Since only one original committee member is still on the committee it was questioned if the current public safety committee could approve the minutes. A suggestion was made to consult the City Attorney for his opinion and for the minutes to be brought back for approval at the next public safety meeting. I have consulted City Attorney Mike Roth. He said that it is okay for the current committee members to approve the 2006 minutes. Page 1 of 3 PUBLIC SAFTY YORKVILLE CITY ALLLL 0 CONFERENCE ROOM DRAFT Thursday, July 13, 2006 Committee Chairman Rose Spears called the meeting to order at 6:30 p.m. Present Alderwoman Rose Spears; Aldermen Jim Bock and Jason Leslie; and Police Chief Harold Martin. 1. Minutes for Approval/Correction — Minutes from the June 8, 2006 meeting were approved without revision. 2. Handicapped Parking Signs Spears said there are still some businesses in town with signs posting fines of $ 100 for parking in spots reserved for handicapped parking. Chief Martin said that the city's police officers went to every business that still had the $ 100 fine posted and made a list. The list was given to Bill Dettmer. 3. PS 2006-30 Police Reports for June 2006 Martin said the report includes a couple of letters thanking officers for their work. He also said the M- 1 vehicle was decommissioned and turned over to the Park and Recreation Department. That department was short a vehicle. Martin said a new car has been ordered to replace the one that was in an accident. He said he's hoping insurance will cover at least 50 percent of the cost and the rest could come from the contingency fund. As for overtime, he said the department is holding the line on overtime. The committee agreed to put the report on the Aug. 1 Committee of the Whole's consent agenda. 4. PS 2006-31 ATF Bomb Dog Update Martin said Officer Jeff Johnson will be the handler for an ATF bomb dog. He will receive training for 10 weeks at a school in Virginia. Martin said representatives from Bureau of Alcohol, Tobacco, Firearms and Explosives recently visited the city. He said the federal government will pay for the officer's training. The city will pay the officer's salary. He added Yorkville is one of the smallest towns to receive a bomb dog and he credits that to a recommendation from U.S. Speaker of the House Dennis Hastert. PS 2006-32 Cannonball Trail @ John Street Signage Martin said the city received a letter from Sheriff Randall requesting that the Cannonball Trail/John Street intersection be signed as a three-way multi-stop intersection. He said the city did an analysis and determined that it is not necessary to have a three- way stop sign at that intersection. His recommendation is to remove the yield signs on Cannonball Trail and add a yield sign for eastbound John Street. He also suggested the intersection be re-evaluated periodically. Martin said the city put up three yield signs on Cannonball Trail. He said the signs should actually be on John Street not Cannonball Trail. His opinion is that the intersection should be legal. If there' s an accident there, then the city's liable. If the county wants to take over John Street from Cannonball to Route 34, that would be acceptable. Martin said city engineer Joe Wywrot will have to talk to county officials to try to get something worked out or the city would have to put yield signs on John Street. Eventually, he said as the city grows, the situation will get worse and something will have to be done. Spears said that if the city puts together a letter to the county on the issue, a letter also should be sent to Judge Wilson. The committee decided to bring the issue to the COW for discussion. 6. PS 2005-13 Countryside Parkway — Proposed Address Changes Spears said the original strategy was to have people on Countryside Parkway change the addresses of the residences as they moved and new people moved in. Then, Mayor Art Prohaska said there are other areas in the city that do no conform to the adopted address grid. It was then decided to correct all the improperly number addresses at the same time. Spears said her neighbors are against it because of the cost involved. Alderman Jim Bock said he thought this issue was resolved when the city decided to notify KenCom about the addresses. Spears wanted to know home many homes are in these areas. She also said she'd like to look at ward maps to see where all of these areas are located. The committee decided to wait until the maps were received and could be reviewed before forwarding the issue to the C.O.W. Page 3 of 3 7, PS 2006-17 Smoking Ban Discussion Leslie said he would send some information to Spears regarding a potential smoking ban. He's been researching what the Illinois regulations are. He said he could have the information ready for the Sept. 5 C.O.W. meeting. 8. Additional Business Leslie said he talked to Mayor Prochaska about extending drinking hours in Yorkville to match those allowed in the county and neighboring communities. Martin said he doesn't like giving people more time to drink, but he also doesn't want people leaving Yorkville, going elsewhere to drink and then driving back. That issue also will be brought to the Sept. 5 C.O.W. meeting. Presentation: None New Business: (The committee moved forward to Item #9). 9. PS 2007-16 Request to Amend Liquor License Ordinance Regarding Patio Licenses This issue had been discussed at a prior meeting regarding a business downtown and the safety factor for children frequenting the business located near the train tracks. The Mayor requested to give some background to the committee. She said that when Taylor Street Pizza asked for a patio license, she allowed the 5-foot fence the previous Mayor had requested. She made this decision just after being elected and stated she wants to be consistent She also said State Statute allows the Mayor to make such decisions. Following other patio license requests, she wants all applicants to be dealt with fairly. She asked for the Council's input so the ordinance is standard. There is a now a limit of three patio licenses and she feels the number should be larger. She said Legends has erected a 4-foot fence with the understanding they would add flower planters, etc. to increase the height of the barrier. Page 2 of 8 Ms. Spears said that the ordinance needs to be readdressed and the number of licenses possibly increased. Other nearby towns do not require a 5-foot fence and she did not feel it was needed for safety. Alderman Werderich noted that all three of the outside licenses have been requested, though no permits have been issued. One establishment is out of business. He felt that different circumstances could call for different fence heights. The fencing material was also discussed and Alderwoman Spears suggested it should be the decision of the business. Mr. Werderich summarized the situation being discussed: that the fence in question was built before the liquor application and was based on the building code. Mayor Burd added that Mr. Ratos had been notified prior to installing his fence and built a 4-foot rather than the 5-foot fence he was told to install. She noted that Taylor Street Pizza had conformed while Mr. Ratos did not. She said she hoped for City Council support in her decision. Mr. Kotter of Taylor Street Pizza said that while he has installed his fence and raised it off the ground a foot to meet the 5-foot requirement, he is still not able to serve liquor until a liquor inspection is done. Mr. Olson said the permit is signed, but due to the 1 - foot gap at the bottom of the fence, the permit had not been issued to the business yet. A suggestion was made by Attorney Dan Kramer that a 4-foot minimum fence would meet the building code. Language should also be added that would state "otherwise approved by Liquor Commissioner" when the permit is issued. Discretion is needed, he said. It was noted that Attorney Kramer was present at this meeting on behalf of the sports bar "Legends" as well as the nearby restaurant. Mr. Kramer said Mr. Ratos had called Bill Dettmer regarding the fence height before Ratos ordered the fence. According to the Mayor, a courtesy call was made to Ratos by Mr. Olson. A suggestion was made to include any height variation language in the liquor permit. Alderman Plocher questioned the point from which a fence height is measured. It was decided it should be measured from finished grade with language stating that a fence must measure a minimum of 4-foot and have final approval from the Liquor Commissioner. The City Attorney will also be asked to review this language. This matter will move to the July 24`h C.O.W. Page 3 of 8 10. PS 2007-17 Request to Limit Number of Package Liquor Licenses Some committee members asked why the number should be limited. The Mayor said the number should be abolished and be determined by mayoral discretion. Alderwoman Spears asked if the City might be challenged if an unlimited number were offered. Mr. Werderich said the applicant should have to prove themselves, rather than the City limiting the number. Ms. Spears suggested the City should check with the Attorney and gather information from other municipalities. It was thought that most other towns do not have a limit. After a brief discussion, it was decided that Bart Olson will consult with the attorney and with Bill Dettmer regarding the fencing issue and these items will be placed on the August 10 City Council agenda. Mr. Olson suggested breaking this down into two segments: 1 ) move forward with fencing amendment and 2) obtain legal opinion for the license limits. Since there is adequate time, a survey of other towns will also be done. In an informal vote, all committee members ratified the 48" fence requirement and to abolish the package liquor license limits. (return to regular order of agenda) Minutes for Correction/Approval: July 13, 2006 It was questioned why the minutes were so late (2006) and Mr. Olson explained it was likely the minutes had been approved at a C.O.W. meeting, but not approved by the committee. This would have occurred when the governing ordinance took effect and committee structures changed. Since only one original committee member is still on the committee, it was suggested that the Attorney be consulted for his opinion on how they should be approved. This item will come back next month. New Business: 1. PS 2007-08 Police Reports for June 2007 It was noted that recent training had been received regarding the design and construction of a new police facility. Chief Martin will give a presentation at the August 13th Public Safety meeting. In other training, officers learned about terrorists possibly using crop duster planes. Alderwoman Spears encouraged all such training and Chief Martin noted that Homeland Security pays for this. Chief Martin also noted a correction (there were 2 `January's') in the offense report. No further action. 2. PS 2007-09 Request to Purchase Terex RL 4000 Light Tower Sgt. Delaney requested the purchase of this item that can be used for traffic reconstruction, disasters, for areas of low lighting and city events. It has its own generator. The cost difference between a new and used light is minimal. The consensus Page 4 of 8 was to purchase this item at a cost of approximately $7,500 and since the purchase is under $ 10,000, it will not need to be forwarded to City Council. 3. PS 2007-10 Request for No Left Turns at Rt 47 & Hydraulic and Rt 47 & River Chief Martin said this action is needed and needs City Council approval. It would be enforced under current ordinances. The wording was clarified that no lefts turns would be allowed from Hydraulic onto Rt. 47 and left from River Rd. onto Rt. 47. An ordinance is not needed for enforcement, according to Bart Olson, however, he said there should be one to memoralize the decision. The City will send a letter to IDOT and this item will be forwarded to C.O.W. in order to inform the entire Council. Alderman Plocher said the same situation occurs on West Main St. Parked cars would need to be further back from the intersection. A similar problem was noted on Countryside Parkway. This moves to the July 24th C.O.W. Committee members all informally voted to ratify this decision. 4. PS 2007-11 Cannonball Trail @ John Street - Intersection Signage The City Engineer brought this problem forward initially. Chief Martin said the intersection is a problem and had been discussed in 2006 (as noted in the minutes for approval). There is a 3-way yield at this intersection that is confusing. IDOT regulations do not allow for a 3-way yield, but the intersection does not warrant stop signs at this time. The Chief said the Kendall County Sheriff had sent a letter requesting stop signs except for the side from which sheriff s vehicles would leave. The City would be liable if an accident occurred there because the City knew it was improperly signed. He said he would like the City Attorney's opinion. To make the intersection legal, both yield signs would be needed on John St., however, that would require the county squads to yield. Alderwoman Sutcliff noted that traffic has increased there. The Chief will contact Sheriff Randall and will also ask for a letter from the Mayor stating the action the City desires to make this intersection legal. This matter will be brought back to committee for review. The consensus of the group was to carry out this action. Page 5 of 8 5. PS 2007-12 Traffic Unit Discussion Alderwoman Spears complimented Sgt. Delaney's written proposal for a Traffic Unit. Chief Martin explained that the majority of calls they receive concern complaints regarding traffic. While some are perception, other complaints require action. The Traffic Unit would address specific issues and would be proactive in child-related issues. It was noted that the Child Seat Safety Event is a popular event and was started in Yorkville. Chief Martin noted that child seat installations would be done at any time. Chief Martin said officers will work with citizens who report various traffic situations like speeding. He said the cost of a Ladar (a laser speed detector) is $5,000. The hand- held units are $ 110041200. Alderwoman Spears suggested that developers should contribute toward these purchases since they help generate traffic. Discussion tamed to impound and forfeitures. Alderman Werderich explained there is a state statute that says if a person commits certain crimes, police can take certain assets from the perpetrator. This is the forfeiture portion. There is also an impoundment proposition that would be part of the city ordinances and would allow for an impoundment fee. Chief Martin noted that the formation of a Traffic Unit was a goal set for him by the prior Mayor and Public Safety Chairman. The consensus of the committee was to approve the formation of the Traffic Unit. No further action is needed. 6. PS 2007-13 Request to Use City Owned Land Parcels for Vehicle Storage Chief Martin presented suggestions for storage of impounded vehicles. Those locations are: just east of the old post office, near the old water tower and by the river near the former Parks building. The water tower location is the most desirable since it is least visible and would be enclosed with a slat type fence. Alderman Werderich said he is totally opposed to using the area near the river since that area should be preserved. He asked if impound money could be used to buy a parcel of land for vehicle storage as a long term solution. Chief Martin said the water tower area (south end of town) would be fenced and added that the money the City would receive from an impound would be less than 50% after other public bodies get their share. The Chief hopes that in 2-3 years a new police facility would be built with adequate storage space. The committee consensus was to approve this temporary solution. All committee members agreed to the fact that storage is needed and that the short-term solution is agreeable. Page 6 of 8 7. PS 2007-1 Sale of 1991 Ford Thunderbird (Old DARE Car) The Police Department wishes to have Council approval to sell the former DARE car that has very high mileage. Sealed bids will be taken with no minimum regsuired. The committee approved this action and this item will move to the July 24` consent agenda. 8. PS 2007-15 Request to Purchase Vehicles — Planned in FY 07108 Budget The City currently has money budgeted for one new police vehicle according to Chief Martin. He said had approved a purchase order already since the time to order was by June 29''. A total of four vehicles are in the budget for this fiscal year. Two vehicles are needed in the next couple months when more funds are available. The committee approved of this purchase and Alderwoman Sutcliff noted that the City should explore alternative fuel vehicles for the City. This item will move to the consent agenda on the next C.O.W. meeting. 10. PS 2007-17 Request to Limit Number of Package Liquor Licenses Because of the number of liquor license applications, this item was brought to the committee. According to Bart Olson, many of the applicants have been asking how many licenses would be allowed. Alderwoman Sutcliff asked if there is a limit on the number of bars in the City. Chief Martin said there was a limit of 3 bars and it was thought that was for the entire town. Distance between the bars was also discussed and it was noted the cost is $750 per liquor license. The Attorney will be consulted for his legal opinion. The Chief said that the City must be careful about placing limits and especially since liquor is sold in various places including gas stations, package liquor stores, etc. The consensus of the group was to conduct some research first including municipal fees and then consult the City Attorney. This will be brought back to committee in August. 11. PS 2007-18 Bicycles and Roller Wheels Ordinance Discussion Chairwoman Rose Spears said this item had been before committee a year ago and was tabled at that time. (Sample ordinances from other towns were handed out.) Ms. Spears said she had received complaint calls regarding rollerblading in business parking lots. However, it was noted that this was private property. Alderman Plocher said he would rather see kids rollerblading instead of drinking and Aldermen Werderich and Sutcliff said they were opposed to restricting kids in that manner. Alderman Werderich added that there are very few trails to reach the downtown. Page 7of8 David Mogle added that restricting rollerbladers from riding in parking lots could cause them to ride on public streets. Motorized scooters were also briefly discussed. The consensus of the group was that they were opposed to an ordinance prohibiting rollerblading in the City. No further action. 12. PS 2007-19 Public Display of Signs — Discussion Only Chairwoman Spears asked to include this agenda item due to the appearance and placement of some of the campaign signs during the recent election. She felt it became a safety issue and noted it is against the law to place them in the right-of-way. She recommended a campaign packet that would outline where signs could be posted and other rules regarding campaign signs. Alderman Plocher noted that Oswego had sent him a campaign policy. He noted there is a fine associated with the numerous builder signs placed on the weekends. Mr. Plocher said that if there was a fine for illegally placed campaign signs, there was also a chance that the signs could be illegally moved causing the candidate to be fined. Mayor Burd said she favored freedom of speech and campaigns were a time to connect with constituents. Alderwoman Spears said placement in the right-of-way is illegal and that candidates would be sending the wrong message if they placed signs there. A request was made for Mr. Olson to obtain campaign rules from other towns so that research could be done prior to any policy-making. It was suggested to make recommendations on campaign petitions. It was noted that campaign petition information falls under the City Clerk. Mayor Burd also suggested a public relations piece prior to any election to help guide a potential candidate through the election process. Acting City Administrator Olson commented that a new legal opinion should be obtained prior to discussion on campaign packets. And he said that he had concerns with staff outside the Clerk's office, rendering opinions on materials needed for the Clerk's office. Mayor Burd said the State Board of Elections packets could be used. She said she had made a telephone call to the State Board to determine the proper petition to be used for the City elections because she said the process was confusing. Information will be obtained from other municipalities prior to any further discussion. In a related signage matter, Chairwoman Spears said she had received inquiries regarding the crosses erected after fatal accidents. The Police Chief said most of the crosses in the City are on state property and if they are not in the right-of-way, they are not illegal. He said the State does not remove them. Alderwoman Sutcliff said she felt they served as a warning. No further action. Page 8 of 8 13. PS 2007-20 Proposed Amendment to Solicitors, Hawkers & Itinerant Merchants Ordinance This item came from a request by the area vendors who sell ice cream from trucks. Chief Martin said the vendors wish to also sell ice cream on Sundays until dark. It was noted that background checks are done on the individual drivers. The committee agreed to this request. Since it is an amendment to the ordinance, the request will be forwarded to the July 24th C.O.W. consent agenda. Old Business: Mayor Burd said that she had recently observed persons sitting on the dam. She called the police and the persons were charged. Police will be carefully monitoring this area. Ms. Spears asked about the status of the stop sign on westbound Countryside and Mr. Olson said he is checking the cost of a lighted stop sign. He asked if that would be a problem with any of the citizens on the corner since a variance for a similar sign had just been denied to a church in that area. It was decided that the start time of the Public Safety meeting would change to 6pm. This change will be posted on the web page. Bart Olson noted an amendment would be needed for the Governing Ordinance. The meeting was adjourned at 9:37pm. Pfizenmaier has been a valued member of this Police Department for two years now, and he has exceeded the expectations of his supervisors and patrol officers that work hand -in-hand with him on a daily basis. I have never been told anything negative about his performance or attitude, everything has been extremely positive. Because of all the above points, I feel we should do what we can to keep him employed with our Department until he can test for our patrolman position this fall . We have put a lot of time and training into him , and if we discontinue his employment it would be a great disservice to this Department and our community. In my opinion, he would be a great addition to our Department as a patrolman, and I don 't think I am alone in thinking this way. (TWL) and Subscriber. I . Services. Subscriber is subscribing to LETN's instructional programs (the "Programs") and other professional services selected above. 2. Term. LETN will provide, at its cost, all repairs or services to the Equipment; provided that Subscriber will reimburse LETN for the cost of any repairs or services required as a result of Subscriber's negligence. Should a DVD player be provided, LETN is not responsible for maintenance or repair of DVD player nor maintain ownership of player. 4. Service Fees. Subscriber will pay LETN the Annual Service Fee and the Implementation Fee, if any, within 30 days of signing this agreement. If Subscriber relocates, Subscriber will be responsible for all costs incurred by LETN to relocate the Equipment and provide services at the Dew location. Failure to pay any sum within 10 days of the due date will constitute a default of this Agreement. Covenants of Subscriber. Subscriber agrees to use the Equipment only in connection with the Programs. Subscriber further agrees to permit only Subscriber's personnel to use the Equipment and view the Programs and only at the Premises. Subscriber will not broadcast, rent, sell, or otherwise distribute the Programs to any other location. Subscriber will not copy, reverse engineer, or otherwise decompile the Software for any purposes whatsoever unless agreed to and noted on a separate agreement. 6. WARRANTY. LETN DOES NOT MAKE, AND SUBSCRIBER EXPRESSLY WAIVES, ANY REPRESENTATION, WARRANTY, OR COVENANT, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANTABILITY, CONDITION, QUALITY, DURABILITY, DESIGN, OPERATION, FITNESS FOR USE OR SUITABILITY OF THE PROGRAMS, TITLES, EQUIPMENT, OR SERVICES. Subscriber understands that satellite telecasting is an endeavor of high technical complexity and agrees that lack of Program availability (downtime) will not constitute a breach of this Agreement. LETN does not warrant that satellite reception of the Programs will be uninterrupted or trouble-free. 7. LIMITATION OF LIABILITY. LETN IS NOT LIABLE FOR ANY ACTUAL, DIRECT OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED, TO LOST PROFITS, ARISING OUT OF THIS AGREEMENT OR ANY BREACH OF THIS AGREEMENT, EVEN IF LETN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LETN'S LIABILITY SHALL NOT EXCEED, IN THE AGGREGATE, THREE TIMES THE MONTHLY SERVICE FEE. 8. Remedies. If Subscriber defaults in any of its obligations, LETN may, in addition to any other remedies, terminate this Agreement, upon which, Subscriber will pay LETN, as liquidated damages and not as a penalty, and in addition to any other remedies, a sum equal to 0 of the Monthly Service Fees due under the remaining term of this Agreement, plus, if LETN installed any Equipment, $300.00 for de-installation. 9. Action upon Termination. Upon termination of this Agreement for any reason, Subscriber will immediately cease using the Programs and Equipment, and will return the TOD Titles (if these services were selected) to LETN, at Subscriber's cost, via insured shipment. If LETN installed any satellite receive equipment, Subscriber will provide reasonable access to LETN for the removal of that equipment. Subscriber will reimburse LETN an amount equal to 80% of the regular purchase price for those TOD Titles not returned. 10. Successors and Assigns. LETN may assign this Agreement and any of its rights and may delegate any of its obligations hereunder. Subscriber may not assign this Agreement without the express prior written consent of LETN. Any attempt by Subscriber to assign this Agreement without such consent will be void and will constitute a default. LETN will not unreasonably withhold consent of an assignment to a successor operating out of the Premises. Failure to assign this Agreement to a successor will not be cause for termination of this Agreement. This Agreement is binding upon and inures to the benefit of the parties and their respective successors and permitted assigns. 11 . Force Majeure. Failure of either party to perform its obligations, other than Subscriber's obligations to pay any charges when due, will not be a default or breach if the failure is the result of acts of God, any government or regulatory agency, common carrier, equipment manufacturer, or cause beyond the reasonable control of LETN or Subscriber, such as, but not limited to, fire, explosion, flood, strike, riot, communications or power supply, delay in delivery, or failure or malfunction of equipment. 12. GOVERNING LAW. THIS AGREEMENT IS TO BE CONSTRUED, ENFORCED AND GOVERNED BY THE LAWS OF THE STATE OF TEXAS WITHOUT REGARD TO PRINCIPLES OF CONFLICTS OF LAWS, WITH VENUE IN DENTON COUNTY, TEXAS. 13. Entire Agreement. Except for the Installation Agreement (and, if applicable, the Course Creation Tool Addendum), this Agreement constitutes the entire Agreement between LETN and Subscriber and supersedes all prior agreements and negotiations, written or oral, relating to this subject matter. No change or waiver of the provisions of the Agreement will be valid or enforceable unless in writing and executed by the party against whom the change or waiver is sought to be enforced. Any terms or conditions in addition to or inconsistent with the preprinted terms and conditions of this Agreement are of no force or effect unless expressly agreed to in writing signed by an authorized representative of LETN. Bridge Street, between the south side of Van Emmon Street and the north side of Van Emmon Street, shall be designated for parallel parking only in those areas of said street so marked, adjacent to the traveled portion of said street, and all vehicles parking adjacent to the northbound lane of Bridge Street shall park parallel with the front of said auto facing in a northerly direction, and all vehicles parking adjacent to the southbound lane of Bridge Street shall park parallel with the front of said auto facing in a southerly direction . 2. It shall be unlawful to park any vehicle upon Bridge Street in the city between Van Emmon Street and the Fox River other than parallel to the traveled portion of Bridge Street in areas so designated and marked for parallel parking; and no vehicle shall be parked upon the aforesaid street for more than two (2) consecutive hours, between the hours of six o'clock (6:00) A.M . and eight o'clock (8:00) P . Prohibited Parking Areas Described: A "no parking" zone shall be created on any grassy area of the Beecher community building property located at 908 Game Farm Road. 2. Violation And Penalty: Any violation of this subsection C shall result in a fine of twenty five dollars ($25.00) to any person charged hereunder; and the city shall further be allowed the right to tow any vehicles from said "no parking at any time" zone, that are parked in violation thereof, and assess to the owner or driver of said vehicle, any and all reasonable towing charges as are billed to the city. (Ord. 1991 -8, 4-25-1991 ) D. City Parkways: 1 . Prohibited Parking Area Described: Parking shall be prohibited on all city parkways in the area between the curb and sidewalk area, at all times. 2. Violation And Penalty: Any violation of this subsection D shall result in a fine of fifty dollars ($50.00) to any person charged hereunder and the city shall further be allowed the right to tow any vehicle from said "no parking" zones that are parked in violation thereof and assess reasonable towing charges as are billed to the city, to the owner or driver of said vehicle. Prohibited Parking Area Described: A "no parking" zone shall be established on the east side of the Bristol-Kendall fire station from September 2006 City of Yorkville 6-2-4 6-2-5 6-2-4: TWO HOUR TIME LIMIT PARKING: A. The following areas shall be designated for two (2) hour parking and no vehicle shall be parked upon said designated areas for more than two (2) consecutive hours between the hours of six o'clock (6:00) A.M. and eight o'clock (8:00) P.M. daily, including Sundays and holidays: City parking lot contiguous to Van Emmon Street on the south and an alley running northerly between Van Emmon Street and Hydraulic Avenue, said city parking lot being more fully described as follows: commencing in the Southwest corner of Lot 6 in Block 12 of Black's Addition to the City of Yorkville; running thence northerly along the east line of an alley, 87 feet; thence easterly along the north line of said Lot 6, 57 feet; thence southerly 87 feet, more or less, to the north line of Van Emmon Street; thence westerly along said Van Emmon Street, 57 feet to the point of beginning, in the City of Yorkville, Kendall County, Illinois. (Ord. 1971 -8, 6-10-1971 , eff. 7-1 -1971 ) Van Emmon Street, between the east line of an alley running between Van Emmon Street northerly to Hydraulic Avenue and midway between Bridge and Heustis Streets. Permit Created: There is hereby created a special permit to identify handicapped individuals and to designate identified vehicles used to transport said handicapped individuals. The permit shall be known as the handicapped identification permit. The handicapped identification permit shall be issued to those individuals who meet the definition in 625 Illinois Compiled Statutes 5/1 -159. 1 . (Ord. 1981 -3, 2-12-1981 ) B. Application For Permit; Issuance: To obtain this permit, the applicant or representative must submit an application and all necessary September 2006 City of Yorkville 6-2-5 6-2-7 c. Temporary place cards for those who qualify for temporary disability pursuant to state statute shall have a red background with white lettering; and d. All place cards shall be of hanging style from rearview mirrors, two (2) sided, have the international symbol of access at least three inches (3") in height and centered on the place card, have an identification number at least one inch ( 1 ") in height, and have the identification of the issuing authority; and e. The place card shall be hung on the rearview mirror. Dashboard or visor placement is allowed when no rearview mirror is available. 2. Duration Of Permits: All permanent disability permits shall be issued for a period of two (2) years; all temporary disability permits shall not be issued for a period in excess of ninety (90) days, subject to renewal for a like period upon showing of the continued disability. (Ord. 1994-3, 2-24- 1994) 6-2-6: RESTRICTIONS ON OVERNIGHT PARKING AND COM- MERCIAL VEHICLE PARKING: A. Limitation On Parking Of Second Division Vehicles: No second division vehicle, including contractors' trailers and equipment, except those with a license classification of A or B under the provisions of the Illinois vehicle code shall be parked for a period longer than one hour on any public street in a residential district, except where making a delivery or rendering a service at such premises. At Par. "A" the restriction is defined. At Par. `B" the exemption language (which was included under "A" in the previous draft) has been set out in a separate section for clarity. The language has been revised so that there is no longer any discretion for the grant of the application. (The prior language required the Chief of Police to determine is a "hardship" existed.) The revised language will allow any property owner to obtain up to 10 exemptions per year, the duration of each exemption is limited to not more than three days. At Par. "C" Chief Martin has suggested that four times per year be identified as exempted throughout the City (Memorial Day, Labor Day, Thanksgiving and Christmas). The language has been expanded per suggestion by the Chief, and he will issue a letter from which the language was adopted (Copy Attached). At Par. "D" the Opt Out language has been amended to indicate that it will entail a petition process. The language is further amended to provide for a compilation of a list by the Chief of Police and a 24 month expiration. The opt out can be renewed (without limit) upon reapplication. This ordinance prohibits parking on all United City of Yorkville streets between the hours of 1 a.m. to 6 a.m . Realizing that there are some times when our residents will need a temporary exemption to this ordinance the police department has developed a process for residents to request these exemptions. A resident may request a temporary exemption for vehicles owned by them or a guest at their residence. This request will be made by calling the police department's non- emergency phone number (630) 553-4343. When making this call you will have to provide your residence address and the vehicle's license plate number and state, make, color and model. We will also need to know the date(s) for which the exemption is being requested , up to three nights in a row. Residents can request exemptions up to ten times a year. These exemptions will be for times when you may be having out of town guests for a family party or some other event for which you do not have enough garage and driveway space to allow all the vehicles to park off of the street. These will not be permanent exemptions and each request will be reviewed by a watch commander. Knowing that a few particular times of the year are particularly busy times for guests to visit, we will not require any exemptions to be requested during the following times: Memorial Day weekend , Friday - Monday Labor Day weekend , Friday - Monday Thanksgiving weekend , Thursday - Monday December 22 - January 2 , of each year We hope this provides the needed information for our residents to make these arrangements to allow for these special circumstances. Blagojevich on July 23 , 2007, and will take effect on January 1 , 2008. Sections 15, 20, and 30 of the Act are pertinent to the City, in that those sections define the scope of the ban, how we as an employer must create signage to communicate the ban to employees and visitors, and that we as an employer must prohibit smoking in City vehicles. Be it enacted by the People of the State of Illinois , represented in the General Assembly : Section 1 . Short title . This Act may be cited as the Smoke Free Illinois Act . Section 5 . Findings . The General Assembly finds that tobacco smoke is a harmful and dangerous carcinogen to humane beings and a hazard to public health . Secondhand tobacco smoke causes at least 65 , 000 deaths each year from heart disease and lung cancer according to the National Cancer Institute . Secondhand tobacco smoke causes heart disease , stroke , cancer, sudden infant death syndrome , low-birth-weight in infants , asthma and exacerbation of asthma , bronchitis and pneumonia in children and adults . Secondhand tobacco smoke is the third leading cause of preventable death in the United States . Illinois workers exposed to secondhand tobacco smoke are at increased risk of premature death . An estimated 2 , 900 Illinois citizens die each year from exposure to secondhand tobacco smoke . '.. The General Assembly also finds that the United States Surgeon General ' s 2006 report has determined that there is no risk- free level of exposure to secondhand smoke ; the scientific evidence that secondhand smoke causes serious diseases , including lung cancer , heart disease , and respiratory illnesses such as bronchitis and asthma , is massive and conclusive ; separating smokers from nonsmokers , cleaning the air, and ventilating buildings cannot eliminate secondhand smoke exposure ; smoke- free workplace policies are effective in reducing secondhand smoke exposure ; and smoke- free workplace policies do not have an adverse economic impact on the hospitality industry . The General Assembly also finds that the Environmental '.. Protection Agency has determined that secondhand smoke cannot be reduced to safe levels in businesses by high rates of ventilation . Air cleaners , which are capable only of filtering the particulate matter and odors in smoke , do not eliminate the known toxins in secondhand smoke . The American Society of Heating , Refrigerating and Air-Conditioning Engineers (ASHRAE ) bases its ventilation standards on totally smoke- free environments because it cannot determine a safe level of exposure to secondhand smoke , which contains cancer-causing chemicals , and ASHRAE acknowledges that technology does not exist that can remove chemicals that cause cancer from the air . ' A June 30 , 2005 ASHRAE position document on secondhand smoke concludes that , at present , the only means of eliminating health risks associated with indoor exposure is to eliminate all smoking activity indoors . Section 10 . Definitions . " Bar " includes , but is not limited to , taverns , nightclubs , cocktail lounges , adult entertainment facilities , and cabarets . " Department " means the Department of Public Health . " Employee " means a person who is employed by an employer in consideration for direct or indirect monetary wages or profits or a person who volunteers his or her services for a non-profit . entity . "Employer " means a person , business , partnership , association , or corporation , including a municipal corporation, trust , or non-profit entity, that employs the services of one or more individual persons . '.. "Enclosed area " means all space between a floor and a ceiling that is enclosed or partially enclosed with ( i ) solid walls or windows , exclusive of doorways , or ( ii ) solid walls '.. with partitions and no windows , exclusive of doorways , that '.. extend from the floor to the ceiling, including , without limitation , lobbies and corridors . "Enclosed or partially enclosed sports arena " means any sports pavilion, stadium, gymnasium, health spa , boxing arena , swimming pool , roller rink , ice rink , bowling alley, or other similar place where members of the general public assemble to engage in physical exercise or participate in athletic competitions or recreational activities or to witness sports , cultural , recreational , or other events . "Gaming equipment or supplies " means gaming equipment / supplies as defined in the Illinois Gaming Board Rules of the Illinois Administrative Code . " Gaming facility" means an establishment utilized primarily for the purposes of gaming and where gaming equipment ',.. or supplies are operated for the purposes of accruing business revenue . "Healthcare facility" means an office or institution providing care or treatment of diseases , whether physical , mental , or emotional , or other medical , physiological , or psychological conditions , including , but not limited to , hospitals , rehabilitation hospitals , weight control clinics , nursing homes , homes for the aging or chronically ill , laboratories , and offices of surgeons , chiropractors , physical therapists , physicians , dentists , and all specialists within these professions . " Healthcare facility" includes all waiting rooms , hallways , private rooms , semiprivate rooms , and wards within healthcare facilities . " Place of employment " means any area under the control of a public or private employer that employees are required to '.. enter , leave , or pass through during the course of employment , including, but not limited to entrances and exits to places of employment , including a minimum distance , as set forth in Section 70 of this Act , of 15 feet from entrances , exits , windows that open , and ventilation intakes that serve an enclosed area where smoking is prohibited; offices and work _ areas ; restrooms ; conference and classrooms ; break rooms and cafeterias ; and other common areas . A private residence or home-based business , unless used to provide licensed child care , foster care , adult care , or other similar social service care on the premises , is not a "place of employment " . For purposes of this definition, "Private club " means an organization that is managed by a board of directors , executive committee , or similar body chosen by the members at an annual meeting, has established bylaws , a constitution , or both to govern its activities , and has been granted an exemption from the payment of federal income tax as a club under 26 U . S . C . 501 . " Private residence " means the part of a structure used as a dwelling , including , without limitation : a private home , townhouse , condominium, apartment , mobile home , vacation home , cabin , or cottage . For the purposes of this definition , a hotel , motel , inn , resort , lodge , bed and breakfast or other similar public accommodation , hospital , nursing home , or assisted living facility shall not be considered a private residence . " Public place " means that portion of any building or vehicle used by and open to the public , regardless of whether the building or vehicle is owned in whole or in part by private persons or entities , the State of Illinois , or any other public entity and regardless of whether a fee is charged for admission , including a minimum distance , as set forth in Section 70 of this Act , of 15 feet from entrances , exits , windows that open , and ventilation intakes that serve an enclosed area where smoking is prohibited . A "public place " does not include a private residence unless the private residence is used to provide licensed child care , foster care , or other similar social service care on the premises . A "public place " includes , but is not limited to , hospitals , restaurants , retail stores , offices , commercial establishments , elevators , indoor theaters , libraries , museums , concert halls , public conveyances , educational facilities , nursing homes , auditoriums , enclosed or partially enclosed sports arenas , meeting rooms , schools , exhibition halls , convention facilities , polling places , private clubs , gaming facilities , all government owned vehicles and facilities , including buildings and vehicles owned, leased , or operated by the State or State subcontract , healthcare facilities or clinics , enclosed shopping centers , retail service establishments , financial institutions , educational facilities , ticket areas , public hearing facilities , public restrooms , waiting areas , lobbies , bars , taverns , bowling alleys , skating rinks , reception areas , and no less than 75 % of the sleeping quarters within a hotel , motel , resort , inn , lodge , bed and breakfast , or other similar public accommodation that are rented to guests , but excludes private residences . " Restaurant " means ( i ) an eating establishment , including, but not limited to , coffee shops , cafeterias , sandwich stands , and private and public school cafeterias , that gives or offers for sale food to the public , guests , or employees , and ( ii ) a kitchen or catering facility in which food is prepared on the premises for serving elsewhere . " Restaurant " includes a bar area within the restaurant . " Smoke " or " smoking " means the carrying , smoking , burning , inhaling , or exhaling of any kind of lighted pipe , cigar , cigarette , hookah , weed , herbs , or any other lighted smoking equipment . " State agency" has the meaning formerly ascribed to it in subsection ( a ) of Section 3 of the Illinois Purchasing Act ( now repealed) . '.. " Unit of local government " has the meaning ascribed to it in Section 1 of Article VII of the Illinois Constitution of 1970 . Section 15 . Smoking in public places , places of employment , and governmental vehicles prohibited . No person shall smoke in a public place or in any place of employment or within 15 feet of any entrance to a public place or place of employment . No person may smoke in any vehicle owned, leased, or operated by the State or a political subdivision of the State . Smoking is prohibited in indoor public places and workplaces unless specifically exempted by Section 35 of this Act . Section 20 . Posting of signs ; removal of ashtrays . ( a ) "No Smoking" signs or the international "No Smoking" symbol , consisting of a pictorial representation of a burning cigarette enclosed in a red circle with a red bar across it , shall be clearly and conspicuously posted in each public place and place of employment where smoking is prohibited by this Act '.. by the owner , operator , manager , or other person in control of that place . '.. ( b ) Each public place and place of employment where smoking is prohibited by this Act shall have posted at every entrance a conspicuous sign clearly stating that smoking is prohibited . ( c ) All ashtrays shall be removed from any area where smoking is prohibited by this Act by the owner , operator , manager , or other person having control of the area . Section 25 . Smoking prohibited in student dormitories . Notwithstanding any other provision of this Act , smoking is prohibited in any portion of the living quarters , including, but not limited to , sleeping rooms , dining areas , restrooms , laundry areas , lobbies , and hallways , of a building used in whole or in part as a student dormitory that is owned and operated or otherwise utilized by a public or private institution of higher education . Section 30 . Designation of other nonsmoking areas . Notwithstanding any other provision of this Act , any employer , owner , occupant , lessee , operator , manager, or other person in control of any public place or place of employment may designate a non- enclosed area of a public place or place of employment , including outdoor areas , as an area where smoking is also prohibited provided that such employer , owner , lessee or occupant shall conspicuously post signs prohibiting smoking in the manner described in subsections ( a ) and (b ) of Section 20 of this Act . r 8/16/2007 3 :31 PM ?Ublic Act 0017 95TH GENERAL ASSEMBLY http://www.ilga.gov/legislation/publicacts/95/095-0017.htm Section 35 . Exemptions . Notwithstanding any other provision of this Act , smoking is allowed in the following - areas : ( 1 ) Private residences or dwelling places , except when used as a child care , adult day care , or healthcare facility or any other home-based business open to the public . ( 2 ) Retail tobacco stores as defined in Section 10 of this Act in operation prior to the effective date of this amendatory Act of the 95th General Assembly . The retail tobacco store shall annually file with the Department by January 31st an affidavit stating the percentage of its gross income during the prior calendar year that was derived from the sale of loose tobacco , plants , or herbs and cigars , cigarettes , pipes , or other smoking devices for smoking tobacco and related smoking accessories . Any retail tobacco store that begins operation after the effective date of this amendatory Act may only qualify for an exemption if located in a freestanding structure occupied solely by the business and smoke from the business does not migrate into an enclosed area where smoking is prohibited . ( 3 ) Private and semi-private rooms in nursing homes and long-term care facilities that are occupied by one or more persons , all of whom are smokers and have requested in writing to be placed or to remain in a room where smoking is permitted and the smoke shall not infiltrate other areas of the nursing home . ( 4 ) Hotel and motel sleeping rooms that are rented to guests and are designated as smoking rooms , provided that all smoking rooms on the same floor must be contiguous and smoke from these rooms must not infiltrate into nonsmoking rooms or other areas where smoking is prohibited . Not more than 250 of the rooms rented to guests in a hotel or motel may be designated as rooms where smoking is allowed . The status of rooms as smoking or nonsmoking may not be - changed, except to permanently add additional nonsmoking. rooms . Section 40 . Enforcement ; complaints . ( a ) The Department , State- certified local public health departments , and local law enforcement agencies shall enforce the provisions of this Act and may assess fines pursuant to Section 45 of this Act . (b ) Any person may register a complaint with the Department , a State- certified local public health department , or a local law enforcement agency for a violation of this Act . - The Department shall establish a telephone number that a person may call to register a complaint under this subsection (b ) . Section 45 . Violations . ( a ) A person , corporation, partnership , association or other entity who violates Section 15 of this Act shall be fined pursuant to this Section . Each day that a violation occurs is a separate violation . (b ) A person who smokes in an area where smoking is prohibited under Section 15 of this Act shall be fined in an amount that is not less than $ 100 and not more than $ 250 . A person who owns , operates , or otherwise controls a public placer or place of employment that violates Section 15 of this Act shall be fined ( i ) not less than $ 250 for the first violation, _ R/16/2007 3 31 PM iblic Act 0017 95TH GENERAL ASSEMBLY http://www.ilga.gov/legislation/publicacts/95/095-0017.litia ( ii ) not less than $ 500 for the second violation within one year after the first violation , and ( iii ) not less than $ 2 , 500 for each additional violation within one year after the first . violation . ( c ) A fine imposed under this Section shall be allocated as follows : ( 1 ) one-half of the fine shall be distributed to the Department ; and ( 2 ) one-half of the fine shall be distributed to the enforcing agency . Section 50 . Injunctions . The Department , a State-certified local public health department , local law enforcement agency, or any individual personally affected by repeated violations may institute , in a circuit court , an action to enjoin violations of this Act . Section 55 . Discrimination prohibited . No individual may be discriminated against in any manner because of the exercise of any rights afforded by this Act . Section 60 . Severability . If any provision , clause or paragraph of this Act shall be held invalid by a court of competent jurisdiction , such validity shall not affect the other provisions of this Act . Section 65 . Home rule and other local regulation . . ( a ) Any home rule unit of local government , any non-home. '.... rule municipality, or any non-home rule county within the unincorporated territory of the county may regulate smoking in public places , but that regulation must be no less restrictive . than this Act . This subsection ( a ) is a limitation on the concurrent exercise of home rule power under subsection ( i ) of Section 6 of Article VII of the Illinois Constitution . ( b ) In addition to any regulation authorized under subsection ( a ) or authorized under home rule powers , any home rule unit of local government , any non-home rule municipality, . or any non-home rule county within the unincorporated territory of the county may regulate smoking in any enclosed indoor area used by the public or serving as a place of work if the area does not fall within the definition of a "public place " under . this Act . Section 70 . Entrances , exits , windows , and ventilation intakes . Smoking is prohibited within a minimum distance of 15 feet from entrances , exits , windows that open, and ventilation intakes that serve an enclosed area where smoking is prohibited under this Act so as to ensure that tobacco smoke does not enter the area through entrances , exits , open windows , or other means . Section 75 . Rules . The Department shall adopt rules necessary for the administration of this Act . Section 80 . The State Mandates Act is amended by adding Section 6 . 31 as follows : ( 30 ILCS 805 / 8 . 31 new ) Sec . 8 . 31 . Exempt mandate . I believe that the ice cream vendors should not be given a license to sell ice cream out of a truck in Yorkville at all. I have never allowed my children to buy ice cream from these trucks. My children never ask as they know how we feel about them. When the boys were much smaller and we lived in Indiana the trucks were banned because of numerous complaints. Recently I have read of three incidents in the Chicago Tribune where children were killed by these trucks as they ran into the streets when they heard the music coming from the trucks. We should ban them just as we did firework stands for the same reason that they are not safe and they are difficult to police. I would rather see someone apply to the park board for one of the two spots allowed in Town Square park for a dippin dots ice cream stand. A concession at the park would be safe and easier to keep an eye on which is less liability for the city. A ice cream vendor at the park would be a better image of Yorkville to potential residents and businesses and shows that we care about the children in our community. Jason - On a side note, I know that this is your industry. If Meadowvale would put clean ice cream trucks with drivers that have had background checks completed on them to sell ice cream in our community with the Meadowvale name on the side of the truck you would be a success. It shall be unlawful for any person to engage in peddling, soliciting or itinerant merchandising for commercial gain without having first obtained said license except as provided in subsection 3-9-4(_H)_ of this chapter. Address of place of residence of applicant during the past three (3) years if other than present address; 3. Name and address of employer of the applicant during the past three (3) years if other than the present employer; 7. Whether the applicant has ever been convicted of a violation of any of the provisions of this chapter or an ordinance of any other Illinois municipality regulating peddling, soliciting , or itinerant merchandising; 12. Whether the applicant has ever been convicted of a felony under the laws of the state of Illinois or any other state or federal law of the United States; 13. The applicant shall provide a full set of fingerprints for the purposes of conducting a background investigation . (B) All statements made by the applicant upon the application or in connection therewith shall be under oath. (C) The clerk shall require applicants to submit to fingerprinting by the police department in connection with the application for license. (D) The clerk shall cause to be kept in his/her office an accurate record of every application received and acted upon together with all other information and data pertaining thereto and all licenses issued under the provisions of this chapter and of the denial of applications. Applications for licenses shall be numbered in consecutive order as filed , and every license issued , and any renewal thereof, shall be identified with the duplicate number of the application upon which it was issued . (E) No license shall be issued to any person who has been convicted of a felony under the laws of the state of Illinois or any other state or federal law of the United States, within five (5) years of the date of the application; nor to any person who has an active, unpaid violation or conviction of any provision of this chapter, nor to any person whose license hereunder has previously been revoked as herein provided, nor to any person convicted of a crime involving dishonesty, fraud, deception or similar offense. (Ord. 04-92, 10-25-2004) M-4: LICENSE FEES : (A) Monthly Or Annual License: Any applicant seeking a license hereunder may apply for a license monthly (1 month) or annually ( 1 year), which fees shall be as follows: Annual $100.00 Monthly 50.00 (B) Number Of Applicants Covered : The annual and monthly fee shall be applied to each license listing up to five (5) applicants. An additional five dollars ($5.00) per person shall apply to the sixth and each consecutive applicant per license. (C) Fingerprint Fee: A fingerprint fee of twenty five dollars ($25.00) per person shall apply to each person listed in a license application. (D) Nonrefundable: All fees are nonrefundable and shall be paid at the time application is made. (E) Prior Payment: No license shall be issued without prior payment of fees. (F) Insurance Companies: No license fee shall be required of insurance companies or their agents. (G) Bond Required ; Itinerant Merchant: 1 . Itinerant merchants shall be required to file with the clerk a surety bond or a cash deposit in an amount not less than fifty percent (50%) of the wholesale value of the merchandise that the applicant intends to offer for sale. Such bond or deposit to be held for the benefit of any person who suffers loss or damage as a result of the purchase of merchandise from said person licensed under this chapter or as the result of the negligent or intentionally tortuous act of the person licensed under this chapter. Action on the bond or deposit may be brought by any person . Surety bonds may not expire sooner than two (2) years from December 31 following the issuance of the license under this chapter. The village shall transfer the bond or deposit to the attorney general of the state of Illinois within fourteen (14) days after the applicant ceases to do business in the village, pursuant to the law. 2. No license shall be issued until the surety bond or cash deposit has been filed with the clerk. (H) Exemptions: 1 . Prior Invitation: Any person who, for the purposes of selling or taking orders for sale of merchandise or services, has been previously invited by the occupant of a residence to call thereon . 2. Newspaper, Book And Periodical Vendors: Any person who sells or distributes any newspaper, book or other periodical. 3. Farmer, Fruit And Vine Grower And Gardener: Any farmer, fruit and vine grower or gardener, who sells the products of their own farm, orchard , vineyard or garden, provided he does not obstruct streets, sidewalks or other public places within the village. 4. Nonprofit Organizations: Any person engaged in peddling or soliciting which is not prohibited by law on behalf of a charitable, religious or nonprofit organization organized as a not for profit corporation under state or federal law. 5. First Amendment Activities: Any person exercising their first amendment rights, including the free exercise of religion, the freedom of speech or press, the right of assembly and not engaged in peddling, soliciting or itinerant merchandising for commercial gain . (Ord. 04-92, 10-25-2004) 3-9-5: ISSUANCE OF LICENSE : Upon receipt of any application for a license hereunder, the clerk shall, within three (3) business days of the applicant submitting to fingerprinting at the village of Oswego police department, issue the license to any applicant hereunder, provided that the applicant has complied with all application requirements, paid all fees pursuant to this chapter, and no grounds exist to deny the license pursuant to subsection 3-973_�E)_of this chapter. If any application for a license is denied , the clerk shall so notify the applicant in writing by stating the specific reason(s) for such denial. An annual license shall be valid for a period of one year from the date in which said license is issued. A monthly license shall be valid for a period of thirty (30) days from the date of its issuance. Any license issued hereunder shall be nontransferable and shall not be prorated. (Ord. 04-92, 10-25- 2004) 3-9-6: FRAUD; PENALTIES : Any person who peddles, solicits or engages in itinerant merchandising without a valid license issued by the village; and any licensed peddler, solicitor or itinerant merchant who shall be guilty of any fraud, cheating, or misrepresentation , whether through himself or through an employee, while acting as a peddler, solicitor or itinerant merchant in the village; or who shall barter, sell , peddle or solicit any goods, wares, or merchandise other than those specified in his application for a license; or who shall peddle, solicit or engage in itinerant merchandising in violation of the terms and provisions of this chapter, unless exempted hereunder, shall be fined not less than fifty dollars ($50.00) for the first offense, and not less than two hundred fifty dollars ($250.00) for the second offense, and not less than five hundred dollars ($500.00) for the third offense and not less than one thousand dollars ($1 ,000.00) for the fourth and each subsequent offense. Each day that said violation occurs shall be deemed a separate offense. The village president, chief of police or village clerk may revoke the license of any applicant under this chapter for any violation of this chapter. (Ord. 04-92, 10-25-2004) 3.9_7; NOTICE REGULATING PEDDLING AND SOLICITING : Every person desiring to secure the protection intended to be provided by the regulations pertaining to peddling and soliciting contained in this chapter shall comply with the following directions: (A) Any owner or resident may restrict peddling and/or soliciting or limit the hours during which peddlers and/or solicitors are invited to his or her residence by posting that intention as provided in this section. (B) Notice of the determination by the occupant of the refusal of invitation to peddlers and/or solicitors or a restriction to peddlers and/or solicitors or a restriction on hours during which peddlers and/or solicitors are invited at any residence, shall be given in the following manner: 1 . A weatherproof card, approximately three inches by four inches (3" x 4") in size, shall be exhibited upon or near the main entrance door to the residence, indicating the determination of the occupant, in substantially the following : NO PEDDLERS AND/OR SOLICITORS INVITED or PEDDLING AND/OR SOLICITING LIMITED TO THE HOURS OF 2. The letters shall be at least one-third inch (1 /3") in height. For the purpose of uniformity, the cards shall be provided by the clerk to persons requesting same, at the cost thereof. 3. Such card , or similar sign, so exhibited shall constitute notice to any peddler, solicitor of the determination by the occupant of the residence of the information contained thereon. (Ord . 04-92, 10-25-2004) M-8: DUTY OF PEDDLERS AND SOLICITORS : (A) It shall be the duty of every peddler and solicitor upon going onto any premises in the village to first examine the notice provided for in section 3-9-71 of this chapter, if any is given or attached, and be governed by the statement contained on the notice. It is hereby declared to be unlawful and shall constitute a nuisance for any person to go upon any premises and ring the doorbell upon or near any door, in defiance of the notice exhibited at the residence in accordance with the provisions of section 3-9-7 of this chapter. If the peddler or solicitor is calling during a time when the resident has restricted peddling and/or solicitation or a notice pursuant to section 3-9-7-of this chapter is posted, then the peddler or solicitor whether registered or not, shall immediately and peacefully depart from the premises. Any peddler or solicitor who has gained entrance to or who is on any premises, whether invited or not, shall immediately and peacefully depart from the premises when requested to do so by the occupant. Peddling and soliciting on streets or ways or in public areas is expressly prohibited except as allowed in section 3-9-10-of this chapter. (B) Any person licensed pursuant to this chapter shall, at all times while engaged in the activities defined herein, keep said license in his possession and shall display the same upon the demand of any police officer or upon the request of any person whose premises he seeks to enter. (Ord. 04-92, 10-25-2004) 3-9-9 : TIME LIMIT ON PEDDLING AND SOLICITING : It is hereby declared to be unlawful and shall constitute a nuisance for any person whether registered under this chapter or not, to go upon any premises and ring the doorbell upon or near any door of a residence located thereon, or rap or knock upon any door, or create any sound in any other manner calculated to attract the attention of the occupant of such residence, for the purposes of securing an audience with the occupant thereof and engage in "peddling", or "soliciting" as herein defined, before nine o'clock (9: 00) A.M. or after seven o'clock (7:00) P.M . , Monday through Friday, or prior to nine o'clock (9:00) A. M or after five o'clock (5:00) P. M. on Saturday, or at any time on a Sunday or on a state or national holiday. (Ord. 04-92, 10-25-2004) 3-9-10 : LIMITATIONS ON PEDDLING AND SOLICITING IN STREETS : Standing on streets within the village for the purpose of peddling or soliciting contributions from occupants of vehicles as provided in 625 Illinois Compiled Statutes 5/11 -1006 is permitted subject to the following limitations: (A) There shall be no peddling or soliciting of any traffic permitted except at fully signalized intersections where all traffic is required to fully stop and has in fact come to a complete stop; (B) Peddling or soliciting shall be permitted during daylight hours only; (C) Any person engaged in the act of peddling or soliciting shall be sixteen (16) years of age or more and shall be wearing a high visibility vest; (D) The peddling or soliciting agency shall be registered with the Illinois attorney general as a charitable organization as provided by 225 Illinois Compiled Statutes 460/1 et seq. , and shall be liable for any injuries to any person or property during the peddling or soliciting which is causally related to an act of ordinary negligence of the peddling or soliciting agent. Evidence of adequate liability insurance shall be required prior to the issuance of any license for the purposes described in this section. Hours are 9 a.m. to 9 p.m. Monday through Friday, 9 a.m. to 5 p.m. on Saturday, and no peddling on Sundays and Holidays. I have included a copy of the current city code for outdoor liquor licenses. Section 3-3-4-5 of the Outdoor Liquor License Code, Paragraph B states that the maximum number of outdoor liquor licenses that are available in the city are three total. We have currently issued the first outdoor license to Taylor Street Pizza, the second outdoor license to Legends Sports Bar & Grill and we have a third pending outdoor license for the restaurant under construction at 604 W. Veteran's Parkway. The timeline for this application is as follows: We received the application on August 13, 2007. The owners have been fingerprinted and the police are currently conducting background checks. The scheduled opening date for the business is September 15, 2007. Because the location is already set up as a restaurant with a fenced in patio area, the owners do not foresee any delays in being able to open. The business owners of the Sawmill Pizza restaurant would like to respectfully request that council consider amending the city code to allow for them to receive an outdoor liquor license at the same time that their restaurant liquor license is issued. Alcoholic beverages shall only be served to or consumed by those outdoor patrons during times at which food is being served on the site. 2. Alcoholic beverages consumed in the outdoor area must be purchased on the premises where the outdoor area is permitted by the City liquor license. 3. Entrance and exit points for the outdoor area shall be restricted as approved by the City Liquor Control Commissioner. There shall be one emergency exit for the area outside of the building. 4. No alcoholic beverages of any kind shall be served in the outdoor area in glass containers. H. Application: 1. Application for permission to conduct such outdoor retail sale of alcohol shall be in writing in the standard license application form for any liquor license in the City, and shall additionally state the dates for the requested license and a diagram of the outdoor area upon which the sale and consumption will occur. 2. The fee for a Class G outdoor license shall be two hundred fifty dollars ($250.00) annually as set forth in this Section 57. For all classes of license holders except holders of a fraternal license, which shall be charged one hundred dollars ($100.00) for said additional license permitting outdoor events. I. Revocation: 1. In addition to those restrictions stated above, all Class G outdoor licenses shall be subject to all the limitations and restrictions set out in this Chapter and State statutes. At the committee meeting, I made the statement that I thought most municipalities do not limit the number of liquor licenses, and therefore Yorkville should keep the current policy of having an unlimited amount of liquor licenses. I have since confirmed from Mike Roth that the City would have additional discretion in approving/denying liquor license requests if the number of licenses allowed by city code is equal to the number of liquor licenses approved. Therefore, as each license application is received, the City Council would have to choose to amend the city code to allow for the additional license, or not amend the city code. At the Public Safety committee in July, I inferred that the committee wished to have more discretion over the approval of liquor licenses — therefore, an amendment to City code to limit the number of package liquor licenses may be desired. Accordingly, any amendment to the liquor license section of the City code would have to reference the building code requirements on guards. I have attached a memo from Gary Williams, Assistant Code Official, which outlines the requirements of guard fences. I recommend that an amendment to the City code on patio licenses be referenced as follows: "Outdoor service and consumption of alcohol shall be in an identified cordoned-off or fenced area, which fence shall be not less than [height requirement chosen by committee] in height from grade, and shall be of such construction quality, security and aesthetic detail as approved by the City Liquor Control Commissioner. For fences governed by section 1003 .2. 12 and 1003 .2. 12. 1 of the International Building Code, the building code restrictions on minimum guard fence height of 42" shall apples In addition to the above referenced policy discussion, the two ordinances prepared by Mike Roth for the August 14`h City Council meeting are still up for consideration. The first version of the ordinance is more elaborate and contains some clauses and formatting not originally discussed the committee. The second version of the ordinance is less elaborate and more closely follows the explicit discussion that took place at the July Public Safety committee meeting. I feel that both versions of the ordinance accurately capture the intent of the committee and COW discussions; it is your choice on which to adopt. The final policy option discussion remains from the August 14`h City Council meeting. This final policy option is the quantity of allowable patio liquor licenses.
