CCSb\- RESOLUTION OF INTENT CONSTRUCTON OF TRAFFIC SIGNALS AT US ROUTE 34 AND GAME FARM ROAD INTERSECTION WHEREAS, the city of Yorkville of Kendall County, Illinois, hereinafter called the CITY, and the State of Illinois, through its Department of Transportation, hereinafter called the STATE, are desirous of constructing traffic signals at the intersection of U.S. Route 34 and Game Farm Road, herein identified under U.S. Route 34 (FAP 591), State Section 131 (see location map attached hereto as Exhibit 1). WHEREAS, STATE participation in the funding of the subject project is contingent upon the CITY and STATE mutually approving and executing a related formal city-state agreement by June 1,2 002 so to assure the securing of STATE's fiscal year 2002 program funds available for the said project. The provisions of this resolution and pending formal agreement relating to the traffic signals at U.S. Route 34 and Game Farm Road shall be null and void in the event the said formal agreement is not mutually executed by the STATE and CITY by June 1, 2002. WHEREAS, due to time restraints in securing STATE fiscal year 2002 funds, installation of the said traffic signals will not include any acquisition of additional rights of way, as purchasing of property could risk delays in the award of a contract within a suitable timeframe. Construction cost for the proposed conventional traffic signals at the three-legged intersection is estimated to be $120,000. Share of responsibility to implementing and funding the said project will be as follows: WHEREAS, the CITY will: A. Make the surveys, prepare plans, receive bids, award the contract and furnish engineering supervision �-' during construction of the traffic signals. (All preliminary and construction engineering required will be at 100 percent CITY cost.) B. Provide plans and obtain plan approval from the Illinois Department of Transportation, District 3 office in Ottawa, Illinois, prior to advertising of the project. C. Assume 6.6 percent of the construction costs for the said traffic signals and required pavement markings. D. Assume 100 percent of the construction costs for any optional items exceeding conventional traffic signals and required pavement markings. (i.e., roadway lighting, preemption emergency vehicle actuators, special landscaping, etc.). E. Pay all construction costs subject to reimbursement by the STATE, as hereinafter stipulated. WHEREAS, the STATE will: A. Reimburse the CITY for 93.4 percent of the construction cost for conventional traffic signals and required pavement markings. Upon award of a contract, the STATE will pay the CITY 90 percent of its obligation incurred. The balance of payment due to the CITY will be made upon completion of the project based on final bid unit prices and quantities of the awarded contract. B. Not participate in any cost of optional pay items beyond those required for conventional traffic signal and required pavement markings. a ' NOW, THEREFORE, BE IT RESOLVED, in consideration of the above, the State of Illinois is hereby notified '-y the action taken on this resolution that the city of Yorkville, Kendall County, Illinois agrees to the terms stated herein and intends to later enter into a formal joint agreement with the State of Illinois to accomplish the above described project.. The state's participation is contingent upon the city of Yorkville assuming all related engineering responsibilities and cost, and that the project does not include any right of way acquisition. Enclosed for your review and execution by the Yorkville City Council are four copies of a Resolution of Intent outlining the general terms, responsibilities and costs relating to the subject project. This resolution serves as a prelude to a formal joint city-state agreement. The purpose of an executed resolution is to confirm the city's commitment to the project and subsequently the programming of state funds for the traffic signals. If you and the City Council approve of the terms of the resolution, please make certain two of the four copies are properly executed and returned to the IDOT District 3 office, each with the necessary original signatures and certification. Upon receipt of the approved resolution, state funds will be secured for the project and this office will proceed with the drafting of a formal city-state agreement. Execution of an agreement will be needed for the state to reimburse the city for IDOT's share of the project.
