RESOLUTION NO. 2000
RESOLUTION APPROVING SPECIAL USE PERMIT
FOR PRIVATE SEWAGE DISPOSAL SYSTEM
WHEREAS the Applicant, LAWRENCE GARDNER, an agent of the record title owner
of Lot 1 of Conover's First Subdivision in the United City of Yorkville, has filed an application
with the City Clerk requesting permission pursuant to Title 7 Chapter 6 Section 3 of the
Municipal Code of the United City of Yorkville to install a private sewage disposal system; and
WHEREAS the Applicant has appeared before the Yorkville Plan Commission as required
pursuant to Title 7, Chapter 6, Section 3 (B) of the Yorkville City Code; and
WHEREAS the City Council has carefully reviewed the application and the minutes of the
Plan Commission meeting and has made the following findings of fact:
1. That the subject real property is zoned R 1 Single Family but has an area in excess
of one acre.
2. There is no city sanitary sewer line within 250 feet of the subject real property.
3. That the Petitioner has properly applied for the special use permit and has
appeared before the Yorkville Plan Commission.

NOW THEREFORE, upon motion duly made, seconded and approved by a majority of
�-' those voting, said special use permit as above requested is hereby granted subject to the following
terms and conditions:
1. The Applicant pays all necessary fees pursuant to code.
2. The building inspector is allowed to inspect the work at any stage of construction.
3. The Applicant notifies the building inspector when the work is ready for final
inspection and before any underground portions are covered.
4. The construction specifications comply with the State of Illinois Private Sewage
Disposal Licensing Act and Code and with the State of Illinois Environmental
Protection Agency.
5. The owner of the system complies with all state, county and municipal laws
applicable to operation of a private sewage system. The owner shall operate and
maintain the private sewage system in a sanitary manner and at no expense to the
City.
6. At such time as a public sewer becomes available to this property, and upon failure
of the proposed septic as determined by the building inspector, a direct connection
shall be made to the public sewer in compliance with Title 7, Chapter 6 of the City
Code within Ninety(90) days.
