This tax was not extended on the 2005 tax bill. The City of Yorkville passed a Supplemental Library Debt Service Tax for Tax Year 2006 (payable in 2007) to gain payment for the 2005 taxes levied but not extended. A few new residents of newly constructed homes have raised concerns about the equity of extending the Supplemental Library Debt Service Tax on their properties. Discussion: After discussing with our City Attorney, there does not appear to be a simple method to allow residents not to pay the Supplemental Library Debt Service Tax as the County Taxes are applied based on the valuation established for the current tax year and does not allow for the recognition that the home did not exist during the prior tax year. Recommendation: In order to treat these new property owners fairly, and recognizing the complexity inherent in the county property tax process, it is my recommendation that the City of Yorkville City Council authorize the City Administrator to credit the city utility billing accounts in an amount equal to the Supplemental Library Debt Service for those residents that can provide documentation that they closed on their newly constructed homes between January 1 , 2006 and December 31 , 2006. Note: The dollar amount to be credited will be equal to . 1098 tax rate applied to the Net Taxable Value on their Current Property Tax Bill. The business applying for the license is Taylor Street Pizza located at 1985 Marketview Drive in Yorkville. I have included a copy of the current mechanical amusement device code for the city (see attachment #1 ). Section 3-4B-2 states that a license is required to operate, maintain, or conduct a billiard table, pool table or pinball machine or amusement device open to the public. Section 3-4B-4 states that all applications for licenses required by this article must be investigated to make sure the business is in compliance with the city's ordinances and also the Kendall County Health Department's ordinances. The applicant is currently in compliance with the health department (see attachment #2) They are also currently in compliance with the city's building and zoning codes (see attachment #3). Section 3-4B-5 states that the application for license, when filed, shall be referred to the City Council which shall issue or cause to be issued to the applicant a license. Section 3-4B-6 states that the business must be located in a B-2 General Business District or B-3 Service Business District. The business is located in a B-3 zoning district. MECHANICAL AMUSEMENT DEVICES 3-413-1 : DEFINITIONS : When used in this Article, the following words and terms shall have the meanings herein ascribed to them: MECHANICAL AMUSEMENT DEVICE: Any machine which, upon the insertion of a coin, slug , token, plate or disc, may be operated by the public generally for use as a game, entertainment or amusement, whether or not registering a score. It shall include such devices as marble machines, pinball machines, skillball, mechanical grab machines, pistol ranges, baseball games, bowling games, tennis games and any and all devices referred to as arcade equipment, and all games and operations similar thereto under whatever name they may be indicated . It shall also include those amusements operated by remote control, whether or not actuated by insertion of a coin. For purposes of this Section, the term "mechanical amusement devices" shall not include mechanical devices commonly known as "kiddie rides" or "carnival amusement rides" designated for child or adult amusement rides or music machines. PINBALL: A game played with any number of balls or spheres upon a table or board having holes, pockets or cups into which such balls or spheres may drop or become lodged , or having arches, pins and springs, or any of them, to control, deflect or impede the direction or speed of the ball or spheres in motion by the player. (Ord. 1978-4, 4-27-78) TAVERN: Any place of business whose chief or principal function is the sale or dispensing of alcoholic beverages, and not chiefly or principally in the business of selling food , as measured by gross sales of food compared to gross sales of alcoholic beverages. (Ord . 1979-20, 11 -15- 79) 3-413-2: LICENSE REQUIRED : No person shall operate, maintain or conduct a billiard table, pool table or pinball machine or amusement device open to the public without first having obtained a license therefor as herein provided. (Ord . 1978-4, 4-27-78) 3-413-3: LICENSE FEE : A. The annual fee for any license required by this Article shall be twenty dollars ($20.00) for each table, machine or mechanical amusement device. If, at the time application is made for a license required by this Article and less than six (6) months of the current license year shall have expired, the full fee shall be charged for any such pool table, billiard table, pinball machines or amusement devices. Upon receipt of any application for license required by this Article, the City Clerk shall forward such application to such other appropriate agencies or administrators as may be affected , including but not limited to the Local Liquor Control Commissioner if liquor is to be sold upon the premises where such pinball machine or mechanical amusement device is to be held and to the Kendall County Health Officer if food is to be dispensed upon the premises. No license shall be issued until such agency or administrator, as the case may be, shall have certified that the intended location of the place of business is in compliance with all other applicable ordinances. (Ord . 1979-20, 11 -15-79) 3-413-5: ISSUANCE OF LICENSE ; RESTRICTIONS : The application for license required by this Article, when filed , shall be referred to the City Council which shall issue or cause to be issued to such applicant a license authorizing the keeping , conducting or operating of such billiard tables, pool tables or pinball machines, as the case may be, at the place described in such application , for and during the term of such license. A license shall not issue, however, to the following person or persons: A. A person who has been convicted of a felony under the laws of the State of Illinois; B. A person whose license issued under this Article has been revoked for good cause; C. A person who, at time of application for renewal of any license issued under this Article, would not be eligible for such license upon first application ; D. A partnership, unless all of the members of such partnership shall be qualified to obtain a license; E. A person whose place of business is conducted by a manager or agent, unless the manager or agent possesses the same qualifications required of the licensee; F. A person who does not own the premises for such a license, unless said person has valid lease for the full period for which the license is to be issued ; G. The Mayor may revoke or suspend any license issued by the City Council if the Mayor determines the licensee has violated any of the provisions of this Article or is convicted of a felony or any crime or misdemeanor involving moral turpitude. However, no such license shall be sold , revoked or suspended except after a public hearing by the Mayor with a three (3) day written notice to the licensee affording the licensee an opportunity to appear and defend . All such hearings shall be open to the public and the Mayor shall reduce all evidence to writing and shall maintain an official record of the proceedings. Any required off-site easements should be recorded separately as plats of easement rather than illustrating them on the future plats of subdivision of Autumn Creek due to the uncertainty of the timing of plat executions and recording. CONCLUSION We recommend the approval of the Final of Subdivision for Unit 2 and ask that the developer review and prepare the easements that will be needed to cover all utilities and pathways or sidewalks. Kurtzman, AICP SUBJECT: Zoning Variance Request 505 Heustis St PC2007-19 PUBLIC HEARING: On Wednesday, September 5, 2007, the Zoning Board of Appeals (ZBA) conducted a public hearing to consider a request to increase the height of a detached accessory building at 505 Heustis Street. Other than the petitioners no one was present in the audience to speak regarding this proposal (there was a letter in support of the requested variance that was submitted and given to the ZBA members). After conducting the hearing the ZBA made a motion to recommend to the City Council approval of the requested variance. This motion passed 3-1-1 . REQUEST: The applicants, Thomas and Roxann Sega, own 505 Heustis Street, Yorkville, Illinois (Property Identification Number 05-39-301 -009) located on the west side of Heustis Street, approximately 80 feet north of Fox Street. The legal description for the subject property is attached to this report. This lot is currently zoned R-2 (one-family residence district) and is improved with a single-family detached house and a detached garage. The applicant is seeking to remove the existing detached garage and replace it with a larger garage. In locating the new garage the applicant is requesting the following variance: 1 . Section 10-3-5C of the Yorkville Zoning Code to increase the maximum height of a detached accessory building from 15 feet to 21 feet. CONDITIONS: The surrounding properties are zoned and used as indicated below: i Zoning Use North R2 Single-family detached housing South R2 Single-family detached housing East R2 Single-family detached housing West R2 Single-family detached housing ' ZBA 505 Heustis Street — PC2007-19 September 14, 2007 Page 2 of 4 STANDARDS FOR GRANTING A VARIANCE: Section 10-14-5(C) of the Municipal Code indicates that the Zoning Board of Appeals shall not vary (or make a recommendation to vary) the regulations of the Zoning Code unless it has made findings based upon the evidence presented to them for each specific case based upon the following: 1 . Because the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out. The ZBA indicated that there are no particular physical aspects of this property that would create a hardship for developing this property. 2. The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. The ZBA stated that this part of town, while not officially so designated, is equivelent to a historic district. The area has other detached accessory buildings that pre-date the zoning code that are greater than 15 feet in height, thus establishing a character to the area. The ZBA felt that the requested variance would be in keeping with the character of this area. 3 . The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. The ZBA stated that they felt that there is no hardship created by the Zoning Code. 4. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. The ZBA noted that the requested variance is in keeping with the character of the neighborhood and therefore would not be detrimental to other nearby properties. They indicated that this position is supported by the letter submitted by the Pierces. 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger to the public safety, or substantially diminish or impair property values within the neighborhood. The ZBA indicated that the requested variance, if granted, would actually increase the value of this property and the neighborhood in general. ZBA 505 Heustis Street — PC2007-19 September 14, 2007 Page 3 of 4 NEXT STEPS The ZBA has made a recommendation to approve the Sega's request to build a detached accessory building in excess of the maximum allowed by the zoning code (increasing it from 15 feet to 21 feet). If the City Council concurs with the ZBA's recommendation (with or without any conditions) then the Council should direct staff to prepare an ordinance. There are two paragraph numbers 6 and 7. • Paragraph 2.iii—The city may not have funds budgeted,plans prepared, or IEPA permits issued for replacement of the sewer line when the property owner removes the structures. Revise to state that the city will replace the sewer within two years of removal of the structures. If that timeframe doesn't work within the property owner's re-development schedule,then the owner may relocate the sewer subject to mutual agreement with the city regarding the design and costs associated with the relocation. The city would reimburse the owner within one year of the new sewer being put into service. • Paragraph 7G—Delete this paragraph. This paragraph indemnifies the property owner and allows them to continue to maintain, use and occupy an existing frame garage and frame shed. Sections 10-3-5A and 10-613-4 provide direction on where detached accessory structures may be located. The detached garage does not conform to either of these Sections and the frame shed does not conform with Section 10-3-5A, which means that they are classified as non-conforming. Section 10-10- 1 of the Municipal Code addresses non-conforming situations, which basically states that if the structure was in place prior to the adoption of the zoning code the non-conforming situation may continue. This section also allows basic maintenance. B. Replace all lot lines and property line stakes moved or disrupted in the course of performing work in connection with the purpose of which this easement is granted. C. Construct no more than one (1) public sewer main or line within the easement area. No structures shall be constructed above ground elevation. Any manhole covers shall be flush with the ground. D. Insure that electric, telephone, cable service and other public utility services are not interrupted during construction and that following installation of the improvements that any services temporarily disconnected are reinstalled at the expense of the CITY in accordance with the utility companies minimum requirements for elevation and use. However, no buildings or structures of a permanent nature, other than curbing, shall be installed or constructed within the easement area. 7. The CITY shall signify its acceptance of this Grant of Permanent Easement in writing. 8. As additional consideration for the Grant of Permanent Easement, the City agrees, simultaneously with the acceptance of this Grant of Permanent Easement, to execute and deliver to the GRANTORS, for recording, a document permanently vacating and abandoning that certain twenty (20) foot wide water main easement granted to the UNITED CITY OF YORKVILLE by Document No. 124570 recorded on February 19, 1959. RESOLUTION AMENDING UNITED CITY OF YORKVILLE EMPLOYEE MANUAL BE IT RESOLVED by the United City of Yorkville as follows: Section 1. Section 3 .4 of the United City of Yorkville Employee Manual is hereby amended by adding the following underlined words: Section 3.4 Drug Testing A. It is the policy of the City that all job applicants will undergo screening for the presence of alcohol and illegal drugs as a condition for employment. Applicants will be required to voluntarily submit to a urinalysis test at a laboratory chosen by the City, at the City's cost. Applicants will also be required to sign a consent agreement provided by the City that will release the City from liability. Any applicant with positive test results will be denied employment. The City will not discriminate against applicants for employment because of past abuse of drugs or alcohol. B. It is also the policy of the City to conduct drug/alcohol testing where it has reason to believe that an employee may be under the influence of alcohol, illegal drugs or other controlled substances. In addition, any employee who is reasonably believed to have caused or contributed to an accident which resulted in personal injury requiring medical treatment away from the scene of the accident or which disabled a piece of equipment shall be tested for alcohol, illegal drugs, or other controlled substances. Further, employees employed in safety sensitive positions are subject to periodic or random testing. Employees subject to Department of Transportation (D.O.T.) testing shall be tested in accordance with D.O.T. regulations in addition to the testing and discipline provisions of this policy. Refusal to submit to testing will result in disciplinary action, up to and including termination of employment. 1 Section 2. Effective Date. This Resolution shall be in full force and effect after its passage and approval, and shall apply to all employees of the United City of Yorkville to which the Employee Manual is applicable. Section 3. Severability. All rules, regulations and resolutions, or parts of same in conflict herewith are hereby repealed insofar as they do so conflict; provided however, nothing herein shall be deemed or construed as modifying Section 1 . 1 of the Employee Manual.
