RESOLUTION 01-
RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO
SIGN THE INTERGOVERNMENTAL AGREEMENT WITH BRISTOL
TOWNSHIP, THE BRISTOL TOWNSHIP HIGHWAY COMMISSIONER
AND MENARD'S, INC.,AS TO THE INSTALLATION AND MAINTENANCE
{ OF A STORM SEWER LINE IN THE TOWNSHIP RIGHT OF WAY ON EAST
LEXINGTON DRIVE AND IN THE DRAINAGE EASEMENT ON LOTS 11 AND 12 IN
BLACKBERRY CREEK SUBDIVISION IN BRISTOL TOWNSHIP,KENDALL
COUNTY, ILLINOIS
WHEREAS, the United City of Yorkville,Bristol Township,the Bristol Township Highway
Commissioner and Menard's, Inc., have entered into negotiations with regard to an
Intergovernmental Agreement concerning the installation and maintenance of a storm sewer line from
the Menard's, Inc., property in the United City of Yorkville across the Township's right of way on
East Lexington Drive in Bristol Township and then across the Township's drainage easement across
Lots 11 and 12 of the Blackberry Creek Subdivision; and
WHEREAS, Menard's, Inc., has agreed to construct the storm sewer line in the Township
right of way to the plans and specifications approved by the City, the Township and the Township
Highway Commissioner; and
WIIEREAS,the City has agreed that once the storm sewer line is installed and all restoration
work is completed, that it would be responsible for future maintenance costs related to the storm

sewer line on the Bristol Township right of way; and
WHEREAS, an Agreement has been prepared and is attached hereto as Exhibit "A"; and
WHEREAS,the Mayor and City Council deem it to be in the best interest of the City to enter
into this Agreement with the parties hereto;
NOW THEREFORE BE IT RESOLVED BY THE UNITED CITY OF YORKVILLE,upon
motion duly made, seconded, and approved by a majority of those Alderman voting,that the Mayor
and City Clerk are hereby authorized to sign the attached Intergovernmental Agreement with Bristol
Township, the Bristol Township Highway Commissioner and Menard's, Inc.
