Resolution 1998-13 State of Illinois ) ss County of Kendall ) RESOLUTION N0. 98- RESOLUTION REQUIRING DEVELOPMENT DEPOSIT WHEREAS, THE UNITED CITY OF YORKVILLE is experiencing substantial growth, which requires it to retain various consultants, and dedicating large amounts of staff time to the consideration of petitions filed for annexation,platting,rezoning, and development of real property both within and without THE UNITED CITY OF YORKVILLE ; and WHEREAS, THE UNITED CITY OF YORKVILLE is called upon from time to time to advance funds to those consultants prior to the payment of fees from the Petitioners to the City; and WHEREAS,at times projects are withdrawn from consideration at the request of Petitioners, or take a substantial amount of time to come to Fruition, and the City is being required to advance funds without reimbursement for substantial periods of time; and WHEREAS,the Mayor and City Council of THE UNITED CITY OF YORKVILLE deem it to be in the best interest of its Citizens and to provide for balancing its budget to have deposit on hand from Petitioners so that advances can be made to consultants and for payment of staff time as provided various Ordinances of the City, without becoming a burden on the current tax payers of THE UNITED CITY OF YORKVILLE; NOW THEREFORE, THE UNITED CITY OF YORKVILLE shall hereby require the following deposits to be paid to THE UNITED CITY OF YORKVILLE prior to the commencement of annexation,preliminary plat applications being considered, or the time of filing of petitions for rezoning, variances, or special uses according to the following schedules: 1. That Petitioners shall be required to deposit the following sums based upon acre set out below: Less than 2 acres $1,000.00 2 to 10 acres $2,500.00 Parcel greater than 10 acres $5,000.00 2. That the City Administrator shall have discretion to require a lesser deposit than the amount set out in paragraph 1 in this Resolution if in fact the City Administrator determines that the fees for outside consultants or staff review will be substantially less than the deposit set out above requires. 3. This deposit will be utilized to assure that the Petitioners payment to all consultants and staff as provided in City Ordinances shall be timely paid. The Petitioner will be billed monthly for services rendered by the City or its consultants, and all disbursements from this account shall be itemized to the Petitioner depositing the same. 4. In the event that the deposit is depleted from monthly billings to a sum of 10% or less of the original deposit, the City Administrator shall request an additional deposit for the reasonably expected sums to be incurred on such projects, unless in the City Administrator's descression he believes that the remaining balance is sufficient to satisfy any future consultation or staff billing needs.
