RESOLUTION AUTHORIZING SALE OF
SURPLUS REAL PROPERTY
WHEREAS, the Mayor and City Council of THE UNITED CITY OF THE VILLAGE
OF YORKVILLE have determined it to be in the best interest of the City, and an adjoining
owner to sell certain surplus real estate; and
WHEREAS, the subject real property is located in an area which a driveway exists upon
adjacent to City owned Park property; and the conveying of the underlying tract would adjust
boundary lines between the adjoining owner and City to the satisfaction of all parties; and
WHEREAS, THE UNITED CITY OF THE VILLAGE OF YORKVILLE has fully
compiled with those provisions of 65 ILCS 5/11-76-4.1 of Illinois Compiled Statutes in obtaining
an MAI appraisal; and
WHEREAS, the fair market value of the subject real property has been determined by said
MAI or other written appraisal to be Four Thousand & 00/00 Dollars ($4,000.00); and
WHEREAS, the adjoining owner, HOLMAN F. HORTON, has submitted an offer to
purchase said adjoining real property for the sum of Four Thousand & 00/00 Dollars ($4,000.00)
which represents 100% of the value as appraised, and in addition thereto to pay the cost of
appraisal and expenses associated with said sale:
NOW THEREFORE, the Mayor and City Council of THE UNITED CITY OF THE
VILLAGE OF YORKVILLE upon motion duly made, seconded, and approved by a two-thirds
majority of those holding office has consented to and approved the acceptance of the offer to

purchase for 100% of its appraised value together with payment of costs of closing by purchaser,
and does find pursuant to 65 ILCS 5/11-76-4.1, that the subject real property being sold is
surplus real property and is entitled to be disposed of pursuant to that Statutory procedure by
THE UNITED CITY OF THE VILLAGE OF YORKVILLE: and does hereby authorize the
Mayor and City Clerk to execute a Warranty Deed transferring ownership to purchaser upon
payment of the sum due for the real property as described in the attached Exhibit "A" hereto
incorporated herein by reference.
It is further agreed that as a condition of said sale, that the proceeds received by the City
shall be used for the maintenance or improvement of the Van Emmon Ball Diamonds/Park.
