PC 2007- 36, PC 2007-36, Stanley and Diane Pobol, petitioners, have filed an application with the United City of Yorkville, Kendall County, Illinois, requesting R- 1 zoning classification, upon annexation to the United City of Yorkville, approved by the City Council on October 9, 2007. The real property consists of approximately 4.53 acres, located a 9255 Lisbon Road, Yorkville, Illinois. Action Items i. Annexation ii. Zoning iii. Special Use 2. PC 2007-37, McCue Builders, Inc., petitioners, have filed an application with the United City of Yorkville, Kendall County, Illinois requesting an amendment to a Planned Unit Development Agreement. Passed unanimously on a voice vote. Public Hearings: Chairman Lucietto entertained a motion to enter into Public Hearing. Holdiman and Adams moved and seconded to enter into the Hearings and this motion passed unanimously on a voice vote. Lucietto asked all who wished to speak to be sworn in as a group. 1 . PC 2007-30 Roger and Betty Jensen. The petitioners requested a continuance to November 14, 2007. Crouch and Lindblom moved and seconded to continue this hearing. The motion passed by a voice vote with all in favor. 2. PC 2007-23, Anthony and Nicole Zangler, petitioners, have filed an application with the United City of Yorkville, Kendall County, Illnois, requesting annexation to the United City of Yorkville and zoning to the United City of Yorkville R- 1 One Family Residence District. The real property consists of approximately 5.7 acres, located at 96 Quinsey Lane, Bristol Township, Kendall County Illinois. Page 2 of The Plan Council has recommended annexation and the petitioner wishes to build one house on this property. Attorney Ingemunson added that there are some easement issues. Chairman Lucietto asked for public comments: Julie Polhill She lives next to the property and expressed concern about the possible bike path. Samantha Duda, 402 Johnson St. She said there is a garbage dumpster on Quinsey Lane for people who live along the river. She asked if the dumpster could be moved east. She also inquired if the driveway would be an access for several homes or just the Zangler's. Ken Griesmann He is the present owner of the property and said he did not feel it was right for the Zanglers to relinquish so many easements on that small of a property. He spoke against the pathway and additional easements. Mike Bollweg He owns property on the east side of the petitioners and also is not in favor of the bike path, however, he is in favor of the possible sewer and water easement. Mike Frick He lives west of the property and spoke out against the bike path and said taxes are high enough. John Roesch, 98 Quinsey He asked if the remaining properties along Quinsey Lane would be annexed if this annexation is approved. There were no further comments and the Public Hearing was closed on a motion by Baker and second by Hegeler. Unanimous approval of motion by voice vote. Travis Miller reviewed staff comments. He first stated that the City is not seeking to annex the remaining property on Quinsey Lane and he noted that Quinsey Lane is a private road. There is a possibility of future sewer hookups, however. The property being discussed automatically becomes R-1 zoning with annexation and staff recommended three easements to be dedicated: utility easement, extension of sanitary sewer easement and trail easement. The trail would connect to the Heartland development. He said staff has recommended that Quinsey Lane remain private. Kraupner noted that Heartland has planned street stubs into the Quinsey Lane area. The Zanglers do not plan to subdivide their property and therefore there would not be a need for a connection. Page 3 of It was noted that the Zanglers are also opposed to a bike path, but would be OK with a sewer pipe being installed if it was done at the time of their home construction. The Commission members generally agreed they would not want a bike path there, however, they agreed that a sewer pipe installation and utility easement would make good sense at the time of construction. Action Items 1 . Annexation Tom Lindblom made a motion to recommend approval of the annexation as presented, omitting the bike path. Jeff Baker seconded the motion and the motion carried on a roll call vote: Adams-aye, Baker-aye, Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch- aye, Kraupner-nay, Lucietto-aye. 3 . PC 2007-32, Thomas O'Brien, Thomas Alarm System, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting rezoning from R-2 One-Family Resident District to the United City of Yorkville B-3 Service Business District. The real property commonly known as Lot 1 of the North Bridge Street Subdivision, consists of approximately 0.2 acres, located at 711 North Bridge Street, United City of Yorkville, Kendall County Illinois. Ms. Lucietto entertained a motion to enter into Public Hearing for the above. It was moved and seconded by Crouch and Lindblom respectively, to enter into Public Hearing PC 2007-32. Unanimous approval. Mr. Thomas O'Brien, 711 N. Bridge, asked for zoning from residential R-2 to business B-3 on this property in order to operate his business. It is located on the west side of Somonauk and Appletree. There was no comment and a motion was made by Lindblom and seconded by Crouch to close the Hearing. Motion approved unanimously. Action Item 1 . Rezoning There was no discussion regarding this request and a motion was made by Crouch to approve the zoning to B-3. Hegeler seconded the motion and it was approved by all on a roll call vote: Baker-aye, Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Lucietto-aye. 4. PC 2007-33, Virginia Welles, petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting zoning to the United City Page 4 of of Yorkville R-1 One Family Residence District. The real property consists of approximately 250.65 acres, located at 13873 Walker Road, Fox Township, Kendall County Illinois. It was moved and seconded by Baker and Crouch to enter into Public Hearing PC 2007-33. A voice vote unanimously approved this motion. Attorney Dan Kramer was present on behalf of the petitioner. He said this property had been annexed the previous night at the City Council meeting. This property is in the midst of agricultural property and is off Hollonback and Walker Roads. He asked for a recommendation of "estate zoning". He added that property owner, Virginia Welles, takes great pride in the fact that her ancestors were the first white settlers in the county and she does not want the property developed. This is the reason for the zoning request. There was no further comment and a motion was made by Crouch and seconded by Adams to close the Public Hearing. Unanimous approval on a voice vote. It was noted that this property shares boundaries on three sides, with the formerly proposed Fox Moraine property. Travis Miller suggested that the Findings of Fact should be considered when making the decision on the zoning. Chairman Lucietto briefly reviewed this. Attorney Kramer noted there are 5 or 6 properties zoned "estate" near the Welles property. After brief discussion, Baker moved and Hegeler seconded to recommend estate zoning as requested. Motion passed unanimously on a roll call vote: Baker-aye, Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Lucietto-aye. New Business 1 . PC 2007-25, The Fields at Westhaven Action Items- 1 . Preliminary Plan Trevor Ryan of Marquette Land represents the owners of the property purchased in 2005 and is near Baseline Road. At that time, there was a PUD and it was amended in 2006. The 161 -acre residential portion is at the northwest part of the site. A Land Vision representative showed a preliminary plan of the 164-acre site. They have been working with Plan Council, staff, the school and parks regarding the site. The development will include 261 lots with average lot size of 13,435 square foot and a gross density of 1 .6. Baseline Road is the main north-side collector road. Page 5 of Concern included having a major collector so close to a school. Concerns from Lindblom included 22 lots being inaccessible due to a 1 -way in/l -way out and two streets called Keystone. Chairman Lucietto agreed and said the Plan Commission always favors two ways in/out. Also, much traffic would be added to the Rt. 30/47/Baseline Road area and improvements would be needed. Mr. Ryan said the Beecher Road extension would ease some of that. Travis Miller offered comments from the staff report and some of those are as follows. He said if this development precedes Bailey Meadows, timing would be an issue in regards to infrastructure, water etc . The city does allow for recapture and front-fund agreements. He also noted that the 15 acre land cash donation is above the required amount. In addition, the area south of the Corn Ed easement is age-restricted and the property will not be a burden on the school system. He recommended that the preliminary plan move forward with a further delineation of the boundaries of the school/park site. Bill Dunn of EEI told the developer that a watermain will go through the school/park site and said no building can be built in that area. Commission member Hegeler asked about widening of Rt. 47 since many collector roads will empty onto it. Funding is the problem at this time. In conjunction with that question, Miller noted that two commercial developments planned along Rt. 47 would require two points of access and an IDOT permit is required. Miller also said that the developer agreed to pay for a portion of Rt. 47 improvements in their agreement. There was no farther discussion and Lindblom made a motion to approve this development subject to staff concerns and the following points: landlocking and the collector road. Hegeler seconded the motion. A roll call vote was taken: Lindblom-aye, Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Baker-aye, Hegeler-aye, Lucietto-aye. Motion passed unanimously. Additional Business: A 2008 tentative meeting schedule was handed out for review. Chairman Lucietto summarized the recent consortium meeting that she and Sandra Adams attended. IDOT and Fran Klaas attended and addressed questions regarding area roads. November 15th is the next meeting date and the topic will be preserving the rural nature. In January, historic preservation will be discussed. Information from the meetings is posted on the City website Page 6 of Travis Miller reviewed the Comp Plan Steering Committee. He would like to meet once a month beginning in November. He expects it will be a 2-hour meeting. Information will be given out for the fixture meetings regarding structure and topics. He would like to schedule two open houses for the public to attend. Chairman Lucietto suggested asking each Alderman to recommend one person from their ward to be part of the committee also and she will present this idea at the November 13`h Council meeting. Ms. Lucietto said there will also be a webpage regarding this committee. She said Platteville has invited her to explain how the Plan Commission works and she would like all Plan Commission members to attend. She also handed out name tags for all commission members for these upcoming meetings. Discussion turned to the boundary agreement between Yorkville and Montgomery. Miller reported that the two staffs have met and drafted an agreement. Council has discussed it and they also asked for Plan Commission input. Documents will be in the packets for next month' s meeting. Miller presented a map that showed the boundaries. Lindblom asked if residents along Galena Road would have input as to what town they would belong. He also asked about the Willowbrook subdivision and noted that those residents have more connection with Yorkville largely due to the schools. He said those people should have input into any decision. Miller said public notices would be posted and they would have a chance to attend meetings. Lucietto suggested discussions should be held with the residents. The Storybook subdivision was also included in this discussion. Crouch concurred with this opinion and said he felt Yorkville would not forcibly annex this area. However, he did not know about Montgomery. He felt those residents would be upset if forcibly annexed where they did not want to be. There will be further discussions next month. Hegeler inquired if Yorkville had any plans for a Yorkville train station since it would ease traffic. It is included on the comp plan on the east side of Yorkville. A comparison was made to Oswego who has a park `n ride, however, there is no train station there. Metra would ultimately decide where a station would be located. There was no further discussion and a motion was made by Crouch to adjourn the meeting. Hegeler seconded the motion and it carried unanimously on a voice vote at 8 :54pm. What happened is we went to Plan 12 Council and they recommended annexation , so we 13 came back through and said okay , if the City 14 wants to annex , then we will be happy to do that , 15 so we are in here requesting annexation . 16 It ' s about 5 . 7 acres on Quincy 17 Lane just east of Woodworth Estates , and we ' re 18 really just requesting annexation and then 19 default zoning to R1 where we would build one 20 house . 21 Travis and I have spoken 22 about - - One additional reason we didn ' t want to 23 annex was because of the cost to hook up to the 24 sewer , which would have been 7 - - 6 or $ 7 , 000 an Depo Court Reporting Service (630) 983-0030 6 1 acre , and with the five acres , we are looking at 2 rather costly . 3 So Travis has had some 4 conversations with Ralph , and I have not yet , but 5 I am going to . We ' re going to try to limit one 6 acre into annexation into YBSD to keep that cost 7 down , and , of course , there will be no other 8 buildings or permits issued on this property , so 9 we would only be building one house on here on 10 approximately 5 . 7 acres , so we would request 11 annexation to be able to actually accomplish 12 that , and we ' ve had some discussions with the 13 City , and there is some easement issues we ' ve 14 talked about . I ' m sure Travis will go into that 15 a little bit , but at this point , I ' ll request a 16 positive recommendation on annexation to the 17 City . 18 CHAIRMAN LUCIETTO : Okay . I live in Woodworth Estates , which is 7 directly next to his client , and some neighbors 8 and I had some questions because we heard that 9 there was a possible bike path , which we are not 10 at all interested in on that easement , and I was 11 wondering if that was going to be a possibility 12 or what we could do to protest the bike path . 13 MR . INGEMUNSON : Well , we don ' t want 14 it either , so we ' re happy they don ' t want it 15 because we don ' t want it , so as much as they can 16 protest , we are happy about that . 17 MR . HOLDIMAN : Gregg , does two 18 negatives make a positive ? 19 MS . POLHILL : It ' s a positive if it 20 works in our favor . 21 MR . INGEMUNSON : Exactly . Behind our house 24 on Quincy Drive there is a garbage dumpster for Depo Court Reporting Service (630) 983-0030 9 1 the houses that are along the river , so we were 2 wondering if anything is going to be done about 3 that because that technically will be those 4 people ' s driveway when they - - if they were to 5 move in there . We don ' t want the garbage 6 dumpster there either . 7 And then the path - - actually 8 Quincy Lane , if that was going to be their 9 driveway , is that going to be access to all the 10 other people that live on the river or are they 11 going to build a different access off of Tuma . 12 We heard rumors about there was 13 going to be a different access off of Tuma for 14 the houses along the river and this was going to 15 be access only for the people moving in . 16 MR . INGEMUNSON : The access is going 17 to remain the same . There is no change for the 18 access . It will be the access for the people , 19 for them , and on the river . 20 As far as the dumpster , I think 21 they are trying to move that . 22 MR . INGEMUNSON : Not just across the 16 little section of the street , all the way down to 17 the western edge . Is that right ? 18 MR . ZANGLER : Eastern side . 19 MR . GRIESMAN : My name is Ken 7 Griesman ( phonetic ) . My wife and I are the 8 present owners of the land to be rezoned . We 9 don ' t feel it ' s right of you to expect the buyers 10 to give up so many easements on this small five 11 and three quarter acre property . 12 If the Zanglers were 13 subdivision developers , we could understand 14 requiring them to put in a pathway and full 15 subdivision , but the Zanglers are not developers . 16 They are a family and they want to build one 17 home . 18 The buildable portion of this 19 property is not that large . The southern section 20 along the river is floodplain and there are 21 already two easements on the property . There is 22 a 30 foot by 765 foot easement on the westerly 23 side and a 16 foot easement exists along the 24 northerly end . Depo Court Reporting Service (630) 983-0030 12 1 You are asking for more 2 easements that will further divide this property . 3 We understand that sometime in the future a 4 sanitary sewer line needs to be provided . We are 5 not opposed to this improvement , but the work 6 needs to be completed now . The sanitary sewer 7 line should be located in an area agreeable to 8 both the City and the Zanglers . 9 There are not many pieces of 10 land like this left in Yorkville . It ' s quiet , 11 tree covered , secluded , and peaceful , a perfect 12 place to put up a large , beautiful home and raise 13 a family . 14 We are opposed to the pathway 15 from Heartland Circle to our property . The 16 homeowners next to the proposed pathway are also 17 opposed . We do not know of any other subdivision 18 in the City that has a pathway from their 19 property to the river . 20 Safe access from this same 21 riverside area is already available by sidewalks 22 on Bruell Street . It seems unnecessary to add 23 expense to the taxpayers for something that 24 already exists . You haven ' t seen it a lot 6 over the years , but if a property owner is 7 willing to annex property and go automatically to 8 the default zoning classification and if there 9 isn ' t a written annexation agreement that the 10 developer or owner wants something special or the 11 City wants something special , the City can simply 12 do that without public hearing , and so the 13 annexation ordinance has I hope been signed by 14 today , but it was unanimously approved by the 15 City Council last night . 16 To get zoning other than the 17 default zoning , we need to do the public hearing 18 in front of the Plan Commission , and actually we 19 filed this petition asking for the default 20 zoning , which is Rl Single Family . 21 Frankly , the area we ' re in , out 22 off of Route 71 , Hollenbeck Road and Walker Road , 23 is very agriculturally based at this time , and we 24 had discussions with your City Community Depo Court Reporting Service (630) 983-0030 21 1 Development Director about perhaps not going to 2 default zoning . 3 A little bit of 4 statutory history ; it used to be pretty much all 5 the time that your R1 would be the default or the 6 most restrictive zoning in any community . You 7 actually have two categories that I would 8 consider less dense or more restrictive ; that 9 being estate , and you also have an ag zoning . 10 We feel that the estate zoning 11 would be perfectly appropriate for this property , 12 and we would be satisfied if you gave a 13 recommendation to the City Council to zone it 14 estate zoning , and as long as we publish for a 15 more dense or a more intense use than R1 , you do 16 have the legal ability to recommend anything more 17 restrictive or lower , even estate or ag . IS Frankly , we would like the 19 estate zoning rather than agricultural . 20 Mrs . The Annexation Plat is attached for reference. City Council approved the annexation of this property on October 9, 2007. Zoning Ordinance 10-4-5 requires all land annexed into the City be classified as R- 1 Residential. Although, the petitioner is not requesting a re-zoning from this classification, 10-4-5 does require the Plan Commission to conduct a public hearing and make findings and recommendations with respect to the appropriate zoning classification or classifications of the annexed land and transmit to the Mayor and City Council. Comprehensive Plan Recommendations: The Comprehensive Plan Land Use Plan recommends Transitional Neighborhood for the area this property is within. The Comprehensive Plan Land Use Plan recommends Office/Research/Industrial north of the subject property based upon the planned Prairie Parkway alignment and future intersection with Route 71 . The Comprehensive Plan Land Use Plan recommends Estate Neighborhood The property to the west was annexed to the City in September 2006 and rezoned to A- 1 . Staff Comments: 1 . The existing use of the property is most similar to the uses permitted in the Estate Residential District. 1 2. State the items to be amended from the existing annexation or PUD agreement. Front Yard Setback We request that the front yard setback be amended from 30' to 25' for lots zoned R-4. This would move the house forward 5', allowing more room in the rear yard. This issue was brought to our attention with a ranch style home that we are currently constructing. Certain floor plans, such as ranch floor plans or a first-floor master floor plan, are deeper than the traditional two story floor plan. These deeper floor plans then take up more of the space in the rear yard, due to the current front yard setback. By allowing the 25' front yard setback, the house will sit on the lot with better balance. Currently, the front yard is too large, and the back yard is small and confining when using the deeper floor plans. A 25 ' front yard setback will allow vehicles to be parked in the driveway without impeding the sidewalk. In addition, this amendment will not affect any public utilities. Lot Coverage Ratio It is also requested that the Lot Coverage Ratio be changed on R-4 lots from 30% to 40%. This is due to the construction of ranch style home plans and first floor master plans, on the smaller sized lots. The foot-print of these plans require more area on the lot than a two-story plan requires. It has always been our intent to primarily construct ranch plans or first floor master bedroom plans on these lots to meet the market's needs. We did not consider the need to request this variance at the time of the annexation agreement. However, we recently submitted a building permit in which this issue was brought to our attention. It has been our mission for the R-4 lots (Villa lots at Blackberry Woods) to provide a good sized home, without compromising on room size, to be targeted toward families wanting to downsize from their current home and stay within the Yorkville community. This agreement provided the property with PUD zoning with both R-2 and R-4 provisions. Exhibit "E" of the agreement lists the Zoning Ordinance variations granted as part of this PUD (Attachment l of this report) as approved in 2005 . The petitioner is requesting to amend Exhibit "E" to include (Attachment 2 of this report explains each request): A Front Yard Setback of 25 ' in the R-4 District. The R-4 requirement is 30' . 5 ' variation. A Lot Coverage Ratio of 40% in the R-4 District. The R-4 requirement is 30%. 10% variation. Staff Comments: The R-4 Zoning District area includes Lots 50-132 of the Blackberry Woods PUD (Attachment 3 of this report). Front Yard Set Back Request Staff verified there are no utilities or infrastructure concerns with the dwelling units being 5 ' closer to the street right-of-way in this development. Staff recommends requiring a minimum 30' Rear Yard Setback in the R-4 area (removing item 4 from Exhibit "E") to provide wider rear yard areas. The Petitioner stated at the Plan Council Review a willingness to maintain a minimum 30' Rear Yard Setback for the R-4 units. 1 Lot Ratio Increase Request Staff recommends requiring a minimum of 50% of the units in the R-4 area include a covered porch in return for the increased footprint size. This architectural element will ensure a varied streetscape environment and reduce the risk of monotony of building masses which may be increased with larger building envelopes and the reduced setback also requested. The Petitioner stated at the Plan Council Review a willingness to commit to this requirement. 2 ATTACHMENT VaMff "E" LIST OF VARIATIONS 1 . Lot sizes in the R-4 District may be less than the 9,000 square feet minimum, but shall be at least 8, 160 square feet. 2. Front Yard Setback We request that the front yard setback be amended from 30' to 25 ' for lots zoned R-4. This would move the house forward 5', allowing more room in the rear yard. This issue was brought to our attention with a ranch style home that we are currently constructing. Certain floor plans, such as ranch floor plans or a first-floor master floor plan, are deeper than the traditional two story floor plan. These deeper floor plans then take up more of the space in the rear yard, due to the current front yard setback. By allowing the 25' front yard setback, the house will sit on the lot with better balance. Currently, the front yard is too large, and the back yard is small and confining when using the deeper floor plans. A 25 ' front yard setback will allow vehicles to be parked in the driveway without impeding the sidewalk. In addition, this amendment will not affect any public utilities. Lot Coverage Ratio It is also requested that the Lot Coverage Ratio be changed on R-4 lots from 30% to 40%. This is due to the construction of ranch style home plans and first floor master plans, on the smaller sized lots. The foot-print of these plans require more area on the lot than a two-story plan requires. It has always been our intent to primarily construct ranch plans or first floor master bedroom plans on these lots to meet the market's needs. We did not consider the need to request this variance at the time of the annexation agreement. However, we recently submitted a building permit in which this issue was brought to our attention. It has been our mission for the R-4 lots (Villa lots at Blackberry Woods) to provide a good sized home, without compromising on room size, to be targeted toward families wanting to downsize from their current home and stay within the Yorkville community. Over the past 15 years of business, we have come to understand what size a room needs to be in order to be functional while not being cramped. Therefore, in order to build a home with all rooms being an adequate size, we are requesting this variance. City Council reviewed a draft boundary agreement October 9, 2007 and requested the review and input of the Plan Commission prior to taking final action on the agreement. Attached is the draft agreement along with all exhibits for your review. A Public Hearing has been scheduled for the November 14, 2007 Plan Commission meeting regarding this agreement. Action Staff recommends, following the Public Hearing, the Plan Commission formulate a recommendation in the form of a motion including any modifications the Plan Commission deems appropriate for the Boundary Agreement to be adopted. INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF MONTGOMERY AND THE UNITED CITY OF YORKVILLE THIS AGREEMENT is entered into as of the day of , 2007, by and between the VILLAGE OF MONTGOMERY, Kane and Kendall Counties, Illinois, a political subdivision organized and existing under the laws of the State of Illinois ("Montgomery"), and the UNITED CITY OF YORKVILLE, Kendall County, Illinois, a political subdivision organized and existing under the laws of the State of Illinois ("Yorkville") (collectively referred to as the "Parties"): RECITALS WHEREAS, a portion of unincorporated Kane and Kendall Counties between Yorkville, and Montgomery, is a rapidly growing area in Illinois; and WHEREAS, developments under way or in various stages of planning are creating unusual growth opportunities between Yorkville and Montgomery; and WHEREAS, Yorkville and Montgomery realize that current plans and opportunities for development will be accompanied by significantly higher demands for transportation, police, utility, and other municipal services and financial commitments to meet the necessities of such services; and WHEREAS, the Constitution of the State of Illinois 1970, Article VII, Local Government, Section 10, provides for intergovernmental cooperation in and authorizes units of local government to obtain or share services to exercise, combine or transfer powers or functions in any manner not proscribed by law or ordinance, and authorized units of local government to use their credit, revenues and other resources to pay costs related to intergovernmental activities; and WHEREAS, the Intergovernmental Cooperation Act provides for the joint exercise of powers, privileges or authority by units of government and provides for intergovernmental contracts; and WHEREAS, Section 11 - 12-9 of the Municipal Code (65 ILCS 5/11 - 12-9) provides for the adoption of agreements establishing the boundaries for jurisdiction between municipalities in accordance with the provisions stated therein; and WHEREAS, Yorkville and Montgomery recognize the need and desirability to provide for logical municipal boundaries and areas of municipal authority between their respective municipalities in order to plan effectively and efficiently for the growth and potential development between their communities and the conservation of the available resources for all of their respective citizens; and 1 WHEREAS, Yorkville and Montgomery after each publishing and holding all public hearings required by law, have authorized, by ordinance, the execution of this agreement, as an exercise of their respective authority and as an exercise of their intergovernmental cooperation authority under the Constitution of Illinois; and NOW THEREFORE, in consideration of the mutual promises and obligations recited herein it is agreed between Yorkville and Montgomery, as follows: 1 . On or after the date of this Agreement, neither party shall annex territory which lies within the jurisdiction of the other municipality as established by such boundary line, nor shall it exercise or attempt to exercise or enforce any zoning, subdivision control, official map, or other municipal authority or ordinance. This boundary line shall not require a municipality to exercise control over the property on that municipality' s side of the boundary line, and shall not prohibit such municipality from negotiating additional boundary line agreements with other municipalities that may surrender such jurisdiction to another municipality (e.g. Montgomery may agree to cede jurisdiction to some property on the northerly and easterly side of the boundary line to Sugar Grove or Aurora and Yorkville may agree to cede jurisdiction to some property on the southerly and westerly side of the boundary line to Plano, without doing so being deemed a violation or inconsistent with this agreement.). Neither municipality shall object to the other municipality's request for an amendment of any facilities planning area in respect to land located on the requesting municipality' s side of the boundary line. 3 . Primary structures shall be constructed upon either a basement or foundation — `slab' construction shall not be permitted. 2. Design a. The height and scale of each building shall be compatible with its site and adjoining buildings. e. All newly installed utility services shall be underground. f. Common open space and pedestrian features/amenities, such as covered walkways, street furniture, and bicycle rack facilities are to be encouraged. g. Trash enclosures shall be located in areas that are easily accessible by service vehicles, but minimally exposed to the public street. Screening these enclosures with a material that is compatible with the principle commercial building is required. h. Rooftop mechanics shall be screened (as viewed from ground elevation at the property line) and enclosed in a manner that masks the equipment from view from all sides and is of the same character and design as the structure. i. Ground level mechanics shall be screened by landscaping and/or fencing. In addition to the properties listed on Exhibit B, Yorkville shall make a good faith effort to amend its annexation agreement with the property owner of the property located at the corner of U.S. Route 47 and U.S. Route 30 (commonly known as the Schramm Property) to require the above standards to be applied to said property. If such an amendment is successfully achieved by Yorkville, the provisions of this paragraph shall likewise apply to the Schramm Property. 4. To allow for comment, each municipality shall promptly notify the other of any proposed or contemplated change to, including, but not limited to, proposed zoning districts, and development plans for the properties listed on Exhibit C in order to foster intergovernmental cooperation and insure the compatibility of land uses along said boundary line. The type of proposed or contemplated change will determine the comment review period as follows: a. Preliminary Subdivision Plan and Plat, and Zoning Changes Approval Review: Comment Period — allow 15 days for initial staff response acknowledging acceptance of plans for review and establishing a review schedule. This review schedule shall not exceed 60 days without the consent of the municipality with jurisdiction, otherwise no comment/recommendation will be required to be considered by the municipality with jurisdiction. 4 b. Site Plan/Development Approval Review: Comment Period — allow five days for initial staff response acknowledging acceptance of plans for review and establishing a review schedule. This review schedule shall not exceed 45 days, otherwise no comment/recommendation will be required to be considered by the municipality with jurisdiction. 5 . The Parties agree that so as to coordinate transportation related issues to adopt and comply with the following (including, to the extent legally possible, requiring all developments to comply with the following): a) If not previously adopted, Exhibit B shall be adopted as each community' s transportation and access plan for full intersection access points 1 and 2 (as depicted on Exhibit D) onto and from U .S. Route 30 between U.S. Route 47 and Dickson Road within 60 days of passage of this Agreement (said access points are subject to reasonable latitude in positioning as long as each adjacent parcel to said future roadways as shown on Exhibit B is insured access to the roadways constructed from said access point). b) Coordination (and reasonable transitions of roadway widths and designs) of road stubs in adjoining developments to insure continuation of all boundary roadways including, but not limited to, Concord Drive extending west from Montgomery. c) Require, to the extent legally possible, all developments to install and coordinate bicycle paths in accordance with Exhibit E. To the extent, that either municipality designs roadways and/or bicycle paths independent of a private developer, the municipalities shall also comply with Exhibit E. This shall include requiring a connecting bicycle path along the Com Ed power lines (which lie south of U.S. Route 30) which shall have mutually agreeable design standards, as depicted on Exhibit E. 1 , and, at a minimum, be 10 feet wide. Should the Com Ed power lines be unavailable for said route, the Parties shall utilize their best good faith efforts to agree to establish a mutually agreeable alternate route for bicycle paths. d) Each municipality shall support the widening of U.S. Routes 30 and 47 within their respective jurisdictions and shall support said widening in the other Party' s jurisdiction to the extent possible. e) U.S. Route 30 and Galena Road constitutes a shared border between the Parties and the Parties acknowledge that there are one or more intersections for roads crossing or intersecting U.S. Route 30 and Galena Road that will require improvements as properties on either or both sides of the shared border are developed. The Parties agree to require either in an annexation agreement, or to the extent legally possible for property already annexed, any developer whose development is either adjacent to and will access U.S. Route 30 or Galena Road or adjacent to one of the intersecting roads for U.S. Route 30 or Galena Road and whose primary access to either of said highways will be from 5 such intersecting road, (i) such developer to pay its Pro rata share, reimbursement and/or recapture for the actual costs of intersection improvements (including but not limited to, traffic signalization, interconnects, and transponders for emergency vehicles), to be paid to the other municipality, and (ii) such developer to pay its Pro rata share, reimbursement and/or recapture of any costs of other intersection improvements (including but not limited to, traffic signalization, interconnects, and transponders for emergency vehicles) along U.S. Route 30 which have been previously installed by or at the direction of the other municipality to be paid to the other municipality. "Pro rata share" shall be defined as 25% for each corner of a four way intersection. 6. Both Parties shall cooperate with the Yorkville Community Unit School District # 115 to attempt to locate a Middle School site consisting of 30 acres. 7. Prior to drilling, or allowing third parties to drill any new water wells within one-half mile of the above-described boundary line, the Parties agree to confer and, using generally accepted engineering principles, not locate, or permit to be located by third parties (to the extent legally possible) any wells that would materially interfere with the operations or supply of other wells within one-half mile of the above-described boundary line. The Parties shall also meet to coordinate all new wells (regardless of their non- interference with existing wells) to avoid interfering with each other' s future well and water plans within one-half mile of the above-described boundary line. The Parties shall compel developers to design and install emergency cross-connections of watermains on boundary line developments. Said cross-connections shall only be opened and utilized upon the consent of the Village Manager/City Administrator of both municipalities and only for so long a period of time as is consented to by both municipalities Village Manager /City Administrator. 8. Yorkville agrees to consider allowing, and Montgomery agrees to consider allowing the tributary developments as shown on Exhibit F to utilize the Raymond Regional Basin for storm water management. A tributary development designed to utilize the Raymond Regional Basin shall be responsible for conveyance of storm water to the basin area (provided however that adequate downstream conveyance is provided) and shall contribute funds necessary to excavate volume capacity and/or other facility appurtenances at a rate of $ 15,000.00 per acre foot of volume generated by the participating development. This rate shall be evaluated when each development is approved to participate and adjusted accordingly based on the Engineering News Record cost index. All properties being served by said basin shall be treated equally by the Parties as to rates. Should a particular development utilizing Best Management Practices avoid or reduce the need for storm water detention through the use of strategies, including but not limited to, permeable pavement, rainwater basins, and other environmentally conscious strategies, said development shall not be prohibited from using such strategies in lieu of said regional basin. Additionally, should the order of development prohibit utilization of said regional basin for any particular landowner, Montgomery shall notify the Yorkville City Administrator and following a 30 day period not be required to compel said developer to utilize said regional basin. 6 Participating developments will be required to pay a proportionate share of the maintenance costs related to the stormwater detention benefit of the Raymond Regional Facility based on the volume served by the basin. All properties being served by said basin shall be treated equally by the Parties as to said costs. The amount assessed shall be based on the actual costs of maintaining said basin (taking into account the need for appropriate reserve funds). A dormant or back-up special service area ("SSA") (including a provision for a 10% administrative fee to be retained by the Party imposing and processing said SSA) will be required to be established to ensure funds adequate to maintain the storm water basin in perpetuity are accessible to Yorkville, therefore, Montgomery and Yorkville agree to allow such provisions be incorporated into the annexation agreements for the tributary properties. 9. This Agreement shall not be construed so as to limit or adversely affect the right of either municipality to file a statutory objection to proposed zoning changes within one and one- half miles of its corporate limits as provided for by State of Illinois statutes. 10. This Agreement is not one intended to benefit a third party, and no third party beneficiary shall be deemed created hereby. This Agreement is binding only upon Yorkville and Montgomery, and their respective successors and assigns. Nothing herein shall be construed as a limitation on the right of either party with respect to its boundaries with any other municipality or unit of local government. 11 . Neither party shall either directly or indirectly seek any modification to this Agreement through court action. This Agreement may not be changed orally. All modifications to this Agreement must be in writing and must be signed by each party. 12. If any provisions of this Agreement, or the application of such provision to any person or circumstance, shall be held invalid, the remainder of this Agreement, or the application of such provision to persons or circumstances other than those as to which it is held invalid, shall not be affected thereby. 13. Both Parties acknowledge that pursuant to the current provisions of 65 ILCS 5/7- 1 - 1 , the annexation of any territory adjacent to any road or highway not already within the corporate limits of any other municipality automatically extends the boundaries of the annexing municipality to the far side of the adjacent highway. To the extent that the provisions of 65 ILCS 5/7- 1 - 1 would result in the automatic annexation of any portion of a highway lying within the other municipality's Jurisdictional Area, the provisions of this Boundary Agreement shall not bar such highway annexation, however the Parties shall file all necessary petitions and otherwise work together to disconnect any portion of a given highway from the municipality and connect said highway to the municipality with jurisdiction of the given side of the boundary line herein established. 7 14. This Agreement shall be in full force and effect for a period of twenty (20) years from the date hereof and for such further and additional time as the Parties hereto may hereafter agree by amendment to this Agreement. 15 . This Agreement shall be construed in accordance with the laws of the State of Illinois and shall be published by the respective municipalities and recorded or filed with appropriate County Recorders, County Clerks, and others as their interest may appear. 16. If either Municipality successfully enforces the provisions of this Agreement against the other Municipality by judicial proceedings, the prevailing party shall be reimbursed for all costs of litigation, including reasonable attorneys' fees and court costs, by the losing Municipality. If litigation should be initiated by any third party challenging this Agreement, or any application thereof to any person or territory, the expenses of defending such litigation shall be shared equally by the two Municipalities. The defense of such litigation and the choice of attorneys shall be controlled by the Municipality whose annexation is being challenged or from whose territory land is to be disconnected. In the event the other Municipality desires to engage additional counsel to defend such litigation it shall be at its own expense. Venue for all litigation related to or arising out of this Agreement shall be in Kane County, Illinois. Step 6: Committee of the Whole: The Committee of the Whole meets the first and third Tuesdays of the month at 7:00 p.m. in the Conference Room at City Hall. The project will be discussed in an informal atmosphere at the Committee of the Whole where no formal voting takes place. This session is to discuss and consider recommendations of prior committee meetings. Step 7: City Council: The City Council meets the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting takes place. If this project has included an annexation and/or zoning petition, a Public Hearing will be held at this time with notice given by publication. Any annexation agreement, PUD agreement or development agreement must be signed by the Petitioner prior to being voted on by the City Council. Prior to the recording of the final plat, the petitioner must pay the Administration Fee. This is equal to 1 .75% of the approved engineer's estimate of construction costs of land improvements, including but not limited to all public improvements to be dedicated to the City, mass earth grading, and quasi-public improvements to be maintained by the homeowner's associations such as private storm sewer, parking areas, and trails. Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council and all required documents, bonds, and letters of credit are submitted to the City, the final plat may be recorded with Kendall County. Submit the final plat mylar to the Deputy Clerk for signatures. When all City signatures are in place, the developer or his surveyor may take the mylar to the Kendall County Clerk for his signature. The next step is to have six paper prints made and return to the Kendall County Recorder' s office for recording. Kendall County requires the mylar and four paper copies. The City of Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any copies you may require would be in addition to these.
