Kurtzman, AICP SUBJECT: Zoning Variance Request Brighton Oaks II PC2006-90ZBA HEARING DATE: The City has received an application for a variance from the City's Zoning Code. A public hearing has been scheduled before the Zoning Board of Appeals to be held on Wednesday, January 3, 2007, at 7 :00 pm at the City's Council Chambers (located at 800 Game Farm Road). REQUEST: The applicant, Fox Valley View, Inc, owns approximately 37.5 acres located on the west side of Highpoint Drive, adjacent to and north of Middle Aux Sable Creek (Property Identification Number 05- 18-300-019). The legal description for the subject property is attached. This property is currently unincorporated and zoned A- 1 in Kendall County. The applicant has applied to annex to the City and as part of the application is seeking to rezone the property to R-2 (Low Density Residential) to subdivide the property into 54 lots. In conjunction with the request to rezone to R-2 the applicant is also seeking the following variance: 1 . Section 10-6C-4b — request to reduce the required setback from a side yard from 10 feet to 7.5 feet when a three-car garage is proposed, otherwise, the standard 10 foot side yard setback would apply. CONDITIONS: The surrounding properties are zoned and used as indicated below: Zoning Use North R-2 PUD Undeveloped Yorkwood Estates South Unincorporated R-2 Single-family detached housing (Hawthorne Village) East Unincorporated RPD-2 and A-1 Single-family detached housing (Brighton Oaks Estates) and Farmland West R-2 PUD and Unincorporated A-1 Undeveloped Yorkwood Estates and Farmland ZBA Brighton Oaks II — PC2006-90ZBA December 12, 2006 Page 2 of 2 STAFF COMMENTS : This request is somewhat unusual for the Zoning Board for a couple of reasons. First, the property is not currently annexed however, the petition for annexation is pending before the City. And second, most variances that the ZBA considers are for single lots, however, the applicant is seeking to have this variance applied to all lots within the proposed 54 lot subdivision. For these reasons the ZBA's recommendation will be forwarded to the City Council and, if deemed appropriate, will be incorporated into the annexation agreement and the subdivision plat. STANDARDS FOR GRANTING A VARIANCE: Section 10- 14-5(C) of the Municipal Code indicates that the Zoning Board of Appeals shall not vary (or make a recommendation to vary) the regulations of the Zoning Code unless it has made findings based upon the evidence presented to them for each specific case based upon the _ following: 1 . Because the particular physical surroundings, shape or topographical conditions of the specific property involved, a particular hardship to the owner would result, as distinguished from a mere inconvenience, if the strict letter of the regulations was carried out. 2. The conditions upon which the petition for a variation is based are unique to the property for which the variation is sought and are not applicable, generally, to other property within the same zoning classification. 3 . The alleged difficulty or hardship is caused by this Title and has not been created by any person presently having an interest in the property. 4. The granting of the variation will not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. 5. The proposed variation will not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion in the public streets, or increase the danger to the public safety, or substantially diminish or impair property values within the neighborhood. NEXT STEPS : Upon closing the hearing, staff requests that the Zoning Board of Appeals (ZBA) make findings based upon each of the standards listed above for each variance being sought. (Section 10- 14- 5(D) outlines occasions when the Zoning Board of Appeals may make a final decision. Subsection la indicates that the Zoning Board of Appeals may grant the variance if the variance is no greater than 25% of a setback standard. The variance to the side yard setback (reducing the setback from 10 feet to 7.5 feet) is reduction of 2.5 feet or 25%. As the variance is 25% of the required setback the ZBA's is normally final, however, as the property is not currently annexed, ZBA Brighton Oaks II — PC2006-90ZBA December 12, 2006 Page 3 of 3 the ZBA's action will be considered by the City Council, and if appropriate will be incorporated into the annexation agreement and will be listed on the subdivision plat. As you know, you make recommend to approve, deny or approve the request with conditions. Upon receipt the variance request will be forwarded to the Zoning Official for review and to coordinate setting a meeting date for the public hearing in front of the Zoning Board of Appeals. Kurtzman, AICP ��' ` SUBJECT: Request for Sign Variance PC 2006-99 (ZBA) 620 W. Veterans Pkwy HEARING DATE: A public hearing to consider the merits of the applicant's request has been scheduled for February 7, 2007, at 7:00 PM at the City Hall (800 Game Farm Road). REQUEST: The applicant, Randall Burggraf, as a tenant, has filed an application to: 1 . Allow a wall sign on a fagade that is not oriented to a public street, the main parking lot of the parcel, or a major access road (Section 8-11 -40b of the Municipal Code). The proposed sign would be located on the eastern fagade, which faces an access drive, directly overlooking a pond. Although the petition is filed by Randoll Burggraf, a tenant who is leasing two tenant spaces, Mr. Jim Ratos, owner of the property, has contacted staff and has verbally indicated a desire to have this variance extended to encompass all tenant spaces. CONDITIONS: A five (5) unit commercial strip center is being constructed on this B-2 zoned with the front of the building facing west. Although this building is being constructed as a five (5) unit building there are only three tenants proposed for the initial build out (two tenants are each leasing two tenant spaces). These five areas are: 1 . consider any unique physical property of the land involved, 2. the available locations for adequate signing on the property, 3 . the effect of the proposed sign on pedestrian and motor traffic, 4. the cost to the applicant of complying with this chapter as opposed to the detriment, if any, to the public from the granting of the variance, and 5. general intent of this chapter. NEXT STEPS: After closing the public hearing no further testimony or information is to be presented to the Zoning Board of Appeals. The Board should review the Findings of Facts for each requested variance (see above) and then motions can be made. The Board's motion(s) can be to accept the variance, denyr the variances or to accept the variances with conditions. All the requested variances are variances to the Sign Code.
