RESOLUTION AUTHORIZING EXECUTION OF AN
INTERGOVERNMENTAL AGREEMENT BETWEEN
THE UNITED CITY OF YORKVILLE AND THE COUNTY OF KENDALL
AS TO THE CITY'S ENFORCEMENT OF
TRUCK AND COMMERCIAL VEHICLE
WHEEL AND AXLE LOADS AND GROSS WEIGHTS
ON COUNTY HIGHWAYS WITHIN THE CITY LIMITS
WHEREAS,the United City of Yorkville(hereinafter referred to as"City")and the County
of Kendall(hereinafter referred to as"County")desire to enter into an Intergovernmental Agreement,
a copy of which is attached hereto as Exhibit"A", with regard to the City enforcing its truck and
commercial vehicle wheel and axle loads and gross weights restrictions on County highways within
the City limits of the United City of Yorkville; and
WHEREAS,the City Council,Mayor and the Chief of Police believe that such enforcement
is necessary for the safety of the citizens of the City and to protect the City's roads that connect to
the County's highways from deterioration by motor vehicle usage in excess of permitted weights;
and
WHEREAS,the County agrees that the City is entitled to the proceeds of any fines collected
from the enforcement of the restrictions on its highways; and

WHEREAS,the fines and penalties recovered from violators will cover the City's costs and
expenses of the enforcement efforts and inure to the benefit of the United City of Yorkville;
NOW THEREFORE BE IT RESOLVED BY THE UNITED CITY OF YORKVILLE,upon
motion duly made,seconded,and approved by a majority of those Alderman voting,that the Mayor
and City Clerk are authorized to execute the Intergovernmental Agreement with the County of
Kendall concerning overweight trucks and commercial vehicles on County highways within the City
limits of the United City of Yorkville.
