This is due to firework sales no longer being legal, pursuant to Ordinance 2005- 01 . 3- 7-3-G Capitalize the "C" in City of Yorkville . 3- 7-9 Add the following words after "national holidays" : "except as follows . Itinerant merchants and hawkers not going door-to-door to residences may conduct business from 9 : 00 A. M . to 8 : 30 P. M . Sunday through Saturday, including holidays . " This is due to better accommodating hawkers and itinerant merchants who do not solicit door-to-door, such as ice cream and food vendors. Please see attached copy of Ordinance 2002-01 with the proposed changes highlighted . CHAPTER 7 SOLICITORS , HAWKERS AND ITINERANT MERCHANTS 3-7-1 : DEFINITIONS: For the purpose of this chapter, the following words as used herein shall be construed to have the meanings herein ascribed : HAWKER: One who carries goods about and sells them by offering them in the streets. His sales are not made from one established spot, excepting where they are made in the street or other public place and he makes delivery at the time of sale. Whether or not he collects at the same time is immaterial. ITINERANT MERCHANT: One who sells commodities from private premises but remains at one place for the purpose of temporary periods only, general l not more than six 6 weeks. Examples include: temporary Christmas tree sales Also called transient merchant or transient vendor. RESIDENCE: Includes every separate living unit occupied for residential purposes by one or more persons, contained within any type of building or structure. SOLICITING: Includes any one or more of the following activities: A. Seeking to obtain orders for the purchase of goods, wares, merchandise, foodstuffs, and services of any kind , character or description whatever, for any kind of consideration whatever; or B. Seeking to obtain prospective customers for application or purchase of insurance of any type, kind or character; or C. Seeking to obtain subscriptions to books, magazines, periodicals, newspapers, and every other type or kind of publication; or D. Seeking to obtain gifts or contributions of money, clothing, or any other valuable thing for the support or benefit of any charitable or nonprofit association , organization, corporation or project. E. Hawking or doing business as an itinerant merchant. SOLICITOR: One who engages in acts of "soliciting" as defined above (also includes hawkers and itinerant merchants). (Ord. 2002-01 , 2-26-2002) 3-7-2 : CERTIFICATE OF REGISTRATION REQUIRED: Every person desiring to engage in soliciting, hawking or business as an itinerant merchant within the city is hereby required to make written application for a certificate of registration as hereinafter provided . It shall be unlawful for any person to engage in soliciting , hawking or business as an itinerant merchant without having first obtained said certificate of registration . Said certificate shall be carried by the applicant while engaged in soliciting , hawking or business as an itinerant merchant and shall be displayed for inspection upon request. (Ord . 2002-01 , 2-26-2002) 3-7-3 : APPLICATION FOR CERTIFICATE: A. Application for a certificate of registration shall be made upon a form provided by the chief of police or his designee and filed with such chief or his designee. The applicant shall truthfully state in full the information requested on the application : 1 . Place Of Residence; Social Security Number: Name and address of present place of residence of solicitor, hawker or itinerant merchant and applicant and length of residence at such address; also business address if other than residence address; also social security number and date of birth; 2 . Previous Residences: Address of place of residence of solicitor and applicant during the past three (3) years if other than present address; 3. Description : Physical description of the solicitor; 4. Name Of Employer Or Representation: Name and address of the person , firm or corporation or association whom the applicant is employed by or represents; and the length of time of such employment or representation; 5. Description Of Subject Matter: Description sufficient for identification of the subject matter of the soliciting , hawking or product being sold by the itinerant merchant which the solicitor, hawker or itinerant merchant will engage in; 6. Time Period : Period of time for which the certificate is applied for; 7. Date Of Previous Application: The date, or approximate date, of the latest previous application for certificate under this chapter, if any; 8 . Revocation History: Whether a certificate of registration issued to the applicant under this chapter has ever been revoked ; 9 . Conviction Of A Violation; History: Whether the applicant or solicitor, hawker or itinerant merchant has ever been convicted of a violation of any of the provisions of this chapter or the ordinance of any other Illinois municipality regulating the activities of solicitors, hawkers or itinerant merchants; 10. Conviction Of A Felony; History: Whether the applicant has ever been convicted of the commission of a felony under the laws of the state of Illinois or any other state or federal law of the United States; 11 . Tax Identification Number: Each applicant shall produce an Illinois department of revenue identification number for the retailers' occupation tax. No license shall be issued if the applicant does not have an identification number except that no identification number shall be required of a solicitor, hawker or itinerant merchant sponsored by or working for a religious, educational or charitable organization where such organization is entirely a nonprofit organization and who can furnish the city with a "Tax Exempt Number" and written proof of its "Tax Exempt Status'; 12. Consent Of Property Owner: All itinerant merchants must submit a signed statement from the owner of the property from which they are proposing to operate their businesses evidencing permission to do business on the particular owner's property; 13. Health Certificate: Any hawker, solicitor, or itinerant merchant who sells food or beverages from a vehicle or stand shall be required to obtain a health inspection certificate from the Kendall County public health department. Said certificate shall be required to do business under a certificate of registration under this title and chapter in the city of Yorkville. B. All statements made by the applicant upon the application or in connection therewith shall be under oath. C. The chief of police or his designee shall require every applicant and solicitor, hawker or itinerant merchant to submit to fingerprinting by the police department in connection with the application for certificate. D. The chief of police or his designee shall cause to be kept in his office an accurate record of every application received and acted upon together with all other information and data pertaining thereto and all certificates of registration issued under the provisions of this chapter and of the denial of applications. Applications for certificates shall be numbered in consecutive order as filed, and every certificate issued , and any renewal thereof, shall be identified with the duplicate number of the application upon which it was issued. No certificate of registration shall be issued to any person who has been convicted of the commission of a felony under the laws of the state of Illinois or any other state or federal law of the United States, within five (5) years of the date of the application; nor to any person who has been convicted of a violation of any of the provisions of this chapter, nor to any person whose certificate of registration issued hereunder has previously been revoked as herein provided . F. Each itinerant merchant applicant shall pay a two hundred dollar ($200.00) application fee per application. Each hawker or solicitor applicant shall pay a forty dollar ($40. 00) application fee per application . No fee shall be charged of a solicitor, hawker or itinerant merchant sponsored by or working for a religious, educational or charitable organization where such organization is entirely a nonprofit organization and who can furnish the city with a "Tax Exempt Number" and written proof of its "Tax Exempt Status" . G. That the above stated registration requirements may be waived by the chief of police or his designee if in his discretion he believes that the registration requirements are unnecessary because of his personal familiarity with the individual or groups of persons seeking to solicit within the M, of Yorkville. (Ord . 2002-01 , 2-26-2002) 3-7-4: ISSUANCE OF CERTIFICATE: The chief of police or his designee, after consideration of the application and all information obtained relative thereto, shall, within ten ( 10) business days of application, approve or deny the application. If the person does not possess the qualifications for such certificate, as herein required , and the issuance of a certificate of registration to the applicant would not be in accord with the intent and purpose of this chapter, then the chief or his designee shall deny the application . Endorsement shall be made by the chief of police or his designee upon the application of the denial of the application. If the solicitor, hawker or itinerant merchant and applicant are found to be fully qualified, the certificate of registration shall be issued within seven (7) calendar days of the application approval so long as the application fees have been fully paid. Any certificate of registration issued pursuant to this chapter shall expire thirty (30) days after issuance. (Ord . 2002-01 , 2-26-2002) 3-7-5: CITY POLICY ON SOLICITING : It is hereby declared to be the policy of the city council that the occupant or occupants of any premises in the city shall make the determination of whether solicitors shall be, or shall not be, invited onto their respective premises. Only solicitors having a valid certificate of registration provided in section 3-7-2 of this chapter shall engage in solicitation within the city unless said solicitor has previously been invited by an occupant of the premises. It is further the city's policy that, in the interest of safety, no child under the age of fourteen (14) shall be allowed to solicit in the city of Yorkville unless said child is supervised during solicitation by an adult who has registered pursuant to this chapter. Both of these change orders call for complete sidewalk replacement on Heustis Street between Fox and Van Emmon Streets. The existing and proposed sidewalk width on this block is four feet. The original project design calls for removal and replacement of approximately 1100 square feet of sidewalk on this block of Heustis Street. The existing sidewalk was not in very good condition before the project began, and construction of the watermain, sanitary sewer, storm sewer, and roadway have resulted in additional damage such that there is little sidewalk left that is worth saving. There has also been discussion about possibly replacing the conventional sidewalk with stamped concrete sidewalk that would look like brick. There are various characteristics of stamped concrete that should be considered when deciding if it should be used in a certain area. Stamped concrete will have a rougher texture than conventional concrete. This should provide good traction for pedestrians, but may make it more difficult to push strollers up the hill. The manufacturer recommends sealing stamped concrete every 5 years. This sealant may be slippery for a period of time after it is applied. Proposed Change Order #1 is for removing all of the existing sidewalk on this block of Heustis Street and replacing it with stamped concrete sidewalk. The additional cost would be $94,050.00. Change Order #2 is also for removing all of the existing sidewalk on this block of Heustis Street and replacing it will conventional concrete sidewalk. The additional cost would be $277610.00. After all of the In-Town Road Program contracts were awarded, we still had about $ 100,000 left over from the original bond sale. We are projecting that the final contract amount for the Phase 1 utility contract will use up about $58,000 of that amount. Therefore we have about $42,000 available to pay for any additional costs associated with the In-Town program. I recommend that one of these two change orders be approved. Since the roadway work is ongoing we don't have time to wait until the next Public Works Committee meeting on August 7a', therefore please place this item on the Economic Development Committee agenda of July 17, 2007 for consideration. Hydraulic would become a right-in/right-out only intersection. IDOT would require signage and also striping of "porkchop" medians to further discourage the prohibited movements. I also asked IDOT about prohibiting left turns from River Road onto Route 47. IDOT was also amenable to that, but said that a striped median may not be possible at that location due to the narrow approach width of River Road. The next steps would be for the city to send a letter to IDOT formally requesting approval of these traffic control measures, adopting an ordinance prohibiting those traffic movements, and arranging for our PW Department to place the signage and striping. In the past, it has been customary to have two current liquor license holders sell alcohol at the event, in order that sales operations are run efficiently. A letter would be sent to each current liquor license holder, with a request for a participation fee. In the event that more than one liquor license holder wanted to participate, a lottery would be held. This year we have had only one current liquor license holder request to participate. Therefore, to assure that operations run efficiently and in order to ease the burden of one vendor selling alcohol during peak times, it is recommended that the City participate as a liquor vendor, and engage outside help to assist in manning the operation at Hometown Days. The Yorkville Moose Club has agreed to work the three-day festival in consideration of a contribution from the City. The plan is for the Moose Club to provide the personnel to operate the booth, and for the City to purchase the alcoholic beverages and provide operational supervision. We expect to make a contribution to the Moose Club for a dollar amount yet to be determined by both parties. Council Action Requested The City is not a current liquor license holder. To move forward, Mike Roth has advised that the City would need to amend the City Code to allow the City to be issued a Temporary Permit under sections 3-3-4 and 3-3- 16, as follows. The proposed amendments are: "Section 3-3-4: CLASSES OF LICENSES : The local liquor control commissioner shall have authority to issue a temporary permit for the sale of alcoholic liquor to be consumed on the premises at a banquet, picnic, bazaar, fair or similar private or public assembly where food or drink is sold served or dispensed. Such temporary permit may be issued to a club, society, fraternal or benevolent organization or association, which is organized not for a pecuniary profit, or a municipal corporation, and shall be for a period of not more than four (4) days. No more than three (3) temporary permits may be granted to any organization during a calendar year. Notwithstanding any of the above-mentioned provisions, a temporary liquor permit may be issued for the sale and consumption of alcoholic liquor at a regularly scheduled game or tournament at a privately owned sports stadium. Such permit shall be issued with the provision that the sale of alcoholic liquor cease at ten thirty o-clock (10:30) P.M. and that the sale and consumption of alcoholic liquor not be allowed outside of the stadium area. The fee for such permit shall be determined, from time to time, by separate ordinance or resolution of the city council, and shall accompany the written application. Once approved, implementation of this addition to the employee manual would start immediately via notification to all employees as well as a requirement to provide driver license numbers to the human resource department. Once all drivers' license numbers are obtained a `Driver Record Abstract Request Form' will be submitted to the Secretary of State by Human Resources. It is my intention to have this process completed by mid fall, after which time, the annual audit would take place at the start of the fiscal year. (Appendix I, III Criteria, A.) Proposed Addition A. An employee, a person whom receives a payroll check from the United City of Yorkville, will be subjected to an annual audit of their driver's license status via the Secretary of State at the start of the annual fiscal year. Those individuals whose job description includes a valid drivers' license requirement and fail to meet that requirement may be relieved of their duties with out pay. Any employee whose driver's license is revoked or suspended while employed with the city is required to notify their department head within 24 hours of the incident. When authorized by a Department Head an employee who holds a valid drivers license may operate a city vehicle. Department Heads shall provide a monthly report, to the Administration Committee on vehicle usage. Current Manual A. Ethical Standards — Elected officials of the United City of Yorkville: A. Shall obey the Constitution and laws of the United States, of the State of Illinois, and the United City of Yorkville. B. Shall be dedicated to the concepts of effective and democratic local government. C. Shall strive to be trustworthy and to act with integrity and moral courage on behalf of one's constituents, so as to maintain public confidence in City government and in the performance of the public trust. D. Shall make impartial decisions, free of bribes, unlawful gifts, narrow special interests, or financial or other personal interests. E. Shall not invest or hold any investment, directly or indirectly, in any financial business, commercial or other private transaction that creates a conflict with official duties. F. Shall extend equal opportunities and due process to all parties in matters under consideration. G. Shall recognize that the chief function of local government is at all times to serve the best interests of the residents of the United City of Yorkville. H. Shall work to keep the community informed on municipal affairs, encourage communication between residents and municipal officers; emphasize friendly and courteous service to the public; and seek to improve the quality and image of public service. I. Shall work to assure that government is conducted openly, efficiently, equitably, and honorably in a manner that permits residents to make informed judgments and hold City officials accountable. J. Shall show respect for persons, confidences and information designated as "confidential'. K. Shall refrain from taking any official action that would censure any other elected official, unless such member has been found guilty of a legal offense that would require such action by the City Council. L. Shall, when representing the City, act and dress in a manner appropriate for the function. II. Duties and Rights of Elected Officials: Aldermen A. Shall, through their council votes, create the public policy that governs the United City of Yorkville, and provide oversight for the executive branch. B. Shall have the right to expect that the mayor and city's staff will provide them with clear and unbiased information to help them in their decision-making process. C. May, at their discretion, hold ward meetings in their ward, or devise other ways to better understand the wishes of their constituents. This is not meant to preclude aldermen from taking a city-wide view of the impact of an item under discussion, but to underline that aldermen are empowered to act on behalf of their constituents, and should be apprised of all items that are brought to the City that in any way pertain to their Ward. It is recommended that as a courtesy the Alderman holding the meeting should contact the other alderman in the ward, in advance, about the meeting. D. Shall refrain from giving direction to any city employee. Policy is created by the entire City Council. If any alderman wishes to address any problems he or she sees occurring in the city, this problem may be brought to the attention of the mayor, the city administrator, department directors, or taken to the council as a whole for action. Requests for information are not to be considered as "giving direction." Mayor A. Shall perform all the duties which are prescribed by law, including ordinances, and shall take care that the laws and ordinances are faithfully executed. Shall from time to time and annually, give the corporate authorities information concerning the affairs of the municipality and may recommend for their consideration measures that the mayor believes expedient. (65 ILCE 5/3.1-35-10) B. Shall be a non-voting member of all standing committees. C. Shall make appointments to fill vacancies, with the advice and consent of the Council. III. Meeting Standards Applicable to City Council Meetings Generally A. City Council Meetings shall be regularly scheduled to convene on the 2"a and 0 Tuesday's of each month immediately following the conclusion of the Committee of the Whole meeting in the City Hall Council Chambers. B. City Council Meetings shall be generally conducted according to the agenda template attached hereto. C. The Mayor, or any 3 Aldermen, may call a special meeting by submitting the request in the form of a Notice, and an Agenda for the meeting, in writing to the City Clerk. The Clerk shall as soon as possible 1) deliver a copy of the Notice and Agenda to each Elected Official, 2) post the Notice and Agenda at City Hall, and 3) send a copy of the Notice and Agenda to all registered news media. No special meeting shall be called for a date less than 48 hours after the Notice and agenda have been submitted to the City Clerk. The Clerk shall submit a Certification of Notice as evidence of providing the notices set out above, including all Copies of Publication to the City Council, and said Certification of Notice shall be inserted into the record of the Special Meeting. (5 ILCS 120/2.02) D. Except during the time allotted for public discussion and comment, no person, other than a member of the council, or an officer, employee, independent contractor, or other person recognized by the presiding officer, shall address the Council, except with the consent of two of the members present. E. No ordinance or resolution shall be voted on at a City Council meeting unless the item to be voted on has been presented in its final form to the Corporate Authorities at least four days prior to the vote. F. All attendees at every city council meeting shall put their cell phones, pagers, PDA's or similar devices on silent mode prior to all such meetings, and shall not communicate on such devices during any such meetings. Elected officials, and department heads may excuse themselves from a meeting in order to communicate on such devices. G. The standards concerning order of speaking and time limits set by this Governing Ordinance shall apply to all items, including motions, resolutions, ordinances or action items wherein a vote may be taken. Aldermen A. Shall have the right to place an item on any Council meeting agenda for discussion. Shall have the right to vote to suspend the rules of order (regarding the order of discussion, and time limits) to provide for an open discussion. B. Shall not speak twice on an item before all other aldermen who wish to speak to the item have had an opportunity to speak once. No alderman nor mayor shall speak more than twice on any item. C. Shall, after being recognized by the chair, limit his or her remarks to five minutes for the first round; two minutes for the second round. Minutes not used shall be forfeited: minutes cannot be accumulated. D. Shall, before speaking at a meeting, first be recognized by the presiding officer, and shall address all remarks to the presiding officer, without a response from the presiding officer. E. May not move to end debate before every alderman who wishes to speak to an agenda item has had the opportunity to do so. A motion to end debate, or "call the question" shall require a two-thirds vote. (Roberts Rules (RONR (10*' Edition) page 189, Section 16) F. May appeal a ruling by the Mayor to the Council as a whole. A majority vote can overturn the Mayor's ruling. (Roberts Rules (RONR (10`h Edition) page 247, Section 24) G. May, by a two-thirds majority vote, expel a fellow alderman from a meeting for cause, but may not do so for the same cause a second time. (65 ILCS 3.1-40-15) H. May, upon the request of any two aldermen present, defer a report of a committee to the next regular meeting of the Council. I. Shall, during a meeting, have the option to be the first and last speaker on an item if he or she has placed the item on the Council agenda. J. Shall, after being appointed as a liaison to another city organization, be responsible for keeping all Council members informed of that organization's significant activities. K. Shall limit their remarks to the question under debate. To this end, aldermen must never attack or make any allusion to the motives of aldermen. (RONR (10a' Edition) page 41, line 31) L. May, before voting, participate in a special committee of the whole meeting to review nominees that the mayor appoints when the appointment is either to fill a vacancy in an elective or appointed office that requires the advice and consent of the City Council. M. Shall elect from one of the Aldermen as Mayor Pro Tem pursuant to the Mayor Pro Tern Policy of the United City of Yorkville, attached hereto. Mayor A. Shall preside at every regular Council meeting fulfilling the normal and customary functions of the chairman of the meeting; in his absence the elected mayor-pro-tern shall preside. At ad hoc committee meetings of the Council, the chairman of the committee shall preside. B. Shall preserve order and decorum, may speak to points of order in preference to aldermen, and shall decide all questions of order, subject to appeal. In the case of disorderly conduct, the mayor shall have the power to request that the Council Chambers be cleared. C. Shall appoint the City Attorney to be parliamentarian of the Council. D. May, without relinquishing the chair, voice his opinion on items before the City Council, in keeping with time limitations. The mayor shall, immediately after stating the item under discussion, ask the alderman who has requested an item to be placed on the agenda if he or she wishes to introduce the item or the applicable Committee Chairman if no particular alderman has requested that the item be placed upon the agenda. The mayor shall recognize this alderman as the last one to speak to the item if the alderman requests to do so. Shall not allow any aldermen to speak more than twice on any item; shall not allow accumulation of minutes that have been forfeited. E. Shall, during debate, limit each alderman's chance to speak to five minutes the first time on each agenda item, and two minutes for rebuttal. The mayor, if he chooses to state his opinion, shall not speak more than five minutes on the issue. F. Shall recognize each alderman wishing to speak to an agenda item in tam, rotating different sides of the question, pro and con, as much as possible, and not allowing any one alderman to speak twice before all aldermen who wish to speak can do so. He shall give preference first to an alderman who has placed the item under discussion on the Council's agenda. G. Shall insure that any information he makes available to aldermen on an agenda item is given to all aldermen in the same timely fashion, so that all aldermen can make informed decisions. It is the mayor's responsibility to insure that any item brought to the mayor's attention that pertains to a project or problem in a City Ward should be brought immediately to the attention of that Ward's two aldermen. The Public Safety Committee shall meet the third Tuesday of each month at 7:gPFim", in the City IV Hall conference room. The Economic Development Committee shall meet the third Tuesday of each month at 7:00 p.m. The Standing Committees of the City Council: in the city Hall Cowen Chambers. The Committee of the Whole will meet on the second and fourth Tuesdays of each A. Shall include the Public Works, Public Safety, Administration, Economic Development month at 7:00 p.m. in the City Hall Committees, and the Committee of the Whole. Councilchambers.¶ B. The Public Works, Public Safety, Administration, and Economic Development Committees shall include four members (one from each ward) of the City Council, including the Mayor. The Committee of the Whole meeting shall include all eight aldermen. The Mayor is a non-voting member of each committee. C. Shall be presided over by its chairman, who will conduct the business of the meeting. In the absence of the chairman, the vice-chairman shall conduct the business of the meeting. Chairman and vice-chairman shall serve two year appointments. Chairs, vice-chairs, and committee rosters shall be filled through the following process: a. For the Committee of the Whole meeting, the chairman shall be the Mayor, and the vice-chairman shall be the Mayor Pro-Tem. b. For the Public Works, Public Safety, Administration, and Economic Development committees: after each election, the four committee chairmanships shall be vacated. The four vice-chairmen shall each select a committee to chair, with the most senior alderman having the first selection and progressing to the next most senior alderman, and so on. After the chairmanships have been selected, the four non-chaired aldermen shall each select a committee to vice-chair, with the most senior alderman having the first selection, and progressing to the next most senior alderman, and so on. In the same order in which chairmanships and vice- chairmanships are selected, the committee rosters shall be filled (committee chairs pick second committee first, vice chairman pick second committee after the chairman pick their committee). i. Should an incumbent alderman be defeated in an election, the incoming alderman shall be placed in the group of four "non-chaired" alderman that will select a vice-chair role in a committee. Subsequently, the most senior alderman of the "non-chaired" group shall be allowed to retain a committee chair for a consecutive year, but will select last in the group of aldermen who are selecting the committee chairs for the upcoming term. In the event there is more than one incumbent alderman allowed to serve consecutive committee chairs, those aldermen shall select committee chairs in order according to seniority, but after the group of alderman who have not served-consecutive committee chairs have selected. D. Shall control the movement of items from committee agendas to Committee of the Whole and City Council agendas. Items may not move out of committee but for a vote of approval by 3 aldermen. E. Shall have the sole power to assign liaisons to those city organizations that fall under that committee's specific area of business listed in the City Council agenda as follows: Public Works: Park Board, YBSD Economic Development Chamber of Commerce, Kendall County Econ. Dev., Plan Commission, Bristol Plan Comm. Yorkville Econ. Dev.
