RESOLUTION NO: 1995-
;ESOLUTION AUTHORIZING ACCEPTANCE AND EXECUTION
OF ILLINOIS POLLUTION CONTROL BOARD ORDER
PCB 95-142 ISSUED SEPTEMBER 7, 1995
WHEREAS, THE UNITED CITY OF THE VILLAGE OF YORKVILLE, has in writing
petitioned the Illinois Pollution Control Board, requesting that an extension be granted for
compliance with Federal and State Illinois Environmental Protection Agency Regulations
concerning the regulation of the content of radium in its water supply system; and
WHEREAS, said CITY has demonstrated that it would be a hardship to comply with the
existing deadline, and has supplied necessary proof of said hardship to the Illinois Pollution
Control Board; and
WHEREAS, an Order was issued by the Illinois Pollution Control Board based upon the
filings of THE UNITED CITY OF THE VILLAGE OF YORKVILLE as well as the Illinois
Environmental Protection Agency, and whereas said Order issued on September 7, 1995 grants
a variance to THE UNITED CITY OF THE YORKVILLE upon certain terms and conditions
incorporated in said Order, and
WHEREAS, it is a requirement of said extension granted pursuant to the Order issued by
the Illinois Pollution Control Board in PCB 95-142, issued September 7, 1995 that compliance
be executed in writing by the Mayor and City Clerk of THE UNITED CITY OF THE VILLAGE
OF YORKVILLE within 35 days of the date of service of said Order on THE UNITED CITY
OF THE VILLAGE OF YORKVILLE:
NOW THEREFORE, THE CITY COUNCIL AND MAYOR OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, upon motion duly made, seconded, and approved by a
majority of those members voting due hereby authorize and direct the Mayor and City Clerk of
THE UNITED CITY OF THE VILLAGE OF YORKVILLE to execute acceptance of the Illinois
Pollution Control Board Order 95-142 issued September 7, 1995.
