STATE OF ILLINOIS ) `-' )ss COUNTY OF KENDALL ) RESOLUTION 01-aL— RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN THE INTERGOVERNMENTAL AGREEMENT WITH KENDALL COUNTY WITH REGARD TO ROUTE 47 AND CANNONBALL TRAIL IMPROVEMENTS WHEREAS,the City of Yorkville and County ofKendall have entered into negotiations with regard to an Intergovernmental Agreement concerning the installation of overhead lighting at the intersection of Illinois Route 47 and Cannonball Trail; and WHEREAS, the County has agreed to pay one-half(1/2) of the installation costs for the overhead lighting at said intersection, not to exceed Five Thousand Dollars($5,000.00); and WHEREAS,the City has agreed to pay all electrical and maintenance costs for the operation of traffic signals and overhead lighting at the intersection; and WHEREAS, an Agreement has been prepared and is attached hereto as Exhibit"A'; and WHEREAS,the Mayor and City Council deem it to be in the best interest of the City to enter into this Intergovernmental Agreement with Kendall County; NOW THEREFORE BE IT RESOLVED BY THE UNITED CITY OF YORKVILLE,upon motion duly made, seconded, and approved by a majority of those Alderman voting,that the Mayor and City Clerk are hereby authorized to sign the attached Intergovernmental Agreement with the County of Kendall. Bridge Street Yorkville, Illinois 60560 630.553.9500 STATE OF ILLINOIS ) May 31, 2001 �-' )ss COUNTY OF KENDALL ) INTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF KENDALL AND THE UNITED CITY OF YORKVILLE FOR TRAFFIC SIGNAL & OVERHEAD LIGHTING IMPROVEMENTS AND MAINTENANCE AT THE INTERSECTION OF ILLINOIS ROUTE 47 AND CANNONBALL TRAIL THIS AGREEMENT is made this 1L day of of 2001, between the UNITED CITY OF YORKVILLE,hereinafter referred to as the"CITY",and KENDALL COUNTY, hereinafter referred to as the "COUNTY". WHEREAS, the Illinois Constitution provides that units of local government may contract to share services and perform capital improvements through intergovernmental agreements, 111. Const., Art. VII Sec. 10 (1970); and WHEREAS, Illinois statutes provide that public agencies may share power through intergovernmental agreements, (5 ILCS 220/1 et. seq.); and WHEREAS,the CITY is a unit of local government,Ill.Const.,Art.VII,Sec. 1,and a public agency, (5 ILCS 220/1) and the COUNTY is a unit of local government, Ill. Const. Art. VII, Sec. 1, and a public agency, (5 ILCS 220/1); and WHEREAS, the COUNTY and the CITY anticipate that the intersection of Illinois Route 47 and Cannonball Trail will need to be signalized in the near future; and WHEREAS, the COUNTY and the CITY agree that overhead lighting will need to be installed at the intersection for safety purposes; and Page 1 of 3 = r WHEREAS, after the intersection is signalized and the overhead lighting is installed,there u will be electrical and maintenance costs for the signals and overhead lighting; and WHEREAS, the COUNTY agrees to pay one-half (%2) of the installation costs for the overhead lighting at said intersection, not to exceed Five Thousand Dollars($5,000.00); and WHEREAS, the CITY agrees, that in exchange for the payment of one-half(%2) of the overhead lighting costs by the COUNTY,the CITY will assume all maintenance and electrical costs that would otherwise be required of he COUNTY for said traffic signal and street lighting into perpetuity; and NOW THEREFORE, in consideration of the mutual covenants contained herein the CITY and the COUNTY agree as follows: 1. That the COUNTY agrees to pay one-half(1/2) of the installation costs for overhead lighting at the intersection of Illinois Route 47 and Cannonball Trail,but said amount shall not exceed Five Thousand Dollars($5,000.00). 2. A. That the CITY shall pay all electrical and maintenance costs only for the operation of traffic signals and the overhead lighting at said intersection. B. In the event future improvements are required at the intersection of i Cannonball and Route 47,which may include work related to traffic signals and street lighting, the allocation of said costs shall be negotiated between the parties. 3. The terms and conditions of this Agreement may be amended only in writing with approval of both the CITY and the COUNTY. 4. This agreement shall be construed in accordance with the law and Constitution of the Page 2 of 3 State of Illinois and if any provision is invalid for any reason such invalidation shall not render invalid other provisions which can be given effect without the invalid provision. IN WITNESS WHEREOF,the undersigned duly authorized representatives ofthe CITY and the COUNTY have caused this Agreement to be executed.
