn their application or brought it into compliance, then the director shall terminate the application. After termination, the application shall not be reconsidered except after the filing of a completely new application. Typical requests requiring the establishment of a Petitioner Deposit Account Fund include, but are not limited to, plan review of development approvals/engineering permits. Deposit account funds may also be used to cover costs for services related to legal fees, engineering and other plan reviews, processing of other governmental applications, recording fees and other outside coordination and consulting fees. Each fund account is established with an initial deposit based upon the estimated cost for services provided in the INVOICE & WORKSHEET PETITION APPLICATION. This initial deposit is drawn against to pay for these services related to the project or request. Periodically throughout the project review/approval process, the Financially Responsible Party will receive an invoice reflecting the charges made against the account. At any time the balance of the fund account fall below ten percent (10%) of the original deposit amount, the Financially Responsible Party will receive an invoice requesting additional funds equal to one-hundred percent (100%) of the initial deposit if subsequent reviews/fees related to the project are required. In the event that a deposit account is not immediately replenished, review by the administrative staff, consultants, boards and commissions - may be suspended until the account is fully replenished. If additional funds remain in the deposit account at the completion of the project, the city will refund the balance to the Financially Responsible Party. A written request must be submitted by the Financially Responsible Party to the city by the 15th of the month in order for the refund check to be processed and distributed by the 15th of the following month. This review and our comments do not relieve the designer from his duties to conform to all required codes, regulations, and acceptable standards of engineering practice. Engineering Enterprises, Inc.'s review is not intended as an in-depth quality assurance review, we cannot and do not assume responsibility for design errors or omissions in the plans. As such, we offer the following comments: There are several items that will be required before we can recommend Final Engineering approval. Items that have yet to be submitted for review include: • Revised stormwater management report for the new land use; • Storm sewer sizing calculations; • Engineers Opinion of Probable Construction Cost for public improvements; • Revised traffic study; The following comments are based on a partial review of the plans. The cover sheet shall be dated and signed and sealed by a professional engineer. 2. The street name north of the school access drive is identified on the engineering plans as Mustang Way but identified on the plat as Whitekirk Lane. The street name shall be changed to Whitekirk Lane to match the plat. 3. The I.D.O.T. Standard Detail referenced in Note 12 of the specifications. Curb Ramps shall be changed to 424001-07 and the reference to a "Type "A"" ramp removed from the note since the detail no longer references a ramp type. 4. We recommend utility key note call outs be removed from the overall site plan and added to a utility sheet(s) and the plan and profile sheets. 5. If proposed utilities are shown on the site plan, existing utilities shall also be shown on the site plan. In addition, distinct line types for existing, proposed and future utilities should be included on the plans. 6. The key note tag labels in the legend as shown on the Overall Site Plan shall be reviewed and corrected for the proper utility. 7. Separate erosion control, utility, grading, landscape and lighting plans shall be prepared in addition to plan and profile sheets for the roadway and sanitary sewer installation. Typical Street Cross Sections/Specifications 8. There are a number of inconsistencies between the plans, specifications and the cross sections. They should be revised accordingly. 9. Placement of drainage and utility easements adjacent to the ROW for each roadway section shall be reviewed and revised accordingly and identified properly on the engineering plans and final plat. 10. Utilities are shown in the typical sections that do not appear on the plan views. The typical sections or plans are to be revised accordingly. 11. A typical section for Whitekirk Lane shall be added to the plans. Water Main 12. We recommend a reconfiguration of the proposed water system to serve the school. The water service shall be looped around the building and connected to the main at two locations. One connection to the east at Whitekirk Land and the other to the west at Pestwick/Mustang Way. We do not agree with the water service being installed between homes off of Callander Trail as proposed. Attached is a sketch of the suggested routing. In addition a fire hydrant is to be within a certain distance from the siamese connection as specified by the fire department. 14. All public water mains are to be located within public ROW or in easements. Sanitary Sewer 15. IEPA Division of Water Pollution Control permit applications shall be submitted for review and approval since the proposed sanitary sewer discharge is anticipated to be in excess of 1,500 GPD 16. Engineering plans must be submitted to the Yorkville-Bristol Sanitary District for review. Comments are to be forwarded to us upon receipt. 17. We question the need to extend the sanitary sewer service past the last connection with the building service. Is this necessary for future improvements or can this last segment be deleted. Drainage & Grading 18. The extent of the proposed grading shall be clarified. Currently proposed contours are running off of the sheet. All proposed grading shall be included on a plan sheet. Existing, proposed and or future contours/grades shall be distinguished from each other on the plans. 19. All accessible routes and accessible parking areas shall be check for conformance to ADA standards. 20. We will require an updated stormwater management report including pipe sizing calculations. Considerations must also be given during interim conditions to maintain positive drainage for all areas designated future development. 21. It is also our understanding that not all of the outlet storm sewer for Unit 1 has been constructed. The outlet storm sewer should be included with the school improvements. FINAL PLAT 22. On Lot 358, a number shall be added to the "See Note xx". 23. Easements will be required through the lot for the public water main and all storm sewer serving off-site areas. Alignments will be finalized as part of the final engineering submittal. 24. Ten foot Public Utility and Drainage Easements are to be provided adjacent to both sides of the road ROW for Whitekirk Lane and Mustang Way. 25. A provision for Pedestrian and Bike Trail Easement in included however, there are no easements shown on the plat. Either the provision is to be removed or easements are to be shown. City Council Action: The City Council has conducted a Public Hearing on a request for annexation on July 23, 2013 and will consider this request along with the Plan Commission's recommendation regarding the 1.5-acre property located west of IL Route 47 and south of the Subset Motel (Property Health & Body Makeover, Inc.) at meeting to be held on August 13, 2013. Due to the timing of this meeting and Plan Commission packet distribution, staff will provide an update as to the vote and final determination regarding this request at our meeting on August 14, 2013. 1
