Roll Call Roll call was taken and a quorum was established. Previous Meeting Minutes July 10, 2013 The minutes were approved on a motion and second by Baker and Jones, respectively. Voice vote approval. Citizen's Comments None Public Hearings 1. 2013-08 Midland States Bank, Petitioner, has filed an application with the United City of Yorkville, Kendall County, Illinois, requesting an authorization within the B-2 General Business District for the purpose of remodeling an existing structure as a new bank establishment with drive- through facilities as allowed by Special Use Permit in Section 10-7C-2, Section 10-7B-2 and Section 10-7A-2 of the United City of Yorkville City 1 Code. The real property consists of approximately 0.516 acres,located at the southeast corner of W. Countryside Parkway and E. Kendall Drive in Yorkville, Illinois. On a motion by Weaver and second by Baker, the Public Hearing was opened at approximately 7:01pm. Chairman Lindblom swore in those who would speak. The Hearing concluded at approximately 7:04pm on a motion by Jones and second by Prochaska. (It was requested that the responses to the Special Use should become part of the official record). (See Court Reporter's transcript) 2. PC2013-10 Mr. Pete Occhipinti, Petitioner and Owner, has filed an application with the United City of Yorkville,Kendall County,Illinois requesting that after annexation to the United City of Yorkville of its property in unincorporated Kendall County and zoned in the County's R-3 One-Family Residence District, that the property be zoned into the United City of Yorkville's R-4 General Residence District. The subject property consists of approximately 0.87 acres east of Illinois Route 47,immediately south of McHugh Road and just west of Farmstead Drive. The Public Hearing was opened at approximately 7:05pm on a motion by Prochaska and second by Jones. Chairman Lindblom swore in those who would speak. The Hearing concluded at approximately 7:24pm on a motion by Weaver and second by Jones. Voice vote approval. It was requested that the Special Use Standards for Rezoning and Petition of opposition should become part of the permanent record). (See Court Reporter's transcript) Old Business None New Business 1. PC 2013-08 Midland States Bank(see description for#1 under Public Hearings above) Commissioner Jones commented that he assumed the bank had done their due diligence regarding adequate business since this bank is situated directly next to an existing bank. Mr. Baker inquired if all right-of-ways, traffic flow, etc. had been cleared. Mr. Prochaska noted that the egress is not directly onto Countryside Parkway. Action Item Special Use Motion by Commissioner Weaver: In consideration of testimony presented during a Public Hearing on August 14, 2013 and discussions conducted at that meeting, the Plan Commission recommends approval to the City Council a request for Special Use authorization within the B-2 General Business District for the purpose of remodeling an existing structure as a new bank establishment with drive-through facilities, as proposed by Midland States Bank, as submitted in an application dated June 4, 2013, subject to any 2 final recommendations from staff. Commissioner Jones seconded this motion. Roll Call: Jones-yes, Baker-yes, Prochaska-yes, Weaver-yes, Lindblom-yes. Passed 5-0. 2. PC 2013-10(See description for#2 under Public Hearings) Action Item Special Use Motion: Commissioner Baker made the following motion: In consideration of testimony presented during a Public Hearing on August 14, 2013 and discussions conducted at that meeting, the Plan Commission recommends approval to the City Council of a request rezoning of the subject property upon annexation to within the R-4 General Residence District, as proposed by Peter Occhipinti, as submitted in an application dated June 20, 2013, subject to recommendations in Staff's memorandum dated August 8, 2013 and further subject to staff comments. Commissioner Jones seconded the motion. Discussion: Mr. Jones said the traffic on McHugh is already heavy and he does not approve of townhomes in this area. Commissioner Prochaska agreed adding that it would start a precedent and he also cited previous history of the area. Roll call: Jones-no, Baker-no, Prochaska-no, Weaver-no, Lindblom-no. Motion defeated 5-0. 3. PC 2013-13 John and Michelle Stewart, Petitioners, have filed an application with the United City of Yorkville requesting Final Plat approval for the Yorkville Christian School Subdivision which resubdivides Lot 358 in Unit I of the former Prestwick of Yorkville Subdivision for the purpose of constructing a new private high school with accessory uses. The property consists of approximately 110.54 acres and is located immediately south of Illinois Route 126(E. Schoolhouse Road) and west of Ashley Road in Yorkville, Illinois. Attorney John Philipchuck spoke on behalf of the Petitioners. Also present was Dave Schultz of HR Green Engineering. They were requesting approval of the final plat. There will be 84 single family lots eliminated as part of the resubdivision and this request will go before the City Council with amendments. All roadways in the subdivision will be kept the same. They have met with IDOT on Rt. 126 concerns and a traffic impact study will be done. Ms. Barksdale-Noble said staff had questioned 3 items and those items have been addressed in a memo. Motion: Mr. Prochaska made the following motion.....in consideration of the proposed Final Plat of Subdivision for the Yorkville Christian School Subdivision, the Plan Commission recommends approval to the City Council of a request for Final Plat approval, as presented by the Petitioner in a plan prepared by HR Green date last revised August 6, 2013, subject to review comments prepared by the City's Engineering Consultant, EEI, in a letter dated July 23, 2013 as stated in a staff recommendation provided in a memorandum dated August 8, 2013 and further subject to City Council approval of the amended annexation agreement allowing a school and accessory structures as a permitted land use in the Prestwick of Yorkville subdivision. Mr. Jones seconded the motion. 3 Attorney George Mahoney of Oswego was present on behalf of the Block family who owns property adjoining the tract. He said his client had 4 issues. The first issue is stormwater management has not fully been addressed and it has already caused problems on his client's property. The plat of subdivision shows the east half of the 31 acres being a mostly paved area with no provisions for additional stormwater management. Issue 2 relates to tract and he referred to the original annexation agreement from 2005. That agreement referred to Ashley Rd as a rural street with no improvements at Rt. 126. Now, a projected 800 students would use this intersection without a traffic study addressing safety for ingress/egress to this property. The third and fourth issues relate to use of the property. He said a cell tower and wind turbine are proposed for the site and these are not reflected on the plat presented to the Commission. He added that an equestrian facility is also proposed for horses on the site. He also addressed building height issues. He said the Commission needs to ascertain if the requests conform to the ordinances. He suggested further discussion and engineering considerations. Attorney Philipchuck addressed these concerns. He said he is presenting the ideas to the Commission at this meeting and would return with applicable requests. These requests are not before the Commission tonight,just the Final Plat, he said. There has been a meeting with IDOT and it is recognized that improvements are needed. He asked for approval for the Final Plat. Ms. Barksdale-Noble said a Public Hearing is scheduled for August 27th before City Council to address the amended annexation agreement that will consider the items Mr. Mahoney discussed. Mr. Baker said this is the first private school request and wonders how inspections are handled. Ms. Barksdale-Noble said the City will conduct inspections and they are comfortable with the standards being used. Chairman Lindblom said the Fire Protection District has already received plans and they are being reviewed. Stormwater and land use has to be approved by the City, commented Mr. Schultz. He said there will be less runoff than if the additional homes were to be built. Mr. Prochaska asked for confirmation on the following: that the R-2 footprint must remain the same, they have an annexation agreement that is current,but can be amended and all other restrictions will apply. Ms. Barksdale-Noble confirmed this would be the case unless unless other requests are made. Action Item Final Plat Roll Call: Jones-yes, Baker-yes, Prochaska-yes, Weaver-yes, Lindblom-yes. Passed 5-0. Additional Business 1. City Council Action Updates 4 a. PC 2013-05 Priority Health and Body Makeover—Annexation & Rezoning The request was presented at City Council, however, the ordinances were not in the packet due to revisions and this will be rescheduled to August 27th. An update will be given after that time. 2. IDOT—IL Route 47 Update a. Oral Report from City Engineer Engineer Julie Morrison reported that work is being done south of the river with storm sewer being installed. Utility work is being done at night. Mr. Baker asked why the stoplight is still functioning at Van Emmon since it is closed both ways and backing up traffic. Ms. Morrison said she would check. Mr. Prochaska also noted that during the night work, Rt. 47 is sometimes closed with no notice, also blocking traffic. Turnarounds are being made on Rte. 47. No more night work is scheduled at this time, however, Ms. Morrison will make mention of this. Ms. Barksdale-Noble noted that she updates the website each month regarding Rt. 47. Ms. Barksdale-Noble also reported that Game Farm improvement bids will be let in September 2014 and acquisitions are now being conducted. The Rt. 47 parking lot contract was awarded at the June 25th Council meeting and work is to begin in August. A meeting attendee asked if the August 27th meeting would still go forward regarding the PC 2013-10 case at 1100 McHugh Road for annexation agreement. Ms. Noble said that tonight was just rezoning but the August 27th meeting will go forward. Adi ournment Prochaska move to adjourn and Baker seconded. Meeting adjourned at 8:03pm. My name is Tom 9 Lilla and I live at 649 Heartland Drive , and I 10 wanted to start by saying thanks for allowing an I i 12 opportunity to speak . 12 My name is Tom Lilla and I am here 13 to speak on behalf of myself , my family , and my 14 neighbors in Heartland Subdivision . 15 My family chose Yorkville and 16 specifically Heartland because of its great 17 location , safe environment , family friendly 18 atmosphere , and it was kind of a - - for us it was 19 kind of a dream come true . 20 Now we are able to provide our 21 children the best quality of life , best 22 neighborhood , best town , and we fell in love with 23 this place and quickly decided this was going to 24 be our community and it was going to be where we Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 11 1 raise our family and call home for many years to 2 come . i 3 The reason that we all came here i 4 tonight is because we have some serious concerns 5 regarding for the petition before the City to 6 annex 1100 McHugh Road and we wanted to address i 7 them here publicly , and as it ' s written , this 8 current petition is requesting annexation and 9 rezoning to R - 4 for future multi - family 10 development . 11 Now , we realize that multi - family 12 homes have a place in the community and not I 13 everyone ' s job , family or economic situation is I 14 conducive to single - family home or home ownership 15 and in these situations multi - family residences , 16 you know , can be a sensible living choice . 17 Our concern is this particular 18 location . The property is surrounded by 19 single - family homes on all sides , and permitting I 20 anything other than a single - family home here i 21 would undoubtedly have a negative effect on our i 22 community ' s schools , property values , and the 23 general harmony of our neighborhood . 24 Yorkville currently has multi - family Vitosh Reporting Service 815 . 993 . 2832 cros . vitosh @gmail . com 12 1 residences just to the west of Heartland , and 2 since these buildings were developed , our area 3 has seen an increase in automobile break - ins and 4 other petty crime . i 5 To keep it short , we all agree that 6 multi - family homes have no place in our 7 neighborhood , so we would ask that the Plan 8 Commission please consider the effects on our I 9 community and focus on long - term effects versus 10 the short - term when making the decision . j i i 11 Please consider our schools , our i 12 safety , and our children ' s safety . One 13 responsibility of the Commission is to preserve , 14 protect and strengthen our city ' s neighborhoods , i i 15 and so we came here tonight because we want to 16 express our view , and it ' s very simple : Anything 17 other than a single - family home would be highly 18 inappropriate for this location , so we ask the 19 Commission please understand our viewpoint and 20 reject the proposal to annex 1100 McHugh Road as 21 it ' s written . 22 Please remember this decision 23 affects more than just one plot of land , it 24 affects the place that many of us call home . My name 11 is Richard Schroeder , I live at 683 Heartland 12 Drive , and my property is the property that most 13 directly borders the property that ' s under i 14 consideration . My entire back yard borders on i 15 this property . And my concern is f 16 I don t kn i i i 17 any of you were here in 2007 , I believe this I 18 property was also under consideration . At that 19 time they wanted to make an office - - put an 20 office building back there and that was rejected , 21 and I think very wisely . i 22 As Tom has said , this area is an 23 area of single - family homes and I believe it 24 should stay an area of single - family homes . I see eight - foot - tall weeds . Just I 4 as we were coming to the meeting tonight , I saw 5 the chickens that were running in front of the 6 Heartland Subdivision sign that are kept by the 7 renter currently there . 8 I came home one night last year from I 9 work to see what I thought was my back yard on i 10 fire , it wasn ' t quite on fire , but the renter had 11 set the weeds on fire because , well , I guess he 12 didn ' t want to cut them , and my lawn was 13 smoldering a little at the edges , I had to stamp 14 it out 15 So I guess my concern is if this 16 gentleman cannot control his one renter , what ' s 17 going to happen when he has multiple renters in 18 there ? 19 I don ' t think he ' s been a very good 20 steward of this property and I don ' t see where 21 that ' s going to change in the future .
