RESOLUTION NO. 1995-
RESOLUTION ACCEPTING DEDICATION OF CERTAIN
PUBLIC IMPROVEMENTS FOR BLACKBERRY NORTH SUBDIVISION
WHEREAS, the Final Plat of Subdivision for BLACKBERRY NORTH SUBDIVISION
has been filed with THE UNITED CITY OF THE VILLAGE OF YORKVILLE and approved
by the City Council; and
WHEREAS, engineering drawings have been reviewed by City Staff and approved by the
City, and construction has been commenced on all public improvements on the subject real
property located within BLACKBERRY NORTH SUBDIVISION; and
WHEREAS, a written request has been made by the Owners and Developers of
BLACKBERRY NORTH SUBDIVISION for acceptance of certain improvements that are
completed, and for a reservation by the City of approval of acceptance of certain improvements
that are not yet completed; and
WHEREAS, the City has conducted on-site inspections of the improvements being
constructed in said Subdivision:
NOW THEREFORE, THE CITY COUNCIL AND MAYOR OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE upon motion duly made, seconded, and approved by a
majority of those members voting does hereby act as follows:
1. That the water mains and sanitary sewers constructed and tendered for acceptance in
BLACKBERRY NORTH SUBDIVISION are hereby accepted by THE UNITED CITY OF THE
VILLAGE OF YORKVILLE and dedicated as public improvements subject to the completion
of the following am items:
1. That an alternative power source by installed and provided by Developer to the
lift station located on the subject property.
2. That there be a telemetry hook-up of the lift station to the main City Offices at
the City Water Tower to detect power outages in said lift station.
3. Developer shall be responsible to identify the necessity for any emergency
pumping, and be responsible for any emergency pumping until the emergency
power supply is installed.
4. Final adjustments to surface structures.
In all other respects the sanitary sewer and water system installed by Developer are hereby
accepted by the City.
Other Public improvements are currently in the process of construction and acceptance
of the same is not being made hereunder until tender of final completed improvements is made.
