RESOLUTION APPROVING THE OPERATION OF
THE SALVATION ARMY GOLDEN DINER'S NUTRITION PROGRAM
Whereas, THE SALVATION ARMY Golden Diner's program has been operating at THE
CITY OF YORKVILLE'S Beecher Community Center for a number of years, and
Whereas, this program provides a valuable service to the community, and
Whereas, THE SALVATION ARMY would like to operate this program again for the
upcoming year.
Now, therefore be it resolved that THE CITY OF YORKVILLE accept the operation of
THE SALVATION ARMY'S GOLDEN DINER'S PROGRAM at THE CITY OF
YORKVILLE'S Beecher Community Center and authorize the Mayor and City Clerk to execute
the memorandum of agreement with THE SALVATION ARMY for their Golden Diner's
Program to extend this service through September 30, 1998.

MEMORANDUM OF AGREEMENT
BETWEEN
THE SALVATION ARMY GOLDEN DINER' S PROGRAM
AND
THE UNITED CITY OF YORKVILLE
Agreement is made this October 1 , 1997 , by and between THE SALVATION
ARMY GOLDEN DINER PROGRAM, having its offices at 705 East State Street .
Geneva, IL 60134 , hereinafter designated as the "PROGRAM" and THE UNITED
CITY OF THE VILLAGE OF YORKVILLE ,. hereinafter designated as the
"COMPANY" .
In consideration of the mutual promises and covenants herein, the
COMPANY and the PROGRAM agree as follows :
1 . _RENTAL FEE:_ COMPANY agrees to provide space to the PROGRAM
( at no charge ) which shall include kitchen, the Austin Room including
dining area, table and chairs , and office space . COMPANY further agrees
to allow PROGRAM employees and agents access to washroom facilities and
ingress and egress to and from space provided .
2 . AGREEMENT TERM: The term of this Agreement shall commence this
1st Day of October , 1997 , and shall terminate the 30th Day of September ,
1993 , or pursuant to the provision of paragraph 5 of this agreement .
3 . _PURPOSE OF AGREEMENT_ The purpose of this Agreement is for the
preparing and serving of hot meals to any senior citizen and for the
purpose of educational and recreational programs to such senior
citizens . PROGRAM reserves the right to refuse service to any
individual .
4 . HOURS_ OF AGREEMENT_ The Austin Room shall be made available to
PROGRAM during the hours of 9 : 00 a . m. to 2 : 00 p.m. , Monday through and
including Friday, except Holidays . The Kitchen will be made available
to PROGRAM during the hours of 8 : 30 a. m. to 2 : 30 p . m. , Monday through
and including Friday. The above facilities , as well as remainina areas
of the building may be used by PROGRAM at the discretion of the Beecher
Building Coordinator , so long as it does not interfere with the use of
the remaining portion of the Beecher Center should the City of Yorkville
by necessity schedule a city function at a conflicting time .
5 . TE_RMINATI.ON OF _AGREEMENT: It is agreed that this Aareement is
for a period of one ( 1 ) year . It is further agreed that this Aareement
may be terminated upon_ thirty ( 301 days written notice by either the
PROGRAM or the COMPANY .
6 . MA_INTENANCE_, REPAIRS_LAND UTILITIES:_ It is mutually agreed upon
that the PROGRAM shall be responsible for a portion of the maintenance
costs , at the rate of $20 . 00 per month. It is also agreed that the
COMPANY shall be responsible for all costs of repairs both structural
and non-structural and utility costs , except as to appliances , fixtures ,
or personal property owned, leased of or controlled by the PROGRAM which
shall be the sole responsibility of the PROGRAM. The PROGRAM shall be
responsible for cleaning up the areas used by it after its ' use .

? . PERSONAL PROPE_RTY;_ It is mutually agreed that a written
inventory be taken of any items or equipment belonaina to the YORKVILLE-
BEECHER BUILDING and shall remain the property of the COMPANY and may
not be removed by the PROGRAM upon termination of the Aareement . Ar_v_
items or equipment belonging to the PROGRAM may be removed upon said
termination.
8 . INSU_R_ANCE_ The PROGRAM covenants and agrees to protect and
save harmless the company from anv and all claims for injuries to
persons or property by reason of any accident or happening which was due
to the fault of the PROGRAM, its Employees or Agents . The PROGRAM
agrees to obtain public liability insurance in the amount of $500 , 000 .
9 . SIGNS: PROGRAM may place upon the premises at its own expense
both exterior and interior signs on the building with the prior
authority of the COMPANY provided, however , that the PROGRAM shall not
cause damage to the premises or the building when placing such signs on
the premises or building and such signs shall be in compliance with all
governmental regulations .
10 . COUNTY HEALTH REGULATIONS_ It is agreed the COMPANY will
insure that the facilities are kept up to the standards set by the
Countv Health and Safety Regulations including slip-retardant surfaces
on all applicable indoor and outdoor walkways and stairs, zoning ,
heating, ventilation, water supply, sewage and waste . Provide
professional pest control services . The COMPANY shall provide the
PROGRAM with copies of Health Inspections , Sanitation Inspections and
Fire Inspections .
11 . The building in which our Site operates is regularly inspected
by the local authorities ____ ves no .
Evidence of these inspections are exhibited in the proper places

IN WITNESS WHEREOF , the PROGRAM and these presents to be signed by
its duly authorized officers , and the COMPANY has caused it hand and
seal to be affixed ;Ln DUPLICATE .
