Chairperson Spears called the meeting to order at 6 :03 p.m. in the Conference Room of City
Hall.

MINUTES:
Minutes for the September 18, 2008 Public Safety Committee Meetings were
approved without changes.
NEW BUSINESS :
1 . PS 2008-44 Police Reports for September, 2008
Committeeman Werderich noted that battery offenses are higher than last
year. Chief Martin stated that the figure includes Domestic Battery offenses
and the rise could also be contributed to harder economic times.
Chairperson Spears asked why Ron Diederich was authorized to take a city
vehicle home. Chief Martin stated that Mr. Diederich does not charge the
City for overtime when he is called out, therefore, he is saving the City money
on the callouts which is why he is allowed to take the vehicle home as he
handles many items during off duty hours such as: heat, electric and water
issues; alarms; speed trailers (he tows the trailer with his City vehicle, drops it
off at the destination, checks on it during the 3-4 day period that its out and
picks it up); speed survey strips; and minor squad car repairs such as tires and
batteries.

Chief Martin stated that Mr. Diederich lives in the general vicinity and feels
that it would cost the City far more to have other employees handle these
responsibilities and therefore, the Police Department is helping with budget
constraints by having Mr. Diederich handle these items. Chairperson Spears
asked Chief Martin to send an outline to Alderman Munns explaining Mr.
Diederich' s responsibilities and why he takes the vehicle home.
Chairperson Spears asked about the vandalism that occurred at the Beecher
Center. Specifically, she asked if the Parks Department was called out for the
pop machine that was knocked over. Chief Martin stated that he is not aware
that anyone was called out for this particular instance, however, the standard
practice is to have a report taken, then have the a member of the dayshift staff
make notification about damage, etc. Additionally, he stated in this case, the
notification would have been made to the owner of the pop machine, not the
Parks Department. Chairperson Spears asked if it is typical to call out the
Parks Department Supervisor for instances of vandalism, to which Chief
Martin stated that the only time that notification would be made during off-
duty hours is when the matter presents a safety issue. Vandalism, he stated,
would not present a safety issue. Chairperson Spears stated that this matter
would need to return to the Administration Committee for further discussion.
With no further discussion, this item was moved to the Consent Agenda.
2. 2008-45 — Payment of Administrative Adjudication Hearing Officers
Attorney Orr stated that staff is very excited about the Adjudication Hearing
Process. She gave a brief summary of the status:
• The rate for the hearing officer is $ 150.00/hour.
• If the hearing is cancelled the day of a scheduled hearing, the officer
will be paid 1 hour.
• The Police Department staff has been great in handling this matter.
• The Police Department collected $ 1200.00 in fines.
• The Police Department is using cadets to issue tickets.
• Numerous ordinances are on the agenda to bring more things into the
scope of the process.
• Most citizens are grateful that they can come to City Hall, pay a fine
and not have to attend court or have an offense on their record.
• The Building Department needs to get onboard.
• For the hearing scheduled October 22, 2008, there are 4 tickets that
remain unpaid.
• The idea of this process is not to create revenue, but to create a good
life at no cost to good citizens.
• With regards to parking tickets, if the violator does not appear after 10
tickets, their vehicle will be booted.
• With regards to seatbelt violations, they are issued as a parking ticket
but if they go unpaid, a lien can be placed on their license in
Springfield.

• This process is used for issuing tickets for vehicles blocking a
sidewalk. Prior to the process, the violator would receive a $75.00
ticket. The City receives many complaints regarding this matter.
• Barking dog complaints were not dealt with before because they would
be dropped in court. This process allows the City an avenue with
which to pursue those complaints.
Committeeman Werderich asked what the violation entitled `Improper
Display of Plate' is for. Ms. Batterson advised that is for vehicles parked on a
street without a registration sticker, or vehicles without a plate light or
vehicles without a front license plate.
Chief Martin stated that the Police Department could be stringent on issues
such as parking in a fire hydrant zone and parking across a sidewalk.
Committeeman Sutcliff asked if the violations were published in the
newspaper. Ms. Batterson responded that some of them, the City has always
been able to issue citations for. However, there is a list available online and in
the newsletter.
Ms. Batterson stated that the process lifts a burden from the courts and allows
the courts to focus on more important violations. Attorney Orr stated that she
spoke with a representative from the courts and they are very encouraged
about this process moving forward.
3. PS 2008-46 — Code Amendment Ordinances
Attorney Orr stated that the next step is to make code amendments to allow
other violations to be handled through the adjudication process. There will be
more in the future and as the City grows and new problems arise, those too
may be brought into this process.
The following discussion took place regarding the proposed ordinances.
• 5-3-2-5 — no issues — moved to Consent Agenda.
• 5-3-8 — change to " . . . it shall be unlawful for any person to possess
with intent to deface a spray paint container. . . " — moved to Consent
Agenda.
• 5-3-9 — Committeeman Werderich stated that the term `cultivate'
would mean to farm and therefore, this did not make sense. Lt. Hart
stated that in this instance, the term means to damage crops.
Committeeman Werderich stated that it meets with State Statute
720ILCS521 -3 and that it does not show intent. He feels that a
violator loses their constitutional rights under this procedure. Attorney
Orr stated that she would withdraw this proposed ordinance as it is a
personal violation, not a public violation. It will be re-written and
returned for review at the next meeting.

• 5-3- 10 — Committeeman Plocher asked if this ordinance includes cap
guns to which Chief Martin stated that it did not. No other issues were
discussed. — moved to Consent Agenda.
• 5-3 - 11 — Attorney Orr advised that this ordinance is intended for ls`
time offenders only. Committeeman Werderich stated that this
ordinance takes the state stature but changes the violator's rights when
charged under a local ordinance rather than state statute. Attorney Orr
stated that every town she has worked with allows for this as it gives
the Police Department an opportunity to work with kids rather than put
a violation on their record immediately. Chief Martin stated that it
allows the officers to make a difference in someone's life. He stated
that this allows them to issue a fine the first time and work with the
kids. He feels that there a many instances when an officer could get
through to the kids just by trying. It allows them to work with the
community and not be adversarial which gives the Police Department
a better outlook. Attorney Orr stated that instead of an officer having
an "all or nothing" option regarding charging a violator, this gives
them another option.
After discussion, it was determined that this ordinance would be
changed as follows. Item B would state " . . .persons knowingly
possessing 2. 5 grams or less of any substances containing cannabis." —
moved to City Council Agenda for discussion.
• 5-3- 12 — Attorney Orr stated that this ordinance is recommended
because it is the only way to get rid of graffiti. The committee agreed
that most people want to get rid of the graffiti, but Committeeman
Werderich does not want the victim of graffiti to be punished. —
moved to Consent Agenda.
• 5-3- 13 — Committeeman Werderich would like state statute
720ILCS516A-3 ,4,5,6 mirrored. Additionally, items F, G & H of the
statute were left out. However, he stated that the statute allows a
minor to be 19 years old and he has no objection to the proposed
ordinance listing a minor as 18 years old. — Attorney Orr will rewrite
this ordinance and then it will be moved to the City Council Agenda
for discussion.
• 5-3- 14 - Committeeman Werderich stated that the language in item A
is the only language that matches the state statute. Additionally, he
stated he does not agree with the language in items I & J. Attorney
Orr agreed as it does not allow for peaceful picketing. — Items I & J
will be removed, and then this item will be moved to Consent Agenda.
• 5-3- 15 — It was determined this proposed ordinance would be removed
from consideration.
4. PS 2008-47 — Parental Responsibility Ordinance
Committeeman Werderich is concerned that someone would be charged with
another person' s wrongdoing. Chairperson Spears stated that if parents were
more responsible for their children, there might not be so many children

violating the law. Discussion took place regarding the cut off age at which a
parent should be notified. It was determined that it would stay at age 18 . The
following changes will be made:
• 5-7- 1 , A " . . . allowing or permitting such minor to commit any
violation of a city ordinance of state statute concerning battery,
curfew, disorderly conduct, fireworks, indecent exposure, intimidation,
possession of spray paint or permanent marker with intent to deface,
obscene conduct, vandalism, trespass, truancy, loitering, use or
possession of tobacco products, possession of alcoholic beverages,
cannabis, ll a substance, or air rifle.
• 5-7- 1 , B-2 is to be removed.
• All references to state statute will be removed.
• Add "intent to deface" after permanent markers in 5-7- 1 , B-2 (top of
page 2).
• 5-7-4 — change "court" to "adjudication hearing".
After the revisions are made, this item will move to the Consent Agenda.
5, PS 2008-48 — Off Street Parking Regulations — Zoning Ordinance Text
Amendment Recommendation
Mr. Miller stated that this item came from the EDC Meeting of October 7,
2008 as staff identified a loop hole in the zoning ordinance and has drafted
text. The problem is that commercial property is not addressed and there is a
problem at the truck stop at Route 71 and Route 47. Chief Martin stated that
the Police Department has received complaints about truck drivers running
their trucks while sleeping for the past 10- 15 years.
Mr. Miller stated that this amendment gives the truckers a 24 hour period
before their vehicle must be moved. Chief Martin stated that there could a
problem if the nature of the business is truck repair and a vehicle is parked for
longer than 24 hours. It was suggested that language should be added that
speaks to the nature of the business.
This item will be moved to the Plan Commission for Public Hearing, then
return to EDC, then to City Council possibly in December.
6. PS 2008-49 — Proposed Public Safety Committee 2009 Meeting Schedule
With no discussion, this item was moved to the Consent Agenda.
OLD BUSINESS:
1. PS 2008-42 — Ordinance Amending the Code of Ordinances Prohibiting
Parking in a Designated Handicapped Parking Space
Chairperson Spears stated that it is proposed to increase the fine for this
violation to $350.00. She noted that there is a problem with the handicapped
parking signs are Marketplace. Lt. Hart will look into this matter.
With no further discussion, this item was moved to the Consent Agenda.

2. PS 2008-43 — Ordinance Amending the Code of Ordinances Regarding
Restrictions to Animals
Lt. Hart stated that the ordinance matches State Statute.

Dear Yorkville Police Department,
My family and I want to thank you for your help on Saturday Oct. 11th assisting the horse drawn
carriage that brought my Mother-in-Law from her home on Blackberry Ln. to our home on
Wooden Bridge Drive to celebrate her 80th birthday.
Your help kept Grandma Cindy and the grandkids safe crossing the river on 47 and crossing 126
to get into our neighborhood. Without your help, we would not have been able to use the
carriage.
We greatly appreciate your help. Your assistance was truly above and beyond the normal
course of daily responsibilities. You had 2 cars escorting the carriage over the river, and
another waiting at Mill St. and 126 to escort the carriage into our neighborhood.
My Mom-in-Law felt like royalty having your assistance.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS, PROVIDING FOR LIQUOR CONTROL
WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality in
accordance with the Constitution of the State of Illinois of 1970 and has the powers granted to it by law;
WHEREAS, the Liquor Control Act of 1934, 235 ILCS 5/1 - 1 , et seq., (the "Liquor Control
Act") sets forth a comprehensive system for the regulation of liquor control within the state of Illinois,
and authorizes broad powers to municipalities with regard to local retail licenses; and
WHEREAS, the City Council of the United City of Yorkville has determined that it will
promote the public health, safety and welfare, and that it is in the best interests of the City to amend the
regulations pertaining to the sale of liquor as set forth in the City Code of the United City of Yorkville as
set forth herein.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Section 3-3- 12-A of the City Code is hereby amended by deleting paragraph lb. in its
entirety and replacing said paragraph with the following:

Permitted Hours of Sale
Monday through Thursday 6:00 a.m. to 1 :00 a.m.
Friday and Saturday 6:00 a.m. to 2:00 a.m.
Sunday 10 :00 a.m. to 1 :00 a.m.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF
YORKVILLE, KENDALL COUNTY, ILLINOIS
WHEREAS, the United City of Yorkville (the "City") is a non home-rule municipality pursuant
to the Constitution of the State of Illinois of 1970 and with such powers as granted to it by law;
WHEREAS, the Liquor Control Act of 1934, 235 ILCS 511 - 1 , et seq., (the "Liquor Control
Act") sets forth a comprehensive system for the regulation of the sale and distribution of liquor within
the state of Illinois, and grants broad powers to municipalities with regard to local retail licenses; and
WHEREAS, the City Council of the United City of Yorkville has determined that it is in the
best interests of the public health, safety and welfare of its residents to amend the regulations pertaining
to the sale and distribution of liquor as set forth in the City Code of the United City of Yorkville as
hereinafter, set forth.
NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1. Section 3-3- 19 of the City Code is hereby amended by deleting said section in its
entirety and replacing with the following:
3-3-19 : TRAINING REQUIRED :
A. All holders of any class of liquor license within the city shall require all employees, who serve, sell
or distribute alcoholic liquor to successfully complete a Beverage Alcohol Servers and Sellers
Eduction Training (BASSET) certified training class.
B. Commencing January 1 , 2009, all applications for a liquor license or renewal of a liquor licensee
shall list all employees who serve, sell or distribute alcoholic liquor and include copies of BASSET
certificates for each employee named on the list. Additionally, the licensee will maintain copies of
all BASSET certificates on the licensed premises for inspection by the city.
C. A request for an extension to complete BASSET certified training for all employees who serve, sell
or distribute alcoholic liquor or a new employee may be made in writing to the local liquor
commissioner for a period not to exceed three months.
D. Failure to comply with the provisions of this Chapter may subject the licensee to the penalties for
violation of this Chapter, up to and including revocation of the license.
Section 2. This Ordinance shall be in full force and effect upon its passage, approval, and
publication as provided by law.

AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE UNITED CITY OF

NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of
Yorkville, Kendall County, Illinois, as follows:
Section 1, Title 5, Chapter 2, Section 5, of the United City of Yorkville Code of Ordinances is
hereby amended by deleting it in its entirety and replacing it with:
5-2-5: RUNNING AT LARGE
It shall be unlawful to permit any dog to run at large with or without a tag
fastened to its collar, within the corporate limits of the city, unless the dog is on
property owned by the dog' s owner. Any dog found upon any public street,
sidewalk, alley or any unenclosed place shall be deemed running at large unless
the dog is firmly held on a leash or is in an enclosed vehicle.

Reference: Truancy Ordinance
Now that we have the adjudication hearing process implemented in the city, I would like to re-submit my
proposal from last year, that the city enact an ordinance regarding truancy. Many cities have ordinances on
truancy, and they are working great. Currently, we do not have a system in place that we can use to enforce
truancy. I think the adjudication process would be a great place to handle truant children.
Truancy leads to community problems that include underage drinking, underage smoking, burglary, criminal
damage, retail theft and disorderly conduct. School attendance is beneficial to the community because it
provides the community with a pool of educated workers and lowers the crime rate.
Working with SRO Hart, we have come up with a sample ordinance (see attached). We have also spoken to a
City Attorney in Ottawa (Ottawa uses this same system to process truancy), and they feel that the ordinance
and the enforcement powers of the adjudication system work great in this matter.

(a) It shall be unlawful for any person under the age of 18 years who is enrolled in a
public, private, or parochial school to absent himself or herself from attendance at school during

or valid cause.
(b) It shall be unlawful for a parent, legal guardian or other adult person standing in loco
parentis to allow a person under the age of 18 years who is enrolled in a public, private or
parochial school to absent himself or herself from attendance at school during such period when
public, private or parochial schools are in session.
(c) A valid cause for absence from school shall include illness, observance of a religious
holiday, death of immediate family member, family emergency or any other situation beyond the
control of the person so absenting himself or herself from school, provided that parental
permission for absence due to such cause is obtained, in writing, from the parent and is
submitted to the proper school authorities, according to their regulations, within twenty-four (24)
hours after such absence, not including weekends.
(d) Parental permission, as required by this Section, shall refer to and include
permission obtained from a parent, legal guardian or other adult person standing in loco parentis
and having custody and control over such person under the age of 18 years.
(e) Each day or portion thereof that such person under 18 years of age absents himself
or herself from school attendance shall constitute a separate offense and shall be punishable as
such.
(f) Each day or any portion thereof that such parent, guardian or person acting in loco
parentis allows a person under 18 years of age to absent himself or herself from school
attendance shall constitute a separate offense and shall be punishable as such.

I talked with Don Urnaza at Bill Jacobs Chevrolet. They have three 2008
white Impala police package vehicles at their location for $ 19 ,061 . 31 The 2009
Chevrolet Impala has gone up in price by $ 280 . 00 , possible delivery date is February,
2009 .
I also talked with Lyle Snow from Landmark Ford . They have two white
Ford Crown Victorias at the dealership for $ 20, 695 . 00 . Lyle told me that the State of
Illinois is going to award the contract tomorrow and he is hoping to get it. Cutoff for
ordering 2009 Fords is March 1 , 2009 , If I can add any further please let me know .

A. It shall be unlawful for any person to sell, keep, expose for sale, loan or give away
any toy pistol, toy gun, toy cannon, blank cartridge, or any fireworks, firecrackers,
torpedoes, bombs, squibs, rockets, pinwheels, fire balloons, Roman Candles,
detonating canes or ammunition therefore, or any substance of articles of any
explosive nature designed or intended to be used as fireworks,anywhere in the city.
B. It shall be unlawful for any person to be possessed of or to discharge anywhere in the
city any of the items enumerated in the above paragraph of this code; provided,
however, that they mayor and city council may issue a permit for the discharge of
fireworks and for pyrotechnical displays.

5-3-9 POSSESSION OF PAINT OR MARKER WITH INTENT TO DEFACE
UNLAWFUL
A. Absent express permission to the contrary by the owner or other person having
control thereof, it shall be unlawful for any person to possess with intent to deface a
spray paint container, liquid paint or any marker containing a fluid which is not water
soluble and has a point, brush, applicator or other writing surface of one-half inch or
greater, in any public building or upon any public facility or property.

Section 1. Title 5, Chapter 3 , of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 10:
5-3-10 REMOVAL OF GRAFFITI
Within seven (7) days of written notification from the city, the owner of any property
upon which graffiti has been placed shall remove same. Failure to remove the graffiti
within seven (7) days of written notification, unless an extension of time is granted, shall
cause the city to remove the graffiti and the property owner shall be liable to the city for
the reasonable cost of the removal. Upon application to the city, an extension of time to
remove the graffiti may be granted due to weather and temperature limitations or
availability of chemicals, but in no event shall any extension exceed ninety (90) days.

Yorkville, Kendall County, Illinois, as follows:
Section 1. Title 5, Chapter 3 , of the United City of Yorkville Code of Ordinances is hereby
amended by adding the following new Section 11 :
5-3-11 CANNABIS
A. Cannabis includes marijuana, hashish and other substances which are identified as
including any parts of the plant Cannabis Sativa, whether growing or not; the seeds
there of, the resin extracted from any part of such plant; and any compound,
manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin,
including tetrahydrocannabinol (THS) and all other cannabinol derivatives, including
its naturally occurring or synthetically produced ingredients, whether produced
directly or indirectly by extraction, or independently by means of chemical synthesis
or by a combination of extraction and chemical synthesis; but shall not include the
mature stalks of such plant, fiber produced from such stalks, oil or cake made from
the seeds of such plant, any other compound, manufacture, salt, derivative, mixture,
or preparation of such mature stalks (except the resin extracted there from) fiber, oil
or cake, or the sterilized seed of such plant which is incapable of germination.
B . It shall be unlawful for any person knowingly to possess any quantity of any
substance containing cannabis, except that the effect of this section shall be limited to
persons knowingly possessing two and a half grams or less of any substance
containing cannabis.
C. The provisions of this section shall not apply to:
1 . Any person who has been authorized by the department of mental health and
developmental disabilities, with the approval of the department of law
enforcement o possess and deliver substances containing cannabis.
2. Persons registered under federal law to conduct research with cannabis.

amended by adding the following new Section 12 :
5-3-12 RETAIL THEFT (SHOPLIFTING)
A. Definitions
For the purpose of this article, the words and phrases defined in this
section have the meanings ascribed to them unless a contrary meaning is
clear from the context:
Conceal. To "conceal" merchandise means that, although there may be
some notice of its presence, that merchandise is not visible through
ordinary observation.
Full retail value. The merchant's stated or advertised price of the
merchandise.
Merchandise. Any type of tangible personal property.
Merchant. An owner or operator of any retail establishment or any agent,
employee, lessee, consignee, officer, director, franchise, or independent
contractor of such owner or operator.
Minor. A person who is less than eighteen ( 18) years of age, is
unemancipated and resides with his parents or legal guardian
Peace officer. Any person who by virtue of his office or public
employment is vested by law with a duty to maintain public order to make
arrests for offenses whether that duty extends to all offenses or is limited
to specific offenses.
Premises of a retail mercantile establishment. Includes, but is not limited
to, the retail mercantile establishments, any common use areas in shopping
centers and all parking areas set aside by a merchant for the parking of
vehicle for the convenience of the patrons of such retail mercantile
establishment.
Shopping cart. Those push carts of the type or types which are commonly
provided by grocery stores, drugstores, or other retail establishments for
the use of the public in transporting commodities in stores and markets
and, incidentally, from stores to a place outside the store.
Under-ring: "Under-ring" means to cause the cash register or other sales
recording devices to reflect less than the fall retail value of the
merchandise.
B. Offense of retail theft
A person commits the offense of retail theft when he knowingly:
1 . Takes possession of, carries away, transfers or causes to be carried away
or transferred, any merchandise displayed, held, stored or offered for sale
in a retail mercantile establishment with the intention of retaining such
merchandise or with the intention of depriving the merchant permanently
of the possession, use or benefit of such merchandise without paying the
full retail value of such merchandise; or
2. Alters, transfers, or removes any label, price tag, marking, indicia of value
or any other markings which aid in determining value affixed to any
merchandise displayed, held, stored, or offered for sale, in a retail
mercantile establishment and attempts to purchase such merchandise
personally or in consort with another at less than the full retail value with
the intention of depriving the merchant of the full retail value of such
merchandise; or
3 . Transfers any merchandise displayed, held, stored or offered for sale,
in a retail mercantile establishment from the container in or on which such
merchandise is displayed to any other container with the intention of
depriving the merchant of the full retail value of such merchandise; or
4. Under-rings with the intention of depriving the merchant of the full retail
value of the merchandise; or
5 . Removes a shopping cart form the premises of a retail mercantile
establishment without the consent of the merchant given at the time of
such removal with the intention of depriving the merchant permanently of
the possession, use or benefit of such cart; or
6. Represents to a merchant that he or another is the lawful owner of
property, knowing that such representation is false, and conveys or
attempts to convey that property to a merchant who is the owner of the
property in exchange for money, merchandise credit or other property of
the merchant; or
7. Uses or possesses any theft detection shielding device or theft detection
device remover with the intention of using such device to deprive the
merchant permanently of the possession, use or benefit of any
merchandise displayed, held, stored or offered for sale in a retail

mercantile establishment without paying the full retail value of such
merchandise; or
S . Obtains or exerts unauthorized control over property of the owner and
thereby intends to deprive the owner permanently of the use or benefit of
the property when a lessee of the personal property of another fails to
return it to the owner, or if the lessee fails to pay the full retail value of
such property to the lessor in satisfaction of any contractual provision
requiring such, within 10 days after written demand from the owner for its
return. A notice in writing, given after the expiration of the leasing
agreement, by registered mail, to the lessee at the address given by the
lessee and shown on the leasing agreement shall constitute proper demand.
C. Presumptions
If any person:
1 . Conceals upon his person or among his belongings, unpurchased
merchandise displayed, held, stored or offered for sale in a retail
mercantile establishment; and
2. Removes that merchandise beyond the last-known station for receiving
payments for that merchandise in that retail mercantile establishment,
such person shall be presumed to have possessed, carried away or
transferred such merchandise with the intention of retaining it or with the
intention of depriving the merchant permanently of the possession, use or
benefit of such merchandise without paying the full retail value of such
merchandise.
D. Detention
Any merchant who has reasonable grounds to believe that a person has committed
retail theft may detain such person, on or off the premises of a retail mercantile
establishment, in a reasonable manner and for a reasonable length of time for all
or any of the following purposes:
1 . To request identification;
2. To verify such identification;
3 . To make reasonable inquiry as to whether such person has in his
possession unpurchased merchandise and, to make reasonable
investigation of the ownership of such merchandise.
4. To inform a peace officer of the detention of the person and surrender that
person to the custody of a peace officer.

5 . In the case of a minor, to inform a peace officer, the parents, guardian, or
other private person interested in the welfare of that minor of this
detention and to surrender custody of such minor to such person.
A merchant may make a detention as permitted herein off the premises of a retail
mercantile establishment only if such a detention is pursuant to an immediate
pursuit of such person.
E. Affirmative defense
A detention as permitted in this article does not constitute an arrest or an unlawful
restraint, as defined in 720 ILCS 5/10-3 , nor shall it render the merchant liable to
the persons so detained.
F. Value of goods
This article shall apply to goods having a value or full retail of one hundred fifty
dollars ($ 150.00) or under.

5-3-13 DISORDERLY CONDUCT
A person commits disorderly conduct when he knowingly:
a. Does any act in such unreasonable manner as to provoke, make or aid in making a
breach of peace; or
b. Does or makes any unreasonable or offensive act, utterance, gesture or display
which, under the circumstances, creates a clear and present danger of a breach of
peace or imminent threat of violence; or
C. Refuses or fails to cease and desist any peaceful conduct or activity likely to
produce a breach of peace where there is an imminent threat of violence, and
where the police have made all reasonable efforts to protect the otherwise
peaceful conduct and activity, and have requested that said conduct and activity
be stopped and explained the request if there by time; or
d. Fails to obey a lawful order of dispersal by a person known by him to be a peace
officer under circumstances where three or more persons are committing acts of
disorderly conduct in the immediate vicinity, which acts are likely to cause
substantial harm or serious inconvenience, annoyance or alarm; or
C. Assembles with three (3) or more persons for the purpose of using force or
violence to disturb the public peace; or
f. Goes about begging or soliciting funds on the public ways without having first
secured a permit therefor; or
g. Appears in any public place manifestly under the influence of alcohol,
narcotics or other drug, not therapeutically administered, to the degree that
he may endanger himself or other persons or property, or annoy persons in
his vicinity; or
h. carries in a threatening or menacing manner, without authority of law, any
pistol, revolver, dagger, razor, dangerous knife, stiletto, knuckles,
slingshot, an object containing noxious or deleterious liquid, gas or
substance or other dangerous weapon, or conceals said weapon on or
about the person or vehicle; or

Section 1. Title 5 of the United City of Yorkville Code of Ordinances is hereby amended by
adding the following new Chapter 7 :
5-7-1 PARENTAL RESPONSIBILITY:
A. Failure to exercise parental responsibility. It shall be unlawful for the parent or legal
guardian of an unemancipated minor residing with such parent or legal guardian to
fail to exercise proper parental responsibility by allowing or permitting such minor to
commit any violation of a city ordinance concerning battery, curfew, disorderly
conduct, fireworks, indecent exposure, intimidation, possession of spray paint or
permanent markers with intent to deface, obscene conduct, vandalism, trespass,
truancy, loitering, use or possession of tobacco products, cannabis, or air rifle.
B . Presumption. A parent or legal guardian shall be presumed to have allowed or
permitted the minor to have committed a violation of a city ordinance under all of the
following conditions:
1 ) The minor has been either adjudicated to be in violation of any as described in
paragraph A above; or has been charged with the violation of any as described
in paragraph A (except if found not liable); or has incurred non-judicial
sanctions from any peace officer, police officer, or conservator of the peace
resulting from an admission of guilt to an offense of an ordinance as described
in paragraph A above; and
2) The parent or legal guardian has received a written notice by certified mail
(return receipt requested) or by personal service in substantially the following
form:

FROM: Yorkville Police Department
You are hereby notified that (minor' s name) has been involved in the
commission of (specify offense), which is a violation of a city ordinance. If
your minor child is again involved in a violation of city ordinances involving
battery, curfew, disorderly conduct, fireworks, indecent exposure,
intimidation, possession of spray paint or permanent markers with intent to
deface, obscene conduct, vandalism, trespass, truancy, loitering, cannabis, or
any other offense of willful or malicious nature to persons or property within
the next two (2) years, you will be charged with parental irresponsibility.
3) The minor, within two (2) years of the receipt of the notice by the parent or
legal guardian, has been either adjudicated to have committed, has been
charged with the violation (except if found to be not liable), or has admitted to
have committed any violation of any ordinance as described in paragraph A
above.
5-7-2 The following terms shall have the meaning ascribed to them for the purposes of
this section:
1 ) Legal guardian means a person appointed guardian or given custody of a
minor by a court, but it does not include a person appointed guardian or given
custody of a minor under the Juvenile Court Act, as amended, in the State of
Illinois.
2) Minor means any person who has not yet attained the age of eighteen (18).
5-7-3 SUPERVISION:
It is the policy of the United City of Yorkville to permit the city prosecutor to use
the provisions of the Unified Code of Corrections, as amended, of the State of
Illinois pertaining to supervision in order to further the ends of justice, restitution,
and purposes of this section.
5-7-4 APPEARANCE OF PARENTS :
It is the policy of the city that a parent or legal guardian of the minor be notified
and required to appear whenever that minor is charged with a violation of a city
ordinance which requires a minor's appearance. To this end it is hereby directed
that a notice in substantially the following form be sent to the parents or legal
guardians of the minor:
LEGAL NOTICE
TO: (Parent's Names)
FROM: Yorkville Police Department
You are hereby notified that (minor' s name) has been charged with an offense
which is a violation of a city ordinance, and which required the appearance of said
minor. You are further notified that one of the parents of said minor must appear
before the case will be tried or be disposed.
If you fail to appear, the city has the power to issue a subpoena or assess a fine.
