City Council Minutes 2013 08-27-13 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS 800 GAME FARM ROAD ON TUESDAY, AUGUST 27, 2013 Mayor Golinski called the meeting to order at 7 : 04 p .m. and led the Council in the Pledge of Allegiance . AMENDMENTS TO THE AGENDA Mayor Golinski tabled item # 1 under Public Works Kendall Marketplace Infrastructure_(PW 2013 -36), item # 1 under Economic Development Committee Ordinance Approving a Fourth Amendment to the Redevelopment Agreement for the Downtown Yorkville Redevelopment Project Area (Imperial Investments, LLC) (EDC 2013 -28), and item # 2 under Plan Commission Grande Reserve Amendment to the Amended Annexation and PUD Agreement (PC 2013 -07). Alderman Koch made a motion to approve the agenda as amended; seconded by Alderman Funkhouser. Amendment approved unanimously by a viva voce vote. PRESENTATIONS Government Transparency Award presented to the City by the Illinois Policy Institute Mayor Golinski called Brian Costin up to the front. Mr. Costin presented the City with a Government Transparency Award. Mr. Costin told the Council about the Illinois Policy Institute and the award. Recognition of Lions Club for their Donation of a Shelter at Bridge Park Mayor Golinski called Don Hirsch from the Lions Club up and presented a plaque to him in recognition of the Lions Club donation of a shelter at Bridge Park. Don Hirsch gave a little background on the Lions Club . PUBLIC HEARINGS 1 . PC 2013 -09 — Mr. Peter Occhipinti, Petitioner and Owner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting annexation by an annexation agreement for an approximately 0 . 87 acre parcel of land located in unincorporated Kendall County. The subject property is generally located east of Illinois Route 47, immediately south of McHugh Road, and just west of Farmstead Drive in Kendall County, Illinois. It is proposed that the subject property be zoned within the City' s R-4 General Residence District for a future multifamily residence development. 2 . PC 2013 - 12 — An amendment to that certain Annexation Agreement (Prestwick of Yorkville Subdivision) dated April 26, 2005 by and among Yorkville Farms Development, LLC. (Owner/Developer), an Illinois Limited Liability Corporation, and the United City of Yorkville, Kendall County, Illinois, for the purpose of amending the agreement regarding a re-subdivision of Lot 358 for a private high school with accessory uses, recalculation of impact fees, revised school and park land-cash fees, extension of fee and ordinance locks and other miscellaneous site development improvements related to the proposed school land use . The proposed accessory uses and improvements may include a retail school store; an equestrian arena and stable; cellular telephone tower; wind turbine; electronic scoreboard, public address system, lighting and concession/restrooms for athletic fields; outdoor storage of farm equipment, grain bins and greenhouses; street parking along Mustang Way and delayed construction of on-site parking; The Minutes of the Regular Meetine of the City Council — August 27, 2013 — Page 2 of 4 school bus parking and garage; an off-premise electronic school identification sign; and building height exceptions. 3 . CITIZEN COMMENTS ON AGENDA ITEMS Kathy Neddo, a citizen, thanked the Council for doing a great job over the past year. Jim Motto, citizen, is one of the four houses in the subdivision that will be affected by the new high school . He stated the Stewarts have been very forth coming with information. He discussed the dangers of Route 126 . He is concerned about his neighborhood's covenants and the property value of his home . CONSENT AGENDA 1 . Kane/Kendall Council of Mayors (KKCOM) Surface Transportation Program (STP) Project Application — authorize staff to submit 2013 Call for Projects application for Mill Street LAFO projectfunding (PW 2013 -37) Mayor Golinski entertained a motion to approve the consent agenda as presented. School Board The Minutes of the Regular Meeting of the City Council — August 27 2013 — Page 4 of 4 Alderman Funkhouser reported on the school board meeting. Middle school curriculum and scheduling issues were discussed, along with the high school expansion. Alderman Funkhouser relayed a compliment from the school to Public Works Director Dhuse and his staff. Push for the Path Alderman Teeling reported that the Push for the Path golf outing is coming up on September 28 , 2013 . STAFF REPORT Hometown Days Director of Park and Recreation Schraw and Mayor Golinski reported on Hometown Days and gave a brief overview of the events . ADDITIONAL BUSINESS Farmers Market Alderman Milschewski discussed the turnout for the Saturday morning farmer's market. Director of Park and Recreation Schraw will look into this issue. Administrator Olson said the EDC had directed the Park Board to come up with recommendations to improve the farmer's market. Senior Services Fashion Show Mayor Golinski stated that he was going to be a fashion model for the Senior Services Fashion Show on Sunday September 15 , 2013 . EXECUTIVE SESSION Mayor Golinski entertained a motion to go into Executive Session for the purpose of 1 . For the discussion of minutes of meetings lawfully closed under the Open Meetings Act, whether for purposes of approval by the body of the minutes or semi-annual review of the minutes. My name is Tom Lilla , 14 I live at 649 Heartland Drive , and we met up with 15 the Plan Commission two weeks ago . 16 Well , first of all I want to start 17 by saying thanks for giving us the opportunity to 18 speak . I ' m kind of here tonight on behalf of my 19 family , myself , and the neighbors of Heartland 20 subdivision . 21 We came a couple weeks ago and 22 talked to the Plan Commission about this 23 particular petition , and the piece of property 24 that ' s in question or that ' s before the - - you Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 5 1 guys are talking about today is - - backs right up 2 to my house , and I ' ve got young children , and 3 there is a proposal on there that the gentleman 4 who owns the property would like to annex it and 5 have it zoned general residence for a future 6 multifamily development . 7 Kind of went through some of my 8 concerns last time ; I don ' t know if you want me 9 to list them , but we ' re definitely against that . 10 It ' s a single family home area . 11 Everything on McHugh Road is single home all the 12 way down to Main Street . I have eight - foot tall 5 weeds behind my house , pretty unsightly . 6 I ' m really kind of embarrassed to 7 invite people over to my very nice home because 8 they have to look at this horrible looking 9 property behind me . 10 Came home one night last year to the 11 weeds on fire because the renter decided rather 12 than cut the weeds , he would light them on fire 13 to get rid of them . 14 I don ' t think that this has any 15 place as a multifamily dwelling . This gentleman 16 cannot keep his renter under control now ; what ' s 17 he going to do when he has a multifamily 18 residence ? 19 The Plan Commission voted five to 20 nothing against this . James Weaver , who is on 21 the Plan Commission , called this property an 22 eyesore . I think that ' s a little mild ; I would 23 call it more like a blight . 24 This needs to be rejected . My name is Robbin 11 Arnfelt and I live at 661 Heartland Drive . These 12 are my neighbors , so our three properties are the 13 fortunate ones that adjoin this . 14 I don ' t have a whole lot new to say , 15 but I wanted to emphasize when I moved into the 16 Heartland subdivision , it was for the nice , safe 17 family surrounding for my children to walk the 18 sidewalks and feel safe in there , and when you 19 start to look at what could happen to that 20 property back there , the idea of a multifamily 21 housing unit - - depends on the condition it ' s 22 kept in obviously , but it just starts to feel 23 like it ' s going to start to take on the 24 neighborhood , especially if it ' s lower income , Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 9 1 and I have terrible concerns over the way the 2 property ' s been maintained over the last several 3 years , too , as Rich mentioned . 4 The weeds every year is a major 5 project for me as the weeds creep into my yard 6 and I have to deal with it . 7 When no one was living on the 8 property for a while it became overrun with 9 rabbits and mice and we all had to do special 10 things in our window wells to protect ourselves 11 from that , so it just starts to feel like if 12 somebody can ' t control the existing property , how 13 will they maintain it when there are many 14 families living there . 15 So I wanted to reiterate all the 16 same concerns for safety and the property values 17 in our area , and if you haven ' t been out in that 18 area , I would highly recommend just drive by 19 there . NOBLE : Yes , it was . 8 MAYOR GOLINSKI : It was admitted into 9 the record , so that ' s fine . 10 If there ' s nobody else , I will open 11 it up to the City Council , if you would like to 12 comment now or wait until it ' s before us . 13 Yes , sir . 14 ALDERMAN FRIEDERS : Well , I 15 unfortunately drive by there every day when I 16 pick up my kids from the day care there and I 17 haven ' t been able to safely turn right on McHugh 18 from Farmstead since I ' ve had children , so the 19 one thing is hey , we can annex , we can chop down 20 the tree , but then the outcome further along is 21 kind of what freaks me out . 22 So I hope the tree miraculously 23 falls down or something , but I don ' t see the 24 multifamily dwellings making much sense to me Vitosh Deporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 11 1 personally . 2 MAYOR GOLINSKI : Yes , sir . 3 ALDERMAN COLOSIMO : Yes , I feel the same 4 way as Alderman Frieders . 5 The only way I would annex this 6 property into the city is if we could keep it at 7 R1 , keep it at the most restrictive zoning and 8 then we could enforce our ordinances on this 9 property . I ' d be interested in doing that 10 because it is an eyesore . I drive by it all the 11 time . 12 There ' s some nice colored pictures 13 in our packets for us to view the property , and 14 really the condition of the property is 15 atrocious , so there is no way that we are going 16 to approve this to be a denser property at R - 4 to 17 allow multiple family units to go on this 18 property when just one unit can ' t control itself , 19 so I feel pretty confident that the votes are 20 there and this petition will be rejected when we 21 have the opportunity to vote . 22 MAYOR GOLINSKI . Go ahead . 15 ALDERMAN KOCH : Yeah , I agree with my 16 fellow aldermen and I think Diane had a very good 17 comment ; if we can ' t get this cleaned up , let ' s 18 see if we can get the county to help get it 19 cleaned it up . 20 MAYOR GOLINSKI : Okay . Enough said . 21 ALDERMAN FUNKHOUSER : Not that I ' m in 22 favor of changing the - - allowing this to be 23 multifamily , but are we missing the obvious that 24 if we annex this , we have property standards and Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 13 1 controls over this property to alleviate the 2 eyesore issue that is on this property currently ? 3 The traffic problem that is 4 currently there , we can work with that . We have 5 issues that we can ' t control . They are out of 6 our control right now . We have the ability to do 7 that . 8 Is that something to consider the 9 option on this property , to be able to alleviate 10 the problems that do exist there ? 11 MAYOR GOLINSKI : And that ' s a good 12 point , but I still don ' t think multifamily is the 13 answer . I mean , I agree , annexing it R1 would 14 be - - 15 ALDERMAN FUNKHOUSER : R - 4 , yes . R - 1 may 16 be a little more appropriate , R - 4 may be a little 17 aggressive , but something here . 18 Obviously there are some other uses 19 in that area , we have commercial uses , we do have 20 some multifamily down the road a little bit 21 further , so it ' s not out of the realm for what 22 the area is . 23 R - 4 might be aggressive , but in 24 general land planning , this type of use is not �itosh Xeporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 14 1 uncommon , having a major road with multifamily 2 fronting it , single family on the other side . 3 It ' s not uncommon to have that in these type of 4 applications looking at what the surroundings 5 are . 6 ALDERMAN MILSCHEWSKI : Can I just 7 clarify what ' s before us really tonight is just 8 the annexation , but by - - Say we vote on 9 annexation , that is not agreeing to the rezoning . 10 That would be a whole separate matter . 11 MAYOR GOLINSKI : Yeah , go ahead . 12 MR . BINNINGER : I was just - - It is the 13 annexation agreement and it is - - the agreement 14 is conditioned on their receiving R - 4 , so if you 15 don ' t approve the agreement - - If you don ' t 16 approve the zoning , you don ' t approve the 17 agreement . 18 Now , they can always come in and 19 amend that , this is just the focus hearing for 20 this . 21 MR . OLSON : We usually approve them at 22 once , usually authorizing the annexation 23 agreement - - the annexation ordinance and the 24 rezoning ordinance . We are not asking for those 15 items . 16 We understand that if there was an 17 eventuality in the future , something were to come 18 about that we could approach the City , request 19 the appropriate special use permit or various 20 instances as may be , but right now the proposal 21 is we will meet the height limitations of that 22 R - 2 zoning district . 23 A school , as you know , is a 24 permitted use . I know it ' s hard to 12 swallow , but let ' s be fair about it . 13 The ordinance says what does it cost 14 to buy the acre of land improved , that ' s what 15 should be charged , that ' s what should be donated , 16 and it ' s not $ 101 , 000 , it ' s $ 25 , 000 , so I know 17 that ' s a big one to digest , but please look at 18 that appraisal and we can discuss that further . 19 There are some other amendments to 20 the ordinance . We looked at trying to get some 21 of the fees back to where they were in some cases 22 prior to where this agreement was entered into 23 back in 2005 . 24 Most of them we agreed to . We hope that 3 someday there may be 800 , 850 students in the 4 school , but obviously starting out it won ' t be 5 quite that . 6 Rather than going in and building a 7 parking lot now , tomorrow , to serve 800 students , 8 we thought we could do it in phases , so that ' s 9 one of the things we threw out there , and we 10 would like to get started on our land development 11 as soon as possible , so as you have worked with 12 other developers , like the theater , the theater 13 going up over here on 47 , we hope you will work 14 with us so we can get some early dirt permits to 15 try and get in there yet this fall and get the 16 dirt moved before winter sets in , maybe get a 17 foundation in the ground for the new school so 18 that we can be building over the winter months . 19 The various land use considerations 20 that Staff pointed out we concur with as far as 21 the various uses , except , as I said , we did take 22 out some of those that they felt were 23 incompatible , and so as a result Staff was given 24 a revised annexation agreement that shows those Vitosh (Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 25 1 requests as being taken out . 2 The overall tone of the school , if 3 you have seen any of the renderings , it ' s an 4 ag - oriented school if you will to recognize some 5 of the rich agricultural heritage of the 6 Yorkville area , and the fact that there are some 7 folks in the community who will continue to do 8 farming operations and some of these children as 9 they come up will have an opportunity not only to 10 get a good high school education , but to also 11 have some activities that revolve around the 12 architectural heritage of the community in the 13 area , so it ' s very unique . 14 I think it ' s a bold statement by the 15 Stewarts . I think it ' s wonderful that they are 16 willing to undertake this themselves . 17 Obviously any students that we put 18 in this school the taxpayers are not supporting 19 like over here across the street in our public 20 high school , so I think that ' s obviously a good 21 thing . 22 They are reducing the density in the 23 subdivision by doing this by 84 units , so that ' s 24 usually considered a good thing . Mayor , Members of the 20 Council , I am George Mahoney , and I am here 21 tonight representing the Block family , who are 22 really next door neighbors to this property . 23 I practice law incidentally for the 24 record on Main Street with Mahoney , Silverman & Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 28 1 Cross in Oswego , Illinois . 2 And so as I see the issue before you 3 tonight , it ' s really fairly direct because 4 although some people might be talking about is 5 just project finance , that ' s not my client ' s 6 concern . 7 My client ' s concern was really four 8 things , now principally down to two , and the 9 things that were addressed earlier , the 10 elimination of the cell phone tower , the 11 elimination of the generation facilities and the 12 windmill on the site certainly makes some big 13 strides , but the issue before us that we see is 14 really - - is really the stormwater management 15 issues and also the road improvements to Ashley 16 Road and 126 . 17 Our engineer , Chris Burke , is in the 18 process of trying to secure that data , that 19 engineering that was done by the developer ' s 20 attorney - - developer ' s engineer , to study the 21 implication of stormwater management on this 22 site , and at the Plan Commission some of you 23 might have heard that they suggested that there 24 was really no more stormwater management required Vitosh Deporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 29 1 for the site other than what was originally 2 proposed , although at least a third of this 3 property now will be developed either with 4 buildings or parking lots or driveways , and even 5 today , with no development on the site , we are 6 experiencing significant stormwater issues , and 7 so that ' s an issue that we really want to discuss 8 with the City and with the developer so that we 9 are assured - - not in the past experience that 10 you had with property owned by the Blocks , but 11 this experience . that there are no problems with 12 stormwater management on the site . 13 And it seems ironic that when you 14 look at your engineer ' s letter of July 23rd - - 15 and it ' s in your board packet - - it talks about 16 the myriad of things that as yet have not been 17 done , and then when you look at your engineer ' s 18 response of August 14th , there are three items 19 that are addressed , but some very key items 20 remain unaddressed , and so you have to consider 21 from an ordinance standpoint , from a public 22 policy standpoint , what ' s right for your 23 residents , because remaining not addressed is 24 that stormwater management study , remaining Vitosh Reporting Service 8159993 . 2832 cros . vitosh @gmail . com 30 1 unaddressed is the traffic study , at least at 2 that time , not addressed in your engineer ' s 3 letter , where you are going to have projected 800 4 students who are going to be attending this 5 facility , many of them who will be entering on 6 Ashley and many who will be exiting on 126 7 street . The Beacon News talked about an accident 8 again on 126 today . 9 And so is it good public policy when 10 you have so many unanswered questions , when you 11 have your engineer telling you in its August 14 12 letter that the final plat can change , to approve 13 it ? 14 The other issue , though , is really 15 more fundamental and it really gets to the issue 16 of the jurisdiction of your Council , Mr . Mayor , 17 to hear this today , and I ' m referring you to 18 10 - 14 - 8 of your ordinances , and the ordinances 19 talk about for an annexation agreement there has 20 to be notice to the adjoining property owners 21 within 500 feet , and within 24 hours prior to 22 this hearing , the returned receipts from 23 certified mail or registered mail have to be 24 filed with the City . Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 31 1 Your staff can tell you if that ' s 2 done , but if it ' s not , I suggest you can ' t even 3 have this hearing . 4 But take a look at the annexation 5 agreement of 2005 because really what ' s proposed , 6 there are several things that are really 7 significant , and I ' m not saying you can ' t do 8 them , but you have to do them if you want to 9 follow your ordinances and good public policy 10 correctly , and that is really having livestock on 11 an R - 2 residential zoned property under your 12 current ordinance , to have an issue with a retail 13 sales on that property , and I suggest to you that 14 under your current ordinances as it relates to 15 this property , you can ' t do it . 16 So , for example , if you agree that 17 your current ordinances do not permit livestock 18 on residential property , then under your 19 ordinances , under 10 - 14 - 8 of your ordinances , 20 prior to this Council having any hearing at all 21 on an annexation agreement , it ' s got to be heard 22 before the Plan Commission or the Zoning Board of 23 Appeals , depending whether it ' s an amendment to 24 the zoning ordinance or a variance , and then it Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 32 1 comes back here and then this Council sets a 2 hearing on the annexation agreement , and 3 recognize , please , that there was no hearing that 4 I am aware of before either your Planning 5 Commission or Zoning Board , and there are several 6 issues ; for example , the issue of livestock on 7 the property or outdoor parking of farm machinery 8 in a residential district . 9 And so if you believe that your 10 ordinances don ' t allow it , you ' ve got to send it 11 back because your hearing is not appropriate . 12 If you believe that it is and you 13 proceed ahead , the issue you are confronting then 14 is that person in a single family residence in an 15 R - 2 District who decides that it ' s an accessory 16 use , which is what you have been told you can do , 17 it ' s an accessory use to have livestock as being 18 proposed here tonight , and have that person put 19 livestock on their developed single family home 20 because you have established the precedent and 21 have taken the position that it ' s an accessory 22 use , or to say that you can store machinery 23 outside on your property because you have 24 determined by approving the ordinance as it ' s Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 33 1 written that it ' s an accessory use . 2 And so I think you ' re going to say , 3 We don ' t allow that . The residents I spoke to 11 didn ' t necessarily have an objection to the high 12 school , they just had the same issues that we 13 have discussed here tonight , so the first two 14 have really gone a long way to help me on my 15 list ; however , some of the concerns I still 16 have - - And first let me say I am all for the 17 high school . 18 I want to work with the developers , 19 I think it ' s a great idea and I think it does fit 20 a need . I ' ve always been one to believe that the 21 private sector can usually do it better than the 22 public sector and I am a big fan of public - - of 23 private schools . 24 I think what Mr .
