Resolution 1994-21 STATE OF ILLINOIS ) ss. COUNTY OF KENDALL ) RESOLUTION No. 1994- � A RESOLUTION APPROVING SICK-DAY COMPENSATION WHEREAS, the United City of the Village of Yorkville is currently in the stage of revising its City Employee Manual; and WHEREAS, Robert Fleckinger has indicated to the City his intention to retire from his position as a member of the City Public Works Department; and WHEREAS, both the City and Robert Fleckinger desire to memorialize in writing their agreement as to compensation for sick-days accumulated by said employee during his tenor of employment with the United City of the Village of Yorkville; and WHEREAS, the United City of the Village of Yorkville has determined to enact a policy providing that sick-days shall be refunded on a cash basis upon retirement on a basis of paying one-half of the actual cash value for the total number of sick-days: NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS AS FOLLOWS: 1. Robert Fleckinger shall be compensated in cash in the form of a lump sum payment for the wages of one-half of the total accumulated sick-days he has accumulated during his employment with the United City of the Village of Yorkville. 2. That each party agrees that this is a fair a equitable settlement and is entered into 1 freely and voluntarily by both parties. 3. That said compensation for sick-days together with all accrued benefits available that have been distributed to the employee constitute a full, fair, and final settlement and relinquishment of all rights between each party.
