Resolution 1998-11 J STATE OF ILLINOIS ) COUNTY OF KENDALL ) RESOLUTION RECOMMENDING APPROVAL OF AURORA BLACKTOP SPECIAL USE REQUEST WHEREAS, the City Council and City Plan Commission of the United City of Yorkville have considered the Petition of Aurora Blacktop to expand its Special Use Permit for operation of an asphalt plant within one and one-half(1 1/2) miles of the United City of Yorkville at its current location; and WHEREAS, by affirmative vote of a majority of those members sitting of the Plan Commission and the City Council, the United City of Yorkville has recommended approval of the expanded Special Use for the installation of a new asphalt plant at its current real property site in Kendall County, Illinois, located within one and one-half(1 1/2) miles of the corporate limits of the United City of Yorkville; and WHEREAS, the City Council of the United City of Yorkville has recommended that the County Board of Kendall County include in the Special Use Permit, a condition setting a time that the existing asphalt plant would be taken out of production, so that the existing plant is not sold off and continue to be used on site at the same time the new plant is operating except by its current owners; WHEREAS, the Aurora Blacktop facility is located within the United City of Yorkville's -1- one and one-half mile (1 1/2)planning area, the City Council requests as part of its recommendation that Aurora Blacktop enter into an Annexation Agreement now with the United City of Yorkville; NOW THEREFORE upon Motion duly made, seconded, and approved, the United City of Yorkville recommends to the County of Kendall as follows: 1. That the Kendall County Board approve the request for Special Use Permit expansion by Aurora Blacktop to install a new asphalt plant at its current real property location. 2. That the County of Kendall in its Special Use Permit set a reasonable deadline for the termination of the existence of the current plant, fixed by a certain number of years or months as deemed acceptable by the County of Kendall,but in no event to be operated as a separate plant by a separate owner in regard to the old existing asphalt plant.
