Rich Hart Deputy Clerk Lisa Pickering Guests: Tony Scott, Kendall County Record (arrived at 6:45 p.m.) The meeting was called to order at 6:00 p.m. by Chairwoman Rose Spears. Presentation: None Minutes for Approval/Correction: Minutes from July 13, 2006 and July 17, 2007 were approved as presented. New Business: (The committee moved forward to Item #3 & #4). 3. PS 2007-23 Committee Liaisons Appointments Chairwoman Spears said that Alderman Munns had requested to be appointed liaison to the School District. Chairwoman Spears would like to appoint him because on his committee he gave up everything. He wanted a couple of things and he wasn't able to do that. He has asked for the school district for a couple of years and wasn't able to do that. Alderwoman Sutcliff thought you only appointed outside your committee if no one within the committee wanted it. Chairwoman Spears said that another committee appointed a liaison outside of their committee. AldermanWerderich said that Alderwoman Sutcliff would also like to be appointed to the School District. Chairwoman Spears asked if Alderwoman Sutcliff would like to be appointed to KenCom or the Fire District instead. It was discussed that to be appointed to KenCom, the Mayor has to send in an official letter recommending the liaison and it has to go to the county board and they have to approve the liaison. It was asked if there were any other positions. Page 2 of 10 Chairwoman Spears said that she had been the liaison for Human Resource Commission for ten years and she thought that she would keep that. Chairwoman Spears suggested that Alderwoman Sutcliff could still go to the school meetings as a backup, because if someone can't make it, then it would be good to have someone representing the city. Alderwoman Sutcliff said that she would be the liaison for KenCom if that's what they want her to do. 4. PS 2007-24 LETNSubscription Request Chief Martin stated that the LETN subscription is supposed to be a total of $3240.00 for the first year. After the first year it goes to $55.00 per user per year. This is a form of continual education. Lt. Schwartzkopf explained that every day has a different topic that is discussed such as suicide prevention for example. The next day will be something different. It' s called Roll Call. It's a fifteen minute tape that the officers come in and watch. There are 800 different training sessions that the officers can use. There are tests that the officers can take on the computer and if they pass, they get a certificate that goes in their training file. It works through a computer and satellite system. Chief Martin stated that the nice thing about this is that it's an in-house training tool. As they hire more officers it becomes more cost effective. It helps them manage the training. It was verified that there is money in the budget. Consensus was to approve purchase. There was no further discussion. (return to regular order of agenda) New Business: 1. PS 2007-21 Police Reports for July 2007 Chairwoman Spears relayed to Molly Batterson that she liked the way the police reports were set up. They are very easy to read. Alderman Werderich asked what suspicious circumstances were? Batterson responded that it could be something like someone calling and reporting that a car drove by and took pictures of their house. The reason might be that the person had applied for a home equity line of credit and the appraiser drove by and took a picture of the house. They are things that the police department is pretty sure are not crimes, however someone called and they need to document it. Page 3 of 10 Alderman Werderich asked if the school resource officer was a new position. Chief Martin responded that we have had a school resource officer since 1992 or 1994, probably 14 or 15 years. Chairwoman Spears pointed out that the letters were very great. Alderwoman Sutcliff agreed. Chief Martin pointed out the letter from Mrs. Willson appreciating the police department' s response in regards to the Fox and Mill Street speed limit. Alderman Werderich complimented the police on their good customer service in dealing with complaints. Alderman Werderich asked about the overtime manhours utilization report. What do the heading details mean? Ms. Batterson responded that details are any assigned paid security detail that the police department goes to including Hometown Festival and the schools. A good majority of these paid details are billed back to the businesses. The Chief stated that they run very stringent when it comes to overtime. The total listed is the total hours of overtime for the entire department. They rarely have more than 50-60 hours of overtime in a pay period. The twelve hour shifts are working very well. The overtime includes court also. Chairwoman Spears suggested that the alderman could check the bill list and the payroll from the other city departments and compare. Chairwoman Spears asked if anyone had any questions about the Monthly Mileage Report. Alderman Werderich asked if the DARE car had been sold. Ms. Batterson responded that Friday would be the bid opening. She said that it had been discussed that they were going to remove the DARE logo before it was sold so that the DARE logo could not be altered in a negative manner. Chairwoman Spears brought up the letter in the packet about the cadet completing his criminal justice associates degree and asked Chief Martin to clarify the situation. Chief Martin stated that he has three positions open for part-time police officers. He would like to put the cadet in as a part-time officer at $ 15.31 per hour. Once a CSO job description is completed and approved, then the cadet could switch over. Currently, if the cadet was moved into a part-time slot, he would be working 30-35 hours per week. He would not be eligible for benefits as a part-time officer. Alderman Werderich is in agreement to keep the cadet around. Chief Martin stated that he is the first cadet to go through our program and he has helped us out a lot. Applications are coming out September 1 and the cadet will be applying. Chief Martins hopes to get him through the process so that they can hire him. The cadet would be a great asset to the department. Lt. Schwartzkopf mentioned that the cadet has turned down other jobs. Chairwoman Spears asked when Officer Groesch and Officer Stroup would be sworn-in as Sergeants. They will be sworn in on the September 25a' City Council meeting. This is an informational item only. Page 4 of 10 2. PS 2007-22 December Public Safety Meeting Date - FYI Chairwoman Spears mentioned that the December Public Safety meeting date has been changed due to the holidays. The December Public Safety meeting has been moved to December 11 , 2007. This is an informational item only. 5. PS 2007-25 Engine Braking Prohibited — Sign Request for the Area of Route 47/Cannonball Trail Chief Martin said that he received an email on this. This is a request in reference to the engine braking prohibited signs. These signs are provided and installed by IDOT because it is a state highway. We would have to request that IDOT do this and make those areas engine braking prohibited areas. Alderwoman Spears asked if we had done this recently. Bart Olson responded that we have had two different situations dealing with this. The city attorney looked at this and said that we have legal authority to do this. Chief Martin pointed out that this is a state highway. IDOT has to put up the signs and this gives us the authority to then enforce this. As far as the city is concerned, we do not control the state highways. Bart is going to check with Eric and Joe to see how we notify IDOT and request that the signs be posted. It was discussed that the area in question was the residential area by Route 47 and Cannonball Trail. Chairwoman Spears asked about having the signs also posted by Bristol Bay. Chief Martin verified that the police will enforce the signs once they are up. Consensus was to move forward with asking IDOT to post signs. Bart Olson will let Eric Dhuse and Joe Wywrot know so they can contact IDOT. 6. PS 2007-26 Off Street Parking Ordinance Alderman Leslie requested that this item be put on the agenda for discussion again. Alderwoman Sutcliff emailed a question about the parking ban, ice cream trucks, and the political signs that afternoon to the Ward 3 residents on her email list. She passed out copies of the responses that she had received. Most of the responses that she received indicated that the residents that responded were not in favor of a parking ban. Alderwoman Sutcliff asked for more details about the parking ban since she and Alderman Werderich were not on the city council the last time this issue was discussed. The Chief responded that people were pretty much 50150 for and against the issue depending on how you read the questions. Spears said that there were problems with the survey when it was mailed out — that the questions were a little unclear. One survey only was mailed to each house. People complained that only one driver from each house got to fill out the survey. Page 5of10 Chairwoman Spears said that the next step was that council was going to have each alderman check their wards. She feels that the collector streets should not have overnight parking or parking on the street itself. Her recommendation was to bring it to each ward and look at the streets on a ward by ward basis. Chief Martin thinks that maybe this would be a good thing to look at during a ward meeting. The Chief pointed out the potential problems when you select certain streets. The police department was in favor of the ban for a number of different reasons, such as burglery to vehicles, burglery to homes, or criminal damage to property. The Chief stated that very rarely does someone who is planning on doing damage park in the victim's driveway. They usually park on the street. A parking ban also helps with the postal delivery, street cleaning, and snowplowing because the cars are automatically off the street. Chairwoman Spears mentioned that this originally came to council from the people in the John Street area. They brought it to the city because they were having a lot of problems. Alderman Werderich said that they have a couple of options — the first is an all out ban. Chief Martin said that the police were in favor of the all out ban because it was fair to everybody. The second option is a parking ban on arterial, major collector and collector streets. Chief Martin said that the other option would be certain streets in each of the wards other than those listed above. Alderman Werderich asked how they would designate those. He thought that maybe they should have a ward meeting. It would be an opportunity to give people a chance to have input. Chief Martin said that Lt. Hart would let the Aldermen know which streets cause public safety issues. There was some discussion on the possibility of putting the parking ban to a referendum question. The drawback to this is that you are allowed one question only. The question would be — do you want a parking ban — yes or no. A referendum would allow the citizens to decide. Chairwoman Spears mentioned that the problem that she forsees with that are that there are some streets right now that there should be no parking whatsoever. One of those streets is Countyside Parkway because that has become a bypass. There is a house that always has a vehicle parked on the street. This forces people to move back and forth. She thinks there are a lot more streets like that throughout the city. Alderwoman Sutcliff brought up Somonauk and Route 47. Somonauk is listed as a local residential, however, there is so much traffic on Somonauk. That particular intersection is a major throughfare for the schools in addition to Route 47. According to Bart Olson, the definition of minor collectors and major collectors are set by our zoning ordinance. It depends on the street width, the pavement makeup, the area that it's in, and the traffic counts. Page 6 of 10 Alderwoman Sutcliff said that originally Spring Street was built as the collector and that's where the stoplight was supposed to go. Then something happened with Parkview and the stoplight ended up at Somonauk instead of Spring. Somonauk was not built to handle all of the traffic. Everyone uses Somonauk Street because the stoplight is there. There shouldn't even be a stoplight there according to the original plan. She feels that there should be no parking for three blocks on Somonauk. Bart Olson suggested that each one of the alderman contact the other alderman in their ward to hold a ward meeting. Consensus for this item to come back to the October Public Safety meeting. 7. PS 2007-27 Smoking Ban in City Vehicles and Buildings Chairwoman Spears contacted Bart about this and he was already researching this. Chief Martin stated that the police department has always had a ban on any kind of tobacco products in city vehicles. It is also in the employee manual. According to Bart and Molly we have to post a few more signs and move the smoking receptacles to be in compliance with the Smoke Free Illinois Act which will take effect January 1 , 2008. This is an informational item only. 8. PS 2007-28 Ice Cream Vendors/Soliciting Ordinance This item was brought up by Alderman Leslie. Alderwoman Sutcliff has information on this from the email survey that she sent out. She received 5 responses that said we should have ice cream vendors and 5 responses that said we shouldn't. Chairwoman Spears brought up an incident that took place in Sugar Grove with an ice cream vendor. If the vendors are a problem, she thinks that we don't need these ice cream vendors in our community. Chief Martin said it's entirely up to the City Council. We have one vendor who has been in our town for approximately 11 years and we have not had any problems with him except for his truck looking seedy. One of the reasons for a complete ban is to keep kids out of the streets. Alderman Werderich asked how many complaints have we received about the ice cream trucks. According to Molly Batterson, we've gotten a few anonymous phone calls complaining about the condition of the trucks and that we should make them buy new trucks. Lt. Schwartzkopf said that some of the different towns go from banning them completely to having an ID card for the vendors. Molly stated that the police department does background checks currently on the vendors. Page 7 of 10 It was asked how many different vendors were selling ice cream currently. Alderwoman Sutcliff said that she had comments that refer to two different people. She received a complaint about one of the vendors not giving kids their change. The police have not received any formal complaints about stealing money from children. It was discussed that possibly we could issue a formal permit to registered ice cream vendors, such as a large colored ice cream cone decal with the year printed on it, so that the public would know that they are buying from a registered ice cream vendor. This would be a way to let the public know that the police have done a background check on the vendor. Another possibility would be to also issue a photo ID to the vendors. Alderwoman Sutcliff suggested that we should educate the public about this. Possible ways to let people know were ward meetings, neighborhood watch newsletters and the city newletter. We need to let people know that if they have a problem with a vendor, they should call the police so they can look into it. Consensus for staff to look into a permitting process which would include a permit for the vehicle and ID tags for the vendor to wear. Consensus for this to come back to the Public Safety Committee in January 2008. 9. PS 2007-29 Request for Patio License A request was received for a patio license for Sawmill Pizza which will be reopening. Bart Olson mentioned that currently, the city code does not allow for any more patio licenses to be issued without council's approval. If council would like to, they can choose to amend the code and approve the patio license. There was some discussion regarding opening up the patio liquor license category to allow for more patio licenses to be issued without having to go to council for approval on each one. Chairwoman Spears questioned the amount of work that was being added to staff by having to get council approval for each patio license. Lisa Pickering responded that it was up to council if they want to have discretion to approve what is coming to town. Currently the city code does not have very many limitations and if the category is open, then people can come in with anything and apply. If the category is closed, then it would give council added discretion over what they choose to approve. Alderman Werderich agreed that council discretion would be a good thing, however, he doesn't want to put additional burden on staff. Bart responded that the amount of additional work was minimal as long as they have a process established. Ms. Pickering also responded that as long as staff has direction from council, they are able to inform the applicants in a timely manner. In this instance, Sawmill was informed when they picked up their liquor application that the patio license category was closed and would have to be approved by city council. As a result they submitted their application in a timely manner to allow for council approval. Page 8 of 10 Consensus to recommend to amend the city code to allow for 4 total patio licenses. This item will move to Committee of the Whole and City Council meetings on September 11 , 2007. Old Business: L PS 2007-17 Request to Limit the Number of Package Liquor Licenses The question is whether they want to change the city code to limit the number of package liquor licenses to the number currently approved. Currently the package license category is unlimited. We have 11 total package licenses issued. The committee is in favor of limiting the number of licenses available to be the same as the number approved. Consensus to recommend to amend the city code to limit the number of package liquor licenses. This item will move to the Committee of the Whole and City Council meetings on September 11 , 2007. 2. PS 2007-16 Request to Amend Liquor License Ordinance Regarding Patio Licenses Bart Olson said that the patio license issue has been an ongoing discussion. The most recent discussion was at the Committee of the Whole meeting last Tuesday. The desire of the Committee of the Whole was to eliminate the height requirements for patio licenses. This is okay by building code, except in cases where the building code requires a guard fence. An example would be an instance where the deck is off the ground. In that case the fence would have to be 42" high to meet our code. This would be governed under the building code when they come into to apply for the deck permit. The city attorney provided two draft ordinances. The first is more restrictive and requires the applicants to submit a site plan detailing where the location of each item in the patio area. The second is not very restrictive. Chairwoman Spears felt that the first ordinance was too restrictive and would allow the city too much control over what could be considered interior decorating decisions. It was mentioned that the intent was probably not to micromanage, more to prevent someone coming in with plastic lawn furniture. Bart mentioned that in asking for details of what the patio area will look like would help the liquor commissioner make a well educated decision. For purposes of amending the city code, it's to the benefit of the applicant to submit as much information as they can. Consensus to send both versions of the ordinance to Committee of the Whole and City Council meetings on August 28, 2007. Page 9of10 3. PS 2007-19 Public Display of Signs Discussion Bart Olson said that staff is looking for more direction from committee. What direction does the committee want to take with this? Chairwoman Spears said that she brought this up because she got a lot of comments from residents about people displaying signs in medians. This is illegal for people to display signs in the right-of-way on state property. After the elections, not all of the signs were picked up. Chairwoman Spears recommended that the Clerk' s Office hand out a packet on sign ordinances when people are running for office during election season. The packet could list guidelines such as where signs can be located, where they can't be located, and when they should be removed. We could also ask for a contact name and phone number so that we can contact someone if there is a problem with one of the signs. They would like to see a recommendation that the signs need to be taken down 24 hours after the end of the election. Consensus for this to come back to the Public Safety Committee in September. Additional Business: Alderwoman Sutcliff responded that she spoke to some residents and they were concerned about speeding issues on Somonauk Street with school starting. She was wondering if a speed sign could be placed at the corner of Somonauk and Freemont or else Somonauk and Liberty. Chief Martin said that Lt. Schwartkopf would make the arrangements. - - - ----------------------- Alderman Werderich received a phone call from a resident who had concerns about the speed sensor sign downtown. Chief Martin said the battery had gone bad. The sign has been fixed and is now working correctly. ----------------------------------- Alderman Werderich brought up the committee appointments again. He said that Alderman Munns wanted the school district, however, since Alderman Munns already is the YEDC liaison, Alderman Werderich feels that Alderwoman Sutcliff should be able to be the school board liaison, since she is not a liaison for anything else. Alderwoman Sutcliff asked if the liaison issue is a vote or an appointment. Chairwoman Spears responded that it is an appointment by the Chairman of the Committee. Bart Olson said that the governing ordinance just says that the committee is supposed to decide liaisons. How the committee chooses is up to the committee. It was found that there was not clear direction in the governing ordinance as to how liaisons are going to be picked. Chairwoman Spears suggested that they forward committee liaisons to Committee of the Whole and have all of the council involved in the discussion of how to select liaisons. ------------ - - - - --------- Page 10 of 10 Chairwoman Spears asked the status of the Mayor's letter regarding Cannonball Trail and John Street intersection. She is wondering if the letter has been sent to Sheriff Randall yet. Bart will follow up. ------------------------------------ Chairwoman Spears mentioned that she received a call from Joe. There is a camper parked near the North Shell in the old movie theatre parking lot at Countyside Center. It was discussed that this is private property, so it would be a zoning issue. ............--- Alderwoman Sutcliff asked why a couple of stop signs were taken down in the Somonauk Street area and replaced with yield signs. Chief Martin explained that they did a traffic survey and found that they had too many signs and some of them had to be pulled out. The police have to follow the IDOT standards, which is a requirement by law. --------------------------------------- Chairwoman Spears asked when the new sign is going to be put up at the Countryside Parkway intersection. Bart Olson responded that the signs are $ 1100-$ 1200 each. Bart will follow up on this. --------------------------------------- The meeting was adjourned at 7:59pm. Camp on River Road for a 2 year old missing Child! It was quickly determined the little girl was probably lost in the corn field adjacent to the Camp. A call out to the Bristol-Kendall Fire Dept. was made, which initiated a joint effort to coordinate a search of the area. The "A Child Is Missing" Alert was put out by Ken-Com dispatch for the Yorkville area. Chief Hitzemann of the Bristol Kendall Fire District called for assistance from Oswego, Little Rock Fox, Newark, Lisbon-Seward and Sandwich Fire Districts. The Yorkville and Plano Police Departments, the Yorkville Citizens Police Academy and the Kendall County Emergency Services responded as well. The most gratifying effort, however, was the response of the Yorkville area residences and neighbors who came to the PNA Camp to offer help in anyway possible. They provided water, coffee, rolls and watched the perimeters, searched the Camp itself and were ready to go further if needed. The best is for last, which is that 3 Yorkville men heard the call and decided to walk the Blackberry Creek from the North of the PNA to the South. Approximately a third of a mile in the woods they saw the little girl laying on the ground and contact was made! They immediately notified Ken-Com and proceeded to a clearing (just south of the Public Safety Center) where the little girl was united with her mother and siblings and taken to Copley Memorial Hospital to be checked out. The three Yorkville heroes are Mr. Art Prochaska Jr., Mr. Richard Bissonette, and Mr. Ernie Stumbo! I was with the child's father and he was overcome with emotion and felt that THANK YOU was not enough. I reassured him it was and I have to thank each and everyone who participated in any way this past Sunday. From prayers to sweat and mud, the Kendall County citizens served and served well. At approximately 11 :45 Ins, a staff member at Streator Township High School received an anonymous telephone call from a male who stated, "There's a bomb in the building, you have one hour" and then hung up. The school immediately evacuated their students and staff. Our agency personnel and school administrators conducted a cursory search of the school building which met with negative results. Due to the physical size of Streator Township High School it would have required a substantial amount of time and personnel to conduct a second, more thorough search. I was able to obtain information indicating your agency possessed an Explosive Detection Canine Unit. I called your agency and was put in contact with Officer Johnson. I explained the situation to Officer Johnson and requested his assistance, along with any other Explosive Detection Canine Units. Officer Johnson stated he would contact other officers he frequently trains with and call me back. Officer Johnson re-contacted me and stated he, along with Officer Joseph Hodder from Northern Illinois University, would be responding to Streator to provide assistance with their canines. Officer Johnson and Officer Hodder arrived at Streator Township High School and met with us. We went over the layout and floor plans of the school and both officers immediately went to work with their canines. Officer Johnson and his canine, along with Officer Hodder and his canine, saved us valuable time and additional personnel. I want to thank you for allowing Officer Johnson and his partner to assist our agency. Officer Johnson displays a very professional attitude and demeanor. I observed Officer Johnson to be a dedicated and knowledgeable canine handler who takes his job very seriously. The bomb threat was made at about 11:35 a.m. Tuesday, Superintendent Steve Swanson sail. Students were evacuated to the football field, which is about two blocks from the school. "We were very pleased with the orderly fashion displayed by students and staff In the evacuation of the building," Swanson said. Joe Grady, a senior, said he first learned about the threat during lunch. A teacher told him about it and asked him to calmly tell others at his table. A few minutes later, an announcement was made over the public address system Informing students they should go to the football field, Grady said. Students stayed at the football field until 12:30 p.m., when they were permitted to leave. They were not allowed back Into the school until this morning. Buses were brought to the school to transport students who didn't have a ride home or were not within walking distance of their afterschool destination. Streator police would not say this morning whether there is a suspect in the case. "Due to the ongoing Investigation, we're not at liberty to release any information at this time," Streator police Lt. Kurt Pastolk said. "More details will become available when the investigation is complete. We're diligently working on tlris." Streator police, with assistance from Streator firefighters and some school employees, conducted an initial search of the school that revealed nothing unusual. A second search was conducted with two bomb-sniffing dogs from Yorkville and Northern Illinois University, Pastirik said. The second search also revealed no evidence of a bomb. Policy It shall be the policy of the Yorkville Police Department to maintain a Field Training Program where a new C.S.O. having been hired, will be required to successfully pass a 60-80 hour (depending on experience) training program. Training will be conducted by selected Officers appointed by the Chief of Police or designee, and maybe extended or shortened based on the recommendations of the F.T.O. and order of the Chief of Police. This training which will be on going will be commensurate with their responsibilities. This General Order shall be comprised of the following sections: I. Duties Il. Investigations III. Limitations IV. Special Requirements V. Physical Demands VI. Equipment Duty Gear to be Worn/Used VII. Rules and Regulations I. Duties A. Regular patrols and inspects the United City of Yorkville to identify and resolve violations of village codes and regulations. B. Responds to complaints of potential violations relating to noise, dumping, animals, water conservation, nuisances, and other related matters. C. Conducts field investigations of potential violations, gather evidence, question complaints, compares facts to current code requirements, makes findings, issues warnings or issues citations. D. Meets with residents, owners, tenants, contractors, developers, businesses, etc. to review and explain code requirements and violations or potential violations and secures compliance. E. Coordinates and trains with the police, the prosecuting attorney, and other staff or agencies, as needed. F. Perform animal control duties, participates in the apprehension and confinement of stray domestic animal and wildlife, prepare reports on such activities. G. Complete found property reports, which include proper storage of such items into temporary evidence lockers. H. Complete lost property reports. I. Complete Illinois traffic crash reports on private property where no citations, injuries, or arrests will take place. J. Assist in delivering board packets or other related village literature. C. S.O. ' s will be trained in the proper use of two-way radios (Ken-Com and Yorkville). K. C. S .O. 's will be trained in report writing, Department Policy & Procedures, Village Ordinances, vehicle equipment operations. L. Assist in vehicle maintenance activities as needed. M. If certified, install car seats, and educate the public with such knowledge. N. Conduct vacation checks. O. Assist in traffic control or school crossing if needed. P. Assist in motor vehicle/residence lock outs. Q. And other related duties. II. Investigations A. The C. S.O. will be instructed on evidence techniques, photography, and proper evidence storage. B. Will assist the property custodian as needed; such as taking evidence to and from the Illinois State Police Crime Lab while maintaining the chain of custody. C. The C. S.O. will also be shown how to prepare for courtroom testimony and prepare for trials. III. Limitations A. Community Service Officers are specially limited and prevented from participating in various aspects of law enforcement duties as follows: 1 . Crimes in progress. 2. Fights in progress. 3 . Alarms. 4. Traffic stops. 5 . Domestic Disturbances. 6. Noisy parties. 7. Suspicious persons, vehicles, and noises. 8 . Any other call which would constitute a hazard for an unarmed officer. B. A C.S .O. shall immediately call for a sworn officer to take over an assignment he/she is handling, if circumstances indicate a sworn officer is needed. C. The C. S .O. shall obey all traffic laws while on duty, and shall not drive with emergency equipment operating on department vehicles. The emergency lights will be used to give warning when assisting in traffic control. D. The C. S .O. shall not be assigned to or become involved in any assignment which requires the use of force. E. The C. S.O. shall assume no police powers except where assignments call for traffic direction, or the issuing of parking and village ordinance violations. IV. Special Requirements Must posses a valid state driver' s license or have the ability to obtain one prior to employment. Be prepared to work flexible hours, weekends, holidays, and evenings as needed. These hours are essential to the job and are considered part of the normal work week. V. Physical Demands While performing the duties of a C. S .O., one is regularly required to see, stand, sit, walk, talk, hear, use hands, and operate objects or controls during a daily activity for periods of long times. VI. Equipment/Duty Gear to be Wom/Used A. Portable radio, Nextel/cell phone (if assigned). CSO ' s may carry handcuffs, O.C. spray, and an ASP only after completing instructions by YPD personnel and completion of a certification course. Handcuffs, O.C., and ASP will only be used as means of self defense if involved in situations that escalates to an assault of a CSO prior to arrival of a sworn officer or to assist a sworn officer if requested. C. S.O. 's shall not be assigned to or become involved in any assignment which requires the use of any force. B. CSO ' s do not have powers of arrest, only that of a citizen. C. Uniforms worn will follow Department dress code. D. All equipment issued to the C. S .O. will be used in a lawful manner and kept in good working condition. VII. This high tech sign features light emitting diodes (LED) that will run dusk till dawn or 24/7. The LEDs are set on the perimeter of the sign, which is a federal standard. Description. The LED Enhanced Stop Sign Assembly shall conform to the 2004 Federal Highway Manual on Uniform Traffic Control Devices (MUTCD). The Village's Sign Ordinance #86-27 allows the placement of temporary political signs on private property for a period of not more than sixty (60) days before and five (5) days after an election. No signs are allowed in the public right-of-way. If you are unsure of where private property starts and the right-of-way ends, a general rule is that the right of way ends approximately one-foot in back (to the home or business side) of the sidewalk, if applicable. In instances where no sidewalk exists, signs should be setback 15 feet from the street curb or edge of pavement to ensure that they are on private property. Please remember to obtain approval from the private property owner before installing signs on their property. Without this approval the property owner has the right to remove these signs. Signs that are located in the public right-of-way or installed outside of the permitted time frame will be removed and placed near the dumpster at the Gurnee Village Hall for a 72 hour period and may be retrieved within this time frame. Please be aware that the reinstallation of signs in violation of the ordinance can be subject to a fine of $200 for each day of the violation. Temporary Signs The following signs shall be permitted anywhere within the Village and shall not require a permit. A. Construction Signs: Not more than two (2) construction signs with a total combined surface area not to exceed thirty-two (32) square feet and a maximum height, to the top of each sign, of eight (8) feet. The signs shall be confined to the site of construction, may be erected after a complete building permit application is submitted, and shall be removed within seven (7) days after the issuance of an occupancy permit. B. Real Estate Signs: Real estate signs not exceeding a total area of twelve (12) square feet and a maximum height, to the top of each sign, of five (5) feet advertising the sale, rental or lease of all, or part, of the premises on which the signs are displayed. One such sign is permitted for each lot or parcel and such signs shall be removed within seven (7) days after the sale is closed or the lease is signed. C. Political Campaign Signs: Political campaign signs, as defined herein, not exceeding sixteen (16) square feet in area for each lot. Maximum height, to the top of such signs, shall be five (5) feet. These signs shall be confined within private property and shall be removed within seven (7) days after the date of the election. D. Development Signs: Development signs not exceeding one hundred (100) square feet in area. Maximum height to the top of such signs shall be twenty (20) feet. One such sign shall be permitted for each thoroughfare or highway frontage of the development. Development signs may be erected upon approval of a preliminary plat of subdivision or upon submission of a building permit application and shall be removed within seven (7) days after the last lot or unit is sold. E. Right-of-Way Signs: Signs may be placed within the public right-of-way under the following conditions: 1 . Signs shall be a maximum of three (3) feet in height and a maximum of four (4) feet per face. 2. Signs may be placed on Saturdays and Sundays only between the hours of 9:00 a.m. and 6:00 p.m. 3. That the written consent of the homeowner be obtained prior to installing signs in the public right-of-way adjoining the front, side or rear of any residential property. 2. Signs must be free standing, not attached to any utility pole or structure nor any traffic control sign and placed at least 3 feet from the curb or edge of pavement. 5. No sign shall be placed within any portion of a twenty-five (25) foot sight triangle at the intersection of two streets. The sight triangle is determined by extending the curb or edge of pavement lines to a point of intersection; then measuring back along these extended curb or edge of pavement lines for a distance of twenty-five (25) feet to two points. A line drawn connecting the above determined points completes a triangle. 6. That only one sign be permitted within 150 feet of an intersection which relates to the same topic and that the next closest sign be no closer than 150 feet. Additionally, there shall be only one sign of the same topic placed in front of a single lot. 7. No attention or attracting devices such as pennants, streamers, balloons, inflatable shapes, banners, flashing lights or other illumination shall be attached to a sign or placed in the public right-of-way. 8. Each sign must have attached an adhesive label or other means to identify the name, address and telephone number of the person responsible for the placement and removal of each sign. 9. That a fine in the amount of $50.00 will be charged to the person whose name is on the sign, if the sign is in violation of any of the above restrictions. If no names are found on the sign, the party or entity identified on the sign will be assessed the fine. 10. That signs which are removed will be kept by the Village for a period of no more than three (3) weeks. In order to retrieve the signs, the fine must be paid within the three week period of time, otherwise they will be discarded. 11 . Any noncomplying sign shall be removed. Sec. 55.11 . Prohibited Signs The following signs are hereby expressly prohibited for erection, construction, repair, alteration or relocation within the Village, except as otherwise hereinafter specifically provided: A. Signs hung across any street, alley, or public right-of-way, except as otherwise permitted herein. T. Signs which contain statement, words, pictures or other depictions of an obscene, indecent or immoral character and which offend public morals or decency. U. Ground and wall signs advertising or displaying interest rates or the price of merchandise, commodities, goods or services for sale or lease except as may otherwise be specifically allowed by other provisions of this Ordinance. V. Internally illuminated signs with a transparent or translucent background that transmits any significant amount of light. W. Miscellaneous advertising devices, other than signs which conform to the provisions of this Chapter. X. Signs in conflict with traffic signals, vehicular or pedestrian travel, or which impede access to fire hydrants and fire lanes and exits, and other signs which impede or impair the public health, safety and welfare. Y. Signs painted on the walls or windows of any building, except as hereinafter permitted. Z. Attention-getting devices. AA. Signs on microwave, radio, transmission or receiving towers and satellite dishes. Sec. 55.29. All heretofore existing sign regulation ordinances enacted by the united city of the village of Yorkville are hereby revoked to the extent that prior ordinances effecting permit fees shall remain in full force and effect. (Ord. 1998-36, 12-17- 1998) 8- 11 -2 : DEFINITIONS: BANNER: Any sign of lightweight fabric or similar material that is displayed on a pole or a building . National flags, state or municipal flags, or the official flag of any institution or business shall not be considered banners. CORNER LOT: A lot with property lines of two (2) streets bisecting on an angle. December 2002 City of Yorkville 8- 11 -2 8- 11 -2 FACADE : The face or wall of a building as it is presented to view; the apparent width and/or height of a building as viewed from streets, driveways, and parking lots. Minor changes in wall elevations do not constitute the creation of additional facades. FLAG : A fabric or bunting containing distinctive colors, patterns, or symbols used as a symbol of a government, political subdivision, or other entity. MESSAGE BOARD : A panel which uses changing and/or flashing lights to electronically communicate copy. A panel with lights flashing time and temperature only is not a message board. PENNANT: Any lightweight plastic, fabric, or other material , whether or not containing a message of any kind, suspended from a rope, wire, or string. SIGN : Any structure, vehicle, device, or any part thereof, intended to be seen by persons in the public right of way which : A. The definition of "sign" shall not, however, be interpreted as prohibiting any structure, vehicle, device, or any part thereof used for the purpose of disseminating political, economic, social, or philosophical ideas entitled to constitutional protection as noncommercial speech. In any instance where this chapter would prohibit any such activity, the conditions of this chapter shall be interpreted as permitting the utilization of a sign to express such noncommercial speech subject to such other limitations as are included I n this chapter. C. Sign types are defined as follows: Animated Sign: Any sign that uses movement or change of lighting to depict action or create a special effect or scene. Business Sign: A sign which directs attention to a business, commodity, service, activity, idea, slogan, or entertainment conducted, sold, offered, or available upon the premises where such sign is located or to which it is affixed. Canopy: Any sign that is part of, or attached to, an awning, canopy, or the fabric, plastic, or structural protective cover over a door, entrance, window, or outdoor service area. A marquee is not a canopy. December 2002 City of Yorkville 8-11 -2 8- 11 -2 Commercial Sign Or Sign Of Commercial Nature: Any sign , the content of which advertises or publicizes any business , commodity, service, activity, idea, slogan, or entertainment conducted, sold, offered, or available by a person , corporation, or entity which has as its goal or effect the distribution of profits to the owners of the advertising enterprise. Freestanding Sign : Any sign supported by structures or supports that are placed on, or anchored in , the ground and that are independent from any building or other structure. Ground Sign : A permanent sign which is supported by uprights or braces securely anchored in the ground, with no more than two feet (2') of clear space between the bottom of the face of the sign and the grade beneath the sign face. Identification Sign: A sign used to display and identify the name of the individual , business, profession, organization, or institution occupying the premises upon which sign is located . Inflatable Sign : A sign inflated with air or helium , such as a balloon . Marquee Sign: A sign attached to any permanent roof like structure of rigid materials supported by and extending from the facade of a building. Permanent Sign : Any sign which is not a temporary sign, and which is designed to be in compliance with the currently adopted BOCA basic building code. Pole Sign : Any business sign having a supporting structure with a size less than twenty five percent (25%) of the two feet (2') of clear December 2002 City of Yorkville 8-11-2 8-11-2 space between the bottom of the face of the sign and the grade beneath the sign face. Portable Sign: Any sign not permanently attached to the ground or other permanent structure, or a sign designed to be transported, including, but not limited to, signs designed to be transported by trailer or means of wheels, menu and sandwich board signs, or balloons used as signs. Projecting Sign: Any sign affixed to a building or wall in such a manner that its leading edge extends more than twelve inches (12") beyond the surface of such building or wall. Real Estate Sign: A temporary business sign placed upon a property advertising that particular property for sale, rent, or lease. Residential Development Sign: A permanent ground sign placed at the major entrances to and identifying a residential development. Roof Sign: Any sign erected or constructed wholly on and over the roof of a building and supported by the roof structure. )� Temporary Sign: A sign intended to be displayed a limited length of time, as per section and is not permanently mounted. Vehicle Sign: Any vehicle primarily situated to serve as a sign rather than as transportation. An automobile, van, or truck displaying the name and/or other information regarding the related establishment used for normal business operation or for employee transportation is not a vehicle sign. Wall Sign: Any sign attached parallel to, but within twelve inches (12") of, a wall, painted on the wall surface of, or erected and confined within the limits of an outside wall of any December 2002 City of Yorkville 8- 11 -2 8- 11 -3 building or structure, which is supported by such wall or building and with only sign surface. Window Sign : Any sign, pictures, symbol, or combination thereof, designed to communicate information about an activity, business, commodity, event, sale , or service, that is placed inside a window or upon the window panes or glass and is visible from the exterior of the window. STREET FRONTAGE : The distance for which a lot line of a zoned lot adjoins a public street, from one lot line intersecting said street to the furthest distant lot line intersecting the same street. (Ord . 1998-36, 12- 17- 1998) 8- 11 -3 : PROHIBITED SIGNS: A. Billboards, i.e. , those structures over one hundred fifty (150) square feet used for attracting public attention for the purpose of advertising a location/product that may/may not be located within or available within the jurisdiction. B. Advertising signs (Note : This prohibition relates to residential and commercial zoning districts and commercial signs only) . C. Moving , rotating , or animated signs, except traditional barber poles not exceeding two feet (2') in height and projecting not more than twelve inches (12") from the building, utilized only to identify a haircutting establishment. In authorizing the latter exemption , the corporate authorities find it in the public interest to retain this historic symbol of American commerce. D. Searchlights, except searchlights permitted for grand openings or special business events with temporary permits. i E. Flashing signs and message boards (except time and/or temperature signs) . F. Freestanding panels or flags used to advertise products, prices, and services, or to attract attention. G . Illumination which is not steady and constant. December 2002 City of Yorkville 8- 11 -3 8- 11 -4 H. Windows painted in excess of fifty percent (50%) . I . Roof signs. J . Vehicle signs. K. Pennants. (Ord. 1998-36, 12-17-1998) 8-11 -4: PERMITTED SIGNS: A. All Districts: Unless otherwise stated, signs listed in this subsection are permitted in all zones and shall not require a sign permit. Such signs shall not be counted when calculating the number of signs or signage square footage on a premises. However, such signs shall conform with the general regulations , e.g. , height, area, setback, clearance, etc. , for signs enumerated in the remainder of this chapter. 1 . Name and address plates which give only the name and address of the resident of the building. 2. Memorial signs or tablets and signs denoting the date of erection of buildings. 3. No trespassing signs or other such signs regulating the use of a property. 4. Real estate signs. 5. Signs regulating on premises traffic and parking, and signs denoting section of a building such as lavatory facilities and public telephone areas. Signs must conform to the state uniform sign code. 6. Signs erected by a governmental body or under the direction of such a body, and bearing no commercial advertising , such as traffic signs, railroad crossing signs, safety signs, and signs identifying public schools and playgrounds. Signs must conform to the state uniform sign code. 7. Signs identifying places of worship when located on the premises thereof. 8. Bulletin boards for public, charitable, or religious institutions if used exclusively for noncommercial announcements. December 2002 City of Yorkville 8-11-4 8-11-4 9. The flag, pennant, or insignia of any government, or of any religious, charitable, or fraternal organization. 10. One logo flag of a company shall be allowed provided that it is flown with the American flag and shall not be larger than that flag. 11 . Temporary signs advertising the sale of edible farm products on the premises, advertising auctions, political candidates, or special events of businesses or charitable/public service groups. Such signage must be removed by close of business of the day the temporary sign permit expires. 12. Garage sale signs may be placed at the curbs in residential districts. Only one sign per street frontage per event is permitted. Such signage may only be placed on the property upon which the sale is conducted only for the duration of the sale. 13. Window signs of paper or similar material shall be allowed in business districts, provided that such signs are to be used to notify the public of special sales or current prices, business hours and/or health regulations. 14. Signs advertising company or group engaged in on site construction or rehabilitation may remain for the duration of such work. 15. Temporary signs advertising city sanctioned special events as approved by the code official. Such signage must be removed by close of business of the day the temporary sign permit expires. B. Residential Districts: 1 . Nameplates and identification signs, subject to the following: a. For one- and two-family dwellings, there shall be not more than one nameplate for each dwelling unit, indicating the name and address of occupant or a permitted occupation, except that on a corner lot two (2) such nameplates for each dwelling unit, one facing each side of the street, shall be permitted. b. For multiple-family dwellings, for apartment hotels, and for buildings other than dwellings, a single identification sign indicating only the name and address of the building and the name of the management thereof may be displayed provided that on a corner lot two (2) such signs, one facing each street, shall be permitted. 1 s December 2002 City of Yorkville 8- 11 -4 8- 11 -4 c. Identification signs for nonresidential uses, e.g. , public and quasi-public buildings, churches, cemeteries, golf courses, private nonprofit recreational areas, provided that such signs are limited to one sign per building. Permanent sign permit is required . d. Permanent residential development signs at entrances to a residential development or residential planned unit development and containing no commercial advertising, constructed of material which is the same or of a more permanent nature than the material used in the buildings. A permanent sign permit is required for each sign . (Ord. 1998-36, 12- 17-1998) e. Temporary residential marketing signs at major entrances to planned unit developments or residential subdivisions. Temporary sign permits and approvals by the zoning board of appeals are required. Such signage must be removed by close of business of the day the temporary sign permit expires. In determining the number, location, and duration of such signs, the code official shall consider the following factors: (Ord. 1998-36, 12- 17-1998; amd. Ord. 2001 -42, 8-9-2001 ) ( 1 ) Location of the development; (2) Size of the development; (3) Visibility the sign will achieve at the particular entrances at which signage is sought; (4) Proximity of existing and proposed residences; (5) Size of the proposed signage, both with regard to individual signs and with total signage requested. 2. Temporary residential off site marketing signs shall be allowed at not more than four (4) off site locations within the city of Yorkville to call attention and give directions to the development. Each sign may be located in any zoning district, provided that there is one-quarter 04) mile separation from each other, and that no such sign shall be closer to an existing residence than one hundred feet (100') . A temporary sign permit is required for each sign and such signage must be removed by close of business of the day the temporary sign permit expires. December 2002 City of Yorkville 8- 11 -4 8-11 -4 C. Business Districts: 1 . All signs permitted in residential districts. 2. Ground or pole signs ; one per street frontage, not to exceed one hundred (100) square feet in area, with a height (measured from average ground level) not to exceed six feet (6') for a ground sign or twenty feet (20') for a pole sign . A permanent sign permit is required for each sign. 3 . Wall signs; a permanent sign permit is required for each sign. i a. Single use buildings; two (2) signs per facade, but not to exceed a total of four (4) such signs. b. Multitenant buildings ; one sign per individual business or enterprise, two (2) signs per corner unit, one on each facade. A wall sign may be placed on any face of a building oriented to a public street, the main parking lot of the parcel, or a major access road. D. Manufacturing Districts: 1 . All signs permitted in residential districts and business districts. i 2. Ground or pole signs ; one per street frontage, not to exceed one hundred (100) square feet in area, with a height (measured from average ground level) not to exceed six feet (6') for a ground sign or twenty feet (20') for a pole sign. A permanent sign permit is required for each sign. 3 . Wall signs; wall signs are limited to an area equal to ten percent ( 10%) of the facade area upon which the sign is to be mounted. A permanent sign permit is required for each sign . 4. Real estate signs as follows: a. One sign per street frontage. b. Sign area cannot exceed twenty (20) square feet per face for each one acre of contiguous land area, not to exceed a maximum of four hundred (400) square feet of area per sign face and ten feet (101) in height. A temporary sign permit is required for each sign. Such signage must be removed by close of business of the day the temporary sign permit expires. (Ord . 1998-36 , 12- 17-1998) December 2002 City of Yorkville 8- 11 -5 8- 11 -5 8- 11 -5 : NONCONFORMING SIGNS: A. Any sign for which a permit has been lawfully granted prior to the effective date of this or any subsequent amendment to this chapter and which does not comply with the provisions of such amendment may nonetheless be completed in accordance with the approved plans, provided construction of the sign is started within ninety (90) days after the passage of the ordinance amendment and is completed within sixty (60) days after beginning construction . B. Whenever a nonconforming sign has been discontinued for a period of six (6) months, or whenever there is evident a clear intent on the part of the owner to abandon a nonconforming sign, such sign shall not, after being discontinued or abandoned, be reestablished, and the sign hereafter shall be in conformity with the regulations of this chapter. C . Normal maintenance of a nonconforming sign is permitted, including necessary nonstructural repairs or incidental alterations which do not extend or intensify the nonconforming features of the sign . D. No structural alteration, enlargement, or extension shall be made in a nonconforming sign, except when the alteration will actually result in eliminating the nonconformance. E. If a nonconforming sign is damaged or destroyed by any means to the extent of fifty percent (50%) or more of its replacement value at the time, the sign can be rebuilt or used thereafter only for a conforming use and in compliance with the provisions of this chapter. In the event the damage or destruction is less than fifty percent (50%) of its replacement value based upon prevailing costs, the sign may then be restored to its original conditions and the use may be continued which existed at the time such partial destruction until the nonconforming sign is otherwise abated by the provisions of this chapter. In either event, restoration or repair must be started within a period of thirty (30) days from the date of damage or destruction, and completed within sixty (60) days after beginning restoration or repair. F. Existing temporary signs shall expire at the termination date specified on the permit, but in no case later than six (6) months from the date of passage hereof. New temporary signs shall be allowed only in conformance with the provisions contained in this chapter. Such signage must be removed by close of business of the day the temporary sign permit expires. The code official shall, after passage of this chapter, notify each owner of a nonconforming sign, and the manner in which such sign is not in compliance with this chapter. The code official shall further notify each owner of a nonconforming sign that such sign must either be brought into compliance with this chapter or be removed. (Ord. 1998-363 12- 17-1998) 8- 11 -6: ILLUMINATION OF SIGNS : The illumination of all signs shall be diffused or indirect and shall be so arranged that there will be no direct rays reflecting into the public way or any lot on the perimeter of the premises on which the signs are located. Exposed light bulbs , neon tubing, flashing , blinking, traveling, and similar illumination, including illuminated canopies, are not permitted . (Ord . 1998-36, 12- 17- 1998) 8- 11 -7: COMPUTATIONS OF SIGNAGE: A. Computation Of Area Of Individual Signs: The area of the sign face, which is also the sign area of a wall sign or other sign with only one face, shall be computed by means of the smallest square, circle, rectangle, triangle, or combination thereof that will encompass the extreme limits of the writing representation, emblem , or other display, together with any material or color forming an integral part of the background of the display or used to differentiate the sign from the backdrop or structure against which it is placed. It does not include any supporting framework, bracing, or decorative fence or wall when such fence or wall otherwise meets zoning ordinance regulations and is clearly incidental to the display itself. A double faced sign shall count as a single sign . B. Computation Of Heights: The height of a sign shall be computed as the distance from the base of the sign at normal grade to the top of the highest attached component of the sign . Normal grade shall be construed to be the lower of: 1 ) existing grade prior to construction or 2) the newly established grade after construction, exclusive of any filling, berming , mounding , or excavating solely for the purpose of locating the sign. In cases in which the normal grade cannot reasonably be determined, sign height shall be computed on the assumption that the elevation of normal grade at the base of the sign is equal to the elevation of the nearest point of the crown of a public street or grade of the land at the principal entrance to the principal structure on the zoned lot, whichever is lower. Computation Of Maximum Total Permitted Sign Area For A Zoned Lot: The permitted sum of the area of all individual signs on a zoned lot shall be the total square foot area of all signs erected or maintained upon a building or lot of record not exceeding two (2) square feet for each linear foot of frontage of building thereon . Buildings having frontage on more than one dedicated street will be allowed signage for frontage on each street in accordance with the above formula. The above signs are limited to an area equal to ten percent (10%) of the facade upon which the sign is to be mounted. D . On Lots: Signs shall be placed no closer than five feet (6) to any lot line. Gasoline prices, one per street frontage, not to exceed twenty four (24) square feet, may be placed within one foot (1 ) of the lot line where it does not obstruct the view of traffic nor exceed fifteen feet ( 15) in height when mounted on light standards. B. On Corner Lots: Within that part of a yard or open area of a corner lot included within a triangular area of twenty five feet (25') from the point of intersection of two (2) street right of way lines forming such a corner lot, no sign shall be constructed having a height of more than thirty inches (30") or as required to provide necessary sight distance. (Ord. 1998-36, 12-17-1998) 8- 11 -9: PERMITTING PROCEDURES: A. Permits For Permanent Signs: Permits to build new permanent signs or to alter or move existing permanent signs: (Ord. 1998-36, 12-17-1998) 1 . No permanent sign shall hereafter be erected, altered , or moved until the person proposing to erect, alter, or move such sign shall have obtained a permit from the code official . Such permit shall be issued only when the sign complies with all of the applicable provisions of this chapter, or upon appeal of the code official's determination, has received approval from the zoning board of appeals. The fee for granting such a permit shall be established by the city council . The schedule of fees shall be posted in the city offices and may be amended only by the city council. (Ord. 1998-36, 12- 17- 1998; amd . Ord. 2001 -42 , 8-9-2001 ) 2. Any person desiring a permit for a permanent sign shall file a permit application which shall contain or have attached thereto the following information : a. Name, address, and telephone number of the applicant. b. Name(s) of the person , firm, corporation , or association erecting, altering, or moving said sign . c. A plat of survey, or a plan acceptable to the code official , that shows the location of the building, structure, or lot to which the sign May 2005 City of Yorkville 8-11 -9 8- 11 -9 is to be attached or erected, and showing the position of the sign in relation to nearby buildings and thoroughfares. d . A plan drawn to scale showing the design of the sign, materials used, and the method of construction and means of attachment to the building or ground. e. Written consent of the owner of the land on which the sign is to be erected, altered, or relocated. f. Any other information necessary for the code official to determine full compliance with this and all other applicable city ordinances. B. Permits For Temporary Signs : 1 . All temporary signs, except those enumerated in subsection 8- 11 -4A of this chapter, shall have a permit. Possession of a valid permit for a temporary sign shall entitle the owner to display such sign for the time period specified thereon. Permits for temporary signs must be kept on the premises where signs are displayed. 2. Permit applications for a temporary sign shall be made on the permit application form provided by the code official . The fees for granting such permits shall be established by the city council. The schedule of fees shall be posted in the city administrative offices and may be amended only by the city council. (Ord. 1998-36, 12-17-1998) 3. Duration of temporary signs shall not exceed the time shown in table II of this section. Any temporary sign must be removed by close of business of the day the temporary sign permit expires. Authority: The zoning board of appeals shall have jurisdiction and authority to enforce and make all decisions under the sign ordinance that were previously under the jurisdiction and control of the sign review board. B. Duties: 1 . Review and make a determination on any appeals to any order, requirement, decision or determination made by the code official in enforcement of this chapter. 2. Review all applications for variances to this chapter, conduct any necessary public hearings, and recommend action to the city council . 3. Administer oaths to persons testifying at such public hearings deemed necessary. (Ord. 2001 -42, 8-9-2001 ) 8-11 -11 : VARIATIONS: A. Right To Appeal For Variation : Any person found in violation of this chapter by any decision of the code official may take an appeal from the decisions or apply for a variation from the requirements of this chapter to the zoning board of appeals. Applications for variations may also be made in the absence of a finding of violation . B. Time For Filing Appeal Or Application: The appellant or applicant must file with the code official no later than thirty (30) days after receiving notice of such violation , a notice of appeal or application May 2005 City of Yorkville 8-11 -11 8- 11 - 11 for variation, directed to the zoning board of appeals, specifying the grounds thereof and relief sought. C . Right To Public Hearing: The zoning board of appeals shall grant to each appellant or applicant a public hearing . 1 . Date Of Hearing : The zoning board of appeals shall , within thirty (30) days after the date of filing of the appeal or application , set a date for the hearing, and have published a notice of said public hearing . 2. Notice Of Hearing: The zoning board of appeals shall give not less than fifteen (15) nor more than thirty (30) days' notice of the hearing . Such notice shall contain the address of the property in question , the owner of the property and the nature of the application or appeal . A copy of the notice shall be mailed to the appellant or applicant, and also the complainant if the hearing arises from the complaint of a person other than the code official . D. Continuances: The zoning board of appeals may, in its discretion , grant continuances, and shall notify the appellant or applicant and any complainant with respect to the appeal or application, or any continuance. E. Zoning Board Of Appeals Decision: After hearing an appeal , the zoning board of appeals shall affirm , modify, or reverse the decision of the code official or order him/her to act; after hearing an application for variation , the zoning board of appeals shall grant or deny the relief applied for or shall grant such other relief as it deems proper. The decision will be referred to the city council for final approval . F. Impose Restrictions, Conditions: The zoning board of appeals shall require from the applicants such sketches, drawings, or photographs as shall be necessary to indicate the present condition of the property or sign and the condition of the property or sign after the variation is granted. The zoning board of appeals may impose reasonable restrictions or conditions which the applicant shall be required to observe if the variance is granted. In considering the application for variance, the zoning board of appeals shall consider any unique physical property of the land involved , the available locations for adequate signing on the property, the effect of the proposed sign on pedestrian and motor traffic, the cost to the applicant of complying with this chapter as opposed to the detriment, if any, to the public from the granting of the variance and general May 2005 City of Yorkville 8-11 - 11 8- 11 - 14 intent of this chapter. (Ord. 1998-36, 12- 17- 1998; amd. Ord. 2001 -42, 8-9-2001 ) 8-11 -12 : MAINTENANCE: A. The owner of a sign and the owner of the premises on which said sign is located shall be jointly and severally liable to maintain such sign or signs subject to the following standards: 1 . Signs shall be maintained in a neat and orderly condition and good working order, including illumination sources, at all times. 2. Signs shall be properly painted unless galvanized or otherwise treated to prevent rust or deterioration . 3. Signs shall conform to maintenance provisions of the building and electrical codes as adopted by the city of Yorkville. (Ord. 1998-36, 12-17- 1998) 8-11 - 13: ABANDONED SIGNS: A. Except as otherwise provided in this chapter, any temporary sign installed for a period of thirty (30) days or more , or any sign which pertains to a time, event, or purpose which no longer applies, shall be removed. B . Permanent signs applicable to a business suspended because of change in ownership or management of such business shall be deemed abandoned if the property remains vacant for a period of six (6) months or more. An abandoned sign is prohibited and shall be removed by the owner of the sign or owner of the premises within thirty (30) days. (Ord. 1998-36, 12-17- 1998) 8-11 -14: REMOVAL OF SIGNS: Any sign found to be improperly maintained , abandoned, or otherwise in violation of this chapter which is not removed or repaired within thirty (30) days of written notice of the code official may be removed or repaired at the order of the code official . Any expense incidental to such removal or repair shall be charged to the owner of the property upon which the sign is located and shall constitute a lien upon the property.
