City Council Minutes 2013 10-08-13 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS 800 GAME FARM ROAD ON TUESDAY OCTOBER 8 2013 Mayor Golinski called the meeting to order at 7 : 02 p .m. and led the Council in the Pledge of Allegiance . AMENDMENTS TO THE AGENDA Mayor Golinski entertained a motion to tabled item # 1 under Public Works Caledonia (PW 2013 -43 ), item # 1 under Economic Development Committee Ordinance Approving a Fourth Amendment to the Redevelopment Agreement for the Downtown Yorkville Redevelopment Project Area (Imperial Investments, LLC) (EDC 2013 -28), and item # 1 under Plan Commission Grande Reserve Amendment to the Amended Annexation and PUD Agreement (PC 2013 -07). So moved by Alderman Milschewski; seconded by Alderman Teeling. Motion approved by a roll call vote. Ayes-8 Nays-0 Koch-aye, Kot-aye, Frieders-aye, Spears-aye, Colosimo-aye Funkhouser-aye, Milschewski-aye, Teeling-aye PRESENTATIONS 2013 Comprehensive Annual Financial Report Jamie Wilkey from Lauterbach & Amen, LLP gave an overview of the annual financial audit. City Administrator Olson followed up with discussion of the historical context. Mayor Golinski thanked City Administrator Olson, Finance Director Fredrickson and team for the work on the audit. He also thanked the department heads, staff, and City Council . PUBLIC HEARINGS None . CITIZEN COMMENTS ON AGENDA ITEMS None . CONSENT AGENDA 1 . Safe Routes to School Authorization of Contract Changes — Authorization 1 — approve decrease in the amount of$24, 508. 70 and authorize City Administrator to execute (PW 2013 -40) 3 . River Road Bridge Authorizations of Contract Changes (PW 2013 -41 ) a. Authorization 10 — approve increase in the amount of$4, 500. 00 and authorize City Administrator to execute b. Authorization 11 — approve increase in the amount of$39, 712. 61 and authorize City Administrator to execute 4. Monthly Treasurer' s Reports for July & August 2013 (ADM 2013 -47) Mayor Golinski entertained a motion to approve the consent agenda as presented. So moved by Alderman Kot; seconded by Alderman Koch. Minutes of the City Council — August 27, 2013 (CC 2013 -63 ) 2 . Minutes of the City Council — September 10, 2013 (CC 2013 -66) 3 . Minutes of the Special City Council — September 12, 2013 (CC 2013 -67) Mayor Golinski entertained a motion to approve the minutes of the regular City Council meetings for August 27, 2013 , and September 10, 2013 , and the minutes of the special City Council meeting for September 12, 2013 , as presented. So moved by Alderman Spears; seconded by Alderman Frieders . Minutes approved unanimously by a viva voce vote. BILLS FOR PAYMENT Mayor Golinski stated that the bills were $893 ,406 . 50 and $448,291 . 19 . REPORTS MAYOR' S REPORT Proclamation for Constitution Week (CC 2013 -64) Mayor Golinski read the proclamation for constitution week. Resolution 2013- 17 Supporting the "Countywide Pay as We Grow Plan" Grant Application to Chicago Metropolitan Agency for Planning (CC 2013 -65 ) Mayor Golinski entertained a motion to approve a resolution supporting the "countywide pay as we grow plan " grant application to Chicago Metropolitan Agency for Planning, and authorize the Mayor and City Clerk to execute. So moved by Alderman Milschewski; seconded by Alderman Koch. Motion approved by a roll call vote . Ayes-8 Nays-0 Spears-aye, Colosimo-aye, Funkhouser-aye, Milschewski-aye, Teeling-aye, Koch-aye, Kot-aye, Frieders-aye Hometown Days Report (CC 2013 -68) The discussion was on the table to combine Hometown Days and the 4th of July. City Administrator Olson gave background on this issue. Superintendent of Recreation Evans went over recommendations of combining these events. Alderman Frieders is in support of combining these events. Alderman Kot stated with a two day event, if rain occurs the City could potentially lose money. Superintendent of Recreation Evans said the overall budget will be smaller so the risk would be smaller. Alderman Koch wonders if the City will make money since the 4th of July is a floating holiday. Alderman Funkhouser asked about other entities to help run the program. City Administrator Olson said the 4th of July planning committee has existed for about a year. Nobody has offered to plan this event. Alderman Colosimo's concern is that the City is getting rid of Hometown Days . It is not combining events. He has concerns about the 4th of July event. It is a two day floating event. He would like community input. Mayor Golinski said when asking residents for feedback the question has to be posed correctly. Alderman Teeling said the City makes a profit from Hometown Days. She agrees with Alderman Colosimo . Alderman Colosimo wanted it clear that the City did not back away from the 4th of July. Alderman Milschewski wondered why the City is not getting the community more involved. She would hate to see Hometown Days go . Mayor Golinski said the direction from the Council is to keep Hometown Days . City Administrator Olson stated the City will plan that for 2014 . PUBLIC WORKS COMMITTEE REPORT Caledonia — Letter of Credit Call (PW 2013 -43 ) Mayor Golinski stated this was tabled. ECONOMIC DEVELOPMENT COMMITTEE REPORT Ordinance Approving the Fourth Amendment to the Redevelopment Agreement for the Downtown Yorkville Redevelopment Project Area (Imperial Investments, LLC) (EDC 2013 -28) Mayor Golinski stated this was tabled. Ordinance Disconnecting Certain Territory From the United City of Yorkville (Portion of the Hoover Forest Preserve) (EDC 2013 -22) Mr. Jeff Wehrli, Hoover Forest Preserve president, discussed the option of being able to disconnect from Yorkville. He also discussed what the procedure would be to de-annex. He wanted guidance from the The Minutes of the Regular Meeting of the City Council — October 8, 2013 — Page 3 of 4 Council to find out whether the annexation would be acceptable . Alderman Kot's issue would be noise complaints . Those would be forwarded to the sheriffs department. Alderman Colosimo's concern is that the City has to be careful of establishing precedence. In the past, the City has had requests for de- annexing, and its position has been not to de-annex. If the City de-annexes then the City will be flooded with requests to be de-annexed. Alderman Colosimo objects to this ordinance. Alderman Funkhouser concurs with Alderman Colosimo. Alderman Kot doesn't have a problem doing this . Alderman Teeling agrees with Alderman Kot. Alderman Koch is against de-annexing. Alderman Spears agrees with Alderman Colosimo . After learning about this topic, Alderman Frieders will be voting nay. Alderman Kot asked City Attorney Orr if this is a bad precedent. City Attorney Orr stated it is not a legal question. Mr. Wehrli discussed the 2 . 5 million dollar restoration. The Hoover Forest Preserve is trying to make it easier for businesses to be able to utilize their facilities. Alderman Milschewski doesn't understand the duplication of liquor licenses . City Administrator Olson explained the duplication. City Attorney Orr asked Mr. Wehrli if under the forest preserve law do they have to obtain a liquor license. He said it is done by vendor. City Attorney Orr would like to see if there was any way Yorkville could issue a liquor license to a vendor and then the state would automatically issue it. The forest preserve might be able to pass an ordinance that says if the City issues the liquor license then the forest preserve would except it. The state license would have to be acquired by either the City or forest preserve. Mayor Golinski said the City will work with the forest preserve to make the licensing process easier. Alderman Milschewski is against de-annexation due to Alderman Colosimo's reasons. Also, it was the City that got the piece of property saved. Mr. Wehrli will check with the states attorney. Mayor Golinski said the majority is against de-annexation. PUBLIC SAFETY COMMITTEE REPORT No report. ADMINISTRATION COMMITTEE REPORT Tax Levy Estimate (ADM 2013 -50) Mayor Golinski entertained a motion to approve a tax levy estimate for 2013 , to be used for purposes of conducting a public hearing on the tax levy in the amount of $3 ,765 , 873 . So moved by Alderman Colosimo; seconded by Alderman Milschewski. Motion approved by a roll call vote. PLAN COMMISSION Grande Reserve Amendment to the Amended Annexation and PUD Agreement (PC 2013 -07) Ordinance Approving Second Amendment to the Annexation Agreement and Planned Unit Development Agreement (Grande Reserve Subdivision) Mayor Golinski stated this was tabled. Prestwick of Yorkville — Yorkville Christian School (PC 2013 - 12 and PC 2013 - 13 ) Ordinance 2013-56 Approving the First Amendment to the Annexation Agreement Mayor Golinski entertained a motion to approve an ordinance approving the first amendment to the annexation agreement of Yorkville farms development - Prestwick of Yorkville subdivision (Yorkville Christian School) and authorize the Mayor and City Clerk to execute. So moved by Alderman Colosimo; seconded by Alderman Frieders. Alderman Colosimo encouraged the Council to vote in favor of this ordinance . The petitioner and adjacent property owner will not be able to work out an agreement. The City's proposal was for the benefit of the adjacent property owner, who are not within the City's municipal boundaries. Alderman Colosimo is concerned about what happens inside of Yorkville . There are alternatives to the water issues that are acceptable by engineering standards. He thinks the high school would be a great addition to his ward. The south end of town needs an economic engine . He believes the high school is part of that master plan. It provides a great service to the City and surrounding areas. Alderman Kot asked about the traffic study. Engineer Sanderson stated there has not been any recent response. Alderman Kot agrees with Alderman Colosimo. He supports this and trusts the state of Illinois will do the right thing in regards to the traffic study. Alderman Funkhouser thinks this will be a good addition to the south side of town. So moved by Alderman Colosimo; seconded by Alderman Funkhouser. Motion approved by a roll call vote.
