Public Hearing: Requested by Petitioners 1 . Attorney Dan Kramer was present on behalf of the petitioner and asked that the Hearing be opened and then continued until the next meeting. He stated they did not have a Plan Council recommendation yet, but all necessary notices have been published. A motion was made by Holdiman and seconded by Adams to open the Hearing. It was approved unanimously by voice vote. There was no one else present who wished to Page 2 of 4 speak regarding this petition. Jones then moved and Holdiman seconded to continue the Hearing until February 13, 2008. Approved on a voice vote. New Business: 1 . PC 2007-27 Lincoln Prairie This item had been tabled at the December 12, 2007 Plan Commission meeting. Travis Miller summarized the decisions from the last meeting and said that the preliminary plan had been approved at the December meeting. The final plan was tabled due to additional requests from the engineer. Among those requests was a field tile survey—now completed. Other information requested has now been received according to a January 8a' memo from Bill Dunn. Miller said there is still concern regarding the impact of stormwater on adjoining properties after it enters field tiles. He said the Illinois Drainage Law governs what an owner can do with a property and the impact on other properties. In Mr. Dunn's memo, he suggests obtaining written consent from adjoining property owners regarding the alternative stormwater design solution. City Attorney Kathy Orr will render an opinion on this suggestion. According to Miller, although the plan is consistent with the zoning and preliminary annexation, the issue is the temporary alternative stormwater management during the first phase of the project, in lot 2 and 3 in the north central part of the property. The temporary solution is to transfer water to an area in the southern portion of the property instead of to the facility. Lindblom commented that the legality of the stormwater issue is beyond the authority and expertise of the Plan Commission. Baker also expressed concern regarding the temporary water solution and the ability to monitor the progress without it becoming lost. After discussion, Miller suggested a positive recommendation subject to the staff report, legal opinion and resolution of the engineering issues. He is confident with the plat and that the alternative stormwater solution is environmentally sound. Miller added that the overflow would only be used until the site develops. Jones was concerned about possible legal challenges for the Plan Commission. Concerns over potential fuel spills and chemicals at the site, were raised by Schillinger. John Philipchuck, Attorney, said there are two triggers in this project: 1 . Construction of public road (part of overflow area) 2. Attempt to secure easement across the adjoining properties, talks have begun with property owners Page 3 of 4 An exhibit showing the temporary storage area was displayed by Eric Gram ud of the SEC Group. Schillinger questioned if there was any special filtering since chemicals will be used. A bio-swale and a gravel-covered surface with catch basins will be constructed. All resulting sediments will flow to a wet pond. A grease and oil interceptor will be constructed for the truck wash area. Granrud told the Commission members that the operator of this plant has not had a violation in over 20 years at their Mt. Prospect facility. Sue Hanson, a property owner at Faxon and Eldamain expressed concern regarding where the permanent drainage will go. She said there is an extremely low area on her property north to Menards' where water collected last spring. The property will drain to the east across Eldamain according to Granrud. She also had concerns about her well and increased traffic. Granrud said the 14-acre site of this proposed facility will also have a well and septic and all contaminants will be contained under very rigorous standards. Alderwoman Robyn Sutcliff asked if the IDNR had been contacted since the overflow of the stonnwater could potentially drain to Rob Roy Creek. She also questioned how often the State checks/inspects the facility. IDNR has been contacted and the State is in charge of permits for this facility. The local Fire Marshal conducts yearly inspections according to Granrud. The City would issue building permits and the business also must obtain permits with respect to air pollution. There was no further discussion and a motion was made by Lindblom to recommend acceptance of the final plat. Jones seconded the motion. This motion is subject to legal opinion, resolution of the engineering issues and also subject to the staff report and recommendations. PC 2007-40 Yorkville Town Center — Concept Plan Attorney Robert Kenny was present on behalf of Raycorp for the Yorkville Town Center plan. He said they wish to change the zoning on 25 acres of the development that is located near on Rt. 47 and 71 on the southwest corner. Currently the zoning is R2 and they wish to change that to B3 due to the commercial nature of that intersection. The full access lines up with the Sunflower development. Baker said he had concerns with the ingress/egress of the property behind outlot H when it develops. Attorney Kenny said the property owner had been spoken with. Schillinger noted that he would like to see connectivity between the existing property and the proposed development. He further stated that there have been many discussions on ways to limit stop signs and lights for better traffic flow. Page 4 of 4 Schillinger also added that although the City needs commercial and open space, he does not feel this development will have a low impact. There will be many cars due to the gas station and a potential grocery store and he felt these factors would change the nature of the nearby Forest Preserve. Chairman Lucietto summarized the points made and there was no further discussion. 2. Update of Comprehensive Plan Advisory Committee Meeting on December 20, 2007 by Anne Lucietto Ms. Lucietto noted that the meeting dates will change—they will alternate between Wednesdays and Thursdays every other month. She asked Commission members to be facilitators for the meetings. Lindblom commented that he thought it would be more beneficial to have City staff members assume that role for continuity. The next meeting is January 23rd Senior Planner Stephanie Boettcher then continued the summary. She said the first meeting topic was natural resources and six goals were identified. The next meeting topic will be infrastructure/water/sewer. The following night is the Plan Commission Consortium to discuss historic planning. Ms. Lucietto asked for any input on this topic. Additional Business: Travis Miller said the Open Lands Conservation Group will sponsor a conference on February 15` and 2nd to discuss farmland conservation and preservation. Anyone interested in attending should contact him. According to Lynn Dubajic, the Home Depot store will be opening early February and she mentioned some of the other businesses scheduled to build there. An open-air area is still scheduled for the Rt. 34/Cannonball area. She also said Target is expected to open late Spring and two other national chains are negotiating with the City. Schillinger asked about the progress of the Wa1Mart store. Many approvals are needed for this 11 -month build project and Ms. Dubajic hopes for a 2009 opening. Hattner Annexation and Zoning The petitioner gave a brief description of the two concept plans for the 80 acre subject property. Concept A has approximately 14 acres of commercial, 70 townhomes and 90 single family lots. Concept B has 28 acres of commercial, 70 townhomes, and 58 single family lots. Both concepts had two access points, one on Penman Road and the other on Route 47. The transitional use of townhomes is to never to exceed 14 acres, but the petitioner would like flexibility to allow end user to increase or decrease commercial as desired. Travis Miller commented that Concept A fit better into the Comprehensive Plan. He also suggested that the commercial retail be changed to commercial office which would fit better with the residential lots on the property. The commercial buildings should follow the same architectural guidelines/style to the residential buildings. Joe Wywrot acknowledged that the closest collector road would be Wheeler. He also commented that approximately 0.25 — 0.5 acres in the southwest corner of the property should be reserved for a pumping station. Anna Kurtzman commented that spacing, specifically for the townhomes, should be included in the terms of the P.U.D agreement. Travis Miller commented that both concept plans should show trails running the length of Route 47 and Penman Road. He also mentioned that since the petitioner had not been in touch with the Aux Sable Group from the Conservation Foundation, that recommendations given by that group for the property should be included in the P.U.D agreement for implementation on the subject property. Joe Wywrot had concerns with the access to the first lots from the Penman and recommended a shared lot, removal of the lots, or the removal of the boulevard feature at the entrance/exit from Penman. Brendan McLaughlin commented that Concept Plan B has a better road alignment which allows for road sharing ability for the parcel north of the subject property. He suggested that this road alignment be used for both concept plans and allows for less traffic thru the townhome acreage. He also mentioned that additional single family homes are better for the community and a less intense commercial use is easier to step directly to single family without needing townhomes. Eric Dhuse mentioned that there is a ComED right of way on the east side of Route 47, so there will be additional right of way running the length of Route 47 on the subject property. Travis Miller requested that since the petitioner was not comfortable with removing the townhomes, since they do not have an end user, that the petitioner should prepare a third option without the townhomes and show all three to the plan commission. The P.U.D. agreement should also be structured to give preference to single family. Brendan McLaughlin mentioned that green design should be encouraged for the subject property. This item will be on the February 13, 2008 Plan Commission Agenda and the February 28a' Park Board Agenda. The petitioner is also responsible for resubmitting three concept plans (Plan A to be revised with road realignment and Plan C created which does not have townhomes) by February 1 , 2008. Shales South of the Fox (Windmill Farms) The petitioner presented 4 concept plans for the subject property. The petitioner addressed the major changes made since the initial concept plan was brought before Plan Council and Plan Commission in July/August 2007. The changes consistent on all of the concept plans are a revised internal roadway network along with increased spacing of 750 ' between full access points along Route 126. Lot 25 was identified as a difficult parcel since the property adjacent to it is not included in the subject property. The difference between all four concept plans is the reconfiguration of the assisted living facility, townhomes and offices uses in the southwest corner of the subject property. The roadway running along the southern portion of the property west of Route 126 was identified as a potential "cut-thru." Joe Wywrot commented that that the full access point could be moved to the southern part of lot 25; however it would reduce the spacing between the full access points. Travis Miller mentioned that the banquet facility, seen on plan C, could tie into the retail on lots 23 and 24, allowing for the potential for the roadway to be omitted. Eric Dhuse identified the road linking the subject property to RainTree Village, south of the property, has multiple access points along what could become a thru road, along with massive driveway cuts for the townhomes as seen on Concept Plan C. It was decided that this road should be designed to discourage thru traffic. Anna Kurtzman identified that the assisted living facility should be better integrated as part of the plan. There should be a synergy between the assisted living and the commercial particularly the restaurant uses and the daycare. The concept plans need to identify pedestrian linkages between these facilities. The development should take on a town center feeling with the assisted living facility being a thread. The assisted living facility also has the ability to share parking with commercial or office uses which should be addressed in the P.U.D agreement language. Travis Miller stated that all of the concept plans were lacking a civic feel and were very conventional. He emphasized that he did not want to miss out on a special opportunity not only for Yorkville, but also for the developer. Anna Kurtzman questioned how the non-included parcels in the subject property can be potentially integrated into the property at a later time. She mentioned that access should be required for lot 25 along with suggesting that an attempt should be made to acquire non-included parcels prior to the development east of Route 126 developing. It was confirmed to the petitioner that a recapture agreement was appropriate for this issue. William Dunn stated that the full access point is very important especially since the petitioner does not have lot 17 included in project. The petitioner mentioned that IDOT was comfortable with the spacing of 750', but Dunn pointed out that the petitioner would need a full commitment from IDOT prior to securing retailers for the property. Joe Wywrot inquired about offsite alignment studies, particularly seeing an aerial for Penman road alignment. A 10' trail should be included on the east side of Route 126, even for non-included parcels. Also, the petitioner should provide an internal circulation plan. Dave Mogle stated that a trail would be desired along Penman Road as it aligns with the forest preserve. Anna Kurtzman questioned the petitioner about architectural features and how the property will tie together. She informed the petitioner to think about signage as the sign ordinance is currently being revised along with making mention of special uses (gas station and daycare) in the P.U.D. agreement. Joe Wywrot mentioned there potentially may be a lift station onsite, but the property located south of Route 126 can use gravity for sewer. Reference the Regional Water Main Plan which states there is a need for a booster station in the area. Petitioner to provide two concept plans (concept plan 1 and concept plan 2) to the Plan Commission on February 13, 2008 and the Park Board on February 28, 2008. The petitioner does not need to resubmit plans; however staff will recommend at plan commission that the concept plans resemble a town center. The Comprehensive Plan, for Suburban Neighborhood, states: "Suburban Neighborhood is intended to be a residential area primarily comprised of single- family detached residences.. .gross density in this classification should be between 1.50 and 2. 25 dwelling units per acre. Developments requesting densities above 2. 0 dwelling units per acre shall illustrate compliance with the Design Guidelines of this Comprehensive Land Use Plan Update. In addition .. . the developer must also demonstrate their ability to add specific improvements such as: assist with funding offsite City infrastructure improvements, integration of architectural standards that exceed the City 's current standards, landscaping, and increased allocation of open space beyond City requirement. " Conceptual Development Plan A • Proposed land uses are not consistent with the Comprehensive Plan. The Conceptual Development Plan A calls for 14 acres of commercial running the length of Route 47 with 14 acres of townhomes buffering the 51 .87 acres of single family from the commercial. ■ The single family area has a density of 1 .79 dwelling units per acre, while the townhome area has a density of 5.0 dwelling units per acre. The combined gross density for the residential areas is 2.52 units per acre which exceeds the intended density of the Suburban Neighborhood Land Use. Conceptual Development Plan B • Proposed land uses are not consistent with the Comprehensive Plan. The Conceptual Development Plan B calls for 19 acres of commercial running the length of Route 47, 8.97 acres of office east of the commercial, 9.94 acres of 15,000 sgft single family lots, and 40.99 acres of 12,000 sgft single family lots. • The single family area has a gross density of 1 .55 dwelling units per acre. Conceptual Development Plan C • Proposed land uses are not consistent with the Comprehensive Plan. The Conceptual Development Plan C calls for 14 acres of commercial running the length of Route 47, and 65.87 acres of 13,000 sqft single family lots. • The single family area has a gross density of 1 .58 dwelling units per acre. Staff Comments/Recommendations: • The petitioner is seeking approval of a pre-annexation agreement and would like the agreement to allow flexibility for future developer to determine the highest/best use of the property following one of the 3 proposed land plans submitted. • Although the Comprehensive Land Use plan recommends Suburban Neighborhood along this property's frontage of Route 47, staff acknowledges that single family homes may not be the best use along Route 47; however the Comprehensive Plan establishes commercial nodes at major intersections with supporting residential uses in between. Staff has concern with allowing commercial use in this location at the same intensity as that of the `nodes' to the north and south of this property, and therefore recommends the non- residential use along Route 47 be limited to less intense commercial and/or office land use. The Annexation Agreement should include provisions that control the architectural design of these buildings to be single story and be consistent with residential architectural styles. Signage should also be limited for this reason as well. • The proposed density in Concept A density exceeds the suggested level for suburban neighborhood, primarily due to the townhome component of the plan. As recommended by the Comprehensive Plan, densities exceeding 2.0 dwelling units per acre must follow the design guidelines in the Comprehensive Plan. Staff recommends a provision in the Annexation Agreement stating this as well as including these guidelines as an exhibit to the agreement. • Aux Sable Creek comments: • Aux Sable Creek is a Class A stream. Floodplain restoration will be required, including one or more of the following; de- channelization of the creek, stream bank erosion stabilization, naturalized seeding of floodplain, and a three year maintenance and management plan. • Due to the sensitivity of the Aux Sable Creek Watershed, additional methods for Non-Point Source Pollution prevention will be necessary. Meetings with The Conservation Foundation will be necessary to determine how the development fits with the master open space/green infrastructure plan. Permits may be required from the IEPA. • Best Management Practices shall be used in all applicable areas. • Improvements enhancing the Aux Sable Creek should be required and should follow the guidelines outlined by the Mid Aux Sable Creek Watershed Plan currently being prepared by the Conservation Foundation. o A cross-section of the Aux Sable Creek depicting typical improvements/enhancements should be prepared and included as an exhibit to the Annexation Agreement. • Access to the proposed lot at the southwest corner of the Penman Road entrance is limited by the proposed median in all concepts. The design should be such that each lot has access to street from either direction. • The access drive entering the property from Route 47 (northwest corner) of each concept plan should allow for cross-access/shared entrance with the property to the north — a note on the concept plan and/or a provision in the agreement should address this. ■ YBSD recommends in the current sanitary sewer expansion plan that a lift station be located in the vicinity of this property. Staff recommends a provision to the annexation agreement to provide/address this facility. • The trail design should include the trail and pedestrian bridges over the Middle Aux Sable Creek for both Route 47 and Penman Road trails. Funding and construction of these bridges should be divided with future development south of the Creek — provisions addressing this should be included in the Annexation Agreement. This property is not currently contiguous to the United City of Yorkville . Therefore, annexation would be subject to this property achieving contiguity through the ultimate annexation of adjacent properties. 3 . The roadway configuration , as revised , conforms to the recommendations that came out of the City's Plan Council meeting of January 24, 2008. 4. The content of the proposed concept plan generally meets the requirements of the City's Subdivision Control Ordinance. Water and sanitary sewer service are not readily available in this area of the City. A regional wastewater pump station is planned near the area of IL Route 47 & Aux Sable Creek. The developer should contact the Yorkville-Bristol Sanitary District or its consulting engineer to obtain the most current planning documents and information regarding wastewater conveyance and treatment. 6. It appears that all buildings within this proposed development would fall in the City's Pressure Zone 3. There are some areas of the parcel that fall within Pressure Zone 4; however, these areas all appear to lay in stormwater management areas. It should be noted that City Standards call for developments to have two sources of potable water in order to maintain reliable service. 7. Improvements to IL Route 47 should be anticipated the developer. The Illinois Department of Transportation (IDOT) will have jurisdiction over the design of the access locations on IL Route 47 as well as any state highway improvements deemed necessary. 8. Similarly, the developer will be responsible for improvements to Penman Road in accordance with City Standards. 9. The location and limits of regional bike trails should be verified with the City's Parks and Recreation Department. The relocation of ComEd facilities may impact the proposed trail location. 10. It is likely that jurisdictional wetlands will lie in the Aux Sable Creek Floodway. A wetland delineation and jurisdictional determination should be anticipated as part of the design process of this property. 11 . When this project advances to preliminary engineering, please note that all intersections of right-of-way lines should form a radius rather than right angles in accordance with the city's Subdivision Control Ordinance. Plans) Comprehensive Plan recommendations for the property: The 2005 Comprehensive Plan Update, Southern Study Area, proposes five land uses for the subject property, • Commercial use south of Route 126 and the western half of the PUD north of Route 126 (west of existing Wing Road) • Transitional Neighborhood use east of Wing Road • Neighborhood Retail use surrounding the intersection of Route 71 and the proposed Penman Road extension • Suburban Neighborhood use east of the intersection of Route 71 and the proposed Penman Road extension in the eastern portion of the PUD fronting Route 71 . • Park/Open Space use in the southwest portion of the PUD area. Two land uses comprise the majority of the subject property, Commercial and Transitional Neighborhood. The Comprehensive Plan, for Commercial, states: "Commercial Land Use . . . intends to promote market-sensitive development of commercial uses within strategically located areas to efficiently, effectively, and conveniently serve the growing local population while reinforcing the importance of the United City of Yorkville as a regional center. " The Comprehensive Plan, for Transitional Neighborhood, states: "The Transitional Neighborhood establishes a medium-density setting that includes a mix of residential uses within master planned communities. These master planned communities can have neighborhoods of varying densities, open spaces and carefully integrated commercial uses. .. Transitional Neighborhood can be designed to provide intermediary space between lower density residential areas and non-residential areas allowing greater flexibility of development adjacent to areas subject to development pressures. Gross residential density ... should be between 2.25 and 3. 50 dwelling units per acre. " Staff Comments/Recommendations: • When the concept plan was brought before staff and the Plan Commission in July/August of 2007, concerns were raised in regards to the full access point proposed on Route 126 south of the Route 71 /Route 126 intersection. This spacing was not consistent with the IDOT spacing standards and it was suggested by staff to modify the plan to comply with MOT standards. The current Conceptual PUD Plans propose two full access points along Route 126 south of Route 71 . The spacing has been increased from 500 feet to approximately 740 feet, which remains to be deficient from IDOT standards, however, staff recommends supporting the spacing request to MOT based on the current land plan. • Staff recommends the concept plan(s) include future access points to, and through the three ` not included' areas depicted on the plans to ensure these properties will be able to develop in conformance with the layout of the proposed Windmill Farms development plan. • Design Guidelines from the 2005 Comprehensive Plan Update, Southern Study Area should also be required of this PUD, particularly focusing on one architectural style to serve as a cohesive element among the PUD. The more intense commercial/retail uses occurring around the two major intersections in the PUD, Route 71/Route 126 and Route 71 /Proposed Penman Road could include taller buildings, potentially second/third floors and architectural elements enhancing the ` nodes' . The Transitional uses along the periphery of the PUD should have a more residential character, single story and reflective of the surrounding residential architecture in conjunction with the PUD architectural character. • The Comprehensive Plan identifies Route 71 and Route 126 as "gateway corridors." Given this distinction, attention should be given to the landscaping along these routes along with providing trails/sidewalks to connect into the surrounding residential properties' networks. Signage design and locations should also be addressed in the Concept PUD by providing general guidelines and design theme. • Special Uses o The Concept Plans each propose a Gas Station and Daycare use which are defined as special uses by the Zoning Ordinance. The `Design Guidelines' are listed below for this Land Use: • Any development or redevelopment shall conform to all City regulations regarding their use • As most development will be redevelopment of existing sites,the distinct character of the (Transitional Residential)Neighborhood will be vulnerable to change. Therefore, all development must be carefully designed to fit the character of its existing surroundings. • Existing residential and commercial uses should be preserved. Residential properties fronting on arterial streets may be used for professional or service offices, or for small retail shops consistent with the character of such uses in the downtown area. Findings Necessary for a Zoning Amendment shall be based on the following: a. Existing uses of property within the general area of the property in question. b. The zoning classification of property within the general area of the property in question. c. The suitability of the property in question to the uses permitted under the existing zoning classification. d. The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning classification. e. (Ord. 1976-43, 11-4-76) Staff Comments: 1. The B-2 zoning classification requested is appropriate and supported by the Comprehensive Plan for this property. 2. The use proposed will be within the existing structure and therefore have a minimal architectural impact on the surrounding character. 3. Allowable signage should be more restrictive than that allowable within the B-2 zoning classification to ensure the property remains in context with the surrounding neighborhood. ■ Recommend requiring the following signage regulation not within the current sign ordinance in the form of a Development Agreement between the City and the Petitioner. 1. No signage may be internally illuminated; 2. No pole signs permitted on the property (one (1) wall and/or one (1) ground sign only) 3. Maximum sign area of any sign shall be no more than thirty-two (32) square feet. 4. The existing structure will encroach the B-2 required setback from Route 47 by 14.83 feet. Background/Need for new Public Hearing Notices of the July 11, 2008 Plan Commission public hearing for the Kalant rezoning request were not sent via certified mail to the surrounding property owners in advance of the July 11, 2007 hearing. Based on this, Kathleen Field Orr, City Attorney has advised to conduct a new public hearing. The chronology of events related to the Kalant property rezoning: May 11, 2007 Received application requesting to rezone property June 21, 2007 Plan Council reviewed petition and forwarded to Plan Commission July 11, 2007 Plan Commission held Public Hearing and forwarded recommendation to City Council July 17,2007 EDC reviewed the Plan Commission recommendation and raised concern regarding parking adjacent to the Town Square Park— requested petitioner to address and return to August EDC August 21, 2007 EDC reviewed site plan,petitioner addressed concerns regarding parking and reviewed a draft Development Agreement. EDC forwarded to COW/City Council August 28, 2007 COW/City Council—Approved rezoning to B-2 and approved execution of Development Agreement Last week in Staff received call from adjoining property owner regarding November business activities in the home on the property—the resident explained they had not received notification of the public hearing. Staff researched to verify if all notices were published and mail properly—it was verified that the property owners within 500' of the property had not been notified by certified mail. December 4,2007 Staff reviewed the case with Kathleen Orr who advised to re- conduct the public hearing and ensure notices are mailed as required. Notified the petitioner's attorney and explained the need to conduct a new public hearing. Given this distinction, attention should be given to the landscaping along this route along with providing trail/sidewalk to connect into the surrounding properties. Findings Necessary for a Zoning Amendment shall be based on the following: a. Existing uses of property within the general area of the property in question. b. The zoning classification of property within the general area of the property in question. c. The suitability of the property in question to the uses permitted under the existing zoning classification. d. The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning classification. e. The impact that such reclassification and/or annexation will have upon traffic and traffic conditions on said routes; the effect, if any, such reclassification and/or annexation would have upon existing accesses to said routes; and the impact of additional accesses as requested by the petitioner upon traffic and traffic conditions and flow on said routes. (Ord. 1976-43 , 11 -4-76) Staff Comments: • The property is currently regulated by the Villas at the Preserve PUD Agreement which includes residential/duplex use. Rezoning to B-3 will require an amendment to the PUD Agreement. • Signage design and locations should also be addressed in the PUD by providing general guidelines and design theme. • The proposed concept plan labels an outlot as a ` Gas Parcel' . A gas station is not a permitted use within the B-3 zoning district but is permissible as a Special Use. The Plan Commission could recommend this special use be included in the PUD amendment upon the Plan Commission finding: 1 . The establishment, maintenance or operation of the special use will not be unreasonably detrimental to or endanger the public health, safety, morals, comfort or general welfare. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the neighborhood. 3 . The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. 4. Adequate utilities, access roads, drainage or other necessary facilities have been or are being provided. 5 . Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets. 6. The special use shall in all other respects conform to the applicable regulations of the district in which it is located, except as such regulations may in each instance be modified by the City Council pursuant to the recommendations of the Plan Commission. City Engineer United City of Yorkville 800 Game Farm Road Yorkville, IL 60560 Re: Yorkville Town Center Concept Plan Review United City of Yorkville, Kendall County, Illinois Dear Mr. Wywrot: We have reviewed following materials submitted for the above-referenced project: • Concept Plan for Rte. 71 & Rte 47 prepared by MeritCorp, P.C. consisting of one (1 ) sheet dated December 28, 2007 • Application & Petition for Zoning dated December 28, 2007 • Application & Petition for Concept Plan Review dated December 28, 2007 GENERAL COMMENTS 1 . The proposed land use for this development, B-3 Highway Business, does not conform to the current Comprehensive Plan's land use designation for this area. The Comprehensive Plan designates this area as Transitional Neighborhood which would seem more appropriate with Harris Forest Preserve lying immediately west of this proposed development. 2. The existing P. U. D. Agreement for this property approves residential land use. The requested land use change would require an amendment to the P.U. D. Agreement. 3. The name and address of the owner or developer should be should be shown on the Plan. 4. The approximate dimensions and area of the parcel should be shown on the plan. Consulting Engineers Specializing in Civil Engineering and Land Surveying 5. Complete topography and existing contours should be shown in this Plan. All existing wooded areas, wetlands, watercourses and drainage ways should also be shown as should existing buildings, existing utilities and proposed utility extensions. 6. We know from previous reviews of this property that this site contains wetlands, drainage routes that bisect the property and areas where existing grades exceed normal design parameters. None of these features have been illustrated on the concept plan. Existing wetland areas are being shown as a developable out lot. No wetland mitigation areas are shown on the Plan. It does not appear that any of these factors have been considered during the preparation of this Concept Plan. 7. Improvements to IL Route 71 fall under the jurisdiction of the Illinois Department of Transportation and will be required of the developer. It is expected that these improvements will include the installation of traffic signals at the entrance to the subdivision as depicted on the concept plan. 8. Easements will be required to bring water and sanitary service to this parcel. Cross-access easements will also be required from the commercial property lying east of the subject parcel. SUMMARY If the proposed zoning for this property is deemed acceptable by the City, we recommend that the developer resubmit the concept plan, complying with the requirements set forth in the checklist found in Article 6.01 .01of the United City of Yorkville's Subdivision Control Ordinance. Additionally, special attention should be given to the comments listed above.
