Mayor Golinski called the meeting to order at 7: 00 p .m. and led the Council in the Pledge of Allegiance.

AMENDMENTS TO THE AGENDA
Mayor Golinski requested that item # (CC 2013 -54) on the Mayor's Report be tabled to the August 13 ,
2013 City Council meeting.
Amendment approved unanimously by a viva voce vote.
Mayor Golinski announced that River Road bridge is open.
PRESENTATIONS
Certificates of Commendation Presented to Officer Roman Soebbing
and Community Service Officer Bob Creadeur
Mayor Golinski presented a certificate of commendation to Officer Soebbing.
Mayor Golinski stated that Community Service Officer Creadeur was not in attendance.
City Services Survey
Administrative Intern Weckbach gave a power point presentation on the City services survey.
PUBLIC HEARINGS
1 . PC 2013 -04 — Priority Health and Body Makeover, Inc ., petitioner, has filed an application with
the United City of Yorkville, Kendall County, Illinois, requesting an annexation agreement for an
approximately 1 . 5 acres of total land located in unincorporated Kendall County. The real property
consists of two (2) parcels and is generally located immediately west of North Bridge Street (IL
Route 47), just north of Walnut Street in Kendall County, Illinois.
2 . PC 2013 - 11 — A fourth amendment to that certain Amended Annexation Agreement and Planned
Unit Development Agreement (Raintree Village f/k/a The Highlands Subdivision) dated January
11 , 2005 by an among Wyndham Deerpoint Homes, an Illinois Partnership, Concord Homes, and
the United City of Yorkville for the purpose of amending provisions related to security
instruments, procedure for acceptance of public improvements, and building code and fee lock
extensions.
3 . PC 2013 -07 — A second amendment to that certain Amended Annexation Agreement and Planned
Unit Development Agreement (Grand Reserve Subdivision) dated January 30, 2012 by and
among Grande Reserve (Chicago) ASLI, L.L.L.P. (Owner), an Illinois Limited Liability Limited
Partnership, and the United City of Yorkville, Kendall County, Illinois for the purpose of
restating the transition fees for School District # 115 and providing for its collection at time of
building permit issuance.

Agreement - Design Engineering
(PW 2013 -33 )
Alderman Teeling made a motion to approve a professional services agreement with Engineering
Enterprises, Inc for design engineering on the Cannonball Trail roadway improvements and authorize the
Mayor and City Clerk to execute; seconded by Alderman Milschewski.
Alderman Colosimo and City Administrator Olson discussed how this may affect the overall budget for
2014 .

Mayor Golinski entertained a motion to approve an ordinance authorizing the issuance of general
obligation refunding bonds (Alternate Revenue Source) of the United City of Yorkville, Kendall County,

Alderman Colosimo wanted to clarify that the City is not taking out additional bonds. The City is
refinancing old bonds on better terms. Alderman Kot asked what is the significance of the City having the
terms of the TIF . City Administrator Olson explained the significance it has on the City. Alderman
Colosimo wanted to clarify why this was being done.

Mayor Golinski stated that no executive session was needed.
Mayor's Report (cont' d) :
City Administrator Employment Agreement
(CC 2013 -57)
Mayor Golinski entertained a motion to approve a City Administrator employment agreement with Bart
Olson and authorize the Mayor and City Clerk to execute. So moved by Alderman Colosimo; seconded
by Alderman Frieders.
Alderman Kot does not have any problem with this agreement. He said the City had a survey done for all
the surrounding communities and he would like that made public so people understand why the City is
increasing the salary. Mayor Golinski said the City will give the salary survey to the press, along with the
employment agreement. The survey will also be on line. Alderman Colosimo will be voting yes on this
agreement. He feels City Administrator Olson does an excellent job.

Chief of Police Employment Agreement
(CC 2013 -58)
Mayor Golinski entertained a motion to approve a Chief of Police employment agreement with Richard T.
Hart and authorize the Mayor and City Clerk to execute. So moved by Alderman Colosimo; seconded by
Alderman Milschewski.
Alderman Colosimo stated the police department is the highest rated department in the City of Yorkville.
He is very happy with the job that Chief of Police Hart is doing.

Approval of a Settlement Agreement
(CC 2013 -54)
Mayor Golinski tabled this agreement to the August 13 , 2013 City Council meeting.
CITIZEN COMMENTS
Erica Rudis, Briarwood Subdivision, spoke in regards to whether the Briarwood Subdivision covenants
are void. She wanted to know if the City of Yorkville enforces the covenants for the Briarwood
- Subdivision. City Attorney Orr stated the City does not own land and has no rights. The City has to look
to the home owners association to enforce its own covenants.
Vince Rosanova, came on behalf of JAC Kendall Holdings who is the developer of Briarwood
Subdivision. He discussed the covenants of the Briarwood Subdivision.
Scott Harmon, Raintree Subdivision, raised the concern of the amendment and if it protects the home
owners from having a new developer come in and do the same type of downgrading of the project. He
asked City Attorney Orr if this amendment protects from this type of issue. City Attorney Orr stated the
amendment does not address covenants in the home owners association. The City would have no rights.
Ralph Axelrod lives in a community of seven homeowners. A new builder has come in to build on the
available lots and is not staying up to the standards that the homeowners hoped to have . He is very
concerned about the health of his community due to the truck loads of dirt that have been dumped there
due to the Route 47 reconstruction. He is also concerned about his communities property values.
