ZBA 2008-05 American Sign & Lighting Company, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting approval for 50 sq. ft. ground sign on a lot that is less than 3 acres, Section 8-11-9A I. The real property address is 102 Beaver Street, Yorkville, Illinois, 60560. 2. ZBA 2008-06 G.B. Illinois 2, LLC, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting relief from several sections of the City of Yorkville Sign Code. The real property is at the southeast corner of Route 34 and Eldamain Road, Yorkville, Illinois, 60560. 3. ZBA 2008-07 John Paravola, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting relief from Sections 10-11-4 A, requiring the enclosure of certain parking spaces, and Section 10-713-8C, exceeding the number of apartments allowed in a business building, of the Yorkville Municipal Code. The real property address is 119 and 125 West Hydraulic Street, Yorkville, Illinois, 60560. 4. ZBA 2008-08 CMP Properties & Development, LLC, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting a variance to the Yorkville Zoning Ordinance, Chapter 10, Section 2.13, seeking reestablishment of residential use after a (12) month period of discontinued use. The real property consists of approximately 2.9acres at 11925 Route 34, Yorkville, Illinois, 60560. Roll Call: Roll call was taken and a quorum was established. Previous Meeting Minutes: August 6, 2008 and September 3, 2008 Funkhouser moved to approve both sets of minutes as presented with a second by Clementz. Travis Miller noted that in the August 6'h minutes, page 3, paragraph 6, it should say City Council, not Committee of the Whole. The minutes were then approved on a voice vote. Public Hearings: Clementz moved and Moe seconded a motion to enter into Public Hearing. Approved on a unanimous voice vote. This item was continued from the September 3, 2008 ZBA meeting. 1. ZBA 2008-04 Joe Lusk, petitioner, filed an application requesting reductions in setbacks in the front yard from 30 ft. to 25 ft., Section 10-6C-4A; and a reduction in the side yard setback from 30 ft. to 3 ft.,3 in., Section 10-6C-4B. The property address is 308 Walnut St. Page 2 of 3 On a motion by Funkhouser and second by Clementz, the Public Hearing was opened. Passed unanimously on a voice vote. Mr. Lusk gave a very brief overview of the improvements he will make to this house. Attorney Heimsoth added that a room addition would be made at the northeast corner and the garage would be in the back. The structure pre-dates the zoning code and Mr. Lusk is trying to square off the house and make improvements to make it more attractive and valuable for the neighborhood. JoAnn Gryder spoke on behalf of her aunt Jean Bryant who owns property adjacent to the Walnut St. property. They asked if the driveway would in fact be switching from Walnut to Fremont. The driveway will be moved and Chairman Baker noted that issue had been addressed and will now be part of the petition as it moves along to City Council. There was no further comment and the Hearing was closed on a motion and second by Skinner and Funkhouser respectively. Discussion Skinner commented that although the property is non-compliant, the petitioner should not be forced to tear out the foundation. Travis Miller then reviewed the Finding of Fact with brief comments from the committee including discussion about whether or not a sidewalk would need to be built. Travis said it is not a requirement of the building permit. Motions Chairman Baker noted that 2 motions would be required. Skinner moved and Funkhouser seconded the motion to approve ZBA 2008-04 requesting a reduction from 30 feet to 25' in the front yard setback. Roll call vote: Moe-abstain; Skinner-yes; Funkhouser-yes, Clementz-yes, Baker-yes. Motion passed. Since this committee is not authorized to grant a variance for the second part of the petition, Skinner made a motion to recommend approval of the second part of ZBA 2008-04, reduction in the side yard setback from 30 feet to 3 feet, 3 inches. Clementz seconded this motion. Roll call vote: Skinner-aye; Funkhouser-aye; Clementz-aye; Moe-abstain; Baker-aye Motion passed. This matter now moves to the City Council on October 14 th at 7pm. Page 3 of 3 Additional Business: 2. ZBA 2009 Submittal Deadlines The 2009 ZBA submittal deadlines and ZBA meeting dates were reviewed. A motion was made by Moe and seconded by Funkhouser to approve this schedule, with the motion passing unanimously on a voice vote. Other: Skinner noted possible issues with the Parkview Christian School sign on Rt. 47 and a portable sign across from the Chapel on the Green. He noted there are other signs in town that are non-compliant and since the code has been adopted by the City Council, those signs should be addressed. Miller commented that pre-existing, non-conforming signs are still legal and the new ordinance does not require replacement of those signs. He will verify if the sign on Rt. 47 was there prior to the adoption of the new ordinance and report back to the committee. Baker added that the portable sign was installed after signs at the former Fox Valley Shopper location were requested to be removed. Funkhouser said that Dick's Sporting Goods (Kendall Marketplace) has a possible non- approved sign on the rear of their building. Miller said the PUD included some signs, but the rear sign was not approved under the PUD. It was reported that HRM Properties has not come back to the City for a property sign for Rte. 47 and 126. There was a brief discussion of the distribution method of the ZBA packets--email, CD, etc. Anna Kurtzman has forms to fill out for the committee members preferred means of receiving the packets. There was no further business and a motion was made by Skinner to adjourn the meeting with a second by Funkhouser. Motion passed unanimously on a voice vote. Adjourned at 7:46pm. A public hearing has been scheduled before the Zoning Board of Appeals to be held on Wednesday, December 3, 2008, at 7:00 pm at City Hall (800 Game Farm Road). Please note that this hearing will be conducted in the Conference Room. REQUEST: The applicant, American Sign and Lighting Company, on behalf of Merlin Corporation (owner), has filed a request seeking relief from Section 8-11-9A1, increasing the size of a free standing sign from 32 sq ft to 50 sq ft(an increase of 18 sq ft). The petitioner's application, including details regarding the requested variances, is attached. CONDITIONS: This 2.3 acre property is zoned B-3 and the new Merlin Muffler Shop is under construction at this location. The surrounding properties are zoned and used as indicated below: Zoning Use North M-1 Fire Station South B-3 Undeveloped East M-1 Manufacturing West B-3 Lawn Care Service STANDARDS FOR GRANTING A VARIANCE: Section 8-11-13 of the Municipal Code provides direction regarding the processing of sign variances. This section indicates that the Zoning Board of Appeals is to consider two sections of Zoning Board of Appeals Case#ZBA 2008-05 November 21. 2008 Page 2 of 3 standards before making a recommendation. The first set is outlined in Section 10-14-5 of the Zoning Code and the second set is outlined in Section 8-11-13. These standards are listed below: Section 10-14-5 (Zoning Code) 1. Because of the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out. 2. The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. 3. The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. 4. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger to the public safety, or substantially diminish or impair property values within the neighborhood. Section 8-11-13 (Sian Code) 1. If the sign was erected legally with a sign permit. 2. If there are any unique physical characteristics of the property 3. If there are limited available locations for signage on the property 4. The cost to the applicant of complying with the sign ordinance requirements 5. if the sign is on or faces a street with a forty (40) mile per hour or higher speed limit. 6. if the sign is on a street with 20,000 or higher vehicle trips per day. 7. if the sign would be blocked by existing or required landscaping. 8. If it is a wall sign facing a public right-of-way without a public entrance. DECISSION Upon closing the hearing, staff requests that the Zoning Board of Appeals make findings based upon each of the standards listed above for each variance being sought. The purpose of the standards is to Zoning Board of Appeals Case#ZBA 2008-05 November 21. 2008 Page 3 of 3 help guide you in making your decision. This section indicates that the Zoning Board of Appeals is to consider two sections of standards before making a recommendation. The first set is outlined in Section 10-14-5 of the Zoning Code and the second set is outlined in Section 8-11-13. These standards are listed below: Section 10-14-5 (Zoning Cade) . Because of the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out. 2. The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. 3. The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. 4. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. 5. Because the South Elevation does not specifically face a public right-of-way, under the Code, the Applicant would not be permitted to place any wall signage on the South fagade of the building. A sign designed so that characters, letters or illustrations can be changed manually or electronically without altering the face or surface of the sign. Electronic message boards must have a minimum duration time of twenty-four hours and no transition effects." (e) Requested Departure: Applicant requests a 15 minute interval as opposed to a 24 hour interval on its electronic message board. On lots less than three acres with one (1) street frontage, one (1) free standing business sign thirty-two square feet or less in area and eight(8) feet or less in height shall be allowed. If the lot has more than one street frontage, one (1) free standing business sign thirty-two square feet or less in area and eight (8) feet or less in height per street frontage with an entrance/exit shall be allowed. On lots three acres or larger with one (1) street frontage, one (1) free standing business sign sixty square feet or less in area and eight feet or less in height shall be allowed. If the lots have more that one street frontage, one (1) free standing business sign sixty-four square feet or less in area and eight(8) feet or less per street frontage with an entrance/exit shall be allowed. Applicant Response: The proposed CVS Pharmacy development will occur on comer lot within the existing Cobblestone Corners commercial development. As demonstrated by the Site Plan, access to the Applicant's development will occur primarily through a full access to the south of the development and through the right in/right out access and full access to the East. Under the subdivision layout as approved by the United City of Yorkville,there will exist no direct access to the actual lot where the CVS development will occur. Therefore, given that direct access to the CVS site is limited, signage becomes even more critical so that potential customers of the CVS are drawn to the development even though a direct and convenient access may not exist. A hardship exists necessitating that CVS Pharmacy be allowed W:IWORK1362131Rider to Application For Variance Request-vCdoc 3 to display appropriate signage indentifying its products and services to the community who may not otherwise access the site given the layout configuration. In addition,the signage proposed by CVS is typical of signage displayed by other retailers in the area and is critical to enabling CVS to remain competitive in the marketplace. Lastly,given the traffic anticipated on Route 34 and along Eldamain Road,the signage allows for motorists to safely traverse this intersection while at the same time being given the opportunity to safely ascertain and digest the abbreviated messages advertising the CVS Pharmacy. (b) The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. Applicant Response: The physical hardship conditions pertaining to the Applicant's proposed CVS Pharmacy development are unique given that the development is anticipated to be situated on a corner lot with no direct access. Its messages are also typical of what is utilized by competitive pharmacies through the Chicago metropolitan area. (c) The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. A public hearing has been scheduled before the Zoning Board of Appeals to be held on Wednesday, December 3, 2008, at 7:00 pin at City Hall (800 Game Faire Road). Please note that this hearing will be conducted in the Conference Room. REQUEST: The applicant, John Paravola. on behalf of Full House Ventures (owner), has tiled a request seeking relief from Section 10-11-4A of the Municipal Code, which requires that half of the required parking spaces for apartments be enclosed. The applicant is seeking 100% relief from this requirement (if the variance is granted then all required parking would not be enclosed). The applicant is also seeking relief from Section 10-713-8C. This section states that, for each business, there can be no more than 2 apartments located on the second floor. If a companion special use request is approved by the City Council, there would be one business left in this building with a total of 3 apartments located upstairs (and a total of 5 apartments in the building). It should be noted that the Plan Commission's recommendation is in regards to the use, whereas the ZBA's recommendation will be based upon the ratio between the number of commercial units verses the number of apartment units. CONDITIONS: This 7.626 sq ft property is zoned B-3 and is improved with a two story building. The first floor of this building has historically had 3 commercial uses with the second floor having 3 apartments. As noted above, the petitioner has also filed a special use permit to allow some of the first floor units to be converted to residential uses. The Plan Commission has heard this request and is recommending to the City Council approval (with a 3-2 vote) of the request, with a suggested condition providing a sunset provision (i.e., the residential uses on the first floor would cease after a specific period of time, in this case, the Plan Commission is recommending 3 years.) Please note that this hearing will be conducted in the Conference Room, REQUEST: The applicant, CMP Properties and Development LLC (owner), has filed a request seeking relief from Section 10-10-2B of the Municipal Code. This section of code stipulates that when a non- conforming use ceases to exist for at least 12 months then that use may not be re-instated. When this property was annexed and zoned B-3 the house was used as a residence and thus, it was considered to be a non-conforming use at that time. The residential component ceased over 12 months ago, as such, the applicant is seeking to re-instate the residential use. CONDITIONS: This 2.92 acre property is zoned B-3 and is improved with a house and out buildings.
