The meeting was called to order at 9 : 00 a.m . by Krysti Noble . The minutes from the last meeting (June 27, 2013 ) were approved as submitted. PC 2013-12 & PC 2013-13 Prestwick of Yorkville Request for Annexation Agreement Amendment and Final Plat : At the request of one of the attendees, Ms . Noble reviewed the General Comments and final Plat of Subdivision comments . On the Architectural Review, she knows she ' s going to get some type of small rendering of elevations, preferably in color for the public hearing process . For general comments, if there is to be any rooftop equipment, it has to be screened; and digital monument signage — as noted — needs a separate detailed signage plan with elevations . Ms . Noble then turned the meeting over to Ms . Morrison to start the Engineering discussion . Ms . Morrison started the discussion by cover referred to the July 23 , 2013 memo to review the four bullet points still required for engineering approval : • Revised storm water management report for the new land use ; 0 Storm sewer sizing calculations ; • Engineers Opinion of Probable Construction Cost for public improvements ; • Revised traffic study i I i II As far as the Revised Traffic Study, they are looking at new uses and differences in volumes for the school area . Mr. Schultz then asked to review the Final Engineering Plans that he felt needed to be addressed. Review of Final EnjjineerinI4 Plans in General : i 2 . He asked if there were any objections to malting Mustang Way one loop . The options are leaving is as two with a break between boulevards or one loop road . Mr. Dhuse assured him there would not be a problem with fire, safety, postal, etc. , because of the grid system ; steering away from the North/South/East/West. 7 . Mr. Schultz said they have provided a landscaping plan; they are still working through a couple of tweaks . It will be forthcoming in their re-submittal . 8 . Because it is so vague, Ms . Morrison said she has gone over it with Bruce and will email with bullet points to Mr. Schultz. i 9 . Mr. Schultz said he has to show easements . 12 . Mr. Schultz said he is going to look at the water main again. I 17 . Sanitary line getting outside parking lot as a future connection . Mr. Dhuse said it was not a public sewer; it will be a service to the school . 18 . Mr. Schultz said the intention is to grade the entire lot. They will take care of clean up . 21 . Mr. Dhuse said Unit 1 has never been tied in and finished . It was temporarily discharging into the ditch of field tile . Mr. Schultz asked if they were required to build the remainder of that storm sewer. Mr. Dhuse thought there was a lot of permeable area. Mr. Schultz would like to re-visit the issue for clarification . 25 . Final Plat Easements — Mr. Schultz is fine with them . - Mr. Schultz looked up the sanitary sewer and pulled the IEPA permit for Phase 1 and found out it was designed for all of Prestwich (356 units) and 250 lots of Hudson Lakes and felt it was over-designed . Now the condition is Hudson Lakes changed from 250 to 235 . The status of the maintenance agreement is still on the owner. - Mr. Schultz then addressed storm water management and essentially found it to be a wash. Mr. Collman said the comments he submitted for the Sanitary District were not the ones in the notes . YBSD reviewed Units 1 & 2 and all the annexation and infrastructure participation fees have been received for Unit 1 . Unit 2 annexation fees have been received; participation fees have not been received . Connection permits and fees will be based on a non-residential formula using fixture count times $ 1 ,400 . IEPA review fess would apply at $ . 50 per lineal foot. Ms . Noble said she would provide a copy those fees . Mr. Schultz said in Unit 2, they are not providing any public sewer; they will be extending a service . i Ili i III Ms . Noble then went back to the annexation agreement to go over the key changes and/or replacements . She said the road contribution fees are established as a policy for collection of transportation improvement and development fees in Kendall County and the ordinance does state that, as a rule, all residential developments would be subject to collection of fees on behalf of the County, even if the development does not have frontage on the county highway. This is because the average trip from nearly every development in Yorkville involves travel on at least one County highway. - Ms . Noble said there would be a Park Board member present at Plan Commission meetings to review the request for the reduction in Land Cash. - Paragraph 4 : It needs to be stated that security will be needed for the proposed high school improvements . The City Attorney wanted to add a paragraph underneath the fees noting, "The owner acknowledges that the donations contained in this agreement and City Code are made voluntarily by the owner and the owner hereby waives for itself and its successors and assigns the right to contest at any time in the future . " The city attorney suggested the agreement expire in 2025 . Ms . Noble then asked that the Accessory Uses be reduced to one ( 1 ) paragraph that encapsulates all the uses; and get significant details on the others since there is no PUD . There was a comment made that the name of the development is going to be changed to "Ashley Pointe . " Ms . Noble confirmed that it would only be for marketing purposes only since the recorded plat is for "Prestwick of Yorkville . " Exhibit E — Fees : Water meter is currently at $435 ; Ms . Noble acknowledged the changes that were made and paid for (BKFD ; the library 50% up front) and is okay with that. t It was asked if there was any concern with the name "Yorkville Christian School Subdivision" in the legal description or if the name "Prestwick" needed to be added. Ms. Noble said it was clearly stated in the legal description — "Unit 1 of Prestwick of Yorkville" — and was more of an engineering question. Ms . Morrison will check and get back with an answer. Ms . Schraw had a comment on the bike trail . She sees on the current plan that they can ask the Park Board regarding the bike trail and Land Cash; but doubted they would accept it because it is a private improvement. She will approach them in the meeting. There are still some funds for the sidewalk. The intention is to connect to the school . Mr. Dhuse suggested Ms . Schraw talk to the school to find out what their plans are . Ms . Noble brought up Mr. Dhuse ' s comments about Mustang Way with perpendicular parking. Mr. Schultz said it was hard to show, but would be in the ROW if there ' s a maintenance agreement (right now it ' s 90' .) In conclusion, Ms . Noble said she would follow up with everyone with a summary of the issues and provide the additional information that was requested. Next meeting will be August 14 — Plan Commission on Final Plat and needs updates as soon as possible . Meeting adjourned . Minutes respectfully submitted by : Bonnie Olsem, Administrative Secretary i i i i i C/" Memorandum EST. `, 1836 To: Plan Council Cowry �O From: Krysti Barksdale-Noble, Community Development Director <CE v` CC: Bart Olson, City Administrator Date: November 8, 2013 Subject: PC 2013-15 &PC 2013-16 Green Organics Rezoning& Special Use Request for Compost Facility I have reviewed the following documents regarding the Green Organics compost and farmland property generally located east of Rte. 47 and south of Galena Road submitted by the petitioner: applications for Rezoning and Special Use; Project Narrative; Non-Residential Site Plan Application; IDNR Termination Letter dated April 25, 2013; WA Termination Letter dated July 19,2013;Engineering Plans dated June 26,2013 prepared by iG Consulting, Inc.; Soil Map, Zoning Map and Site Plan dated October 15, 2013 prepared by Eon Hill Design & Development, Inc.; as well as other related documents and plans associated with the proposed project. Based upon my review, and of other city and local agency staff members, of these plans and documents,the following comments were compiled: General Comments: • Green Organics currently has 57.81 acres of leased land of which approximately 31.88 acres are currently being used for its compost facility of landscape waste and food waste. The operation is located on approximately 15.98 acres of land situated in Kendall County and 15.90 acres of land in Yorkville on land entitled for the Westbury Subdivision. The portion of the property within Yorkville City limits is zoned R-2 One-Family Residence District as part of the Westbury Planned Unit Development (PUD). The petitioner proposes to eliminate 10.5 acres of the currently leased land in Yorkville and reconfigure its operation on approximately 9.5 acres of land within the entitled Westbury Subdivision for the purpose of adding taller wind rows and increasing capacity. Effective January 2010, compost facilities which meet the following criteria are not considered Pollution Control Facilities and are exempt from the local siting process: • Livestock waste in the raw form or in the process of being composted does not exceed 30,000 cubic yards one time capacity of the facility. • All raw materials are placed in an enclosed air and temperature controlled vessel by the end of each day or if: ■ All set backs are met. • All raw materials are processed into wind-rows or piles that prevent scavenging by birds and animals. Per the provided Site Plans, the Petitioner is not seeking to process livestock waste and has designed the site to place all raw materials into wind rows. Verification from IEPA that this compost facility is exempt from local siting is required. Verification is also needed with regards the minimum setbacks, particularly distances from non-farm residences and nearest populated areas. • The current Yorkville operations of Green Organics have been in place since 1999. According to information gathered from the Illinois Environmental Protection Agency (IEPA), a similar composting facility, Scott's Composting, had been operating on the property previous to Green Organics and under different ownership.t • The petitioner is currently leasing land from MILROY FARMS LLC for the portion of its operations in Kendall County and BRISTOL VENTURES, LLC for the portion in Yorkville. • The petitioner is also contemporaneously pursuing a major amendment to their existing Special Use in the County. • This land is going to overlap into Westbury east village. That will need to be addressed, as we might have to amend the Westbury annexation agreement to accommodate them. Compost Facility Operational/Design Comments: • It is staff's understanding that the compost facility will be reconfigured to increase the amount of permitted landscape material (brush, leaves, tree trimmings, grass, etc.) processed from 150,000 cubic yards to 175,000 cubic yards. Clarification is needed regarding if this total capacity is measured per day, per year, or other measurement of time. • A new facility basin is proposed as part of the new reconfiguration to be located in the southwest corner of the site. Detailed plans, inclusive of landscaping to ensure compliance with the Yorkville Park Development Standards will be required. Is this already occurring with the existing basin? If so, how is the water to be reused? • The proposed new berm surrounding the site will require additional detail with regard to proposed cover and landscaping. It is staff' s understanding that the County will be requiring the maintenance of plantings on the existing berm and ditch. I • The answers to the special use questionnaire assume no negative impact to surrounding property as they are just "reconfiguring the property." They are reconfiguring the property and increasing their maximum annual yardage by 25 ,000 cubic yards . I would assume that there is an incremental negative impact on surrounding property when their maximum capacity increases 16%. I predict this will be a major complaint from residents during our approval process . • According to the petitioner, the compost facility currently provides a host fee to Kendall County which ranged from $0 .60 to $0 . 70 per ton of landscape waste on a monthly basis in the past. Yorkville will request a similar host fee agreement for the proposed reconfigured operation . Weight receipts shall be provided to the City to confirm such reported tonnage . • According to the IEPA, the compost facility should not exceed the Illinois Pollution Control Boards standards for decibel levels at the property line . What are those levels and are they consistent with the city' s performance standards . • Staff has received and reviewed the Natural Resource Information (NRI) Executive Summary Report 1305 dated November 6, 2013 and prepared by the Kendall County Soil f & Water Conservation District which addresses natural resource concerns related to the proposed reconfigured compost facility on local soils and water. The findings of their report states the site is well-suited for agricultural uses . • Staff has contacted the IEPA seeking to obtain any copies of violations or complaints . A FOIA was completed on November 2, 2013 . We are awaiting the results . We have also contacted the County and verified that they have not issued any violations or received any complaints . • Staff is recommending the following operational conditions to be consistent with the County' s current and proposed Special Use conditions : o A plat shall be kept on file indicating the location of all operations and processes (i .e . , receiving/processing area, composting area for the windrows, preliminary and final cure areas for compost storage prior to screening) . o The facility operator shall provide up-to-date copies of the State permit and related documents including Operational Plan changes (if any), copies of complaints/violations taken or issued by the IEPA and/or the County Solid Waste Coordinator. o Operational Personnel shall be present on site during times when the facility is open for business . An emergency contact for the facility available 24 hours a day shall be provided to the City and updated anytime such personnel changes . o Lock-box keep shall be provided to the Bristol Kendall Fire District (BKFD), if not already, as well as the Building Department for emergency situations . • Authorized United City of Yorkville personnel shall be allowed on the premises during business hours for inspection and testing, if required. • All results from required water and soil samples which are to be taken by an independent laboratory and provided to the Kendall County Environmental Health Department, will also be provided to the United City of Yorkville's engineer to remain on file. • The County is proposing to have a sunset clause in their Special Use approval for a term of ten (10) years ending on December 1, 2023 with petition renewal made prior to July 1,2023. • Staff typically is not in favor of sunset clauses as part of special use agreements; however, in some circumstances a time limit on such uses could be justified. If we are to recommend a time frame for the operation, it would only be sensible to be consistent with the terms of the contract lease between the petitioner and BRISTOL VENTURES, LLC which is for a period of five (5) years for the portion of the land within the City of Yorkville. Comprehensive Plan/Zoning Comments: • The petitioner is seeking to rezone the property from R2 PUD (as part of the Westbury East Village Subdivision) to Al- Agricultural District. Currently, the Zoning Ordinance identifies"filling of holes,pits or lowlands with noncombustible material free from refuse and food wastes" as a Special Use in the R2 District via Section 10-613-2. However the petitioner's operation does not include filling of land, but rather creation of mounds or wind rows.Additionally,the operation will include refuse and some food waste material. • The Al Agricultural District would be the most compatible zoning to accommodate the proposed compost facility operation as a Special Use, and is similarly zoned A-1 Special Use in Kendall County. • The existing land use and zoning for the properties surrounding the subject property are as follows: Zoning Land Use Description North A-1 Agriculture Unincorporated Kendall County South A-1 SU Agriculture Unincorporated Kendall County East R2 PUD Agriculture Westbury East Village(Yorkville) West M-3 SU Manufacturing Unincorporated Kendall County • The 2008 Comprehensive Plan Update designates the subject property as "Suburban Neighborhood" which is intended to be a residential area primarily comprised of single- family detached residences. • The Westbury Village Annexation and Planned Unit Development Agreement designate this portion of the subdivision where the reconfigured compost facility will be located for single-family residences. I I Westbury Village Annexation Agreement: • The Westbury Village Annexation and Planned Unit Development Agreement was originally approved in 2002 and subsequently amended in 2004 (the property was annexed in 1997) . The development comprised of 300 acres with a mix of single-family, multi-family and commercial land uses . • Only Unit 1 or Pod 6 was approved for Final Plat and recorded . This portion of the development is located in the southeast section of the development and consisted of approximately 19-acres comprising of 200 units . Partial construction has begun on this area of the subject property, but has since ceased . The remaining areas of the Westbury Village development, inclusive of the subject parcels are un-platted . • It was acknowledged at the time of the Westbury East Village annexation agreement that the compost facility was operating on the property. In paragraph 3 : Zoning on page 4 of the Annexation Agreement reads, in p art, " . . . The existing uses on the Property may continue to operate as non-conforming uses until such time as a final plat is approved for j the affected portion of the Property. We cannot and do not assume responsibility for design errors or omissions in the plans. There are several items that will be required before we can recommend Final Engineering approval. Property owner of record information shall be included on the Cover Sheet, 2 . Plans shall be signed and sealed by a Registered Professional Engineer. 3 . A project bench mark that is in close proximity to the site should be provided . 4 . An overall plan of the facility shall be provided in the plan set with the existing area , proposed expansion area and area to be removed from the facility identified and quantified . 5 . Existing zoning information shall be shown on the site and adjacent properties . 6 . A site data table shall be added to the plan . 7 . Construction of, the proposed detention basin is not in conformance with United City of Yorkville standards as indicated in the South Berm Cross-Section . The proposed detention pond construction shall be in accordance with the United City of Yorkville Park Development Standards, refer to Section 5 : Detention and Retention Basins. i 8 . We would recommend the side slopes on the proposed perimeter screening berm not exceed 3: 1 . j 9 . Grading/contours shall be provided along the west and south sides of the proposed expansion area to show how the proposed grades will match existing . In some cases the vertical difference between existing and proposed grades is in excess of 10 feet. 10 . A detail/cross-section for the east berm referenced on the plan shall be included on the plans . 11 . A stage-storage discharge table for the proposed detention pond shall be added to the plan . 12 . The note for the proposed detention pond indicates the water is to be reused . More detail shall be provided for the proposed water reuse . 13 . We would recommend the detention pond overflow be located at the southeast corner of the facility which is closer the low point of the adjacent site . 14 . Justification for the size of the proposed detention pond shall be included in the storm water management report. 15 . More information shall be provided for the outlet from the proposed detention basin . A temporary riser is identified at the outlet from the pond . A schedule shall be provided for the removal of the temporary riser and installation of the permanent outlet with appropriate details . Call-out information shall also be provided for the outlet pipe and control structure from the detention pond . 16 . We are also concerned about creating a point discharge that most likely will be a nuisance to the adjacent property owner. This needs to be addressed . 17 . A SWPP Plan including implementation schedule shall be included in the plan set . j 18 . Final surface treatment shall be added to the plan for the final restoration/establishment of the perimeter berms and detention pond . 190 A pipe trench and detention control structure details shall, be added to the plan . 20 . The Water Reuse and Detention Pond Typical Section does not match the section included on previous sheets and shall be in accordance with City Standards as indicated above . 21 . " North Shore" shall be changed to "Yorkville-Bristol" in Note 2 . Paragraph G in the General specification section . i Ms . The Kendall County Soil and Water Conservation District Board has reviewed the proposed development plans for Petitioner Green Organics, Inc. This parcel is located in the NW% NE% of j Section 8 in Bristol Township (T. 37N .- R7E . of the 3 `d Principal Meridian ) in Kendall County. Based on the information provided by the petitioner, a data review of the parcel in question and site visit the SWCD Board has the following opinions and recommendations . The Kendall County Soil and Water Conservation District has always had the opinion that Prime Farmland should be preserved whenever feasible . A land evaluation, which is a part of the Land Evaluation and Site Assessment ( LESA) was conducted on this parcel . The soils on this parcel scored a 93 out of a possible 100 points indicating the soils are not well suited for agricultural uses . In addition, soils can have potential limitations for development.
