Approved unanimously on a voice vote. Public Hearings: Requested by Petitioners Chairman Lucietto noted that Public Hearing PC 2007-35 Letterle Annexation and Zoning would be postponed to December 12. Travis Miller stated that notices had been sent to the property owners, however, the published notice from the City had an incorrect date, making it invalid. Therefore, the hearing needs to be continued. As a result, Chairman Lucietto entertained a motion to open and close the Public Hearing. It was moved by Jones and seconded by Adams to open the Hearing. Passed unanimously on a voice vote. Dan Kramer, Attorney for the petitioner, stated that the notice will be re-published in the newspaper and courtesy notices will be sent to other interested parties. A motion to close the Public Hearing was then made by Crouch and seconded by Hegeler. It was approved by all on a voice vote. i Page 2 of 5 Chairman Lucietto then conducted a swearing-in of all who would speak at this meeting. 1. PC 2007-36, PC 2007-36, Stanley and Diane Pobol, petitioners. The petitioners filed an application requesting R-1 zoning upon annexation to the City, which was approved by City Council on October 9, 2007. This request is for 4.53 acres located at 9255 Lisbon Road, Yorkville. The Public Hearing was opened at 7:35pm on a motion by Jones and second by Crouch. Roll call vote was taken: Jones-aye, Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch- aye, Kraupner-aye, Adams-aye, Schillinger-aye, Lucietto-aye. Unanimous vote. Hearing closed at 7:37pm on a motion by Jones and second by Crouch. Approved unanimously on a voice vote. See Court Reporter 's transcript of Public Hearing. Discussion: Lindblom questioned why the petitioners wished to annex. Attorney Kramer said that at the time of the request, there was indication that the property in between might request to be de-annexed. Action Items i. Annexation-already completed ii. Zoning: Travis Miller said staff recommends rezoning this property to estate district. iii. Special Use: no further action needed A motion was made by Schillinger to approve the estate zoning, subject to staff comments for PC 2007-36. Crouch seconded the motion. Motion approved unanimously on a roll call vote: Jones-aye, Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Schillinger-aye, Lucietto-aye. 2. PC 22007-37 Mc Cue Builders, petitioners, filed an application for an amendment to a Planned Unit Development Agreement. This is for 60 acres of property south of Route 34 on Cannonball Trail. This Hearing was opened at 7:43pm on a motion by Crouch and second by Jones and approved unanimously on a voice vote. See Court Reporter 's transcript of Public Hearing. The Public Hearing was closed on a motion and second by Crouch and Jones respectively. It closed at 7:45pm following a unanimous voice vote. i Page 3 of 5 Discussion: Travis Miller reviewed the staff comments and summarized the two requests. 1 . Front yard setback is requested to be five feet closer to the street to allow for ranch style footprint on the Rt. 34 portion. Staff concerns included utility easements, however, they determined it would not cause problems for the infrastructure. The five feet will be recovered in the rear yard setback. 2. Lot coverage ratio: the request was for all lots in the R-4 zoning and is for 40% coverage rather than 30%. Staff recommended that a minimum of 50% of all units should have a covered porch. McCue representative, Sean Michels, said most porches would be decorative. Bill McCue also gave an overview of their home plans and porches. Schillinger asked if porches might be enclosed therefore increasing the square footage. McCue said they are only striving for curb appeal. He said there would also be some brick on the front. Schillinger also expressed concern for age-targeted /age-restricted neighborhoods and density. He said national builders could come in and promote age-targeted communities to increase density if the lot size is smaller. There is also the possibility of one developer selling to another and their standards might not be the same. Mr. McCue said he thought 70% of the homes would be ranches. Jones suggested a cap of 75%. Action Item: i. PUD Amendment After some further discussion, Lindblom made a motion to recommend approval of the changes in the setback with 40% lot coverage for 50% of ranch homes in the subdivision. Crouch seconded the motion. There were some brief comments. Roil call vote was taken: Hegeler-aye, Lindblom-aye, Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Schillinger-aye, Jones-aye, Lucietto-aye. Motion carried unanimously. 3. The Village of Montgomery and United City of Yorkville are considering approval of a Boundary Line Agreement pursuant to 65 ILCS 5111-12-4. A motion was made by Jones and seconded by Crouch to enter into Public Hearing. All were in favor following a voice vote. The Hearing opened at 8:10pm. It concluded at 8:25pm and a motion was made by Jones and seconded by Crouch to officially close the Hearing. All were in favor on a voice vote. See Court Reporter 's transcript of Public Hearing. i i Page 4 of 5 Discussion: Lindblom asked if nearby Willowbrook residents had been notified of the Boundary Agreement. They had not been notified. He further stated they are supporters of the Yorkville schools and that verbage should be included to prevent forced annexation. Crouch noted that Yorkville has a policy of no forced annexations. Mayor Burd said verbage was to have been included in the agreement. Kraupner asked if the north/south boundary was on Dickson Road. It is actually west of Dickson Road. It was noted that a couple properties on Dickson Road do not wish to be force annexed. Action Item: i. Boundary Agreement A motion was then made by Lindblom and seconded by Crouch to accept the boundary agreement with the inclusion of a statement relating to non-forced annexation by either community. It passed unanimously on a roll call vote: Lindblom-aye, Holdiman, Crouch-aye, Kraupner-aye, Adams-aye, Schillinger-aye, Jones-aye, Hegeler-aye, Lucietto-aye. New Business: 1. PC 2007-38 Menard's 6th Addition This property is adjacent to Countryside Parkway. Miller said a request has been made to divide lot 4 into 3 parcels and he reviewed staff comments, including a staff recommendation in favor of this request. There was no discussion. Action Items: L Preliminary Plan Lindblom moved and Crouch seconded a motion to accept the preliminary and final plat subject to staff comments. Lucietto noted that two separate votes would be needed. A roll call vote was taken on the preliminary plan portion as follows: Holdiman-aye, Crouch-aye, Kraupner-aye, Adams-aye, Schillinger-aye, Jones-aye, Hegeler-aye, Lindblom-aye, Lucietto-aye. ii. Final Plat A motion was then made by Crouch to approve the Menard's final plat and it was seconded by Jones. Countryside Center Concept Development Plan by Tri-Land Richard Dube, President of Tri-Land, gave a presentation of the concept plans for Countryside Center. He had previously met with Mayor Burd to discuss a vision for the property. A design firm, Sparks & Co., was then hired and a mixed-use, town center type look was designed. Charles Sparks described the amenities that are under consideration: hotel, retailers, pedestrian-friendly areas, fountains, raised sidewalks, pavilion, office space, restaurants, promenades, prairie-style architecture and others. Mr. Dube added that approximately 160,000 square feet of retail space would be available on this 18-acre property. Chairman Lucietto asked if the designers had considered elements of sustainability. Sparks & Co. is looking at silver and platinum. Traffic concerns were discussed since Rte. 47 is already congested. Travis Miller said the plan has been submitted for IDOT review and they already recognize the need for a signal that would probably be located near Dunkin' Donuts. The Commission members gave favorable comments for the plan as presented and Mr. Dube credited the Mayor for her input on some of the design elements. Mr. Dube said the concept plan will be presented at the City Council meeting on November 27th. Other Business: Chairman Lucietto noted that she had obtained a subscription of Planning Commissioners ' Journal that contains ideas from other towns. She asked for feedback from the commission members. There was no further business and Crouch moved for adjournment, followed by a second from Hegeler. I am an attorney licensed 12 to practice law in the state of Illinois and 13 represent the petitioner . 14 This one is somewhat of an 15 unusual procedure in that the property has 16 already been annexed into the United City of 17 Yorkville . It ' s a little over four- acre parcel 18 that ' s contiguous to the North Star property that 19 was annexed to the property on the east boundary 20 of North Star . 21 The property is accessed by a 22 long private easement off Lisbon Road to the 23 west . It ' s over 1100 feet to get back to where 24 the home is , and we have to assign the zoning - 0030 Depo Court Reporting Service ( 630 ) 983 Page 6 1 class for it . We filed as a R1 , which is the 2 default zoning . 3 Frankly , the petitioner does 4 have horses there , so we are fine if you want to 5 do a more restrictive class , estate or 6 agriculture , under the City . We ' re fine with 7 either of those . 8 I think Travis ' recommendation 9 was the estate class , which is fine with us . 10 There ' s no new improvements to it . It ' s just 11 again , assign a zoning class to the parcel that ' s 12 already annexed . 13 CHAIRMAN LUCIETTO : Great . MILLER : I ' m going to refer to 12 the November 1st staff report just give you the 13 background and the actions in front of you , and I 14 previewed this under official business at last 15 month ' s meeting , so as we go through the 16 discussion , I want to refer to the back pages of 17 the draft annexation agreement as I described . 18 it may be easier to visualize . 19 Exhibit A shows the proposed 20 boundary line . The discussions started in the 21 summer , this summer , between the staff at the 22 direction of the mayor and village manager of 23 Montgomery , myself and community development 24 director for the Village of Montgomery , and our Depo Court Reporting Service ( 630 ) 983 - 0030 Page 11 1 staffs have met on several occasions to talk 2 about the terms of the boundary agreement and to 3 try to formulate a draft agreement to be 4 presented to the boards of both communities for 5 their consideration and for approval . 6 The concepts , a draft was 7 submitted to the City Council in October . The 8 City Council reviewed it and immediately asked 9 for the Plan Commission ' s review and 10 consideration . There was a public hearing and 11 this draft is before you for consideration . 12 So this is the actual public 13 hearing being conducted for the consideration as 14 required by state statute for a boundary 15 agreement between two municipalities . 16 Geographically speaking , the 17 boundary , starting at the west side moving east , 18 which starts - - follows Baseline Road at the 19 beginning of the intersection of Ashley Road and 20 Baseline , heading east to - - crossing Route 47 to 21 the section line that ' s just to the east of 22 Bristol Bay subdivision , which if we look at 23 Exhibit A , you can identify Bristol Bay 24 subdivision , so following this section line then Depo Court Reporting Service ( 630 ) 983 - 0030 Page 12 1 south to Galena Road , and then basically 2 following Galena Road to Orchard Road , which 3 actually goes beyond our curb boundary agreement 4 with Oswego , which was pointed out during 5 discussion last month , so the legal description 6 will be modified to stop short of that to be 7 consistent with that boundary agreement , but the 8 general alignment here is to follow Galena Road 9 to the edge of our plan . 10 I ' m going to move through some 11 of the key points of the agreement itself . We 12 get through the various titles and the legal 13 description and the real heart of this agreement 14 I believe begins in line item number 3 , which 15 starts at bottom of Page 2 of the agreement . 16 This is where we talk about 17 applying development standards , development 18 standards that would govern development in both 19 communities regardless of the jurisdiction 20 authority . 21 The development standards 22 outlined in Section 3 would be followed , so 23 whether it ' s an incorporated area on the 24 Yorkville side of the boundary or the Montgomery Depo Court Reporting Service ( 630 ) 983 - 0030 Page 13 1 side , each municipality would be expected to 2 follow these minimum standards . 3 These minimum standards come 4 from - - primarily come from the Yorkville 5 Comprehensive Plan guidelines , as well as the 6 Yorkville Appearance Code , so you should be 7 familiar with the majority of , better than 90 s percent , of the standards of the City here . 9 One difference is when you get 10 to density and we look at - - bear with me . 11 MR . HOLDIMAN : Page 3 . 12 MR . KRAUPNER : Page 3 . 13 MR . MILLER : The four units per acre 14 is going to be a foreign number to Yorkville . 15 This is a density standard that is a maximum 16 density for the Village of Montgomery , so as we 17 looked at density , the 2 . 25 comes from the 18 Yorkville standards as a minimum with our density 19 standards . 20 we take a gross density 21 calculation , so any time there is open space , 22 such as right - of - way or detention basins , all 23 that is factored in . Montgomery has a different 24 formula when applying densities ; they look at Depo Court Reporting Service ( 630 ) 983 - 0030 Page 14 1 developable area , lot area . The inventory is 2 slightly higher . 3 The compromise that staff came 4 up with is for developments that are going to be 5 managing stormwater on- site and detention basins 6 within the development , the 2 . 25 standard would 7 be utilized . 8 For developments that utilize 9 the regional basin , which all of the area that ' s 10 undeveloped between the tributary to community 11 basin and potential stormwater there , if a 12 development is sending their stormwater there , 13 four units per acre would be a maximum density . 14 That ' s when you take out 15 stormwater and open space , it would be four units i 16 per acre , which is pretty low for suburban i 17 residential development , so I just wanted to 18 point that difference out to you . 19 MR . SCHILLINGER : That would be all 20 these properties highlighted there in blue ? 21 MR . MILLER : Highlighted in blue , 22 correct . The item number 4 , back to that 23 exhibit , Brian , the areas highlighted in blue 24 were also designated as areas where each Depo Court Reporting Service ( 630 ) 983 - 0030 page 15 1 municipality had a joint review process . 2 It would be very similar to a 3 review ; difference being a community where this 4 falls within their municipality with the boundary 5 agreement would have the jurisdiction obviously 6 to approve the development plan . 7 However , they are agreeing by 8 the terms of this agreement not to make that 9 approval until , use the example of property that 10 falls on the east side of the line and/or on the 11 other side of the line , would have an opportunity 12 to review and provide comment before they give a 13 final decision on that development agreement . 14 Of course , we would - - staff 15 would review that and we would expect it to meet 16 the minimum standards of this agreement . 17 So that I thought personally 18 was a unique way to approach working together 19 with neighboring communities throughout the life 20 span for the next 20 years , and we will have a 21 current pulse on what ' s happening across the 22 line . 23 Item number 5 talks about 24 coordinating transportation- related improvements , Depo Court Reporting Service ( 630 ) 983 - 0030 Page 16 1 This would be everything from improvements along 2 State Route 30 , which IDOT has designated 3 District 1 , IDOT has designated full intersection 4 locations along 30 . 5 The Village of Montgomery has 6 gotten approval in their long range plan from 7 District 1 . We ' re part of District 31 They have 8 shared their plans with District 1 , and those 9 plans make sense with what we are accustomed with 10 in terms of spacing , so they have identified 11 those on the exhibit . 12 It ' s so far consistent with 13 plans we have approved along Route 30 , and we 14 want to make sure as plans continue along 30 , we 15 make sure that those locations are consistent 16 with it . 17 Really the only development 18 plan left would be the Schramm property . we are 19 at a concept level . That concept plan does show 20 a connection to Route 30 . It ' s a very wide arrow 21 on a public map . When the engineering comes in , 22 we will make sure it ' s consistent with that , is 23 the issue there . 24 Item number B talks more about Depo Court Reporting Service ( 630 ) 983 - 0030 Page 17 1 coordinating internal drive between developments , 2 and just for connectivity , it is something we 3 strive within our community , as does Montgomery , 4 so it makes sense along our borders we do the 5 same thing . 6 Other highlights , item number 7 six relates to the school district . Yorkville 8 Community School District goes into the village 9 of Montgomery and covers this territory . 10 One issue that has come about 11 just in the past year is the fact that some of 12 the preliminary - - concept and preliminary 13 development plans that Yorkville has approved , we 14 haven ' t approved one yet with the middle school 15 land dedication and we ' re beginning to paint 16 ourselves into a corner . 17 The school district has brought 18 this to our attention . we have the ability on a 19 few of the school sites that have been dedicated 20 or on the concept plan to expand those sites from 21 15 acres as necessary to a larger school , but as 22 a case -by- case , we don ' t have a crystal ball . So 23 we wanted to have something in this agreement 24 that formulates a middle school north of the Depo Court Reporting Service ( 630 ) 983 - 0030 Page 18 1 river . 2 It would be our hope that 3 somewhere some are developed between the two 4 communities where we can house a 25 - acre middle 5 school location . That ' s going to be contingent 6 upon and driven to a large degree by the 7 developer or group of developers that come in in 8 the area . 9 A note , item 6 is one sentence 10 that doesn ' t have a lot of teeth in it , but I 11 think the important point here is that we are 12 memorializing the fact that we need at least 30 13 acres . When we are reviewing , we can find a 14 suitable location . 15 MR . JONES : Does any of Montgomery ' s 16 plan or current jurisdiction or boundary lines 17 impact the Yorkville School District ? 18 MR . MILLER : No . No . The school 19 district boundaries would stay the same . It 20 would just be the area within the Village of 21 Montgomery would be Montgomery residents , the 22 Yorkville School District 115 does serve the 23 Village of Montgomery . 24 MR . The predominant land use proposed for the surrounding areas is Suburban Residential. In addition to satisfying open space for recreational needs, the Comprehensive Plan goal and Objectives for Park/Open Space areas include the preservation of areas of unique scenic or natural quality. A common theme repeated in the Comprehensive Plan is the preservation of rural character, respecting and enhancing natural and historical resources. Staff Comments: 1 . The current use of the property for boarding horses and equestrian activities is rural activity consistent with the combined recommendations of the Comprehensive Plan. 2. Agricultural District zoning allows for Riding Academies and Stables are listed as a Special Use. Staff recommended the petitioner to request A- I Zoning with a Special Use to allow for the existing land use to remain on the property upon annexation. 3 . Staff recommends the Annexation Agreement include the following provisions: a. A requirement for the owner to reimburse the City $3,464.95 upon annexation for the properties proportion of the cost for the Rob Roy Creek Flood Study conducted in 2002 which benefited this property by determining the flood plain location for the Rob Roy Creek. The reimbursement amount is based on a $5.29/lineal foot rate calculated at the time the study was prepared; 1 b. A provision allowing the gravel drive and parking areas to remain on the property with a requirement to pave the segment of the driveway 25 ' from the driveway intersection with Eldamain Road to allow for safe ingress/egress from the property; c. Petitioner is responsible for making submittals to other review agencies such as Kendall County, Illinois Department of Transportation, Illinois Department of Natural Resources, U.S. Army Corps of Engineers, etc., to allow timely review by City. *Fees: 1 . Preliminary Plan Fee - $500/Final Plat Fee - $500 a. Engineering Review Fees - 1 .25% of the approved engineer' s estimate of cost of all land improvements, to be determined by City Engineer. b. Step 2: Plan Council: The Planning Council meets the 2nd and 4th Thursday of the month at 9:30 a.m. in the City Administration Office. Upon recommendation by the Plan Council, you will move forward to the Plan Commission Meeting. Attendees to this meeting include: City Administrator, Community Development Director, Sanitary District Director, City Engineer, Building Department Official, Emergency Medical Rep, Public Works Director, Executive Director of Parks and Recreation, Fire Department Rep, and Police Chief. Step 3: For Preliminary Plans only; Park Board Planning Meeting: The Park Board makes recommendations on any Park Sites included in the development. The Park Board Planning Meeting is the fourth Monday of each month at 7:00 p.m. at the Riverfront Building, 301 E. Hydraulic Street. Step 4: Plan Commission: The Plan Commission meets the second Wednesday of each month at 7:00 p.m. in the Council Chambers at City Hall. The Plan Commission will make a recommendation for the City Council's consideration. The Plan Commission consists of 10 members appointed by the Mayor, the City Attorney and City Land Planner. The project will be discussed in an informal atmosphere at the Committee of the Whole where no formal voting takes place. This session is to discuss and consider recommendations of prior committee meetings. Step 6: City Council: The City Council meets the second and fourth Tuesdays of the month at 7:00 p.m. in the Council Chambers at City Hall. This is where all City Council voting takes place. If this project has included an annexation and/or zoning petition, a Public Hearing will be held at this time with notice given by publication. Any annexation agreement, PUD agreement or development agreement must be signed by the Petitioner prior to being voted on by the City Council. Prior to the recording of the final plat, the petitioner must pay the Administration Fee. This is equal to 1 .75% of the approved engineer' s estimate of construction costs of land improvements, including but not limited to all public improvements to be dedicated to the City, mass earth grading, and quasi-public improvements to be maintained by the homeowner's associations such as private storm sewer, parking areas, and trails. Step 8: Final Plat recording instructions: Once the final plat is approved by the City Council and all required documents, bonds, and letters of credit are submitted to the City, the final plat may be recorded with Kendall County. Submit the final plat mylar to the Deputy Clerk for signatures. When all City signatures are in place, the developer or his surveyor may take the mylar to the Kendall County Clerk for his signature. The next step is to have six paper prints made and return to the Kendall County Recorder' s office for recording. Kendall County requires the mylar and four paper copies. The City of Yorkville requires that you submit two recorded paper copies to the Deputy Clerk. Any copies you may require would be in addition to these. Landscape Plan Comments: 1) At the permanent entrance on Eldamain, street trees are required on both sides of the road. Landscaping is also required in the center median. 2) The hatching pattern for the seed mixes shall be shown under the appropriate seed list. 3) The NWL and HWL shall be indicated on the plans. 4) Include a detail of the erosion control blanket, which shall be specified for any slope to be seeded with native seed. 5) The design shows a retention basin, with a 3 ' wide band of `detention basin wet prairie mix' seed along the water's edge. Wywrot, PE December 5, 2007 Page 2 of 7 Our review of these materials is to generally determine the plan's compliance with City of Yorkville ordinances and whether the improvements will conform to existing City systems and equipment. This review and our comments do not relieve the designer from his duties to conform to all required codes, regulations, and acceptable standards of engineering practice. Engineering Enterprises, Inc. 's review is not intended as an in-depth quality assurance review. We cannot and do not assume responsibility for design errors or omissions in the plans. Our comments are as follows: GENERAL 1 . A copy of the Natural Resource Information (NRI) Report by the Kendall County Soil and Water Conservation District should be filed with the City. 2. Permits or Sign-offs will be required from the following agencies: a. (IDNR) Consultation Agency Action Report regarding endangered/threatened species or natural areas. b. (IHPA) regarding preservation of cultural resources. c. Kendall County Health Department regarding the well and septic. d. (IEPA) Division of Water Pollution Control regarding a Notice of Intent (NOI) General permit to discharge storm water. e. Kendall County Highway Department regarding proposed improvements in the Eldamain Road Right-of-Way. {A letter from the County Highway Department is on Mel 3. An agricultural field tile survey should be performed and the results submitted for review. 4. A copy of the soils report for this project should be submitted for review. 5. A wetland delineation report has been submitted confirming the presence of wetlands on the subject parcel. The report indicates that for each wetland area there is no "clear hydrologic connection with Waters of the U.S. The final jurisdictional determination will be made by the Army Corps of Engineers (Rock Island District). Mitigation of wetlands could become an issue on this project depending upon this jurisdictional determination. Public sidewalks should be provided on each side of Road "Aa between Eldamain Road and Sta. 104+02 in accordance with City Standards. 7. The heavy-duty pavement section should specify the use of Amoco 4551 geotextile fabric or equal over the compacted subgrade. OVERALL PLAN 8. The note regarding the connection of the 12-inch RCP outfall to the 15-inch drain tile should be deleted. SITE & UTILITY PLAN 9. Recent groundwater studies from this area suggest that the groundwater gradient is generally from northeast to southwest. These findings lead to a recommendation to avoid locating sources of potential groundwater contamination north or east of a potable well, particularly a shallow groundwater well. 10. Based on the observations in comment #7, we recommend the relocation of the gasoline and diesel fuel storage tanks to a location that is down gradient with respect to the proposed well site. The design of the fuel storage and containment facilities falls under the jurisdiction of the Fire Protection District. We recommend that plan review of this facility by the Fire Protection District be encouraged early in this process. The review of the three 35,000-gallon liquid asphaltic cement (AC) vessels proposed for this site would also fall under Fire Protection District jurisdiction. 11 . The design engineer should identify in the plans what standards are being used in the design and construction of the above mentioned fuel and asphalt storage tanks. 12. A mechanical system for. handling sanitary flows that includes a seepage field and tank is proposed for the same area as the fuel storage. The design engineer should include details as to the design and capacity of the proposed system within the plans. Similar to the concerns voiced in the comment regarding fuel storage, there are also concerns with this sanitary facility being immediately up gradient of the proposed potable shallow well. Inasmuch as the private well and sanitary system approval falls under the jurisdiction of the Kendall County Health Department, we recommend that plans and specifications be submitted for Health Department review as early as possible. The crushing operations and material storage areas are positioned such that stormwater runoff from the processing and storage areas will sheet drain untreated directly into the stormwater management basin (wet). We strongly encourage the incorporation of additional Best Management Practices (BMP'S) to pretreat this runoff before entering the pond. The developer should provide aggressive measures to protect the shallow sand and gravel aquifer which is a renewable source of potable water for both private and municipal wells in the area. GRADING & EROSION CONTROL PLAN 14. The future roadway improvements (Road "A") will require significant regrading and drainage improvements in the north half of the right-of-way. 15. Stormwater easements should be provided for all off-site stormwater facilities (Sediment Basin "A" and stormwater seepage field). 16. Details for the seepage field design should be included in the plans. 17. The general site grading calls for sheeting drainage at 0.50% throughout much of the site. Inasmuch as most of the open areas are designated for material storage, likely in the form of stockpiles and material bins, we believe surface drainage may become a problem on this site. We recommend that more detail be provided to illustrate the proposed use of these areas and the probable locations of stockpiles, etc. so that more detailed drainage patterns can be defined. We further recommend that grades be increased wherever possible in order the avoid drainage issues. ELDAMAIN MEDIAN — ENTRANCE PLAN & PROFILE 18. On Sheets 8 and 9 the median at the west end of Road "A" falls within two different types of hatching. These two types of hatching should be explained as they do not appear to conform to the hatch legend. 19. Increased runoff from additional pavement on Eldamain Road is undetained and should be directed to an on-site stormwater facility. INTERSECTION DETAIL 20. The one street light symbol shown in the boulevard median fails to identify the mast arm configuration. There should be an indication as to whether this unit will have a single mast arm or a twin mast arm. If single, will it be extended over Eldamain or over one of the Road "A" lanes? The detail for the pole and luminaire on Sheet 17 indicates that the pole intended is that specified for residential streets. Wywrot, PE December 5, 2007 Page 5 of 7 DETAILS 21 . The 10' Path Section should include the requirement of geotextile fabric between the subgrade and the aggregate base course. 22. The curb and gutter details should indicate the requirement for continuous reinforcement (2 - #4 deformed bars 12 inches apart and 3 inches above the bottom). DETAILED CROSS-SECTIONS 23. The Typical Cross-Section thru Retention Basin (XS-4) should be revised to show a maximum slope of 5: 1 between the 100-year HWL and the normal water level. (SHEET 14) STORMWATER MANAGEMENT REPORT 24. The United City of Yorkville's Stormwater Ordinance does not provide design specifications for the infiltration of stormwater. Of late, our office and City staff members have researched the various issues surrounding the design of infiltration basins and have identified certain principles that should be considered in the design of this site. The proposed system on this site combines the elements of a traditional retention basin and stormwater infiltration. This site has the added complications of proposed heavy industrial use and the existence of a shallow sand and gravel aquifer that must be protected. The comments provided below use what we have learned about the infiltration basins contemplated at other locations within the City and attempts to balance those concepts with the intended use and stormwater design found in this application. 25. Given its proposed industrial use, it is expected that there will be significant levels of suspended solids in stormwater runoff from this site. The recommended treatment for this type of runoff would be to provide a forebay to settle out solids prior to cleansing through vegetated wetland areas or bioswales. These pretreated flows would then be introduced to the retention pond. Understanding that it may be challenging to provide the optimum pretreatment on the subject site, we recommend that the design engineer develop viable options for settling out solids and cleansing contaminants prior to the introduction of stormwater runoff into the pond and infiltration field. Anticipating high levels of particulate matter from the crushing operations and the handling of stockpiled materials, it will be important to design BMP's that are sustainable and maintainable. The design engineer should provide a recommended schedule for the maintenance of any BMP's or facilities that will be sensitive to accumulations of sand, screenings, silts, asphalt grindings, etc. Maintenance responsibility for BMP's and stormwater GAPubRc\Yorkv111et2005\Y00503 Hammann-Eldamain RoaftoWkywrot04.doc Mr. Joseph A. The engineer should provide the maximum possible separation between inflows into the pond and its outfall. Structure #218 is too close to outfall structure #100. Greater separation should be provide. 27. It should be noted that the use of the seepage field may not be an appropriate BMP. If the groundwater table elevation is greater than the invert of the seepage field, it may cause groundwater contamination from the interaction between the runoff water and the groundwater. It is recommended that the bottom of the seepage field be a minimum of 4' above the seasonally high groundwater table. The use of this BMP will be reviewed once the soil boring report and final seepage field design are submitted . 28. The stormwater design implies that the retention pond will be lined. The design engineer should confirm this requirement and indicate the method proposed for the lining of the pond. 29. The Zero Release HEC-1 model indicates that the peak water elevation of the basin is 644.57 . Due to this result, the overflow weir curtain wall should be placed at an elevation of least 644.6, for the interim condition. 30. The Engineer should revise the storm sewer calculations to include the pipe run 224 to 204. PRELIMINARY/ FINAL PLAT OF SUBDIVISION 31 . Provisions for the Ingress Egress Easement should be provided at final platting. 32. Provisions for the Railroad Spur Easement should be provided at final platting. 33. A note should be provided on the final plat stating when the temporary I. E. E. and the Temporary Turnaround Easements will expire. 34. If the railroad spur easement has been granted and recorded, the document number needs to be shown. Landscaping is also required in the center median. 2) The hatching pattern for the seed mixes shall be shown under the appropriate seed list. 3) The NWL and H WL shall be indicated on the plans. 4) Include a detail of the erosion control blanket, which shall be specified for any slope to be seeded with native seed. 5) The design shows a retention basin, with a 3 ' wide band of `detention basin wet prairie mix' seed along the water's edge. The meeting was called to order at 7:00 pm by Anne Lucietto, Plan Commission Chairwoman from the United City of Yorkville. Welcomes and introductions of the speakers, Stephanie Sheetz and Dan Lobbes, from the Conservation Foundation, were made. Ms. Sheetz thanked the group for the invitation and shared that The Conservation Foundation's goal is to preserve natural areas and open space, protect rivers and watersheds, and act as stewards of the environment. The Conservation Foundation has 4500 members and works with public agencies, private landowners and local environmental groups. Conservation easements are legal agreements that permanently restrict the amount and type of development on a property, tailored to the land' s character and specific to what each landowner desires. These easements are monitored and enforced by public agencies. Landowners may qualify for income tax deductions, reduced property taxes and reduced estate taxes. Easements are used: 1 ) to preserve habitats or species; 2) provide access for outdoor or recreation education; 3) must be identified in the Ill. Natural Area Inventory; 4) be part of a local, state or federal policy to conserve, restore and protect wildlife or scenic areas; 5) must be monitored by a nonprofit land conservation agency. Deed restrictions, as pointed out by Mr. Lobbes, are not monitored regularly and do not require land stewardship. A conservation easement is a separately recorded document, referenced on the plat and any entity cannot hold a conservation easement on land it owns. Two funds must be established for good project management: 1) one for monitoring and enforcing the project, including legal fees, which the developer is encouraged, up front, to give the entity; and 2) management of ongoing funds by the Home Owners Association, and secondly, with a dormant back-up SSA. It was urged by Mr. Lobbes, that any easement management plan be implemented by a contractual agreement, determined for as many as 5 years, to qualified companies. Plan commissions can be involved by evaluating which tool is appropriate for their community, relevant to the development, and involving The Conservation Foundation with educational issues, as needed. Ms. Lucietto asked those in attendance if they had questions. The following are information items, discussed by Ms. Sheetz and Mr. Lobbes; 1 ) the HOA has specifically designated accounts which keep monies for upkeep by the contractual agency; 2) landowners receive a benefit of more control, ultimately, for the use of their property, even though by including an easement the overall price of the property may be lower; 3) Mr. Lobbes stressed the importance of the dormant SSA's, as a funding and management mechanism that is always available, but are put in place by the Villages; 4) the minimum area of a conservation easement is not regulated, as long as it meets all the criteria; 5) a conservation easement can be added after an annexation is completed, if the commitment is attainable by all parties; 6) The Conservation Foundation holds the maintenance contract and executes it, with the by-laws of the HOA establishing the easement documentation and establishing the funding. The next Planning Commission Consortium meeting is scheduled for Thursday, January 24, 2008 at the Yorkville Library. The topic will be historic preservation. These properties may include wetlands, streams, hydric soils or other natural features that make them difficult to build on easily. As fewer and fewer of the"easier"pieces remain, developers are increasingly choosing to work with lands that have conservation value. In addition, more municipalities and county governments are wanting to protect the natural values of these properties in order to stave off flooding or poor water quality and to maintain the quality of life in the area. Conservation easements are being used more frequently in Illinois to protect the conservation values of properties while keeping them in private ownership. There are certain criteria that a property must meet in order to qualify for an easement, specified in Illinois' Real Property Conservation Rights Act(765 ILCS 120/0.01 et seq.). The Comprehensive Plan Citizen Advisory Committee will be meeting monthly, the third Thursday of each month, to discuss a chapter of the comprehensive plan. There will be two main meeting tasks at these monthly meetings, perform a SWOT Analysis and formulate Goals and Objectives which correspond to the meeting topic of that night. The Citizen Advisory Committee comprised of approximately 32 members will be split among 5 or 6 groups to complete these tasks. These groups will be guided through the meeting tasks by a meeting facilitator. The first meeting task is a SWOT Analysis. SWOT is an acronym which stands for Strengths, Weaknesses, Opportunities, and Threats. As a meeting facilitator your role is to guide the discussion to ensure that it is productive and each topic of the SWOT Analysis is covered in the allotted time. You will be provided with a large memo pad and marker to record the comments given by the committee members. Following this, the committee will reconvene as a whole to share each group's SWOT Analysis. Major themes from the SWOT Analysis will be used as a means of goal formulation. A GOAL is general language outlining a need or desire which compliments the overall intent and vision of the comprehensive plan. Following goal formulation by the whole committee, each group will be given 1-2 specific goals to develop objectives for. An OBJECTIVE is a specific task in order to implement or achieve a goal. In general, a goal is what the community hopes to accomplish through the comprehensive plan and an objective is the means of accomplishing it. As the meeting facilitator you will guide your group in developing objectives for each goal. When formulating objectives follow the SMART method, Specific, Measurable, Attainable, Realistic and Time dated. Along with each objective, an action plan will also be developed as an outline to achieve that specific objective. You may have multiple objectives for achieving one goal. The goals, objectives, and action plans will also be recorded by the meeting facilitator on the goals and objectives worksheet. This process will be done at each Citizen Advisory Committee meeting from now until late spring. Your participation will help make each meeting more organized, efficient, and productive. The responsibility of the facilitator is to the group and its work rather than to the individuals within the group. 3. Know the agenda and have a good understanding of the big picture. 4. Keep the group focused on the agenda item and task at hand. 5. Make sure that people's comments and ideas are properly recorded. 6. Encourage the expression of various viewpoints - the more important the decision, the more important it is to have all pertinent information (facts, feelings and opinions) on the table. 7. Make sure everyone has a chance to participate. Call on people who haven't spoken as much to give them an opportunity to address the issue. Notice who is confused, agitated or unhappy with the debate, and call on them to speak to the issue. 8. Suggest ways to look at problems and reach conclusions. Break big problems into workable pieces and look for minor points of agreement to help morale. 9. Periodically summarize what has happened, what has been resolved, and focus on identifying appropriate next steps. 10.
