Chairperson Spears called the meeting to order at 6:02 p.m. in the Conference Room of City
Hall.

MINUTES :
Minutes for the August 21 , 2008 Public Safety Committee Meetings were approved
without changes.
OLD BUSINESS:
Chairperson Spears asked to move to Old Business first.
2. PS 2008-38 Request to Amend Code Regarding No Parking Areas on Certain
Streets
Chairperson Spears stated that the City has identified heavily traveled streets
through the Village Engineer. As such, she opened this matter up to public
discussion. The following discussion took place:
• Resident Ken Neal of 122 Bertram stated that he is disappointed with
areas of the development such as 1 parking spot per resident; therefore, he
feels it is absurd to limit parking on streets. He stated that if he has
visitors, they have nowhere to park. Chairperson Spears asked about
separate parking areas that are available. Mr. Neal stated that there are 3
visitor spots in front of the condos, and that there are 1 -2 handicapped
spots per building. He feels that restrict parking on the thoroughfare is not
conducive. Committeeman Sutcliff asked if the units had garages, resident
Abbey Schramm of 128 Bertram stated that they are approximately 1
block away from the unit and they are so small that a truck will not fit in
them, therefore, most people use the garages for storage.
• Resident Corrin VanDeVeire of 4504 Marquette stated that there are 1 -2
spaces for guests and therefore, people park along her street (she resides in
the single family area). She finds that there are times when she cannot
back out of her driveway because of the cars parked on the street.
• Resident Chris Schramm of 128 Bertram stated that when they purchased
their home they were told that parking would be available on Bertram.
The building he resides in only has 1 guest parking spot. There is also a
turn lane that runs the entire length of the street, but there are only 2 places
to make turns, therefore, he feels that the turn lane could be removed and
parking could be made available on the street. He does not feel that there
is a lot of traffic along the road. Chief Martin stated that when the
roadway opens to Route 47, there would be an increase in traffic. With
regards to the long turn lane, Chief Martin stated that it is for stacking
purposes at the traffic light. Chairperson Spears added that developers are
not always honest with prospective buyers; however, there is nothing the
City can do about that.
• Resident John Lechowicz of 308 Timbelear stated that Rosenwinkle Drive
is behind him. His neighbors have parties and feels that the residents
should have some dispensation for those occasions. Chairperson Spears
stated that they could contact the Police Department to request special
parking permission. Mr. Lechowicz asked if people could park on their
lawns like is done at the water park. Lieutenant Schwartzkopf stated that
the area he is referring to is an overflow parking lot on private property.
Mr. Lechowicz added that he would like to see Bristol Bay connect to
Route 47 in his lifetime.
• Chief Martin stated that he feels that a situation could be worked out with
the residents on Bertram and that he sees their point of view. He
recommends to the committee to limit parking to one side only. He added
that the snow ordinance would apply as always.
• Abbey Schramm stated that there are 16 units in her building with
1 visitor spot. Other buildings have 2 or 3 visitor spots.
• Corrin VanDeVeire stated that if parking were to be allowed on
one side of Bertram, it would help with the problems on Marquette
because she can't get out of her driveway when cars are parked on
both sides.
• Lt. Schwartzkopf stated that he received a phone call from a resident of
the 200 block of Bertram. She understands why this needs to be done, but
would like the development looked at. Lt. Schwartzkopf explained that
some roads are city roads and others are not. Her name and telephone
number were given if anyone is interested.
• Chairperson Spears stated she received a letter from a resident named
Heather who could not be in attendance. She resides on the 200 block of
Bertram and she is upset with the proposed parking ban.
• Mr. Lechowicz asked if the City looks at the number of parking spaces
when development plans are received. Chairperson Spears stated that the
City is addressing this issue along with driveway sizes and street widths.
There are codes that are required to be met, however, she feels that Mr.
Lechowicz has a good concern.
• Mr. Lechowicz stated the fire codes requires two entrances into a
subdivision where is school is at, which has not been done. Chief Martin
stated that the builder could only do so much at a time. The City is trying
to work with the developer.
• Mr. Schramm stated that when he moved in, Bristol Bay was open to
Route 47 and now it is closed, he would like to know why. Chief Martin
stated that it was possibly closed because the traffic light was not installed,
however, he was not sure.
• Committeeman Werderich stated that in high-density areas, parking seems
to be a problem.
The residents in attendance were encouraged to attend the City Council
meeting to voice their concerns. With no further discussion, this item was
moved to the October 7, 2008 City Council Meeting (regular agenda).
NEW BUSINESS :
1 . PS 2008-40 Police Reports for August, 2008
Chairperson Spears commended the Police Department for a good job done.
She was surprised by the amount of No Valid Drivers License and No
Insurance offenses.
With no further discussion, this item was moved to the Consent Agenda.
3. 2008-41 — Request for TracView Program (Grant)
Chief Martin stated that the purchase of the program would be of no cost to
the Police Department and it would aid them when people come in to access
reports. Furthermore, he stated that it would reduce the amount of time in
handling requests for report copies. There would still be a charge for reports
requested to be mailed out. Committeeman Werderich asked if report copies
would still be available in hardcopy, to which Chief Martin replied yes.
With no further discussion, this item will be sent to the Consent Agenda.
4. PS 2008-42 — Unauthorized Parking in Handicapped Spaces — Discussion
Chief Martin stated he would like to present to the Committee to increase
handicapped parking fines from $250.00 to $350.00, which is allowed by
State Statute. This will put the City with others in the area. The Police
Department does not see many violators of this offense, however, they would
like to enforce it at the highest rate.
Chairperson Spears stated that with more commercial in the City, there would
be more opportunities for violators to be fined. She agrees with the maximum
fine. All other members of the committee were also in agreement.
Chairperson Spears asked Chief Martin if Attorney Orr would put together the
ordinance. Chief Martin will have Attorney Orr prepare it and will have it
brought back to this committee in draft form.
5. PS 2008-43 — Ordinances Pertaining to Hunting
Lieutenant Hart stated that an officer from the IDNR contacted him last week
regarding hunting laws. The IDNR stated that municipalities could no longer
enforce hunting ordinances, only state laws. Therefore, the City's ordinance
is no longer legal.
He stated that it is illegal to hunt on State and City owned property. The
IDNR will come out to educate the officers regarding this change.
He stated that the biggest complaint is duck/goose hunting on the Fox. The
IDNR pointed out islands where it is legal, but those are not within City
limits.
Committeeman Werderich asked where this is applicable. Lieutenant Hart
stated that Wydet Ridge near Route 71 , south of Route 47 is one location, also
on Fox Road where the Police Department has received complaints of bow
hunting. He added that persons who hunt on private property must have
written permission from the property owner.
Committee Sutcliff asked the differences between the State Statute and the
City ordinance. Lieutenant Hart stated that the City does not allow hunting
within City limits, but the state says the Police Department can no longer
regulate that. Chief Martin added that State ' Statute supercedes the City
ordinance. She asked if hunting on Fox Road was acceptable, to which
Lieutenant Hart added that written permission is required on private property.
Chief Martin added that hunters are generally well versed on hunting laws.
Lieutenant Hart stated that this change does not affect the ordinance regarding
discharge of a firearm, but the state law states that birdshots must be 100
yards away from a residence and deer hunting must be 300 yards away from a
residence. Chairperson Spears stated that years ago there was a complaint
about homes being shot by hunters. Lieutenant Hart stated that the Police
Department could use a laser to measure the distance if hunters are near
houses.
Chief Martin stated that he would have Attorney Orr prepare an ordinance that
mirrors the State Statute and return the draft to the Committee.
OLD BUSINESS :
1. PS 2007-31 — Update on the Administrative Adjudication Hearing Process
Lieutenant Schwartzkopf stated that the first hearing dates are October 15 and
October 19 at 5 :30 pm in Chambers. Chairperson Spears added that Attorney
Orr would like to change the next Public Service Committee meeting date to
October 16, 2008 so that she can update the committee on the first
adjudication hearing.
The following discussion took place:
• The Police Department will have the docket approximately 4-5 days in
advance of the hearing.
• With regards to staff, only current staff members are being utilized for this
function.
• At the present time, Molly, Shemim and Lt. Schwartzkopf are dedicating
time to this function. Their work hours will be will be adjusted
accordingly so that the process is cost effective.
• At the present time, it is unknown if additional office staff will be
necessary, however, Chief Martin has already informed the City that there
may be a need to increase office staff next May. Until the process gets
going this remains unknown, however, the thought is that an additional
person will handle this process and other functions that can be dovetailed.
• The purpose of this process is to make things work that didn't work
before, such as parking tickets have been a problem for the courts and this
process will help that.
• Committeeman Werderich is in favor of the process but would like to see
it self-funded.
• The funds that are collected will be turned into the General Fund.
Chairperson Spears feels that the funds should remain in the Police
Department fund in order to cover costs on the process so that it could be
self-funded. Committeeman Werderich added that he felt the funds
collected should be considered if an additional staff member is requested.
ADDITIONAL BUSINESS :
Committeeman Plocher — would like to look at Van Emmon at the next meeting.
Committeeman Sutcliff — She received another email about the gentleman that was
reported going door-to-door. Chief Martin stated that there are 2 individuals who sell
books door-to-door. While doing so, they ask questions about kids and neighborhood
kids. He has received complaints via email and a few calls regarding this matter. An
Officer has talked to him and his partner. They state that it is part of their sales
program, but people are concerned. The gentlemen have been advised that if
additional complaints were received, their solicitation permit would be revoked.
Chief Martin stated the gentlemen are here on a Visa, they have a permit and they
have identification cards. He asked that if anyone receives more complaints, to
inform the Police Department.
Additionally, Committeeman Sutcliff stated that it was discussed at the Public Works
Committee Meeting that the stop sign at the corner of Countryside and McHugh is not
visible due to high weeds. Chief Martin stated that he would discuss this matter with
Director Dhuse to see if there is something that could be done to resolve this matter.
Lastly, Committeeman Sutcliff wanted to know if E85 fuel would be better for Police
vehicles. Chief Martin stated that is it not as efficient for squad cars; however, it
could be considered for detective vehicles and school resource officer vehicles.
Committeeman Plocher stated that E85 usually increases horsepower, but it runs hot
and it not as efficient. Chief Martin added that the Village of Oswego has a hybrid
car to see how it works for them. He would be interested in hybrids for squads in the
future.
Committeeman Werderich — None
Chairperson Spears — He is concerned about the fact that a bank signature card was
being passed around to all of the Alderman. These cards include names, social
security numbers and the person' s mother's maiden name. Attorney Orr saw this
occur and stated that she would take care of it. Additionally, the auditors have stated
that they should not sign the card and Attorney Orr supports that. He received an
email from someone in the Finance Department and was asked to come in and sign
the card to which he refused. City Administrator McLaughlin thinks that his concern
is having his name on the account, however his concern is identity theft as these cards
are being passed around. He feels that a procedure should be in place to have the
Alderman go into the bank or to have someone bring the cards to them directly. He
feels the entire matter is disturbing.

This memorandum is to inform City Council that the hearing officers will be
compensated at $ 150 per hour for hearings . If a hearing is cancelled the same day it
was supposed to occur, hearing officers will be compensated $ 150 , or one hour of
time . Otherwise, hearing officers will not be compensated for cancelled hearings .

Administrative Adjudication Hearing Process
The attached proposed ordinances are needed to address issues which are deemed ancillary to
the City's substantial growth in population as well as retail businesses, and may be enforced
through the administrative adjudication hearing process . These ordinances will address
misdemeanor offenses that are non -reportable to the State of Illinois, and are not required to
be heard in the Circuit Court system . It is important to incorporate these minor misdemeanor
offenses into our City Code in order to permit enforcement.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3, Section 2, Subsection 5, of the United City of Yorkville Code of
Ordinances is hereby amended by deleting it in its entirety and replacing it with:
5-3-2-5: ADVERTISING AND SIGNS ON BUILDINGS
A. No person shall post, stick, stamp, tack, paint, or otherwise fix, or cause the same to
be done by another person, any notice, placard, bill, handbill, sign, poster, card
advertisement, or other device calculated to attract the attention of the public, upon
any building or part thereof, wall or part thereof, or window, without first obtaining
the authority of the city council and the written consent of the owner, agent, lessee, or
occupant of such premises or structure, and provided, further, that this section shall
not apply to advertising matter upon billboards owned or controlled by private
individuals.

5-3-8 POSSESSION OF PAINT OR MARKER WITH INTENT TO DEFACE
UNLAWFUL
A. Absent express permission to the contrary by the owner or other person having
control thereof, it shall be unlawful for any person to possess a spray paint container,
liquid paint or any marker containing a fluid which is not water soluble and has a
point, brush, applicator or other writing surface of one-half inch or greater, in any
public building or upon any public facility or property.

A. No person shall enter into or upon any lot, block, or tract of ground in the city which

upon any such premises shall be treated as a trespasser unless he can produce
satisfactory evidence of ownership or right to be in and upon such premises.

5-3-10 FIREWORKS
A. It shall be unlawful for any person to sell, keep, expose for sale, loan or give away
any toy pistol, toy gun, toy cannon, blank cartridge, or any fireworks, firecrackers,
torpedoes, bombs, squibs, rockets, pinwheels, fire balloons, Roman Candles,
detonating canes or ammunition therefore, or any substance of articles of any
explosive nature designed or intended to be used as fireworks, anywhere in the city.
B. It shall be unlawful for any person to be possessed of or to discharge anywhere in the
city any of the items enumerated in the above paragraph of this code; provided,
however, that they mayor and city council may issue a permit for the discharge of
fireworks and for pyrotechnical displays.

amended by adding the following new Section 11 :
5-3-11 CANNABIS
A. Cannabis includes marijuana, hashish and other substances which are identified as
including any parts of the plant Cannabis Sativa, whether growing or not; the seeds
there of, the resin extracted from any part of such plant; and any compound,
manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin,
including tetrahydrocannabinol (THS) and all other cannabinol derivatives, including
its naturally occurring or synthetically produced ingredients, whether produced
directly or indirectly by extraction, or independently by means of chemical synthesis
or by a combination of extraction and chemical synthesis; but shall not include the
mature stalks of such plant, fiber produced from such stalks, oil or cake made from
the seeds of such plant, any other compound, manufacture, salt, derivative, mixture,
or preparation of such mature stalks (except the resin extracted there from) fiber, oil
or cake, or the sterilized seed of such plant which is incapable of germination.
B. It shall be unlawful for any person knowingly to possess any quantity of any
substance containing cannabis, except that the effect of this section shall be limited to
persons knowingly possessing less than ten (10) grams of ay substance containing
cannabis.
C. The provisions of this section shall not apply to:
1 . Any person who has been authorized by the department of mental health and
developmental disabilities, with the approval of the department of law
enforcement o possess and deliver substances containing cannabis.
2. Persons registered under federal law to conduct research with cannabis.

5-3-12 REMOVAL OF GRAFFITI
Within seven (7) days of written notification from the city, the owner of any property
upon which graffiti has been placed shall remove same. Failure to remove the graffiti
within seven (7) days of written notification, unless an extension of time is granted, shall
cause the city to remove the graffiti and the property owner shall be liable to the city for
the reasonable cost of the removal. Upon application to the city, an extension of time to
remove the graffiti may be granted due to weather and temperature limitations or
availability of chemicals, but in no event shall any extension exceed ninety (90) days.

Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3 , of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 13 :
5-3-13 RETAIL THEFT (SHOPLIFTING)
A. Definitions
For the purpose of this article, the words and phrases defined in this
section have the meanings ascribed to them unless a contrary meaning is
clear from the context:
Conceal. To "conceal" merchandise means that, although there may be
some notice of its presence, that merchandise is not visible through
ordinary observation.
Full retail value. The merchant's stated or advertised price of the
merchandise.
Merchandise. Any type of tangible personal property.
Merchant. An owner or operator of any retail establishment or any agent,
employee, lessee, consignee, officer, director, franchise, or independent
contractor of such owner or operator.
Minor. A person who is less than eighteen (18) years of age, is
unemancipated and resides with his parents or legal guardian
Peace officer. Any person who by virtue of his office or public
employment is vested by law with a duty to maintain public order to make
arrests for offenses whether that duty extends to all offenses or is limited
to specific offenses.
Premises of a retail mercantile establishment. Includes, but is not limited
to, the retail mercantile establishments, any common use areas in shopping
centers and all parking areas set aside by a merchant for the parking of
vehicle for the convenience of the patrons of such retail mercantile
establishment.
Shopping cart. Those push carts of the type or types which are commonly
provided by grocery stores, drugstores, or other retail establishments for
the use of the public in transporting commodities in stores and markets
and, incidentally, from stores to a place outside the store.
Under-ring: "Under-ring" means to cause the cash register or other sales
recording devices to reflect less than the full retail value of the
merchandise.
B. Offense of retail theft
A person commits the offense of retail theft when he knowingly:
1 . Takes possession of, carries away, transfers or causes to be carried away
or transferred, any merchandise displayed held, stored or offered for sale
in a retail mercantile establishment with the intention of retaining such
merchandise or with the intention of depriving the merchant permanently
of the possession, use or benefit of such merchandise without paying the
full retail value of such merchandise; or
2. Alters, transfers, or removes any label, price tag, marking, indicia of value
or any other markings which aid in determining value affixed to any
merchandise displayed, held, stored, or offered for sale, in a retail
mercantile establishment and attempts to purchase such merchandise
personally or in consort with another at less than the full retail value with
the intention of depriving the merchant of the full retail value of such
merchandise; or
3 . Transfers any merchandise displayed, held, stored for sale, in a retail
mercantile establishment from the container in or on which such
merchandise is displayed to any other container with the intention of
depriving the merchant of the full retail value of such merchandise; or
4. Under-rings with the intention of depriving the merchant establishment
without the consent of the merchant given at the time of such removal
with the intention of depriving the merchant permanently of the
possession, use or benefit of such cart.
C. Presumptions
If any person:
1 . Conceals upon his person or among his belongings, unpurchased
merchandise displayed, held, stored or offered for sale in a retail
mercantile establishment; and
2. Removes that merchandise beyond the last-known station for receiving
payments for that merchandise in that retail mercantile establishment;
such person shall be presumed to have possessed, carried away or transferred such
merchandise with the intention of retaining it or with the intention of depriving

the merchant permanently of the possession, use or benefit of such merchandise
without paying the full retail value of such merchandise.
D. Detention
Any merchant who has reasonable grounds to believe that a person has committed
retail theft may detain such person, on or off the premises of a retail mercantile
establishment, in a reasonable manner and for a reasonable length of time for all
or any of the following purposes:
1 . To request identification;
2. To verify such identification;
3 . To make reasonable inquiry as to whether such person has in his
possession unpurchased merchandise and, to make reasonable
investigation of the ownership of such merchandise.
4. To inform a peace officer of the detention of the person and surrender that
person to the custody of a peace officer.
5. In the case of a minor, to inform a peace officer, the parents, guardian, or
other private person interested in the welfare of that minor of this
detention and to surrender custody of such minor to such person.
A merchant may make a detention as permitted herein off the premises of a retail
mercantile establishment only if such a detention is pursuant to an immediate
pursuit of such person.
E. Affirmative defense
A detention as permitted in this article does not constitute an arrest or an unlawful
restraint, as defined in 720 ILCS 5/10-3, nor shall it render the merchant liable to
the persons so detained.
F. Value of goods
This article shall apply to goods having a value or full retail of one hundred fifty
dollars ($ 150.00) or under.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3, of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 14:
5-3-14 DISORDERLY CONDUCT
A person commits disorderly conduct when he knowingly:
a. Does any act in such unreasonable manner as to provoke, make or aid in making a
breach of peace; or
b. Does or makes any unreasonable or offensive act, utterance, gesture or display
which, under the circumstances, creates a clear and present danger of a breach of
peace or imminent threat of violence; or
C. Refuses or fails to cease and desist any peaceful conduct or activity likely to
produce a breach of peace where there is an imminent threat of violence, and
where the police have made all reasonable efforts to protect the otherwise
peaceful conduct and activity, and have requested that said conduct and activity
be stopped and explained the request if there by time; or
d. Fails to obey a lawful order of dispersal by a person known by him to be a peace
officer under circumstances where three or more persons are committing acts of
disorderly conduct in the immediate vicinity, which acts are likely to cause
substantial harm or serious inconvenience, annoyance or alarm; or
e. Assembles with three (3) or more persons for the purpose of using force or
violence to disturb the public peace; or
f. Goes about begging or soliciting funds on the public ways without having first
secured a permit therefor; or
g. Appears in any public place manifestly under the influence of alcohol,
narcotics or other drug, not therapeutically administered, to the degree that
he may endanger himself or other persons or property, or annoy persons in
his vicinity; or
h. carries in a threatening or menacing manner, without authority of law, any
pistol, revolver, dagger, razor, dangerous knife, stiletto, knuckles,
slingshot, an object containing noxious or deleterious liquid, gas or
substance or other dangerous weapon, or conceals said weapon on or
about the person or vehicle; or
i. Pickets or demonstrates on a public way within one hundred fifty (150)
feet of any primary or secondary school building while the school is in
session and one-half hour before the school is in session and one-half hour
after the school session has been concluded, provided that this subsection
does not prohibit the peaceful picketing of any school involved in a labor
dispute; or
j . Pickets or demonstrates on a public way within one hundred fifty ( 15 0)
feet of any church, temple, synagogue or other place of worship while
services are being conducted and one-half hour before services are to be
conducted and one-half hour after services have been concluded, provided
that this subsection does not prohibit the peaceful picketing of any church,
temple, synagogue or other place of worship involved in a labor dispute.

NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5 of the United City of Yorkville Code of Ordinances is hereby amended by
adding the following new Chapter 7:
5-7-1 PARENTAL RESPONSIBILITY:
A. Failure to exercise parental responsibility. It shall be unlawful for the parent or legal
guardian of an unemancipated minor residing with such parent or legal guardian to
fail to exercise proper parental responsibility by allowing or permitting such minor to
commit any violation of a city ordinance or state statute concerning battery, curfew,
disorderly conduct, fireworks, indecent exposure, intimidation, possession of spray
paint or permanent markers, obscene conduct, vandalism, trespass, truancy, loitering,
use or possession of tobacco products, possession of alcoholic beverages, cannabis,
controlled substance or air rifle.
B . Presumption. A parent or legal guardian shall be presumed to have allowed or
permitted the minor to have committed a violation of a city ordinance of state statute
under all of the following conditions:
1 ) The minor has been either adjudicated to be in violation of any ordinance or
state statute as described in paragraph A above; or has been charged with the
violation of any ordinance or state statute as described in paragraph A (except
if found not guilty); or has incurred non-judicial sanctions from any peace
officer, police officer, or conservator of the peace resulting from an admission
of guilt to an offense of an ordinance or state statute as described in paragraph
A above; and
2) The parent or legal guardian has received a written notice by certified mail
(return receipt requested) or by personal service in substantially the following
form:

TO: (Parent' s Names)
FROM: United City of Yorkville Police Department
You are hereby notified that (minor' s name) has been involved in the
commission of (specify offense), which is a violation of a state statute or city
ordinance. If your minor child is again involved in a violation of state statutes
or city ordinances involving battery, curfew, disorderly conduct, fireworks,
indecent exposure, intimidation, possession of spray paint or permanent
markers, obscene conduct, vandalism, trespass, truancy, loitering, possession
of alcoholic beverages, cannabis, or controlled substance, or any other offense
of willful or malicious nature to persons or property within the next two (2)
years, you will be charged with parental irresponsibility.
Conviction for said offense can result in a fine of not less that twenty-five
dollars ($25.00) nor more than five hundred dollars ($500.00). You are hereby
notified that you must exercise proper parental responsibility over said minor
by controlling his unlawful conduct.
3) The minor, within two (2) years of the receipt of the notice by the parent or
legal guardian, has been either adjudicated to have committed, has been
charged with the violation (except if found to be not guilty), or has admitted to
have committed any violation of any ordinance or state statute as described in
paragraph A above.
5-7-2 The following terms shall have the meaning ascribed to them for the purposes of
this section:
1 ) Legal guardian means a person appointed guardian or given custody of a
minor by a court, but it does not include a person appointed guardian or given
custody of a minor under the Juvenile Court Act, as amended, in the State of
Illinois.
2) Minor means any person who has not yet attained the age of eighteen (18).
5-7-3 SUPERVISION:
It is the policy of the United City of Yorkville to permit the city prosecutor to use
the provisions of the Unified Code of Corrections, as amended, of the State of
Illinois pertaining to supervision in order to further the ends of justice, restitution,
and purposes of this section.
5-7-4 COURT APPEARANCE OF PARENTS :
It is the policy of the city that a parent or legal guardian of the minor be notified
and required to appear in court whenever that minor is charged with a violation of
an ordinance or state statute which requires a minor' s appearance in court. To this
end it is hereby directed that a notice in substantially the following form be sent to
the parents or legal guardians of the minor:

You are hereby notified that (minor's name) has been charged with an
offense which is a violation of a city ordinance or state statute, and which

subpoena to bring you into court. Failure to obey a subpoena can result in

Issue•
Staff has recently received complaints regarding commercial trucks being parked in business
parking lots for extended periods of time. The concern expressed by nearby citizens include
nuisances related to the noise of running engines, unsightliness of tractor trailers, and general
concern related to the transient nature of the users.
Background:
The Building and Safety Department in recent years has successfully controlled the use of
parking facilities in business districts for tractor trailer parking for extended periods by
interpreting this as a use (storage of trucks and trailers) not permitted in Business Districts if this
use is not part of the primary use of the property. For instance, there have been tractor trailer
parking activities in recent years at the Countryside Center property, the Aldi parking lot, Cozy
Corner property none of which is related to the primary use of these properties. A 24 hour
period has been used by the Department to determine the point at which an unattended truck
and/or trailer must be removed from the property, however, this period has never been
incorporated into an ordinance.
The EDC reviewed the attached text amendment and advised staff to forward the same
recommendation to the Public Safety Committee for review and input prior to scheduling a
public hearing at Plan Commission.
Staff Recommendation:
The draft text amendment clearly identifies the period of time (24 hours) in which a parked
vehicle becomes a violation. This amendment addresses commercial vehicles, such as tractor
trailers, as well as passenger vehicles, such as for sale vehicles parked in a facility if it is not
owned by the property owner, employee or patron. The EDC recommended adding delivery
vehicles to the list of vehicle types to avoid limiting the length of time a delivery vehicle serving
the business is parked on the premises.
Based on the direction of the Committee, this text amendment would require consideration of
and a public hearing conducted by the Plan Commission prior to adoption.
10-11 -3 : OFF STREET PARKING REGULATIONS AND
REQUIREMENTS :
A. Use Of Parking Facilities:
1 . Residential Districts: Off street parking facilities accessory to
residential use and development in any residential district in
accordance with the requirements of this chapter shall be used
solely for the parking of passenger automobiles owned by
occupants of the dwelling structures to which such facilities are
accessory or by guests of said occupants. Under no circumstances
shall required parking facilities accessory to residential structures
be used for the storage of commercial vehicles or for the parking of
automobiles belonging to the employees, owners, tenants, visitors
or customers of business or manufacturing establishments.
2. Business and Manufacturing Districts: Off street parking facilities
accessory to business and manufacturing use shall be used solely
for the parking of vehicles of owners employees, and patrons of
the business or establishment as well as for delivery vehicles
serving the business or establishment. Vehicles owned by said
patrons shall not be parked on said parking facilities for periods
longer than twenty-four (24) hours.

non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970

WHEREAS, the City believes that prohibiting non-permitted individuals from parking in a
designated parking space is in the best interests of the health, safety, welfare, and morals of its residents;
and,
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 6, Chapter 2, Section 5 of the United City of Yorkville Code of Ordinances is
hereby amended by the addition of the following new Subsection E:
E. Prohibited Parking: No vehicle may be parked in a designated handicapped parking
space without a handicapped identification permit displayed in accordance with this
Section. A violation of this Section will result in a $350.00 fine.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS, REGARDING RESTRICTIONS TO ANIMALS
WHEREAS, the United City of Yorkville (the "City") is a duly organized and validly existing
non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970
and the laws of the State; and,
WHEREAS, pursuant to Section 2. 1 of the Illinois Wildlife Code (520 ILCS 511 . 1 , et seq. ), the
ownership and title to all wild birds and wild mammals within the jurisdiction of the State are declared
to be in the State, and no wild birds or wild mammals shall be taken or killed, in any manner or at any
time, unless the person or persons so taking or killing the same shall consent that the title thereto shall be
and remain in the State for the purpose of regulating the taking, killing, possession, use, sale and
transportation thereof, after such taking or killing; and,
WHEREAS, Section 2. 1 of the Illinois Wildlife Code further states that the taking or killing of
wild birds or wild mammals at any time, in any manner, and by any person, shall be deemed a consent
on the part of such person that the title to such wild birds or wild mammals shall remain in the State for
the purpose of regulating the possession, use, sale and transportation thereof; and,
WHEREAS, the City believes that the adoption of Section 2. 1 of the Illinois Wildlife Code is in
the best interests of the health, safety, welfare, and morals of its residents; and,
WHEREAS, the regulation and licensing of the taking of wildlife in Illinois are exclusive powers
and functions of the State, and the City is in no way attempting to regulate or license the taking of
wildlife, but rather desires to reiterate Section 2. 1 of the Illinois Wildlife Code.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 7, Chapter 4, Section 5 of the United City of Yorkville Code of Ordinances is
hereby amended by the addition of the following new Subsection F:
F. Taking or Killing Wild Birds or Wild Mammals: No wild birds or wild mammals
shall be taken or killed, in any manner or at any time, unless the person or persons so
taking or killing the same shall consent that the title thereto shall be and remain in the
